Terms of service of on-line platforms too often contain clauses that are potentially unfair to the consumer. We present an experimental study where machine learning is employed to automatically detect such potentially unfair clauses. Results show that the proposed system could provide a valuable tool for lawyers and consumers alike.

In combating the ongoing global health threat of the COVID-19 pandemic, decision-makers have to take actions based on a multitude of relevant health data with severe potential consequences for the affected patients. Because of their presumed advantages in handling and analyzing vast amounts of data, computer systems of algorithmic decision-making are implemented and substitute humans in decision-making processes. In this study, we focus on a specific application of ADM in contrast to human decision-making, namely the allocation of COVID-19 vaccines to (...) the public. In particular, we elaborate on the role of trust and social group preference on the legitimacy of vaccine allocation. We conducted a survey with a 2 × 2 randomized factorial design among n = 1602 German respondents, in which we utilized distinct decision-making agents and prioritization of a specific social group as design factors. Our findings show that general trust in ADM systems and preference for vaccination of a specific social group influence the legitimacy of vaccine allocation. However, contrary to our expectations, trust in the agent making the decision did not moderate the link between social group preference and legitimacy. Moreover, the effect was also not moderated by the type of decision-maker. We conclude that trustworthy ADM systems must not necessarily lead to the legitimacy of ADM systems. (shrink)

A historical and philosophical reassessment of the impact of Aristotle and early-modern Aristotelianism on the development of Kant’s transcendental philosophy. Kant and Aristotle reassesses the prevailing understanding of Kant as an anti-Aristotelian philosopher. Taking epistemology, logic, and methodology to be the key disciplines through which Kant’s transcendental philosophy stood as an independent form of philosophy, Marco Sgarbi shows that Kant drew important elements of his logic and metaphysical doctrines from Aristotelian ideas that were absent in other philosophical traditions, such (...) as the distinction of matter and form of knowledge, the division of transcendental logic into analytic and dialectic, the theory of categories and schema, and the methodological issues of the architectonic. Drawing from unpublished documents including lectures, catalogues, academic programs, and the Aristotelian-Scholastic handbooks that were officially adopted at Königsberg University where Kant taught, Sgarbi further demonstrates the historical and philosophical importance of Aristotle and Aristotelianism to these disciplines from the late sixteenth century to the first half of the eighteenth century. François Viète is considered the father both of modern algebra and of modern cryptanalysis. The paper outlines Viète’s major contributions in these two mathematical fields and argues that, despite an obvious parallel between them, there is an essential difference. Viète’s ‘new algebra’ relies on his reform of the classical method of analysis and synthesis, in particular on a new conception of analysis and the introduction of a new formalism. The procedures he suggests to decrypt coded messages are particular forms of (...) analysis based on the use of formal methods. However, Viète’s algebraic analysis is not an analysis in the same sense as his cryptanalysis is. In Aristotelian terms, the first is a form of 'analysis,' while the second is a form of 'diaresis.' While the first is a top-down argument from the point of view of the human subject, since it is an argument going from what is not actual to what is actual for such a subject, the second one is a bottom-up argument from this same point of view, since it starts from what is first for us and proceed towards what is first by nature.Keywords: Analysis; Cryptanalysis; Algebra; Aristotle; Viète. Meditation comprises a series of practices mainly developed in eastern cultures aiming at controlling emotions and enhancing attentional processes. Several authors proposed to divide meditation techniques in focused attention and open monitoring techniques. Previous studies have reported differences in brain networks underlying FA and OM. On the other hand common activations across different meditative practices have been reported. Despite differences between forms of meditation and their underlying cognitive processes, we propose that all meditative techniques could share a central process that (...) would be supported by a core network for meditation since their general common goal is to induce relaxation, regulating attention and developing an attitude of detachment from one’s own thoughts. To test this hypothesis, we conducted a quantitative meta-analysis based on activation likelihood estimation of 10 neuroimaging studies on different meditative techniques to evidence the core cortical network subserving meditation. We showed activation of basal ganglia , limbic system and medial prefrontal cortex . We discuss the functional role of these structures in meditation and we tentatively propose a neurocognitive model of meditation that could guide future research. (shrink)

