For decades, the discussion on children’s competence to consent to medical issues has concentrated around normative concerns, with little progress in clinical practices. Decision-making competence is an important condition in the informed consent model. In pediatrics, clinicians need to strike a proper balance in order to both protect children’s interests when they are not fully able to do so themselves and to respect their autonomy when they are. Children’s competence to consent, however, is currently not assessed in a standardized way. (...) BackgroundFor many decades, the debate on children’s competence to give informed consent in medical settings concentrated on ethical and legal aspects, with little empirical underpinnings. Recently, data from empirical research became available to advance the discussion. It was shown that children’s competence to consent to clinical research could be accurately assessed by the modified MacArthur Competence Assessment Tool for Clinical Research. Age limits for children to be deemed competent to decide on research participation have been studied: generally children of 11.2 (...) years and above were decision-making competent, while children of 9.6 years and younger were not. Age was pointed out to be the key determining factor in children’s competence. In this article we reflect on policy implications of these findings, considering legal, ethical, developmental and clinical perspectives.DiscussionAlthough assessment of children’s competence has a normative character, ethics, law and clinical practice can benefit from research data. The findings may help to do justice to the capacities children possess and challenges they may face when deciding about treatment and research options. We discuss advantages and drawbacks of standardized competence assessment in children on a case-by-case basis compared to application of a fixed age limit, and conclude that a selective implementation of case-by-case competence assessment in specific populations is preferable. We recommend the implementation of age limits based on empirical evidence. Furthermore, we elaborate on a suitable model for informed consent involving children and parents that would do justice to developmental aspects of children and the specific characteristics of the parent-child dyad.SummaryPrevious research outcomes showed that children’s medical decision-making capacities could be operationalized into a standardized assessment instrument. Recommendations for policies include a dual consent procedure, including both child as well as parents, for children from the age of 12 until they reach majority. For children between 10 and 12 years of age, and in case of children older than 12 years in special research populations of mentally compromised patients, we suggest a case-by-case assessment of children’s competence to consent. Since such a dual consent procedure is fundamentally different from a procedure of parental permission and child assent, and would imply a considerable shift regarding some current legislations, practical implications are elaborated. This article builds on feminist scholarship on new biologies and the body to describe the temporal politics of epigenetic research related to the human placenta. Drawing on interviews with scientists and observations at conferences and in laboratories, we argue that epigenetic research simultaneously positions placenta tissue as a way back into maternal and fetal bodies following birth, as a lens onto children’s future well-being, and as a bankable resource for ongoing research. Our findings reflect how developmental models of health have (...) helped recast the placenta as an agential organ that is uniquely responsive to environments during pregnancy and capable of embodying biological evidence about the effects of in utero experiences after birth. We develop the concept of ‘recursive embodiment’ to describe how placenta epigenetics is reimagining relationships between bodies and environments across developmental, epigenetic, and generational time, and the impacts this has for experiences of pregnancy and responsibilities related to children’s health. Emerging empirical evidence indicates that discrete emotions are associated with teaching practices and professional experiences of university instructors. However, further investigations are necessary given that university instructors often face high job demands and compromised well-being. Achievement goals, which frame achievement-related thoughts and actions, have been found to describe motivational differences in university instructors and are hypothesized to be associated with their discrete emotions. Moreover, as variation exists in how university instructors respond to job demands regarding their emotional experiences, certain goals (...) may moderate this relationship on the basis of framing different interpretations and reactions to stressors. To investigate these links, 439 instructors (46.7% female) from German and Austrian universities completed a survey assessing their achievement goals, discrete emotions (enjoyment, pride, anger, anxiety, shame, and boredom), and job demands. As hypothesized, multiple regression analyses revealed that achievement goals were differentially and meaningfully associated with discrete emotions. Specifically, learning approach goals were positively related to enjoyment and negatively related to anger and boredom, while learning avoidance goals were positively related to anger. Performance (appearance) approach goals were positively related to pride, and performance (appearance) avoidance goals were positively related to anxiety and shame. Lastly, relational goals were positively related to shame and boredom, and work avoidance goals were negatively related to enjoyment and positively related to shame and boredom. Conclusive moderation effects on the relations between job demands and emotions were not found. Future research avenues aimed at further understanding the supportive role that achievement goals can have for university instructors’ emotional experiences and well-being are discussed. (shrink)

