In this paper we aim to offer a balanced argument to motivate (re)thinking about the mental illness clause within the insanity defence. This is the clause that states that mental illness should have a relevant causal or explanatory role for the presence of the incapacities or limited capacities that are covered by this defence. We offer three main considerations showing the important legal and epistemological roles that the mental illness clause plays in the evaluation of legal responsibility. Although we acknowledge (...) that these advantages could be preserved without having this clause explicitly stated in the law, we resist proposals that deny the importance of mental illness in exculpation. We argue, thus, that any attempt at removing the mental illness clause from legal formulations of the insanity defence should offer alternative ways of keeping in place these advantages. (shrink)

Psychopaths have emotional and rational impairments that can be expressed in persistent criminal behaviour. UK and US law has not traditionally excused disordered individuals for their crimes citing these impairments as a cause for their criminal behaviour. Until now, the discussion of whether psychopaths are morally responsible for their behaviour has usually taken place in the realm of philosophy. However, in recent years, this debate has been informed by scientific and psychiatric advancements, fundamentally so with the development of Robert Hare's (...) diagnostic tool, the Psychopathy Checklist. Responsibility and Psychopathy explores the moral responsibility of psychopaths. It engages with problems at the interface between law, psychiatry, and philosophy, and is divided into three parts offering relevant interdisciplinary background information to address this main problem. The first part discusses the public policy and legal responses to psychopathy. It offers an introduction to the central practical issue of how public policy should respond to psychopathy, providing insights for those arguing about the responsibility of psychopaths. The second part introduces recent scientific advancements in the classification, description, explanation, and treatment of psychopathy. The paper introduces and formally defines a functional concept of a measuring system, on this basis characterizing the measurement as an evaluation performed by means of a calibrated measuring system. The distinction between exact and uncertain measurement is formalized in terms of the properties of the traceability chain joining the measuring system to the primary standard. The consequence is drawn that uncertain measurements lose the property of relation-preservation, on which the very concept of measurement is founded according to the representational (...) viewpoint. Finally, from the analysis of the inter-relations between calibration and measurement the fundamental reasons of the claimed objectivity and intersubjectivity of measurement are highlighted, a valuable epistemological result to characterize measurement as a particular kind of evaluation. We present an inferentialist account of the epistemic modal operator might. Our starting point is the bilateralist programme. A bilateralist explains the operator not in terms of the speech act of rejection ; we explain the operator might in terms of weak assertion, a speech act whose existence we argue for on the basis of linguistic evidence. We show that our account of might provides a solution to certain well-known puzzles about the semantics of modal vocabulary whilst retaining classical logic. (...) Constitutivism argues that the source of the categorical force of the norms of rationality and morality lies in the constitutive features of agency. A systematic failure to be guided by these norms would amount to a loss or lack of agency. Since we cannot but be agents, we cannot but be unconditionally guided by these norms. The constitutivist strategy has been challenged by David Enoch. He argues that our participation in agency is optional and thus cannot be a source of (...) categorical demands. In this paper, I defend the viability of constitutivism by showing that agency is indeed a special ‘inescapable’ enterprise. Agency has the largest jurisdiction, and it is closed under rational assessment. This inescapability does not exempt constitutivism from raising the question whether agents have reason to be agents, but this question has to be taken up within agency. If this question is answered affirmatively, then—I argue—the criteria of practical correctness are self-ratifying in a non-circular way. This is sufficient to show the viability of the constitutivist strategy. Whether agents have conclusive reasons to be agents, however, is a matter to be addressed in the terms of particular versions of constitutivism. (shrink)

ABSTRACTLinguistic evidence supports the claim that certain, weak rejections are less specific than assertions. On the basis of this evidence, it has been argued that rejected sentences cannot be premisses and conclusions in inferences. We give examples of inferences with weakly rejected sentences as premisses and conclusions. We then propose a logic of weak rejection which accounts for the relevant phenomena and is motivated by principles of coherence in dialogue. We give a semantics for which this logic is sound and (...) complete, show that it axiomatizes the modal logic KD45 and prove that it still derives classical logic on its asserted fragment. Finally, we defend previous logics of strong rejection as being about the linguistically preferred interpretations of weak rejections. (shrink)

