We argue that, in certain circumstances, doctors might beprofessionallyjustified to provide abortions even in those jurisdictions where abortion is illegal. That it is at least professionally permissible does not mean that they have an all-things-considered ethical justification or obligation to provide illegal abortions or that professional obligations or professional permissibility trump legal obligations. It rather means that professional organisations should respect and indeed protect doctors’ positive claims of conscience to provide abortions if they plausibly track what is in the best (...) medical interests of their patients. It is the responsibility of state authorities to enforce the law, but it is the responsibility of professional organisations to uphold the highest standards of medical ethics, even when they conflict with the law. Whatever the legal sanctions in place, healthcare professionals should not be sanctioned by the professional bodies for providing abortions according to professional standards, even if illegally. Indeed, professional organisation should lobby to offer protection to such professionals. Our arguments have practical implications for what healthcare professionals and healthcare professional organisations may or should do in those jurisdictions that legally prohibit abortion, such as some US States after the reversal ofRoe v Wade. Cameron et al ’s1 ethical considerations about the ‘Dualism of Values’ in pandemic response emphasise the need to strike a fair balance between the interests of the less vulnerable to COVID-19 and the interests of the more vulnerable. Those considerations are at the basis of ethical defences of focused protection strategies.2 One example is the proposal put forward in the Great Barrington Declaration. It presented focused protection strategies as more ethical alternatives to lockdowns which would prevent lockdowns’ ‘irreparable damage, with (...) the underprivileged disproportionately harmed’.3 Here we want to suggest that a version of Cameron et al ’s analysis can be applied to the case of vaccines to support a focused protection vaccination strategy. At this stage, we should limit vaccination to the vulnerable and not target children in COVID-19 vaccination strategies. We argue that, given the current state of knowledge about COVID-19, immunity and vaccines, it would be wrong to pose the costs and risks of vaccines on children for three reasons. This paper argues that the AI ethics has generally neglected the issues related to the science communication of AI. In particular, the article focuses on visual communication about AI and, more specifically, on the use of certain stock images in science communication about AI — in particular, those characterized by an excessive use of blue color and recurrent subjects, such as androgyne faces, half-flesh and half-circuit brains, and variations on Michelangelo’s The Creation of Adam. In the first section, the author (...) refers to a “referentialist” ethics of science communication for an ethical assessment of these images. From this perspective, these images are unethical. While the ethics of science communication generally promotes virtues like modesty and humility, similar images are arrogant and overconfident. In the second section, the author uses French philosopher Jacques Rancière’s concepts of “distribution of the sensible,” “disagreement,” and “pensive image.” Rancière’s thought paves the way to a deeper critique of these images of AI. The problem with similar images is not their lack of reference to the “things themselves.” It rather lies in the way they stifle any possible forms of disagreement about AI. However, the author argues that stock images and other popular images of AI are not a problem per se, and they can also be a resource. This depends on the real possibility for these images to support forms of pensiveness. In the conclusion, the question is asked whether the kind of ethics or politics of AI images proposed in this article can be applied to AI ethics tout court. (shrink)

To the extent that antibiotic resistance (ABR) is accelerated by antibiotic consumption and that it represents a serious public health emergency, it is imperative to drastically reduce antibiotic consumption, particularly in high‐income countries. I present the problem of ABR as an instance of the collective action problem known as ‘tragedy of the commons’. I propose that there is a strong ethical justification for taxing certain uses of antibiotics, namely when antibiotics are required to treat minor and self‐limiting infections, such as (...) respiratory tract infections, in otherwise healthy individuals. Taxation would allow a reduction in consumption (given certain behavioural economics assumptions) and/or ensure that individuals internalize or compensate for their contribution to the erosion of the common good of antibiotic effectiveness. I suggest that revenue from the tax could be used to fund conservation and innovation strategies. Taxation might be a coercive policy, especially for certain individuals, but the ethical case for coercive policies is very strong when the good to be preserved is important enough and when they force individuals to do something they have a moral obligation to do anyway. I argue that, in the case of mild and self‐limiting infections, individuals have a moral duty of easy rescue and a moral duty of fairness to make their contribution to the preservation of the common good of antibiotic effectiveness by foregoing antibiotics. I also suggest that taxing antibiotics in such cases is an all things considered ethically justified policy even if it would introduce inequalities in access to healthcare. (shrink)

