This article examines how skilled middle-class Tamil women—an Indian regional group—negotiate with gender to strategize immigration to and settlement in the United States by drawing on life-history interviews with 33 first-generation professional women, most of whom entered the United States as family migrants. I find that the women negotiate with gender to configure Tamil Brahminical relations of subordination, thereby asserting their subjectivity through “strident embedded agency” in immigration. In this way, they realize gender non-normative desires for immigration, engage in gender (...) non-normative actions, and perform normative actions in reconstituted ways. Even as their strident embedded agency facilitates their embodiment of configured Tamil womanhood, it produces Tamil Brahmin relations of subordination. This article delineates the complexity of women’s subjectivities and agency and Tamil women’s agential strategizing of immigration as emergent from their gendered and caste/classed social locations. Whistleblowing is the act of disclosing information from a public or private organization in order to reveal cases of corruption that are of immediate or potential danger to the public. Blowing the whistle involves personal risk, especially when legal protection is absent, and charges of betrayal, which often come in the form of legal prosecution under treason laws. In this article we argue that whistleblowing is justified when disclosures are made with the proper intent and fulfill specific communicative constraints in (...) addressing issues of public interest. Three communicative constraints of informativeness, truthfulness and evidence are discussed in this regard. We develop a ‘harm test’ to assess the intent for disclosures, concluding that it is not sufficient for justification. Along with the proper intent, a successful act of whistleblowing should provide information that serves the public interest. Taking cognizance of the varied conceptions of public interest, we present an account of public interest that fits the framework of whistleblowing disclosures. In particular, we argue that whistleblowing is justified inter alia when the information it conveys is of a presumptive interest for a public insofar as it reveals an instance of injustice or violation of a civil or political right done against and unbeknown to some members of a polity. Whistleblowing is the public disclosure of information with the purpose of revealing wrongdoings and abuses of power that harm the public interest. This book presents a comprehensive theory of whistleblowing: it defines the concept, reconstructs its origins, discusses it within the current ethical debate, and elaborates a justification of unauthorized disclosures. Its normative proposal is based on three criteria of permissibility: the communicative constraints, the intent, and the public interest conditions. The book distinguishes between two forms of whistleblowing, civic and (...) political, showing how they apply in the contexts of corruption and government secrecy. The book articulates a conception of public interest as a claim concerning the presumptive interest of the public. It argues that public interest is defined in opposition to corporate powers and its core content identified by the rights that are all-purposive for the distribution of social benefits. A crucial part of the proposal is dedicated to the impact of security policies and government secrecy on civil liberties. It argues that unrestrained secrecy limits the epistemic entitlement of citizens to know under which conditions their rights are limited by security policies and corporate interests. When citizens are denied the right to assess when these policies are prejudicial to their freedoms, whistleblowing represents a legitimate form of political agency that safeguards the fundamental rights of citizens against the threat of unrestrained secrecy by government power. Finally, the book contributes to shifting the attention of democratic theory from the procedures of consent formation to the mechanisms that guarantee the expression of dissent. It argues that whistleblowing is a distinctive form of civil dissent that contributes to the demands of institutional transparency in constitutional democracies and explores the idea that the way institutions are responsive to dissent determines the robustness of democracy, and ultimately, its legitimacy. What place dissenters have within a society, whether they enjoy personal safety, legal protection, and safe channels for their disclosure, are hallmarks of a good democracy, and of its sense of justice. There has been an alarming increase in the numbers of illicit massage businesses (IMB) in the United States and the revenue generated by this illegal industry. Although empirical research on IMBs is scant, it is well documented that most of the women exploited in IMBs are immigrant