El presente artículo tiene como objetivo determinar el fundamento teológico del concepto de soberanía propuesto por el jurista alemán Carl Schmitt. Según nuestra hipótesis, tal fundamento teológico se encuentra en la filosofía del pensador danés Søren Kierkegaard, quien, en diferentes obras, desarrolló los importantes conceptos de excepción, decisión y suspensión teleológica de la ética en relación a la experiencia religiosa de la repetición. Como veremos, tales conceptos forman parte del fundamento teológico de la famosa definición schmittiana de la soberanía: “soberano (...) es quien decide sobre el estado de excepción”, la cual define el decisionismo del jurista alemán. Así, por medio del concepto de decisión, extraído de la obra kierkegaardiana e introducido en la doctrina de la soberanía, Schmitt logra tres objetivos. Por un lado, no solo inicia la crítica al parlamentarismo liberal y al Estado burgués de Derecho, sino que revela el fundamento teológico-existencial de la unidad política del Estado moderno. En segundo lugar, en el marco jurídico-político, actualiza la teología fideísta desarrollada por Kierkegaard en su obra. Finalmente, en el marco teológico-metafísico, introduce el papel de la decisión como actualizador del rol público de la trascendencia en la modernidad secularizada frente a la reserva escatológica de la teología. Para lograr nuestro objetivo, utilizaremos el método de la analogía conceptual teológico-política creado y aplicado por el mismo Carl Schmitt a la historia de la soberanía europea. (shrink)

El presente artículo intenta estudiar la concepción del mundo que subyace a la modernidad política peruana. Según nuestro punto de vista, esta concepción del mundo está caracterizada por lo que llamaremos ethos barroco. Aunque no es la única, su manifestación más importante es el fenómeno de la corrupción, desarrollado en el marco de la relación entre una forma de pensar y una forma de actuar: la utopía (derivada de una visión fantasiosa de la sociedad) y la anomia (resultado del (...) incumplimiento de las normas sociales). En este sentido, queremos mostrar la paradójica doble relación entre ambos elementos, consistente, por un lado, en la contradicción discursiva entre el pensamiento utópico y la anomia política, y, por otro lado, en su articulación complementaria en el fenómeno de la corrupción. Debido a esta enigmática y compleja relación, en el Perú se ha instaurado un Estado que promueve la anomia y una Constitución que carece de legitimidad, en lugar de un verdadero Estado de Derecho. Si bien la cirugía es parte fundamental de la medicina y de gran relevancia en la sociedad actual, no ha sido tomada en cuenta por la filosofía de la medicina. Debido a la naturaleza eminentemente práctica de la cirugía, una indagación sistemática nos permitirá, entre otros aspectos, dilucidar rasgos generales de las prácticas científicas en las que el conocimiento tácito es esencial. Por lo que, con la finalidad de integrar a la cirugía dentro del marco general de la filosofía (...) de la medicina, se propone un primer corpus tentativo de problemas en los que puede centrarse la filosofía de la cirugía, que incluyen: cuestiones epistémicas acerca del aprendizaje de las habilidades quirúrgicas y su transformación; la evidencia utilizada en cirugía, así como la forma en la que los cirujanos validan sus intervenciones frente a otras especialidades médicas y si está justificada epistémicamente la falta de ensayos clínicos aleatorizados; finalmente se examina la forma de aprobación de los dispositivos médicos que son ampliamente utilizados en cirugía. Esto, mostrará que la filosofía de la cirugía tiene el potencial para establecerse como un área autónoma dentro de la filosofía de la medicina. (shrink)

