World Rugby (WR) announced in 2020 that transwomen should not be competing at the elite level because of safety and fairness concerns. WR and Jon Pike, a philosopher of sport advising them, adopted a lexical approach to get a grip on the three values in play: safety, fairness, and inclusion. Previously, governing bodies tried to balance these competing values. Michael Burke recently published a paper taking aim at Pike’s lexical approach. This is a reply to Burke.

This book is a revised translation of two works by Miroslav Hroch, which together form a pioneering comparative analysis of the various struggles for national identity in nineteenth-century Europe. It is concerned with the decisive phase of 'national renaissance', when small groups of committed patriots successfully generated mass support. When and why was their propaganda effective? The author attempts to answer this fundamental question by locating the patriots within the contemporary social structure, and uses data derived from many different (...) nationalisms. The work is divided into three sections; a theoretical examination of the origins of nationalism and nation-hood, a quantitative survey of the social and territorial structure of the patriots of eight representative national movements, and a comparative analysis of the social and professional groups that formed the milieu of patriotism. While classical neo-positivists reject any role for traditionally understood values in science, Kuhn identifies five specific values as criteria for assessing a scientific theory; this approach has been further developed by several other authors. This paper focuses on Helen Longino, who presents a significant contemporary critique of Kuhn’s concept. The most controversial aspect of Longino’s position is arguably her claim that the criterion of empirical adequacy is the least defensible basis for assessing theories. The de-emphasizing of the importance of external (...) consistency as a value and the introduction of socio-political considerations into the processes of an assessment of scientific theories are also considered problematic issues. I provide arguments against Longino’s conception, identify some of its problems, and argue for refusal of her approach. (shrink)

Over the last decades we have witnessed a proliferation of new human rights claims (e.g. the ‘human right’ to internet access) . But Milan Kundera (1991) reminds us that not all desires are human rights. Trans women athletes (and their supporters) often claim that there is a human right to sport and they derive a further ‘human right’ from this: the right to compete in the sex category with which they identify (i.e. the female category). The purpose of this article (...) is to critically assess these two claims: 1. every person has a human right to compete in sport; 2. trans women have a human right to compete in the female category in sport. The author points out that the moral condemnation of “nationalism” that is common in contemporary Anglo-Saxon literature does not hold up once we subject it to historical and, by extension, sociolinguistic criticism. This term, originally nebulous and confusing, has become meaningless as a result of forgetting that it is the designation of the relationship of an individual (or social group) to the entity of a nation, an entity that is the result of the empirically well grasped historical process of nation (...) formation under conditions that were specifically European. This circumstance is especially important in the case of the category “small nation”, by which the author means those nations whose formation took place in the form of a national movement – a purposeful effort to acquire all relevant attributes of a nation for one’s own ethnic community. This movement, in its scholarly and agitational phase, was based on a selfless effort to develop and ennoble the nation as an abstract community of cultural values and should be designated by the term “patriotism” and possibly its translations into (some) central European languages, which were and are used with a morally positive connotation. The pejorative label “nationalism” is justified only where the national movement has progressed to its mass phase, when a substantial part, if not most, of the members of the ethnic group have identified with the nation. Since then, it has been necessary to talk about the nation in a dual position. Not only in the position of an abstract community of values but also in the position of “sociological fact”, where it also acquired the morally ambivalent nature of the struggle for power. This ambivalence – the tension between altruism and egoism – is still preserved today even where the national interest is discussed. (shrink)