During his celebrated 1922 debate with Bergson, Einstein famously proclaimed: “the time of the philosopher does not exist, there remains only a psychological time that differs from the physicist’s.” Einstein’s dictum, I maintain, has been metabolized by the natural sciences, which typically presuppose, more or less explicitly, the existence of a single, univocal, temporal substratum, ultimately determined by physics. This reductionistic assumption pervades much biological and biomedical practice. The chronological age allotted to individuals is conceived as an objective quantity, allowing (...) one to straightforwardly assign and compare the biological age of organisms. This essay argues that the standard practice of assessing the age and aging of organisms against the backdrop of a physical conception of time is problematic. This becomes especially evident in light of recent discoveries of various levels of senescence underlying the development of individual organisms—a phenomenon known as ‘age mosaicism.’ The bottom line is that the study of age and aging requires a biological conception of time, as opposed to a physical one. Einstein clearly wasn’t wrong about his operationalization of time in relativity theory. Still time may be less monolithic than he surmised. (shrink)

I discuss three arguments that have been advanced in support of the epistemic mentalist view, i.e., the view that infants' social cognitive abilities manifest a capacity to attribute beliefs. The argument from implicitness holds that SCAs already reflect the possession of an “implicit” and “rudimentary” capacity to attribute representational states. Against it, I note that SCAs are significantly limited, and have likely evolved to respond to contextual information in situated interaction with others. I challenge the argument from parsimony by claiming (...) that parsimony per se favors neither a mentalist nor a behavior-reading account. Finally, I argue that early SCAs do not develop continuously into four-year-olds' belief attribution abilities. Accordingly, the argument from developmental continuity is empirically inadequate. Careful analysis of both the empirical data and the theoretical assumptions leading to the epistemic mentalist view is needed in order to improve our understanding of SCAs in earl.. (shrink)

By inserting the dialogue between Einstein, Schlick and Reichenbach into a wider network of debates about the epistemology of geometry, this paper shows that not only did Einstein and Logical Empiricists come to disagree about the role, principled or provisional, played by rods and clocks in General Relativity, but also that in their lifelong interchange, they never clearly identified the problem they were discussing. Einstein’s reflections on geometry can be understood only in the context of his ”measuring rod objection” against (...) Weyl. On the contrary, Logical Empiricists, though carefully analyzing the Einstein–Weyl debate, tried to interpret Einstein’s epistemology of geometry as a continuation of the Helmholtz–Poincaré debate by other means. The origin of the misunderstanding, it is argued, should be found in the failed appreciation of the difference between a “Helmholtzian” and a “Riemannian” tradition. The epistemological problems raised by General Relativity are extraneous to the first tradition and can only be understood in the context of the latter, the philosophical significance of which, however, still needs to be fully explored. A standard approach to examining Deleuze's concept of difference in Difference and Repetition is to follow his critique of representation through an overturning of Platonism, which Deleuze finds to be the definitive task of philosophy after Nietzsche. While engaging this largely critical project, however, there is a tendency to overlook the dimensions of Platonism that Deleuze rehabilitates in a differential and immanent register. This paper aims to recover the essential dimensions of Platonism at the very heart of Deleuze's philosophy of (...) difference. This recovery is accomplished by distinguishing Nietzsche's overturning of Platonism through his evaluation of the reactive politics of the Idea from Deleuze's own reversal of Platonism through his evaluation of the active politics of simulacra. The paper addresses the question of the nature and limits of philosophical thought experiments. On the one hand, experimental philosophers are right to claim that we need much more laboratory work in order to have more reliable thought experiments, but on the other hand a naturalism that is too radical is incapable of clarifying the peculiarity of thought experiments in philosophy. Starting from a historico-critical reconstruction of Kant’s concept of the “experiments of pure reason”, this paper outlines an account of (...) thought experiments in philosophy that tries to reconcile the thesis of a principled difference between scientific and philosophical TEs with the position of a methodological naturalism that does not admit any difference in kind between the methods of science and of philosophy. In the present article, I review some evidence that shows how body odor disgust sensitivity plays a central role in the so-called behavioral immune system, a set of processes aimed at detecting, emotionally reacting, and behaviorally avoiding pathogen threats. I also report empirical evidence on how the BODS relates to social attitudes such as authoritarianism, xenophobia, and condemnation of “impure” moral violations. This research is interpreted from an Evolutionary psychology framework.

