Background Respect for human rights and bioethical principles in prisons is a crucial aspect of society and is proportional to the well-being of the general population. To date, these ethical principles have been lacking in prisons and prisoners are victims of abuse with strong repercussions on their physical and mental health. Methods A systematic review was performed, through a MESH of the following words (bioethics) AND (prison), (ethics) AND (prison), (bioethics) AND (jail), (ethics) AND (jail), (bioethics) AND (penitentiary), (ethics) AND (...) (penitentiary), (prison) AND (human rights). Inclusion and exclusion criteria were defined and after PRISMA, 17 articles were included in the systematic review. Results Of the 17 articles, most were prevalence studies (n.5) or surveys (n.4), followed by cross-sectional studies (n.3), qualitative studies (n.1), retrospective (n.1) and an explanatory sequential mixed-methods study design (n.1). In most cases, the studies associated bioethics with prisoners’ access to treatment for various pathologies such as vaccinations, tuberculosis, hepatitis, HIV, it was also found that bioethics in prisons was related to the mental health of prisoners, disability, ageing, the condition of women, the risk of suicide or with the request for end-of-life by prisoners. The results showed shortcomings in the system of maintaining bioethical principles and respect for human rights. Conclusions Prisoners, in fact, find it difficult to access care, and have an increased risk of suicide and disability. Furthermore, they are often used as improper organ donors and have constrained autonomy that also compromises their willingness to have end-of-life treatments. In conclusion, prison staff (doctors, nurses, warders, managers) must undergo continuous refresher courses to ensure compliance with ethical principles and human rights in prisons. (shrink)

The current status of Beilock and Carr's "execution focus" theory of choking under pressure in performance of a sensorimotor skill is reviewed and assessed, mainly from the perspective of cognitive psychology, and put into the context of a wider range of issues, attempting to take philosophical analysis into account. These issues include other kinds of skills, pre-performance practice, post-performance evaluation and repair, and integrating new and creative achievements into repertoires of heavily practiced routines. The focus is on variation in the (...) demand for reflection versus automaticity across the full gamut of learning and experience, not just game-time performance. Though automaticity remains important and there are many circumstances in which being "in the zone" is good whereas “execution focus” can do harm, it appears that reflective action deserves just as much a place at the performance table as does unreflective action. The Collectio Avellana, a collection of late antique documents which has been thoroughly investigated, above all by ancient historians and historians of Roman law, provides a wealth of historical, political-religious and legal information for the period between the middle of the 4th and the middle of the 6th century AD. This contribution, limited to the years of the pontificate of Pope Damasus, seeks to understand whether these texts can also represent a source of topographical information for the city of Rome.

Contextualism, Pragmatics and Definite Descriptions Very few philosophers and linguists doubt that definite descriptions have attributive uses and referential uses. The point of disagreement concerns whether the difference in uses is grounded on a difference in meaning. The Ambiguity Theory holds while the Implicature Theory denies that definite descriptions are ambiguous expressions, having an attributive meaning and a referential meaning. Contextualists have attempted to steer between the Ambiguity Theory and the Implicature Theory. I claim that the early contextualist account provided (...) by Recanati and Bezuidehnout based on the idea that definite descriptions are semantically underdetermined and in need of a completion from the contextually available information through an optional top-down pragmatic process suffers from an explanatory gap. The work of Thomas Kuhn has been very influential in Anglo-American philosophy of science and it is claimed that it has initiated the historical turn. Although this might be the case for English speaking countries, in France an historical approach has always been the rule. This article aims to investigate the similarities and differences between Kuhn and French philosophy of science or ‘French epistemology’. The first part will argue that he is influenced by French epistemologists, but by lesser known authors (...) than often thought. The second part focuses on the reactions of French epistemologists on Kuhn’s work, which were often very critical. It is argued that behind some superficial similarities there are deep disagreements between Kuhn and French epistemology. This is finally shown by a brief comparison with the reaction of more recent French philosophers of science, who distance themselves from French epistemology and are more positive about Kuhn. Based on these diverse appreciations of Kuhn, a typology of the different positions within the philosophy of science is suggested. (shrink)

