The concept of burden of proof is used in a wide range of discourses, from philosophy to law, science, skepticism, and even in everyday reasoning. This paper provides an analysis of the proper deployment of burden of proof, focusing in particular on skeptical discussions of pseudoscience and the paranormal, where burden of proof assignments are most poignant and relatively clear-cut. We argue that burden of proof is often misapplied or used as a mere rhetorical gambit, with little appreciation of the (...) underlying principles. The paper elaborates on an important distinction between evidential and prudential varieties of burdens of proof, which is cashed out in terms of Bayesian probabilities and error management theory. Finally, we explore the relationship between burden of proof and several (alleged) informal logical fallacies. This allows us to get a firmer grip on the concept and its applications in different domains, and also to clear up some confusions with regard to when exactly some fallacies (ad hominem, ad ignorantiam, and petitio principii) may or may not occur. The central idea developed by the contributions to this book is that the split between analytic philosophy and phenomenology - perhaps the most impor tant schism in twentieth-century philosophy - resulted from a radicalization of reciprocal partialities. Both schools of thought share, in fact, the same cultural background and their same initial stimulus in the thought of Franz Brentano. And one outcome of the subsequent rift between them was the oblivion into which the figure and thought of Brentano have fallen. (...) The first step to take in remedying this split is to return to Brentano and to reconstruct the 'map' of Brent ani sm. The second task (which has been addressed by this book) is to revive inter est in the theoretical complexity of Brentano' s thought and of his pupils and to revitalize those aspects that have been neglected by subsequent debate within the various movements of Brentanian inspiration. We have accordingly decided to organize the book into two introductory es says followed by two sections (Parts 1 and 2) which systematically examine Brentano's thought and that of his followers. The two introductory essays re construct the reasons for the 'invisibility', so to speak, of Brentano and set out of his philosophical doctrine. Part 1 of the book then ex the essential features amines six of Brentano's most outstanding pupils (Marty, Stumpf, Meinong, Ehrenfels, Husserl and Twardowski). This chapter sets aside the question of whether a Singularity will occur, to focus on the closely related issue of MU, specifically as presented by one of its most articulate proponents, David Chalmers. The fundamental premise of Chalmers' arguments about MU is some strong version of the Computational Theory of Mind (CTM). The chapter proceeds in the following fashion: first, it recalls Chalmers' main arguments; second, it argues that the ideas of MU and CTM do not take seriously enough the (...) fact that consciousness is a biological phenomenon, as pointed out in different contexts by both John Searle and Jerry Fodor, among others; third, it stipulates for the sake of argument that MU is somehow possible, and show that it would, at best, amount to a sort of mind cloning, but most certainly not to a preservation of anyone's consciousness in a medium different from one's own brain. While “meaning negotiation” has become an ubiquitous term, its use is often confusing. A negotiation problem implies not only a convenience to agree, but also diverging interest on what to agree upon. It implies agreement but also the possibility of disagreement. In this chapter, we look at meaning negotiation as the process through which agents starting from different preferred conceptual representations of an object, an event or a more complex entity, converge to an agreement through some communication medium. We shortly (...) sketch the outline of a geometric view of meaning negotiation, based on conceptual spaces. We show that such view can inherit important structural elements from game theoretic models of bargaining – in particular, in the case when the protagonists have overlapping negotiation regions, we emphasize a parallel to the Nash solution in cooperative game theory. When acceptable solution regions of the protagonists are disjoint, we present several types of processes: changes in the salience of dimensions, dimensional projections and metaphorical space transformations. None of the latter processes are motivated by normative or rationality considerations, but presented as argumentation tools that we believe are used in actual situations of conceptual disagreement. A conflict of interest is a situation in which a person has competing loyalties or interests that make it difficult to fulfil his or her duties impartially. Conflict of interest is not categorically improper in itself but requires proper management. A SCOPUS literature search was performed for publications on the efficacy/safety of Phospho-Di-Esterase Inhibitors for treating erectile dysfunction. A categorization tool was used to review and classify the publications as supportive/not-supportive for the discussed active ingredient and reporting or not reporting (...) a COI for that specific drug or for the remaining PDEIs. Multivariable binary logistic regression was performed. In the 419 selected records the prevalence of supportive opinions was higher when a COI for the index label was declared. The CoOpCaT showed good internal consistency, discriminative validity and intra/inter-rater agreement. The strongest predictor for a supportive opinion was the total number of financial COIs for the index label. A mild protective effect of the total number of financial COIs for any competitor label was noted. Financial COIs have frequently been associated with bias, and the measures currently adopted to restrain it lack effectiveness. Some evidence for monitoring and/or compensating this bias is reported here, but the ultimate solution remains distant. (shrink)

