The volume contains the papers given at a conference held in Basle in Autumn 2006 on the writer Philipp von Zesen (1619-1689). The publication – the first collected volume devoted to this author for 35 years – displays the whole breadth of Zesen's work: Apart from his lyric poetry and novels, the papers discuss his linguistic and poetological innovations together with his contributions to nature philosophy, mythology, historiology and politics.

With the outbreak of severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2), global researchers were confronted with major challenges. The German National Pandemic Cohort Network (NAPKON) was launched in fall 2020 to effectively leverage resources and bundle research activities in the fight against the coronavirus disease 2019 (COVID-19) pandemic. We analyzed the setup phase of NAPKON as an example for multicenter studies in Germany, highlighting challenges and optimization potential in connecting 59 university and nonuniversity study sites. We examined the ethics application (...) process of 121 ethics submissions considering durations, annotations, and outcomes. Study site activation and recruitment processes were investigated and related to the incidence of SARS-CoV-2 infections. For all initial ethics applications, the median time to a positive ethics vote was less than two weeks and 30 of these study sites (65%) joined NAPKON within less than three weeks each. Electronic instead of postal ethics submission (9.5 days (Q1: 5.75, Q3: 17) vs. 14 days (Q1: 11, Q3: 26), p value = 0.01) and adoption of the primary ethics vote significantly accelerated the ethics application process. Each study center enrolled a median of 37 patients during the 14-month observation period, with large differences depending on the health sector. We found a positive correlation between recruitment performance and COVID-19 incidence as well as hospitalization incidence. Our analysis highlighted the challenges and opportunities of the federated system in Germany. Digital ethics application tools, adoption of a primary ethics vote and standardized formal requirements lead to harmonized and thus faster study initiation processes during a pandemic. (shrink)

In professional soccer, players, coaches, and researchers alike recognize the importance of cognitive skills. Research addressing the relevance of cognitive skills has been based on the cognitive component skills approach or the expert performance approach. Our project aimed to combine the strengths of both approaches to develop and validate cognitive tasks measuring inhibition and cognitive flexibility in a soccer-specific setting with a soccer-specific motor response. In the main study 77 elite youth soccer players completed a computerized version of the standard (...) flanker and number–letter tasks as well as flanker and number–letter tasks requiring a soccer-specific motor response in a soccer-specific setting. Results show good reliability for both tasks. For the SoccerBot360 number–letter task, switch effects for response times and accuracy and acceptable convergent validity were shown. A flanker effect for response time but not accuracy was apparent. Due to no acceptable convergent validity, the flanker task was revised and 63 adult soccer players participated in a follow-up validation study in the SoccerBot100. The revised flanker task showed the flanker effect for response time, but not for accuracy. However, acceptable convergent validity for response time was present. Thus, the soccer-specific number–letter and to some extent the soccer-specific flanker task show potential to be used as a valid cognitive diagnostic tool by soccer clubs. (shrink)

Building on the computer science concept of _code smells_, we initiate the study of _law smells_, i.e., patterns in legal texts that pose threats to the comprehensibility and maintainability of the law. With five intuitive law smells as running examples—namely, duplicated phrase, long element, large reference tree, ambiguous syntax, and natural language obsession—, we develop a comprehensive law smell taxonomy. This taxonomy classifies law smells by when they can be detected, which aspects of law they relate to, and how they (...) can be discovered. We introduce text-based and graph-based methods to identify instances of law smells, confirming their utility in practice using the United States Code as a test case. Our work demonstrates how ideas from software engineering can be leveraged to assess and improve the quality of _legal_ code, thus drawing attention to an understudied area in the intersection of law and computer science and highlighting the potential of computational legal drafting. The following article aims to answer the question: “How do we experience weather and qi?” Answering this question addresses two problems: Both the phenomena of weather and qi elude classic phenomenological paradigms such as thing-perception and Dasein, brought forth by Edmund Husserl and Martin Heidegger, respectively. If phenomenology is concerned with giving an account of experience starting with the “things themselves,” weather and qi necessitate a different phenomenological paradigm, which comprehensively accounts for the experience of both. This article demonstrates (...) that inconspicuousness, as it has been recently phenomenologically accounted for by Günter Figal, is such a new paradigm. Philosophy done across different languages and cultures is often faced with the problem of untranslatability. This article further demonstrates, following Hisayama Yuho’s work, how phenomenology can present a ground for such philosophy: Instead of discussing qi through its mistranslations into English, I approach the phenomenon by discussing the similarity of phenomenological accounts of qi from Japanese philosophy with my own account of the phenomenology of weather. Both phenomenological accounts mutually elucidate each other. A phenomenological analysis of weather and qi thus both illustrates a largely unthematized facet of human experience in phenomenology, namely, the immersion in media of perception and experience, and demonstrates the philosophical productivity of intercultural philosophy. The present paper provides the first reconstruction of the discussion between Martin Heidegger and Maximilian Beck, a former member of the Munich Circle of Phenomenology—a discussion that revolved around Beck’s interpretation of the “fundamental ontology” of Being and Time. Based upon the still unpublished correspondence between Heidegger and Beck, the essay first reconstructs their relation and then offers a meticulous discussion of Beck’s major criticism of Heidegger, i.e., “correlativism,” and the latter’s response to it in his courses of (...) 1928. Martin Heidegger’s 1942 lecture course interprets Friedrich Hölderlin’s hymn "The Ister" within the context of Hölderlin’s poetic and philosophical work, with particular emphasis on Hölderlin’s dialogue with Greek tragedy.

