Osmanlı şer‘iyye sicillerinin bir kısmı Arapça olarak tutulduğu için söz konusu dile hâkim olamayanlar pek yararlanamamaktadırlar. Arapça kayıtlardan istifade etme ve bunların tercümesi ek bir uzmanlık gerektirir. İstanbul kadı sicilleri dahil birkaç örnek dışında bu alanda pek çalışılmamıştır. Bu makalemizde, Arapça siciller üzerinde çalışacaklar için Bursa B-18 numaralı sicilden nitelikli kayıt örnekleri seçilerek günümüz Türkçesi’ne tercüme edilmiştir. Bunun yanında bir kaydın muhteva açısından hangi konuları içerdiğine de değinilmiştir. Ayrıca sicilde yer alan Arapça methiye ve lakaplar da günümüz Türkçesi’ne çevrilmiştir. (...) İslâm’ın ilk dönemlerinden itibaren Kur’ân’da Arapça dışında bir kelimenin bulunup bulunma-dığı hususunda farklı görüşler ileri sürülmüştür. Bu görüşler çerçevesinde mesele, Kur’ân’da yabancı dillerden bazı kelimelerin bulunup bulunmadığı merkezinde tartışıldığı gibi, bazı kelimelerin köken itibarıyla Arapça olmakla beraber şer’î terminolojinin ortaya çıkışı sonra-sında Arapların o zamana kadar bilmediği yeni anlamlar kazanmış olmasının Kur’ân’ın arabî olmasına engel teşkil edip etmeyeceği boyutuyla da tartışılmıştır. Şâfiî, Kur’ân’ın arabîliği görüşünün ilk ve en tavizsiz savunucularından biridir. Kur’ân, muhatapları Arap olduğu için Arapça nazil olmuştur. Her dil, (...) o dili konuşan halkın kültürünü ve düşünce yapısını da barındı-rır. Şâfiî nazarında Kur’ân’ın arabî olması Arap dilinin kurallarına, üslubuna uygun olmasının ötesinde Arap kültürünü ve düşünce yapısını da barındırması demektir. Muhataplar açısından bakınca da kendi dillerinde inen vahyin kendileri için olabildiğince açık/mübin olması gerekir. Dolayısyla Şâfiî’nin er-Risâle’de, nasslardan hüküm çıkarırken Arapçanın kural ve üsluplarını dikkate alma üzerine kurmuş olduğu beyân teorisi Kur’an’ın arabî olması ile yakından alakalı-dır. ÖZ Geçmişi insanlık tarihi kadar eski olan iyilik yapma ve sevap kazanma duygusundan doğan vakıf, İslam ile birlikte hukuksal bir zemin kazanarak ebedi bir müessese haline gelmiştir. Sosyo-kültürel ve dini hizmetleri üstlenen vakıf ya da vakfa benzer fiiller yalnızca Müslümanlar arasında değil diğer dinlere mensup insanlar arasında da yaygın şekilde görülmekteydi. Örneğin Hint devletlerinde kralların din adamı olan Brahmanlara köyler hediye ettiği görülmektedir. Brahmanlar bu köylerin mülküne sahip olmamakta, köylüler tarafından işlenen toprakların gelirini almakta ve böylece varidat sahibi olmaktaydılar. Dârülislâm’da (...) gerek Müslüman gerekse de gayrimüslim tebaa tarafından kurulan vakıflar şerʻî hukuka bağlı olarak faaliyet göstermekteydi. Osmanlı Devleti’nin üç yüz yedi yıl hüküm sürdüğü Kıbrıs Adası’nda da aynı şerʻî hükümler bağlamında çok sayıda vakfın kurulduğu görülmektedir. Osmanlı Dönemi Kıbrıs vakıfları üzerine birçok çalışma yapılmasına rağmen bunlardan yalnızca biri gayrimüslim vakıflarını konu edinmektedir. Söz konusu çalışmada ise yalnızca yedi şahıs vakfı ele alınmakta ancak kiliselere ait fetih öncesi ve sonrası vakıflarına değinilmemektedir. Bu çalışmada işaret edilen söz konusu eksiklik üzerinde durulacaktır. Genel olarak KKTC Girne Milli Arşiv ve Araştırma Dairesinde bulunan Kıbrıs Şerʻiyye Sicilleri kaynak olarak alınmakla birlikte, Osmanlı Arşivi ve Vakıflar Genel Müdürlüğü Arşivinden tespit edilen belgeler analiz edilecektir. Öncelikle gayrimüslim ve zimmî kavramları açıklanarak Kıbrıs’ta bu kategoriye giren şahıslar ve bunların hukuki haklarına değinilip İslam hukukunda gayrimüslimlerin vakıf kurma hakları üzerinde durulacaktır. The Ottoman State contains many different ethnic elements which constituted a legal perspective. In this regard, the necessary precautions were taken to ensure that Muslims and non-Muslims live together peacefully in Vidin, a border city that was very important for the Western military expeditions of the Ottoman State known as “dār al-jihad wa-l-mujāhidīn” during the 18th century which set a historical example. The economic and social dimensions of the relations between the Muslim and non-Muslim population comprising the society in Vidin (...) who have shared the same city, neighborhood and public space during 1700-1750 were examined in this study and the conflicting subjects with regard to the ongoing relations between these two communities were tried to be determined. A total of 15 shari‘aregistries kept by the qāḍī (Muslim Judge) court for the related period located at the Oriental Department of National Library of Bulgaria constitute the main resources of the study. The shari‘aregistries that are the main resources of urban historical studies are full of countless examples that provide information on the relations between Muslims and non- Muslims in Vidin. The examination of these examples is of significant importance for putting forth the methods with which the nation system is applied by the Ottoman Empire as well as their opinions towards the non-Muslims they rule.SummaryVidin, located today in northwest Bulgaria was founded during the 1stcentury BC to the right of the River Danube by the Romans and named as Bononia. This settlement which was named as V’dinby the Muslims throughout the Middle Ages was transformed into a castle about 800 years after its foundation. The city that continuously changed hands due to its location at the border fell under the Ottoman rule after Battle of Nicopolis dated 1396. Vidin became one of the important border cities of the Ottoman against Serbia, Walachia and Hungary until the beginning of the 16thcentury. This importance of Vidin gradually decreased after the Ottoman Empire conquered Belgrade, Budin and Timişoara. Vidin retrieved its status as a border city against the Hungarians and the Wallachians after the Habsburgs dominated the region following the Great