O presente trabalho se propõe a analisar a apropriação feita por Carl Schmitt do conceito de guerra elaborado por Rousseau no Contrato social. Está em jogo explicitar o que cada um desses autores tem em mente quando se refere à guerra como relação de Estado a Estado, elucidando, assim, como eles compreendem as implicações mútuas entre soberania e território. Para tanto, será preciso esclarecer os pressupostos que orientam a leitura sui generis que o jurista alemão faz da teoria (...) rousseauniana da guerra. (shrink)

Il saggio esamina la posizione del presidente della Repubblica, Francesco Cossiga, in merito all'art. 11 della Costituzione in occasione della crisi del Golfo del 1990-1991. Cossiga considerò l'art. 11 il parametro giuridico fondamentale per valutare ogni attività a carattere bellico dell'Italia e ispirò le scelte del governo Andreotti a questo parametro. Fin dall'avvio della crisi, l'Italia partecipò all'esecuzione delle sanzioni economiche decise dal Consiglio di Sicurezza contro l'Iraq con una forza navale. Cossiga si oppose a un rafforzamento della missione militare (...) italiana con truppe di terra, perché ciò era incompatibile con l'art. 11, e suggerì l'invio di una forza aeronautica di caccia-bombardieri Tornado come appoggio alla missione navale italiana. Il presidente della Repubblica, inoltre, negò la legittimità di utilizzare le forze armate italiane come ausilio alle operazioni statunitense nel quadro della solidarietà atlantica come era stato richiesto da Washington. A giudizio di Cossiga e di Andreotti, le sanzioni economiche e le operazioni militari contro l'Iraq andavano tutte gestite all'interno del sistema giuridico dell'ONU, che costituiva una delle poche eccezioni al ripudio della guerra iscritto nell'art. 11. O presente artigo visa argumentar que a lei e a educação, em John Locke, em alguma medida se complementam para ceifar a possibilidade de opressão, objetivando garantir a liberdade política dos indivíduos contra a dominação. Para efetivar esse objetivo, duas obras serão fundamentais: o _Segundo tratado sobre o govern_o e _Alguns pensamentos sobre a educação_. Com base na primeira, buscaremos analisar as circunstâncias que resultaram na renúncia da liberdade por parte dos indivíduos, para associarem-se em sociedade sob a proteção da (...) lei o que implica a necessidade de examinar o estado de natureza e o estado de guerra; na segunda, buscamos investigar a preocupação empregada pelo inglês no cuidado para que as crianças não se tornem opressoras. Com isso, esperamos contribuir com os futuros pesquisadores do pensamento político e educacional de Locke, de modo a demonstrar um possível meio de relacionar esses dois aspectos da filosofia do pensador inglês. Este trabajo aborda el fenómeno de involución que se ha producido en los últimos años en el entendimiento de las relaciones entre libertad y seguridad en la tradición democrática. Tras el 11 de septiembre de 2001, la estrategia de guerra contra el terrorismo sustituye la lógica del Estado de Derecho por la del Estado de sitio y difunde el viejo recurso del miedo al otro y el paradójico repliegue en un nosotros cada vez más reducido, incluso en sociedades que (...) hacen bandera del universalismo. Entre el miedo a la amenaza exterior y el miedo al enemigo interno, se acrecienta el rechazo a la inmigración, construida de nuevo como un problema-obstáculo. El autor muestra, además, como la actual crisis económica se ha convertido en un factor añadido que ha multiplicado los discursos acerca de la urgencia de ofrecer respuestas adecuadas frente a la inmigración en las que se opta por una lógica jurídica de la excepcionalidad, de derogación o al menos suspensión de alguno de los principios y reglas del Estado de Derecho cuando se trata de regular el status jurídico de quienes son identificados como amenaza. O presente artigo discutirá as origens e os desdobramentos do revisionismo no pensamento historiográfico sobre a Guerra do Paraguai, ressaltando a posição do político e escritor argentino Juan Bautista Alberdi como peça chave na gênese desse movimento de interpretação da guerra. Sem desvalorizar o papel de revisionistas históricos como O’Leary e Baéz, argumentamos que é nos escritos de Alberdi que encontramos a gênese mais bem definida do pensamento revisionista que iria assumir diversas cores político argumentativas ao longo dos (...) séculos XIX e XX. Concluímos que, ao interpretar a Guerra do Paraguai como uma continuidade das guerras intestinas argentinas, Alberdi inaugura um modelo interpretativo que, explorado à exaustão, definirá o Paraguai como vítima de uma agressão desmedida e baluarte da causa americana. Luca Corchia esamina gli indirizzi normativi, la programmazione e il coordinamento delle strategie della Regione Toscana in merito alla promozione di una cultura di pace e nel quadro di un sistema integrato regionale che include altresì la promozione dell’attività di cooperazione e partenariato internazionale. Pace e cooperazione sono i due assi di una politica che assume come finalità il ripudio della guerra, la tutela dei diritti umani, la democrazia politica, la giustizia economica e la solidarietà sociale. Tutti i (...) documenti della Regione Toscana, per coerenza esterna “verticale” ed “orizzontale”, disciplinano in forma integrata i due settori tanto nei contenuti quanto nell’iter delle loro procedure. Un aspetto rilevante di tale orientamento concerne il processo partecipativo, esteso a Comuni, Province, Comunità montane, mondo della scuola e associazioni, con la costituzione di “Conferenze regionali”, “Forum territoriali della cooperazione e della pace”, “Tavoli di coordinamento di area geografica”; sedi di concertazione degli obiettivi generali, specifici e delle scelte di allocazione delle risorse dedicate agli “Interventi dei soggetti terzi” e ai “Progetti di Interesse Regionale” (PIR). La partecipazione come metodo decisionale ex ante ma anche come strumento di trasparenza, controllo e valutazione ex post. L’elemento fondante delle azioni regionali è il riconoscimento e la valorizzazione delle comunità locali quali promotrici della cultura della pace, anzitutto attraverso la comunità scolastica. La scuola, infatti, è presente in massima misura nell’articolato ventaglio di progetti di cui si fa menzione in questo scritto. (shrink)

