This book is the first to offer a detailed analysis of Aristotelian and Kantian ethics together, in a way that remains faithful to the texts and responsive to debates in contemporary ethics. Recent moral philosophy has seen a revival of interest in the concept of virtue, and with it a reassessment of the role of virtue in the work of Aristotle and Kant. This book brings that re-assessment to a new level of sophistication. Nancy Sherman argues that Kant preserves (...) a notion of virtue in his moral theory that bears recognisable traces of the Aristotelian and Stoic traditions, and that his complex anthropology of morals brings him into surprising alliance with Aristotle. The volume brings together for the first time original essays by leading philosophers working on powers in relation to metaphysics, philosophy of natural and social science, philosophy of mind and action, epistemology, ethics and social and political philosophy. In each area, the concern is to show how a commitment to real causal powers affects discussion at the level in question. In metaphysics, for example, realism about powers is now recognized as providing an alternative to orthodox accounts of causation, modality, properties (...) and laws. Dispositional realist philosophers of science, meanwhile, argue that a powers ontology allows for a proper account of the nature of scientific explanation. In the philosophy of mind there is the suggestion that agency is best understood in terms of the distinctive powers of human beings. Those who take virtue theoretic approaches in epistemology and ethics have long been interested in the powers that allow for knowledge and/or moral excellence. In social and political philosophy, finally, powers theorists are interested in the powers of sociological phenomena such as collectivities, institutions, roles and/or social relations, but also in the conditions of possibility for the cultivation of the powers of individuals. Probability is a guide to life partly because it is a guide to causality. Work over the last two decades using Bayes nets supposes that probability is a very sure guide to causality. I think not, and I shall argue that here. Almost all the objections I list are well-known. But I have come to see them in a different light by reflecting again on the original work in this area by Wolfgang Spohn and his recent defense of it in (...) a paper titled “Bayesian Nets Are All There Is to Causality”. As a response to Le Fils, a film directed by the Dardenne brothers (), we explore the idea of speaking as an invitation and juxtapose it against ideas of speaking as a transactional, calculative, calibrated, activity. Speaking tends to be understood as a relatively straightforward matter: as a means of communication structured by such values as the reciprocal balancing of rights and obligations, of clear communication of information, of the gaining of insight into what is happening. Speaking, then, is a (...) means by which we explain, prove or pass judgement on something. Understood this way, it is easily associated with ideas of empowerment or of the mediation of information: one directs or commits oneself to a (shared) orientation—for example to what Jürgen Habermas refers to as ‘communicative reason’. It presupposes a particular attitude of the subject; speaking that addresses the listener and the speaker herself in the name of an orientation or particular expertise to which access is claimed. In this article, by contrast, we would like to explore a different avenue of thought whereby speaking appears rather as an abandoning or exposing of oneself. It is less an activity than a passivity or passion, through which one becomes present in the present, which is at once also a kind of invitation. In exploring this form of speaking, we take up some ideas of Martin Buber. Our discussion relates speaking to being inspiring and being inspired, revealing in the process the way that to be inspiring is at the same time to be inspired. Speaking as invitation, we conclude, is what education is about. (shrink)

It is widely assumed that informing prospective subjects about the risks and possible benefits of research not only protects their rights as autonomous decisionmakers, but also empowers them to protect their own interests. Yet interviews with patient‐subjects conducted under the auspices of the Advisory Committee on Human Radiation Experiments suggest this is not always the case. Patient‐subjects often trust their physician to guide them through decisions on research participation. Clinicians, investigators, and IRBs must assure that such trust is not misplaced.

People who lack decision‐making capacity may be able to communicate preferences, which can and should inform surrogate decision‐making on their behalf. It is unclear whether making a further distinction about “capacity for preferences,” as Jason Wasserman and Mark Navin propose in this issue of the Hastings Center Report, would improve the process of surrogate decision‐making. Anyone who is regularly involved in surrogate decision‐making or who has worked to articulate decision‐making standards and processes can think of cases in which a patient's (...) voice was ignored or his or her preferences and ability to communicate them overlooked. However, we can also think of cases in which it was unclear whether information provided by a patient, recently or in the past, should have been characterized as a preference relevant to a medical decision that the patient lacked the capacity to make. We should also recognize that clear preferences of a patient who lacks decision‐making capacity may conflict with the limits of another person or of a family's resources such that these preferences cannot guide a surrogate's decision. This patient will not get what he wants. A situation in which preferences are known and make sense but cannot be applied in a feasible way demonstrates the limits of the medical decision‐making framework concerning care that is not covered by medical insurance. This paper raises health equity concerns about the use of passports for domestic and international travel to certify COVID-19 vaccination. Part I argues that for international travel, health equity objections undercut arguments defending vaccine passports, which are based on tholding people responsible, protecting global health, safeguarding individual liberty and continuing current practice. Part II entertains a proposal for a scaled down vaccine passport for domestic use in countries where vaccines are widely and equitably available. It raises health equity concerns related (...) to racial profiling and fairness to people who are vaccine cautious. Part III sets forth a proposal for a flexible pass that certifies people who have been vaccinated, tested, previously infected or granted a conscientious objection. It sets ethical guidelines for the timing and use of flexible passes that promote equity, public health education, antidiscrimination, privacy and flexibility. (shrink)