The Hamiltonian structure of General Relativity (GR), for both metric and tetrad gravity in a definite continuous family of space-times, is fully exploited in order to show that: i) the "Hole Argument" can be bypassed by means of a specific "physical individuation" of point-events of the space-time manifold M^4 in terms of the "autonomous degrees of freedom" of the vacuum gravitational field (Dirac observables), while the "Leibniz equivalence" is reduced to differences in the "non-inertial appearances" (connected to gauge variables) of (...) the same phenomena. ii) the chrono-geometric structure of a solution of Einstein equations for given, gauge-fixed, initial data (a "3-geometry" satisfying the relevant constraints on the Cauchy surface), can be interpreted as an "unfolding" in mathematical global time of a sequence of "achronal 3-spaces" characterized by "dynamically determined conventions" about distant simultaneity. This result stands out as an important conceptual difference with respect to the standard chrono-geometrical view of Special Relativity (SR) and allows, in a specific sense, for an "endurantist" interpretations of ordinary physical objects in GR. In a life-span perspective, Baglio and Marchetti make the hypothesis of “the existence of multiple kinds of Theory of Mind” and urge the transition from a discrete to a dimensional approach in the study of mentalization (“ToM may vary along a quantitative and a qualitative continuum”). We resist such a plea and argue that we can stick to a discrete approach which posits just a single early-developing mindreading system, and then works out a “third-person first” perspective on mentalization, according to (...) which the understanding of other minds both ontogenetically precedes and grounds the understanding of our own minds. In this third-person first framework, Baglio and Marchetti’s claim that mentalization is “a multifaceted set of competences liable to influence -- and be influenced by -- a manifold of psychosocial aspects” is reformulated as follows: first-person mentalization evolves in an interplay of third-person mentalization, autobiographical memory and socio-communicative skills attuned by cultural variables. Let us examine these points one by one.In the first place, we take a nativist-modularist perspective on third-person mentalization (henceforth “mindreading”). After Onishi and Baillargeon’s (2005) groundbreaking paper, enough evidence has accumulated to endorse the hypothesis that a form of primary mindreading is not a developmental achievement, but an innate social-cognitive evolutionary adaptation (Baillargeon et al., 2013, 2014). The paper investigates the role played by pre-scientific experience in the philosophy of Josiah Royce and Edmund Husserl. Such a notion, generally associated with Husserl’s conception of the life-world (Lebenswelt) in the Crisis of European Sciences and Transcendental Phenomenology (1936), finds an equivalent and historical antecedent in Royce’s distinction between a world of description and a world of appreciation. The final goal is to show how, despite their different philosophical frameworks, Royce and Husserl agree on the idea that, through the (...) rejection of the world given through mere perception (Lebenswelt/world of appreciation), European sciences have somehow failed their task of universality. As it will be shown, this idea is also due to methodological affinities among the two thinkers. The experience of interconnectedness among individual minds, while precluded in the mere scientific explanation of the world, it becomes possible through the enactment of the Lebenswelt or, as in Royce’s case, through a return to the experience of the world of appreciation. Biological research on race has often been seen as motivated by or lending credence to underlying racist attitudes; in part for this reason, recently philosophers and biologists have gone through great pains to essentially deny the existence of biological human races. We argue that human races, in the biological sense of local populations adapted to particular environments, do in fact exist; such races are best understood through the common ecological concept of ecotypes. However, human ecotypic races do not in general (...) correspond with 'folk' racial categories, largely because many similar ecotypes have multiple independent origins. Consequently, while human natural races exist, they have little or nothing in common with 'folk' races. (shrink)

We present an account of semantics that is not construed as a mapping of language to the world but rather as a mapping between individual meaning spaces. The meanings of linguistic entities are established via a “meeting of minds.” The concepts in the minds of communicating individuals are modeled as convex regions in conceptual spaces. We outline a mathematical framework, based on fixpoints in continuous mappings between conceptual spaces, that can be used to model such a semantics. If concepts are (...) convex, it will in general be possible for interactors to agree on joint meaning even if they start out from different representational spaces. Language is discrete, while mental representations tend to be continuous—posing a seeming paradox. We show that the convexity assumption allows us to address this problem. Using examples, we further show that our approach helps explain the semantic processes involved in the composition of expressions. (shrink)