Trata-se de uma introdução interpretativa ao primeiro livro filosófico publicado por Simone de Beauvoir, Pirro e Cinéias (1944), que inaugura, segundo ela, após a eclosão da Segunda Guerra Mundial, o período moral de sua carreira literária e seu interesse particular em atribuir um conteúdo material à moral existencialista – junto de um livro publicado posteriormente, Por uma moral da ambiguidade (1947). Destaca-se, portanto, que Beauvoir é a autora que vai superar as oposições que separavam a natureza da cultura, o (...) corpo do espírito, a liberdade da facticidade, a subjetividade da objetividade, o individual do coletivo, o particular do universal, de tal forma que sua alternativa será, no ensaio aqui estudado, pensar como as liberdades separadas entre si se reconhecem mutuamente para que o movimento ontológico de uma em direção à outra possibilite uma investigação do vínculo fundamental e indissociável entre os extremos mencionados. Com efeito, nossa conclusão é que Pirro e Cinéias anuncia duas das ideias centrais que esclarecem o período moral da literatura beauvoiriana, que é a individualidade de cada situação vivida, tal como as situações de suas personagens literárias, e o movimento das liberdades situadas em sua própria dimensão: a dimensão humana. Este artículo explora los modos en que las imágenes de perpetradores pueden encarnarse en las maquinarias propagandísticas. En este sentido, analiza parte del material de archivo de la televisión oficial argentina durante la Guerra de las Islas Malvinas que aparece en el film documental 1982 (Lucas Gallo, 2020), a fin de elaborar una revisión no sólo de la imbricación de las imágenes con las políticas de exterminio, sino para discutir la concepción del archivo como ficción y como instrumento de (...) la memoria. El presente trabajo investiga las tesis sobre el poder civil de Alonso de la Veracruz que buscan incorporar en la comunidad política española a los habitantes autóctonos del Nuevo Mundo, tesis que suelen relacionarse con F. de Vitoria y el tomismo español, y que últimamente son consideradas parte del republicanismo novohispano elaborado desde la periferia americana. Se busca demostrar que su propósito era aplicar una teoría de derechos naturales, sin que ello implique participación política de los indios americanos. The paper explores Alonso de la Veracruz's theses on civil power, which sought to integrate the native inhabitants of the New World into the Spanish political community. These theses, which have usually been associated with F. de Vitoria and Spanish Thomism, have recently come to be considered part of a Novohispanic republicanism developed in the American periphery. The article seeks to show that the purpose of such theses was to apply a theory of natural rights that did not entail the political participation of the indigenous population, as well as to analyze Veracruz's position regarding cultural diversity and the war against the indigenous peoples. In this paper we aim to offer a balanced argument to motivate (re)thinking about the mental illness clause within the insanity defence. This is the clause that states that mental illness should have a relevant causal or explanatory role for the presence of the incapacities or limited capacities that are covered by this defence. We offer three main considerations showing the important legal and epistemological roles that the mental illness clause plays in the evaluation of legal responsibility. Although we acknowledge (...) that these advantages could be preserved without having this clause explicitly stated in the law, we resist proposals that deny the importance of mental illness in exculpation. We argue, thus, that any attempt at removing the mental illness clause from legal formulations of the insanity defence should offer alternative ways of keeping in place these advantages. (shrink)