The late fourteenth-century English Carmelite Richard Lavenham was a prolific author of Latin and vernacular treatises on logic, physics, philosophy, and theology. Among other works pertaining to natural philosophy, he authored the short Tractatus terminorum naturalium, preserved in three complete or almost complete late fourteenth- or early fifteenth-century copies, with the opening passage preserved in three other manuscripts. The text is fundamentally a redaction of the Heytesburian Termini naturales, a brief glossary of technical vocabulary of the natural philosophy and physics (...) of the Oxford Calculators, supplemented by additional textual and pictorial material. As such, Lavenham’s treatise is a specific branch of an influential tradition of school texts that took the form of elementary treatises, additional glosses, quaestio-commentaries, and excerpts. Johann Eck (1486–1543) has been introduced to modern scholarship as a prominent figure of the pre-Tridentine Counter-Reformation. As part of the curricular transformations of the University of Ingolstadt, he wrote commentaries on logical and scientific works by Aristotle and Peter of Spain. Utilising a variety of sources, the two volumes dedicated to physics and natural philosophy published in 1518 and 1519 were self-contained textbooks including annotated translations of the texts and quaestio-commentaries. These developed the doctrines of the Oxford Calculators mediated (...) through Continental sources, reproducing their conceptual and mathematical apparatus, including the famous middle degree theorem and Bradwardine’s law. The paper deals with cognitive interview, a method for pre-testing survey questions that is used in pilot testing to develop new measures and/or adapt ones in foreign languages. The aim is to explore the usefulness of the method by looking at two questionnaires measuring anti-Roma prejudice. The first, the Stereotype Content Model (SCM), contains questions that are dominantly used to test two dimensions of social perceptions of various groups: warmth and competence. The second, Interventions for Reducing Prejudice against Stigmatized Minorities (...) (INTERMIN) consists of the items most frequently used in contact research to measure attitudes, social distance, anxiety, trust and behavioural intentions towards outgroups. Two rounds of cognitive interviews were held on both questionnaires to verbally evaluate participants’ understanding and/or interpretation of the draft questions. The first round was attended by university students, while the second round (with improved versions of the questionnaires) was done with high school students, as they are the target group for planned interventions based on the contact paradigm. The paper explains the problems/difficulties the participants had answering some of the questions and our attempts at improving the questionnaires. The problems can be grouped around six issues: The first two deal with the strategies participants used to answer our questions – whom exactly did they have in mind when answering the questionnaires and whose viewpoint did they represent in their answers. The next four problems are around nuances in the formulations of our questions and generally have to do with how the participants interpreted our questions – they concern assumptions that distinct items were logically interconnected, the period of time and locality referred to in our questions, translation and transferability of meanings from one language to another and double negation. Recently, David Boonin has put forward several objections to Carlos S. Nino's 'Consensual Theory of Punishment'. In this paper I will defend Nino against the 'explicit denial objection'. I will discuss whether Boonin's interpretation of Nino as a tacit consent theorist is right. I will argue that the offender's consent is neither tacit nor express, but a special category of implicit consent. Further, for Nino the legal-normative consequences of an act (of crime) are 'irrevocable', i.e. one cannot (expressly and successfully) (...) deny liability to them. I will suggest an explanation for Nino's irrevocability claim. (shrink)

University study can be a life period of heightened psychological distress for many students. The development of new preventive and intervention programs to support well-being in university students is a fundamental challenge for mental health professionals. We designed an 8-week online mindfulness-based program combining a face-to-face approach, text, audio, video components, and support psychotherapy principles with a unique intensive reminder system using the Facebook Messenger and Slack applications in two separate runs. We assessed the program’s effect on mindful experiencing, perceived (...) stress, emotion regulation strategies, self-compassion, negative affect, and quality of life. The results of the presented pilot study confirmed that eMBP is a feasible and effective tool in university students’ mental health support. The students who completed the eMBP reported a reduction of perceived stress with a large effect size as well as a decrease of negative affect experience frequency and intensity, an increase of being mindful in their life, and a higher rate of self-compassion with a medium effect size. A small effect size was found in the frequency of using a cognitive reappraisal strategy. One new result is the observation of an eMBP effect on the decrease in attributed importance to the quality-of-life components replicated in two consecutive runs of the program. The study affirms that mindfulness-based interventions can be effectively delivered in an eHealth form to university students. (shrink)

