Kişinin bazı yükümlülükleri uhdesinde barındırması için akıllı olması şarttır. Bu durum hem dinî hem de beşerî sistemlerde aynı şekildedir. Bu bağlamda Kur’an’da aklı kullanmaya vurgu yapan birçok ayet vardır. Her bir ayetin anlatmak istediği aklın nasıl kullanılacağına dair bir hakikat mevcuttur. Bu hakikatin ortaya çıkarılması ise ehil olan kişilerin izahlarıyla mümkün olacaktır. Öte yandan bu ayetlerin bağlamıyla birlikte değerlendirilmesi doğru bir anlamın ortaya çıkmasında önemli bir etkendir. Nitekim aynı ifadeler birçok ayette tekrar edilmesine rağmen her birinde farklı bir konuya temas (...) edilmektedir. Mesele aklî çerçevede Kur’an’ın ele alınmasıyla ilgili olduğu için konuyu dirayet tefsiri ekseninde değerlendirmek daha doğru olacaktır. O nedenle bu çalışmamızda aklî çıkarımlara çok fazla başvurulan Te’vîlâtü’l-Kur’ân ve Tefsîru’l-Menâr isimli iki tefsir bağlamında konunun değerlendirilmesi yapılacaktır. Yaşadıkları zaman dilimi birbirinden çok uzak olmasına rağmen her ki tefsirdeki müelliflerin meseleye bakışları arasında benzerliklerin çok olduğu görülmüştür. O nedenle ayetlerin verdiği mesajların farklı zamanlarda nasıl anlaşıldığı, ne gibi anlayış farklılıklarının oluştuğu, ortak noktaların neler olduğu bu çalışmada ortaya konmaya çalışılacaktır. A comparative study of Tibetan Buddhist logic and Aristotelian logic of argument.

Cảm xúc là yếu tố cơ bản thúc đẩy con người đưa ra quyết định và xử lý thông tin. Sợ hãi là một trong những cảm xúc phổ biến nhất ảnh hưởng đến hành vi của nhà đầu tư cá nhân trên thị trường chứng khoán. Mặc dù nhiều nghiên cứu đã được thực hiện để khám phá tác động của nỗi sợ hãi đối với hiệu quả đầu tư và hành vi giao dịch của nhà đầu tư cá (...) nhân, nhưng vẫn còn rất ít thông tin về các yếu tố ảnh hưởng đến nỗi sợ hãi của nhà đầu tư cá nhân trong thời kỳ thị trường sụt giảm (hoặc những giai đoạn cực kỳ biến động). Vì thế, nghiên cứu này được thực hiện để tìm hiểu liệu các nguồn thông tin ảnh hưởng đến quyết định đầu tư của nhà đầu tư có ảnh hưởng đến sự sợ hãi của họ khi khủng hoảng xảy ra hay không. Nghiên cứu đã sử dụng phương pháp phân tích Bayesian Mindsponge Framework (BMF) trên bộ dữ liệu từ 1526 nhà đầu tư Trung Quốc và Việt Nam. Kết quả nghiên cứu chỉ ra rằng các nhà đầu tư tiếp cận các loại thông tin khác nhau khi đưa ra quyết định đầu tư sẽ ảnh hưởng đến tần suất phản ứng sợ hãi khác nhau. Cụ thể, các nhà đầu tư tham khảo thông tin từ chuyên gia hoặc tự phân tích khi đưa ra quyết định đầu tư ít bị đóng băng (biểu hiện của tâm lý sợ hãi) hơn trong thời kỳ thị trường sụt giảm. Ngược lại, những người đưa ra quyết định đầu tư dựa trên thông tin từ người quen hay bạn bè và trực giác sẽ bị đóng băng thường xuyên hơn. Kết quả nghiên cứu này giúp gợi ý nhà đầu tư cá nhân nên trang bị cho mình các kiến thức về tài chính cũng như tham khảo các ý kiến chuyên gia trên thị trường, hoặc những nguồn thông tin đáng tin cậy, khi đưa ra quyết định đầu tư. Bên cạnh đó, cơ quan quản lý thị trường cần có hoạt động phổ cập kiến thức về thị trường chứng khoán, hạn chế ảnh hưởng của các kênh thông tin không chính thống, và khuyến khích nhà đầu tư ít kinh nghiệm mua chứng chỉ quỹ của các quỹ đầu tư. Zájem současné sociologie a dalších společenských věd o výzkumy spokojenosti a štěstí zatemňuje skutečnost, že původně právě sociologie chtěla „štěstí" poskytovat a nahrazovat tak náboženské přístupy ke světu. Tento implicitně nábo- ženský charakter je patrný i v rané české sociologii v dílech prvních propagátorů sociologie, jako byl především Emanuel Makovička, a později u některých následovníků a epigonů T. G. Masaryka, v meziválečném období zejména u Ladislava Kunteho, R. I. Malého, Alexandra Sommera-Batěka, Jindřicha Fleischnera a Jana Duška. Z hlediska vývoje české (...) sociologie šlo o zcela okrajové postavy, ačkoli mnohé z nich vynikly v jiných oblastech, jako celek jsou nicméně vyjádřením jednoho z aspektů dobových teoretických úvah o společnosti, jejím uspořádání a vývoji, na který by nemělo být zapomínáno. Zatímco T. G. Masaryka a pozdější akademické sociology „omezoval" vědecký charakter jejich práce, a i pokud směřovali k sociálnímu reformismu, oddělovali jej od teoretické sociologie, „sociologie vedoucí ke štěstí" nalezla plné uplatnění ve vizích a ambiciózních projek- tech těchto amatérských takésociologů - třebaže skončily faktickými nezdary nebo ani nedošly praktického naplnění, ostatně stejně jako v případě jejich pravzoru, Comtova pozitivistického apoštolátu. The history of the idea of biological progress shows that it is not a selfexplanatory category, so a clear definition is required. Biological progress exists if: “more progressive” is defined as “more complex” – in that case evolution is