Turkish Wars that took place during 1683-1699, and thus regained its past importance. Even though the pressure influenced Vidin as a result disappeared with the 1739 Treaty of Belgrade, the conflicts between Austria and the Ottoman Empire did not end completely and continued throughout the 18thcentury. Vidin preserved its status as a first-degree border city for the Ottomans during the period of time, as examined in this study, which was also known as “dār al-jihad wa-l-mujāhidīn” starting from the beginning of the new century. Majority of the settled public were comprised of military classes in Vidin due to its geographical location where the Muslims and non-Muslims lived together. While the Muslim population was higher during the period of time following the establishment of the Ottoman rule, the non-Muslim population continued to increase throughout the 17thcentury reaching 23.961 taxpayer non-Muslim men in the 18thcentury. The Ottoman Empire based its ruling in Vidin, where almost the same number of Muslim and non-Muslims lived, on the principles of Islamic Law rules for non-Muslims. Since this legal system takes into consideration religious differences, non-Muslims were not held responsible from the prayers of Muslims and the actions that were not prohibited in their religion did not pose any contradictions with regard to Islamic law. The Ottoman Empire did not apply the Islamic Law on its non-Muslim citizens living in Vidin and allowed them to continue their social and religious lives based on their own religious principles in a special legal stance. Thanks to the system applied, the Muslim and non-Muslim community in Vidin were able to continue their daily lives without serious conflicts.The main purpose of this study is to explain how the Muslim and non-Muslim population related with each other in the city of Vidin during the second half of the 18thcentury and the dynamics with which they continued these relationships. Following this purpose, the cases between Muslims and non-Muslims in court records kept by the Vidin sharia court during 1700-1750 are examined. The relations between Muslims and non-Muslims are subject to two different classifications as economic and social issues, and each topic is supported and explained as sub-titles using different case examples. Majority of the relations between Muslims and non-Muslims in the city are economic according to Vidin court records. In this regard, it seems that there is no religious discrimination between the artisan groups in the city. In addition, many home, land, store and vineyard sales took place between the Muslims and non-Muslims which were resolved in the court mostly for registration purposes. It can also be understood from the court records that there were commercial relations between the Muslims and non-Muslims, that they had partnerships and that they lent money to each other which can be seen as an example of interpersonal support. Various social relationships were also established between the Muslim and non-Muslim population in Vidin during the period examined in this study. Even though non-Muslims had the right to carry out marriages and resolve their issues at their own community courts, it was observed that they frequently applied to the sharia courts for these purposes. They have developed witnessing relationships in such cases with the Muslims. The non-Muslim community did not experience any issues in finding Muslim witnesses for their cases with the Muslims; many Muslims acted as witness against their fellow Muslims without any hesitation. Two cases of injuries and few robbery issues were reflected in the courts of Vidin between the Muslims and non-Muslims during the fifty-year period examined in the study and no incident ending with death took place. Various singular cases took place between the two groups which were resolved at the sharia courts without escalating into severe conflicts. When all court records are taken into consideration, it can be understood that the Muslim judge of Vidin did not make any distinctions between the non-Muslims and Muslims and that he did not compromise from the principle of fairness. Both the Muslims and non-Muslims managed to live comfortably by acting carefully so as to not cross their own lines in both their economic and social relations in Vidin. When the faith-related conflicts that are taking place in our day in many regions of the world despite the level of education and culture are taken into consideration, it is very meaningful that people living in Vidin during the first half of the 18thcentury managed to live in peace. Araştırma, ilahiyat fakültesi hazırlık sınıfı öğrencilerinin Arapça dersine dair görüş ve tutumlarını değerlendirmektedir. Değerlendirme sonucunda Arapça öğretiminin daha verimli olması için çözüm önerileri sunmayı ve bu suretle ilahiyat fakültelerinde Arapça öğretiminin kalitesinin iyi yönde arttırılmasına katkı sunmayı amaçlamaktadır. Araştırmanın önemi, Arapça öğrenimini daha etkili kılmak için öğrencilerin düşüncelerinden hareketle çözüm üretmesidir. Örneklem olarak Tekirdağ Namık Kemal Üniversitesi İlahiyat Fakültesi Hazırlık Sınıfı öğrencileri seçilmiştir. Araştırma verilerini toplamak için Aydoslu tarafından geliştirilen “İngilizce Dersine Yönelik Tutum Ölçeği” Arapçaya uyarlanarak kullanılmıştır. Araştırmanın bağımsız değişkenleri (...) cinsiyet, öğretim türü, mezun olunan lise türü ve Arapçaya ayrılan zamandır. 2018-2019 eğitim öğretim yılı bahar yarıyılında 166 öğrenci-nin katılımıyla toplanan veriler SPSS yazılımı kullanılarak analiz edilmiştir. Elde edilen bulgulardan hazırlık öğrencilerinin çoğunun Arapça dersine yönelik olumsuz tutumlara sahip olmadığı ancak Arapçayı zor bir dil olarak gördükleri anlaşılmaktadır. (shrink)