We often encounter the term “post-truth situation” in quite different contexts. This paper compares existing approaches to the term, reviewing sources of this notion in different domains and fundametally identifying its conceptual core. The starting point is the analysis of the recent transformation of the relationship between scientific fact and the political sphere and the change of the role of experts in relationship to society. The next section focuses on the role of digital and especially social media in the emergence (...) of the post-truth society and some important phenomena that are constitutive for the post-truth society in the information arena. Subsequently, we identify other sources of post-truth situations in the economic sphere, which is related to globalization, and also in the field of postmodern philosophy. (shrink)

Man geht davon aus, dass die Probleme und Lösungen in Sportsystemen den Vergleich mit Rechtssystemen erlauben. Tagungen, Aufsätze und Bücher zum Thema „Jurisprudence of Sport“ deuten darauf hin, dass hier ein neuer Forschungsbereich entsteht. Dieser Beitrag bietet eine Einführung in die Thematik.

The debate about the Strategic Foul has been rumbling on for several decades and it has predominantly been fought on moral grounds. The defenders claim that the rules of a game must be supplemented by the ‘ethos’ of the game, by its conventions or informal rules. Critics of the Strategic Foul argue that to break the rules deliberately, in order to gain an advantage, is morally wrong, spoils the game, or is a form of cheating. Rather than entering the moral (...) maze I will argue that the Strategic Foul rests on a conceptual mistake. I will contrast the Strategic Foul with the idea of Efficient Breach in the economic approach to law in order to bring out some of the salient features. While doing so I will attempt some cross-fertilisation between jurisprudential insights and philosophical reflection on game rules. Finally, I will re-cast Searle’s distinction between constitutive and regulative rules in order to bring out the conceptual mistake more clearly. (shrink)

In life there can be good reasons to break the rules. Some sports philosophers have suggested that this also holds for games. In this essay I will compare and contrast reasons for rule-breaking in life and in sports. Some of my focus will be on recent attempts to defend strategic fouling (by Eylon & Horowitz, Russell, and Flynn). Supporters of strategic fouling try to provide a philosophical underpinning for the practice, but they ignore the genealogy of such rule-violations. I will (...) also discuss how some legal theorists view rule-breaking and contrast this with sport. Lastly, I will introduce the idea of ‘transcendental rules’ in games. They are the conditions for the possibility of playing a game. Following Aurel Kolnai, I will argue that strategic fouling violates a transcendental rule – it is not just a moral error, it is also a conceptual error. (shrink)