The paper introduces and formally defines a functional concept of a measuring system, on this basis characterizing the measurement as an evaluation performed by means of a calibrated measuring system. The distinction between exact and uncertain measurement is formalized in terms of the properties of the traceability chain joining the measuring system to the primary standard. The consequence is drawn that uncertain measurements lose the property of relation-preservation, on which the very concept of measurement is founded according to the representational (...) viewpoint. Finally, from the analysis of the inter-relations between calibration and measurement the fundamental reasons of the claimed objectivity and intersubjectivity of measurement are highlighted, a valuable epistemological result to characterize measurement as a particular kind of evaluation. Psychopaths have emotional and rational impairments that can be expressed in persistent criminal behaviour. UK and US law has not traditionally excused disordered individuals for their crimes citing these impairments as a cause for their criminal behaviour. Until now, the discussion of whether psychopaths are morally responsible for their behaviour has usually taken place in the realm of philosophy. However, in recent years, this debate has been informed by scientific and psychiatric advancements, fundamentally so with the development of Robert Hare's (...) diagnostic tool, the Psychopathy Checklist. Responsibility and Psychopathy explores the moral responsibility of psychopaths. It engages with problems at the interface between law, psychiatry, and philosophy, and is divided into three parts offering relevant interdisciplinary background information to address this main problem. The first part discusses the public policy and legal responses to psychopathy. It offers an introduction to the central practical issue of how public policy should respond to psychopathy, providing insights for those arguing about the responsibility of psychopaths. The second part introduces recent scientific advancements in the classification, description, explanation, and treatment of psychopathy. The third part of the volume includes chapters covering the most significant dimensions of philosophical debate on the moral and criminal responsibility of psychopaths. (shrink)

Transmission of justification across inference is a valuable and indeed ubiquitous epistemic phenomenon in everyday life and science. It is thanks to the phenomenon of epistemic transmission that inferential reasoning is a means for substantiating predictions of future events and, more generally, for expanding the sphere of our justified beliefs or reinforcing the justification of beliefs that we already entertain. However, transmission of justification is not without exceptions. As a few epistemologists have come to realise, more or less trivial forms (...) of circularity can prevent justification from transmitting from p to q even if one has justification for p and one is aware of the inferential link from p to q. In interesting cases this happens because one can acquire justification for p only if one has independent justification for q. In this case the justification for q cannot depend on the justification for p and the inferential link from p to q, as genuine transmission would require. The phenomenon of transmission failure seems to shed light on philosophical puzzles, such as Moore's proof of a material world and McKinsey's paradox, and it plays a central role in various philosophical debates. For this reason it is being granted continued and increasing attention. (shrink)

