In a recent series of papers, Jane Friedman argues that suspended judgment is a sui generis first-order attitude, with a question as its content. In this paper, I offer a critique of Friedman’s project. I begin by responding to her arguments against reductive higher-order propositional accounts of suspended judgment, and thus undercut the negative case for her own view. Further, I raise worries about the details of her positive account, and in particular about her claim that one suspends judgment about (...) some matter if and only if one inquires into this matter. Subsequently, I use conclusions drawn from the preceding discussion to offer a tentative account: S suspends judgment about p iff S believes that she neither believes nor disbelieves that p, S neither believes nor disbelieves that p, and S intends to judge that p or not-p. The Value-free ideal of science (VFI) is a view that claims that scientists should not use non-epistemic values when they are justifying their hypotheses, and is widely considered to be obsolete in the philosophy of science. I will defend the ideal by demonstrating that acceptance of non-epistemic values, prohibited by VFI, necessitates legitimizing certain problematic scientific practices. Such practices, including biased methodological decisions or Questionable Research Practices (QRP), significantly contribute to the Replication Crisis. I will argue that the realizability of (...) VFI is not a necessary condition for its validity. Then, I will show how some of the prominent proposals of value-laden science legitimize problematic scientific practices, provide real-world examples, and generalize the argument. Finally, I will show how value-laden methodological decisions contribute to the Replicability Crisis and discuss two strategies for realizing VFI. (shrink)

The results of forensic science are believed to be reliable, and are widely used in support of verdicts around the world. However, due to the lack of suitable empirical studies, we actually know very little about the reliability of such results. In this paper, I argue that phenomena analogous to the main culprits for the replication crisis in psychology are also present in forensic science. Therefore forensic results are significantly less reliable than is commonly believed. I conclude that in order (...) to obtain reliable estimates for the reliability of forensic results, we need to conduct studies analogous to the large-scale replication projects in psychology. Additionally, I point to some ways for improving the reliability of forensic science, inspired by the reforms proposed in response to the replicability crisis. (shrink)

The total value set of a working individual consists of three components: personal, professional and organizational values. In the light of the changing health care environment, the individual nurse manager’s values may no longer be applicable for coping with the needs of the work environment. For many nurses who developed their values in keeping with the humanistic tradition, the ‘new’ organizational values may create confusion, frustration and conflict. The purpose of this study was to determine if the organizational domain in (...) the value sets of Israeli middle nursing managers in acute care hospitals reflect the process of shifting values needed in today’s management roles. Analysis of the results revealed that head nurses did not yet fully internalize the ‘new’ organizational values. Implications of the results for planning undergraduate and graduate programmes are detailed. (shrink)

The chapter is devoted to the probability and acceptability of indicative conditionals. Focusing on three influential theses, the Equation, Adams’ thesis, and the qualitative version of Adams’ thesis, Sikorski argues that none of them is well supported by the available empirical evidence. In the most controversial case of the Equation, the results of many studies which support it are, at least to some degree, undermined by some recent experimental findings. Sikorski discusses the Ramsey Test, and Lewis’s triviality proof, with special (...) attention dedicated to the popular ways of blocking it. Sikorski concludes that the role of the three theses in future studies of conditionals should be re-thought, and he presents alternative proposals. (shrink)

Philosophers and scientists refer to the special character of phenomenal consciousness, something supposedly obvious to all conscious persons. However, we had no empirical evidence about the folk view of consciousness until the first studies were carried out in the experimental philosophy of consciousness. According to the leading interpretation of these results, laypersons—people without academic knowledge about consciousness—do not notice the phenomenal aspect of consciousness. The aim of the article is to answer the question of whether we can trust these results. (...) I show that there are serious doubts about the validity of the experimental philosophy of consciousness research. As a result, the leading interpretation should be rejected, and the question about the folk nature of the concept of consciousness must be regarded as open. (shrink)

The first issue of Artificial Intelligence and Law journal was published in 1992. This paper provides commentaries on nine significant papers drawn from the Journal’s second decade. Four of the papers relate to reasoning with legal cases, introducing contextual considerations, predicting outcomes on the basis of natural language descriptions of the cases, comparing different ways of representing cases, and formalising precedential reasoning. One introduces a method of analysing arguments that was to become very widely used in AI and Law, namely (...) argumentation schemes. Two relate to ontologies for the representation of legal concepts and two take advantage of the increasing availability of legal corpora in this decade, to automate document summarisation and for the mining of arguments. Connections between partially ordered connectives and Henkin quantifiers are considered. It is proved that the logic with all partially ordered connectives and the logic with all Henkin quantifiers coincide. This implies that the hierarchy of partially ordered connectives is strongly hierarchical and gives several nondefinability results between some of them. It is also deduced that each Henkin quantifier can be defined by a quantifier of the form equation imagewhat is a strengthening of the Walkoe result. MSC: 03C80.

