This book is a collection of secondary essays on America's most important philosophic thinkers—statesmen, judges, writers, educators, and activists—from the colonial period to the present. Each essay is a comprehensive introduction to the thought of a noted American on the fundamental meaning of the American regime.

To deal with the upcoming challenges and complexity of the nursing profession, it is deemed important to reflect on our current organization of care. However, before starting to rethink the organization of nursing care, an overview of important elements concerning nursing care organization, more specifically nursing models, is necessary. The aim of this study was to conduct a mapping review, accompanied by an evidence map to map the existing literature, to map the field of knowledge on a meta‐level and to (...) identify current research gaps concerning nursing models in a hospital setting. Next to nursing models, two other organizational correlates seem to be of importance when looking at the organization of nursing care: nurse staffing and skill mix. Although it seems that in recent research, the theoretical focus on the organization of nursing care has been left behind, the increasingly complex healthcare environment might gain from the use of nursing theory, or in this case, care delivery models. As almost no fundamental studies have been done toward the combination of care delivery models, nurse staffing, and skill mix, those elements should be taken into account to fully capture the organization of nursing care in future research. We provide a new link between deductive and probabilistic reasoning fallacies. Illusory inferences from disjunction are a broad class of deductive fallacies traditionally explained by recourse to a matching procedure that looks for content overlap between premises. In two behavioral experiments, we show that this phenomenon is instead sensitive to real-world causal dependencies and not to exact content overlap. A group of participants rated the strength of the causal dependence between pairs of sentences. This measure is a near perfect predictor (...) of fallacious reasoning by an independent group of participants in illusory inference tasks with the same materials. In light of these results, we argue that all extant accounts of these deductive fallacies require non-trivial adjustments. Crucially, these novel _indirect_ illusory inferences from disjunction bear a structural similarity to seemingly unrelated _probabilistic reasoning_ problems, in particular the conjunction fallacy from the heuristics and biases literature. This structural connection was entirely obscure in previous work on these deductive problems, due to the theoretical and empirical focus on content overlap. We argue that this structural parallelism provides arguments against the need for rich descriptions and individuating information in the conjunction fallacy, and we outline a unified theory of deductive illusory inferences from disjunction and the conjunction fallacy, in terms of Bayesian confirmation theory. Recent changes in access to contraceptive and infertility treatments in the state of Illinois, and across the United States more generally, have heightened class cleavages in access to reproductive health care benefits in the United States. Using data gleaned from government testimonies, public documents, and telephone interviews, the authors found that poor women have broad access to contraceptive coverage but very little access to infertility treatments, while working-and middle-class women have increasingly broad coverage of infertility treatments but spare coverage of (...) contraceptives. These findings suggest that while the extreme measures of the eugenics movement are less frequently in evidence, class differences in access to reproductive services lead to an equally dualistic, albeit unstated, fertility policy in the United States: encouraging births among working- and middle-class families and discouraging births among the poor, particularly those on Medicaid. Leibniz's earliest philosophy and its importance for his mature philosophy have not been examined in detail, particularly in the level of detail that one can achieve by placing Leibniz's philosophy in the context of the sources for two of the most basic concerns of his philosophical career: his metaphysics of individuals and the principle oftheir individuation. In this book I provide for the first time a detailed examination of these two Leibnizian themes and trace its implications for how we should (...) interpret other major Leibnizian themes and for how we should read Leibniz and other philosophers of the sixteenth and later centuries as 'modem' philosophers. Leibniz began his philosophical career more than 300 years ago, a fact that shapes fundamentally my attempt in the pages that follow to come to terms now with the texts that he left us. Leibniz's did not do philosophy in a way wholly congenial to twentieth century philosophical methodologies, especially those that have enjoyed some prominence in recent Anglo-American philosophy. Moreover, as we shall see, Leibniz is not a modem philosopher, when 'modem' is understood to mean making a sharp break with medieval philosophy. Indeed, I shall argue, scholars should discard such terms as 'modem' from historical philosophical scholarship, so that old texts can be allowed to remain old - to stand on their own in and from times now long past. Consideration of a paradox originally discovered by John Buridan provides a springboard for a general solution to paradoxes within the Liar family. The solution rests on a philosophical defence of truth-value-gaps and is consistent (non-dialetheist), avoids ‘revenge’ problems, imports no ad hoc assumptions, is not applicable to only a proper subset of the semantic paradoxes and implies no restriction of the expressive capacities of language.