In his 1916 review paper on general relativity, Einstein made the often-quoted oracular remark that all physical measurements amount to a determination of coincidences, like the coincidence of a pointer with a mark on a scale. This argument, which was meant to express the requirement of general covariance, immediately gained great resonance. Philosophers such as Schlick found that it expressed the novelty of general relativity, but the mathematician Kretschmann deemed it as trivial and valid in all spacetime theories. With the (...) relevant exception of the physicists of Leiden (Ehrenfest, Lorentz, de Sitter, and Nordström), who were in epistolary contact with Einstein, the motivations behind the point-coincidence remark were not fully understood. Only at the turn of the 1960s did Bergmann (Einstein’s former assistant in Princeton) start to use the term ‘coincidence’ in a way that was much closer to Einstein’s intentions. In the 1980s, Stachel, projecting Bergmann’s analysis onto his historical work on Einstein’s correspondence, was able to show that what he started to call ‘the point-coincidence argument’ was nothing but Einstein’s answer to the infamous ‘hole argument’. The latter has enjoyed enormous popularity in the following decades, reshaping the philosophical debate on spacetime theories. The point-coincidence argument did not receive comparable attention. By reconstructing the history of the argument and its reception, this paper argues that this disparity of treatment is not justified. This paper will also show that the notion that only coincidences are observable in physics marks every critical step of Einstein’s struggle with the meaning of coordinates in physics. (shrink)

Recent discussions on Fregean and neo-Fregean foundations for arithmetic and real analysis pay much attention to what is called either ‘Application Constraint’ ($AC$) or ‘Frege Constraint’ ($FC$), the requirement that a mathematical theory be so outlined that it immediately allows explaining for its applicability. We distinguish between two constraints, which we, respectively, denote by the latter of these two names, by showing how$AC$generalizes Frege’s views while$FC$comes closer to his original conceptions. Different authors diverge on the interpretation of$FC$and on whether it (...) applies to definitions of both natural and real numbers. Our aim is to trace the origins of$FC$and to explore how different understandings of it can be faithful to Frege’s views about such definitions and to his foundational program. After rehearsing the essential elements of the relevant debate (§1), we appropriately distinguish$AC$from$FC$(§2). We discuss six rationales which may motivate the adoption of different instances of$AC$and$FC$(§3). We turn to the possible interpretations of$FC$(§4), and advance a Semantic$FC$(§4.1), arguing that while it suits Frege’s definition of natural numbers (4.1.1), it cannot reasonably be imposed on definitions of real numbers (§4.1.2), for reasons only partly similar to those offered by Crispin Wright (§4.1.3). We then rehearse a recent exchange between Bob Hale and Vadim Batitzky to shed light on Frege’s conception of real numbers and magnitudes (§4.2). We argue that an Architectonic version of$FC$is indeed faithful to Frege’s definition of real numbers, and compatible with his views on natural ones. Finally, we consider how attributing different instances of$FC$to Frege and appreciating the role of the Architectonic$FC$can provide a more perspicuous understanding of his foundational program, by questioning common pictures of his logicism (§5). Special attention is given to the success factors in the subsequent phases of implementation (sensitivity to the organizational environment, awareness of core values and clear leadership), to ensure that the most optimal results attainable for the organization can be reached. In his Zur Einstein’schen Relativitätstheorie, Ernst Cassirer presents relativity theory as the last manifestation of the tradition of the “physics of principles” that, starting from the nineteenth century, has progressively prevailed over that of the “physics of models.” In particular, according to Cassirer, the relativity principle plays a role similar to the energy principle in previous physics. In this article, I argue that this comparison represents the core of Cassirer’s neo-Kantian interpretation of relativity. Cassirer pointed out that before and after (...) Kant, the history of physics presents significant instances in which the search for formal conditions that the laws of nature must satisfy preceded and made possible the direct search for such laws. In his earlier years, Cassirer seems to have regarded principles like the energy principle, the relativity principle, and the principle of least action as a constitutive but provisional form of a priori, imposing specific limitations on the form of the allowable laws of nature. Only in his later years, by attributing an autonomous status to these statements of principle, did Cassirer attribute a definitive but merely regulative meaning to the a priori. This does not impose specific requirements on natural laws but only a motivation to search for them. (shrink)