This paper proposes a new dialetheic logic, a Dialetheic Logic with Exclusive Assumptions and Conclusions ), including classical logic as a particular case. In \, exclusivity is expressed via the speech acts of assuming and concluding. In the paper we adopt the semantics of the logic of paradox extended with a generalized notion of model and we modify its proof theory by refining the notions of assumption and conclusion. Excellent performance in sport involves specialized and refined skills within very narrow applications. Choking throws a wrench in the works of finely tuned performances. Functionally, and reduced to its simplest expression, choking is severe underperformance when engaging already mastered skills. Choking is a complex phenomenon with many intersecting facets: its dysfunctions result from the multifaceted interaction of cognitive and psychological processes, neurophysiological mechanisms, and phenomenological dynamics. This article develops a phenomenological model that, complementing empirical and theoretical research, helps understand and (...) redress choking. It aims at describing the experience of choking as experience, and to discuss strategies to palliate or prevent its onset at the pragmatic level at which athletes engage the phenomenon experientially. An overview of current empirical research and theoretical models highlights key ideas and points out contentious issues. The model describes the common structure of the choking experience. It identifies four core constitutive elements: A) disruptive proprioceptive and kinesthetic dynamics, B) a malfunctioning background or Jamesian fringe of consciousness, C) dislocated time dynamics, and D) emotional disturbances. The novelty of the remedy is that it is designed to cross disciplinary boundaries between phenomenology, historiography, and hermeneutics, and moreover connects theory to praxis as it looks at Japanese dō, practices of self-cultivation. It focuses on actual do-or-die situations, not putative ones such as important business deals or competing for a medal. To this effect, it examines medieval Japanese swordsmanship and training manuals and also engages risk sports, where death is indeed a real possibility. The manuals, which arise in the context of choke-inducing life or death duels, and risk sports, afford keen phenomenological observations and practical advice that prove invaluable for today’s sports world and beyond. Massimiliano Simons provides the first systematic study of Serres' work in the context of late 20th-century French philosophy of science. By proposing new readings of Serres' philosophy, Simons creates a synthesis between his predecessors, Gaston Bachelard, Georges Canguilhem, and Louis Althusser as well as contemporary Francophone philosophers of science such as Bruno Latour and Isabelle Stengers. Simons situates Serres' unique contribution through his notion of the quasi-object, a concept, he argues, organizes great parts of Serres' work into a promising (...) philosophy of science as well as a challenge to the narrower field of French epistemology, to which it has often been limited. Simons highlights how the concept encompasses Serres' commitment to positive relations between science and culture and his rejection of pleas to purify the scientific self from imaginative and cultural elements. It helps to situate Serres between the distinct traditions of Bachelard and Latour as well as progressing the innovative aspects of Serres' philosophy for current debates in the philosophy, history, and sociology of science. Showing how Serres' philosophy can serve as a normative approach to science and technology, Michel Serres and French Philosophy of Science takes in themes of materiality, religiosity, modernity and ecology to advance a timely alternative to philosophy of science for contemporary life. Although implementation is ubiquitous in computer science, there is no systematic philosophical analysis of its metaphysical structure. In this article, I argue that the conceptual resources of analytical metaphysics can be very helpful in laying the foundations for a metaphysics of implementation and, by extension, of computer science. More specifically, I hold that implementation is a form of metaphysical grounding, and I show that, by combining the properties of grounding with the specific constraints of computer science, one can clarify what (...) a metaphysics of computer science could look like. In sections 2 and 3 of the article, I discuss various meanings of implementation, while in section 4, I submit my central claim that implementation is a form of metaphysical grounding. I substantiate this claim by showing that implementation and grounding share the same formal properties. If this is correct, then issues of ontological dependence, metaphysical explanation, hyperintensionality, and foundedness, typically associated with grounding, can be re-formulated in computer science using the concept of implementation. This is what I do in sections 5.1-5.4. I conclude with some general remarks about the future development of computer science's metaphysics. (shrink)

I examine two explanatory models of choking: the representationalist model and the anti-representationalist model. The representationalist model is based largely on Anderson's ACT model of procedural knowledge and is developed by Masters, Beilock and Carr. The antirepresentationalist model is based on dynamical models of cognition and embodied action and is developed by Dreyfus who employs an antirepresentational view of know-how. I identify the models' similarities and differences. I then suggest that Dreyfus is wrong to believe representational activity requires reflection and (...) attention. I also argue that the representationalist model of choking is preferable, since some embodied actions require appeals to representations, something not available to Dreyfus's anti-representational model. This article intends to summarise the content of my book Insurgent Universality: An Alternative Legacy of Modernity and expand the meaning of the term ‘universality’. Universality is not defined in abstract legal terms or by juxtaposition vis-à-vis a common enemy. Instead, I clarify the meaning of a more concrete and open practice of universality through historical examples and theories that I excavate from social practices.