"The last remnant of physical objectivity of space-time" is disclosed, beyond the Leibniz equivalence, in the case of a continuous family of spatially non-compact models of general relativity. The physical individuation of point-events is furnished by the intrinsic degrees of freedom of the gravitational field, (viz, the "Dirac observables") that represent - as it were - the "ontic" part of the metric field. The physical role of the "epistemic" part (viz. the "gauge" variables) is likewise clarified. At the end, a (...) peculiar four-dimensional "holistic and structuralist" view of space-time emerges which includes elements common to the tradition of both substantivalism and relationism. The observables of our models undergo real "temporal change" and thereby provide a counter-example to the thesis of the "frozen-time" picture of evolution. (shrink)

In this paper, I will discuss the various ways in which intentions can be said to be conditional, with particular attention to the internal conditions on the intentions’ content. I will first consider what it takes to carry out a conditional intention. I will then discuss how the distinctive norms of intention apply to conditional intentions and whether conditional intentions are a weaker sort of commitments than the unconditional ones. This discussion will lead to the idea of what I call (...) the ‘deep structure’ of intentions. Roughly, this is the idea that the conditional nature of our intentions is only partially made explicit in the expressions we use to communicate our intentions and in the explicit form of our thinking about and reasoning with them. Most conditions that qualify our intentions are part of a deep functional structure that can be evinced by observing the actual psychological functioning of intentions and by considering the rational requirements that they engage. I will argue that the deep structure of intentions is characteristically conditional. Genuinely unconditional intentions are only limiting instances of conditional intentions and their contribution to agency can only be understood in light of this fact. I will conclude by showing that the characteristic conditional structure of intentions is intimately related to distinctive features of human agency, especially to its unity over time. (shrink)

It is often argued that future-directed decisions are effective at shaping our future conduct because they give rise, at the time of action, to a decisive reason to act as originally decided. In this paper, I argue that standard accounts of decision-based reasons are unsatisfactory. For they focus either on tie-breaking scenarios or cases of self-directed distal manipulation. I argue that future-directed decisions are better understood as tools for the non-manipulative, intrapersonal division of deliberative labor over time. A future-directed decision (...) to ϕ gives rise to a defeasible exclusionary reason to ϕ. This reason is grounded on the default authority that is normally granted to one’s prior self as an “expert” deliberator. I argue that this kind of exclusionary reason is the only one that can account for the effectiveness of future-directed decisions at shaping our diachronic agency without violating our autonomy over time. Boran Berčić, in the second volume of his recent book "Filozofija" , offers two responses to David Chalmers’s conceivability or modal argument against physicalism. This latter argument aims at showing that zombies, our physical duplicates who lack consciousness, are metaphysically possible, given that they are conceivable. Berčić’s first response is based on the principle of the uniformity of nature that states that causes of a certain type will always cause effects of the same type. His second response is based on (...) the assumption that the basic statements of physicalism in philosophy of mind are or should be contingently true. I argue that if Berčić’s first defence is aimed at the conceivability of zombies, it is unsatisfactory. Moreover, I argue that a quite similar argument, offered by John Perry in his book "Knowledge, Possibility and Consciousness" , is afflicted by a similar problem. Nevertheless, under a more plausible interpretation, Berčić’s argument might be taken to attack the metaphysical possibility of zombies. This version of the argument might be effective and has the merit to point out a so far overlooked link between the discussion of the Chalmers’s conceivability arguments against physicalism and the modal strength of causal links and natural laws. Then, I argue that Berčić’s second defence of physicalism, which cannot be combined consistently with his first one, in any case, should not be formulated in the terms of contingent physicalism. The philosophical contributes in the volume offer several considerations for the conclusion that psychopaths offenders should not be considered morally responsible for their crimes. We situate this conclusion within wider philosophical debates and indicate relevant directions of further research.

In this chapter we argue that Robert Hare's psychopathy checklist revised (PCL-R) offers a construct of psychopathy that is valid enough for philosophical investigations of the moral and legal responsibility of psychopathic offenders.