synonymous with progress, i.e. development from simple to complex, from homogeneous to heterogeneous; we perceive the expression “more progressive” as more successful in relation to the environment, in these terms some groups in the history of life were more progressive because/so that (...) they survived, while others were retrogressive or less progressive because/so that they died out; on the other hand, within their ecological niches, certain forms of life are perfectly adapted to their environment as long as it is stable ; we take the span or reach of a potential adaptation of populations as a measure . However, there is no active, innovative problem solving in relation to the environment either with plants or animals – only the variability mechanism / selection is in place, automatism, instinct. In the light of the above-mentioned biological criteria, man is the most complex living creature by his constitution , he is the least dependent on the environment and can be innovative in relation to the environment. Man is the only living creature capable of establishing an active relationship with the environment through his special tool – culture. Considering the level of organization and quantity of information, the mammal genome is more progressive than the bacterium genome, while the human genome comprises most information which makes man the most progressive living thing. We can talk about biological progress if we define progressiveness as advancement toward complexity of organisation, but sometimes thesimplification of structure enables survival. It seems that we can talk about progressivenessin biology only if we accept the anthropic principle – that is why only cultural progress is possible. Information is the link between biological and cultural-anthropological successfulness . Biological information is a “complete” piece of information to an animal . To a human being, it is only a condicio sine qua non for the reality of human spirit which receives, keeps and generates information. Progress can be measured according to the capability ofestablishing an active and innovative relationship with the environment, but only within some sort of anthropocentric outlook which is a criterion of value. It is not possible to talk about progressiveness of life if man is not the measure of all things.Povijest ideje biološkog napretka pokazuje kako to nije samorazumljiva kategorija, pa se traži jasna definicija. Biološki progres postoji ukoliko: “naprednije” definiramo kao “složenije” – evolucija je tada sinonim napretka, tj. prelaženja iz jednostavnijeg u složenije, iz homogenog u heterogeno; “naprednije” shvatimo kao “uspješnije” s obzirom na okoliš; u tom smislu neke skupine u povijesti života bile su naprednije jer/pa su opstale, dok su druge bile nazadnije ili manje napredne pa/jer su izumrle; s druge strane unutar svojih ekoloških niša pojedini oblici života savršeno su prilagođeni svojem okolišu dokle god je on stabilan ; kao mjerilo uzmemo raspon ili širinu moguće prilagodbe populacija jer tada postoje razlike; ipak ni u biljaka ni u životinja tu nema aktivnog inovatorskog rješavanja problema okoliša, nego djeluje samo mehanizam varijabilnost/selekcija, automatizam, nagon. U svjetlu gore navedenih bioloških mjerila čovjek je svojim ustrojstvom najsloženije biće , najmanje je ovisan u odnosu na okolinu, može se novativno nositi spram okoline. Čovjek je jedini kadar za pravi aktivni odnos prema svom okolišu putem specifičnog oruđa kulture. S obzirom na stupanj organizacije i količinu informacija, genom sisavca je napredniji od genoma bakterije, a genom čovjeka raspolažes najviše informacija, pa je on po tome najprogresivnije biće u prirodi. O biološkom progresu možemo govoriti ako progresivnost definiramo kao porast složenosti organizacije, no ponekad pojednostavljenje građe omogućava preživljavanje. Čini se da o progresivnosti u biologiji možemo govoriti samo usvajajući princip antropičnosti, zato je u svijetu moguć samo kulturni progres. Posjedovanje informacije je veza između biološke i kulturno-antropološke uspješnosti . Posjedovanje biologijske informacije za životinju je “potpuna informacija” , dok je za Čovjeka samo condicio sine qua non za zbiljnost ljudskog duha koji dobiva, posjeduje i stvara informaciju. Progres je moguće mjeriti prema sposobnosti aktivnog i inovativnog odnosa spram okoliša jedino u nekoj vrsti antropocentričnog obzora koji u središtu ima mjerilo vrijednosti. Nemoguće je govoriti o progresivnosti života ako svemu nije mjera sam čovjek. (shrink)