The step to e-research in philosophy depends on the availability of high quality, easily and freely accessible corpora in a sustainable format composed from multi-language, multi-script books from different historical periods. Corpora matching these needs are at the moment virtually non-existing. Within @PhilosTei, we have addressed this corpus building problem by developing an open source, web-based, user-friendly workflow from textual images to TEI, based on state-of-the-art open source OCR software, to wit Tesseract, and a multi-language version of TICCL, a powerful (...) OCR post-correction tool. We have demonstrated the utility of the tool by applying it to a multilingual, multi-script corpus of important eighteenth to twentieth-century European philosophical texts. Sir Arthur Stanley Eddington was a key figure in the development of modern astrophysics, who also made important contributions to the philosophy of science and popular science writing. The Arthur Eddington Memorial Trust was set up after his death in order to hold annual lectures on the relationship between scientific thought and aspects of philosophy, religion or ethics. This 2012 collection gathers together six of these lectures, including contributions by Sir Edmund Whittaker, Herbert Dingle, Richard B. Braithwaite, John C. Eccles, (...) Luther had been reproached to be a populist in his closeness to simple people, but this was only due to his intention, that everyone should understand his translation of the bible. How do multiple obligations to give, to receive, and to reciprocate contribute to the evolution of international society? This question can be derived from the works of the French anthropologist and sociologist Marcel Mauss, in particular from his classic essay The Gift, published in 1925. The aim of this article is to introduce Mauss’ theory of the gift to international political theorists, to develop a general theoretical argument from his claim about the universality of gift-giving, and to lay out the (...) plan of the Special Issue. In addition to his considerable contributions to the teaching and mentoring of several dozen Western scholars of (...) Buddhist studies, a first major achievement was the translation and interpretation of eminent Zen Buddhist thinkers. Abe is especially known for his work on Dōgen, the thirteenth-century founder of the Sōtō Zen sect, and Nishida Kitarō, the leading figure in modern Japanese philosophy and originator of the Kyoto school, of which Abe is considered a prominent member. Abe’s renderings (as a cotranslator) and hermeneutic discussions of Dōgen and Nishida remain among the best and most frequently cited in those respective fields.Second, Abe gained prominence more generally as a presenter of traditional Zen Buddhist thought to the modern West. The Trends in International Mathematics and Science Study found that even though children from all East Asian countries outperformed American children, American students reported higher self-evaluation of their math and science abilities than did students from East Asian countries such as China, Korea, and Japan (Mullis, Martin, Gonzalez, & Chrostowski, 2004). Such cross-cultural differences in self-appraisal fit the stereotype of the modest East Asian and contribute to the received view that East Asians have less positive self-concepts than Americans. The Curry-Howard isomorphism states an amazing correspondence between systems of formal logic as encountered in proof theory and computational calculi as found in type theory. For instance, minimal propositional logic corresponds to simply typed lambda-calculus, first-order logic corresponds to dependent types, second-order logic corresponds to polymorphic types, sequent calculus is related to explicit substitution, etc. The isomorphism has many aspects, even at the syntactic level: formulas correspond to types, proofs correspond to terms, provability corresponds to inhabitation, proof normalization corresponds to (...) term reduction, etc. But there is more to the isomorphism than this. For instance, it is an old idea---due to Brouwer, Kolmogorov, and Heyting---that a constructive proof of an implication is a procedure that transforms proofs of the antecedent into proofs of the succedent; the Curry-Howard isomorphism gives syntactic representations of such procedures. I define ecosabotage and relate this definition to several well-known analyses of civil disobedience. I show that ecosabotage cannot be reduced to a form of civil disobedience unless the definition of civil disobedience is expanded. I suggest that ecosabotage and civil disobedience are special cases of the more general concept of conscientious wrongdoing. Although ecosabotage cannot be considered a form of civil disobedience on the basis of the standard analysis of this concept, the civil disobedience literature can provide important insights (...) into the justification of ecosabotage. First, traditional appeals to a higher law in justifying ecosabotage are no more successful than they are in justifying civil disobedience. Second, utilitarian justifications of ecosabotage are promising. At present there is no apriori reason tosuppose that some acts of ecosabotage could not be justified on utilitarian grounds, although such ecosaboteurs as Dave Foreman have not provided a full justification of its use in concrete cases. Social attitudes toward usury (here defined using the archaic meaning as the taking of interest on loans) have changed dramatically over the centuries. From antiquity until the Protestant Reformation, usury was regarded as an inherently evil activity. Today, with few exceptions, usury is met with moral indifference. Modern objections to usury are limited to protest against "excessive" interest rates rather than interest per se. With this change in focus, the very meaning of the term "usury" has also changed. Many early (...) pronouncements against the taking of interest emphasized the plight of the poor, but ironically, the poor actually pay the highest rates of interest in the modern American economy. Despite the universality of usury, some socio-economic subcultures still manage to avoid the taking or giving of interest. Orthodox branches of both Judaism and Islam have maintained bans on usury throughout the centuries and up to the present time. This is especially interesting in the case of Judaism, given the popular cultural image of the Jew as usurer. Jewish free loan systems may actually offer a model for modern loan programs that can be designed to aid poor borrowers, who are frequently shut out of mainstream financial services. (shrink)