In 2004 in Prague, I met Slovak philosopher Miroslav Marcelli, who had attended Foucault's lectures in Paris in 80s. We talked about the legacy of Foucault and contemporary philosophy. Mr. Marcelli taught me philosophy at Comenius University in 1995.. I never visited his lectures, I only passed the exam.. The most interesting point was his answer to my 'provocations' replicating the common prejudice about impracticability of the philosophy. He answered "Do you think that e.g. Descartes didn't know about it?" (...) In fact, people tend to think that philosophers or mathematicians, are "asocial" without "social" intelligence, while their occasional isolation (e.g. Nietzsche) is a product of social exclusion, rather than their choice. In 2013 I applied Foucault's concept of Discontinuity to short 10 minutes movie: Discontinuity, projected in my exhibition "From Animation" in Holland Park, London. The film has 3 parts, ends as it starts to show the significant historical events in 4 windows, when the same idea appears to disappear to re-appear.. Foucault's philosophy doesn't seem to me so unique now, e.g. the idea that many historical changes or progress itself is often illusionary - masking the power structure, had already been explored 515 BC, in depth by Parmenides who concluded: the change is impossible. One of the buzzwords of today is ‘inclusion’. But the idea that everyone should be ‘included’ is a mistake, thoughtlessly reproduced by many. This holds in the private sphere, as well as in the institutional settings of the public sphere. There is very little conceptual analysis of the term, although there is plenty of literature on ‘social inclusion’ and the political vision of including the marginalized. My aim is to show that there are constraints on inclusion – particularly in institutional (...) settings. Participation in social life is a kaleidoscope of inclusion and exclusion practices; this actually makes social life possible. Without inclusion/exclusion practices social life would be chaotic – if not impossible. Even philosophy journals have submission criteria which permit exclusion: e.g. the paper must not be under consideration by any other journal. Thus, exclusion is not per se a denial of someone’s dignity or a failure to recognize them as a fellow human being. The aim of this short essay is to raise awareness about inclusion and two of its constraints (eligibility and forfeiture), thereby starting a long overdue debate in the humanities. [open access]. Given Bernard Suits’ stature in the philosophy of sport, his take on strategic fouling, surprisingly, hasn’t been given much attention in the literature. Rather than relying on a purely empirical or ‘ethos’ approach to justify the Strategic Foul he provides a mixed justification. Suits’ account combines a priori and a posteriori elements. He introduces a third kind of rule, which appears to be unlike rules of skill or constitutive rules, into his conceptual scheme. Suits claims that it is sometimes tactically (...) correct to break such a rule in order to gain an advantage. I will argue that the a priori element in his justification of strategic fouling is unconvincing because there is nothing special about ‘third type’ rule-violations, which incur a ‘fixed penalty’. Furthermore, the a posteriori element ultimately reduces to a rule of skill, and it is doubtful whether it has sufficient normative force to warrant breaking a rule. But, most importantly, the a posteriori element degrades the power of the a priori element. (shrink)

The concept of natural law is fundamental to political philosophy, ethics, and legal thought. The present article shows that as early as the ancient Greek philosophical tradition, three main ideas of natural law existed, which run in parallel through the philosophical works of many authors in the course of history. The first two approaches are based on the understanding that although equipped with reason, humans are nevertheless still essentially animals subject to biological instincts. The first approach defines natural law as (...) the law of the strongest, which can be observed to hold among all members of the animal kingdom. The second conception presents natural law as the principle of self-preservation, inherent as an instinct in all living beings. The third approach, also developed in antiquity, shifts the focus to our rationality and develops the idea of natural law as the law of reason within us. Some Christian thinkers who consider the origin of reason in us to be divine, identify the law of reason inherent in us with God's will. This paper gives a brief exposition of the development of these three concepts of natural law in philosophy, with emphasis on the intertwining of these three concepts, which we, however, understand as primarily and essentially independent. The paper concludes with an overview of twentieth-century authors who exclusively focus on only one of the three concepts. The aim of this article is to argue against these one-sided interpretations and to uphold the independence and distinctness of the three historical conceptions of natural law. (shrink)

Robin Dembroff (Real Talk about the Metaphysics of Gender, 2018) believes that ‘non-binary’ is a social kind. I have my doubts about this, but if it is a social kind, then it is a very special one. The membership conditions of the social kind ‘non-binary’ are only accessible to non-binary persons. They establish and police their own membership conditions (Dembroff 2018: 36f.): ‘Individuals are granted authority over their gender kind membership.’ So, if this is indeed a ‘social kind’, then it (...) is a highly unusual one. In this paper I will discuss two aspects of ignorance of the law: ignorance of illegality (including mistaking the law) and ignorance of the penalty; and I will look at the implications for natives, for tourists and for immigrants. I will argue that Carlos Nino's consensual theory of punishment needs to rely on two premises in order to justify that (claiming) ignorance of the law is no excuse. The first premise explains why individuals are presumed to 'know' current laws. The (...) second premise explains why individuals are presumed to 'know' new legislation. (shrink)

