Friedrich Adolf Trendelenburg war einer der akademischen Lehrer Hermann Cohens und die Debatte zwischen Trendelenburg und Kuno Fischer über die Interpretation der transzendentalen Ästhetik gilt gemeinhin als Anlass für Cohens Kantstudien und seine Abwendung von der Völkerpsychologie und damit als Geburtsstunde des Marburger Neukantianismus. Über die nähere persönliche Beziehung Cohens zu Trendelenburg ist allerdings wenig bekannt und auch die Frage, ob und inwiefern Cohen als „Schüler“ Trendelenburgs bezeichnet werden kann ist nicht eindeutig zu beantworten, zumindest scheint Cohens Verhältnis zu Trendelenburg (...) eher distanziert gewesen zu sein und es ist nicht klar, ob nicht Cohens Trendelenburg gegenüber teilweise auch kritische Haltung in seiner Stellungnahme zur Kontroverse zwischen Trendelenburg und Fischer auch zum Scheitern seiner Habilitationsversuche in Berlin beigetragen hat. Andererseits wurde darauf hingewiesen, dass sich Cohen durch die von Trendelenburg aufgeworfene Frage, ob Kant die ausschließliche Subjektivität von Raum und Zeit bewiesen habe, vor das für seine Philosophie und Kantkritik zentrale Problem einer nicht bloß „subjektiven“ Begründung des Idealismus gestellt sah und diesbezüglich (in Abgrenzung von Kuno Fischer und Friedrich Albert Lange) im wesentlichen Trendelenburgs Absicht, „das Ideale im Realen zu befestigen“, weiterverfolgte (Klaus Christian Köhnke). Kurt Walter Zeidler hat diese These vor kurzem insofern zugespitzt, als er zu dem Schluss kommt, dass Cohen „seine eigene systematische Position – und damit die Grunddoktrin der Marburger Schule – an dem Leitfaden einer Kantinterpretation entwickelt, die Trendelenburgs latenten Platonismus, seine Lehre von der ursprünglichen Tätigkeit und konstruktiven Bewegung sowie den wissenschaftstheoretischen Ansatz seiner Logischen Untersuchungen gleichsam als Hebel einsetzt, um Kants Lehre von allen Anmutungen eines empirischen oder subjektiven Idealismus zu befreien.“ Diese These wird mit Blick auf Cohens frühe Kant- und Platon-Interpretation überprüft und der historische und biographische Kontext von Cohens Berliner Studienzeit skizziert. Le travail de Kurt Walter Zeidler n’est pas connu en France, mais il représente aujourd’hui la tentative la plus ambitieuse et la plus aboutie pour interpréter la philosophie critique à partir de son double héritage, postkantien et néokantien. Comme l’indiquent ici un grand nombre de ses collègues et de ses disciples, son œuvre très fournie part du constat que l’idéalisme transcendantal n’est pas vraiment parvenu à fonder la synthèse de la raison et de la réalité et à résorber le divorce (...) que le nominalisme a introduit entre le logos et le monde quand il a érigé le sujet en instance jugeante détachée de tout (p. 18, 574). Kant a fait le premier pas pour émanciper la logique du primat de la forme judicative (p. 67). Mais ni son contextualisme temporel, qui rapporte tout ce qui est su à la forme du temps (p. 345), ni les efforts de son continuateur Cohen pour fonder l’idéalisme critique sur un dépassement du psychologisme n’ont réussi à réconcilier la raison avec la réalité ou à rétablir son unité (p. 205). Kurt Walter Zeidler darf als einer (...) jener selten gewordenen Denker gelten, die in unermüdlichem Reflexionseinsatz seit Jahrzehnten sich für die seit längerem in Gefahr geratene klassische Philosophie auf einem ihrer Hochplateaus, der Transzendentalphilosophie, genauer noch: deren postneukantianischer Erscheinungsform einsetzen, dies im lebendigen Wechselgespräch mit einer Reihe von Meisterdenkern von Platon und Aristoteles an über Leibniz, die neuzeitliche Aufklärung hin zu Kant, dann über Fichte, Hegel, Schelling zu ausgewählten Neukantianern sowie z. T. auch polemisch zu den ‚Modernen‘ und dem neo-nominalistischen Zeitgeist weithin. – Die Position Zeidlers dem allen gegenüber ist im Grunde sehr einfach zu kennzeichnen: Es ist ein Denken einer ihre eigene Geschichte in ihren ‚großen‘ Gestalten einbeziehenden Vernunft, die in ihrem Prinzipien-Selbst als theoretischer wie praktischer Erst- und Gesamtgrund menschliche Würde wie auch diesheitliche Ganzheit zu fundieren und zu garantieren vermag. – Zeidler darf in diesem Panorama mit Fug und Recht als eine Art Leuchtturm im rasch wechselnden Gewölk modernen und nachmodernen Gedankenlebens erscheinen. Après le rappel de différents contextes dans lesquels a émergé et s’est affirmée en Allemagne au xixe siècle l’idée de philosophie scientifique, l’article a pour objectif une description de la conception de Reichenbach, contrastée avec celle de plusieurs membres du Cercle de Vienne. Je montre en particulier le lien épistémologique et institutionnel entre le groupe de Reichenbach à Berlin et celui de Göttingen autour de Hilbert. J’esquisse aussi un rapprochement entre certains traits caractéristiques de la position de Reichenbach et (...) la conception régionale de l’épistémologie historique française. L’axiomatique et la métamathématique de Hilbert sont bien entendu une racine commune aux orientations suivies par Reichenbach et les épistémologues français des mathématiques. Mais l’impact de la théorie de la relativité, de la mécanique quantique et du calcul des probabilités ne fut pas moins grand et renouvela en profondeur les concepts de temps, d’espace, de substance, de cause et de loi dans une mise en question des thèses du transcendantalisme kantien qui tourna l’intérêt vers les pratiques scientifiques effectives. Jérusalem, livre majeur de Moses Mendelssohn, est une apologie du judaïsme. Apologie dans le sens de Socrate : sommé de répondre aux accusations des hommes de la cité, Mendelssohn, le " Socrate de Berlin ", doit répondre de soi. Peut-on être juif et éclairé à la fois? Le juif des Lumières est-il pensable? Peut-il exister? Face à la critique moderne du judaïsme - celle qui trouve sa formulation la plus accomplie dans le Traité théologico-politique de Spinoza -, Mendelssohn formule (...) une réponse fondamentale, inaugurant ainsi la pensée juive moderne. Entendre cette réponse nécessite une lecture attentive de Jérusalem. Inspiré par la leçon de Franz Rosenzweig et d'Emmanuel Lévinas, et dans le sillage de l'enseignement de Benny Lévy, L'Apologie de Mendelssohn tente une telle lecture. Lecture sensible au retour à Platon s'opérant discrètement dans le penser de Mendelssohn : le Platon dialoguant, celui attaché à la vérité d'existence plutôt qu'à l'exactitude mathématico- logique. Mais lecture sensible aussi au retour à la sagesse des maîtres d'Israël qui s'opère nettement au sein de Jérusalem. Sagesse qui sait penser le commandement divin non pas comme loi politique mais comme possibilité singulière d'accorder vie et vérité. Sagesse permettant ainsi de repenser le sens de l'élection d'Israël et son rapport à l'universalisme. Mendelssohn a-t-il su rester fidèle à l'enseignement des maîtres d'Israël? A-t-il pu accorder jusqu'au bout élection et universalisme? Question ultime que pose L'Apologie de Mendelssohn, permettant enfin d'examiner les limites qu'il impose à la pensée juive dans son oeuvre. François Duchesneau | : Nicolas de Béguelin, philosophe et scientifique, membre de l’Académie de Berlin, entreprit de concilier des thèses contrastées sur les fondements de la philosophie de la nature, qui semblaient suggérer une antinomie irréductible entre les principes leibniziens-wolffiens et les principes newtoniens. Dans une série de mémoires consacrés à ce projet, il tente d’établir qu’une philosophie expérimentale reste incertaine de ses hypothèses, si elle ne les confronte aux réquisits qu’imposent certains des principes architectoniques dérivant du principe de (...) la raison suffisante. This paper explains why informed consent for randomized comparative effectiveness research must include risks of standard care. Disclosures of such risks are both legally and ethically required and, for reasons discussed in the paper, should remain so.

