Herder, the German humanist from the end of the 18th century, a representative of Weimar classicism and of the Sturm und Drang movement, man of letters, philosopher of history, defender of popular cultures, advocate of the uniqueness and importance of every civilization. The ways in which one may summarize his legacy extend even further. The present paper will focus on the philosophy of history. We will prove that his writings reveal a complex and solid theory of barbarianism, topical for 21st (...) century Europe. First of all, we aim to clarify the multiple meanings of this concept, identifying both the historical data and the theoretical principles behind it. In this way, the grounds on which Herder executed a radical overthrow of the Enlightenment conception upon the barbarian will be revealed. Subsequently should derive the relativity of the “civilization–barbarism” opposition, as well as the anticipation of Hegel’s idea that history necessarily continues through the barbarian. Finally, we aim to provide reasonably founded answers to the questions generated by this thesis: 1. What are the qualities that confer on the barbarian the possibility of creating history? – in other words, what turns him from supporting actor into a collective agent able to change the course of history? 2. Is there a law of history that decides whether some barbarians are doomed to perish, while others build empires? (shrink)

Admiration is thought to have essential functions for social interaction: it inspires us to learn from excellent models, to become better people, and to praise others and create social bonds. In intergroup relations, admiration for other groups leads to greater intergroup contact, cooperation, and help. Given these implications, it is surprising that admiration has only been researched by a handful of authors. In this article we review the literature, focusing on the definition of admiration, links to related emotions, measurement, antecedents, (...) and associated behaviors. We propose a conceptual model of admiration that highlights admiration’s function for approaching and emulating successful models, thus contributing to social learning at the interpersonal level and to cultural transmission at the group and societal level. ABSTRACT Academic dishonesty has been found to be on the increase globally, affecting the quality of education, ethics of professional practices and career outcome. Substantial literature exists on the role of religious commitment in reducing academic dishonesty, but few or no studies have examined the pathways explaining this link. The present study examined whether self-efficacy mediates the relationship between RC and AD. Undergraduates of the University of Nigeria, Nsukka completed the Academic Dishonesty Scale, Religious Commitment Inventory and New General Self-Efficacy (...) Scale and also provided relevant demographic information. Results of statistical analysis indicated that RC was negatively associated with AD. Self-efficacy was also a partial mediation in the relationship between RC and AD. This implies that self-efficacy contributes to the pathways through which RC influences AD among students. Our findings suggest that consideration of students’ level of self-judgment on their ability to cope with academic demands may be an important target toward enhancing the influence of RC in reducing academic dishonest behaviors among students. We present an analysis of over 400 comments about complying with tax obligations extracted from online discussion forums for freelancers. While the topics investigated by much of the literature on taxpayer behaviour are theory driven, we aimed to explore the universe of online discussions about tax in order to extract those topics that are most relevant to taxpayers. The forum discussions were subjected to a qualitative thematic analysis, and we present a model of the ‘universe’ of tax as reflected in (...) taxpayer discussions. The model comprises several main actors and describes the multiple ways in which they relate to taxpayers’ behaviour. We also conduct a more focused analysis to show that the majority of taxpayers seem unconcerned with many of the variables that have been the focus of tax behaviour research, and that most people are motivated to