In the 1330s Roger Swyneshed formulated a solution to semantic paradoxes based on the distinction between correspondence with reality and self-falsification as truth-making factors. Since Swyneshed states that some valid inferences are not truth-preserving, his view implies the question of the general definition of validity which he does not address explicitly. Logical works attributed to Paul of Venice contain developments of Swyneshed's contextualist semantics substantially modified by the assumption that sentential meanings are objective propositional entities. The main goals of this (...) paper are to show the correlations between the ontological and logical developments of Swyneshed's semantics in the works of Paul of Venice and to outline a context-sensitive formal semantics that could serve as a model of this family of semantic theories. The problem of logical omniscience breaks down to the problems of the closure of knowledge under implication and of the distribution of knowledge over implication. In late medieval scholasticism these two related issues were engaged in various genres, in particular in general analysis of validity, games of obligationes, solution to self-referential antinomies and semantics of terms. The present study analyses the corpus of fourteenth-century texts with some overreaches to the subsequent two centuries, attempting to cover representatives of both the “British” (...) and the “Continental” tradition. With some degree of simplification, this results in a range of four basic positions: 1. knowledge is closed under “analytic entailment” (Buridan), 2. knowledge distributes over implication (Heytesbury), 3. knowledge distributes over implication provided that its consequent’s truth is being taken into consideration (Peter of Mantua), 4. knowledge does not distribute overimplication (Wyclif). Background: -/- Having colonised the social role ‘woman’, and entering female-only spaces, there is one bastion of womanhood left which has always been closed off to men who claim to be women: the inner life, the phenomenology of inhabiting a female sexed body. This bastion has come under attack; trans women claim that they ‘feel like a woman’ or that they are ‘a woman inside’. The aim of this essay is to assess such claims. -/- The appropriation of ‘womanhood’ by (...) males leads to the sidelining of women. Trans women are lauded as exemplars of womanhood. They are crowned ‘woman of the year’, become university women’s officers, represent women in political parties, or are being nominated for a women’s prize for fiction. The message is that trans women make for better ‘women’. The philosophical underpinnings for this view can be found in the work of Talia Mae Bettcher. -/- Road Map: -/- Part I: Recently, trans women have been claiming to have the phenomenal experience of women (I am a woman inside; I feel like a woman). Relying on Thomas Nagel[1] and Frank Jackson,[2] I will argue that they are in error. The inner life of trans women is fundamentally different from that of women, because the former cannot take up the female perspective. Being a woman means, among other things, to have a female body and, consequently, to experience yourself and the world through a female body. This is the core of being a woman, and trans women can never satisfy this condition, because they are – and remain – male-bodied (regardless of any bodily modifications). Thus, such claims are simply wrong. Trans women are not physiologically equipped to share in the female phenomenal experience. -/- Without a female body there is no female experience; the latter relies on the presence of the former.[3] This means that trans women are not women because a) they lack the respective body, and b) they lack the respective phenomenal experience. Their imitations of the female (experience) don’t make them into women. -/- Part II: Trans theory offers a way out, by sidelining the body. Talia Mae Bettcher’s account of ‘first-person authority’ (henceforth, FPA) about gender as well as the ‘liberatory project’ constitutes the strongest defence available to take the avowals of trans people (about sex, gender and their phenomenal experience) seriously. Bettcher’s theory has two advantages. It doesn’t matter whether you have a female body or not, and it doesn’t matter whether you are mistaken about your avowals or not (i.e. the epistemic question). The avowals of transgender people have ‘ethical force’, rather than epistemic force. This would mean that we need to affirm trans women in their belief that ‘trans women are women’, and it would follow that the ethical force would underwrite their claims of feeling like a woman inside. I will subject Bettcher’s cogitations to philosophical scrutiny; this is something that, surprisingly, is missing in the literature. Most subsequent writers adopt Bettcher’s FPA uncritically. I will conclude that Bettcher’s project fails, and that trans claims about having the phenomenal experience of women cannot find support from Bettcher’s FPA. -/- [1] Nagel, T. 1974. Under the Second Demographic Transition, alternative forms of living arrangement are on the rise. The aim of this article is to compare quality of life in children living in married and cohabiting families. We present the results of representative research conducted in Slovakia in 2018 (N = 1,010 respondents). We tested whether children brought up in traditional married families had better material resources and healthcare, fewer behavioural problems, better peer relations and spent more leisure time with their parents than children (...) brought up by cohabiting parents. We also investigated whether number of children in the family and net monthly household income affected the children’s quality of life. The results show that there were almost no differences in quality of life between children brought up by married and by cohabiting parents and that number of children in the family and level of net monthly household income affected only the child’s material resources. There are two conceptions of ‘inclusion’ in play in this debate. 1. The traditional conception in sport: How does sport provide inclusion/exclusion? Through eligibility criteria. 2. The social justice conception: trans people must be included in all social endeavours/institutions, one of these being sport. In the latter ‘inclusion’ facilitates affirmation and validation of their gender identity. The question is: should sport take on this ‘social justice’ task?