"The last remnant of physical objectivity of space-time" is disclosed, beyond the Leibniz equivalence, in the case of a continuous family of spatially non-compact models of general relativity. The physical individuation of point-events is furnished by the intrinsic degrees of freedom of the gravitational field, (viz, the "Dirac observables") that represent - as it were - the "ontic" part of the metric field. The physical role of the "epistemic" part (viz. the "gauge" variables) is likewise clarified. At the end, a (...) peculiar four-dimensional "holistic and structuralist" view of space-time emerges which includes elements common to the tradition of both substantivalism and relationism. The observables of our models undergo real "temporal change" and thereby provide a counter-example to the thesis of the "frozen-time" picture of evolution. (shrink)

Sets are central to mathematics and its foundations, but what are they? In this book Luca Incurvati provides a detailed examination of all the major conceptions of set and discusses their virtues and shortcomings, as well as introducing the fundamentals of the alternative set theories with which these conceptions are associated. He shows that the conceptual landscape includes not only the naïve and iterative conceptions but also the limitation of size conception, the definite conception, the stratified conception and the (...) graph conception. In addition, he presents a novel, minimalist account of the iterative conception which does not require the existence of a relation of metaphysical dependence between a set and its members. His book will be of interest to researchers and advanced students in logic and the philosophy of mathematics. (shrink)

In this paper we focus on two claims, put forward by Feyerabend in his later writings , which constitute the metaphysical core of his view of scientific inquiry. The first, that we call the pliability thesis, is the claim that the world can be described by indefinitely many conceptual systems, none of them enjoying a privileged status. The second, that we call the resistance thesis, is the claim that the pliability of the world is limited, i.e., not all the different (...) conceptual systems that can be used to describe the world will be equally successful: the world offers resistance to some attempts to describe it. We show that, in spite of the later Feyerabend’s notorious antirealist leanings, the pliability thesis is fully compatible with a robustly realist view of science, and we suggest that, surprisingly, Feyerabend’s insights concerning the limited pliability of the world turn out to be those of a potential ally of sophisticated versions of scientific realism. We show that the modal µ-calculus over GL collapses to the modal fragment by showing that the fixpoint formula is reached after two iterations and answer to a question posed by van Benthem in [4]. Further, we introduce the modal µ~-calculus by allowing fixpoint constructors for any formula where the fixpoint variable appears guarded but not necessarily positive and show that this calculus over GL collapses to the modal fragment, too. The latter result allows us a new proof of the (...) de Jongh, Sambin Theorem and provides a simple algorithm to construct the fixpoint formula. (shrink)

In set theory, a maximality principle is a principle that asserts some maximality property of the universe of sets or some part thereof. Set theorists have formulated a variety of maximality principles in order to settle statements left undecided by current standard set theory. In addition, philosophers of mathematics have explored maximality principles whilst attempting to prove categoricity theorems for set theory or providing criteria for selecting foundational theories. The question of how we should engage with a philosopher’s racial thought is of particular importance when considering Kant, who can be viewed as particularly representative of Enlightenment philosophy. In this article I argue that we should take a stance of deep acknowledgment when considering Kant’s work both inside and outside the classroom. Taking a stance of deep acknowledgment should be understood as 1) taking Kant’s racial thought to be reflective of his moral character, 2) Kant being accountable for his (...) racial thought and 3) being willing to consider the possibility that Kant’s racial thought is consistent with and inextricable from his moral philosophy. Alternative forms of engaging with Kant’s racial work have either moral or pedagogical failings, which range from simply teaching the history of philosophy uncritically to outright deception. A stance of deep acknowledgement will allow philosophers to understand how Kant’s racial thought interacts with his moral philosophy and allow instructors to teach philosophy in a historically contextualized approach so as to not alienate students whose demographic was disparaged by Kant. We study the strictness of the modal μ-calculus hierarchy over some restricted classes of transition systems. First, we prove that over transitive systems the hierarchy collapses to the alternationfree fragment. In order to do this the finite model theorem for transitive transition systems is proved. Further, we verify that if symmetry is added to transitivity the hierarchy collapses to the purely modal fragment. Finally, we show that the hierarchy is strict over reflexive frames. By proving the finite model theorem for (...) reflexive systems the same results holds for finite models. (shrink)