be compliant and are more concerned with how to comply than whether to comply. Moreover, we discuss how these ‘real-world’ tax discussions question common assumptions in the study of tax behaviour and how they inform our understanding of business ethics more generally. In the context of increasingly numerous cultural and political contradictory debates, humanities are facing the difficult responsibility of removing the veil of ambiguity and doubt. However, they cannot fulfil this task without first undertaking a rigorous return upon themselves, their own fundaments, methods and targeted objects. This book investigates the influence of G.W.F. Hegel on these sciences during their long and controversial process of transformation and consolidation. For this purpose, the author developed, on Gadamer’s suggestions, a dialectical-hermeneutical method able to (...) overcome the insufficiencies of both historical and systematic approaches and to properly take into account the significant references to authors of the Modern Age and the Contemporary Era. In his attempt to advance a speculative model for the present-day social and political sciences, the author brings a new light on some renowned topics including agency in history (Napoleon – Weltgeist or Weltseele on horseback?), the inner structure of the interpreter (Gadamer between Hegel and Heidegger) and the critical concept of alienation (an overthrow or continuity of absolute idealism?), among others. Academic dishonesty (AD) is a threat to quality education, ethics of professional practices and career outcomes. Psychopathy is connected to AD. This study investigated whether academic confidence (AC) mediates the relationship between psychopathy and AD. University students (N = 335, mean age = 18.38 years) completed measures of relevant variables, in addition to providing demographic details. Results of statistical analysis showed that AC mediated the association between primary psychopathy and AD. Considering the extent of students' belief, trust and expectation that (...) they can execute their academic tasks by themselves could be important target in enhancing ethical behaviors among students. This article uses the example of the feminist movement in Latin America and the Caribean to analyse the way in which the UN and its allied organisations neutralise anti-establishment social movements by urging then to « participate » in its project of global « good governance ». By studying the « population politics » of international institutions and the question of micro-credit schemes for women, we see how the UN presented itself as an « ally » to women and managed (...) to recruit a part of the feminist movement to its own project, even though it was carrying out policies that were absolutely disastrous for women, and in particular for the poor women of the Southern hemisphere. Abstrac. The work argues the activation of the competence of the UN Security Council to review the complex humanitarian emergency situation in Venezuela, and adopt as a provisional measure a Humanitarian Electoral Intervention (IHE), which allows to settle and alleviate conflicts by holding some general elections, based on the experience of Cambodia (1992-1993) and Timor Leste (2001-2002), and thus ruling out any possibility of violence in the Venezuelan conflict, also removing any possibility of military intervention, bearing in mind that the (...) continuity or aggravation they constitute a threat to regional and world peace and security. A guerra civil iniciada no final de 2013 no Sudão do Sul causou, pela primeira vez na história das Nações Unidas, um afluxo gigantesco de deslocados internos para o interior de bases da Missão das Nações Unidas no Sudão do Sul, em busca de proteção. Assim, foram criados os Protection of Civilian Sites. Com a chegada de dezenas de milhares de pessoas em poucas semanas, houve um enorme crescimento nas demandas humanitárias e de segurança. This paper explores the apparently fairness of the United Nations’ collective security system, through an indicator: the attention paid, in terms of amount of resolutions, by the Security Council to the major episodes of political violence within the second half of twentieth century where the principle of “responsibility to protect” should have been activated. This study, however, is embedded into a wider context: the social conditions which allowed for the emergence of the modern State. The underlying thesis points out that (...) those same conditions had to be present at the international before a global organism with real capacity to order the world may appear. Along this line of thought, the paper resorts to the experience of the Human Rights Effectiveness Institute in the process of developing a human rights effectiveness index. (shrink)