Comenzando con su preocupación común por la multiplicidad, exploraremos el movimiento fundacional de Deleuze hacia diferentes tipos de multiplicidad. La crítica de Badiou a este enfoque estará relacionada con su defensa de los recursos abstractos de la teoría de conjuntos en oposición a las síntesis concretas con las que Deleuze busca comenzar. La segunda parte de este documento explorará las consecuencias de (...) los compromisos ontológicos de Deleuze cuando se trata de la ética del acontecimiento exigido por Badiou. El compromiso de Deleuze con el estoicismo proporcionará el escenario para su explicación de cómo ocurren los acontecimientos y representa una fuente de pensamiento y actividad. En la tercera y última parte se buscará evaluar la explicación de Deleuze sobre el papel de los acontecimientos en situaciones particulares y en las actividades de los sujetos que responden a estos. Esto nos permitirá sacar conclusiones sobre la crítica de Badiou a Deleuze y la capacidad de Deleuze para resistir estas críticas. Argumentaré que Deleuze comparte con Badiou la preocupación de mantener una visión clara del tema como una figura comprometida en la búsqueda de proyectos nuevos e inauditos que responden al llamado de los acontecimientos. Reliance on intuitive and emotive responses is widespread across many areas of bioethics, and the current debate on biotechnological human enhancement is particularly interesting in this respect. A strand of “bioconservatives” that has explicitly drawn connections to the modern conservative tradition, dating back to Edmund Burke, appeals explicitly to the alleged wisdom of our intuitions and emotions to ground opposition to some biotechnologies or their uses. So-called bioliberals, those who in principle do not oppose human bioenhancement, tend to rely on (...) rational arguments and to see intuitions and emotions mostly as sources of biases. This approach often translates into shifting the burden of proof onto bioconservatives and challenging them to provide arguments against the proposed enhancement to back what bioliberals perceive as merely intuitive, emotive, and irrational reactions. -/- In this article, I am going to show that the methodological divide between bioliberals and bioconservatives is less significant than at first glance it appears to be and less significant than it is often taken to be. I will do so by defending two theses. The first is that reliance on intuitions and emotions is not a prerogative of bioconservatives: bioliberals have their typical intuitions and emotive responses and are for this reason exposed to potential biases in the same way as bioconservatives are. The second thesis is that reliance on intuitions and emotions is not necessarily antithetic to reason and rationality. This latter thesis has been philosophically defended with particular reference to the debate on biotechnologies, while the former is perhaps more controversial and more difficult to accept—at least for bioliberals. In both cases, I will support the claims by drawing on resources from the field of moral psychology and the sciences of the mind and, particularly, by applying to some positions in the enhancement debate recent findings about the role of intuitions and emotions in human moral assessment. This new empirically informed perspective holds promises for solving the methodological controversy between bioconservatives and bioliberals, thus enabling proper dialogue and debate between the two sides. El objetivo del presente trabajo es explicar la relación entre las nociones de discurso y acción en un marco pragmático trascendental. El trabajo comienza con una presentación de la primera noción y de la idea de pretensión de validez. Luego son examinadas algunas objeciones a la justificación última de la ética, formulada por Apel. La conclusión es que es posible una respuesta a esas objeciones mediante la diferenciación entre dos niveles de la relación entre discurso y acción: un nivel fáctico (...) y uno trascendental. The aim of this paper is to explain the relation between the notions of discourse and action in a transcendental-pragmatic frame. The paper begins with a presentation of the first notion and the idea of validity claim. After that, some objections to Apel's ultimate justifications of ethic are examined. The conclusion is that an answer to these objections is possible throw the difference between two levels of the relation between discourse and action: a real level and a transcendental one. (shrink)

El objetivo de este artículo es explorar la manera en que Joaquim Xirau y Miguel de Unamuno concibieron el amor. A pesar de que no hay motivos suficientes para concluir una influencia directa y filosóficamente relevante de Unamuno en la obra de Xirau, sí podemos concluir que la forma en que ambos autores concibieron el amor guarda ciertas similitudes. Así, ambos coinciden en concebir la entrega amorosa como un ejercicio de afirmación individual que trae consigo un incremento de la propia (...) singularidad. También, tanto Unamuno como Xirau conciben la entrega amorosa como un acto que, aun surgiendo del propio individuo y no de como es de hecho el mundo, personifica aquello amado, dejando de ser así visto como un mero objeto y mostrándose bajo una forma personal. Y ambos, aunque de un modo distinto, hacen del relato bíblico acerca de la vida y Resurrección de Cristo un aspecto central de sus maneras de entender el amor. (shrink)