Court (Shar’iyya) recordings are at the forefront of primary written sources, which contain important documents related to Turkish history, sociology and culture. The court records shed light on city history of the period concerned with rich information and documents. These records are important books in which the documents related to the judicial, administrative, economic, architectural and social structure of a city as well as diplomatic correspondence between the center and the province were recorded. The purpose of this study is to (...) prepare a detailed catalog in addition to the catalog which was made in 1963 and contained only 119 books specifying only the dates covered by the book number. As we have seen in this study, all of the 119 notebooks in the records do not consist of the court registers in the known form. They are the books that include the records of court proceedings, which are different from those of the court, especially after the Tanzimat e.g. Qassam, Enkiha, Zabt al-Da’wa, Permission and so on. The microfilms of the books were presented to the service of researchers in Sivas Ziya Bey Library of Ancient Works. They are important notebooks, which are related to the judicial, administrative, economic, architectural and social structure of a city, and also in the form of diplomatic correspondence between the central and provincial posts.After the Anatolian Selçuk (Saljūq) State, which collapsed under the pressure and domination of the Iranian Mongols in the last half of the XIIIth century, a state was established in the Selçuk-Byzantine border in the north-west of Anatolia in XIVth century, which did not even lasted a hundred years and had a reign in three continents. In the Bursa inscription, which dated to 1337/8, the second Ottoman Sultan (Sulṭān) Orhan was titled as the mujahedeen (warrior), the sultan of the veterans, son of veteran of veteran. The fact that Orhan carring these titles shows that since the earliest times, the Ottoman sultans considered themselves as the leader of the religious war against the infidels. Since the first years of the establishment of the Ottoman State, the Sharīʿa ruled on the establishment of administration and for this reason, they established institution of the Shaykh al-Islām(the chief juristconsult). Firstly, by appointing a subaşı(subashi, an Ottoman gubernatorial title) to the conquered places, then it gradually began to establish judicial courts from the smallest areas.In the XVth century, the number of qāḍī increased in parallel with the increase in their jurisdiction as a result of the expansion of the Ottoman Empire, and the proliferation of the administrative units called sancak, (sanjaq, division of a province) and so the failure of oneqāḍīto satisfy court affairs of an entire sanjaq. New districts arose from some of the former large districts. As a result of this in the XVIth century, the administrative system of the sanjaq's Tımar system and at the same time a geographical integrity of the districts/provinces to see the legal work of a qāḍī to pass by the districts and sub-district as a legal caused to occur two legal definitions that is legal and military administrative. Records of qāḍīs, which is called as sicilemerged because it was their duty to record their works and orders issued to them and the answers and the provisions given to them.The courts of Shar’iyyaserved as primary general courts (maḥākim-i ʿumūmiye) until the declaration of the Tanẓīmāt in the Ottoman Empire and heard the suit at legal, criminal, administrative, military, financial and all kinds of cases. Tanẓīmāt period, or rather Maḥmūd II and the period following him, the judicial organs in terms of reorganization was a circuit that was on the scene.In this way, which was occurred in the judicial system, records which were kept in the Meşihat (Mashīkhat) began to diversify depending on this change. Since in the registry books, which we call classical, all correspondence between the central and provincial offices were recorded. Records such as pleas, letters of patent, verdicts, order of the high, bonds etc. could be found in these documents.These records, which are one of the most important sources of an Ottoman city history, were kept in the museums and libraries of the cities until recently. A few years ago, these records, with a correct decision, were collected in the Prime Ministry Ottoman Archives and it was preserved and presented to the use of researchers by transferring them into digital. The Sivas Court building as it is known in history is now in the Pāshābeg quarter and known as the Court Bazaar in these days. There is no clear information about when the court was built in Sivas. In time, changes have occurred in cities and we are losing the historical side of them. In addition, the fact that people acted in an unconscious manner that would harm the historical texture was the biggest factor in disappearance of material remains. With the remaining physical materials available, we can only access crumb information and we can only make predictions. In this evaluation, the biggest materials are the documents and notebooks, which are the memory of city dates. However, it is understood from the records that there is a foundation belonging to this court and some of the court's repair and maintenance works were carried out by this foundation. As it is understood from a document dated 14 August 1798, one of the repairs was sponsored by Ḥüseyin Efendī. In an inscription dated 1906, which was found during the renovation of the basement of an apartment building owned by the General Directorate of Foundations in May 2018, the location of the building was previously known as the Sivas Muftī 's Office.In this study, a total of 240 registry books belonging to Sivas were prepared as in a catalog system. In this study, we have seen that a great deal of records have been lost, burnt or destroyed in a certain way through history. The burn marks in the records of 79 is a striking example in this regard. The book number 139, which is not shown in Osman Ersoy's work, is a record book in classical form. An important case in this study is that the register number 206, which is registered to Sivas, belongs to the province of Burdur and it is also a registry book in classical form. This book covers the dates of 18 M. 1248/23 N.1250 - 1832-1835. (shrink)

