ZusammenfassungDie rechtliche Regelung der Fortpflanzungsmedizin ist dringend reformbedürftig. Das Embryonenschutzgesetz von 1990 erfasst die neuesten technischen Entwicklungen nicht, ist in manchen Bereichen unstimmig und lückenhaft, setzt die betroffenen Frauen, Paare und Kinder unnötigen gesundheitlichen Risiken aus, erschwert paradoxerweise die Durchsetzung von Kinderrechten und erzeugt Gerechtigkeitsprobleme und Rechtsunsicherheit für die betroffenen Paare und die behandelnden Ärztinnen und Ärzte.Das Embryonenschutzgesetz enthält zudem nur strafrechtliche Verbote. Diese erlauben keine angemessene Reaktion auf die medizinische Entwicklung und den gesellschaftlichen Wandel und werden der Komplexität der (...) Materie nicht gerecht.Diese Probleme müssen gelöst werden. Der Bundesgesetzgeber verfügt seit mehr als 20 Jahren über die Kompetenz zur Regelung der Fortpflanzungsmedizin. Er sollte in der kommenden Legislaturperiode ein umfassendes Fortpflanzungsmedizingesetz schaffen. (shrink)

Research suggests that sedentary behavior is negatively associated with cognitive outcomes. Interrupting prolonged sitting has been shown to improve cognitive functions, including executive functioning, which is important for academic performance. No research has been conducted on the effect of standing on EF in VET students, who make up a large proportion of the adolescent population and who are known to sit more than other students of this age. In this study, we investigated the acute effects of reducing SB by short (...) time standing on EF in vocational education and training students. In a randomized crossover study, 165 VET students were first taught for 15 min in seated position. After this, they performed while seated the Letter Memory Test for updating, and the Color Shape Test for shifting and inhibition. Students were randomly assigned to a sitting or standing condition. All students were taught again for 15 min and then took the same tests in the condition they were allocated to, respectively, standing or seated. After 1 week, the test procedure was repeated, in which students switched conditions. Mixed model analyses showed no significant effect of sitting or standing on updating, shifting, or inhibition. Also, no significant differences were found for the order of condition on updating, shifting, or inhibition. Our results suggest that 40 min of standing does not significantly influence EF among VET students. (shrink)

Background Genuine uncertainty on superiority of one intervention over the other is called equipoise. Physician-investigators in randomized controlled trials need equipoise at least in studies with more than minimal risks. Ideally, this equipoise is also present in patient-participants. In pediatrics, data on equipoise are lacking. We hypothesize that 1) lack of equipoise at enrolment among parents may reduce recruitment; 2) lack of equipoise during participation may reduce retention in patients assigned to a less favoured treatment-strategy. Methods We compared preferences of (...) parents/patients at enrolment, documented by a questionnaire, with preferences developed during follow-up by an interview-study to investigate equipoise of child-participants and parents in the BeSt-for-Kids-study. This trial in new-onset Juvenile Idiopathic Arthritis-patients consists of three strategies. One strategy comprises initial treatment with a biological disease-modifying-antirheumatic-drug, currently not standard-of-care. Semi-structured interviews were conducted with 23 parents and 7 patients, median 11 months after enrolment. Results Initially most parents and children were not in equipoise. Parents/patients who refused participation, regularly declined due to specific preferences. Many participating families preferred the biological-first-strategy. They participated to have a chance for this initial treatment, and would even consider stopping trial-participation when not randomized for it. Their conviction of superiority of the biological-first strategy was based on knowledge from internet and close relations. According to four parents, the physician-investigator preferred the biological-first-strategy, but the majority stated that she had no preferred strategy. In phase 2, preferences tended to change to the treatment actually received. Conclusions Lack of equipoise during enrolment did not reduce study recruitment, mainly due to the fact that preferred treatment was only available within the study. Still, when developing a trial it is important to evaluate whether the physicians’ research question is in line with preferences of the patient-group. By exploring so-called ‘informed patient-group’-equipoise, successful recruitment may be enhanced and bias avoided. In our study, lack of equipoise during trial-participation did not reduce retention in those assigned to a less favoured option. We observed a change for preference towards treatment actually received, possibly explained by comparable outcomes in all three arms. (shrink)