Here, we provide an ethical analysis of discrimination in private insurance to guide the application of non-discriminatory algorithms for risk prediction in the insurance context. This addresses the need for ethical guidance of data-science experts, business managers, and regulators, proposing a framework of moral reasoning behind the choice of fairness goals for prediction-based decisions in the insurance domain. The reference to private insurance as a business practice is essential in our approach, because the consequences of discrimination and predictive inaccuracy in (...) underwriting are different from those of using predictive algorithms in other sectors. Here we focus on the trade-off in the extent to which one can pursue indirect non-discrimination versus predictive accuracy. The moral assessment of this trade-off is related to the context of application—to the consequences of inaccurate risk predictions in the insurance domain. (shrink)

Lantos and Feudtner argue that SUPPORT was an instance of CER and that CER differs from research involving unproven, experimental therapies because it exposes research subjects to the same risks patients regularly face in clinical practice. Like many defenders of SUPPORT, they formally acknowledge the study as research but want it to be thought of as clinical care. They develop an appealing argument, but it is misleading. Whatever doctors might have done in clinical practice, their choice of target range within (...) the study and for study participants was influenced by research aims. Just as in research involving unproven, experimental therapies, the care of patients in SUPPORT was altered for the goal of obtaining knowledge to help future patients. (shrink)