In set theory, a maximality principle is a principle that asserts some maximality property of the universe of sets or some part thereof. Set theorists have formulated a variety of maximality principles in order to settle statements left undecided by current standard set theory. In addition, philosophers of mathematics have explored maximality principles whilst attempting to prove categoricity theorems for set theory or providing criteria for selecting foundational theories. This research was carried out to explore some of the cognitive processes involved in scientific anomalies resolution. 40 subjects with a good neuropsychology expertise were asked to explain two (invented) anomalous neuropsychological cases. The subjects' efforts to give a meaningful structure to the data were recorded, and the resulting reasoning blocks were analysed to extract and compute the inferential (deductive, inductive and abductive) and analogical processes used. The processes were intercorrelated to experimentally verify the co-occurrence of different forms of logical (...) thinking. Statistical analysis point out the relevance of abductive inferences, the possible presence of an inferential-style switching process , the high number of external analogies used, the cognitive closeness manifested by expert reasoners. This essay tries to rethink Benjamin’s notion of “aura” through the consideration of two authors such as G. Didi-Huberman and D. Costello. The aim is not to distinguish between auratic and postauratic (or non-auratic) works of art, but to rethink the problem of aesthetic perception in the age of mechanical reproduction. More specifically, Costello and Didi-Huberman point out the relation between “aura” and “subjectivity”: on the one hand, the intersubjective (and ethical) nature of an “authentic” (i.e., auratic) experience; on the (...) other hand, the presence of the aura nowadays in the “interplay of gazes” between the (subject-)work and the (subject-)spectator. Works of art are indeed characterized by a “two-fold” or aesthetic “transcendence” – they are at once both inside and outside my world – which enables them to resist the reification into reproducible commodity. Sets are central to mathematics and its foundations, but what are they? In this book Luca Incurvati provides a detailed examination of all the major conceptions of set and discusses their virtues and shortcomings, as well as introducing the fundamentals of the alternative set theories with which these conceptions are associated. He shows that the conceptual landscape includes not only the naïve and iterative conceptions but also the limitation of size conception, the definite conception, the stratified conception and the (...) graph conception. In addition, he presents a novel, minimalist account of the iterative conception which does not require the existence of a relation of metaphysical dependence between a set and its members. His book will be of interest to researchers and advanced students in logic and the philosophy of mathematics. (shrink)

Given the common assumption that measurement plays an important role in the foundation of science, the paper analyzes the possibility that Measurement Science, and therefore measurement itself, can be properly founded. The realist and the representational positions are analyzed at this regards: the conclusion, that such positions unavoidably lead to paradoxical situations, opens the discussion for a new epistemology of measurement, whose characteristics and interpretation are sketched here but are still largely matter of investigation.

Timothy Smiley’s wonderful paper ‘Rejection’ (1996) is still perhaps not as well known or well understood as it should be. This note first gives a quick presentation of themes from that paper, though done in our own way, and then considers a putative line of objection – recently advanced by Julien Murzi and Ole Hjortland (2009) – to one of Smiley’s key claims. Crispin Wright has given an explanation of how a first time warrant can fall short of transmitting across a known entailment. Formal epistemologists have struggled to turn Wright’s informal explanation into cogent Bayesian reasoning. In this paper, I analyse two Bayesian models of Wright’s account respectively proposed by Samir Okasha and Jake Chandler. I argue that both formalizations are unsatisfactory for different reasons, and I lay down a third Bayesian model that appears to me to capture the valid kernel of (...) Wright’s explanation. After this, I consider a recent development in Wright’s account of transmission failure. Wright suggests that his condition sufficient for transmission failure of first time warrant also suffices for transmission failure of supplementary warrant. I propose an interpretation of Wright’s suggestion that shield it from objections. I then lay down a fourth Bayesian framework that provides a simplified model of the unified explanation of transmission failure envisaged by Wright. (shrink)