women entrapped in trafficking situations involving commercial sex and/or labor exploitation. First, our research comprises an exploratory study of women exploited in US illicit massage parlors using a sample of news articles highlighting law (...) enforcement raids in the US. Next our research adopts a novel theoretical perspective to develop a conceptual framework of trauma proliferation experienced by these women. Our theoretical analyses build on the literature related to migration, as well as homelessness, to present a framework of trauma proliferation in IMBs. Implications for theory and practice, and how this research has implications towards promoting just and inclusive societies are discussed. Particularly, this work has implications for the well-being and cultural integration of women exploited in IMBs. We also make recommendations for inclusive clinical practices, services, and support resources. (shrink)

In this article we argue that governmental practices of secrecy threaten the epistemic dimension of rights. We defend the view that possessing a right entitles its holder to the largest extent of available knowledge of the circumstances that may impede the enjoyment of that right. We call this the ‘epistemic entitlement’ of rights. Such an entitlement holds in ideal conditions once full transparency is assumed. However, under non-ideal conditions secrecy is a fact that should be accounted for. We argue that, (...) under such conditions, interference due to secrecy is legitimate when the circumstances under which it occurs are open to assessment by the right-holder. We call this the ‘right of assessment’. It ensures the ex-post fulfillment of the epistemic entitlement under non-ideal conditions of partial compliance where full transparency is unattainable due to the fact of secrecy. The right of assessment shields against arbitrary interference by imposing an obligation on the government to provide justification for any interference in the sphere of fundamental rights. (shrink)

This chapter presentsa principled view that grounds the need for whistleblowing protection, often missing in the literature. They argue that whistleblowers have a right to protection because of their role in ensuring accountability against wrongdoings that go unnoticed due to unrestrained practices of secrecy. This right derives from the crucial role of whistleblowing in exposing right limitations, in absence of procedures of redress, and information of public interest. Given this role, absence of procedures of protection and fair hearing of disclosure (...) claims puts unfair burdens on whistleblowers so much as to, in some instances, preclude the very possibility of disclosure. In this regard, a cognizance of their role in ensuring protection of rights and structure of accountability demands a system of protection extended to human rights defendants. Santoro and Kumar argue that the European Union should stand up for the legal protection of whistle-blowers and encourage their contribution towards more transparent institutions and economic transactions. Bu makalede, râ harfinin tefhîm/kalın ve terkîk/ince okunmasına dair hususlar son dönem Osmanlı kurrâlarından Bursalı Süleyman Vehbi’nin (öl. 1334/1916) Risâle-i Râiyye adlı eseri ekseninde ele alınmıştır. Kur’ân harflerinin seslendiriliş biçimini ifade eden fonetik farklılıklar kıraat ilminin amelî/pratik boyutunu oluşturan en önemli unsurdur. Bu minvalde Kur’ân alfabesindeki harfler genel olarak, birbirinin zıddı olan tefhîm-terkîk sıfatlarından biriyle seslendirilmektedir. Bununla birlikte lâm ve râ harfleri bazen kalın bazen de ince okunmaktadır. Lâm harfinde aslolanın terkîkle telaffuz edilmesi olup bazı durumlarda tağlîzle/tefhîmle okunduğu hususunda ittifak (...) edilmiştir. Fakat âlimler râ harfinin tefhîm veya terkîki konusunda ihtilaf etmişlerdir. Bazıları, aslı itibariyle râ harfinde tefhîm-terkîk özelliği bulunmayıp birtakım şartlar muvacehesinde bunlardan birisiyle okunduğunu söylerken; cumhur ise râ’da aslolan tefhîm olup bazı şartlar çerçevesinde terkîkle okunduğunu ileri sürmüştür. Husûsen Verş (öl. 197/812) rivâyeti ve Ezrak (öl. 240/854) tarikine göre râ harfinin tefhîm-terkîkle okunması gereken yerlerin tespiti kıraat tedrisatında zaptı en zor olan hususlardan addedilmiştir. Hâl böyle iken günümüze değin râ harfine dair kurrâ arasındaki ihtilafların tam anlamıyla açıklanıp vuzuha kavuşturulduğu -Süleyman Vehbi’nin risâlesi dışında- Türkçe bir eser kaleme alınmamıştır. Türkçe eserlerde râ’nın okunuşuna dair hususlar genelde Hafs (öl. 180/796) rivâyeti özelinde işlenmiş, Verş ve Ezrak’ın, râ harfini okuyuş keyfiyetlerine yönelik bilgilere yeterli ölçüde yer verilmemiştir. Bu bağlamda mezkûr boşluğun doldurulması, çalışmanın amaçlarından biridir. Makalenin Risâle-i Râiyye çerçevesinde ele alınmasının sebebi müellifin, Osmanlı’daki kıraat tedrisinde temel kaynak olarak kullanılan