Luciano Floridi was not the first to discuss the idea of group privacy, but he was perhaps the first to discuss it in relation to the insights derived from big data analytics. He has argued that it is important to investigate the possibility that groups have rights to privacy that are not reducible to the privacy of individuals forming such groups. In this paper, we introduce a distinction between two concepts of group privacy. The first, the “what happens in Vegas (...) stays in Vegas” privacy (in the following: WHVSV privacy), deals with confidential information shared with the member of a group and inaccessible to (all or a specific group of) outsiders. The second, to which we shall refer as inferential privacy, deals with the inferences that can be made about a group of people defined by a feature, or combination thereof, shared by all individuals in the group. We show why we unreservedly agree with Floridi that groups can have a form of privacy that amounts to more than the mere fact of being sets of individuals each of whom has individual privacy; moreover, like Floridi, we find it plausible that at least some groups (those satisfying our definition of type-a groups) may have a right to a species of group privacy (that is, WHVSV privacy) as groups (and not just as individuals who belong to those groups). However, by turning our attention to the context of big data analytics, we show that the relevant, new notion of group privacy is one of inferential privacy. We argue that an absolute right (either of individuals or groups) to inferential privacy is implausible. We also show that many groups generated algorithmically (those satisfying our definition of type-b groups) cannot be right holders as groups (unless they become type-a groups). (shrink)

There is a need to feminize the research on entrepreneurs — to include the experiences of women in what we know to be true about entrepreneurs and the entrepreneurial process. This paper highlights some of the most significant methodological problems in researching women's entrepreneurial experience, problems which in the past, have prevented researchers from gaining an understanding of this experience, and which continues to stand in the way of developing female perspectives. Instead of using the existing male-based models, new approaches (...) are called for in incorporating women's experiences into entrepreneurship theory. This paper outlines the state of research and suggests future directions for developing research on women as entrepreneurs. (shrink)

Many current abortion regulations represent an over-medicalization of abortion or a corruption of abortion's true medical nature, with disproportionate consequences to women with lower incomes and lesser means. This article explores the effects of unnecessary and harmful abortion restrictions on women living in poverty. A brief summary of the major abortion rights cases explains how the Constitution, as currently interpreted, vests the government and sometimes the medical profession with the power to protect women's health, rather than granting this power to (...) women themselves. The article then argues for a new approach for protecting women's health and respecting their dignity by reframing reproductive rights as health rights that women themselves can assert. (shrink)

In this paper we argue that transparency of machine learning algorithms, just as explanation, can be defined at different levels of abstraction. We criticize recent attempts to identify the explanation of black box algorithms with making their decisions (post-hoc) interpretable, focusing our discussion on counterfactual explanations. These approaches to explanation simplify the real nature of the black boxes and risk misleading the public about the normative features of a model. We propose a new form of algorithmic transparency, that consists in (...) explaining algorithms as an intentional product, that serves a particular goal, or multiple goals (Daniel Dennet’s design stance) in a given domain of applicability, and that provides a measure of the extent to which such a goal is achieved, and evidence about the way that measure has been reached. We call such idea of algorithmic transparency “design publicity.” We argue that design publicity can be more easily linked with the justification of the use and of the design of the algorithm, and of each individual decision following from it. In comparison to post-hoc explanations of individual algorithmic decisions, design publicity meets a different demand (the demand for impersonal justification) of the explainee. Finally, we argue that when models that pursue justifiable goals (which may include fairness as avoidance of bias towards specific groups) to a justifiable degree are used consistently, the resulting decisions are all justified even if some of them are (unavoidably) based on incorrect predictions. For this argument, we rely on John Rawls’s idea of procedural justice applied to algorithms conceived as institutions. (shrink)

This article argues that the failure of certain theories of reflexive identity transformation to consider more fully issues connected to gender identity leads to an overemphasis on the expressive possibilities thrown up by processes of detraditionalization. By ignoring certain deeply embedded aspects, some theories of reflexive change reproduce the `disembodied and disembedded' subject of masculinist thought. The issues of disembodiment and disembeddedness are explored through a study of the work of Pierre Bourdieu on `habitus' and the `field'. The idea of (...) habitus yields a more dynamic theory of embodiment central to a feminist understanding of gender identity as a durable but not immutable norm. The idea of the `field' provides a more differentiated analysis of the social context in which the reflexive transformation of gender identity unfolds. This in turn offers a way of thinking of possible transformations within gender identity as uneven and non-synchronous phenomena. (shrink)

My essay consists of three parts. In the first section, I review the historical context of Baroque aesthetics as it is developed during the late 16th and 17th centuries in Europe and then I track its development in Latin America into the third quarter of the 18th century. The principled excess of the Baroque, to adapt Cyrano de Bergerac’s formulation cited below, was designed for theological and imperial purposes. Secondly, I address more recent literature and literary theory. Why, in the (...) early 20th century, did Latin American poets, novelists, essayists and critics begin to rediscover, recover and reconstitute Baroque modes of expression? What was it about this Catholic, monarchical, colonizing aesthetic that now seemed suited to postcolonial purposes? I refer to several theorists and writers who pioneered and/or inspired the 20th-century idea of the New World Baroque as a rebellious retort to Europe rather than a passive reflection. My third section considers how to teach the politics of Baroque aesthetics, and why Baroque aesthetics remains relevant today. (shrink)

This paper explores the analogy between food label information and genetic information, in order to defend the right not to know judgmental nutritional information, such as the one conveyed by traffic light labels and other, more aggressive, recent proposals. Traffic light labeling judges the nutritional quality of food by means of colored flags on the front pack . It involves a simplification of the link between food quality and health outcomes.