Societal aging raises challenging ethical questions regarding the just distribution of health care between young and old. This article considers a proposal for age-based rationing of health care, which is based on the prudential life span account of justice between age groups. While important objections have been raised against the prudential life span account, it continues to dominate scholarly debates. This article introduces a new objection, one that develops out of the well-established disability critique of social contract theories. I show (...) the implications of this critique for the prudential life span account and for the special case of age-group justice. The result is that age-based rationing based on the prudential life span approach is not supported, and that the prudential life span approach itself is not the best way to think about allocating health care between age groups. I propose an alternative approach that avoids the disability objection, and consider its implications for specific proposals for age-based rationing of health care. (shrink)

A missed phone call. A misheard word. An inaudible noise. All these can make the difference between life and death. Failures to listen are frequently at the root of the marginalization and exclusion of certain forms of life. Audibility decides livability. Shattering Biopolitics elaborates for the first time the intimate and complex relation between life and sound in recent European philosophy, as well as the political stakes of this entanglement. Nowhere is aurality more pivotal than in the dialogue between biopolitical (...) theory and deconstruction about the power over and of life. Closer inspection of these debates reveals that the main points of contention coalesce around figures of sound and listening: inarticulate voices, meaningless sounds, resonant echoes, syncopated rhythms, animal cries, bells, and telephone rings. Shattering Biopolitics stages a series of "over-hearings" between Jacques Derrida and Giorgio Agamben who often mishear or completely miss hearing in trying to hear too much. Notions of power and life are further diffracted as Hélène Cixous, Catherine Malabou, and Jean-Luc Nancy join in this high-stakes game of telephone. This self-destructive character of aurality is akin to the chanciness and risk of death that makes life all the more alive for its incalculability. Punctuating the book are a series of excurses on sound-art projects that interrogate aurality's subordination and resistance to biopower from racialized chokeholds and anti-migrant forensic voice analysis to politicized speech acts and activist practices of listening. Shattering Biopolitics advances the burgeoning field of sound studies with a new, theoretically sophisticated analysis of the political imbrications of its object of inquiry. Above all, it is sound's capacity to shatter sovereignty, as if it were a glass made to vibrate at its natural frequency, that allows it to amplify and disseminate a power of life that refuses to be mastered. Is age discrimination ethically objectionable? One puzzle is that we sometimes assume that the target of both age discrimination and ageism must be older people, yet in poorer nations, older people are generally shown more respect. This article explores the ethical question. It looks first at ethical arguments favoring age discrimination toward younger people in low‐income, less industrialized countries of the global South, using sub‐Saharan Africa as an illustration. It contrasts these with arguments favoring age discrimination toward older people in (...) high‐income, more industrialized countries of the global North, particularly the United States and United Kingdom. Finally, it considers what role, if any, differences in life expectancy, infant and child mortality, and prospects for healthy lives should play in the moral embrace of a particular view by a community. It argues that there can be reasons to favor different types of discrimination in different parts of the world. (shrink)

An advertising firm''s ethical culture (as defined by the firm''s managerial and peer ethical behaviors) may affect the employees'' comfort levels and ethical behaviors. In this research, scenarios were used to describe advertising firms with various ethical cultures. Respondents'' perceived comfort levels in working for the firms described in the scenarios and the respondents'' behavioral intentions when faced with various advertising situations were assessed. Results of the study indicate that peer ethical behavior exerts a strong influence on the comfort or (...) discomfort level and the ethical behavioral intentions of potential advertising employees. Further, the strong influence exerted by peers seems to transcend the ethical behavior of the manager and carry over to the attitude toward the entire corporate advertising environment. This study provides insights for firms and researchers interested in assessing the impact of an advertising firm''s ethical culture on potential employees. (shrink)

This response to Richard Lennan’s presentation of Rahner’s call for a new understanding of faith raises questions about 1) the rationale behind Rahner’s “short formulas,” 2) how feminist challenges are understood, and 3) the place of “the ecclesial” in a secular milieu.