He then argues that (1), (2) and (3) constitute an inconsistent triad as follows (1991, p. 15): Suppose (1) that Oscar knows a priori that he is thinking that water is wet. Then by (2), Oscar can simply deduce E, using premisses that are knowable a priori, including the premiss that he is thinking that water is wet. Since Oscar can deduce E from premisses that are knowable a priori, Oscar can know E itself a priori. But this contradicts (3), (...) the assumption that E cannot be known a priori. Hence (1), (2), and (3) are inconsistent. McKinsey’s conclusion is that ‘anti-individualism is inconsistent with privileged access’ (ibid.). (shrink)

In this book Martin Bunzl considers the prospects for a general and comprehensive account of explanation, given the variety of interests that prompt explanations in science. Bunzl argues that any successful account of explanation must deal with two very different contexts - one static and one dynamic. Traditionally, theories of explanation have been built for the former of these two contexts. That is to say, they are designed to show how it is that a 'finished' body of scientific knowledge (...) can be put to explanatory use. But finished sciences are few and far between. Real 'explanation' also occurs in a dynamical context in which questions are asked and answers are given as theories are in the process of being constructed. Here, Bunzl argues that attending to explanation produced under these dynamic circumstances undermines prominent features of the theory of explanation produced in the traditional static context. Avigail Eisenberg is an Associate Professor in the Department of Political Science, University of Victoria. She was also a fellow of CRÉUM during the 2004-2005 academic year. She has written important texts on the issues of identity, race, gender, minority rights, and in particular, Aboriginal claims. Her writing displays intelligent and acute commentaries in which she demonstrates an ability to tackle difficult questions in a refreshing way. De entre aquellas páginas hemos querido recuperar y adaptar a la lengua castellana el estudio del prestigioso medievalista Martin Grabmann. La referencia (...) a éste entre los especialistas en el pensamiento suareciano es un lugar común a la hora de precisar el carácter sintético y ecléctico de la obra metafísica de Suárez, así como para ilustrar la tesis de la penetración de sus ideas en el ámbito protestante. Es nuestra pretensión que la traducción que aquí presentamos auxilie tanto al historiador, a modo de recordatorio de un valor que generalmente no encuentra asiento en nuestros escritos ni en nuestras aulas, como al especialista, en la justa ponderación de sus rasgos y en especial, de su influencia. Heidegger’s interpretation of Husserl’s Logical investigations as presented in his lectures History of the concept of time: Prolegomena was a remarkable contribution in the development of phenomenology: First, Heidegger starts with the interpretation of intentionality and his considerations become thus methodologically transparent . Second, Heidegger managed to answer the question: Why is Husserl’s phenomenology the philosophically decisive alternative when compared to the domination of reflexive consciousness and logical judgment in modern philosophy? It is because concepts are not the representations of (...) things any more; as the “states of things” they are explicit expressions of an implicitly given meaning . Third, Heidegger’s interpretation includes the fundamental question of being in its three meanings , due to which the status of the explanation of “reality” changes as well. (shrink)

El presente estudio identifica el lento forjamiento de un procedimiento de subjetivación cristiano que, creado a propósito del uso de las riquezas entre finales del siglo II y mediados del siglo III de nuestra era, empieza a imaginar que la circulación de riquezas entre los hombres y mujeres en la tierra permite atesorar riquezas en el cielo. Se trata de un procedimiento penitencial de transformación de sí que permitirá a los y las cristianas remitir el mal hecho y manifestar su (...) verdad mediante un peculiar uso de las riquezas. El estudio de este procedimiento de subjetivación puede abrir un nuevo capítulo para explorar la formación de un tipo de experiencia con base a “cierto modo de relación de uno consigo mismo y cierta relación entre el mal y la verdad”, que Michel Foucault estudia en _Las confesiones de la carne_. Dicha experiencia no será, sin embargo, una experiencia de la carne. Si seguimos a Clemente de Alejandría, esta experiencia sería la de la constitución de una vida sencilla por quien se dirige a ser espiritualmente pobre, mientras que si escuchamos a Cipriano de Cartago la llamaríamos simplemente la de la constitución de un sujeto misericorde. Al terminar el estudio propondré que esta experiencia de la pobreza espiritual o de la misericordia descansa en una profesión de fe no verbalizada que revela una copertenencia entre el acto de fe y el acto de verdad a partir de la reflexividad del sujeto sobre sí mismo. En otras palabras, sostendré que el uso penitencial de las riquezas, aunque no se verbalizara, se dirigía a realizar un acto reflexivo de verdad. (shrink)