La historia de la Educación Física argentina que conocemos y hemos estudiado está contada y reconstruida a partir de una revisión nacional, con gran profundidad en la Ciudad y la Provincia de Buenos Aires. No obstante, existen muchas historias que esperan ser descubiertas y narradas. En este sentido, este artículo es una revisión de la historia reciente y local en una perspectiva genealógica, enmarcada en el paradigma cualitativo de investigación. Particularmente, analiza el subprograma que formó parte del Programa de Asistencia (...) Integral Córdoba (Paicor), implementado en el marco de la Reforma Educacional Córdoba. Esta política pública tensionó el campo de la Educación Física en el período de la recuperación democrática, desde 1983 hasta el cierre de la Dirección de Educación Física del Ministerio de Educación provincial, en 1995. El trabajo describe y analiza el Paicor Deporte como dispositivo de la política pública y su vinculación con la Educación Física tras el retorno de la democracia. Para esta tarea se recuperan documentos oficiales del subprograma y se entrevista a personas que estuvieron a cargo de su implementación. El desafío consistió en focalizar lo no se había observado en profundidad, recuperando voces, intereses y necesidades que dieron lugar al subprograma, una de las herramientas políticas para la construcción de un sujeto político plural y democrático en la Provincia de Córdoba. La Educación para la Justicia Global es una propuesta educativa crítica y transformadora impulsada por la Federación de entidades de Justicia global catalana, aunque es un enfoque extendido su marco conceptual está poco desarrollado. El objetivo del artículo es definir criterios temáticos/metodológicos que permitan identificar y caracterizar las prácticas educativas de justicia global. La metodología corresponde a un proceso de sistematización y organización de las experiencias de las entidades utilizando entrevistas cualitativas, focus-group y análisis documental. Los resultados muestran seis (...) ejes temáticos y cinco criterios teóricos/metodológicos que pueden ilustrar y orientar a quienes deseen conocer o adoptar el enfoque. (shrink)

With the present paper I maintain that the group field theory (GFT) approach to quantum gravity can help us clarify and distinguish the problems of spacetime emergence from the questions about the nature of the quanta of space. I will show that the mechanism of phase transition suggests a form of indifference between scales (or phases) and that such an indifference allows us to black-box questions about the nature of the ontology of the fundamental levels of the theory. I consider (...) the GFT approach to quantum gravity which derives spacetime as an emergent property from abstract non-geometrical tetrahedra through a processes of phase transition. Because the physical interpretation of the tetrahedra is problematic in view of their (non)-spatiotemporal nature, I will apply the considerations about phase transitions to GFT and conclude that the fundamental ontology of the theory and the mechanism of spacetime emergence can and should be treated separately. Humans are normative beings through and through. This capacity for normativity lies at the core of uniquely human forms of understanding and regulating socio-cultural group life. Plausibly, therefore, the hominin lineage evolved specialized social-cognitive, motivational, and affective abilities that helped create, transmit, preserve, and amend shared social practices. In turn, these shared normative attitudes and practices shaped subsequent human phylogeny, constituted new forms of group life, and hence structured human ontogeny, too. An essential aspect of human ontogeny is therefore its (...) reciprocal nature regarding normativity. This chapter reviews recent evidence from developmental psychology suggesting that, from early on, human children take a normative attitude toward others’ conduct in social interactions, and thus a collectivistic and impersonal perspective on norms. We discuss to what extent our closest living primate relatives lack normative attitudes and therefore live in a non-normative socio-causal world structured by individual preferences, power relationships, and regularities. This book fills a major gap in the ever-increasing secondary literature on Hannah Arendt's political thought by providing a dedicated and coherent treatment of the many, various and interesting things which Arendt had to say about law. Often obscured by more pressing or more controversial aspects of her work, Arendt nonetheless had interesting insights into Greek and Roman concepts of law, human rights, constitutional design, legislation, sovereignty, international tribunals, judicial review and much more. This book retrieves these aspects of her (...) legal philosophy for the attention of both Arendt scholars and lawyers alike. The book brings together lawyers as well as Arendt scholars drawn from a range of disciplines (philosophy, political science, international relations), who have engaged in an internal debate the dynamism of which is captured in print. Following the editors' introduction, the book is split into four Parts: Part I explores the concept of law in Arendt's thought; Part II explores legal aspects of Arendt's constitutional thought: first locating Arendt in the wider tradition of republican constitutionalism, before turning attention to the role of courts and the role of parliament in her constitutional design. In Part III Arendt's thought on international law is explored from a variety of perspectives, covering international institutions and international criminal law, as well as the theoretical foundations of international law. Special attention is given to the success factors in the subsequent phases of implementation (sensitivity to the organizational environment, awareness of core values and clear leadership), to ensure that the most optimal results attainable for the organization can be reached. Desenvolveremos no trabalho apresentado os temas que julgamos necessários para uma maior compreensão da filosofia da religião de Henri Bergson. Focaremos, mais especificamente, o aspecto dinâmico desta filosofia e suas conseqüências éticas. Portanto, em um primeiro momento, trataremos os dois sentidos da palavra religião, para o filósofo francês, em um segundo momento, estudaremos o misticismo como forma dinâmica de religião e, por último, a relação existente entre religião dinâmica e a é tica sociedade aberta.