Scholastic and analytic definitions of semantic paradoxes, in terms of groundlessness, circularity, and semantic pathology, are introduced and compared with each other. The fundamental intuitions used in these definitions are the concepts of being true about extralinguistic reality, of making statements about one’s self, and of compatibility with an underlying semantic theory. The three approaches—the groundlessness view, the circularity view, and the semantic pathology view—are shown to differ not only conceptually, but also in their applications. As both a means for (...) showing these differences and as an adequacytest, the so-called two-line puzzles are used, which allows one to address the possibility of making non-paradoxical statements about paradoxical sentences within the same language. Lidská práva jsou v současné době předmětem řady komplexních otázek, které jsou politické, sociální či právní povahy. Abychom na otázky mohli smysluplně odpovídat, musíme brát ohled i na obecnější filosofické souvislosti a mít jasnější představu o tom, co lidská práva jsou a na jakých základech stojí. V předkládaném textu si klademe otázku, zdali máme v současné době k dispozici plně filosoficky fundovanou koncepci založení a legitimizace lidských práv. Předkládáme postupně různé současné přístupy, které jsou kandidáty na řešení tohoto problému a (...) přinášíme jejich kritické zhodnocení. Východiskem je pro nás představa lidských práv jako evidentních pravd a od ní odvozené přístupy zakládající je na racionální či emocionální evidenci. Dále se věnujeme možnosti náboženského založení lidských práv, přístupům přirozenoprávním, utilitaristickým a koncepcím vycházejícím z pojmu důstojnosti. Stručně jsou zmíněny i některé další související teorie a historický kontext analyzovaných pojetí. V závěru na položenou otázku odpovídáme, že zcela uspokojivá filosofická teorie lidských práv stále není k dispozici, a přinášíme také vlastní doporučení pro řešení předložených problémů zkoumaných teorií. As sports have become more professional, winning has become more important. This emphasis on results, rather than sporting virtue and winning in style, probably explains the rising incidence of the Strategic Foul. Surprisingly, it has found some apologists among the philosophers of sport. The discussion of the Strategic Foul in the literature has produced subtle distinctions (e.g. Cesar Torres: constitutive skills versus restorative skills) as well as implausible distinctions (e.g. D’Agostino: ‘impermissible’ but ‘acceptable’ behaviour). In this paper I will review (...) Robert Simon’s defence of strategic fouling and conclude that his justification is not convincing. (shrink)