Boran Berčić, in the second volume of his recent book "Filozofija" , offers two responses to David Chalmers’s conceivability or modal argument against physicalism. This latter argument aims at showing that zombies, our physical duplicates who lack consciousness, are metaphysically possible, given that they are conceivable. Berčić’s first response is based on the principle of the uniformity of nature that states that causes of a certain type will always cause effects of the same type. His second response is based on (...) the assumption that the basic statements of physicalism in philosophy of mind are or should be contingently true. I argue that if Berčić’s first defence is aimed at the conceivability of zombies, it is unsatisfactory. Moreover, I argue that a quite similar argument, offered by John Perry in his book "Knowledge, Possibility and Consciousness" , is afflicted by a similar problem. Nevertheless, under a more plausible interpretation, Berčić’s argument might be taken to attack the metaphysical possibility of zombies. This version of the argument might be effective and has the merit to point out a so far overlooked link between the discussion of the Chalmers’s conceivability arguments against physicalism and the modal strength of causal links and natural laws. Then, I argue that Berčić’s second defence of physicalism, which cannot be combined consistently with his first one, in any case, should not be formulated in the terms of contingent physicalism. This research was carried out to explore some of the cognitive processes involved in scientific anomalies resolution. 40 subjects with a good neuropsychology expertise were asked to explain two (invented) anomalous neuropsychological cases. The subjects' efforts to give a meaningful structure to the data were recorded, and the resulting reasoning blocks were analysed to extract and compute the inferential (deductive, inductive and abductive) and analogical processes used. The processes were intercorrelated to experimentally verify the co-occurrence of different forms of logical (...) thinking. Statistical analysis point out the relevance of abductive inferences, the possible presence of an inferential-style switching process , the high number of external analogies used, the cognitive closeness manifested by expert reasoners. This essay tries to rethink Benjamin’s notion of “aura” through the consideration of two authors such as G. Didi-Huberman and D. Costello. The aim is not to distinguish between auratic and postauratic (or non-auratic) works of art, but to rethink the problem of aesthetic perception in the age of mechanical reproduction. More specifically, Costello and Didi-Huberman point out the relation between “aura” and “subjectivity”: on the one hand, the intersubjective (and ethical) nature of an “authentic” (i.e., auratic) experience; on the (...) other hand, the presence of the aura nowadays in the “interplay of gazes” between the (subject-)work and the (subject-)spectator. Works of art are indeed characterized by a “two-fold” or aesthetic “transcendence” – they are at once both inside and outside my world – which enables them to resist the reification into reproducible commodity. The philosophical contributes in the volume offer several considerations for the conclusion that psychopaths offenders should not be considered morally responsible for their crimes. We situate this conclusion within wider philosophical debates and indicate relevant directions of further research.

In this chapter we argue that Robert Hare's psychopathy checklist revised (PCL-R) offers a construct of psychopathy that is valid enough for philosophical investigations of the moral and legal responsibility of psychopathic offenders.

Given the common assumption that measurement plays an important role in the foundation of science, the paper analyzes the possibility that Measurement Science, and therefore measurement itself, can be properly founded. The realist and the representational positions are analyzed at this regards: the conclusion, that such positions unavoidably lead to paradoxical situations, opens the discussion for a new epistemology of measurement, whose characteristics and interpretation are sketched here but are still largely matter of investigation.