A study of texts in which such an expression (...) is used reveals its centrality in the Nietzschean genealogical approach, as well as how it is linked to a decisive comparison with Kant's practical philosophy. In 1886, Nietzsche felt the need to exercise a retrospective look at the works he had written up to that point. Hence, the writing of a series of prefaces (Vorreden). They can be considered and read as a thematically unified textual body. Rereading them as a unified work allows us to recognise their value as an “auto-pathobiography”. In it, the concepts of health and illness occupy a central position that Nietzschean research has long been questioning. Nevertheless, in reflecting on health (...) and illness, in the Vorreden, Nietzsche also prepares the fundamental epistemological move that will enable him to gradually and increasingly shift his speculative focus from the autoanalytical and biographical to the genealogical plane and authorise him to look at his main object of research, the moral phenomenon, as no other thinker had done before. Measurement in soft systems generally cannot exploit physical sensors as data acquisition devices. The emphasis in this case is instead on how to choose the appropriate indicators and to combine their values so to obtain an overall result, interpreted as the value of a property, i.e., the measurand, for the system under analysis. This paper aims at discussing the epistemological conditions of the claim that such a process is a measurement, and performance evaluation is the case introduced to support the (...) analysis, performed in systematic comparison with the paradigm of measurement of physical quantities. Some background questions arising here are: – Are the chosen indicators appropriate performance indicators? – Do such indicators convey complete and non-redundant information on performance? – Does the chosen combination rule generate results suitably interpretable as performance values? And enlarging the focus: – Does the obtained value specifically convey information on the system under analysis, instead of some different entity (typically including the subject who is evaluating)? Operatively: would different subjects evaluate the same system in the same way? i.e., is the obtained information objective? – Does the obtained value convey information that is interpretable in the same way by different subjects? Operatively: would different subjects who have agreed on a decision procedure make the same decision from the same performance information? i.e., is the obtained information intersubjective? Any well founded positive answers to these questions significantly support a structural interpretation of measurement encompassing both physical and soft measurement. (shrink)

Coherentism in epistemology has long suffered from lack of formal and quantitative explication of the notion of coherence. One might hope that probabilistic accounts of coherence such as those proposed by Lewis, Shogenji, Olsson, Fitelson, and Bovens and Hartmann will finally help solve this problem. This paper shows, however, that those accounts have a serious common problem: the problem of belief individuation. The coherence degree that each of the accounts assigns to an information set (or the verdict it gives as (...) to whether the set is coherent tout court) depends on how beliefs (or propositions) that represent the set are individuated. Indeed, logically equivalent belief sets that represent the same information set can be given drastically different degrees of coherence. This feature clashes with our natural and reasonable expectation that the coherence degree of a belief set does not change unless the believer adds essentially new information to the set or drops old information from it; or, to put it simply, that the believer cannot raise or lower the degree of coherence by purely logical reasoning. None of the accounts in question can adequately deal with coherence once logical inferences get into the picture. Toward the end of the paper, another notion of coherence that takes into account not only the contents but also the origins (or sources) of the relevant beliefs is considered. It is argued that this notion of coherence is of dubious significance, and that it does not help solve the problem of belief individuation. (shrink)

The non-well-founded set theories described by Aczel (1988) have received attention from category theorists and computer scientists, but have been largely ignored by philosophers. At the root of this neglect might lie the impression that these theories do not embody a conception of set, but are rather of mere technical interest. This paper attempts to dispel this impression. I present a conception of set which may be taken as lying behind a non-well-founded set theory. I argue that the axiom AFA (...) is justified on the conception, which provides, contra Rieger (Mind 109:241–253, 2000), a rationale for restricting attention to the system based on this axiom. By making use of formal and informal considerations, I then make a case that most of the other axioms of this system are also justified on the conception. I conclude by commenting on the significance of the conception for the debate about the justification of the Axiom of Foundation. (shrink)