This paper focuses on the early sixteenth-century epistemic logic developed by John Mair’s circle and discusses iterated epistemic modalities, epistemic closure and Bradwardinian semantics related to the logic of epistemic statements. These topics are addressed as part of setting up and solving epistemic sophisms based on traditional scenarios which can be traced back to fourteenth-century British epistemic logic. While the ultimate source for the debate appears to be the second chapter of William Heytesbury’s Regule solvendi sophismata, the immediate source is (...) the Italian editorial, commentarial and philosophical tradition, notably Paul of Venice and Cajetan of Thiene. Many philosophers of science have maintained that science should be value-free; still others believe that such ideal is neither achievable nor desirable for science. Hugh Lacey is presently one of the main supporters of the idea of value-free science and his theory is probably the most debated today and attracts the most attention and criticism. Therefore, in this text, I will primarily analyze his theory of value-free science. After briefly defining the notion of value I highlight which strategy Lacey chooses (...) to lay a firm foundation for the concept of science without value, with his starting point being the differentiation between cognitive and non-cognitive values. Then I describe three basic characteristics of Lacey’s value-free science: impartiality, neutrality, and autonomy. However, the overall plan and design of his project, together with some concrete steps he takes, are not without problems in our view. I will try to point out some of these problematic issues and provide brief suggestions for alleviating them. (shrink)

Although there have been efforts to integrate Semantic Web technologies and artificial agents related AI research approaches, they remain relatively isolated from each other. Herein, we introduce a new ontology framework designed to support the knowledge representation of artificial agents’ actions within the context of the actions of other autonomous agents and inspired by standard cognitive architectures. The framework consists of four parts: 1) an event ontology for information pertaining to actions and events; 2) an epistemic ontology containing facts about (...) knowledge, beliefs, perceptions and communication; 3) an ontology concerning future intentions, desires, and aversions; and, finally, 4) a deontic ontology for modeling obligations and prohibitions which limit agents’ actions. The architecture of the ontology framework is inspired by deontic cognitive event calculus as well as epistemic and deontic logic. We also describe a case study in which the proposed DCEO ontology supports autonomous vehicle navigation. (shrink)

There is a well-documented paradigm-shift in eighteenth century Jesuit philosophy and science, at the very least in Central Europe: traditional scholastic version(s) of Aristotelianism were replaced by early modern rationalism (Wolff's systematisation of Leibnizian philosophy) and early modern science and mathematics. In the field of probability, this meant that the traditional Jesuit engagement with probability, uncertainty, and truthlikeness (in particular, as applied to moral theology) could translate into mathematical language, and can be analysed against the background of the accounts of (...) probability, pre-mathematical Jesuit logic, Wolff's conceptual analysis, and Bernoullian mathematisation. The works of two Jesuit philosophers, Berthold Hauser and Sigismund Storchenau, can be related to this context. The core of their logic of (epistemic) probability is the account of negation (or ‘contradiction’) and implication (or ‘argument’), in particular, the algorithms for computing the reliability of one piece of evidence when compared to the respective counter-evidence and for computing the probability of a conclusion given the probability of its premises. Among the important conceptual innovations introduced in the second scholasticism era and motivated by theological debates following the Council of Trent were the theories of moral necessity and moral implication. As they were centred upon a view of moral necessity as a form of necessity weaker than physical necessity, and moral implication as weaker than physical implication, some interpretations of moral necessity encouraged the logic of statistical hypotheses and probability. Three branches of this debate are studied in this paper: the (...) explanation of moral necessity in terms of suppositio, the confrontation over the interpretation of moral necessity, and the theory of statistical quantification. Gaunilo presents Anselm with a dilemma in section 7 of his Responsio: I know most certainly that I exist. But If I cannot think my non-existence at the same time, then Anselm's claim in Proslogion 3 (that my inability to think God's non-existence, while knowing most certainly that He exists, is a unique property of God) would be false. If I can do so, however, then I should also be able to know most certainly that God exists and, at the (...) same time, think his non-existence. I will show that Anselm's response to Gaunilo's attack is not adequate because it does not address the issue of certainty, which is at the heart of Gaunilo's objection. (shrink)