El presente trabajo recupera, caracteriza y evalúa el marco antropológico subyacente en la Declaración de los Derechos Humanos de 1948. Para este propósito, se utilizó como metodología el análisis del discurso y una evaluación antropológica de su contenido en relación directa con la Bioética contemporánea y sus problemas más sobresalientes.

In this article, we present findings from a participatory action research program in France on the exercise of human rights and supported and substitute decision-making, inspired by the United Nations Convention on the Rights of Persons with Disabilities (“CRPD”). Bringing together persons with the lived experience of disability, academics, and health and social care and support professionals, the project used the method of “experience-based construction of public problem” to transform experience into collective expertise. This enabled the exploration of support that (...) persons in vulnerable situations, whose capacity to exercise their human rights has weakened, need to make decisions in their lives and participate meaningfully in public debate. The relationship between the awareness of rights and exercise of rights is discussed. We argue for the need to balance out the positions of different contributors in participatory action research, in a reasoned manner, by recognizing the scientific and citizen-based participation of all partners. Ce texte revisite le processus de consécration et d’universalisation des droits des femmes au gré des quatre conférences mondiales organisées par l’ONU de 1975 à 1995. Il interroge le récit linéaire d’un « féminisme global » dont la caractéristique est de ne pas prendre en compte les tensions développées durant la guerre froide autour d’acceptions contradictoires des droits des femmes dans les deux camps, capitaliste et socialiste. Après un bref retour sur les principaux acquis des recherches qui ont étudié les (...) efforts militants déployés dans les cadres onusiens depuis 1975, ce sont les contextes d’énonciation du « féminisme global » ainsi que la trajectoire sociale d’une de ses principales théoriciennes qui sont ensuite abordés pour élucider les mécanismes sociaux de production des références idéologiques à vocation « globale » comme les « droits humains des femmes » et le gender mainstreaming, qui émergent au début des années 1990. El artículo describe la decisiva participación de los países América Latina y de sus juristas en el desarrollo del Derecho del Mar, desde el cuestionamiento del Derecho clásico a partir de la Declaración de Santiago (1952) a su modernización en la III Conferencia de la ONU sobre el Derecho del Mar. Expone la disparidad de posiciones entre los Estados “territorialistas” y los “patrimonialistas”, especialmente desde la Declaración de Santo Domingo (1972) que elaboró la noción de “mar patrimonial”, que sirvió de (...) fundamento para la aceptación en la Conferencia de la Zona Económica Exclusiva. El autor -protagonista directo en la Conferencia en su calidad de jefe-adjunto de la delegación española- narra las principales intervenciones de las distintas delegaciones iberoamericanas sobre los principales temas y cuestiones abordados por la Conferencia en sus 11 sesiones, y los avatares que llevaron a la adopción de la Convención de Montego-Bay sobre Derecho del Mar de 1982. En 2015, la ONU aprobó 17 Objetivos de Desarrollo Sostenible (ODS) integrados en la Agenda 2030. Siguiendo esta línea, y dada su relevancia, las universidades europeas están integrando el desarrollo sostenible en sus planes de estudio. El objetivo de esta propuesta consistirá en desarrollar una experiencia piloto donde nuestros estudiantes a través del aprendizaje cooperativo formen equipos de trabajo agrupados según el test Riso-Hudson (1999) garantice el máximo rendimiento. Como resultado se ofrecerá una medida de la rentabilidad que aporta la (...) incorporación de la sostenibilidad en los proyectos de inversión empresariales a la par que la creación de valor sostenible. Verili bir durumu anlamayı, onu bir bütün olarak kurgulamak olarak düşünelim. Kurgu basit bir gösterge de olabilir, karmaşık bir yapı da olabilir; belli belirsiz bir iz veya izler toplamı da olabilir. Kurgunun işlevini yerine getirmesini sağlayan gerek ve yeter koşul verili olan durum ile kendi yapısı arasında bir karşılaştırma olanağını sağlamasıdır. Nitekim, en bilindik anlamda bir durumu kurgulamak onu bir başka durumla karşılaştırmaktır. Bu yüzden de karşılaştırma yapmayı anlama yetimiz için ön dayanak olan bir alt-yeti olarak tanımlayabiliriz. Bu alt-yetinin edimsel (...) doğasına ilişkin bazı sorulara yanıt aramak istersek, karşılaştırma dediğimiz edimin doğal koşullarını incelememiz gerekir. Bu bildiride karşılaştırma ediminin doğal koşullarını betimlemeyi amaçlayan bir çerçeve çizmeye ve böylelikle anlama yetimizin ön dayanaklarının edimsel doğasını uygun bir biçimde nasıl yorumlayabileceğimiz sorusuna yanıt vermeye çalışacağım. Cet article propose d’abord une analyse de la représentation de la personne souffrant de handicap ou de troubles mentaux telle qu’elle existe dans l’appel à la désinstitutionnalisation lancé par le Comité des droits des personnes handicapées (ONU). Il montre ensuite comment cette anthropologie, exigeante et parfaitement en phase avec les idéaux d’une société où l’autonomie individuelle est un droit et un devoir de chacun, est négociée en pratique sur le terrain d’un établissement de santé mentale qui accompagne les sorties de (...) l’institution de leurs patients au terme de leur séjour. Il prend pour objet empirique un dispositif central de ce processus, les “réunions-partenaires” et les échanges qui s’y tiennent entre le patient et d’autres acteurs. Le chapitre montre que, loin de l’abstraction des textes juridiques, la perception par les soignants du patient comme un partenaire est un processus fragile. Le partenariat est toujours conditionné au fait que les soignants soient non pas inquiets par l’incapacité d’une personne à se prendre en charge, mais rassurés par la démonstration de son appétence et de ses compétences pour l’autonomie. Dans ces négociations, le patient en santé mentale est toujours potentiellement, mais jamais totalement le partenaire de sa sortie de l’institution. (shrink)

Muhyiddin ibn Arabî, İslam'daki tartışmasız en etkili sufi teorisyendir. Kalıcı şekilde en popüler çalışması olan Fusûsül-hikem'de, Kur'an'da bir peygamber hakkında algımız ne olursa olsun, onunla ilişkilendirilen ve ondan türetilen hikmetin çok farklı olduğunu açıkça ve ısrarla göstermektedir. Bu, İbn Arabî'nin Kur'an'ın literal metnini inkar ettiği anlamına gelmez. Tam tersine, O sadece Kur'an'ı farklı algılama ve alımlama düzeylerinin olduğunu iddia eder: Kur'an'ın dış gerçekliği (zâhir) kitlesel tüketim içindir ve İbn Arabî'ye göre kişinin Kur'an'ın yüzeysel bir anlayışından elde ettiği bilgidir. Bununla birlikte, (...) Kuran'ın, ariflerin (arifûn) korumasında olan daha derin bir anlayışı vardır. İbn Arabî, dış gerçeğin ötesine geçen, ancak ona (dış gerçekliğe) ayrılmaz bir şekilde bağlı olan Kur’an’ı bu şekilde okumasıyla, Kur'an'ın tasavvufi tefsir geleneğini kendi tarzında sürdürür ve birincil amacını Fusûs’un her bölümünde uygular: Her ikisinin de meşruiyetini korurken, Kur'an'ın zâhir ve bâṭını arasındaki antitezi vurgulamak ve hatta bâṭına ancak ẓâhir yoluyla erişilebileceğini iddia edecek kadar ileri gitmek. Bu makale, bu karşılıklı bağımlı bilgi ('ilm)/hikmet (hikma) antitezinin en açık örneklerini bulduğumuz ve belirli nedenlerle seçilmiş Fusûs'un dört bölümünü detaylı şekilde incelemektedir: Adem bölümü, Fusûs'un ilk bölümü olduğu için seçilmiştir ve bu bölümde İbn Arabî'nin eserin tamamına yönelik amacı ve yaklaşımı net şekilde belirginleşir. Lût ve Hârûn bölümleri, Endülüs'ün ikili hermenötik ilkesinin en bariz örneklerini oluşturdukları için seçilmiştir. Son olarak, İbn Arabî metnin tahiriyle çelişiyor gibi görünse bile, aslında birincil zahiri modele dayanan daha gelişmiş bir yorum modelini açıkladığı için Nûh bölümü seçilmiştir. Âdem bölümünde İbn