This paper outlines a critique of the use of the genetic variance–covariance matrix (G), one of the central concepts in the modern study of natural selection and evolution. Specifically, I argue that for both conceptual and empirical reasons, studies of G cannot be used to elucidate so-called constraints on natural selection, nor can they be employed to detect or to measure past selection in natural populations – contrary to what assumed by most practicing biologists. I suggest that the search for (...) a general solution to the difficult problem of identifying causal structures given observed correlation’s has led evolutionary quantitative geneticists to substitute statistical modeling for the more difficult, but much more valuable, job of teasing apart the many possible causes underlying the action of natural selection. Hence, the entire evolutionary quantitative genetics research program may be in need of a fundamental reconsideration of its goals and how they correspond to the array of mathematical and experimental techniques normally employed by its practitioners. Le quarantuno dissertazioni filosofiche di Massimo di Tiro offrono una visione privilegiata della cultura imperiale del secondo secolo, epoca in cui, dominante l’eleganza stilistica, anche la filosofia non disdegnava di dispiegare i propri contenuti mediante il bello stilo dello (...) strumento retorico. Nello svolgimento dei temi, perlopiù platonici nell’ispirazione e orientati ad argomenti presenti al dibattito coevo, ma comunque non escludenti altre influenze filosofiche, Massimo di Tiro si mostra pensatore dalla non banale semplicità. Muovendosi fra filosofia e letteratura, fra Platone e Omero, egli calibra l’erudizione sul filtro di un’esigenza educativa di ampio respiro. Nel volume si presenta la prima traduzione italiana completa dal greco. Il commento critico, aggiornato al dibattito accademico internazionale, mira a mostrare come l’opera del pensatore meriti una rinnovata attenzione nell’ambito degli studi classici letterari e filosofici, giacché nel delineare il quadro culturale del tempo essa consente di meglio precisare alcuni non marginali aspetti del platonismo del secondo secolo. During the last two decades the role of quantitative genetics in evolutionary theory has expanded considerably. Quantitative genetic-based models addressing long term phenotypic evolution, evolution in multiple environments (phenotypic plasticity) and evolution of ontogenies (developmental trajectories) have been proposed. Yet, the mathematical foundations of quantitative genetics were laid with a very different set of problems in mind (mostly the prediction of short term responses to artificial selection), and at a time in which any details of the genetic machinery were virtually (...) unknown. In this paper we discuss what a model is in population biology, and what kind of model we need in order to address the complexities of phenotypic evolution. We review the assumptions of quantitative genetics and its most recent accomplishments, together with the limitations that such assumptions impose on the modelling of some aspects of phenotypic evolution. We also discuss three alternative appr oaches to the theoretical description of evolutionary trajectories (nonlinear dynamics, complexity theory and optimization theory), and their respective advantages and limitations. We conclude by calling for a new theoretical synthesis, including quantitative genetics and not necessarily limited to the other approaches here discussed. (shrink)

Crimes against humanity are supposed to have a collective dimension with respect both to their victims and their perpetrators. According to the orthodox view, these crimes can be committed by individuals against individuals, but only in the context of a widespread or systematic attack against the group to which the victims belong. In this paper I offer a new conception of crimes against humanity and a new justification for their international prosecution. This conception has important implications as to which crimes (...) can be justifiably prosecuted and punished by the international community. I contend that the scope of the area of international criminal justice that deals with basic human rights violations should be wider than is currently acknowledged, in that it should include some individual violations of human rights, rather than only violations that have a collective dimension. Just war theory is currently dominated by two positions. According to the orthodox view, provided that jus in bello principles are respected, combatants have an equal right to fight, regardless of the justice of the cause pursued by their state. According to “revisionists” whenever combatants lack reasons to believe that the war they are ordered to fight is just, their duty is to disobey. I argue that when members of a legitimate state acting in good faith are ordered to fight, (...) they acquire a pro-tanto obligation to obey which does not depend for its validity on the justice of the cause being pursued. However, when the war is unjust, this obligation may be overridden, under certain conditions, by the obligation not to contribute to the unjustified killing of innocents. This is because the pro-tanto force of the duty to obey the law is best understood in terms of “presumptive”, rather than “exclusionary” reasons for action. This approach captures the insights of both the orthodox and the revisionist view, while avoiding the problems that afflict each of them. (shrink)