In their attempt to connect the workings of the human mind with their neural realizers, cognitive neuroscientists often bracket out individual differences to build a single, abstract model that purportedly represents (almost) every human being’s brain. In this paper I first examine the rationale behind this model, which I call ‘Platonic Brain Model’. Then I argue that it is to be surpassed in favor of multiple models allowing for patterned inter-individual differences. I introduce the debate on legitimate (and illegitimate) ways (...) of mapping neural structures and cognitive functions, endorsing a view according to which function-structure mapping is context-sensitive. Building on the discussion of the ongoing debate on the function(s) of the so-called Fusiform “Face” Area, I show the necessity of indexing function-structure mappings to some populations of subjects, clustered on the basis of factors such as their expertise in a given domain. While there is convincing evidence that preverbal human infants and non-human primates can spontaneously represent number, considerable debate surrounds the possibility that such capacity is also present in other animals. Fish show a remarkable ability to discriminate between different numbers of social companions. Previous work has demonstrated that in fish the same set of signature limits that characterize non-verbal numerical systems in primates is present but yet to provide any demonstration that fish can really represent number rather than basing their (...) discrimination on continuous attributes that co-vary with number. In the present work, using the method of 'item by item' presentation, we provide the first evidence that fish are capable of selecting the larger group of social companions relying exclusively on numerical information. In our tests subjects could choose between one large and one small group of companions when permitted to see only one fish at a time. Fish were successful when both small (3 vs. 2) and large numbers (8 vs. 4) were involved and their performance was not affected by the density of the fish or by the overall space occupied by the group. Reductionists in biology claim that all biological events can be explained in terms of genes and macromolecules alone, while antireductionists argue that some biological events must be explained at a higher level. The literature, however, does not distinguish between different kinds of molecular explanation. The goal of this article is to identify and analyze three such kinds. The analysis of molecular explanations herein carries an important philosophical implication; in shunning crude reductionism and extreme versions of holism, we can combine the (...) insights of thoughtful reductionists with sophisticated antireductionism. When this is done, the question of explanatory reductionism becomes less substantial than often supposed. (shrink)

In 1912, Ernst Cassirer contributed to the special issue of the Kant-Studien that honored Hermann Cohen's retirement—his mentor and teacher, and the recognized founding father of the so-called 'Marburg school' of Neo-Kantianism. In the context of an otherwise rather conventional presentation of Cohen's interpretation of Kant, Cassirer made a remark that is initially surprising. It is “anything but accurate,” he wrote, to regard Cohen's philosophy as focused “exclusively on the mathematical theory of nature,” as is usually done. This book fills a major gap in the ever-increasing secondary literature on Hannah Arendt's political thought by providing a dedicated and coherent treatment of the many, various and interesting things which Arendt had to say about law. Often obscured by more pressing or more controversial aspects of her work, Arendt nonetheless had interesting insights into Greek and Roman concepts of law, human rights, constitutional design, legislation, sovereignty, international tribunals, judicial review and much more. This book retrieves these aspects of her (...) legal philosophy for the attention of both Arendt scholars and lawyers alike. The book brings together lawyers as well as Arendt scholars drawn from a range of disciplines (philosophy, political science, international relations), who have engaged in an internal debate the dynamism of which is captured in print. Following the editors' introduction, the book is split into four Parts: Part I explores the concept of law in Arendt's thought; Part II explores legal aspects of Arendt's constitutional thought: first locating Arendt in the wider tradition of republican constitutionalism, before turning attention to the role of courts and the role of parliament in her constitutional design. In Part III Arendt's thought on international law is explored from a variety of perspectives, covering international institutions and international criminal law, as well as the theoretical foundations of international law. We investigated motor resonance in children using a priming paradigm. Participants were asked to judge the weight of an object shortly primed by a hand in an action-related posture or a non action-related one . The hand prime could belong to a child or to an adult. We found faster response times when the object was preceded by a grasp hand posture . More crucially, participants were faster when the prime was a child’s hand, suggesting that it could belong to (...) their body schema, particularly when the child’s hand was followed by a light object . A control experiment helped us to clarify the role of the hand prime. To our knowledge this is the first behavioral evidence of motor simulation and motor resonance in children. Implications of the results for the development of the sense of body ownership and for conceptual development are discussed. (shrink)