Bu makalede, râ harfinin tefhîm/kalın ve terkîk/ince okunmasına dair hususlar son dönem Osmanlı kurrâlarından Bursalı Süleyman Vehbi’nin (öl. 1334/1916) Risâle-i Râiyye adlı eseri ekseninde ele alınmıştır. Kur’ân harflerinin seslendiriliş biçimini ifade eden fonetik farklılıklar kıraat ilminin amelî/pratik boyutunu oluşturan en önemli unsurdur. Bu minvalde Kur’ân alfabesindeki harfler genel olarak, birbirinin zıddı olan tefhîm-terkîk sıfatlarından biriyle seslendirilmektedir. Bununla birlikte lâm ve râ harfleri bazen kalın bazen de ince okunmaktadır. Lâm harfinde aslolanın terkîkle telaffuz edilmesi olup bazı durumlarda tağlîzle/tefhîmle okunduğu hususunda ittifak (...) edilmiştir. Fakat âlimler râ harfinin tefhîm veya terkîki konusunda ihtilaf etmişlerdir. Bazıları, aslı itibariyle râ harfinde tefhîm-terkîk özelliği bulunmayıp birtakım şartlar muvacehesinde bunlardan birisiyle okunduğunu söylerken; cumhur ise râ’da aslolan tefhîm olup bazı şartlar çerçevesinde terkîkle okunduğunu ileri sürmüştür. Husûsen Verş (öl. 197/812) rivâyeti ve Ezrak (öl. 240/854) tarikine göre râ harfinin tefhîm-terkîkle okunması gereken yerlerin tespiti kıraat tedrisatında zaptı en zor olan hususlardan addedilmiştir. Hâl böyle iken günümüze değin râ harfine dair kurrâ arasındaki ihtilafların tam anlamıyla açıklanıp vuzuha kavuşturulduğu -Süleyman Vehbi’nin risâlesi dışında- Türkçe bir eser kaleme alınmamıştır. Türkçe eserlerde râ’nın okunuşuna dair hususlar genelde Hafs (öl. 180/796) rivâyeti özelinde işlenmiş, Verş ve Ezrak’ın, râ harfini okuyuş keyfiyetlerine yönelik bilgilere yeterli ölçüde yer verilmemiştir. Bu bağlamda mezkûr boşluğun doldurulması, çalışmanın amaçlarından biridir. Makalenin Risâle-i Râiyye çerçevesinde ele alınmasının sebebi müellifin, Osmanlı’daki kıraat tedrisinde temel kaynak olarak kullanılan en-Neşr, İthâf, Zübdetü’l-irfân, Umdetü’l-hullân, el-Îtilâf, Bedâi‘u’l-burhân ve Mürşidü’t-talebe gibi eserlerin hemen hepsine müracaat edip konuyu sistematik bir şekilde ele alması ve yeri geldikçe mezkûr eserlerdeki hata ve eksikliklere değinmesidir. Makalede öncelikle müellifin hayatına yer verilmiş, ardından risâlede işlenen konular tavzih edilmiştir. Bu yapılırken müellifin verdiği bilgilerin aslî kaynaklardaki yeri ve râ’nın tefhîm-terkîk ile okunmasının illeti/sebebi tespit edilmeye çalışılmıştır. Ayrıca müellifin eser içerisinde hata ve eksikliklerine değindiği kaynakların ilgili yerleri tespit edilip hangi ibare ve ifadelerle tashih edilmesi gerektiğine işaret edilerek araştırmacılara kolaylık sağlanması amaçlanmıştır. Çalışma sonunda görülmüştür ki Ezrak, esreli râlar’ın terkîkinde ve kelime başlarındaki fethalı-zammeli râlar’ın tefhîminde diğer kurrâ ile müttefiktir. Ancak kelime ortasında-sonunda bulunan mansûb-meftûh râlar’ı “kelimenin aslından olan lâzımî kesreli harften sonra gelmesi”, “lâzımî kesreyle râ’nın arasında sakin bir hurûf-i isti‘lânın -hâ/خ hariç- bulunmaması” ve “râ’nın sakin yâ harfinden sonra gelmesi” durumunda sadece terkîkle; bu şartları taşımakla birlikte râ’nın tenvinli olması durumunda terkîk ve tefhîm olmak üzere iki vecihle; bu şartlardan birinin bulunmaması durumunda ise sadece tefhîmle okumuştur. Mazmûm ve merfû râlar’ı ise mansûb râlar için zikri geçen şartları taşımaları halinde Verş sadece terkîk, Ezrak ise terkîk ve tefhîm vechiyle okumuştur. Burada şunu ifade etmek gerekir ki kütüphanelerde özellikle Osmanlı dönemine ait pek çok kıraat eseri gün yüzüne çıkarılmayı beklemektedir. Söz konusu eserlerin ortaya çıkarılıp incelenmesi hem süreç içerisinde kıraat ilminin nasıl bir seyir izlediğinin tespiti hem de mezkûr eserlerin verilerinden istifade edilerek yeni çalışmaların ortaya konulması açısından önem arz etmektedir. O presente artigo pretende realizar uma aproximação entre os pressupostos do projetoepistêmico decolonial e daquele de Michel Foucault relativamente às suas análises histórico-políticas e àfilosofia como atitude crítica. Para tanto, categorias como Estado e raça deverão ser perscrutadas emambos os projetos visto que congregam conceitos e teorizações importantes sobre a modernidade, obiopoder e a colonialidade.