en-Neşr, İthâf, Zübdetü’l-irfân, Umdetü’l-hullân, el-Îtilâf, Bedâi‘u’l-burhân ve Mürşidü’t-talebe gibi eserlerin hemen hepsine müracaat edip konuyu sistematik bir şekilde ele alması ve yeri geldikçe mezkûr eserlerdeki hata ve eksikliklere değinmesidir. Makalede öncelikle müellifin hayatına yer verilmiş, ardından risâlede işlenen konular tavzih edilmiştir. Bu yapılırken müellifin verdiği bilgilerin aslî kaynaklardaki yeri ve râ’nın tefhîm-terkîk ile okunmasının illeti/sebebi tespit edilmeye çalışılmıştır. Ayrıca müellifin eser içerisinde hata ve eksikliklerine değindiği kaynakların ilgili yerleri tespit edilip hangi ibare ve ifadelerle tashih edilmesi gerektiğine işaret edilerek araştırmacılara kolaylık sağlanması amaçlanmıştır. Çalışma sonunda görülmüştür ki Ezrak, esreli râlar’ın terkîkinde ve kelime başlarındaki fethalı-zammeli râlar’ın tefhîminde diğer kurrâ ile müttefiktir. Ancak kelime ortasında-sonunda bulunan mansûb-meftûh râlar’ı “kelimenin aslından olan lâzımî kesreli harften sonra gelmesi”, “lâzımî kesreyle râ’nın arasında sakin bir hurûf-i isti‘lânın -hâ/خ hariç- bulunmaması” ve “râ’nın sakin yâ harfinden sonra gelmesi” durumunda sadece terkîkle; bu şartları taşımakla birlikte râ’nın tenvinli olması durumunda terkîk ve tefhîm olmak üzere iki vecihle; bu şartlardan birinin bulunmaması durumunda ise sadece tefhîmle okumuştur. Mazmûm ve merfû râlar’ı ise mansûb râlar için zikri geçen şartları taşımaları halinde Verş sadece terkîk, Ezrak ise terkîk ve tefhîm vechiyle okumuştur. Burada şunu ifade etmek gerekir ki kütüphanelerde özellikle Osmanlı dönemine ait pek çok kıraat eseri gün yüzüne çıkarılmayı beklemektedir. Söz konusu eserlerin ortaya çıkarılıp incelenmesi hem süreç içerisinde kıraat ilminin nasıl bir seyir izlediğinin tespiti hem de mezkûr eserlerin verilerinden istifade edilerek yeni çalışmaların ortaya konulması açısından önem arz etmektedir. The Hanafi Sect was the first among the fiqh sects that completed its formation and codification. Abu Hanifa, the founding imam of the sect, raised many students. His most prominent students were Abu Yusuf, Muhammed al-Shaybani and Zufar. While teaching his students, Abu Hanifa created a free environment and was pleased that his students adopted opposing views to his. Accordingly, different views emerged among the imams in question for reasons such as interpreting the texts, taking into account the changes in (...) customs and time, and approaching the issues from different perspectives. After the death of Abu Hanifa, Abu Yusuf served as a kadi, i.e. a judge. Muhammad al-Shaybani played an important role in the formation of the sect. Zakat is one of the subjects where different opinions and disagreements occurred among the imams of the madhhab, or sect. Hanafi books exhibited different approaches in revealing these differences of opinion. For example, there were jurists who mentioned and discussed their differences of opinion in detail, as in Ka-sana’s work Bedai al-sanai fi tertib al-sharai, as well as in Mawsili’s work el-Ihtiyar li-talil al-Muhtar. There were also jurists who took a middle way on the subject. In this study, the differences of opinion of the sect imams Abu Hanifa, Abu Yusuf, Muhammed al-Shaybani and Zufar on zakat will be explained based on the book al-Hidaye by Burhaneddin al-Merginani, which is one of the most popular books of the Hanafi sect. However, the commentaries of al-Hidaye and the books of the sect on fiqh will also be consulted occasionally. In this study, the subjects that are considered more important than the others in regard to the fiqh of zakat will be analyzed. (shrink)

This article revisits the intellectual history of inequality in the thinking of Dr Bhimrao Ramji Ambedkar (1891–1956) and Dr Ram Manohar Lohia (1910–1967). Both were pivotal figures in the intellectual history of inequality in colonial and postcolonial India. Yet little work has been done to systematically juxtapose the two and their thinking on inequality. This article offers a first comparison, arguing that their ideas on inequality can be seen as the emergence of a unique, Indian version of what, in (...) this article, we term “organic intersectionality.” We build this argument on four claims. First, both were organic intellectuals whose thinking was molded in the marginalized groups from which they arose, but whose ideas developed in unique and organic ways. Second, both had a unique eye to the intersectional and holistic character of Indian inequality, cutting across caste, class, race, and gender. Third, their thinking grew from a deep engagement with religion, which they saw as both legitimizing and delegitimizing inequality. Fourth, both these figures exemplify postcolonial hybridity and thus stand in contrast both to a diffusionist approach whereby ideas are simply diffused from the West to the East, and to a nationalized, self-contained, or decolonial history of ideas.
