The traditional paradigm of medicine assumes that health is a natural given depending on a body's intrinsic teleology, and that medicine aims at restoring or preserving health, making a physician only an "assistant to nature." I argue that nowadays this paradigm is becoming obsolete, because the concept of health is no longer a "natural given" and interventions on the human body attempt not only to help nature's teleology, but also to change it whenever doing so can satisfy human needs and (...) wants. We should abandon the term "medicine" and adopt the term "health care" to mark such an epoch-making transition, analogous to that marking the passage from "alchemy" to "chemistry.". (shrink)

This book studies a central but hitherto neglected aspect of Rousseau's political thought: the concept of social order and its implications for the ideal society which he envisages. The antithesis between order and disorder is a fundamental theme in Rousseau's work, and the author takes it as the basis for this study. In contrast with a widely held interpretation of Rousseau's philosophy, Professor Viroli argues that natural and political order are by no means the same for Rousseau. He explores the (...) differences and interrelations between the different types of order which Rousseau describes, and shows how the philosopher constructed his final doctrine of the just society, which can be based only on every citizen's voluntary and knowing acceptance of the social contract and on the promotion of virtue above ambition. The author also shows the extent of Rousseau's debt to the republican tradition, and above all to Machiavelli, and revises the image of Rousseau as a disciple of the natural-law school. (shrink)

Starting from the doctrine of ideology proposed by Destutt de Tracy in the late eighteenth century, the paper reconstructs its historical relationship with the social science, of which it was originally meant to be the ultimate expression. The historical necessity of ideology as a political science of the social is found in its ability to mediate and legitimize power relationships. It is not for chance that the Marxian critique of ideology is a radical critique of the constitution of power in (...) a capitalist society. The attempt of the social science to neutralize the problem of power through the abandonment of the value judgments leads instead to the declaration of the end of ideologies. In the last part, the paper analyses the way in which ideology, after its identification with the forms of total domination, returns as a neoliberal tool of legitimizing market as a society without history. This paper aims to argue for the thesis that it is not a priori morally justified that the first phase of space colonisation is based on sexual reproduction. We ground this position on the argument that, at least in the first colonisation settlements, those born in space may not have a good chance of having a good life. This problem does not depend on the fact that life on another planet would have to deal with issues such as solar radiation (...) or with the decrease or entire absence of the force of gravity. These issues could plausibly be addressed given that the planets or settlements we will feasibly colonise could be completely transformed through geoengineering processes. Likewise, the ability of humans to live in space could be enhanced through genetic modification interventions. Even if, however, the problems concerning survival in space were solved, we think that, at least in the first period of colonisation of space or other planets, giving birth to children in space could be a morally irresponsible choice since we argue, the life we ​​could give them might not be good enough. We contend that this is the case since when we decide to have a baby. We argue that it is not morally right to be content that our children have a minimally sufficient life worth living; before we give birth to children in space, we should make sure we can give them a reasonable chance of having a good life. This principle applies both on Earth - at least where you can choose - and for space travel. (shrink)

This article investigates the intense debate on the figure of “Chinese public intellectuals,” which has gained increasing importance, both inside and outside Mainland China, during the last decade. The climax was reached in the year 2004, when the debate on the search for and against a role for the “public intellectuals” became the litmus test of the intellectual intersections between the State actors and the public. Through a close reading of the crucial documents, this article critically engages with the terminology (...) and the interpretive paradigms employed. Thus the article highlights the contribution of the scholars examined to a dialogue on the role of critical thinking within China as well as globally. In fact, the exploration of the diversity of contemporary Chinese thought on the topic of “public intellectuals” can be inscribed within the framework of the following questions: How is the social category of “public intellectuals” used and why? And, ultimately, what does it really means to be an intellectual for the public in China today? In this sense, the article sheds light on the indigenous and foreign understandings of “public” and “intellectual.”. (shrink)

The article illustrates the different meanings of the term “logic” in Weber's work and then proceeds to discuss his approach to the explanation of historical events and in particular to counterfactual analysis. Weber's epistemology is first situated within the neo-Kantian debates of his time as well as legal positivism and historical jurisprudence. The article then focuses on this author's conception of science as a value sphere, on the aims and methods of explanation in the social and historical sciences and on (...) the key concepts of possibility judgements and adequate causation. The central role played by counterfactuals and modal logic is illustrated through the example of the battle of Marathon, which Weber himself saw as the starting point of a causal chain leading to the rise of Western rationalism. The article concludes by highlighting the pioneering role of Weber's counterfactualism for the subsequent development of possible worlds theory and its use in the causal analysis of singular historical events. The paper takes into consideration the different degrees of power and control that can be exercised by the mediator/arbitrator. This issue is investigated with particular regard to such aspects as the nature of the ADR procedure adopted, the cultural context in which the procedure takes place, and the formulation of specific legal norms. The analysis both of a few arbitration rules and some data from real arbitral proceedings shows great reliance on the arbitrator’s discretion and use of common sense, which (...) is in line with the idea itself of arbitration. Moreover, the high degree of power autonomy enjoyed by the arbitrator during the whole procedure derives from the presupposition that the parties accept the arbitrator’s personal opinion and final judgment and from the fact that the majority of the disputes in international commercial arbitration are of a technical and complicated nature. The analysis also shows that the legal background of most arbitrators tends to surface even when they are involved in alternative dispute resolution proceedings and is clearly visible in the orderly allocation of turns and the strict control over the procedures to be followed. Especially when arbitrators are lawyers or judges, they tend to promote a feeling of belonging to the same professional community, which induces a greater spirit of cooperation and a lowering of the control level.