What does it mean to subvert the rules? One way of doing so is to interfere with or curb the display of skill of your opponent by a) breaking the rules deliberately and openly or b) by acting contrary to the idea of sportspersonship. In both instances you violate the norm that displaying/exercising your game-related skills is central for a good contest. In the former you incorporate the penalty rules into the playing rules, i.e. you act as if breaking the (...) rules is part of playing the game. In the latter you adopt a (new) strategy which curbs the display of skill by your opponent, a strategy about which the rules are silent. The motivation for such acts is not to make the game better, but to ensure a win. The former suffers from a conceptual error, because it attempts to make transcendental elements of the game into part of play (e.g. strategic fouling). The latter strategy exploits the fact that the rules are ‘silent’ on many possible actions, because the gamewright cannot envision everything and/or because such actions are contrary to the spirit of the game (e.g. Bianca Walkden’s pushing strategy in Taekwondo; the underarm bowling incident from 1981). In this paper I will illustrate and analyse such rule subversion, combined with some reflections on game rules and the good contest. Uma forma de fazer isso é interferir ou restringir a exibição das habilidades do adversário, o que pode ocorrer de duas maneiras: a) violando deliberada e abertamente as regras, ou b) agindo de forma contrária ao espírito esportivo. Em ambos os casos, ocorre uma transgressão da norma que valoriza a demonstração/exercício de habilidades como elemento essencial para uma boa competição. No primeiro caso, você integra as penalidades às regras do jogo, como se infringir as regras fosse parte da própria dinâmica do jogo. No segundo caso, adota-se uma (nova) estratégia que limita a exibição das habilidades do adversário sobre a qual as regras nada estabelecem. A motivação por trás desses atos não é o aprimoramento do jogo, mas garantir a vitória. Neste artigo, ilustro e analiso essa subversão das regras, trazendo reflexões sobre o papel das regras no jogo e uma boa competição. (shrink)

This article critically examines the evolving policies surrounding the inclusion of transgender women in women’s sports categories, with a focus on the International Olympic Committee’s (IOC) framework. The author highlights the implications of prioritizing inclusion over fairness, arguing that the fundamental value of fairness in sports is compromised when male-bodied athletes compete in female categories. Through a detailed analysis, the article explores the role of categorization in preserving equitable competition, the impact of physiological advantages, and the socio-cultural narratives influencing policy (...) shifts. It concludes by questioning the long-term consequences of redefining sports to prioritize social justice concerns over their traditional purpose of fair competition. (shrink)

I confront arbitrariness of the sign to a criterion assessing the quality of language, logical system, psychometrics and art.

The research presented in this article is motivated by the increasing importance of complex human relations in linked data, either extracted from social networks, or found in existing databases. The FOAF vocabulary, targeted in our research, plays a central role in those data, and is a model for lightweight ontologies largely used in linked data, such as the DBpedia ontology and schema-org. We provide an overview of FOAF and other approaches for describing human relations, followed by a detailed analysis and (...) critique of the FOAF Relationship Vocabulary, the most important FOAF extension. We propose an explicit formal axiomatization of this vocabulary, and an ontological analysis concerning the properties used to describe human relationships. We analyze the distribution of human relations based on their epistemological status, and define an ontoepistemic meta-property as characteristic of some of these predicates. Our analysis is generalizable to semantic modeling of social networks. Additionally, the modeling patterns used in other relevant linked data vocabularies are analyzed for comparison. (shrink)

The axial aim of the paper is to dissect the main concepts of Margaret Archer’s theoretical position. In that line, first, the broader context of critical realism as a unique standpoint of philosophy of science is depicted, as her understanding of epistemology of the social is derived from there. The main body of the manuscript conveys discussions about crucial conceptual categories of the sociology of Margaret Archer primarily linked with analytical dualism, realist social theory, and morphogenetic/morphostatic approach. Moreover, a short (...) review of novel tendencies in further articulation of Archer’s theory, such as relational sociology, is presented. Furthermore, some examples of empirical application of her concepts are noted, as well as some critical remarks addressed to her epistemological-theoretical standpoint. Finally, in the concluding section, the prospects of using Archer’s sociological theory for empirical research on the transformation of contemporary Croatian society are emphasized. (shrink)
