Involuntary psychiatric commitment for suicide prevention and physician aid-in-dying (PAD) in terminal illness combine to create a moral dilemma. If PAD in terminal illness is permissible, it should also be permissible for some who suffer from nonterminal psychiatric illness: suffering provides much of the justification for PAD, and the suffering in mental illness can be as severe as in physical illness. But involuntary psychiatric commitment to prevent suicide suggests that the suffering of persons with mental illness does not justify ending (...) their own lives, ruling out PAD. Since both practices have compelling underlying justifications, the most reasonable accommodation might seem to be to allow PAD for persons with mental illness whose suffering is severe enough to justify self-killing, but prohibit PAD for persons whose suffering is less severe. This compromise, however, would require the articulation of standards by which persons’ mental as well as physical suffering could be evaluated. Although the recent emphasis on models in philosophy of science has been an important development, the consequence has been a shift away from more traditional notions of theory. Because the semantic view defines theories as families of models and because much of the literature on “scientific” modeling has emphasized various degrees of independence from theory, little attention has been paid to the role that theory has in articulating scientific knowledge. This paper is the beginning of what I hope will be (...) a redress of the imbalance. I begin with a discussion of some of the difficulties faced by various formulations of the semantic view not only with respect to their account of models but also with their definition of a theory. From there I go on to articulate reasons why a notion of theory is necessary for capturing the structure of scientific knowledge and how one might go about formulating such a notion in terms of different levels of representation and explanation. The context for my discussion is the BCS account of superconductivity, a `theory' that was, and still is, sometimes referred to as a `model'. BCS provides a nice focus for the discussion because it illuminates various features of the theory/model relationship that seem to require a robust notion of theory that is not easily captured by the semantic account. The rich conceptual and experiential relays between music and philosophy—echoes of what Theodor W. Adorno once called _Klangfiguren_, or "sound figures"—resonate with heightened intensity during the period of modernity that extends from early German Idealism to the Critical Theory of the Frankfurt School. This volume traces the political, historical, and philosophical trajectories of a specifically German tradition in which thinkers take recourse to music, both as an aesthetic practice and as the object of their speculative work. This chapter offers a conceptual analysis of territory, distinguishes it from property accounts, and discusses different versions of property accounts, all derived from Locke’s ‘Second Treatise of Government’. It offers a conceptual analysis of territory and the various rights associated with territory. According to Locke, territorial right is established through the subjection, by free consent, of persons and their land to state authority. This theory is found to rest on a number of flawed assumptions, among them claims to natural rights (...) of property and an obvious link between private property and territorial jurisdiction. Cara Nine draws on Lockean principles to claim that a state is a collective that, like individuals, owns property, namely the territory of the state. After examining the historical antecedents of such ideas, the chapter points away from them and towards accounts of territory based on individual and collective claims of rights. (shrink)

Making a show of conceding by using a three-part structure of proposition, concession and reassertion has the effect - in contrast to other ways of conceding - of strengthening one's own position at the expense of a counter-argument. This three-part structure can be also exploited so as to carry the battle to the enemy, as it were, and make the concession do more offensive work. We detail three such ways: Trojan Horses where the speaker imports a caricature of the opposition (...) into the conceded material; stings in the tail, where the speaker specifically overturns the concession they have just made in the original claim; and cheapeners, where the speaker works pragmatically to devalue even a positive endorsement of the opposition's case. In all their variety, what marks the concession as being hearably in the speaker's own interest is the robust, normative three-part proposition - concession - reprise structure. It is available for use in supporting or demeaning any position, whether mundane or explicitly ideological. (shrink)