The case of Alta Fixsler, where a judge ruled that withdrawing life sustaining care was in her best interest rather than transferring her to Israel, as her parents wanted, is the latest in a series of controversial paediatric best interest decisions. Using this case, as well as some other recent cases, I argue that the UK exhibits a high degree of medico-legal paternalism in best interest decisions, even though paternalism seems to be ubiquitously negatively perceived in medical ethics. Firstly, I (...) explain what I mean by medico-legal paternalism and defend my claim that this phenomenon is present in the UK. I then argue that at least philosophically (rather than legally) such a situation is impossible to justify in a secular state and that how we treat paediatric best interest decisions is very different from other areas of medical law. We study a logic whose formulae are interpreted as properties of a finite set over some universe. The language is propositional, with two unary operators inclusion and extension, both taking a finite set as argument. We present a basic Hilbert-style axiomatisation, and study its completeness. The main results are syntactic and semantic characterisations of complete extensions of the logic.

Both the multidimensional phenomenon and the polysemous notion of consciousness continue to prove resistant to consistent measurement and unambiguous definition. This is hardly surprising, given that there is no agreement even as regards the most fundamental issues they involve. One of the basic disagreements present in the continuing debate about consciousness pertains to its gradational nature. The general aim of this article is to show how consciousness might be graded and multidimensional at the same time. We therefore focus on the (...) question of what it is, exactly, that is or could be graded in cases of consciousness, and how we can measure it. Ultimately, four different gradable aspects of consciousness will be described: quality, abstractness, complexity and usefulness, which belong to four different dimensions, these being understood, respectively, as phenomenal, semantic, physiological, and functional. Consequently, consciousness may be said to vary with respect to phenomenal quality, semantic abstraction, physiological complexity, and functional usefulness. It is hoped that such a four-dimensional approach will help to clarify and justify claims about the hierarchical nature of consciousness. The approach also proves explanatorily advantageous, as it enables us not only to draw attention to certain new and important differences in respect of subjective measures of awareness and to justify how a given creature may be ranked higher in one dimension of consciousness and lower in terms of another, but also allows for innovative explanations of a variety of well-known phenomena (amongst these, the interpretations of blindsight and locked-in syndrome will be briefly outlined here). Moreover, a 4D framework makes possible many predictions and hypotheses that may be experimentally tested (We point out a few such possibilities pertaining to interdimensional dependencies). In the posthumously published ‘Future People, the Non-Identity Problem, and Person-Affecting Principles’, Derek Parfit presents a novel axiological principle which he calls the Wide Dual Person-Affecting Principle and claims that it does not imply the Repugnant Conclusion. This paper shows that even the best version of Parfit's principle cannot avoid this conclusion. That said, accepting such a principle makes embracing the Repugnant Conclusion more justifiable. This paper further addresses important questions which Parfit left unanswered concerning: the relative importance of individual (...) and collective goodness, comparisons involving unequal outcomes, how to understand individual goodness, and whether incomparability at the level of individual goodness implies incomparability at the level of overall goodness. In the framework of Stewart Shapiro, computations are performed directly on strings of symbols (numerals) whose abstract numerical interpretation is determined by a notation. Shapiro showed that a total unary function (unary relation) on natural numbers is computable in every injective notation if and only if it is almost constant or almost identity function (finite or co-finite set). We obtain a syntactic generalization of this theorem, in terms of quantifier-free definability, for functions and relations relatively intrinsically computable on certain types (...) of equivalence structures. We also characterize the class of relations and partial functions of arbitrary finite arities which are computable in every notation (be it injective or not). We consider the same question for notations in which certain equivalence relations are assumed to be computable. Finally, we discuss connections with a theorem by Ash, Knight, Manasse and Slaman which allow us to deduce some (but not all) of our results, based on quantifier elimination. (shrink)

The Ramsey Test is considered to be the default test for the acceptability of indicative conditionals. I will argue that it is incompatible with some of the recent developments in conceptualizing conditionals, namely the growing empirical evidence for the _Relevance Hypothesis_. According to the hypothesis, one of the necessary conditions of acceptability for an indicative conditional is its antecedent being positively probabilistically relevant for the consequent. The source of the idea is _Evidential Support Theory_ presented in Douven (2008). I will (...) defend the hypothesis against alleged counterexamples, and show that it is supported by growing empirical evidence. Finally, I will present a version of the Ramsey test which incorporates the relevance condition and therefore is consistent with growing empirical evidence for the relevance hypothesis. (shrink)