Arabi, Adem ile ilişkilendirilen en tutarlı Kur'anî betimlemenin insanlığın babası olduğu için onun insanlığının olduğunu öne sürer. Oysa onun hikmeti ilahi vasfıdır. Bunun nedeni, İlahi en katıksız ve tam ifadesini ancak insanda bulabilmesidir. Diğer taraftan, Nuh'un Kuranî sembolü ise kavminin büyük çoğunluğunun boğulduğu tufandır. Sufî’ye göre (İbn Arabî) onun hikmeti, şeyleri yüzdürmesidir- subbūḥiyya/sebūḥiyya hikmeti. İbn Arabî için boğulma bir ölüm nedeni olmaktan çok bir yaşam kaynağı olmuştur. Lut'un Kur'an'daki en kalıcı imgesi, kavminin günahını dizginlemedeki yetersizliğinden dolayı güçsüzlüğüdür. İbn Arabî, ama yine de onun hikmetinin güç olduğunu söylüyor. Son olarak, Hârûn, Kuran'da Mûsâ'ya itaat eden biri olarak tasvir edilir. Kardeşine yardım etmesi, yükünü taşımasına yardım etmesi için kendisine peygamberlik verildi. Mûsâ, Sina'ya gidip onu sorumlu bıraktığında bile, o sadece Mûsâ'nın yardımcısı rolünü yerine getirir ve ona tabidir. Oysa onun hikmeti itaatin, liderliğin antitezidir. (shrink)

A ideia de um novo período geológico expressa pelo conceito de Antropoceno nos dá a dimensão do impacto humano sobre a Terra. Nós, os humanos contemporâneos, somos uma força geológica, ou melhor, o nosso modo de existência se tornou essa força. Relatórios do Painel do Clima da ONU, dados climatológicos, projeções, entre outras fontes científicas, tornaram-se objetos de interesse da reflexão filosófica sobre o futuro em um planeta fortemente impactado pelos excessos da civilização tecnológica. Tal situação impõe à filosofia contemporânea (...) o desafio não apenas de encarar o problema, mas também de pensar em outras possibilidades de existência que fortaleçam o vínculo com a Terra. Neste sentido, o presente artigo tem o intuito de apresentar em linhas gerais a discussão sobre a ideia de Antropoceno e a proposta eudemonológica schopenhaueriana a partir da atualização do pensamento de Schopenhauer, para pensarmos o cenário catastrófico que está se configurando com a constatação da gravidade de nosso tempo. İbn Sînâ, sonrakilerden bazılarının kâide-i vâhid veya “bir kuralı” (BK) olarak adlandırdığı şeyin sıkı bir savunucusudur. BK’nın ana fikri şunu ifade etmektedir: Birden, doğrudan, yalnızca bir ortaya çıkar. İbn Sînâcı bu kuralın ikincil literatürdeki tartışması genellikle onun hususi bir uygulama alanı yani, sudûr meselesiyle sınırlıdır. Sonuç itibarıyla, BK’nın ne anlama geldiği ve İbn Sînâ’nın onu neden savunduğu kesin değildir. Bu yazıda ben bu meseleyi iki şey yaparak çözmeye çalışmaktayım: Bunlardan biri tasavvur, diğeri ise tasdik açısındandır. İlkin, sadece BK’nın terimlerinin, yani (...) onun özne ve yükleminin ne anlama geldiğini açıklamaktayım. Bunu yaparken, BK’nın dar ve geniş anlamları arasında ayırım yapmakta ve İbn Sînâcı bakış açısından BK’nın kapsamının geniş olduğunu; bunun ise BK’nın fail nedenliğin temel ilkesi olduğu anlamına geldiğini göstermekteyim. Bu sebepledir ki, farklı bağlamlarda önemli felsefî tezleri inşa etmede bu kurala başvurulmuştur. İkinci olarak, İbn Sînâ’nın el- Mübâhasât’ta BK’na dair sunduğu argümanı değerlendirmekteyim. Bu argümanı açıklarken onun bazı gerçekçi varsayımlarını ortaya çıkarmaktayım. Sonrasında, ilk olarak Behmenyâr tarafından öne sürülen ve daha sonrasında Fahreddin er-Râzî tarafından yaygınlaştırılan bir eleştiri ışığında bu meseleyi daha açık hale getirmekteyim. Devamında İbn Sînâ’nın, söz konusu argümanın öncülleri içerisinde, gündeme getirilen itirazları karşılayacak dayanaklarının olup olmadığına bakarak bir sonuca varmaktayım. (shrink)

Carl Schmitt, yirminci yüzyılın en ihtilaflı düşünürlerinden biridir. Politik olana dair görüşleri başta olmak üzere hukuk, tarih ve edebiyat gibi alanlarda ürettiği fikirlerle büyük önemi haizdir. Politik tavır alışlarından dolayı çoğu yazar tarafından tepki gösterilen bir isim olsa da kimi mühim araştırmacının, çağdaş politik krizlere çözüm bulma gayeleriyle Schmitt’e başvurması, onu sıklıkla gündeme gelen bir isim hâline getirmiştir. Böylelikle düşünür, dünya genelinde ve Türkiye özelinde hukuk ve politika eksenli tartışmaların daha iyi anlaşılması için değerlendirilir olmuştur. Felsefeciler, hukukçular ve siyaset bilimciler (...) olarak üç ana hatta tasnif edilebilecek araştırmacılar, bilhassa 2000 sonrası dönemde Schmitt