The main purpose of this work is to provide a semiotic ontology for redescription of active cognitive externalism, recently developed by the paradigm 4E (embodied, embedded, enactive, extended cognition). In our approach, distributed cognitive systems (DCSs) are described as semiosis, signs in action. We explored the relationship between semiosis and cognition, as conceived by C. S. Peirce, in association with the notion of distributed cognitive system (DCS). We introduce Peircean externalist approach with an emphasis on the notion of temporal distribution (...) of semiosis, and describe DCSs, and their elements, as “sign in action”. To develop this argument, we describe an example of DCS -- verbal-musical improvisation of repente, repentismo, or viola singing. It is a phenomenon of verbal-musical improvisation that takes the form of a challenge in versified oral poetry. We describe the phenomenon as the embodiment of the formal structure of a cognitive task and an inferential process. This embodiment corresponds to a semiotization of the repente performances as DCSs. The temporally distributed tendency of repentismo organizes the DCS as a system that performs metasemiotic experiments on the action of signs. (shrink)

For some time, the role of culture in language education within schools, universities and professional communication has received increasing attention. This article identifies two aporias in the discourse of intercultural communication : first, that it contains an unstated movement towards a universal consciousness; second, that its claims to truth are grounded in an implicit appeal to a transcendental moral signified.These features constitute IC discourse as ‘totality’, or as ‘metaphysics of presence’.The article draws on the work of Levinas ; and Derrida (...) to propose more considered ethical grounds for intercultural praxis. Contra a Hegelian impetus towards universal consciousness,we posit an irreducible distance and separation between the self and other. In so doing, not only are we able to supersede the field’s implicit appeal to the transcendental as a source of truth but also to counter perceptibly ‘exorbitant’ claims and actions of the intercultural other. In this vein, the article proposes a discourse ethics of responsibility by which it still becomes possible for a critical intercultural praxis to make value judgements and to take potentially transformative action vis-à-vis cultural acts that challenge the limits of intercultural tolerance and hospitality. Celem tego artykułu jest analiza powiązań jakie zachodzą pomiędzy fenomenami metodyczności i etyczności we wczesnej filozofii Martina Heideggera. Nie pojmuje się tu ani metody jako procedury badawczej prowadzącej do określonych rezultatów, ani etyki jako odrębnej dyscypliny filozoficznej posiadająca własne pole przedmiotowe. Chodzi o dwa wymiary bycia, które wzajemnie się implikują. Na początku badana jest fenomenologia jako sposób pytania o bycie, a następnie zostaje wydobyty metodyczny sens postępowania, które Heidegger określa mianem formalnego wskazywania. W rezultacie metodyczność zostaje odsłonięta jako droga prowadząca (...) do bycia jako źródła sensu, droga, którą zapewnia samo to bycie. W dalszej kolejności analizowany jest fenomen filozofowania, który Heidegger interpretuje jako wyraźne transcendowanie. Transcendowanie to ostatecznie okazuje się wolnością, której fundamentalny charakter stanowi pozwolić-być, kładące jednocześnie fundament pod odpowiedzialność. Odpowiedzialność zaś jest odpowiedzią udzielaną na wezwanie bycia i przyjmuje postać (zobo)wiązania Dasein wobec bytu, któremu pozwoliło ono być. Etyczność odsłania się tym samym jako domaganie się takiej odpowiedzi na wezwanie bycia, która sprosta ciężarowi jego przesłania. W tym miejscu na jaw wychodzi spotkanie etyczności z metodycznością – ta ostatnia jest drogą do otwartości bycia zapewnioną przez samą tę otwartość, by postulat etyczności mógł zostać spełniony. Oznacza to, że etyczność domaga się metodyczności, a metodyczność (a wraz z nią filozofowanie) niesie ze sobą konsekwencje etyczne dla rozumienia bycia i bytu. BackgroundThis paper represents a portion of the findings from one of the first research studies eliciting the lived experience of adults with an early diagnosis of Phenylketonuria living in Ireland. Ireland has one of the highest prevalence rates of PKU in Europe, however, little is known about the experience of Irish adults with PKU. Furthermore, Ireland is one of the first countries in the world to introduce neonatal screening followed by the introduction of long-term dietary therapy over 50 years ago. (...) This study presents the first comprehensive assessment of the lived experience of Irish adults with PKU on long term dietary therapy.MethodsNarrative data was collected from eleven self-selected participants, using semi-structured