Baconian science, a tool for plundering nature, has impelled physicians to insist on medical treatment even when it is futile. The Hippocratic tradition of medicine teaches us instead to acknowledge nature's limits.

This paper explores the relationship between the bonds of practitioner/patient trust and the notion of a justified lie. The intersection of moral theories on lying which prioritize right action with institutional discretionary power allows practitioners to dismiss, or at least not take seriously enough, the harm done when a patient's trust is betrayed. Even when a lie can be shown to be justified, the trustworthiness of the practitioner may be called into question in ways that neither theories of right action (...) nor contemporary discourse in health care attends to adequately. I set out features of full trustworthiness along Aristotelian lines. (shrink)

Traditionally, a wayzgoose was a celebration at the end of a printer’s year, a night off in the late fall before the work began of printing by candlelight. According to the OED, the Master Printer would make for the journeymen “a good Feast, and not only entertains them at his own House, but besides, gives them Money to spend at the Ale-house or Tavern at Night.” Following in this line, continent. proposes in its publication(s) a night out and a good Feast, away from the noxious fumes of the Academy and into a night of revelry which begins, but does not end, at the alehouse or Tavern. continent. proposes that the thinking of the Academy be freed to be thought elsewhere, in the alleys and doorways of the village and cities, encountered not in the strictly defined spaces of the classroom and blackboard (now white) but anticipated and found where thinking occurs. Historically, academic journals have served a different purpose than the Academy itself. Journals (from the Anglo-Fr. jurnal , "a day," from O.Fr. jornel , "day, time; day's work," hence the journalist as writer of the news of the day ) have served as privileged sites for the articulation and concretization of specific modes of knowledge and control (insemination of those ideas has been formalized in the classroom, in seminar). In contrast, the academic journal is post-partum and has been an old-boys club, an insider trading network in which truths are (re)circulated against themselves, forming a Maginot Line against whatever is new, or the distinctly challenging. All in a Jurnal’s Work will discuss (in part) the ramifications of cheap start-up publications that are challenging the traditional ensconced-in-ivory academic journals and their supporting infrastructures. The panel will be seeking a questioning (as a challenging) towards the discipline of knowledge production/fabrication (of truth[s]) and the event of the Academy (and its publications) as it has evolved and continues to (d)evolve. Issues to be discussed will revolve around the power of academic publishing and its origins, hierarchical versus horizontal academic modules (is there a place for the General Assembly in academia?) and the evolving idea of the Multiversity as a site(s) of a (BABELing) multivocality in the wake of the University of Disaster. A CONTINUOUS ACT Nico Jenkins In Pierre Hadot’s extraordinary book, Philosophy as a Way of Life , the practices of philosophy—that is the exercise of what we can term pre-institionalized love of wisdom, what Philo of Alexandria described as a training towards wisdom—are described as, following the Stoics, “a continuous act, permanent and identical with life itself, which had to be renewed at each instant.” This renewal of thinking, this coming to be of being itself —meeting itself on its own ground, concerns the way philosophy is practiced, and more often, taught, or rather not taught. Hadot continues his thinking with a description of what happens to the structure of thought in the medieval ages as it becomes adopted—co-opted— by the university, and by extension, by the institution of the church. Philosophy becomes no longer a way of living, no longer a praxis as such but becomes a condition that is locked in a theoretical construct, one which was literally removed from life (and in life we read then love, wisdom, being etc, also the home, the market, the field, the street) and secured behind the high walls of the monastery (which were shortly replaced by the high walls of the Academy) where thinking unfortunately rests for the most part today. Hadot writes further that this dangerous movement of removal reduces thinking to a theoretical practice akin to the mythical Ouroborous; “education was thus no longer directed toward people who were to be educated with a view to becoming fully developed human beings, but to specialists, in order that they might learn how to train other specialists.” Thought then is trapped behind the walls of the academy, and with the exception of such thinkers as Spinoza, Descartes, and Liebnitz as well as others who think from an outside in, thought remains, in the form of Kant, Fichte, Hegel, a practice reduced or removed from life and restricted to what Schopenhauer will call “mere fencing in front of the mirror.” This is of course the tendency today and philosophy remains, for the most part, a discourse produced and thought inside the academy and disseminated, in seminated through university presses and of course the academic journal. It seems necessary to me that we have to have a place, a return, to a thinking which is closer to the Stoics, closer to the pre-Socratics, to a thinking which is a practice of becoming, a training to think, to live, to die. this is not south romantic than imperative . This thinking is one of a deep ir