How Tort Can Address Historical Injustice Recent years have seen an increase in civil litigation of cases of systemic and historical injustice in the Netherlands. Cases regarding war crimes, genocide and other human rights violations in the past and present have reached the Dutch civil courts through tort law. Meanwhile, scholarly disciplines have difficulty understanding the match between tort law and historical injustice cases, distracted by tort’s technicalities and alleged formality. This article provides an interdisciplinary analysis aiming to theoretically clarify (...) the urgency and aspiration put on tort by the slavery justice movement: what potential does tort hold for addressing historical injustice, such as slavery? The article identifies ‘talking points’ between two compatible theories from the sociological and legal disciplines, transformative justice and civil recourse theory, illustrated with cases of systemic and historical injustice. It argues that despite difficulties, tort litigation can be a viable platform to address historical injustices such as colonial slavery. This impact is not dependent on a successful legal outcome: the process can foster agency through process, and participation through inclusion, as core characteristics of remedying historical injustice. Alternative ways to ensure mate compatibility, such as hermaphroditism and the breakdown of self‐incompatibility, evolved repeatedly when finding a mating partner is difficult. In a variety of microorganisms where compatibility is determined by mating‐types, a highly regulated form of universal compatibility system called mating‐type switching has evolved several times. This sophisticated system allows for the genetic adjustment of the mating type during asexual growth, and it most likely evolved for reproductive assurance of immotile species under low densities. In this review, (...) we compare the switching strategy to other universal compatibility systems such as “unisexual mating” and homothallism. We identify the costs of switching, including genome instability, and mechanistic costs, as well as the benefits, mainly the maintenance of important mating‐type functions. Given the potential benefits of mating‐type switching, we speculate that switching is likely to have evolved many times independently, and may be more common in groups where genetic mating types regulate mate compatibility than assumed so far. This article takes stock of the basic notions of Information Structure (IS). It first provides a general characterization of IS following Chafe (1976) within a communicative model of Common Ground (CG), which distinguishes between CG content and CG management. IS is concerned with those features of language that concern the local CG. It then defines and discusses the notions of Focus (as indicating alternatives) and its various uses, Givenness (as indicating that a denotation is already present in the CG), and (...) Topic (as specifying what an statement is about). It also proposes a new notion, Delimitation, which comprises contrastive topics and frame setters, and indicates that the current conversational move does not satisfy the local communicative needs totally. The immediate successors of Kant in classical German philosophy considered a subjectivity irreducible to objecthood as the core of personhood. The thesis of an irreducible subjectivity has, after the German idealists, been advocated by the phenomenological movement, as well as by analytical philosophers of self-consciousness such as Hector-Neri Castaneda and Sydney Shoemaker. Their arguments together show that self-consciousness cannot be reduced to a relation whereby a subject grasps itself as an object, but that there must be a core of subjectivity (...) always already familiar with itself before reflection. A number of contemporary accounts of self-consciousness are unaware of these old and new arguments, and flawed in that they do not account for the core 'non-objectal subjectivity' necessary for self-consciousness and. The distinction between telic and atelic predicates has been described in terms of the algebraic properties of their meaning since the early days of model-theoretic semantics. This perspective was inspired by Aristotle’s discussion of types of actions that do or do not take time to be completed1 which was taken up and turned into a linguistic discussion of action-denoting predicates by Vendler (1957). The algebraic notion that seemed to be most conducive to express the Aristotelian distinction appeared to be the (...) mereological notion of a part, applied to the time at which these predicates hold: atelic predicates, like push a cart, have the subinterval property, that is, whenever they are true at a time interval, then they are true at any part of that interval; this does not hold for telic predicates, like eat an apple, cf. Bennett & Partee (1972), Taylor (1977), and Dowty (1979)2. Bach (1986) integrated these insights into a semantics based on events. (shrink)

Quantified NPs in questions may lead to an interpretation in which the NP quantifies into the question. Which dish did every guest bring? can be understood as: 'For every guest x: which dish did x bring?'. After a review of previous approaches that tried to capture this quantification formally or to explain it away, it is argued that such readings involve quantification into speech acts. As the algebra of speech acts is more limited than a Boolean algebra – it only (...) contains conjunction, not disjunction or negation – it is predicted that only universal quantifiers can scope out of questions or other speech acts. The approach is extended to indirect questions, which either are embedded speech acts or coerced to denote the true answers, depending on the embedding verb; in the latter case a Boolean structure results, and we find wide-scope readings of non-universal quantifiers. Joseph Schumpeter's work has been all too selectively appropriated by public choice theorists. Schumpeter criticized the high level of rationality the classical model of democracy imputes to citizens, and he provided an alternative theory, inspiring rational choice theory and allowing for diverse forms of irrationality. Following in Schumpeter's footsteps I will discuss four problems: the deficient rationality of voters, politicians as ?political entrepreneurs,? leadership in democracy and the rise of the ?political class,? and the affinity between democracy and capitalism.

