This article investigates a high-profile and ongoing dilemma for healthcare professionals (HCPs), namely whether the existence of a (legal) duty of care to genetic relatives of a patient is a help or a hindrance in deciding what to do in cases where a patient’s genetic information may have relevance to the health of the patient’s family members. The English caseABC v St George’s Healthcare NHS Trust and othersconsidered if a duty of confidentiality owed to the patient and a putative duty (...) of care to the patient’s close relatives could coexist in this context. This article examines whether embracing the concept of coexisting duties could enable HCPs to respect duties in line with their clinical judgement, thereby providing legal support and clarity to professionals to allow them to provide the best possible genetics service to both the patient and their family. We argue that these dual duties, framed as a novel, composite duty to consider the interests of genetic relatives, could allow HCPs to exercise and act on their professional judgements about the relative value of information to family members, without fears of liability for negligence or breach of confidence. A number of anthropologists have argued that religious concepts are minimally counterintuitive and that this gives them mnemic advantages. This paper addresses the question of why people have the memory architecture that results in such concepts being more memorable than other types of concepts by pointing out the benefits of a memory structure that leads to better recall for minimally counterintuitive concepts and by showing how such benefits emerge in the real‐time processing of comprehending narratives such as folk tales. This (...) model suggests that memorability is not an inherent property of a concept; rather it is a property of the concept, the context in which the concept is presented, and the background knowledge that the comprehendor possesses about the concept. The model predicts how memorability of a concept should change if the context containing the concept were changed. The paper also presents the results of experiments carried out to test these predictions. (shrink)

The emerging field of cognition and culture has had some success in explaining the spread of counterintuitive religious concepts around the world. However, researchers have been reluctant to extend its findings to explain the widespread occurrence of culturally counterintuitive ideas in general. This article develops a broader notion of social counterintuitiveness to include ideas that violate shared expectations of a group of people and argues that the notion of social counterintuitiveness is more crucial to explaining cultural success of surprising ideas (...) than the traditional notion of individual counterintuitiveness. Building on the context-based account of individual counterintuitiveness, the article also outlines how the once unorthodox cultural ideas become conventionalized over time only to be swept under the next wave of cultural innovation. By helping us peel away the layers of tradition that weave together the multilayered tapestry of culture, this account can be useful for understanding the development of cultural scaffolding that is needed to support the spread of maximally counterintuitive concepts such as widespread religious concepts of God and ghosts. The article presents the conceptualization of philosophical education, in the context of which the evolution of the development of society from informational to smart society takes place. The purpose of the article is to reveal the conceptualization of philosophical education in the context of the idea of a smart society and to show that philosophical education does not stand still but develops along with the development of science and technology, which requires the development of a conceptual and categorical apparatus. Research (...) objectives: to show the development of philosophical knowledge, in the context of which new innovative ideas are ripening; to reveal that the concept of a smart society is based on the expectation or belief in the ability of modern smart technologies to positively influence social processes and lead to a new qualitative state of all social life, which is called a smart society; to prove that much in solving all these problems depends on the state of education, including philosophical and ideological, not only developing our cognitive abilities, but also forming a responsible and demanding attitude to goal setting, the choice of basic life values. Analysis of recent research and publications, which presents a solution to this problem. We rely on the works of I.Ardashkin, V.Voronkova, M.Kastels, O.Kivlyuk, K.Korsak, A.Lazarevich, R.Oleksenko, O.Punchenko, which in one way or another reflected the problem of the formation of a smart society. The research methodology is the dialectical, historical, systemic, informational methods, which allowed to penetrate deeply into the evolution of philosophical knowledge that is not in mass, but develops with the development of science, technique and technology. The result of research - based smart society the development of information and computer technologies that lead to breakthrough technologies and innovative development It is noted that the proposed reorganization of the system of social-humanitarian education in the universities of the Republic of Belarus intended to raise to the level of philosophical training of domestic specialists. RESUMEN. En este artículo se analiza (y cuestiona) la tesis de la vulnerabilidad de la jurista estadounidense Martha A. Fineman. El trabajo se estructura en cinco apartados en los que el paradigma de Fineman es sucesivamente contextualizado, proyectado sobre la jurisprudencia del TEDH y comparado con otras contribuciones críticas al Derecho antidiscriminatorio. El trabajo finaliza con una breve conclusión en la que, aun reconociendo la validez del diagnóstico y la loable finalidad que mueve la teoría de Fineman, pone en duda (...) la virtualidad de la misma como inspiración de un nuevo y necesario concepto de igualdad jurídica. ABSTRACT. This article analyzes (and argues) the American legal scholar Martha A. Fineman’s thesis about vulnerability. It is divided into five sections in which Fineman’s paradigm is successively contextualized, projected to the ECtHR cases on vulnerability and compared with other critical contributions to Antidiscrimination Law. It ends with a brief conclusion that, while recognizing the validity of the diagnosis and the laudable purpose that moves Fineman’s theory, it is critical about taking it as inspiration for a new and necessary concept of legal equality. Recent advances in wireless technologies have led to the development of intelligent, in-vehicle safety applications designed to share information about the actions of nearby vehicles, potential road hazards, and ultimately predict dangerous scenarios or imminent collisions. These vehicle safety communication (VSC) technologies rely on the creation of autonomous, self-organizing, wireless communication networks connecting vehicles with roadside infrastructure and with each other. As the technical standards and communication protocols for VSC technologies are still being developed, certain ethical implications of these new (...) information technologies emerge: Coupled with the predicted safety benefits of VSC applications is a potential rise in the ability to surveil a driver engaging in her everyday activities on the public roads. This paper will explore how the introduction of VSC technologies might disrupt the “contextual integrity” of personal information flows in the context of highway travel and threaten one’s “privacy in public.” Since VSC technologies and their related protocols and standards are still in the developmental stage, the paper will conclude by revealing how close attention to the ethical implications of the remaining design decisions can inform and guide designers of VSC technologies to create innovate safety applications that increase public safety, but without compromising the value of one’s privacy in public. The current behavioral consultation case demonstrates how functional behavioral assessment (FBA) data, basic and applied research, teacher preferences, and contextual variables contribute to the decision making process when developing classroom intervention procedures. A male, African-American, fifth-grade general education student was initially referred for his inappropriate vocalizations duringtime designated for independent seatwork. FBA data suggested that this behavior was being reinforced with teacher attention. Additional data showed that he was failing to complete his assignments. An intervention was implemented where the student (...) was given assignments one a time. He was instructed to solicit teacher attention and his next assignment after completing each assignment. Analysis ofteacher ratings for inappropriate vocalizations and assignment performance data suggest that the intervention was effective in increasing assignment completion and decreasing inappropriate verbalizations. Discussion focuses on how the various data playa role in the development and implementation of classroom intervention procedures. (shrink)