What it means for conspiracy theories to become mainstream In debates about conspiracy theories, it is often claimed that conspiracy thinking is on the rise or has even become mainstream. In this article, I want to explore this claim conceptually, and argue that there are at least three ways to interpret the claim that ‘conspiracy thinking has become mainstream’. First, there is the individual level, where it is a matter of counting heads. Mainstream then means that the majority believes in (...) conspiracy theories. But there are two other levels. There is the institutional level, which is about whether conspiracy theories circulate within social institutions in an acceptable way. Is it acceptable to express conspiracy theories as a politician, scientist or journalist? Mainstream here means that dominant institutions in society view conspiracy thinking as an acceptable form of communication. Finally, there is the cultural level. Here the question is whether conspiracy thinking is a culturally acceptable way of speaking and thinking about society. Is it socially accepted as normal behavior, or is it rather a form of deviant behavior, accompanied by (informal) sanctions or demands for additional justification or proof? Mainstream here means that conspiracy thinking is seen as a normal way of speaking, without being accompanied by strange looks, shunning or the need to justify oneself as a conspiracy thinker. By making this distinction, we can think more clearly about whether conspiracy thinking is actually on the rise, and how we should deal with it. (shrink)

There is a widespread view that well-learned skills are automated, and that attention to the performance of these skills is damaging because it disrupts the automatic processes involved in their execution. This idea serves as the basis for an account of choking in high pressure situations. On this view, choking is the result of self-focused attention induced by anxiety. Recent research in sports psychology has produced a significant body of experimental evidence widely interpreted as supporting this account of choking in (...) certain kinds of complex sensorimotor skills. We argue against this interpretation, pointing to problems with both the empirical evidence and the underlying theory. The experimental research fails to provide direct support for the central claims of the self-focus approach, contains inconsistencies, and suffers from problems of ecological validity. In addition, qualitative studies of choking have yielded contrary results. We further argue that in their current forms the self-focus and rival distraction approaches both lack the theoretical resources to provide a good theory of choking, and we argue for an expanded approach. Some of the elements that should be in an expanded approach include accounts of the features of pressure situations that influence the psychological response, the processes of situation appraisal, and the ways that attentional control can be overwhelmed, leading to distraction in some cases, and in others, perhaps, to damaging attention to skill execution. We also suggest that choking may sometimes involve performance-impairing mechanisms other than distraction or self-focus. (shrink)

According to Frege a proposition—or, in his terms, a thought—is an abstract structured entity constituted by senses which satisfies, at least, the three following properties: it can be semantically assessed as true or as false, it is the object of so called propositional attitudes and it can be grasped. What Frege meant by 'grasping' is the peculiar way in which we can have epistemic access to propositions. The possibility for propositions to be grasped is put by Frege as a warrant (...) for their existence: to challenge their graspability would amount to jeopardise their ontological reality. But is it true, as Frege uncritically maintained, that the "graspability requirement" is satisfied as far as propositions are concerned? This is the topic of the present work. A negative answer to the above mentioned question has been given in recent time by the representatives of what has come to be labelled the "cognitive turn" in analytical philosophy. People such as Fodor and Johnson-Laird patently denied the possibility for propositions, conceived Frege, to be accessed by the grasping relation. What grounds their position is, to put it roughly, the following train of thought: in order for something to be the target of the grasping relation it must enter the mind. Nothing which is different from a mental entity can enter the mind. Therefore, what can be grasped must be mental. The upshot of this move implies, among other things, the rejection of that radical anti-psychologism which was characteristic of the forefathers of the analytical tradition. In our work we shall try to resist their conclusion by showing that it is not necessary to zero the distinction between propositions and mental entities in order to provide an adequate account of the grasping relation. What one has to give up, instead, is only Frege's late Platonism of the "third realm" which, in our view, is a wholly unnecessary and dispensable accretion of his picture. For, as we shall show, if Platonism is in place it is difficult to provide an account of the grasping relation which makes no use of the "representationalist hypothesis" — i.e. of the hypothesis that mediate our access to whatever can be given to us. But representationalism, once in place, makes the theoretical role of the notion of sense dispensable or purely additional. (shrink)

