Ethics plays an essential role in the philosophical framework of Abū Bakr al-Rāzī. Although most of his philosophical works have become extinct, two surviving works serve as primary sources for understanding his ethical theory. Although sharing certain foundational principles, these two works diverge in terms of ethical standards and exhibit distinct logical approaches to ethics, a facet that has largely remained unexplored within contemporary scholarly discourse. I aim to extract and reconstruct both of his ethical decision-making systems by shedding light (...) on the place of ethics in his philosophy, explaining the interconnection of the two ethical frameworks, reconstructing both of these ethical systems, and finally presenting them in patterns. Primer avance de un trabajo en curso sobre la doctrina de Ibn Tūmart. Se pone de relieve la profunda originalidad del pensamiento jurídico y religioso del fundador del movimiento almohade tal y como se refleja en A‛azz mā yuṭlab. Su respuesta a la pregunta «¿De qué clase es y de dónde procede el conocimiento de la ley divina?» supone una crítica radical a las posturas de sus predecesores en los uṣūl al-fiqh, ya que Ibn Tūmart rechaza frontalmente la suposición como (...) fundamento del saber. Una valoración de la šarī‛a no puede ser establecida en ningún caso basándose en una mera suposición. Al análisis de las consecuencias de este punto de partida, sigue el análisis de la estrecha conexión entre saber y práctica establecida en la doctrina de Ibn Tūmart, eliminándose así el principio de la «carga insoportable» del aŠ‛arismo. Frente a al-Gazālī, para Ibn Tūmart no sólo los conceptos, sino también las mismas cosas están en una relación susceptible de análisis, garantizadas por la existencia del saber creado por Dios. La misión de al-mahdī al-ma‛ṣūm al-ma‛lūm es la de hacer que ese saber aparezca claramente tal y como era al comienzo. Gracias al mahdī se sustentan el Cielo y la Tierra lo cual permite establecer un paralelismo con la doctrina del sufí al-Qādir al-Yīlānī, contemporáneo oriental de Ibn Tūmart. (shrink)

In _Doubts on Avicenna_, Ayman Shihadeh offers an extended study and critical edition of Sharaf al-Dīn al-Masʿūdī’s _al-Mabāḥith wa-l-Shukūk_, a key and hitherto unstudied source for twelfth-century Arabic philosophy. This text inaugurates the long commentarial tradition on Avicenna’s _Ishārāt_.

Los estudios modernos sobre derecho islámico han puesto de relieve la necesidad de estudiar los procedimientos jurídicos en el Islam y el papel desempeñado por la práctica judicial en su formación. Se considera en general que, en el período temprano, los cadíes disponían de mayor libertad en lo relativo a testigos y métodos para establecer pruebas. Posteriormente y de forma gradual el sistema se volvió más rígido y restrictivo. En relación a este desarrollo, los investigadores han propuesto distintas fechas, que (...) van desde la segunda mitad del siglo VII hasta el siglo VIII e incluso hasta el siglo XI. Estos investigadores han tratado la doctrina de al-yamīn ma‛ al-šàhid como una excepción dentro del procedimiento establecido por la šarī‛a que, según ellos, se basaba estricta y mecánicamente en la doctrina de los dos testigos. Para dichos investigadores, la doctrina de al-yamīn ma‛ al-šàhid surgió bajo la influencia de determinadas locadidades o bien por influencia judía. Este artículo propone que esa doctrina debió de surgir en el contexto del período de la guerra civil, cuando las cuestiones sobre qiṣāṣ, qawad, qasāma y ḥakam fueron discutidas con frecuencia en relación con el Corán y la sunna común y cuando se sintió la necesidad de reformar la institución del ḥakam. Sobre la base de afirmaciones dispersas de ulemas que vivieron en fechas cercanas a ese período, afirmaciones que se ven confirmadas por los comentarios de Wakī‛, se concluye que Mu‛āwiya fue quien introdujo ese método para reformar la institución del ḥakam. La práctica judicial de esta doctrina también confirma que estaba demasiado difundida como para poder considerarla una práctica medinense o una práctica local, tal y como pretenden algunos juristas clásicos, los tradicionistas y algunos investigadores modernos. metempsychosis is the concept of the transmigration of a human or animal soul into another human, animal, plant, or even an inanimate object. The theory of metempsychosis poses a challenge to the belief in resurrection (maʿād), making it necessary to reject metempsychosis before proving maʿād. Avicenna presents two arguments against metempsychosis. The first argument, found in numerous works, rejects metempsychosis on the grounds that it requires the union of two soul s within a single body. Avicenna alludes to the second (...) argument in his Al-Isharat wa al-Tanbihat but postpones its full explanation to another unspecified work. Nasir al-Din al-Tusi, Fakhr al-Din Razi, and Qutb al-Din Razi have proposed different interpretations of this second argument. The variations in interpretation revolve around the number of implications Avicenna expressed for this modus ponendo and his reasons for rejecting them. Among these interpretations, only Qutb al-Din Razi's aligns more closely with Avicenna's original words. In the other two interpretations, there are either deficiencies or excesses compared to Avicenna's work. (shrink)