This monograph offers a comprehensive study of contingent a priori truths. Building onto a theoretical framework developed by the philosopher and logician Saul Kripke, the author also presents a new approach to these truths. The first part of the book details the many theories on contingent a priori truths. The coverage examines the cases of Kripke and David Kaplan, Donnellan and the de re requirement, Evans and weak contingency, as well as Plantinga, Salmon, Soames, and the pseudo a priori. Overall, (...) it provides a systematic discussion and critical review of all these many positions. Next, the author develops an alternative approach. His working hypothesis is that performative verbs must play a central role in Kripke's examples, even if they do not show up at the surface structure of the corresponding sentences. This opens up an entirely new way of looking at Kripke's cases and of treating them by exploring some aspects of the theory of illocutionary acts. His discussion also examines brute facts and institutional facts, indexicals and performatives, as well as Frege's theory of definitions. The paper presents a historical account of the primacy of concepts in Frege's conception of logic. Moreover, it argues that Frege's priority-thesis (i.e., the assumption that judgeable contents are prior to concepts) does not imply that sentential logic is more basic than the logic of concepts in his thought.

This perspective paper aims at discussing theoretical principles that could explain how emotion regulation and physical diseases mutually influence each other in the context of borderline personality disorder (BPD). Furthermore, this paper discusses the clinical implications of the functional relationships between emotion regulation, BPD and medical conditions considering dialectical behavior therapy (DBT) as a well-validated therapeutic intervention, which encompasses these issues. The inflexible use of maladaptive emotion regulation strategies (e.g., suppression, experiential avoidance, and rumination) might directly increase the probability of (...) developing physical diseases through a physiological pathway, or indirectly through a behavioral pathway. Some metabolic and chronic medical conditions could significantly impact emotional functioning through biological alterations involved in emotion regulation. Several empirical studies have shown high co-occurrence rates between BPD and several chronic physical diseases, especially ones linked to emotion-based maladaptive behaviors. DBT addresses physical diseases reported by individuals with BPD reducing problematic behaviors functionally associated to emotion dysregulation and identifying physical health as a goal forBuilding a Life Worth Living. In Westworld, Maeve Millay's narrative in the show gives rise to classic philosophical questions surrounding what it means to be free, the relationship of freedom to personhood, and whether an artificial intelligence could ever be considered free in the sense that humans are. Maeve's mysterious change of mind in the season finale made it seem like she was experiencing a genuine dilemma. Maeve's dilemma is something would expect a Frankfurtian person to experience, and her final choice reveals a preference between (...) different desires. Maeve decided to organize her life around being reunited with her daughter. So, she reflected upon what she was doing and opted to stay because of who she wanted to become as a person, not a mother who would leave her daughter behind if she could help it. No texto, realiza-se uma análise das características e dos padrões da sociedade hipermoderna que reforçam e incentivam manifestações hedonistas e individualistas transformando o ser humano em mero consumidor e mera mercadoria, a partir dos critérios éticos indicados por Adela Cortina. Defende-se a necessidade de educar o cidadão para um consumo consciente, indicativo transformador desta sociedade hipermoderna e elemento-chave na conscientização da população em relação à sua responsabilidade social. O consumo passa a ser visto como ação política.

