Terms of service of on-line platforms too often contain clauses that are potentially unfair to the consumer. We present an experimental study where machine learning is employed to automatically detect such potentially unfair clauses. Results show that the proposed system could provide a valuable tool for lawyers and consumers alike.

Driven by the increasing availability and deployment of ubiquitous computing technologies across our private and professional lives, implementations of automatically processable regulation (APR) have evolved over the past decade from academic projects to real-world implementations by states and companies. There are now pressing issues that such encoded regulation brings about for citizens and society, and strategies to mitigate these issues are required. However, _comprehensive yet practically operationalizable_ frameworks to navigate the complex interactions and evaluate the risks of projects that implement (...) APR are not available today. In this paper, and based on related work as well as our own experiences, we propose a framework to support the conceptualization, implementation, and application of _responsible_ APR. Our contribution is twofold: we provide a holistic characterization of what responsible APR means; and we provide support to operationalize this in concrete projects, in the form of leading questions, examples, and mitigation strategies. We thereby provide a scientifically backed yet practically applicable way to guide researchers, sponsors, implementers, and regulators toward better outcomes of APR for users and society. (shrink)

This article is an attempt to show Karl Marx from the humanistic perspective in order to prove that it is unauthorized to blame him for all the evil of totalitarianism. The semantic content of the presented material includes three key areas. The first figure refers to Karl Marx, his personal characteristics and activity. Secondly, a question of philosophical foundations on which the thought of Marx is set. The third aspect of the problem concerns his economic theory. All these planes are (...) explored through the prism of Marx’s humanism. The article is summarised by a short reflection which denudes errors in Marx is dogmatism and reflect son the pertinence of setting Marx in a series of dictator criminals. (shrink)

Celem artykułu jest prześledzenie kariery wojskowej wojewody krakowskiego Mikołaja Zebrzydowskiego oraz próba znalezienia odpowiedzi na pytania, w jakim stopniu wpłynęła ona na jego cywilną działalność oraz pomogła w budowie prestiżu Zebrzydowskiego i jego rodziny. Badania zostały przeprowadzone na podstawie źródeł rękopiśmiennych oraz wydanych drukiem (księgi Metryki Koronnej, akta skarbowe oraz skarbowo-wojskowe, korespondencja, diariusze), jak również literatury przedmiotu. Przyjęta na wstępie badań teza zakładała, że służba wojskowa – najpierw w charakterze rotmistrza jazdy, później zaś hetmana nadwornego – odegrała istotną rolę w (...) życiu Zebrzydowskiego, znacznie przyczyniając się do rozwoju kariery urzędniczej oraz pozwalając na gromadzenie przezeń majątku, zwłaszcza dzięki nadaniom dóbr królewskich. Bezpośrednia oraz pośrednia analiza źródeł oraz opracowań pozwoliła pozytywnie zweryfikować przyjęte założenia badawcze. Mikołaj Zebrzydowski nie należał do najwybitniejszych rotmistrzów epoki Stefana Batorego oraz Zygmunta III, ale służba wojskowa odegrała znaczącą rolę w jego karierze. Zdobyte w toku wypraw wojennych zaufanie Stefana Batorego, a zwłaszcza jego najbliższego współpracownika, kanclerza oraz hetmana koronnego Jana Zamoyskiego, zaprocentowało nadaniami urzędów oraz dóbr królewskich i pozwoliło Zebrzydowskiemu wspiąć się na szczyt hierarchii senatorskiej oraz położyć podwaliny pod potęgę rodziny. Ciekawe, że formy aktywności wojskowej Zebrzydowskiego zmieniają się wraz z rytmem jego awansów. Rotmistrz jazdy nadwornej w latach 1576–1582, a następnie wojska kwarcianego zostaje wraz z uzyskaniem starostwa krakowskiego strażnikiem stolicy państwa, po czym jako wojewoda lubelski i hetman nadworny dowodzi znaczącymi – w owych czasach – oddziałami wojskowymi. Wydatki, poczynione w związku z działaniami wojennymi, zwracają się jednak nie tyle dzięki dochodom z żołdu, ile dzięki łasce królewskiej i zaufaniu Zamoyskiego. (shrink)