Al-Qadi al-Nu´man b. Muhammad es el más destacado y prolífico de los estudiosos fatimíes y el fundador de la jurisprudencia isma´ilí. En su epístola " La clarificación elocuente para la refutación de Ibn Qutayba", todavía en manuscrito, al-Nu,man se lanza a una polémica en contra de Ibn Qutayba, que había vivido un siglo antes. Es probable que la epístola fuera escrita en la época de al- Mu´izz a petición de un tutor anónimo de los hijos del califa. En ella, al-Nu´man (...) se propone refutar la afirmación de Ibn Qutaybba, incluida en la introducción de su famosa obra Adab al-Katib, según la cual era suficiente para la realización de sus tareas que los kuttab, o funcionarios del estado, memorizaran una serie de fórmulas legales simples, sin tener que aprenderse las largas disertaciones de los fuqaha' o doctores de la ley. Al-Qadi al-Nu´man, un faqih famoso, se dedica en la epístola a demostrar que sin estas disertaciones no se podía aplicar la ley correctamente. En su texto se refiere a cada fórmula legal mencionada por su rival en Adab al-Katib y demuestra cómo la ley se debería aplicar basándose en la autoridad de los imames del Ahl al-Bayt, la Familia del Profeta Muhammad. : Hisbah is the most important institution in a society and nation.Enforcement parties are those who are directly involved in executing this. Incarrying out their duties, they bear heavy responsibility because it involvesthe rights of Allah and the rights of human. Hisbah implies theimplementation of al-amr bi-l-maʿrūf when it is clear thatit is abandoned, and wa-n-nahy ʿani-l-munkar when itis clear that it is done. This study is based on the concept of Hisbah in SharīʿahLaw which is of a general and (...) widespread aspect of enjoining good andpreventing evil. Literature reviews and library searches have been conductedintensively to clarify the principles of hisbah. Additionally, descriptiveand content analysis of textual content was done on the provisions of lawsand regulations as well as guidelines on the prevention of sharīʿah crimeparameters in Malaysia. In general, our country has implemented the conceptof hisbah in its own form without the branding of an institution specifically as“the institution of hisbah”. The roles and functions of hisbah are given to theSharīʿah Enforcement Division, Islamic Religious Department in the states. (shrink)

Although there are fundamental differences between Ahl al-Sunnah and Shī‘a on the issue of Mahdī, one of the controversial issues among Islamic sects, Shī‘a has attached much greater importance to the issue. In this study, after the information about Mahdiship in the primary sources of Islam is conveyed, the opinions of the Ahl al-Sunnah and Shī‘a will be given and an evaluation will be made about the evidence and opinions put forward by the two sects. The Shiites, who formed the (...) principles of belief based on the theory of imamate, explained the issue of Mahdism in the axis of imamate and gave it a religious dimension, but the Shi‘ī sects disagreed on the subject of Mahdī. Shi‘ī sources tried to show that the claim of Mahdiship is an important issue, which has preoccupied Muslims, by dating the claim of Mahdiship back to Ali ibn Abi Talib's son, Muhammad ibn Hanafiyah. In a very early period, it was claimed that Muhammad ibn Hanafiyya did not die but was still living on a mountain called Razva in Madinah, and he was the anticipated (muntaẓar) Mahdī. Most of the Zaydiyya did not consider the issue of Mahdiship an important fundamental basis of belief. Ismailiyya maintain that Muhammad ibn Ismail did not die and will come and amend the world one day. Imāmiyya believe that Hasan, whom they accept as the last imam, will reappear as the Mahdī in the latest days of the world, and in line with this belief, they have made great efforts to find proof from the Qur’ānic verses and hadiths and interpreted them. In this way, they attached more importance to the understanding of Mahdiship on the axis of imamate than the other Shi‘ī sects. According to Imāmiyya, since the world cannot be left without a prophet, an open, or a secret imam, Muhammad b. Hasan will remain hidden as long as he wants and appear as the Mahdī near the Doomsday. Based on the clear statement of the Messenger of Allah (pbuh) that twelve caliphs would come after him, the Imāmiyya restricted the number of Imams from Ahl al-Bayt to twelve and claimed that the twelfth imam would come again as Mahdī. Although the Imāmiyya believe that the Mahdī will be from the Ahl al-Bayt, just like the other imams, they have not been able to provide valid evidence for the belief that the twelfth imam will be hidden and appear near Judgment Day. Although Imāmiya tried/have been trying to prove that it is possible for a person to live for centuries (more than a thousand years), which is called al-Ghaybat al-Kubrā by Imamiyya, it cannot be said that they have succeeded in doing so.