interviews. The interviews were divided into five sections focused on eliciting a holistic understanding of the lived experience of adults with PKU living in Ireland. Thematic analysis was guided by Colaizzi's Framework in conjunction with NVivo qualitative data analysis software.FindingsFindings from the original research encompassed a broad understanding of the lived experience of adults with PKU living in Ireland, including factors influencing dietary therapy and managing PHE blood levels. The themes being discussed within this article are those which appear to be least represented within current literature: living with PKU, including reproductive health, the importance of self-management and establishing routine, support networks in adulthood and concerns regarding aging with PKU.ConclusionIt was evident from the findings that a diagnosis of PKU can influence how adults with PKU may experience aging and their own mortality. These findings offer new insight into the vulnerability attached to the experience of aging with PKU and may be beneficial to advocacy groups and for future development of policy and practice. The Indigenous Māori of Aotearoa New Zealand have a knowledge system embedded with understandings related to consciousness, soul, and spirit. Although the effects of colonization are vast and ongoing, these knowledges have not been completely lost, and endure as an essential part of Māori comprehensions about the nature of everyday life and reality. We provide an overview of the socio-historical context of Māori, before briefly summarizing Māori cosmogony. We then discuss some of the more popularized ways the constructs of consciousness, (...) soul, and spirit are interpreted from an Indigenous Māori perspective, while importantly highlighting that there are no single words in the Māori language that readily translate to these concepts, making the task of elucidating what the terms mean for Māori somewhat complex. The concept of Amīr al-Umarā was used for the first time during the re-ign of Caliph Umar. This term, which was used to mean "commander-in-chief" at that time, denoted a higher rank during the Abbasid period. This institution was used during the Abbasid period to express a title between vizierate and caliphate. However, Amīr al-Umarā had much more authority than the viziers. During the establishment of this institution, the position of vizier continued to exist, but the vizier no longer had (...) any authority. The Caliph transferred almost all his authority and responsibility to Amīr al-Umarā. The reason for the emergence of this institution, equipped with enormous powers, was to restore the political and economic stability that had been lost throughout the country. Founded by Caliph Rāzī (d. 329/940) in the mid-tenth century, this institution continued its existence for about ten years. Charismatic leaders of the period such as Ibn Rāik (d. 330/942), Bajkam (d. 329/941) and Tuzun (ö. 333/945) were appointed with the authority of Amīr al-Umarā. In this study, an answer was sought to the question of whether this institution, which was established to end the bad situation in the country, could provide the expected function. How did Amīr al-Umarā, equipped with extraordinary powers, contribute to political and economic stability? As a result of the research, it was seen that amīrs who were assigned with high expectations could not show the success expected from them. Resumo: A máxima de Píndaro “torna-te o que tu és” representou por muito tempo o mote da formação humana, pautada historicamente por diversos humanismos, até ser ressignificada em um perspectiva pós-humanista por Nietzsche, que a retoma no subtítulo de sua obra autobiográfica Ecce Homo. Coube a Foucault, no entanto, apresentar uma versão transformada da velha máxima. “Tornarmo-nos o que nunca fomos” é a reivindicação de um cuidado de si liberto dos pressupostos metafísicos e ideológicos dos muitos humanismos que almejam impor (...) tipos humanos universais. O objetivo deste artigo é recuperar as linhas gerais desse movimento histórico-filosófico em dois momentos: primeiro, na transformação do sentido originário da máxima de Píndaro no uso que Nietzsche faz dela; depois, na crítica ao humanismo que segue com Heidegger e desemboca em Foucault. Argumenta-se que a versão foucaultiana da máxima de Píndaro, “torna-te o que nunca fostes”, pode ser assumida como um lema da formação pós-humanista. It was up to Foucault, however, to present a transformed version of the old maxim. “We have become what we have never been” is the demand for self-care freed from the metaphysical and ideological assumptions of the many humanisms that aim to impose universal human