Despite its prominence in the abortion debate and in public policy, the discourse of 'unborn patient' has not been subjected to critical scrutiny. We provide a critical analysis in three steps. First, we distinguish between the descriptive and normative meanings of 'unborn child.' There is a long history of the descriptive use of 'unborn child.' Second, we argue that the concept of an unborn child has normative content but that this content does not do the work that opponents of abortion (...) want it to do, namely, to establish the independent moral status of fetuses and their rights, the right to life in particular. Third, we argue that the normative content of 'unborn child' should be dependent moral status, not independent moral status. We conclude that the ethical concept of the fetus as a patient should replace the discourse of “unborn child” when that phrase is used normatively. (shrink)

According to Hans Kamp and Frank Vlach, the two-dimensional tense operators “now” and “then” are ineliminable in quantified tense logic. This is often adduced as an argument against tense logic, and in favor of an extensional account that makes use of explicit quantification over times. The aim of this paper is to defend tense logic against this attack. It shows that “now” and “then” are eliminable in quantified tense logic, provided we endow it with enough quantificational structure. The operators might (...) not be redundant in some other systems of tense logic, but this merely indicates a lack of quantificational resources and does not show any deep-seated inability of tense logic to express claims about time. The paper closes with a brief discussion of the modal analogue of this issue, which concerns the role of the actuality operator in quantified modal logic. (shrink)

Wide-ranging essays making up the first major study of Nietzsche and the classical tradition in a quarter of a century. This volume collects a wide-ranging set of essays examining Friedrich Nietzsche's engagement with antiquity in all its aspects. It investigates Nietzsche's reaction and response to the concept of "classicism," with particular reference to his work on Greek culture as a philologist in Basel and later as a philosopher of modernity, and to his reception of German classicism in all his texts. In this article, I focus on two moments of Nathaniel Kleitman's career, specifically that of his Mammoth Cave experiment in the 1930s and his consultation with the United States military in the 1940s–1950s. My interests in bringing these two moments of Kleitman's career together are to examine the role of nature and the social in his understanding of human sleep and the legacies these have engendered for sleep science and medicine in the present; more specifically, I am interested in Kleitman's (...) disallowance of napping in his scientific protocols, which may seem incidental until one apprehends the lack of napping as therapeutic treatment in modern sleep medicine. By forwarding a conception of historiography building on Raymond Williams’ “structures of feeling” and Gilles Deleuze and Felix Guattari's philosophy of immanence, I show how the work of William Dement in the 1970s to found a medicine of sleep and the eclipse of biphasic sleeping patterns as a biological and social possibility is indebted to Kleitman's scientific work. The modification of sleep is also the modification of society itself; and, as Kleitman argued, the harnessing of nature can lead to the finer entrenchments of human nature and society. (shrink)

McCullough (bio)Those of us who work in the field of bioethics tend to think that, because the word “bioethics” is new, so too the field is new in all respects, but we are not the first to do bioethics. John Gregory (1724–1773) did bioethics just as we do it, at least two centuries before (...) we thought to do it (Gregory 1772). He deployed philosophical methods as sophisticated as our own. Indeed, Gregory took up the very best moral philosophy available to thinkers of the Scottish Enlightenment, namely, David Hume’s moral philosophy and its core concept of sympathy. Gregory also responded in a conceptually powerful and clinically applicable way to the problems of his time, just as we do. I want here to outline Gregory’s accomplishment and to identify some aspects of its importance for bioethics in the twenty-first century.Gregory’s “Problem List”Gregory wrote his medical ethics as a response to the then current state of medicine in Britain. We now follow Gregory in our writing of bioethics and clinical ethics in response to the problems of our time. A great deal that we now take for granted did not then exist. 1There was not, as there is now, any uniform pathway into medicine. Nor did there exist universal licensure. The Royal Colleges did attempt to assert, but failed to achieve, monopoly control of medical practice. The concepts of health and disease were themselves contested and therefore competed for their success in the market place. There was a marked oversupply of practitioners who competed fiercely—very fiercely indeed—in the medical market place for their concepts of health and disease, their treatments, and therefore their livelihoods. Patients had their own concepts of health and disease, engaged in “self-physicking” or self-care, and often traded physician’s prescriptions.Medicine exhibited little scientific discipline in its accounts of disease and in determining the efficacy of treatments, a fact that Gregory (1743) laments as a [End Page 329] medical student. There was no marked improvement when he began to give his medical ethics lectures nearly a quarter of a century later. Treatments failed as often, perhaps more often, than they succeeded in benefiting patients. The sick usually sought out the help of a physician after trying self-physicking.Physicians, Gregory taught, could not hope to control human biology, though they could aim to manage its processes well. When nature underresponds to disease the physician should assist her processes; when nature overresponds, the physician should tamp down nature’s responses, to lessen their “violence”—in both cases always attentive to the limits of medicine’s capacities in treating disease.Physicians attended the well-to-do sick at home, and the sick person summoned and dismissed physicians, surgeons, or apothecaries at will. A physician therefore might find himself—no women had yet been admitted to the ranks of university-trained physicians—summoned before, after, or simultaneously with a competitor, with his concepts and diagnosis and treatment put to the acid test. In this setting, there existed only a patient-physician relationship, not a physician-patient relationship.Physicians left off the care of dying patients, a practice that was made a matter of duty by Friederich Hoffmann (1749). One would suffer punishing economic consequences if one had a high mortality rate. Better, then, to label the patient incurable, withdraw, and turn matters over to clergy. Gregory attacks this practice as intellectual fraud and calls for the physician to continue to attend the dying. Indeed, he says, “It is as much the business of a physician to alleviate pain, and to smooth the avenues of death, when unavoidable, as to cure diseases” (Gregory 1772, p. 35). Clinical ethics, like bioethics more generally, until recently has tended to focus on the present and future, with little attention to the history of moral thought about health care that preceded bioethics. As a consequence, clinical ethics and bioethics lack maturity as fields of the humanities. The papers in this year's clinical ethics issue of the Journal put contemporary clinical ethics in critical dialogue with the past, making the former accountable to the latter. The six papers in this issue of (...) the Journal are briefly described, with an emphasis on how they contribute to the maturation of clinical ethics as a field of the humanities. (shrink)