A pervasive and much cherished paradigm among historians of science is to view the origin of “modern science” as a reaction against Aristotelians and Aristotle’s ruling authority. But what does a Renaissance Aristotelian really look like? This article seeks to answer this question by bringing to light direct accounts of what it meant to be an Aristotelian at that time and by showing a connection between the antiauthoritarian stance that is typical of early modern scientists and thinkers and that of (...) certain Renaissance Aristotelians. This paper attempts to show how the logical empiricists’ interpretation of the relation between geometry and reality emerges from a “collision” of mathematical traditions. Considering Riemann’s work as the initiator of a 19th century geometrical tradition, whose main protagonists were Helmholtz and Poincaré, the logical empiricists neglected the fact that Riemann’s revolutionary insight flourished instead in a non-geometrical tradition dominated by the works of Christoffel and Ricci-Curbastro roughly in the same years. I will argue that, in the attempt to interpret (...) general relativity as the last link of the chain Riemann–Helmholtz–Poincaré–Einstein, logical empiricists were led to argue that Einstein’s theory of gravitation mainly raised a problem of mathematical under-determination, i.e. the discovery that there are physical differences that cannot be expressed in the relevant mathematical structure of the theory. However, a historical reconstruction of the alternative Riemann–Christoffel–Ricci–Einstein line of evolution shows on the contrary that the main philosophical issue raised by Einstein’s theory was instead that of mathematical over-determination, i.e. the recognition of the presence of redundant mathematical differences that do not have any correspondence in physical reality. O presente trabalho pretende avaliar como as definições matemáticas são abordadas no comentário de Alberto Magno à Física de Aristóteles. Particularmente, procura-se distinguir definição natural de definição matemática. Em seguida, propomos uma interpretação segundo a qual Alberto estaria preocupado em conciliar dois níveis de definições matemáticas: uma definição genética, responsável pela construção dos objetos matemáticos na imaginação, e uma definição matemática propriamente dita, responsável pelas considerações universais dos geômetras.

As state-of-art technology can create artificial images that are indistinguishable from real ones, it is urgent to understand whether believing that a picture is real or not has some import over affective phenomena such as sexual arousal. Thus, in two pre-registered online studies, we tested whether 60 images depicting models in underwear elicited higher self-reported sexual arousal when believed to be (N = 57) or presented as (N = 108) real photographs as opposed to artificially generated. In both cases, Realness (...) correlated with significantly higher scores on self-reported sexual arousal. Consistently with the literature on downregulation of emotional response to fictional works, our result indicates that sexual images that are perceived to be fake are less arousing than those believed to portray real people. This article aims to present one of the main themes that characterize the philosophical reflection of Jan Patočka: the appearing as such. Specifically, this papers is focused on three questions: what (was) appears? How (wie) the world appears? Which is the hidden reason (Grund) that founds appearing, but that remains hidden? The Czech philosopher reaches a conception of phenomenality in which appearance can only be conceived through an a priori structure. This conception leads to a formal transcendentalism of appearing, on (...) the basis of which it can only be thought, but not shown. The formal character of Patočka's approach, however, is a consequence of his speculative method. This speculative method, nevertheless, is problematic because on the one hand the structure of appearing is only responsible for its own laws (and not for what appears), on the other hand Patočka states that the phenomenal sphere also has a practical and vital function. The article traces the way the philosopher proceeds on this theme, which points he analyzes it discusses and which difficulties he exposes himself to. Although Patočka's reflection seems to postulate more than what he can justify (neglecting appearing as experiencing), it offers a strong hint to rethink the roots of the major phenomenological themes still remaining open. Operationalism and theoretical entities. The thesis of the“theory ladenness” of observation leads to an antinomy. In order to solve this antinomy a technical operationalism is sketched, according to which theories should in principle not contain anything that cannot be reduced to technical procedures. This implies the rejection of Quine's underdeterminacy thesis and of many views about the theoretical-observational distinction, e.g. neopositivistic views, van Fraassen's view, Sneed-Stegmüller's view. Then I argue for the following theses: 1. All scientific concepts are theory laden (...) in the sense that they allow us to anticipate possible experiences, but they have to be in principle fully observable, i.e. integrally convertible into operational-technical applications. 2. The observation/theory distinction can be maintained as a historical one: what is observable depends on the instruments that are available at any stage of the development of science. 3.In principle theoretical entities are empirically real in Hacking's sense. However, some aspects of Hacking's realism are to be criticized. Theoretical entities are to be resolved into the totality of the interrelated properties accessible to us by means of theoretical points of view embodied in scientific instruments. (shrink)