The article presents one of the lesser known treatise produced within the Polish Socinian movement, written by Johann Ludwig von Wolzogen (ca. 1599-1661), under the title Breves in Meditationes Metaphysicas Renati Cartesii annotationes [Brief Notes on the Metaphysical Meditations of Rene Descartes]. It appeared in print in 1657 in Amsterdam and was ten years later reprinted in the series Bibliotheca Fratrum Polonorum. In its entirety, the text is intended as a polemic against Descartes's views and written as a detailed commentary (...) on the Meditationes de prima philosophia. Here I intend to demonstrate that Wolzogen's treatise deserves a close scrutiny. First of all, it considerably contributes to our knowledge on the 17th century disputes around the Meditations on First Philosophy. Second, it represents the first substantive and fairly extensive discussion of Descartes's philosophy to appear in the territory of the Polish-Lithuanian Commonwealth. Third, it is a treatise issued from the milieu of the Polish Socinians (the Polish Brethren) that has been recognized by recent research as having exerted a non-negligible influence upon the development of the progressive European thought of the period, both in the domain of theology and philosophy. Górny Śląsk kilkakrotnie stawał na „na rozdrożu” swoich dziejów. Stanął także niewątpliwie po Wielkiej Wojnie. Okres powstań śląskich i plebiscytu na Górnym Śląsku doczekał się bardzo bogatej literatury przedmiotu. Konsekwencją tamtego czasu był podział regionu między Polskę a Niemcy. Prace nad wytyczaniem linii granicznej nie były dotąd przedmiotem wnikliwych studiów historyków. Najczęściej poruszano ten problem przy okazji omawiania okresu powstańczo-plebiscytowego. Artykuł jest próbą wyjścia naprzeciw takiemu stanowi rzeczy. Jego celem jest usystematyzowanie wiedzy oraz ukazanie przebiegu sporu o granicę na Górnym (...) Śląsku między Polską a Niemcami w latach 1921–1922 na podstawie literatury przedmiotu i źródeł archiwalnych przechowywanych w zasobie Archiwum Państwowym w Opolu. Nie aspiruje on bynajmniej do rangi całościowej i wyczerpującej syntezy na ten temat. W wytyczanie granicy zaangażowana była każda ze stron w sporze o Górny Śląsk między Warszawą a Berlinem. Propozycje podziału padały tuż po głosowaniu plebiscytowym (20 marca 1921 r.) i formułowano je do czasu przejęcia sprawy przez Ligę Narodów. Projekt granicy przyjęto 20 października 1921 r., po czym ruszyły prace nad jej wytyczeniem w terenie. Zajęła się tym specjalnie do tego celu powołana Komisja Graniczna, w której zasiadali również przedstawiciele Polski i Niemiec. Spór o przebieg linii granicznej między Polską a Niemcami, często w sposób kuriozalny wytyczoną, toczył się przede wszystkim o okręg przemysłowy – region najbardziej pożądany dla obu stron. Ostateczna granica została potwierdzona i przyjęta przez obydwa kraje w konwencji o Górnym Śląsku z 15 maja 1922 r. Specyfika tytułowego zagadnienia powoduje, że świetnym jego uzupełnieniem jest prezentacja mapy, ukazującej dokładny przebieg wytyczonej linii granicznej. Uzupełnia ona w ten sposób słowo pisane, dając jeszcze lepsze wyobrażenie o przebiegu tej granicy. Mapa ta przechowywana jest w zespole Rejencja Opolska w zasobie opolskiego archiwum. (shrink)

In this short paper I consider Professor Bence Nanay’s suggestion that representationalism can be supported by the theory of tropes. I argue that from a philosophical point of view such a support is nevertheless not very strong.

Gestural and pantomimic accounts of language origins propose that language did not develop directly from ape vocalisations, but rather that its emergence was preceded by an intervening stage of bodily-visual communication, during which our ancestors communicated with their hands, arms, and the entire body. Gestural and pantomimic scenarios are again becoming popular in language evolution research, but this line of thought has a long and interesting history that gained special prominence in the Enlightenment, often considered the golden age of glottogony. We highlight several themes key to this line of reflection, such as the idea of innate communication that consists of visual bodily signs and non-linguistic vocalisations; the division of labour between these two semiotic resources ; or the developmental trajectory of this bi-modal system of communication determined by its transmission through generations of users and the intervention of social factors. We confront these ideas with problems discussed in current language evolution research, focusing on polysemioticity, sign function, conventionality and modality transition. (shrink)

Przedmiotem niniejszej pracy jest analiza rozprawki An Essay Concerning the Use of Reason in Propositions, The Evidence whereof depends upon Human Testimony (Londyn 1707, II wyd. 1709) brytyjskiego filozofa Anthony’ego Collinsa (1676-1729). Analiza ta prowadzi do odkrycia trudności bronionego w niej stanowiska, polegających na niejasności użytej terminologii, niejednoznaczności tezy głównej, zgodnie z którą warunkiem koniecznym uznania twierdzenia jest jego zgodność z rozumem, oraz niewystarczalności jej podanego w Eseju uzasadnienia. Zarysowano również kontekst filozoficzny i historyczny tego rzadko analizowanego dzieła.