types. The aim of this article is to recover the general guidelines of this historical-philosophical movement in two moments: first, in the transformation of the original meaning of Pindar’s maxim in the use that Nietzsche makes of it; then, in the critique of humanism that follows with Heidegger and ends in Foucault. It is argued that the Foucauldian version of Pindar’s maxim, “become what you have never been”, may be assumed as a motto of post-humanist education. Este artigo visa analisar as implicações existenciais de uma das sentenças principais das Confissões, a saber, “Tu excitas para que se regozije o louvar te, porque nos fizeste para ti e nosso coração está inquieto enquanto não repousar em ti” (I, i, 1). Para esta finalidade, exploramos o pensamento do autor não apenas nesta obra supramencionada, mas também a partir de algumas que a precederam e que nutrem as colocações feitas neste escrito posterior. A tese básica com a qual o (...) autor trabalha é a de que as inquietações existenciais são inerentes ao homem e significam uma demanda por Deus. Além de destacar o significado psicológico da sentença, esclarecemos a equivocada interpretação de que tal condição implicaria nalguma maldição inerente ao homem, afastando a perspectiva pessimista que pode surgir a partir desta leitura. Con người không còn nhiều thời gian để sửa chữa, phục hồi đưa hệ sinh thái môi trường (tự nhiên) trở về trạng thái an toàn. Trong khi các nỗ lực trong thời gian qua chưa thực sự hiệu quả thì COP26 mở ra cơ hội lớn để nhân loại tiến gần đến mục tiêu kiềm (...) chế nhiệt độ của trái đất không vượt quá 1.5 độ C. Mặc dù Việt Nam cùng với 146 quốc gia trên thế giới đã có cam kết mạnh mẽ nhất trong việc giảm phát thải vào năm 2050, tuy nhiên việc cụ thể hóa cam kết thông qua các giải pháp sáng tạo là rất quan trọng. Sử dụng (áp dụng, vận dụng) hệ sáng tạo 3D và nguyên lý bán dẫn giá trị, tác giả đề xuất hệ sinh thái “giải pháp trụ cột” cần thực hiện gồm có tăng cường thông tin, truyền thông, nghiên cứu khoa học về môi trường (biến đổi khí hậu, ô nhiễm môi trường...); xây dựng, chuyển đổi và nâng cao văn hóa và môi trường; đẩy mạnh phát triển kinh tế gia tăng phúc lợi; xây dựng (chuyển đổi) lớp doanh nhân có văn hóa, trách nhiệm môi trường; tăng cường mở rộng sự hợp tác quốc tế về mọi mặt đặc biệt là trong lĩnh vực kinh tế, truyền thông và khoa học; và thực thi các giải pháp nêu trên một cách kỷ luật. Most documented extinctions of vertebrates in the last 400 years have been island endemics. In this paper, we focus on the need to develop a historical framework to establish conservation priorities for insular faunas and, in particular, to test the validity of nominal endemics. We use the example of the islands of the North Pacific Coast of North America, a region that includes approximately one-half of all mammals endemic to North American islands north of Mexico. Few of these endemics have (...) been re-evaluated since their original descriptions, although many of these islands have been heavily impacted by habitat conversion, species introductions, over-exploitation, and secondary ripple effects. Evidence from molecular genetics and paleontology suggests that many taxa arrived in the region since the last glacial advance. Some of these nominal endemics show minimal differentiation, while others comprise multiple evolutionary lineages. The NPC may also have played an important role in the in situ diversification of some taxa during the Pleistocene. Evidence, such as new fossil discoveries and numerous described endemics, lends support for refugia hypotheses. However, these ideas cannot be tested until a better understanding of geographic variation and the evolutionary relationships of the fauna and flora of the North Pacific Coast is developed. This framework would provide significant insight into the dynamic biogeographic history of the region and help prioritize conservation efforts. (shrink)

BackgroundUse of modified texture diets—thickening of liquids and modifying the texture of foods—in the hope of preventing aspiration, pneumonia and choking, has become central to the current management of dysphagia. The effectiveness of this intervention has been questioned. We examine requirements for a valid informed consent process for this approach and whether the need for informed consent for this treatment is always understood or applied by practitioners.Main textValid informed consent requires provision of accurate and balanced information, and that agreement is (...) given freely by someone who knows they have a choice. Current evidence, including surveys of practitioners and patients in different settings, suggests that practice in this area is often