The subject of this study are the argumentation strategies applied by the Polish and German apex courts competent in criminal matters, namely the Supreme Court and the Federal Court of Justice, respectively. The investigation encompasses a total of 200 rulings issued by the criminal panels of these bodies. Particular focus was put on examining which arguments both courts apply to solve interpretation problems, and secondly, how these courts systematize the interpretation process. Methodologically, the examination utilizes, inter alia, the principles of (...) qualitative research, without neglecting the legal dogmatic perspective. A crucial theoretical foundation underlying this study is the distinction between formalistic and substantive legal cultures. The examination reveals that neither the Polish nor the German legal culture is purely formalistic or value-oriented. Nevertheless, the Supreme Court of Poland shows greater affinity for formalistic arguments, whereas the substantive interpretation methods are more widespread in the judicature of the German Federal Court of Justice. In particular, the Polish Court prefers the linguistic interpretation, whereas the German Court favours the purposive approach. (shrink)

Especially in periods of crises, economists try to explain why some economies suffer negative consequences more strongly than others. In order to explain these differential effects, two economic categories known as economic vulnerability and economic resilience can be used. Hence, the aim of the paper is to undertake a critical reflection on the interrelated categories of economic vulnerability and resilience to shocks. The paper analyses these categories from a theoretical perspective and identifies the factors that shape each of them. It (...) then attempts to measure the economic vulnerability and resilience of selected European countries using two synthetic variables. Based on these, a classification of countries in terms of economic vulnerability and resilience was made. The results achieved provide a good starting point for a more detailed study of the paths of crises and their consequences in individual countries. (shrink)

Roman Ingarden’s theory of the musical work is usually criticized for not being able to handle the problems of avant-garde music. The most important reason for this criticism is its dependence on the musical score and, generally, on the conventions of pre-twentieth century European classical music. In my article I offer a revision of Ingarden’s theory, which on the one hand leaves its substantial arguments intact and on the other allows the theory to tackle the problem of avant-garde music successfully. In this paper we give a positive answer to a problem posed by G. Hofer-Szabo and M. Redei regarding the existence of infinite common cause systems. An example of a countably infinite CCS is presented, as well as the proof that no CCSs of greater cardinality exist.

Background: The development of the COVID-19 pandemic has prompted the implementation of many procedures to safeguard against further increases in illness. Unfortunately, this has drastically reduced residents’ contact with their families, which has increased feelings of loneliness and isolation. This is particularly difficult in long-term care facilities, where the risk of developing depression is higher than in the general population.Objectives: The aim of the study was to assess the risk of depression among the residents of long-term care institutions in Poland (...) during the COVID-19 pandemic and to determine the relationship between the risk of depression and the occurrence of cognitive impairment in the study group.Methods: The study included 273 residents from long-term care institutions in Poland. The risk of depression was determined based on an originally designed questionnaire. The cognitive state of the subjects was assessed using the screening test Mini-Mental State Examination. Both the depression risk assessment and the MMSE test were conducted twice: in March and December 2020.Results: In March, severe dementia was present in 28.2% of the residents and normal MMSE scores were observed in 16.1% of the subjects; in December, the prevalence of severe dementia increased to 31.1% and that of normal scores decreased to 10.3%. In March, no participant was found to be at high risk of depression and moderate risk was observed in 14.3% of the subjects; in December, 2.6% of the residents had a high risk score and 45.4% had a moderate risk score. Statistical analysis revealed that higher MMSE scores correspond with a higher risk of depression.Conclusion: A higher risk of depression was observed with the development of the pandemic. Residents with cognitive impairment were characterised by a lower risk of depression compared to individuals with normal MMSE scores. During the study, progression of cognitive impairment was observed in the residents. (shrink)

In my thesis, I develop two distinct themes. The first part of my thesis is devoted to indicative conditionals and approaching them from an empirically informed perspective. In the second part, I am developing classical topics of philosophy of science, specifically, scientific objectivity and the role of values in science, in connection to recent methodological developments, revolving around the Replication Crisis.