Upon hearing “Some of Michelangelo’s sculptures are in Rome,” adults can easily generate a scalar implicature and infer that the intended meaning of the utterance corresponds to “Some but not all Michelangelo’s sculptures are in Rome.” Comprehension experiments show that preschoolers struggle with this kind of inference until at least 5 years of age. Surprisingly, the few studies having investigated children’s production of scalar expressions like some and all suggest that production is adult-like already in their third year of life. (...) Thus, children’s production of implicatures seems to develop at least 2 years before their comprehension of implicatures. In this paper, we present a novel account of scalar implicature generation in the framework of Bidirectional Optimality Theory: the Asymmetry Account. We show that the production–comprehension asymmetry is predicted to emerge because the comprehension of some requires the hearer to consider the speaker’s perspective, but the production of some does not require the speaker to consider the hearer’s perspective. Hence, children’s comprehension of scalar expressions, but not their production of scalar expressions, is predicted to be related to their theory of mind development. Not possessing fully developed theory of mind abilities yet, children thus have difficulty in comprehending scalar expressions such as some in an adult-like way. Our account also explains why variable performance is found in experimental studies testing children’s ability to generate scalar implicatures; moreover, it describes the differences between children’s and adults’ implicature generation in terms of their ability to recursively apply theory of mind; finally, it sheds new light on the question why the interpretation of numerals does not require implicature generation. Gerhard Ebeling on faith. Gerhard Ebeling (1912–2001), not only the foremost Luther researcher of the previous century but also one of the most prominent contributors to protestant theology during that period, wrote extensively about faith throughout his long and productive life as a professional theologian. He learnt from Luther that discerning judgement in the differentiation of related matters forms the basis of all sound theology. Applying this insight to his own thought, he reflects on the development of the phenomenon of (...) faith in the Old Testament community and early Christianity and the formalisation of the concept for use in the domain of religious studies. He defends the argument that Christian faith is not only faith in Jesus as the Christ and Lord but also that Jesus, and He only, is the founder and perfecter of faith. The concept of faith is also explored by Ebeling in relation to love, life and reason. The article concludes with a critical evaluation of Ebeling’s contribution in guiding us to witness authentically about our own faith in Jesus Christ within our own situation and against the background of the problems it poses for believing in Christ. International business organizations are regularly addressed on their corporate social responsibility (CSR). As illustrated in this paper, it is not yet clear exactly what CSR means to organizations and how to deal with it. In this paper, the authors explore how a sensemaking approach helps to understand the business challenges of CSR within an organizational context. The theories of Karl Weick are applied to the experiences of CSR in Royal Dutch Shell. The authors argue that the key to CSR in (...) international business organizations is to engage stakeholders and start a process of joint sensemaking. Three main competencies are crucial in this: the competency to engage stakeholders through listening and understanding; the creation of an organizational language so that CSR makes sense to members of the organization; and recognizing the momentum of taking action. It is suggested that consciousness is primarily associated not with stimuli and perception, as commonly supposed, but with movement and responses. Consciousness of stimuli arises in situations in which possible movements are planned, or in which information must be actively acquired rather than passively registered, and may or may not require overt movements to be performed. By emphasizing response, this formulation provides a simple explanation for the perceived unity of consciousness: though stimuli can be diverse, with independent components, movements must (...) necessarily be coordinated. Therefore, if we are to look for a `site' for consciousness, it is likely to be in a region such as the anterior cingulate that is neurally close to the higher motor hierarchical levels, and also accessible both to real sensory feedback and also to virtual feedback derived through mechanisms of efference copy from actual or proposed motor commands. It is suggested that synchrony of arrival of such information may be an important prerequisite of this unity, and that on this basis such a `master node' might be expected to be temporally `equidistant' from each of these sources; this may well be true of the anterior cingulate, but no doubt also of other structures. Health care reform poses numerous challenges. A core challenge is to make health care more efficient and effective without causing more harm than benefit. Additionally, those fashioning health-care policy must encourage patients to exercise caution and restraint when expending scarce resources; restrict the ability of politicians to advance their careers by promising alluring but costly entitlements, many of which they will not be able to deliver; face the demographic challenges of an aging population; and avoid regulations that create significant inefficiencies (...) and restrict access to health care. Given such real-world challenges, how should health care be reformed in the United States or elsewhere? This number of The Journal of Medicine and Philosophy examines many of the complex issues that must be considered in reforming a health-care system. (shrink)