The five papers in the 2008 “Clinical Ethics” number of the journal address the conceptual and empirical foundations of clinical ethics. Three articles take up the concept of professionalism in medicine, exploring its possibilities and implications. The fourth article provides a distinctive, phenomenological account of the “placebo effect,” a vexing topic of surprising durability in the clinical setting. This article focuses on the recent production of sleep as a matter of concern in American society. In it, I draw primarily on fieldwork with sleep researchers and clinicians to understand the means by which ideas about sleep are produced and disseminated, and discuss the rise of sleep medicine since the late 1970s and the ways sleep disabilities have been constructed and mobilized in contemporary allopathic research and practice. The article provides a description of modern sleep medicine practices, and analyses (...) clinical encounters between researchers, clinicians and patients, particularly the ways patient cases are produced and interpreted. I follow these ethnographic observations with textual analysis of the National Sleep Foundation's campaigns to promote sleep awareness, and offer the theoretical concepts of medical abstraction and insistence as a means to understand the production of sleep as a matter of concern, and how it might be made to adhere in particular patients' lives and the practices of clinicians. This article is primarily a defense of the Paradigm Case Argument (PCA). It is secondarily a comment on a recent controversy over the validity of its use in philosophy. I argue that the controversy rests on a misinterpretation. By extending the analysis of the objections (and here I invoke Descartes' famous method of possible doubt) I show that the occurrence of a paradigm and the fact that a concept is normally used to describe that paradigm logically entails not that the (...) paradigm is instantiated, but only that it is correct to apply that concept to that paradigm. In this manner the ontological fallacy is avoided, and further, this enforces the important separation between saying something about the correct application of a concept and saying something about its meaning. Leibniz's work resembles its author. A. Robinet has called it “an intellectual storm.” In its two hundred thousand pages of manuscript (most of it still unpublished) there are philosophical works that have nourished the thoughts of thinkers from generation to generation; mathematical texts of fundamental import (we all know of Leibniz as the founder - or rather co-founder - of infinitesimal calculus, but this triumph ought not to obscure his other contributions; for example, his being a precursor in the field (...) of formal logic and the inventor of analysis situs); treatises on physics that have been relegated to obscurity by Newtonian mechanics but which may be in the process of being given new life because of the problems that the classic paradigm has encountered in the twentieth century; an impressive correspondence (approximately fifteen thousand letters, addressed to more than a thousand corespondents); significant contributions to fields as varied as theology, jurisprudence, history, politics and even technology (Leibniz did not scorn practical problems, and we find, alongside the most abstract of metaphysical systems, notes concerning the problem of Venice's sinking or the production of cognac). Inhabitants of a land that their ancient myths proclaimed to be the creation of divinities, the Japanese have peopled their archipelago with numerous earth gods: giants trees, simple pebbles concealed either in an oratory, a corner of a garden or deep inside a thicket; crossroads stoneposts, steles in the middle of a plot or next to a rice field, tombstones, and rocks that are worshipped on home altars. The imposing presence of these divine proprietors of the provinces and of sites (...) that were once urban settlements, villages, or private residences is still visible in the tall buildings of Tokyo and Osaka. These protean spirits, found on roof tops in the form of stone foxes or redwood porticos, bear witness, even in the heart of the city, to a latent belief: the forces of the earth are still at work in the world, keeping watch over human activities. Although there are very few people left who believe, as the ancients stories tell, that the citizens of Japan are descendants of the gods of the earth and sky, there nevertheless remain many who accept the notion that a single telluric energy inhabits the world of the living, the dead, things, and the gods.