The essay aims to analyse the gradual historical process of the partial overlap, replacement and expansion of the theoretical paradigm of depression with respect to that of melancholy. The first part is devoted to analysing some of the central features of the multivalent thematizations of melancholy drawn up during modernity, also with relation to the spirit of capitalism (in its Weberian acceptation). This is followed by an overview of the birth of the modern category of depression, and the process that (...) during the twentieth century led to its transformation into a theoretical and nosological paradigm which in the end replaced that of melancholy. The second part is the attempt to draw up a Zeitdiagnose: the aim is to assess the ‘depressive’ psychosocial impact exercised by particular socio-economic mechanisms and cultural trends, with particular reference to what has been defined as the ‘new spirit of capitalism’, as well as the new forms of individualism and their paradoxical dynamics. In conclusion, I will form a bridge between the history of the two aforesaid paradigms and the contemporary psychosocial dynamics correlated to the phenomenon today interpreted as a ‘depression epidemic’. Der Aufsatz zielt darauf, der Prozess der historischen Überlagerung, Substitution und Verbreitung des theoretischen Paradigmas der Depression gegenüber jenem der Melancholie darzustellen. Im ersten Teil wird versucht, einige der einschneidenden Eigenschaften der Thematisierungen der Melancholie in der Frühen Neuzeit anzugeben, auch im Verhältnis zum Geist des Kapitalismus. Nachdem eine Skizze der Entstehung der moderne Kategorie der Depression, geht es darum, den Verlauf nachzuzeichnen, der im 20. Jahrhundert zu ihrer Transformation in ein weitläufiges theoretisches Paradigma geführt hat, das schließlich jenes der Melancholie ersetzt hat. Der zweite Teil stellt den Versuch dar, eine Zeitdiagnose umzureißen: An dieser Stelle ist die psychosoziale Bedeutung bestimmter sozioökonomischer und kultureller Mechanismen zu untersuchen, unter besonderem Hinweis auf das, was als »der neue Geist des Kapitalismus« bezeichnet worden ist, sowie auf neue Formen des Individualismus und ihre paradoxen Dynamiken. Abschließend wird eine Brücke geschlagen, zwischen der Geschichte der beiden bezeichneten Paradigmen und der zeitgenössischen psychosozialen Dynamiken, die mit dem als »depressive Epidemie« interpretierten Phänomen verbunden sind. This edited collection addresses the complexity of Islamic political thought and resolves some deep misconceptions surrounding crucial concepts such as din wa-dawla relationships and shari’a law.

This work approaches views on the preservation of industrial housing heritage in Malaga, Spain, and the pressure caused by its recent urban renovation. The aims of the research include geographic space analysis and assessing how archaeological recording and archaeometry, specifically archaeometallurgy, can contribute to the preservation of information about structures and materials that continuously disappear from urban contexts. The results constitute an initial beginning to expand a comparative archaeological database for the city.