Este artículo pretende establecer una relación entre la frase “Dios ha muerto” y el tema de la ciencia en Nietzsche. Para tal fin, se hará un análisis de la frase “Dios ha muerto” a la luz de la reciente interpretación hecha en el mundo alemán. En segundo lugar, nos ocuparemos de los conceptos de ausencia y caos para determinar si dichas nociones pueden ser consideradas como un paso ulterior a la “muerte de Dios”. Finalmente, revisaremos el tema de la ciencia: (...) las opiniones que Nietzsche tenía de la misma, las implicaciones que se desprenden de sus obras y, sobre todo, el nexo directo de la ciencia con dicha muerte. El vínculo entre estos temas permite una nueva comprensión del futuro de las investigaciones sobre el filósofo de Röcken. This article aims to establish a relationship between the phrase “God has died” and the theme of science in Nietzsche. For this purpose, an analysis of the phrase “God has died” will be made in the light of the recent interpretation made in the German world. Secondly, we will deal with the concepts of absence and chaos to determine if these notions can be considered as a further step to the “death of God”. Finally, we will review the subject of science: Nietzsche's views on it, the implications that stem from its works and, above all, the direct nexus of science with that death. The link between these themes leads to a new understanding of the future of research on the philosophy of Röcken. (shrink)

RESUMEN El presente artículo pretende ofrecer un breve recorrido por algunos aspectos del pensamiento filosófico y teológico de Abraham Heschel, un rabino polaco del siglo XX, conocido por ser asesor y maestro espiritual de Luther King. El texto inicia presentando algunos aspectos biográficos y contextuales de la vida de Heschel. Luego de ello se aluden las pautas centrales de su crítica a la religión, resaltando la intención auténtica de la misma y mostrando los peligros de separarla de la razón. Se (...) denuncia la simulación de Dios en las religiones y el daño social que estas ocasionan cuando no favorecen la autocrítica y eluden su colaboración en el desarrollo social. ABSTRACT This article aims to provide a brief summary of some aspects of the philosophical and theological thought of Abraham Heschel, a Polish rabbi of the 20th century, known for being an advisor and spiritual teacher to Luther King. The text begins with some biographical and contextual aspects of Heschel's life. After that, the central guidelines of Heschel's critique of religion are alluded to, highlighting the authentic intention of religion and showing the dangers of separating it from reason. The simulation of God in religions and the social damage that these cause when they do not favor self-criticism and avoid their collaboration in social development are denounced. (shrink)

Kâdirî tarikatının kurucusu olarak bilinen Abdülkâdir Geylânî’ye nispet edilen Arapça pek çok kaside bulunmaktadır. Bu kasidelerden biri, bu çalışmaya konu edilen Kasîdetü’t-Tâ’iyye’dir. Geylânî, Allah’ın kendisine lütfettiği nimetleri anlatıp O’na şükrünü dile getirdiği beyitlerde şatahat olarak tabir edilen ifadelere yer vermiştir. Kendisinden istigâsede bulunanlara yardımda bulunulacağına dair bir havassı da bulunan mezkûr kasidenin Türkçe tercüme ve şerhleri yapılmıştır. Bu çalışmada, Geylânî’nin Kasîdetü’t-Tâ’iyye’sine yapılan Şerh-i Kasîdetü’t-Tâ’iyye başlıklı şârihini tespit edemediğimiz Türkçe şerh incelenmiştir. Çalışmanın giriş bölümünde Geylânî’nin hayatı ve mezkûr kasidenin türü olan (...) şathiye hakkında temel bilgiler sathî olarak verilmiştir. İnceleme bölümünde ise Geylânî’nin Kasîdetü’t-Tâ’iyye’si tanıtılmış ve tetkik edilen şerhle ilgili bilgilere yer verilmiştir. Çalışmanın neticesinde ise tespit edilen üç nüshanın karşılaştırılmasıyla şerhin transkripsiyonlu metni hazırlanmıştır. Bu çalışma, tasavvufî şiir şerhleri literatürüne katkı açısından önem arz etmektedir. (shrink)

Bu makalede Marmara Denizi’nin Kuzeybatısında yer alan Rodosçuk/Tekirdağ kazasında yaşayan halkın beslenme kültürü ele alınmıştır. Hangi ürünlerin yaygın olarak tüketildiğini belirlemek için başvurulan temel kaynak narh defterleridir. Bilindiği üzere narh, mal ve hizmet fiyatlarının esnaf örgütlerinin görüşü alınarak devlet tarafından belirlenen üst sınırını ifade etmektedir. Piyasada bulunan malların listelerini barındırdığı için ayrı bir önem taşıyan narh defterleri ilgili kazaya ait şer’iyye sicillerinde yer almaktadır. 1638-1730 yıllarına ait narh listelerinde bulunan ürünler türlerine göre sınıflandırılarak başlıklar halinde değerlendirilmiştir. Bu araştırmada ayrıca narh (...) defterlerine yansıdığı kadarıyla Rodosçuk piyasasında bulunan yiyecek maddelerinin çeşitliliği, yakınlığı nedeniyle özellikle İstanbul’da ve Saray’da tüketilen ürünlerle karşılaştırılarak zaman içinde meydan gelen değişimler belirlenmiş ve incelenen dönemin başından sonuna kadar önemli bir dönüşümün yaşanmadığı ortaya çıkmıştır. Varılan sonuçlardan bir diğeri de Amerikan menşeli yiyeceklerin henüz Rodosçuk’ta sahneye çıkmamış olmasıdır. (shrink)

Bayʿ al-wafā is a fatwa issue (waqıʿat/nawazil) in the form of a legal solu-tion (hīla al sharʿiyyah), the legal nature of which was intensely debated by Central Asian Hanafi jurists. This contract appears to be a practice by which Muslim communities living in Central Asia, particularly in Bukhara and Samarkand, were able to conduct their debt relations without involving interest. The initial assessments regarding the legal nature of bayʿ al-wafā, for which there is no transmission from the founding imams, emerged (...) in the fatwas of Central Asian Hanafi scholars in the 4th/10th century. Subsequently, from this century, when the first examples of fatwa literature were penned, to the 6th/12th century, when the most advanced and influential examples were produced, there were many different opinions on the legal nature of this contract according to the Hanafī doctrine. In this study, based on the fatwa literature that emerged between these centuries, the chronological development of opinions on the legal nature of the bayʿ al-wafâ contract has been examined. Furthermore, this study also addresses the fundamental trends that have led to different assessments on the subject and identifies the subordinate and opposing views concerning it. (shrink)