Esprit, l’un des mots clés des Pensées, reçoit chez Pascal deux significations : la raison et le souffle intérieur. Si l’esprit en tant que mens rationalis appartient au deuxième ordre, l’esprit en tant que mens spiritualis relève du troisième ordre. Deux dualismes se croisent dans la distinction pascalienne des trois ordres : le premier de nature philosophique, cartésienne, oppose le premier ordre, voué au corps, et les deuxième et troisième ordres, voués à la mens ; le second, de nature éthico-religieuse, (...) oppose le premier et le deuxième ordres, ordres de la cupidité, au troisième ordre, celui de la charité. Au-dessus de l’esprit/raison se tient l’esprit/amour. Pascal tisse, au sein du troisième ordre, un lien entre l’esprit et le cœur. Dans la notion de spiritus cordialis, d’esprit cordial, se situe l’apport essentiel de l’auteur des Pensées.« Esprit », one of the key-words of Pascal’s Pensées, has two meanings according to Pascal : i.e. reason and interior creative inspiration. If esprit as mens rationalis belongs to the second order, esprit as mens spiritualis refers to the third order. Two dualisms cross themselves within the Pascalian distinction of three orders. The former – of a philosophical nature, i.e. Cartesian – opposes the first order, devoted to the body and the second and third order devoted to the mens ; the latter – of an ethico-religious nature – opposes both the first and second order, i.e. the orders of cupidity to the third order, i.e. that of charity. The esprit as love rests above the esprit as reason. Pascal weaves, amid the third order a link between the esprit and the heart. The major contribution of the author of the Pensées rests in the concept of spiritus cordialis. (shrink)

Africa’s current socio-economic predicament is often solely attributed to political and economic mismanagement. However, such an analysis is far from comprehensive, as it fails to account for the historical, sociological and psychological causes of the current unsatisfactory social conditions in the continent. Consequently, using the critical and prescriptive techniques of philosophic reflection, this paper examines four apparent mental impediments to desirable social transformation in contemporaryAfrica, namely, conservatism, feeble social consciousness, blind acceptance of the white-black dichotomy, and a fixation with foreign (...) paradigms of managing public affairs. The paper calls for an interdisciplinary approach to the verifying, mitigating and/or eliminating of these impediments. (shrink)

The issue of energy and its potential localizability in general relativity has challenged physicists for more than a century. Many non-invariant measures were proposed over the years but an invariant measure was never found. We discovered the invariant localized energy measure by expanding the domain of investigation from space to spacetime. We note from relativity that the finiteness of the velocity of propagation of interactions necessarily induces indefiniteness in measurements. This is because the elements of actual physical systems being measured (...) as well as their detectors are characterized by entire four-velocity fields, which necessarily leads to information from a measured system being processed by the detector in a spread of time. General relativity adds additional indefiniteness because of the variation in proper time between elements. The uncertainty is encapsulated in a generalized uncertainty principle, in parallel with that of Heisenberg, which incorporates the localized contribution of gravity to energy. This naturally leads to a generalized uncertainty principle for momentum as well. These generalized forms and the gravitational contribution to localized energy would be expected to be of particular importance in the regimes of ultra-strong gravitational fields. We contrast our invariant spacetime energy measure with the standard 3-space energy measure which is familiar from special relativity, appreciating why general relativity demands a measure in spacetime as opposed to 3-space. We illustrate the misconceptions by certain authors of our approach. (shrink)

This text is an innovative exploration of philosophy and madness in the context of the critical engagement of Heidegger’s phenomenological ontology with Freudian psychoanalysis. Included is a play in which, after a mental breakdown, Martin Heidegger undergoes psychoanalytic treatment from Dr. Medard Boss. Boss is essentially caught between two intellectual giants: his patient, Heidegger, who challenges him to evolve beyond traditional Freudian psychoanalysis, and his mentor, Freud, who acts as a “ghostly” consultant in facilitating Heidegger’s return to health. The dialogue (...) of the play consists of actual quotes taken from the major thinkers themselves, which enhances the authenticity of this fictitious production. In addition, the theoretical perspectives of Freud, Heidegger, Boss, and Ludwig Binswanger are included to enhance the readers’ background knowledge. In the process of disclosing these brilliant theorists, this book uncovers what each orientation has to offer the others. (shrink)