Despite its virtues, lay decision-making in medicine shares with professional decision-making a disturbing common feature, reflected both in formal policies prohibiting high-risk research and in informal policies favoring treatment decisions made when a crisis or change of status occurs, often late in a downhill course. By discouraging patient decision-making but requiring dedication to the patient's interests by those who make decisions on the patient's behalf, such practices tend to preclude altruistic choice on the part of the patient. This eclipse is (...) to be regretted not just because widescale altruism has the capacity to provide important social goods and correct injustices in distribution, but for intrinsic reasons as well. It is argued that preserving the possibility of altruism obliges patients – and future patients – to make decisions about dying and other medical matters in advance, thus avoiding that displacement of decision-making onto lay and professional second parties which results in altruism's eclipse. The problem of the transcendental has haunted philosophy for some time now. How can we think that which is external to our thought without by that token assimilating it to our thought? In other words, how can we speak of the outside without by that very gesture bringing it inside? While this conversation spun its complex tapestry over centuries, there developed alongside various attempts to dismiss or deflate the problem altogether. The most recent manifestation of this deflationary tendency is the (...) “speculative materialism” movement, represented with most clarity by Quentin Meillassoux in his 2006 work After Finitude. He attempts here to restore “the Great Outdoors” to a philosophical tradition mired in what he calls “correlationism,” which he characterizes as a kind of narcissism. So the present conjuncture seems to offer us a choice between the subjective transcendental cellar and the wilderness of speculative materialism. In this essay, we articulate an alternative to this choice rooted in readings of Merleau-Ponty and Deleuze. Our intent here is not to compare or contrast their bodies of work as wholes, but to trace a distinct philosophical maneuver that is not only common to the two thinkers but reveals a link between them. Rather than annulling the transcendental question, these figures encourage us to reverse it, and ask instead “how can we think the inside without by that very token bringing it outside?” This provides us with a response to the problem of philosophy’s narcissism without recourse to Meillassoux’s “speculative” solution.Le problème du transcendantal a hanté la philosophie depuis un bon moment à présent. La manifestation la plus récente de cette dernière tendance est le mouvement du « matérialisme spéculatif » représenté avec le plus de clarté par Quentin Meillassoux dans son oeuvre de 2006, Après la finitude. La manifestazione più recente di questa tendenza coincide con il movimento del “materialismo speculativo”, rappresentato nel modo più emblematico da Quentin Meillassoux con il suo saggio Après la finitude, pubblicato nel 2006. In questo saggio, l’autore tenta di restituire “il Grande Fuori” a una tradizione filosofica invischiata in quello che egli definisce “correlazionismo” e che descrive come una sorta di narcisismo. La situazione attuale sembra così porci di fronte all’alternativa tra la chiusura angusta del trascendentale soggettivo e l’apertura incontrollata del materialismo speculativo. In questo articolo, sviluppiamo una proposta alternativa basata sulla lettura di Merleau-Ponty e di Deleuze. Il nostro intento non è quello di confrontare o contrapporre le opere dei due autori nel loro complesso, ma quello di evidenziare una precisa mossa filosofica che non solo li accomuna, ma li rivela come effettivamente connessi. Piuttosto che annullare l’interrogativo trascendentale, questi autori ci invitano a capovolgerlo, domandandosi invece: “Come possiamo afferrare con il pensiero l’interno senza per ciò stesso portarlo all’esterno?”. Questa mossa fornisce una risposta al problema del narcisismo della filosofia eludendo il ricorso alla soluzione “speculativa” di Meillassoux. (shrink)

This article examines different conceptions of causation and their implications for understanding educational phenomena and conducting educational research. Specifically, I discuss four research designs for pursuing questions about causation in education. Two of these research designs take a variance approach to causation , while the other two take a process approach . The point of the discussion is to illustrate, first, their respective strengths and, second, their necessary interdependence. Ultimately, I argue that just as both hammers and saws are needed (...) to build a good house, both variance and process approaches are needed to build a good understanding of causation in education. Legal pluralism refers to the idea that in any one geographical space defined by the conventional boundaries of a nation state, there is more than one law or legal system. This article examines several aspects of legal pluralism focusing on the relationship between the empirical facts of pluralism and its conceptual foundations. Variety of factors produce the perception of legal pluralism, which is reflected in intensified interest in the concept in contemporary scholarship. Legal philosophy and sociological approaches to law often (...) still occupy quite separate scholarly terrains. Legal pluralism has been identified as a fruitful area for constructive engagement between legal philosophy and the sociology of law. This article emphasizes the fact that with the decline of nation states as the locus of political and legal power, it seems inevitable that traditional state-centered legal philosophy must give way to a different paradigm, which recognizes the plurality of law. This book, the last volume in the Social Morphogenesis series, examines whether or not a Morphogenic society can foster new modes of human relations that could exercise a form of 'relational steering', protecting and promoting a nuanced version of the good life for all. It analyses the way in which the intensification of morphogenesis and the diminishing of morphostasis impact upon human flourishing. The book links intensified morphogenesis to promoting human flourishing based on the assumption that new opportunities open up (...) novel experiences, skills, and modes of communication that appeal to talents previously lacking any outlet or recognition. It proposes that equality of opportunity would increase as ascribed characteristics diminished in importance, and it could be maintained as the notion of achievement continued to diversify. Digitalization has opened the cultural 'archive' for more to explore and, as it expands exponentially, so do new complementary compatibilities whose development foster yet further opportunities. If more people can do more of what they do best, these represent stepping stones towards the 'good life' for more of them. (shrink)