We argue that we should provide extra payment not only for extra time worked but also for the extra risks healthcare workers (and those working in healthcare settings) incur while caring for COVID‐19 patients—and more generally when caring for patients poses them at significantly higher risks than normal. We argue that the extra payment is warranted regardless of whether healthcare workers have a professional obligation to provide such risky healthcare. Payment for risk would meet four essential ethical requirements. First, assuming (...) healthcare workers do not have a professional obligation to take on themselves the risks, payments in the form of incentives would preserve autonomy in deciding what risks to take on oneself. Second, even assuming that healthcare workers do have a professional obligation to take on themselves the risks, payments for risk would create fair working conditions by avoiding exploitation. Third, payments for risk would make it more likely that public healthcare systems can discharge their institutional responsibility to provide healthcare in circumstances where healthcare workers may otherwise (perhaps legitimately) opt out. Fourth, payments for risk would guarantee an efficient healthcare system in pandemic situations. Finally, we address two likely objections that some might raise against our proposal, particularly with regard to incentives, namely that such payments or incentives can themselves be coercive and that they represent a form of undue inducement. El propósito de este trabajo es explicar la relación entre acción, reglas y discurso. El trabajo comienza con una presentación de algunas objeciones a la ética del discurso y su base común: la independencia entre moralidad y razón. Luego son propuestas contra esas objeciones dos tesis sobre la relación entre acción y discurso en un marco pragmático trascendental. La conclusión es que la posibilidad del discurso es una condición del sentido de la acción humana.

A common assumption in non-relativistic quantum mechanics is that self-adjoint operators mathematically represent properties of quantum systems. Focusing on spin, we argue that a natural view considers observables as determinable properties and their eigenvalues as their corresponding determinates. We provide a taxonomy of the different views that one can hold, once it is accepted that spin can be modelled with the determinable-determinate relation. In particular, we present the two main families of views, dubbed Spin Monism and Pluralism, and we show (...) that the current literature does not take a stance between the two. Then we put forward two arguments in favour of the former. Finally, we present a new account of Spin Monism, that is absent in current literature; such a view is worth discussing, or so we contend, because several compelling considerations support it, and it opens new ways of thinking about the ontology of quantum mechanics. This book offers a comprehensive and accessible characterisation of the first-person shooter videogame genre. After providing an overview of the history of the first-person shooter videogame genre, Alberto Oya comments on the various defining peculiarities of this genre, namely the first-person perspective, the shooting gaming mechanics, the heroic in-game narrative or background story, and multiplayer gaming. Oya also argues that educators can use first-person shooter videogames to encourage their students to reflect on historical and philosophical issues.

In this response paper, we respond to the criticisms that Michal Pruski raised against our article “Beyond Money: Conscientious Objection in Medicine as a Conflict of Interests.” We defend our original position against conscientious objection in healthcare by suggesting that the analogies Pruski uses to criticize our paper miss the relevant point and that some of the analogies he uses and the implications he draws are misplaced.

In a paper published recently in this journal, Buben attempted to show the philosophical relevance of Unamuno’s philosophical works when addressing the current debate on whether an endless existence would be something desirable—a debate which is nowadays commonly known as “The Makropulos Debate” since it was Bernard Williams’s “The Makropulos Case: Reflections on the Tedium of Immortality” that aroused interest in this question among contemporary analytic philosophers. Unfortunately, Buben’s paper fails to capture or even outline the reasoning behind Unamuno’s claim (...) that we all naturally long for an endless existence —and consequently it also fails to clarify how Unamuno’s position may contribute to the current philosophical debate on the question as to whether an endless existence would be something desirable. In this paper I will point out that Unamuno’s affirmation that we all, without exception, long for an endless existence is grounded in his metaphysical claim that the most basic and natural inclination of all singular things is to increase their own singularity. In doing so, I will also be showing that Unamuno’s proposal is not philosophically relevant when addressing the current debate on the question as to whether living an endless existence would be something desirable. In Defining Racism, I offer the first comprehensive examination of the philosophical literature on racism and argue for a new methodological approach that I call conventionalism. Framing my argument within this approach, I defend an oppression theory of racism. In this article, I will attempt to accomplish two goals: offer a reply to the thoughtful comments of my critics, and lay out the main argument and major themes of my book in an accessible manner. First, I will describe the philosophical (...) problem of defining “racism” and explain why I think a new methodological approach is necessary to address this problem. Second, I will present the moralist presupposition of my project and extend my oppression theory of racism in response to the challenge of assigning responsibility for oppression. Finally, I will address several criticisms to my prescriptive approach, including: my prescriptive approach unjustifiably privileges moralist explanation over social explanation ; the tool of semantic clarification, which my conventionalist framework draws upon, is inadequate for resolving conceptual disagreement; my call for scholars to negotiate the meaning of “racism” is unlikely to succeed and would be insufficient to inspire social change if it were to succeed; and, finally, my conventionalist approach is wedded to a misguided intensionalist semantics, for an extensionalist semantics is more appropriate for the term “racist.”. This paper traces the concept and phenomenon of generosity from Aristotle to Emannuel Levinas and beyond. The question motivating this investigation is: must the generous act be restricted by a rational calculation of correct, or prudent, giving? Answers to this question vary. Aristotle and Kant would answer in the affirmative, while Emerson and Levinas would not. The bulk of this paper is dedicated to Levinas's characterization of excessive generosity as a condition for the fundamental ethical relation, namely, the generous welcome (...) of the Other. I end by considering the phenomenon of generosity from the point of view of the mid‐20th century Mexican philosopher, Emilio Uranga. (shrink)