In this paper we focus on two claims, put forward by Feyerabend in his later writings , which constitute the metaphysical core of his view of scientific inquiry. The first, that we call the pliability thesis, is the claim that the world can be described by indefinitely many conceptual systems, none of them enjoying a privileged status. The second, that we call the resistance thesis, is the claim that the pliability of the world is limited, i.e., not all the different (...) conceptual systems that can be used to describe the world will be equally successful: the world offers resistance to some attempts to describe it. We show that, in spite of the later Feyerabend’s notorious antirealist leanings, the pliability thesis is fully compatible with a robustly realist view of science, and we suggest that, surprisingly, Feyerabend’s insights concerning the limited pliability of the world turn out to be those of a potential ally of sophisticated versions of scientific realism. Maddy gave a semi-formal account of restrictiveness by defining a formal notion based on a class of interpretations and explaining how to handle false positives and false negatives. Recently, Hamkins pointed out some structural issues with Maddy's definition. We look at Maddy's formal definitions from the point of view of an abstract interpretation relation. We consider various candidates for this interpretation relation, including one that is close to Maddy's original notion, but fixes the issues raised by Hamkins. This monograph contrasts two prominent models of education, Competence-Based Education (CBE), more recent and currently dominant in most school systems around the world, and Bildung-Oriented Education (BOE), once the basis of the school systems of Northern Europe. CBE is assessment-oriented and interprets learning as the acquisition of clearly definable and allegedly measurable competences, and is supported by supranational organisations, such as the OECD, which approach education from the perspective of human capital theory. BOE is instead teaching-oriented and characterises learning holistically (...) as aimed at the progressive articulation of a meaningful ‘big picture’ in the student’s mind. Emerged in Northern Europe under the influence of the ideals of the Enlightenment and Neo-Humanism of individual and collective autonomy and responsibility, BOE was subsequently enriched with a hermeneutical approach to teaching and socio-political objectives of emancipation and solidarity originating within Critical Theory. The book first analyses CBE and argues that, in spite of its celebrated ‘scientificity’, it is internally incoherent and unreliable, contributes to structural forms of oppression and injustice, can foster social pathologies, and fails to provide students with the kind of intellectual autonomy they need as both human beings and citizens of our complex post-industrial societies. Then, it introduces BOE and articulates and defends an updated version of it from objections raised by critical theorists, poststructuralists and postcolonial thinkers. It argues that BOE is a coherent and flexible model of education that endows students with autonomy and responsibility, can reduce structural forms of oppression and injustice, and can heal social pathologies. According to constitutivism, we can justify the authority of aims and norms on the ground that they are inescapable. Constitutivist views divide between ambitious and modest ones. According to ambitious constitutivism, the inescapability of aims grounds their unconditional authority, whereas according to modest constitutivism, the inescapability of aims only grounds their conditional authority. Either way, both forms of constitutivism share the assumption that inescapability grounds authority, which in turn presupposes that at the foundation of normativity we find aims and norms (...) that can be evaluated as having or lacking authority. In this paper I shall defend a form of constitutivism that rejects this assumption. According to this view, which I shall call Hinge Constitutivism, at the foundation of epistemic normativity we find an aim, the truth-aim, that is altogether beyond the evaluation in terms of the ordinary notion of authority. Moreover, I shall argue that to aim at truth is a condition of possibility for justifying the authority of any other aims or norms. In this sense, to aim at truth is a hinge of deliberation. Recent works in epistemology show that the claim that coherence is truth conducive – in the sense that, given suitable ceteris paribus conditions, more coherent sets of statements are always more probable – is dubious and possibly false. From this, it does not follows that coherence is a useless notion in epistemology and philosophy of science. Dietrich and Moretti (Philosophy of science 72(3): 403–424, 2005) have proposed a formal of account of how coherence is confirmation conducive—that is, of how the (...) coherence of a set of statements facilitates the confirmation of such statements. This account is grounded in two confirmation transmission properties that are satisfied by some of the measures of coherence recently proposed in the literature. These properties explicate everyday and scientific uses of coherence. In his paper, I review the main findings of Dietrich and Moretti (2005) and define two evidence-gathering properties that are satisfied by the same measures of coherence and constitute further ways in which coherence is confirmation conducive. At least one of these properties vindicates important applications of the notion of coherence in everyday life and in science. (shrink)

How psychopaths and their capacity for moral action are viewed is not only philosophically interesting but is also important and relevant for policy. The philosophical discussion of psychopathy has focussed upon the psychological faculties that are prerequisites for moral responsibility and empirical findings regarding psychopathy that are relevant to philosophical accounts of moral understanding and motivation. However, there are legitimate worries about whether psychopathy is a robust scientific construct, and there are risks attached to reifying psychopathy or other psychiatric constructs. (...) We defend the concept of psychopathy by pointing out the relevance of empirical studies about it for our ordinary practices of ascribing moral responsibility and folk psychological accounts of moral understanding and motivation. Most countries have been struggling with the spread of the COVID-19 pandemic imposing social isolation on their citizens. However, this measure carried risks for people's mental health. This study evaluated the psychological repercussions of objective isolation in 1,006 Italians during the first, especially strict, lockdown in spring 2020. Although varying for the regional spread-rate of the contagion, results showed that the longer the isolation and the less adequate the physical space where people were isolated, the worse the mental health. Offline (...) social contacts buffered the association between social isolation and mental health. However, when offline contacts were limited, online contacts seemed crucial in protecting mental health. The findings inform about the potential downsides of the massive social isolation imposed by COVID-19 spread, highlighting possible risk factors and resources to account for implementing such isolation measures. Specifically, besides some known factors such as physical space availability, the local contagion rate is critical in moderating the link between social isolation and mental health issues, supporting national policies implementing regional tiers of restriction severity.