Kur’ân-ı Kerîm lafızlarının eda keyfiyetlerini ihtiva eden kıraatler İslâmî ilimlerin birçoğunun önemli mevzuları arasında yer almaktadır. Özellikle tefsir ilminin temel konularından olan kıraatler söz konusu ilmin sembol şahsiyetlerinden olan Zemahşerî’nin (öl. 538/1144) tefsirinde de kayda değer bir yer işgal etmektedir. el-Keşşâf tefsirinde kıraat ihtilaflarına sıkça müracaat eden Zemahşerî’nin kıraatler konusundaki yaklaşımı kendisinden sonraki müfessirleri de etkilemesi yönüyle önem arz etmektedir. O, ele aldığı kıraatlerin bazen hüccet bazen de nispet yönüne temas etmektedir. Kıraatlere daha çok lügavî açıdan yaklaşan Zemahşerî, ilgili kıraatlerin (...) özellikle dilde hüccetliği üzerinde durmaktadır. Bununla birlikte çoğu zaman bahse konu ettiği telaffuzla okuyan isimleri zikretmeyi de ihmal etmemektedir. Onun zikrettikleri arasında sahih kıraat sahibi imamlar (kıraat-i aşere imamları), şâz kıraat imamları ve seleften kıraati ile meşhur şahıslar yer almaktadır. Müfessirin bu tavrı onun meseleye vukûfiyetini de ortaya koymaktadır. el-Keşşâf’ta sahih kıraatlerin yanında birçok şâz kıraate de yer verilmektedir. Müfessir zaman zaman -sahih olsun şâz olsun- bazı telaffuzların naklî temeline de inmekte, ilgili telaffuzu tâbiîne, sahabeye hatta Hz. Peygamber’e nispet etmektedir. Ancak bu nispet esnasında bir sorun göze çarpmaktadır. O da söz konusu telaffuz şekillerinin sıhhati meselesidir. Zira bir kıraatin sahih olabilmesi için onun kıraatçiler nezdinde makbul bir senetle gelmesi, Arapça’ya ve Hz. Osman tarafından yazdırılan mushaflardan birinin imlasına uygun olması gerekmektedir. Müfessir birçok yerde sadece “Hz. Peygamber’in kıraati bu şekildedir.” gibi kesin ve net ifadeler kullanmakta, ele aldığı telaffuz şekli hakkında bir değerlendirme ya da bir kaynağa atıfta bulunma ihtiyacı hissetmemektedir. Mevzubahis tefsirde Hz. Peygamber’in okuduğu söylenen şâz kıraatler Yazma Eserler Kurumu (YEK) tarafından neşredilen Keşşâf Tefsiri mütercimlerinin de dikkatini çekmiş, konuyu değerlendirdikleri “el-Keşşâf’ta Kıraatler” başlığı altında şu cümleye yer vermişlerdir: “Bunların en ilginci herhalde Hz. Peygamber’e nispet edilen -fakat mütevâtir kıraatlerde yer almayan- kıraatlerdir.” Bu tespit, el-Keşşâf’ta yer alan bu kıraatlerin derinlemesine incelenmesini gerekli kılmaktadır. Ancak önemine rağmen ilgili konuda yapılmış bir çalışmaya rastlanılmamıştır. Bu çalışmada el-Keşşâf tefsirinde Hz. Peygamber’e nispet edilen kıraatlerin tespit, teyit ve tenkidi hedeflenmektedir. Öncelikle eserde bahsedilen bu kıraatlerin sayısı, kaynak ve isnatları tespit edilmiş, daha sonra bunların kıraat imamları arasında ne şekilde karşılık bulduğu ortaya konulmuştur. Tespitlerimize göre Zemahşerî bir kıraatin Hz. Peygamber’e nispetine özel bir önem vermemekte, rivayet ve kıraatin sıhhat ve şöhretine bakmamaktadır. Onun bu yaklaşımı hadisçiler nezdinde de kıraatçiler nezdinde de kabul görmemiştir. (shrink)

Kur’ân-ı Kerîm kelimelerinin yazım özelliklerini inceleyen ilim dalına resm-i mushaf /resm-i Osmânî adı verilmektedir. Bu ilme, Hz. Osman’ın (ö. 35/656) halifelik devrinde (644-656), dönemin fasih Arapça kaidelerine göre yazım esas alınmak sûretiyle gerçekleştirilen mushaf istinsah faaliyeti kaynaklık etmektedir. Sahabe eliyle gerçekleştirilen bu çalışmada kullanılan imlanın, sonraki dönemlerde yazılan mushaflarda esas alındığı kabul edilmektedir. Bugün Hz. Osman himayesinde imla edildiği kesin olarak bilinen bir mushaf mevcut değildir. Bu yüzden Hz. Osman mushaflarındaki yazım şekillerine ait detaylar ancak hicrî 3-4. asırlarda telif edilmeye (...) başlanan eserlerden öğrenilebilmekte, resm-i mushaf kriterleri mezkûr kaynaklar baz alınarak belirlenmektedir. Lakin mushaf istinsahı faaliyetinden 3 asırdan daha fazla bir süre sonra kaleme alınan eserlerde verilen bilgilerin yeterliliği/sıhhati konusunda birtakım tereddütlerin varlığı malumdur. Mezkûr tereddütlerin izale edilmesine katkı sunma maksadıyla hazırlanan bu makalede, alanın temel eserlerinde yer alan resm-i Osmânî kaideleri bağlamında Topkapı Sarayı Müzesi/Emanetler Hazinesi 2 nr. Mushaf incelenmektedir. Erken dönemlere ait olduğunda şüphe bulunmayan Mushaf’ın, Hz. Ali’ye (ö. 40/661) tarafından yazıldığı iddia edilmektedir. Mevcut çalışma sayısı bakımından oldukça yeni bir alanda yapılan bu araştırmada, hicretten birkaç asır sonra telif edilen eserler vasıtasıyla ulaşılabilen kaideler ile erken dönemlerde yazılmış TMSK E. H. 2 nr. Mushaf’ın imlası kıyaslanmak sûretiyle, kaidelerin o dönemde ne derece uygulandığını tespite çalışılmıştır. İki bölümden müteşekkil makalenin ilk kısmında, Mushaf’a dair tanıtıcı ve teknik mahiyetteki bilgilere yer verilmiş, Mushaf’ın Hz. Ali’ye nispeti tetkik edilmiştir. Mushaf’ın erken dönemde imla edildiği ancak Hz. Ali tarafından yazılmasının mümkün olmadığı kanaatine yer verilmiştir. İkinci kısımda, ilgili eserlerde “hazf, ispat, ibdal, maktu‘/mevsûl yazım, hemze, Mesâhif-i Emsâr’ın gönderildiği beldelere göre farklılık arz eden yazım farklılıkları” şeklindeki konu başlıkları altında yer verilen toplam 1406 kelimenin yazım özelliğiyle TMSK E.H. 2 nr. Mushaf’ın yazımı mukayese edilmiştir. Sayfa, âyet noksanlığı bakımından neredeyse kusursuz nitelikteki bu Mushaf’ın tamamında yapılan inceleme sonucunda toplam 319 kelimede kaidelere muhalif yazım olduğu tespit edilmiştir. Üzerine inceleme yapılan tüm kadim Mushaflarda da görülen bu imla uyumsuzluğu, resm-i mushaf kaidelerinin sıhhatine dair mevcut soru işaretlerini kuvvetlendirmektedir. Bu da resm-i mushaf ilminin sınırlarını tespit için kadim mushafların imlasının da dikkate alınması gerektiğine, bunun için de erken dönemde yazılmış mushafların yazım şekilleri üzerine daha fazla araştırma yapmanın gerekliliğine işaret olarak kabul edilmelidir. In this article are mentioned the educational history, institutions and activities of the Mountain Jews living in Azerbaijan in private religious schools and state schools in the period after the independence of the Tsarist Russia, the Soviet Union and Azerbaijan. In addition mentioned, the Religious Education Centers whic established by the Mountain Jews by their communities in the 19th century Tsarist Russia and the secular schools of the state. In the religious schools called Talmudhuna and Nobuhunde, mostly male students were (...) educated by rabbi, reznik and religious teachers. With the opening of modern style schools, Mountain Jewish children in many regions of Tsarist Russia started to enroll in these schools. While mostly male students were enrolled in these schools, girls received religious and traditional education in their families. During the Soviet Union, Religious Education Centers were completely closed, only public schools continued education. Enrollment and attendance at schools has been made compulsory. Mountain Jewish children continued their education in public schools like the children of other nations. After Azerbaijan gained its independence, Mountain Jews continued to receive education in public schools and gained the right to open their own religious education institutions. In this new period, Mountain Jews expanded their opportunities by opening new educational institutions, especially in Baku and Quba cities, with the support of the Azerbaijan State and the help of their coreligionists in other countries. Mountain Jewish children in these cities receive education in both public and private religious schools. (shrink)