By the colours and decoration of a vase fragment one determines the period and style to which the original belonged; while its physical contours show from what part of the original it comes. The material may be insufficient for a reconstruction of the whole design. But it is often legitimate to go beyond what is actually contained in the preserved pieces.

Quantum mechanical measurements on a physical system are represented by observables - Hermitian operators on the state space of the observed system. It is an important question whether all observables may be realized, in principle, as measurements on a physical system. Dirac’s influential text ( [1], page 37) makes the following assertion on the question: The question now presents itself – Can every observable be measured? The answer theoretically is yes. In practice it may be very awkward, or perhaps even (...) beyond the ingenuity of the experimenter, to devise an apparatus which could measure some particular observable, but the theory always allows one to imagine that the measurement can be made. The history of moral dilemma theory often ignores the medieval period, overlooking the sophisticated theorizing by several thinkers who debated the existence of moral dilemmas from 1150 to 1450. In this book Michael V. Dougherty offers a rich and fascinating overview of the debates which were pursued by medieval philosophers, theologians and canon lawyers, illustrating his discussion with a diverse range of examples of the moral dilemmas which they considered. He shows that much of what seems particular to twentieth-century moral (...) theory was well-known long ago - especially the view of some medieval thinkers that some forms of wrongdoing are inescapable, and their emphasis on the principle 'choose the lesser of two evils'. A metaphysical strand of C. S. Peirce’s American pragmatism resonates deeply in potential alliance with “incorporeal feminism”: a transcontinental philosophy with origins in Luce Irigaray’s ethics of sexual difference. A psychoanalyst trained by Lacan himself, Irigaray analyzes the unconscious of various philosophical systems, revealing dualism as an underlying phallic structure. In the dualism between idealism and materialism, she explains, the terms become sexually coded: idealism, paternal-masculine; materialism, maternal-feminine. Incorporeal feminism does not merely invert the roles, but radically reimagines the relation (...) between them, postulating the ideal as a maternal condition of possibility for birthing the material into existence; not separate substances but the inseparable activity of materiality making itself. For Peirce, ideas act; and though he was by no means a feminist, his metaphysics lend at least three insights to incorporeal feminism: an alternative to dualism in the trichotomic categories “firstness, secondness, and thirdness”; an evolutionary cosmology where the material universe is a gestating embryo within a womb; and an objective idealism: a model for addressing the dilemma of when sexual difference begins. Within “firstness,” sexual difference is ideal; an incorporeal activity pre-existing and latently imbuing materiality to varying degrees, ultimately expressing itself in certain life-forms as bodily differences. In the opinion of Aristotle and Plutarch the growth of latifundia and consequent decline of the citizen population at Sparta were due to the absence of restrictions on gifts and bequests of land. According to Plutarch this freedom of gift and bequest, so far as it applied to the κλροι or entailed estates, was introduced by the τρα of an ephor named Epitadeus, who removed the ban on gift and bequest imposed by Lycurgus.

Several US states are enacting 'right-to-die' laws, in the wake of the Karen Quinlan case. But the way such a law is drafted may cast doubt on a patient's existing common law right to control all aspects of his own treatment; it may give legal sanction to a lower standard of medical care that society at present expects from doctors; and it may lead to conflict between the patient's directive and his doctor's clinical judgement which cannot readily be resolved. The (...) laws themselves are categorised as a) legalising active killing or b) defining rights of patients to control treatment or c) assigning to others the rights to control treatment where the patient is not competent. The California law is discussed critically. The conclusion is that such legislation is not a satisfactory answer to the ethical problem of euthanasia. (shrink)

There is a theistic argument which is discussed at least twice in the Hume corpus, both times rather perfunctorily. This perfunctoriness has carried over to some of his commentators, who are not always clear as to what the argument is or about the force of Hume’s comments on it. On page 23 of A Letter from a Gentleman to his Friend in Edinburgh Hume calls it “the metaphysical Argument a priori” and in Part 9 of Dialogues concerning Natural Religion simply (...) “the argument a priori”.1 It is the argument of Demea. The 14th general election in Malaysia held on May 9, 2018 is anhistoric event that altered the political landscape of the nation.