Some authors argue that it is permissible for clinicians to conscientiously provide abortion services because clinicians are already allowed to conscientiously refuse to provide certain services. Call this the symmetry thesis. We argue that on either of the two main understandings of the aim of the medical profession—what we will call “pathocentric” and “interest‐centric” views—conscientious refusal and conscientious provision are mutually exclusive. On pathocentric views, refusing to provide a service that takes away from a patient's health is professionally justified because (...) there are compelling reasons, based on professional standards, to refuse to provide that service (e.g., it does not heal, and it is contrary to the goals of medicine). However, providing that same service is not professionally justified when providing that service would be contrary to the goals of medicine. Likewise, the thesis turns out false on interest‐centric views. Refusing to provide a service is not professionally justified when that service helps the patient fulfill her autonomous preferences because there are compelling reasons, based on professional standards, to provide that service (e.g., it helps her achieve her autonomous preferences, and it would be contrary to the goals of medicine to deny her that service). However, refusing to provide that same service is not professionally justified when refusing to provide that service would be contrary to the goals of medicine. As a result, on either of the two most plausible views on the goals of medicine, the symmetry thesis turns out false. (shrink)

In the philosophy of fiction, a majority view is continuism, i.e., the thesis that ordinary names, or genuine singular terms in general, directly refer to ordinary real individuals in fiction-involving sentences – e.g. “Napoleon” in the sentences that constitute the text of Tolstoy’s War and Peace. But there is also a minority view, exceptionalism, which is the thesis that such terms change their semantic value in such sentences, either by directly referring to fictional surrogates of those individuals – what we (...) may call exceptional hyperrealism about fictional characters – or by acquiring a semantic value that turns them into nonreferential terms, involving no ontological commitment to such characters – exceptional irrealism about fictional characters. In this paper, first of all, I want to support hybrid exceptionalism, according to which both parties are partly right and partly wrong. In the fictional use of fiction-involving sentences, those terms directly refer to ordinary real individuals, as continuists claim, while both in the internal and the external metafictional use of fiction-involving sentences, such terms change their semantic value, as exceptionalists claim. (By contrast, for pure exceptionalists such terms either always refer to fictional surrogates or are nonreferring on all such uses.) Moreover, I will argue that hybrid exceptional hyperrealism must be preferred to hybrid exceptional irrealism: in the latter uses, I claim, such terms directly refer to fictional surrogates. In this article, the author deals with the status of the self and personal identity in the digital milieu. In the first section, he presents his general approach to digital media and technologies, which he has called “digital hermeneutics”. He distinguishes between three perspectives in digital hermeneutics, namely the deconstructive, epistemological, and ontological approaches. In the second part, he focuses on digital hermeneutics as hermeneutics of the self. He compares Paul Ricoeur’s narrative identity to Pierre Bourdieu’s habitus. His first thesis (...) is that the habitus can be seen as a concept of subjectivation that neglects an important part of the subject. Narrative identity offers, in this sense, a remedy to such negligence. His second thesis is that today’s digital media and technologies are closer to the Bourdieusian habitus than to the Ricoeurian narrative identity. In other words, digital machines and technologies are “habitus machines” both in their structure and in their effects. In the conclusion, the author accounts for three potential responses to the habituation of our selves online. He also introduces the concepts of “digital agency” and “digital citizenship”. (shrink)