Monetary intelligence theory asserts that individuals apply their money attitude to frame critical concerns in the context and strategically select certain options to achieve financial goals and ultimate happiness. This study explores the dark side of monetary Intelligence and behavioral economics—dishonesty. Dishonesty, a risky prospect, involves cost–benefit analysis of self-interest. We frame good or bad barrels in the environmental context as a proxy of high or low probability of getting caught for dishonesty, respectively. We theorize: The magnitude and intensity of (...) the relationship between love of money and dishonest prospect may reveal how individuals frame dishonesty in the context of two levels of subjective norm—perceived corporate ethical values at the micro-level and Corruption Perceptions Index at the macro-level, collected from multiple sources. Based on 6382 managers in 31 geopolitical entities across six continents, our cross-level three-way interaction effect illustrates: As expected, managers in good barrels, mixed barrels, and bad barrels display low, medium, and high magnitude of dishonesty, respectively. With high CEV, the intensity is the same across cultures. With low CEV, the intensity of dishonesty is the highest in high CPI entities —the Enron Effect, but the lowest in low CPI entities. CPI has a strong impact on the magnitude of dishonesty, whereas CEV has a strong impact on the intensity of dishonesty. We demonstrate dishonesty in light of monetary values and two frames of social norm, revealing critical implications to the field of behavioral economics and business ethics. (shrink)

Personal health technologies such as apps and wearables that generate health and behavior data close to the individual patient are envisioned to enable personalized healthcare - and self-care. And yet, they are consumer devices. Proponents of these devices presuppose that measuring will be helpful, and that data will be meaningful. However, a growing body of research suggests that self-tracking data does not necessarily make sense to users. Drawing together data studies and digital health research, we aim to further research on (...) data ambivalence, a term we use to refer to the ambiguities and uncertainties people experience when interpreting their own data, as well as the critical obligation towards cultivating ethically sound uses and responses to such data in context. We develop the relationship between data, interpretation, and context as a central theoretical and practical problem in the datafication of healthcare. We then show how interpretation and context matter for data ambivalence through an empirical study of heart patients with an implanted advanced pacemaker who were offered a Fitbit wristband for self-tracking as part of a research project. We argue that the hope, anxiety, and doubt connected to the promise and accuracy of data are tempered by the context and purpose of self-tracking, and by individual circumstances. Finally, we link the findings on context-sensitivity in data interpretation to questions about response-ability in cloud-based care infrastructures. We discuss the ethical dilemmas associated with the use of commercial wellness-technologies in healthcare, and with researching such emerging practices. (shrink)