çalışmalarına yoğunlaşmıştır. Yoğunlaşan akademik çalışmaların ivmesi Türkiye’de de bir moment oluşturmuş ve Türkçe literatürün sahip olduğu materyal giderek genişlemiştir. Bu bağlamda düşünüre ve görüşlerine yönelik kitaplar, kitap bölümleri, makaleler, tezler ve benzeri doküman kaleme alınmış; yine kitaplar ve makaleler gibi dokümanların da çevirileri yapılmıştır. İşbu bibliyografya çalışması, mevzubahis Schmitt eğiliminin neticesinde üretilen akademik çalışmalara odaklanıp ilerleyen süreçte yapılacak yeni çalışmalara bir literatür taraması olarak yardımcı olma gayesi gütmektedir. Geleneksel bir bakış açısıyla İsrailoğullarının Tevrat’taki ilk kadın peygamberi olan Miryam, Harun ve Musa’nın kız kardeşi olup Mısır’dan çıkışın önemli figürlerinden biridir. Ancak eleştirel ve farklı bakış açısından Miryam ile ilgili kutsal kitap ve midraşlardaki anlatılara bakıldığında onun üç farklı portreye sahip olduğu görülmektedir. İlk portre, sepet içinde suya bırakılan Musa’yı uzaktan seyreden ve ismi belirtilmeyen abladır. İkinci tasvirde o, Mısır’dan çıkış esnasında Harun’un kız kardeşi peygamber Miryam olarak betimlenmektedir. Bu tasvir daha yakından incelendiğinde Mısır’dan çıkışta dilinde ezgisi, elinde tefi (...) ile dans ederek İsrailoğullarına liderlik eden Miryam’ın, peygamber olmaktan ziyade Mısır’dan izler taşıyan rahibe olmaya daha yakın durduğu görülmektedir. Nitekim Miryam’ı bir rahibe olarak görmek Cüzzamlı Miryam kıssasını daha anlaşılır kıldığı gibi onun fiziki kusurla cezalandırılması Mısır’daki bir rahibenin görevden uzaklaştırılmasıyla uyumluluk arz etmektedir. Rabbani literatür başta olmak üzere Yahudi geleneğinin Miryam algısı ise ona üçüncü bir portre kazandırmaktadır. Midraş literatürün Miryam portresi, ölümünden hemen önce Tevrat’ın ondan aldığı saygınlığı iade çerçevesinde olup, onu diğer önemli anneler arasında görmek üzerine kuruludur. (shrink)

The author examines the character of the changes taking place in contemporary Serbian society. He emphasizes at the same time that contemporary Serbian philosophy is facing these crucial questions as well, which without it cannot be even addressed, let alone solved. The key difference between modern West European and contemporary Serbian societies, seen from the perspective of philosophy, is demonstrated most clearly in the manner of constituting institutions and transforming the modern Serbian society. In the process of building modern institutions (...) philosophy, not just in our country but throughout the Slavic East, has not had the role it played in Europe. Here lies the explanation why natural consciousness and an original ethos, though considerably modified, still remain unadapted and today represent a major obstacle to the establishment of the rule of European law. Without a change in the sense of justice and respect for the law it is impossible to accomplish the transformation of the society in which the law recognized by a democratic state could not be super ordinate to any reason. The crucial role of philosophy in this process is seen by the author not only in establishing modern European institutions and acceptance of the principle of European legislation, but above all in its influence on the transformation of the original ethos and establishment of new criteria on which the reflection, decision making and action of any individual would be based.. Autor u ovom radu nastoji da pokaze u cemu se sastoji sustinski karakter promenama koje se danas ostvaruju u savremenom srpskom drustvu, ukazujuci istovremeno, da i savremena srpska filozofija stoji pred tim sustinskim pitanjima, koja se bez njenog sudelovanja ne mogu na valjan nacin ni predociti, a kamo li da se mogu uvideti putevi njihovog razresenja. Kljucna razlika izmedju modernog zapadnoevropskog i savremenog srpskog drustva, sagledanog iz perspektive filozofije, najjasnije se pokazuje u nacinu konstituisanju institucija i nacina preobrazaja modernog srpskog drustva. U izgradnji modernih institucija filozofija, ne samo u nas, vec i na celom slovenskom istoku nije imala onu ulogu koju je imala u Evropi. U toj cinjenici nalazi se objasnjenje zasto su prirodna svest i izvorna obicajnost, iako znatno izmenjeni, ostali ipak neprilagodjeni i danas predstavljaju jednu od glavnih prepreka u uspostavljanju