This brief response aims to contextualize and reflect further on James Gustafson's new essay regarding “participation” in relation to God, nature, and human beings. In it I attempt to address Gustafson's innovative method and the difference it makes for interpreting some of his previous work. For the first time Gustafson's direct mode of access to the meaning and implications of human participation is through his own experience. I argue that he breaks new ground with what might be called descriptive experiential (...) analysis, moving forward yet harking back to longtime central themes regarding knowledge of God, moral discernment, theocentrism and anthropocentrism, relationalism and unity. Margaret Otlowski investigates the complex and controversial issue of active voluntary euthanasia. She critically examines the criminal law prohibition of medically administered active voluntary euthanasia in common law jurisdictions, and carefully looks at the situation as handled in practice. The evidence of patient demands for active euthanasia and the willingness of some doctors to respond to patients' requests is explored, and an argument for reform of the law is made with reference to the position in the Netherlands (where active (...) voluntary euthanasia is now openly practiced). I defend moral objectivism against charges that it cannot plausibly preserve or explain morality's action-guiding nature. I take as my starting point the intuitive view that morality has a special connection to motivation: one who genuinely accepts a moral verdict must have a motivating reason to follow its dictates and, indeed, must often enough be motivated to act as it recommends. ;Many have argued that this connection vindicates subjectivism. Some argue that there can be no universally accessible truths whose acknowledgements (...) necessarily give one reason to act, because all reasons for action are based on desires that vary across rational agents. I argue against the Humean doctrine, implicit in this claim, that beliefs alone cannot move rational agents. The 18th-century metaphors of "passive" belief and "active" desire rest on arguments which either beg the question, equivocate, or misunderstand what would be involved in attributing the appropriate motivational power to belief. Others ground their objection in morality's holistic tie to desire, claiming that desires distort truth, rather than reveal it to us. I argue that there is nothing mysterious about the idea that possession of certain desires can be preconditions to seeing how things are. (shrink)

This book addresses one of the most urgent questions in American society today, one that is currently in the spotlight and hotly debated on all sides: Who shall rule the schools--parents or educators? _School Choice or Best Systems: What Improves Education?_ presents an overview of research and practical applications of innovative--even radical--school reforms being implemented across the United States. These fall along a continuum ranging from "parental choice" to "best systems." At the one extreme are schools of choice, which allow (...) parents to choose and even govern schools for their children. These include charter schools, traditional private and parochial schools, schools that are privately governed but publicly funded through vouchers, and those that are funded by private scholarships provided by both corporations and wealthy individuals. At the other extreme are centralized state or district systems, based on reform initiatives and new systems of education that have been developed in response to views of citizens and legislators that schools can do much better. These schools, which specify uniform goals, policies, and programs for each school, are highly innovative systems based on research or representing advanced thinking about "what works," and have attracted wide interest. Important questions related to schools of choice and best systems are addressed: How can we choose among schools of choice and best systems? Among the various approaches within each of these alternatives? How can we understand their guiding principles and operational practices? What results do they produce? How can we evaluate their claims? In choosing among the alternatives, how should issues of student achievement, accountability, costs, feasibility, and equity be factored in? This volume brings together leading researchers and education leaders who have carried out the latest studies and advances in the field, providing a forum for them to set forth the arguments and evidence that will be most helpful in making choices for tomorrow's schools. It does not provide a single "right" answer--values and preferences differ across parents, schools, districts, and states. However, there are benefits for all from seeing the rigorous research, challenging thinking, and alternate points of view this volume presents. (shrink)

A limiting factor in ethics education in medical training has been difficulty in assessing competence in ethics. This study was conducted to test the concept that content analysis of pediatric residents’ personal reflections about ethics experiences can identify changes in ethical sensitivity and reasoning over time. Analysis of written narratives focused on two of our ethics curriculum’s goals: 1) To raise sensitivity to ethical issues in everyday clinical practice and 2) to enhance critical reflection on personal and professional values as (...) they affect patient care. Content analysis of written reflections was guided by a tool developed to identify and assess the level of ethical reasoning in eight domains determined to be important aspects of ethical competence. Based on the assessment of narratives written at two times (12 to 16 months/apart) during their training, residents showed significant progress in two specific domains: use of professional values, and use of personal values. Residents did not show decline in ethical reasoning in any domain. This study demonstrates that content analysis of personal narratives may provide a useful method for assessment of developing ethical sensitivity and reasoning. (shrink)

The Erasmus + Play4Guidance project introduces an online business game, designed to help teach entrepreneurial, transversal and mathematical skills using a real-world business environment. This paper explains how the Business Model Canvas strategy tool facilitated student understanding of real life business development prior to playing the game. An initial mapping exercise was conducted to find out if the Business Model Canvas could transform the experience of playing the game by providing an overview of real life business strategy, and explain the (...) crucial role that markets and customers play in business growth. As a result of the mapping exercise a workshop session was developed to ensure that students could enact the real life business scenarios presented in the game. Three different types of videos were produced and integrated into the workshop to demonstrate key entrepreneurial competencies and graphically illustrate the nine key building blocks of the BMC. Survey responses from a student cohort evidenced that the workshop was central in helping them to understand real life business strategy prior to playing the game. (shrink)