inadequate. This may be due to patients’ communication difficulties but also poor communication—and no real attempt to obtain consent—by practitioners before people are ‘put on’ modified texture diets. Even where discussion occurs, recommendations may be influenced by professional misconceptions about the efficacy of this treatment, which in turn may poison the well for the informed consent process. Patients cannot make appropriate decisions for themselves if the information provided is flawed and unbalanced. The voluntariness of patients’ decisions is also questionable if they are told ‘you must’, when ‘you might consider’ is more appropriate. Where the decision-making capacity of patients is in question, inappropriate judgements and recommendations may be made by substitute decision makers and courts unless based on accurate information.ConclusionResearch is required to examine the informed consent processes in different settings, but there is ample reason to suggest that current practice in this area is suboptimal. Staff need to reflect on their current practice regarding use of modified texture diets with an awareness of the current evidence and through the ‘lens’ of informed consent. Education is required for staff to clarify the importance of, and requirements for, valid informed consent and for decision making that reflects people’s preferences and values. (shrink)

Neste Ano Internacional da Biodiversidade, reflito sobre as responsabilidades crescentes das entidades religiosas no contexto atual da Crise Ambiental. Faço uma retrospectiva sobre a origem evolutiva das religiões no contexto da evolução cultural do homem. Em seguida, menciono algumas dimensões ecológicas do pensamento religioso, significativas para os problemas ambientais. Paradigmas religiosos se originam de forma semelhante aos das ciências. As doutrinas sociais das igrejas, especialmente a igreja católica, estabelecem compromissos com os excluídos e promovem o desenvolvimento integral da pessoa humana, (...) buscando justiça social e econômica. Isto tem implicações para o equilíbrio ecológico e para o futuro da humanidade. Sugiro que as igrejas atuem mais intensamente, de forma integrada com a ciência, na intermediação política em prol da solução dos problemas ambientais. A moral religiosa ajudaria a reverter os ganhos econômicos advindos da utilização sustentável da biodiversidade genética para as culturas locais. Também antevejo um papel maior na conscientização das comunidades sobre os benefícios de uma vida equilibrada com a natureza e de uma exploração racional dos recursos naturais. A preservação da biodiversidade constitui uma questão moral de cuja conscientização e regulamentação legal urgentíssima dependemos para a sobrevivência dos ecossistemas naturais e da própria espécie humana. Palavras-chave: Evolução Cultural; Religião; Crise da Biodiversidade; Política Ambiental; Papel da Igreja.In this International Year for the Conservation of Biodiversity, I reflect on the increasing responsibilities of religious entities towards solving the present Environmental Crisis. I provide a retrospect on the debate over the origin of religions in the context of the cultural evolution of man. I then mention some ecological dimensions of religious thinking, which are particularly significant for approaching environmental problems. Religious paradigms originate in ways that are similar to those in science. The social doctrines of churches establish compromises for excluded groups and promote the unabridged development of the human individual, which includes social and economic justice. This has implications for the ecological balance of nature and for the future of humanity. I suggest that the Church should act more intensely, integrated with science, in the political intermediation that searches for solutions for our environmental problems. Religious morality could help to restore the economical benefits resulting from the sustainable use of genetic biodiversity to local cultures. I also foresee a larger role of the church in promoting human perceptions regarding the benefits involved in obtaining a more sustainable relationship with nature and in promoting a more rational exploitation of natural resources. The conservation of biodiversity represents a moral matter demanding urgent legislation for the survival of natural ecosystems and, ultimately, of the human species. Os nomes dos que chegaram a apreciar Nietzsche formam uma galeria heterogênea; Mahler, Thomas Mann, Hitler, Adorno, Foucault, Mussolini. A América do Sul, onde Nietzsche é descoberto cada vez mais, tem a chance de tirar proveito à luz de um contexto cultural bem diferente e abrir perspectivas nunca percebidas.