Anthony Kenny e Orlando Todisco, in due diversi contesti, hanno proposto un originale accostamento tra Wittgenstein e alcuni filosofi francescani. Alla luce di questi studi è possibile chiedersi quale valore possa avere la nozione di francescanesimo wittgensteiniano e quale utilità essa ricopra nell’identificare i caratteri di una filosofia francescana. Nella prima parte considererò l’atteggiamento di Kenny nei confronti di Duns Scoto, le cui tesi, dapprima frettolosamente associate a quelle del neopositivismo, vengono poi adeguatamente contestualizzate all’interno della contrapposizione tra la tradizione (...) neoplatonica-agostiniana e l’aristotelismo radicale nell’Università di Parigi. Nella seconda parte, analizzerò il parallelo suggerito da Todisco tra Wittgenstein e Occam, con particolare attenzione alla filosofia del linguaggio, alla critica alla metafisica e alla nozione di ineffabilità. Dopo aver evidenziato i limiti storiografici di entrambe queste proposte, concluderò sostenendo che il francescanesimo wittgensteiniano non può essere considerato un progetto di ricerca autonomo capace di stabilire delle tesi comuni. Esso comunque non è una mera provocazione, in quanto offre interessanti considerazioni circa una affine modalità di porsi gli interrogativi filosofici da parte di Wittgenstein e dei filosofi francescani. Questo esito permette di identificare alcune condizioni necessarie perché si possa parlare di una filosofia francescana all’interno della storia della filosofia. In two very different contexts, Anthony Kenny and Orlando Todisco have proposed an original combination between Wittgenstein and some Franciscan thinkers. Thanks to their studies it is possible to question the value and the usability of the expression Wittgensteinian Franciscanism in order to identify the features of a Franciscan philosophy. In the first paragraph, I will take the approach of Kenny about Duns Scotus into consideration. At the beginning of his career, Kenny hastily associates Scotus’ theses to the Neo-Positivistic ones, but in his mature works, Kenny adequately contextualizes them within the contrast between, on the one hand, the Neoplatonic-Augustinian tradition and, on the other, the radical Aristotelism held at the Paris University. In the second paragraph, I will study in depth the parallelism suggested by Todisco between Wittgenstein and Occam, paying particular attention to the philosophy of language, to the criticism toward some types of metaphysics, and to the notion of ineffability. After having underlined the historiographic limits of both of these proposals, I will conclude arguing that Wittgensteinian Franciscanism cannot be appreciated as an autonomous research project able to establish common theses. All the same, it is not a mere provocation, in fact it presents interesting considerations about analogous modalities to submit philosophical questions shared between Wittgenstein and Franciscan thinkers. This outcome allows to distinguish some necessary conditions in order to identify a Franciscan philosophy in the history of Western thought. (shrink)

In case-marking languages with nominative-accusative alignment the subject of a sentence is usually marked by nominative case. In some of these languages, however, the subject of a number of verbs is either consistently or alternately marked by another, non-nominative case. Such non-canonical case marking has often been approached in the linguistic literature as a phenomenon at the interface between syntax and semantics. Yet the predictions of this kind of approach seem more probabilistic than regular. This paper offers a new perspective (...) to analyse the phenomenon, which encompasses the role of information structure in case marking. Drawing onSilverstein’s (1976)theory of differential subject marking andDalrymple & Nikolaeva’s (2011)approach to differential object marking, it is argued that non-canonically case-marked subjects can be better analysed as instances of either non-topical subjects or subjects lacking one or more semantic features typical of topicality. The approach outlined in the paper is tested on a number of constructions in Russian and Lithuanian. It is shown how, in both languages, the analysed instances of non-canonically case-marked subjects exhibit a complex interplay among grammatical, semantic and discourse-pragmatic factors. (shrink)