vladavine evropskog prava. Bez promene osecanja pravednosti i postovanja zakona nije moguce izvrsiti preobrazaj drustva u kojem pravo priznato od demokratske drzave ne bi moglo biti nadredjeno nikakvom umu. Kljucnu ulogu filozofije, autor ne vidi samo u uspostavljanju modernih evropskih institucija i prihvatanju nacela evropskog zakonodavstva, vec pre svega u njenom uticaju na preobrazaj izvornog etosa i uspostavljanje novih merila na kojima ce biti zasnovano promisljanje, odlucivanje i delanje svakog pojedinca.. El artículo analiza el derecho al agua y su importancia, no sólo para la supervivencia humana, sino para el desarrollo económico sostenible, de ahí que se esperaba que Río+20 avanzara en la protección del derecho del agua: un derecho de todos, incluso de las generaciones futuras. Pero lo cierto es que ha sido una oportunidad perdida, en un mundo en el que según la ONU, 884 millones de personas no tienen garantizado el acceso seguro a aguas potables y 2.600 millones (...) no disponen de servicios básicos de saneamiento. Fanon’un düşüncesinde özgürleşmenin boyutlarını ortaya çıkarmayı amaçlayan bu çalışmaya göre, uyuşmazlığa dayanan siyaset özgürleşmenin öncelikli yoludur ve tam olarak bu sebeple Fanon’un düşüncesi özgürleşme siyaseti olarak adlandırılmayı doğrudan hak eder. Uyuşmazlık çıkarmak veyahut Fanon’daki biçimiyle, çelişkilerin farkında olma ve onları aşmak üzere evrenseli hedefleyen eylemlere girişme özgürleşme siyasetinin içeriğini oluşturur. Siyaseti inşa etmek için, öncelikle, kolonyal dünyanın çalışma şeklini anlamak gerekir. Kolonyal dünya sömürenin ve sömürülenin davranışları aracılığıyla işler. Fakat, özgürleşme siyasetinde özgürleşecek olanlar sömürülenler, siyahlar, kolonyal dünyanın çoğunluğunu oluşturan öteki (...) olduğu için, Fanon, özelde siyahların ve genelde de koloni halkının deneyimlerine odaklanır. Özgürleşmeyi ilk elde sömürülenin özgürleşmesi olarak gören Fanon aynı zamanda onu gerçek bir özgürleşme düzlemine doğru genişletir. Bu düzlemde efendi ve özne konumu dünyada artık bulunmaz ve evrensel eşitlik somutlaşır. Fanoncu özgürleşme siyaseti sömürülenlerin, yani tikelin özgürleşmesinden bütün dünyanın, evrenselin, bütün insanlığın özgürleşmesine doğru çok kapsamlı bir alana yayılır. Bu fikirden hareket eden bu çalışmanın ilk kısmı, kolonyal dünyanın mantığına, bu mantığın dayandığı kavramlara, unsurlara ve deneyimlere odaklanır. İkinci kısım ise, özgürleşmenin sömürülen (köle, siyah kişi) ve sömüren (efendi, beyaz kişi) ilişkisinin efendi ve köle arasındaki ilişki olmaktan çıkarılması ve köleliğe bir son verilmesi olduğundan hareketle, kolonyal dünyanın işleme şeklinin kesintiye uğramasıyla görünür olan özgürleşme siyasetine eğilir. Çalışmanın son kısmı da bu kesintiye uğratıcı/yıkıcı etkinliklerin nasıl Fanon tarafından şiddet ile birlikte düşünüldüğünden bahseder. Özgürleşme siyaseti açısından şiddetin şiddet olarak değil, fakat özgürleşme adına, bu mücadelenin sonucunda erişilecek yeni bir insanlık adına işlevselleştirildiğine dikkat çeker. Fanon düşüncesinde özgürleşmenin boyutlarıyla ilgilenen bu çalışma için özgürleşme sürecindeki yıkıcı etkinlikler ve dolayısıyla çatışmaya dayanan bu etkinliklerden biri olarak beliren karşı-şiddet, özgürleşmenin öncelikli yoludur. Bu etkinlikleri açık bir şekilde kapsayan Fanon düşüncesi de bu nedenlerle günümüzde özgürleşme siyasetinin düşüncesi olmanın yanı sıra bizatihi siyasal bir düşünce olarak hak eder. (shrink)

Una vez acabada la división del mundo en bloques, tras la caída, hace quince años, del régimen soviético, parecía que ya nada podría oponerse a la instauración de la paz en el mundo, y a la difusión y consolidación de la democracia en el nivel planetario. Y precisamente a partir de entonces se ha ido gestando, en los ordenamientos de los principales países occidentales y en las relaciones internacionales, una crisis no coyuntural que afecta a los dos niveles del constitucionalismo (...) actual: por un lado, las formas de la democracia diseñadas por las rígidas constituciones de la última posguerra y, por el otro, el proyecto de paz y de garantía de los derechos humanos formulado en ese embrión de constitución mundial que representan la Carta de la ONU, y las distintas declaraciones y convenciones sobre los derechos fundamentales.