THE CONCEPT OF COMMUNICATION FROM THE PERSPECTIVE OF THE POZNAN SCHOOL METHODOLOGY The aim of this article is to describe the meaning of the concept of communication from the perspective of the socio-regulative theory of culture by Jerzy Kmita (as well as from the perspective of the Poznan School of Methodology in general). Many contemporary theories of human communication tend to avoid the social and cultural context of communication acts, which may be called a naturalistic approach to communication. This tendency (...) is discussed in the paper. The socio-regulative theory of culture describes communication as one of the most important parts of symbolic culture and as a cultural act. This act of communication is characterized as rational and intentional and it connects the actors through the interpretation process. In conclusion, there is provided a sketch of theoretical background which opens the possibility to apply Kmita’s theory of culture to the theory of communication. Polski gnostyk, kwestionując kantowski podział sądów, dostrzegł w nich agnostyczną bezsilność. Jego zdaniem, powodem słabości myśli Kanta było materialistyczne rozumienie doświadczenia, protestantyzm oraz życie osobiste filozofa.

The evolution of criminal law in Western legal systems is often portrayed as a path leading from objective to subjective notions of criminal responsibility. By examining the historical development of the notions of subjective responsibility, this article suggests that the function of a wrongdoer’s subjective mental state, in both its substantive and procedural aspect, as an element in the process of attributing criminal responsibility, remains much the same today as it was in antiquity. This is indicated by what subjectivity, as (...) an essential condition of culpability, is said to imply: the distinction between intentional and unintentional acts. Although the notions of intent and malice aforethought are attested to in various sources on ancient Athenian law, there are several kinds of cases in which the role played by these aspects—traditionally referred to as mens rea —remain unsolved in contemporary jurisprudence and legal practice. Yet despite the difficulties of establishing facts in particularly complex criminal cases, setting the boundary between “intentional” and “unintentional” remains crucially important in determining criminal responsibility and thus in distinguishing the “licit” from the “illicit,” which is the very foundation of the rule of law. A comprehensive understanding of participants’ motives to complete web-based surveys has the potential to improve data quality. In this study we tested the construct validity of a scale developed to measure motivation to participate in webbased surveys. We expected that 7 different motivations observed in our previous study will form a 3-factor structure, as predicted by Self-Determination Theory. This web-based questionnaire study comprised 257 participants completing the Voluntary Participation in Online Studies Scale. Their responses to 21 items underwent a principal (...) component analysis and confi rmatory factor analysis. As we expected, three factors were identifi ed: intrinsic motivation, extrinsic motivation and amotivation. In line with Self-Determination Theory there are three distinct groups of motives among web-surveys participants with amotivation as an understudied motivational state. We discuss the results suggesting which types of motivation might lead to higher quality of data with an emphasis on possible negative effects of amotivation. (shrink)

This text aims at a multi-dimensional reflection on Erich Fromm’s conception of the human being. Starting from Marxist-Freudian sources of the philosopher’s thought, the authors show the fundamental ideas underlying his version of psychoanalysis. Next, Fromm’s view of the human being as a social being is discussed, referring to the concepts of unproductive and productive orientations. Another important dimension of Fromm’s thought that is discussed is the reflection on the nature and functions of the symbolic language of the unconscious, which (...) reveals to the human being both the best and the worst aspects of his or her personality. One of the most famous concepts of the American philosopher is also discussed — the distinction between the being mode and the having mode. The authors drawattention to the value Fromm placed on a life oriented towards the being mode. Finally, they remind us, following Fromm, that a human being turns towards himself in his or her dreams, going beyond all the schemes and concepts that bind his mind when he or she is awake. The understanding of oneself that comes from a deep reflection on the content and character of a dream can awaken in a person the recognition of previously unknown dimensions of his or her mind; from now on, he is not merely someone immersed in the reality of everyday life. Crossing the horizon of oneiric imagination, he or she becomes free, in the dream, and she experiences the freedom of being on waking. (shrink)

This paper describes the process of reception of Catholic Modernism in Poland as well as the Polish contribution to this movement. It shows the Polish antimodernist perspective on modernistic thought. The neglect of Polish modernism was caused by the nationalistic character of the Polish theology and has resulted in absence of historical studies of Polish Catholic Modernism. Based on the results of archival and literature research the paper presents a variety of Polish Catholic Modernists and non-Catholic supporters of the modernist (...) thought. A unique place among Polish modernists belongs to Marian Zdziechowski (1861–1938) who was the only Polish participant of the international intellectual debate on the “modernisation” of Roman Catholicism. The paper analyses the development of Zdziechowski’s thought and shows that his main demand throughout the modernist debates was to create a new, more efficient apologetics, which would be grounded in the religious experience of the individual.