Typically, those analyses concern decisions in a particular class of uncertain situations, namely “risky” situations, where all the relevant available alternative actions (...) are known, each or most actions are non-deterministic , and the probability of each outcome is known to some degree of approximation. As yet, formal analyses have only begun to scratch the surface of the subtleties implicated in uncertain, but not risky, situations, where the available courses of actions, and/or their possible outcomes, and/or the probabilities of those outcomes, are not all. In Mathematics is megethology Lewis reconstructs set theory combining mereology with plural quantification. He introduces megethology, a powerful framework in which one can formulate strong assumptions about the size of the universe of individuals. Within this framework, Lewis develops a structuralist class theory, in which the role of classes is played by individuals. Thus, if mereology and plural quantification are ontologically innocent, as Lewis maintains, he achieves an ontological reduction of classes to individuals. Lewis’work is very attractive. However, the alleged (...) innocence of mereology and plural quantification is highly controversial and has been criticized by several authors. In the present paper we propose a new approach to megethology based on the theory of plural reference developed in To be is to be the object of a possible act of choice. Our approach shows how megethology can be grounded on plural reference without the help of mereology. (shrink)

For decades, historians have debated the conditions of possibility of Max Planck's discovery as a paradigmatic example of scientific revolution. In particular, the use of combinatorics, which eventually paved the way for the introduction of the quantum hypothesis, has remained a puzzle for experts. The article analyzes, at different levels, the relationship between war and borders. The question of the borders may provide an interesting point of view. At stake, in “new wars” is not the path of interstate frontiers but different borders developments. To analyze these dynamics the article emphasizes the useful relationship between two different bibliographies, on one hand the strategic literature about “new wars”, on the other hand the territorial and regional studies analyzing the new form of political, economic and juridical (...) spatiality. The aim is to catch the types of non homogeneous territorialities striated by flux spaciality, scaling and rescaling processes and different regimes of temporality and mobility, at stake in the “new wars”. The starting point of this PhD project is a constructivist interpretation of scientific practices: science does not study independent and pre-given phenomena, but constructs them in an active way. Although this topic has already been argued for in general, this project wants to focus on recent emerging life sciences, such as systems biology, Artificial Life and synthetic biology. These disciplines bring forth an extreme form of this constructivist aspect: they actively and explicitly produce biological phenomena, such as synthetic cells that (...) do not exist outside of the laboratories. It is, however, unclear what this ‘construction’ of nature entails. There are multiple interpretations of how to understand these technical mediations and how this constructive element either shows the uniqueness of scientific practices or precisely shows how there is nothing special about scientific practices in relation to other practices. On the one hand this project wants to identify the different interpretations of constructivism in science: what does it in fact mean to claim that science constructs its object? Secondly, it wants to differentiate the notion of constructivism itself, by abandoning it as a general claim to more local, historical claims. This allows us to differentiate how a discipline, such as synthetic biology, is constructive in a unique sense, rather than being classified merely as one illustration of constructivism. This allows us to make room for the singularity of synthetic biology: in what specific way is synthetic biology a constructive practice? (shrink)

The emerging field of synthetic biology aims to design biological entities by engineering methods. Nature is explicitly no longer something ‘out there’, but instead as whatever is actively made in scientific laboratories. Although apparently unrelated to the Anthropocene, interesting discussions arise once confronted with each other. On the one hand, authors such as Bruno Latour have forced us to reflect on how we are not the masters of nature as was claimed before. We can even speak of ‘the end of (...) nature’. On the other hand, synthetic biology claims that we can now be the masters of nature we have never been before. Nature exists indeed, namely the nature that we have created in the laboratory. How to relate these two perspectives? Their simultaneous emergence appears paradoxical, but must not too hastily result in the conclusion that synthetic biology is merely the latest shape of our childish, modern dreams. Rather synthetic biology can be a critical interrogator of the ‘end of nature’. Can we really endorse that it is impossible to “return to a pre-modern notion of nature” and this “take-offpoint is irretrievably lost”? Or must we make the more modest claim, that modern projects often fail, but that success is not excluded? I argue that Latour mix up two possible conclusions: starting from the correct conclusion that we are uncertain that we are certain they jump to stating that we are certain that we are uncertain, which does not follow. We can never be certain again that we can reduce things to passive nature, although it might work for some cases, perhaps even synthetic biology. (shrink)

Stephen Schiffer holds that propositions are pleonastic entities. I will argue that there is a substantial difference between propositions and fictional characters, which Schiffer presents as typical pleonastic entities. My conclusion will be that if fictional characters are typical pleonastic entities, then Schiffer fails to show that propositions are pleonastic entities.