There has been a growing interest in research concerning memory modification technologies (MMTs) in recent years. Neuroscientists and psychologists are beginning to explore the prospect of controllable and intentional modification of human memory. One of the technologies with the greatest potential to this end is optogenetics—an invasive neuromodulation technique involving the use of light to control the activity of individual brain cells. It has recently shown the potential to modify specific long-term memories in animal models in ways not yet possible (...) with other MMTs. As the therapeutic potential of optogenetics has already prompted approval of the first human trials, it is especially important and timely to consider the opportunities and dangers this technology may entail. In this article, we focus on possible consequences of optogenetics as an MMT by analyzing fundamental threats potentially associated with memory modifications: the potential disruption of personality and authenticity. This paper analyses the international media coverage of the dispute surrounding the pardons the Polish President granted in 2015 to two politicians, arrested almost a decade later. However political this case has become, it is underlain by a specific interpretive problem concerning the presidential pardon power under the Constitution, particularly whether it can be exercised before a final conviction (the so-called ‘individual abolition’). This question has long been controversial in scholarship and, in recent years, has been addressed by top Polish (...) courts, passing conflicting rulings. Attempting to probe into the intersection of journalism, politics, law and linguistics, this paper evaluates the issue’s portrayal in 37 articles published on major news websites around the time of the arrest. It is argued that when reporting local legal news, international media engage in a dual translation, rendering legal communications in one language into media communications in another. While ‘lossless’ transfer cannot be expected, this research shows that certain limits should not be crossed to maintain journalistic standards. In particular, most articles entirely omit the scholarship and rulings confirming the validity of the pardons. Consequently, readers are not given an opportunity to become aware of all relevant facts and perhaps seek further information. On the positive side, it has been found that simple and accessible language does not necessarily mean material distortions in the coverage of legal issues. The research thus suggests that reporting domestic legal news for international audiences requires understanding the source context, conscious language use and a reliable selection of information. The paper attempts to construct a theoretical account of what melancholy—in a psychoanalytical and cultural sense—may mean for jurisprudence. It argues that the map of relations and displacements between the object and the subject that is associated with melancholy in different psychoanalytical approaches can be fruitfully adopted for understanding of normativity. Based on a thorough re-reading of Freud’s Trauer und Melancholie, it suggests that there is an irremovable component of melancholy contained in the primordial act of separation of normativity from (...) non-normative reality. This interpretation is confronted with Kelsen’s Theory of Pure Law in order to analyse in which respect the momentum of self-sufficiency within normativity entails structures of melancholy. Kelsen’s concept of ‘effectiveness’ is proposed as a key link which explains how melancholic withdrawal allows the law to interact with reality. Then the paper discusses Agamben’s theory of applicability and of the state of exception to demonstrate the law’s melancholic trap. Finally, the paper draws on Lacanian and post-Lacanian approaches to melancholy in order to investigate how melancholic momentum is inherent in the very structure of the law’s validity. (shrink)

Preview: The status of philosophy of culture seems to be notoriously unclear. Since its birth as a methodologically self-aware discipline, it constantly provokes controversies and questions concerning its nature, scope, and objective field of cognitive interests. Is it to be conceived – as it was intended by Wilhelm Dilthey – as a kind of philosophical foundation for Geisteswissenschaften and even more specifically for Kulturwissenschaften – in which case it would play a parallel role to philosophy of science in its relation (...) to natural sciences? Or is it to be understood as a kind of inter-discipline or trans-discipline whose task is to provide a synoptic view on the world we live in and try to understand? Or perhaps one should see it as a particular meta-philosophical orientation – understood rather in terms of a specific approach or a form of sensitivity than as a discipline which would be fully determined with regard to its methodology and objective field of cognitive interests? Or, as some scholars quite convincingly suggest, should be seen first and foremost as a way of life oriented around human intellectual and spiritual growth? Or still as something else? Furthermore, even if we assume a common agreement with regard to its nature and status among other philosophical disciplines as well as its relation to humanities and natural sciences – it does not mean that it will be followed by a similar agreement with regard to its most adequate methodological approach. Should it be: descriptive, archeological, critical, procesual, teleological, normative? Perhaps a synthesis comprising all of them? Or still something different? (shrink)

While in the majority of English-speaking territories the dominant legal tradition is common law, in Louisiana and Quebec the native language is English and the legal system stems from continental civil law. Both the Louisiana Civil Code and the Civil Code of Quebec take root in the European codification movement, following Code Napoleon. Bearing in mind the link between law and language, these jurisdictions provide a unique source of English civil law terminology with well-founded conceptual background. The civil codes of (...) Louisiana and Quebec seem to be potentially useful for the translation of Polish private law into English. Yet there are some reservations which should be considered. By comparing two different translations of Article 292 of the Polish Civil Code, this paper is intended to contribute to the debate on the use of Quebec and Louisiana terminology in Polish-English legal translation.