Given the beginnings of the United States of America, its sympathy with the French revolution and its rationalist attitude towards the institutions of society, one would have expected that it would have been one of the first nations to adopt the new metric system that was introduced in France in 1800. But the history of the attempts to do so is decidedly mixed. American Congress authorized the use of the metric system in 1866. In 1959, American measurements were defined in (...) relation to the metric system. In 1968, the government ordered a study which was published three years later under the title “A Metric America: A Decision Whose Time Has Come”. The year 1975 then saw the Metric Conversion Act, leading to the establishment of the US Metric Board. Amended in 1988, it resulted in the Metric Program, an organization founded to support the various federal agencies, which are required since 1991 to file an annual report on their efforts to change to the metric system. The paper explains response particles like yes and no as anaphoric elements that pick up propositional discourse referents that are introduced by preceding sentences. It is argued that negated antecedent clauses introduce two propositional discourse referents, which results in ambiguities of answers that are partly resolved by pragmatic optimization. The paper also discusses response particles like okay, right, uh-huh, uh-uh, and German ja, nein and doch.

In the logical, philosophical and linguistic literature, a number of theoretical frameworks have been proposed for the meaning of questions (see Ginzburg (1995), Groenendijk & Stokhof (1997) for recent overviews). I will concentrate on two general approaches that figured prominently in linguistic semantics, which I will call the proposition set approach and the structured meaning approach (sometimes called the “propositional” and the “categorial” or “functional” approach). I will show that the proposition set approach runs into three problems: It does not (...) always predict the right focus structure in answers, it is unable to distinguish between polarity (yes/no) and a certain type of alternative questions, and it does not allow to formulate an important condition for a type of multiple constituent questions. On the other hand, I will show that the main argument brought forward against the structured meaning framework, namely that it does not give us an elegant way to account for embedded questions, does not withstand closer scrutiny. In this I will take up an issue raised in von Stechow (1990), namely, that the greater expressive power of the structured meaning approach might be necessary for the proper treatment of semantic phenomena like question formation and focusation. The universally valid genetic code is the final result of a multi-stage course of development. Degeneracy, as an important property of the genetic code, was possibly not yet present in the earliest code, first appearing at a later stage of development. Possibly this step in development is coupled with the presence of a total of four amino acid groups. Each group contains a specific number of amino acid. Amino acid groups: — hydrophobic– - weakly hydrophobic or polar but uncharged – (...) - hydrophilic, acidic – - hydrophilic, basic – - hydrophobic, aromatic In a subsequent stage of development the number of amino acids increases further. At the same time the code becomes more degenerate. The universal genetic code is characterized by three constants of being degenerate. Its immediate predecessor has linear degeneration with two constants. The mitochondrial code represents a transitional form between these two codes. (shrink)

In this paper we argue that an operational organism concept can help to overcome the structural deficiency of mathematical models in biology. In our opinion, the structural deficiency of mathematical models lies mainly in our inability to identify functionally relevant biological characters in biological systems, and not so much in a lack of adequate mathematical representations of biological processes. We argue that the problem of character identification in biological systems is linked to the question of a properly formulated organism concept. (...) Lastly, we demonstrate how a decomposition of an organism into independent characters in the context of a specific biological process--such as adaptation by means of natural selection--depends on the dynamical properties and invariance conditions of the equations that describe this process. This paper deals with what has been called "ars inveniendi" (’art of finding‘) in antiquity, medieval and early modern times. A survey of different techniques of finding tenable and relevant arguments is presented (among them, the Topical tradition, Status theory, Debate theory, Encyclopedic systems, Creativity techniques). Their advantages and disadvantages are critically compared. It is suggested that a mixture of strategies of finding arguments should be used. Finally, a few remarks showing the relationship beween the strategies of finding arguments and (...) creativity in general are given. (shrink)

It is generally assumed that there are two types of genericity, called characterizing statements and kind reference in Krifka et al. (1995). Characterizing statements express generalizations about sets of entities or situations, cf. (1); kind reference involves reference to an entity that is related to specimens, cf. (2).

A partially ordered set is called k-homogeneous if any isomorphism between k-element subsets extends to an automorphism of . Assuming the set-theoretic assumption ⋄, it is shown that for each k, there exist partially ordered sets of size ϰ1 which embed each countable partial order and are k-homogeneous, but not -homogeneous. This is impossible in the countable case for k ≥ 4.

Gerhard von Rad was both a professor and a preacher. He understood and taught the Old Testament as a text to be preached and closely connected with the New Testament to form a theological basis for Christian faith.

Kant calls himself a realist, qualifying this label with the adjective ‘empirical’. It is fair to say that most critics take this qualification as somehow implying that his idealism, itself qualified as ‘transcendental’, is primary. It is often assumed that the realism is merely a concession Kant makes from within an epistemological framework that is basically and in the final analysis an idealist one. There is an interpretation of Kant’s transcendental idealism that supposes that there is a sense in which (...) it is true to say that “mind makes nature”. Typically, metaphors used to describe the relationship between the mind and the world are ones that suggest the imposition of form on a material in itself shapeless.