responsibility because it is not known, it is not figured out. It requires a risk and what Heidegger calls a leap (for there is no bridge to it). I call it irresponsible because for too long sanctioned thought has had as its premise the idea that thinking has a goal, a direction, a telos ; that it is not an activity but a process which gives a product; that the responsibility of thinking in turn demand an answer. In my mind, only freed from that goal can thinking, in contrast, bask in its own thinking, bask in a state in which the unknown can remain unknown, that mystery can rest as mystery. This is not to say that the world needs no answers, or to promote a Whitmanesque “leaning and loafing” as the only valid practice. It is only to say that for too long, thinking has been validated by the academy, by the answerable, by the already decided. To me, this requires—as an answer— the ir responsibility of thought, what Nancy calls, “a world for which all is not already done (played out, finished, enshrined in a destiny), nor entirely still to do (in the future for always future tomorrows).” This is a thinking not sanctified by the academy, made sacred by the church or the palace but rather it takes place on the périphérie , beyond the ring road, in alleyways behind the marketplace, in cafes stained with the syphilitic patina of irresponsible talk, of loose talk, the kind of talk made loose not only by the tankard and the goblet by the practice and training of attuned thinking. continent. was formed as a collective of thinkers coming out of the European Graduate School (also known as the University of Disaster) three years ago, in an effort to combat, or challenge, the dominant paradigm which isolates thinking from the street, from life, from where perhaps wisdom tends to emerge. We feel that not only is the university herself no longer the privileged site of where true thinking takes place—and where only official thought can take place—but that the very artificiality of the academy denies thinking—at times—authentic, thought. Our goal at continent. is to create a media agnostic publication which is rigorous in its intellectual underpinnings but which will remain permanently beyond and out of reach of the academy. Though many of us butter our bread with academic paychecks (maid!) we attempt to keep continent. as a refuge—and a refugee—from the University in ruins, from the University as a site of preformed and institutionalized pre-set dialogues. In concert with other publications-both cyber and print—as well as various blogs we are attempting to re-dialogize the dialogue of thinking. We are attempting both to speak to— as well as with and against —the university as a site of accreted knowledge. We have not been utterly successful and continue to attempt to define what that role of being perpetually beyond is (while still trying to maintain rigorous intellectual standards) but it is just that, a goal, which is perpetually opening, perpetually unanswered, perhaps even by design, perpetually unanswerable. The non-financial effects (NFE) antitakeover amendment addresses the duties of company directors and management when faced with a possible takeover bid. The NFE amendment either permits or requires managers to consider the interests of the company's stakeholders during takeover bids. Other types of antitakeover devices have been viewed as protecting either stockholder or management interests. The NFE amendment would appear to protect a broad spectrum of interests including those of company employees, creditors, and the community in which the company operates. (...) Positive market returns to the adoption of NFE amendments provide some evidence that investors approve. The percent of both management and institutional ownership are positively related to the market reaction to the NFE amendment adoption. To the extent that institutional ownership proxies for the broad spectrum of stakeholder interest, NFE devices, unlike some other amendments that have been studied, appear to be in the interests of more than a single interest group. Many, if not most, of our highly prized ‘laws’ of physics cannot be adequately rendered as statements of regular association among the values of ‘categorical’ quantities, I have argued.63 This is true even if we do not balk at the concept of natural necessity and are willing to add that the associations hold ‘by law’. They are rather ascriptions of capacities. They tell us what capacities a system will have by virtue of having a given property. The law of gravity (...) is one example. A system of mass M has the capacity of strength GMm/r2 to move another object of mass m a distance r away towards itself. I call this the gravitational capacity. My second thesis is a commonly shared one. Ascriptions of capacities do not reduce to conditionals involving only categorical properties. I shall here discuss two questions about these theses: 1) Why think of capacities as akin to dispositions or powers; and 2) Why allow them in science? Before tackling the first question, I shall first try to figure out what features we expect to be characteristic of dispositions and powers themselves. (shrink)

Evidence abounds of a close relation between ingestive and affective processes in rats and in humans. Emotional distress alters food intake and body weight; conversely, alterations in eating and weight influence emotional health. Thorough experimental analysis of the ingestion-affect relation may clarify the mechanisms of anxiety and depression. A strategy is proposed for examination of environmental and dispositional determinants of ingestive processes, emotionality, and responses to stress.