Os requisitos formais do ideal de Estado de direito respondem por alguns dos princípios mais caros ao liberalismo, a saber: a igualdade perante o direito, a segurança no usufruto dos direitos individuais e a previsibilidade na aplicação de sanções. A instituição do Estado no pensamento de Locke se dá exatamente em busca desses fins. Na linha de sua teoria política, o presente artigo pretende mostrar a necessidade da constituição de uma autoridade pública para que os requisitos formais do ideal de (...) Estado de direito possam ser cumpridos, bem como argumentar que a concepção libertária de Estado mínimo apresentada por Nozick é incapaz de satisfazê-los. (shrink)

Em recente artigo, o ministro do STF Luís Roberto Barroso defendeu o exercício de um papel representativo pelo Poder Judiciário, como forma de dar voz a uma vontade da maioria não captada pelas regras de direito positivo devido às distorções dos mecanismos institucionais fundados no voto. O presente trabalho tem como objetivo investigar se essa reivindicação é compatível com a noção de Estado Democrático de Direito levando em consideração tanto a possibilidade de se aferir a vontade empírica da maioria à (...) parte dos mecanismos institucionais fundados no voto quanto a função do Judiciário nesse tipo de sociedade. Por fim, sugere a possibilidade de reconhecer um papel representativo ao Judiciário fundado naquilo que se pode argumentar ser o interesse dos cidadãos de um Estado Democrático de Direito enquanto tais. Há um discurso teórico que denuncia a igualdade formal presente no ideal de Estado de Direito como um manto ideológico a serviço do conservadorismo. Por debaixo desse manto, as profundas desigualdades sociais e relações de opressão seriam legitimadas como se fossem simplesmente fruto da aplicação imparcial das regras jurídicas a que todos estariam igualmente submetidos. Embora essa crítica sirva quando direcionada ao modelo de Estado de Direito defendido por Hayek, que apresenta falsamente as regras oriundas dos costumes e dos precedentes (...) como isentas de posições políticas, ela não atinge da mesma maneira o modelo de Estado de Direito centrado na supremacia da legislação. Apesar de todas as limitações que podem ser reconhecidas no ideal de igualdade formal, a sua recusa parece antes permitir novas e mais graves formas de opressão do que as suprimir. (shrink)

Jan-Heiner Tück presents a work that explores the sacramental theology, lived spirituality, and Eucharistic poetry of the Church’s doctor communis, St. Thomas Aquinas. Although Aquinas’ Eucharistic poetry has long occupied an important place in the Church’s liturgical prayer and her repertoire of sacred music, the depth of these poems remains hidden until one grasps the rich sacramental theology underlying it. Consequently, Tück first offers a detailed but approachable primer of Aquinas’ theology of the sacraments, before diving deeply into the Angelic (...) Doctor’s theology and poetry of the Eucharist. The Scriptural accounts stand at the heart of the systematic framework developed by Aquinas, and thus significant attention is devoted to showing the harmony between the accounts of Christ’s passion and the detailed exposition of the Summa theologiae. Moreover, the Eucharistic controversies of the ninth and eleventh centuries provide the contrapuntal context in which Aquinas did his thinking, praying, and writing. Not surprisingly, therefore, the response he crafts to these controversies draws upon both speculative powers and contemplative prayer, brought together in the unity of Aquinas’ theology and spirituality. The net result is a twofold treasure for the Church: a careful systematic presentation of Eucharistic theology and the lived devotional expression of the same in the carefully constructed—and now much beloved—stanzas of Pange lingua gloriosi, Lauda Sion, Adoro te devote, etc. By revealing the lively interplay of the saint’s powerful speculative intellect and a heart steeped in love for the Eucharistic Lord, Tück offers a sophisticated exposition of Aquinas’ Eucharistic poetry and the roots it sinks into a wider theological framework. Finally, the contemporary significance and power of Aquinas’ work is drawn out, not only in the rarefied realm of intellectual inquiry but also in the everyday expanse of ordinary life. (shrink)