R. Feldman defends a general principle about evidence the slogan form of which says that ‘evidence of evidence is evidence’. B. Fitelson considers three renditions of this principle and contends they are all falsified by counterexamples. Against both Feldman and Fitelson, J. Comesaña and E. Tal show that the third rendition––the one actually endorsed by Feldman––isn’t affected by Fitelson’s counterexamples, but only because it is trivially true and thus uninteresting. Tal and Comesaña defend a fourth version of Feldman’s principle, which––they (...) claim––has not yet been shown false. Against Tal and Comesaña I show that this new version of Feldman’s principle is false. (shrink)

The non-well-founded set theories described by Aczel (1988) have received attention from category theorists and computer scientists, but have been largely ignored by philosophers. At the root of this neglect might lie the impression that these theories do not embody a conception of set, but are rather of mere technical interest. This paper attempts to dispel this impression. I present a conception of set which may be taken as lying behind a non-well-founded set theory. I argue that the axiom AFA (...) is justified on the conception, which provides, contra Rieger (Mind 109:241–253, 2000), a rationale for restricting attention to the system based on this axiom. By making use of formal and informal considerations, I then make a case that most of the other axioms of this system are also justified on the conception. I conclude by commenting on the significance of the conception for the debate about the justification of the Axiom of Foundation. (shrink)

This article is based on Gibson’s “experimental phenomenology” and ecological perspective. It aims to develop Merleau-Ponty’s concept of “incarnate” by relating it to the more general concept of “illusion” in order to apply it to digital environments and immersive virtual realities. First of all, we should clarify, from a phenomenological point of view, the notion of “world.” Although the concept of “world” is closely linked to that of “reality,” it cannot be superimposed on it. We will analyze this distinction by (...) focusing on specific cases of optical-geometric illusions and their ontological and epistemological implications. Maddy gave a semi-formal account of restrictiveness by defining a formal notion based on a class of interpretations and explaining how to handle false positives and false negatives. Recently, Hamkins pointed out some structural issues with Maddy's definition. We look at Maddy's formal definitions from the point of view of an abstract interpretation relation. We consider various candidates for this interpretation relation, including one that is close to Maddy's original notion, but fixes the issues raised by Hamkins. Our work brings (...) to light additional structural issues that we also discuss. (shrink)

In this review of Persons and Things, recently translated into English and published by Polity Press, we discuss how this text investigates some of the most important themes of Roberto Esposito’s thought. Specifically, the book continues the process of constructing an idea of community intended as lack, gift and impropriety that the Italian philosopher has been developing since the publication of Communitas. In this case, it is the notion of body that demolishes the metaphysical apparatus that has conditioned the moulding (...) of the philosophical-legal lexicon of the Western tradition. Doomed to constant submission to the rational sphere of the person, hence assimilated to the materiality of a mere thing, the body can win back its full dignity if it is considered as a ‘living body’. Only in this way, according to Esposito, is it possible to move past the ‘proprietary’ and subjectivistic notion that, in philosophy as well as in law, has determined a clear-cut separation between persons (intended as rational beings) and things (conceived as inert objects), as well as between ‘superior’ and ‘inferior’ persons. Thus, in Persons and Things, the body becomes an actual vector for a trans-individualization of the individual, for an opening to the common, public, and communitarian dimension. According to Esposito, this process is favoured by the changes brought about by biotechnologies and science in general, not only in medical practices, but also in the legal formulations that follow from them. Recent works in epistemology show that the claim that coherence is truth conducive – in the sense that, given suitable ceteris paribus conditions, more coherent sets of statements are always more probable – is dubious and possibly false. From this, it does not follows that coherence is a useless notion in epistemology and philosophy of science. Dietrich and Moretti (Philosophy of science 72(3): 403–424, 2005) have proposed a formal of account of how coherence is confirmation conducive—that is, of how the (...) coherence of a set of statements facilitates the confirmation of such statements. This account is grounded in two confirmation transmission properties that are satisfied by some of the measures of coherence recently proposed in the literature. These properties explicate everyday and scientific uses of coherence. In his paper, I review the main findings of Dietrich and Moretti (2005) and define two evidence-gathering properties that are satisfied by the same measures of coherence and constitute further ways in which coherence is confirmation conducive. At least one of these properties vindicates important applications of the notion of coherence in everyday life and in science. (shrink)