Increasingly, companies implement social and environmental standards as instruments towards corporate social responsibility (CSR) in supply chains. This is based on the assumption that such standards increase legitimacy among stakeholders. Yet, a wide variety of standards with different requirement levels exist and companies might tend to introduce the ones with low exigencies, using them as a legitimacy front. This strategy jeopardizes the reputation of social and environmental standards among stakeholders and their long-term trust in these instruments of CSR, meaning that (...) all expenses for their implementation are of no avail for the companies. Therefore, this paper highlights which criteria are important for the selection, implementation and improvement in order to achieve a company's aim, but also to strengthen the legitimacy of social and environmental standards. This research is based on conceptual thought and some existing empirical research, comparing four different social and environmental standards, revealing weaknesses and strengths. It exposes the basic conditions for the success of such standards among stakeholders and identifies the need for more empirical data. (shrink)

Daniel Taylor and Dawn Goodwin present a case study of the Morecambe Bay Inquiry (MBI), which examined the high rate of maternal and neonatal deaths over a period of 9 years (2004–2013), within the small maternity unit of Furness General Hospital (FGH), one of the three hospitals comprising Morecambe Bay Hospitals Trust.1 They examine this through a conceptual lens, and provide a solution involving changes in medical education. This commentary explores both these elements. First, they use the lens of ‘Normalisation (...) of Deviance’ (NoD) to explain organisational failure. However, other available lenses such as ‘Sociology of Disasters’, ‘Organisational Silence’ and ‘Comfort-seeking Behaviour’ may point to different problems and solutions. More justification for their choice of the lens of NoD would have been useful. Similarly, more justification for their focus on a cluster of five ‘serious untoward incidents’ (SUIs) occurring in 2008 would also have been useful. They suggest that before 2008, the perinatal mortality rate was low, patient satisfaction was high and recent level 2 accreditation of maternity services by the Clinical Negligence Scheme for Trusts all suggested standards of care within the obstetric department were adequate. This stream of positive signals is likely to have contributed towards a genuine belief of safe operation within the maternity unit by staff and board members. In these passages Kant claims that practical philosophers should follow the paradigm of the chemist and conduct experiments on common human reason. I explain Kant’s conception of the chemical experiment, provide a detailed interpretation of the two passages in question, and conclude by applying the structure of the chemical experiment to the Analytic of the Critique of Practical Reason. Chemical experiments as a model (...) of ethics should be understood as a method of confirming that a philosophical theory systematizes and defends ideas that ordinary rational agents are already committed to. What does it take for an individual to be personally responsible for behaviors that lead to increased risk of disease? We examine three approaches to responsibility that cover the most important aspects of the discussion of responsibility and spell out what it takes, according to each of them, to be responsible for behaviors leading to increased risk of disease. We show that only what we call the causal approach can adequately accommodate widely shared intuitions to the effect that certain causal (...) influences—such as genetic make-up or certain social circumstances—diminish, or undermine personal responsibility. However, accepting the causal approach most likely makes personal responsibility impossible. We therefore need either to reject these widely shared intuitions about what counts as responsibility-softening or undermining or to accept that personal responsibility for behaviors leading to increased risk of disease rests on premises so shaky that personal responsibility is probably impossible. Luck egalitarians need to address the question of cost-responsibility: If an individual is responsible for being worse off than others, then what benefits, if any, is that individual uniquely cost-responsible for? By applying luck egalitarianism to justice in health I discuss different answers to this question inspired by two different interpretations of luck egalitarianism, namely ‘standard luck egalitarianism’ and ‘all luck egalitarianism’, respectively. Even though I argue that the latter is more plausible than the former, I ultimately suggest and defend (...) a third interpretation of luck egalitarianism, which I label ‘universal luck egalitarianism’. In this book, Mike W. Martin interprets Schweitzer's 'reverence for life' as an umbrella virtue, drawing together the specific virtues--authenticity, love, compassion, gratitude, justice and peace loving--in individual chapters. Martin's treatment of his subject is sympathetic yet critical, and for the first time clearly places Schweitzer's environmental ethics within the wider framework of his ethical theory.