As questões de justiça não dizem respeito apenas à determinação dos critérios de igualdade que devem orientar as regras jurídicas, mas também afetam a própria legitimidade da escolha desses critérios. Em virtude das experiências trágicas vividas no século XX e da impossibilidade de estabelecer um mecanismo perfeito de escolha social, o debate recente sobre os critérios justos de igualdade deve ser contextualizado em uma discussão mais ampla que envolva também questões atinentes à legitimidade política e à estabilidade dos regimes democráticos (...) apesar do forte desacordo ocasionado pelo pluralismo. O presente trabalho tem como objetivo comparar as teorias políticas de Ronald Dworkin, Amartya Sen e John Rawls quanto ao modo como se posicionam frente ao desacordo político com respeito a quais seriam os critérios justos de igualdade a serem incorporados na legislação. Ao constatar funções distintas à teoria política conferidas pela abordagem de cada autor, busca-se verificar se essas são entre si incompatíveis ou complementares. Palvras-chave: Teoria política. Peter Abelard (1079–1142 ce) was the most wide‐ranging philosopher of the twelfth century. He quickly established himself as a leading teacher of logic in and near Paris shortly after 1100. After his affair with Heloise, and his subsequent castration, Abelard became a monk, but he returned to teaching in the Paris schools until 1140, when his work was condemned by a Church Council at Sens. His logical writings were based around discussion of the “Old Logic”: Porphyry's Isagoge, aristotle'S Categories and (...) On Interpretation and boethius'S textbook on topical inference. They comprise a freestanding Dialectica (“Logic”; probably c.1116), a set of commentaries (known as the Logica [Ingredientibus], c. 1119) and a later (c. 1125) commentary on the Isagoge (Logica Nostrorum Petititoni Sociorum or Glossulae). In a work Abelard called his Theologia, issued in three main versions (between 1120 and c.1134), he attempted a logical analysis of trinitarian relations and explored the philosophical problems surrounding God's claims to omnipotence and omniscience. The Collationes (“Debates,” also known as “Dialogue between a Christian, a Philosopher and a Jew”; probably c.1130) present a rational investigation into the nature of the highest good, in which the Christian and the Philosopher (who seems to be modeled on a philosopher of pagan antiquity) are remarkably in agreement. The unfinished Scito teipsum (“Know thyself,” also known as the “Ethics”; c.1138) analyses moral action. (shrink)

What is the future of Philosophy of education? Or as many of scholars and thinkers in this final ‘future-focused’ collective piece from the philosophy of education in a new key Series put it, what are the futures—plural and multiple—of the intersections of ‘philosophy’ and ‘education?’ What is ‘Philosophy’; and what is ‘Education’, and what role may ‘enquiry’ play? Is the future of education and philosophy embracing—or at least taking seriously—and thinking with Indigenous ethicoontoepistemologies? And, perhaps most importantly, what is that (...) ‘Future’? These debates have been located in the work of diverse scholars: from the West, from Global South, from indigenous thinkers. In this collective piece, we purposefully juxtapose diverse takes on the future of these intersections. We have given up the urge to organise, place together, separate with subheadings or connect the paragraphs that follow. Instead, we let these philosophers of education and thinkers who use philosophical texts and ideas to sit together in one long read as potentially ‘strange and unusual bedfellows’. This text urges us to understand how these scholars and thinkers perceive our educational philosophical futures, and how the work and thinking they have done on thinking about what the future of that new key in philosophy of education may look like is embedded in a much deeper and richer literature, and personal experience. O direito público contemporâneo é pensado a partir do tratamento impessoal dos cidadãos por autoridades e funcionários que agem dentro da moldura jurídica que delimita sua competência e orienta a sua ação ao interesse público. Se a soberania for compreendida a partir do instituto da propriedade (dominium), a relação entre o Estado e o cidadão acaba por espelhar a forma da relação entre senhor e escravo, em que os súditos se encontram submetidos à vontade privada do soberano. Uma tal modalidade (...) patrimonial de Estado mostra-se incompatível com a caracterização do direito público moderno. Neste artigo, identificamos na obra de Jean Bodin o contraste entre, de um lado, o caráter público do exercício da soberania nos regimes legítimos e, de outro, a natureza patrimonial dos regimes despótico e tirânico. No pensamento de Thomas Hobbes, observamos a evolução de uma concepção meramente patrimonial da soberania presente em Elements of law e De cive para uma distinção formal entre a vontade privada e a vontade pública do soberano no Leviathan. Nossa conclusão é que ambos os autores acabam por fornecer, cada um à sua maneira, um aparato conceitual apto para lidar com as características do Estado moderno acima apontadas, cuja repercussão pode ser notada na Filosofia Política dos séculos subsequentes.