Corruption involves greed, money, and risky decision-making. We explore the love of money, pay satisfaction, probability of risk, and dishonesty across cultures. Avaricious monetary aspiration breeds unethicality. Prospect theory frames decisions in the gains-losses domain and high-low probability. Pay dissatisfaction (in the losses domain) incites dishonesty in the name of justice at the individual level. The Corruption Perceptions Index, CPI, signals a high-low probability of getting caught for dishonesty at the country level. We theorize that decision-makers adopt avaricious love-of-money aspiration (...) as a lens and frame dishonesty in the gains-losses domain (pay satisfaction-dissatisfaction, Level 1) and high-low probability (CPI, Level 2) to maximize expected utility and ultimate serenity. We challenge the myth: Pay satisfaction mitigates dishonesty across nations consistently. Based on 6500 managers in 32 countries, our cross-level three-dimensional visualization offers the following discoveries. Under high aspiration conditions, pay dissatisfaction excites the highest- (third-highest) avaricious justice-seeking dishonesty in high (medium) CPI nations, supporting the certainty effect. However, pay satisfaction provokes the second-highest avaricious opportunity-seizing dishonesty in low CPI entities, sustaining the possibility effect—maximizing expected utility. Under low aspiration conditions, high pay satisfaction consistently leads to low dishonesty, demonstrating risk aversion—achieving ultimate serenity. We expand prospect theory from a micro and individual-level theory to a cross-level theory of monetary wisdom across 32 nations. We enhance the S-shaped Curve to three 3-D corruption surfaces across three levels of the global economic pyramid, providing novel insights into behavioral economics, business ethics, the environment, and responsibility. We theorize: Managers with low love of money motive but high stewardship behavior will have high subjective well-being: pay satisfaction and (...) quality of life. Data collected from 6586 managers in 32 cultures across six continents support our theory. Interestingly, GDP per capita is related to life satisfaction, but not to pay satisfaction. Individual income is related to both life and pay satisfaction. Neither GDP nor income is related to Happiness. Our theoretical model across three GDP groups offers new discoveries: In high GDP entities, “high income” not only reduces aspirations—“Rich, Motivator, and Power,” but also promotes stewardship behavior—“Budget, Give/Donate, and Contribute” and appreciation of “Achievement.” After controlling income, we demonstrate the bright side of Monetary Intelligence: Low love of money motive but high stewardship behavior define Monetary Intelligence. “Good apples enjoy good quality of life in good barrels.” This notion adds another explanation to managers’ low magnitude of dishonesty in entities with high Corruption Perceptions Index. In low GDP entities, high income is related to poor Budgeting skills and escalated Happiness. These managers experience equal satisfaction with pay and life. We add a new vocabulary to the conversation of monetary intelligence, income, GDP, happiness, subjective well-being, good and bad apples and barrels, corruption, and behavioral ethics. (shrink)

In most countries where Islam is acknowledged as a, or the, source of legislation, abortion is permitted under certain conditions and at certain stages of pregnancy. This article examines some of these laws and argue that they represent a continuation of the logic that governed the views of pre-modern Muslim jurists on abortion, that is, harm aversion. However, these laws also add a ‘modernist’ twist to that logic – rather than repealing that logic altogether, modernist views on ‘rights’ and the (...) advancement of medical knowledge and technology have influenced the priorities of Muslim jurists and lawmakers as far as abortion and the issues associated with it are concerned. This influence has furthermore been possible by a conscious selection and blending of pre-modern views to serve modern concerns. In all this, however, harm aversion remains the centrifugal principle, even when the abortion discourse in Muslim countries appears couched in the modernist discourse of rights. (shrink)

El pensador suizo Andreas Urs Sommer es, sin dudarlo, uno de los actuales especialistas de Nietzsche. En el año 2017 publica un texto titulado Nietzsche und die Folgen, un libro que recobra la figura del pensador alemán a la luz de ideas bastantes novedosas que hasta ahora no habían sido presentadas por la mayoría de los intérpretes de Nietzsche. En ese sentido, la filosofía experimental (Experimentalphilosophie) que presenta Sommer es la que ha llamado la atención de la crítica. Se trataría (...) de esconder bajo el juego experimental la filosofía de Nietzsche, omitiendo de ese modo un cierto tipo de compromiso de sus postulados filosóficos. Esta determinación está cobrando fuerza en la medida en que nos muestra las consecuencias de la filosofía experimental. Este trabajo pretende desarrollar, por un lado, los postulados centrales de la propuesta de Sommer para luego confrontarlos a la luz de la crítica y en qué medida dicha crítica es medular. Lo anterior da luces a una discusión que, más que inclinarse a la polémica, muestra el nutriente de una fructífera investigación. -/- The Swiss thinker Andreas Urs Sommer is, undoubtedly, one of Nietzsche’s current specialists. In the year of 2017 publishes a text entitled Nietzsche und die Folgen, a book that recovers the figure of the German thinker in the light of quite novel ideas that until now had not been presented by most of the interpreters of Nietzsche. In that sense, the experimental philosophy (Experimentalphilosophie) presented by Sommer is the one that has caught the attention of critics. It would be a matter of hiding Nietzsche’s philosophy under the experimental game, thus omitting a certain type of commitment from his philosophical postulates. This determination is gaining strength insofar as it shows us the consequences of experimental philosophy. This work aims to develop, on the one hand, the central postulates of Sommer’s proposal and then confront them in the light of criticism and to what extent such criticism is central. The foregoing gives light of a discussion that more than leaning to the controversy shows the nutrient of a fruitful investigation. (shrink)

Contemporary Islamic management scholars have agreed that values are embedded in quality management. Their agreement is grounded on the famous prophetic tradition encouraging diligence in work, uttered more than 1400 years ago, which has been narrated authentically. However, little studies have specifically indicated its application in quality management activities. As quality management is initiated in the West, little attention has been given to Islamic perspective of the discipline. However, as the Japanese had successfully implemented quality management in their cultural value (...) perspective, many parties come to acknowledge the significance of values. In the literature, various Islamic values have been linked to quality management practice. While studies analyzing and categorizing them is limited, several values are redundant or being termed differently, though they are similar in crux. This article compiles the values and categorizes them depending on similar bases of Quranic verses or Prophetic traditions. The categorization proposes a set of Islamic values related to quality management practice, based on a simple frequency analysis matrix. In three experiments, we show that the task that is performed consciously can also be applied unconsciously to items outside the current task set. We found that a same–different judgment of two target stimuli was also performed on two subliminally presented prime stimuli. This was (...) true for target and prime stimuli from entirely different categories, as well as for prime and target stimuli at different levels of abstraction. Neutrosophy, the study of neutralities, is a new branch of Philosophy that has applications in many different fields of science. Inspired by the idea of Neutrosophy, Smarandache introduced NeutroAlgebraicStructures (or NeutroAlgebras) by allowing the partiality and indeterminacy to be included in the structures’ operations and/or axioms.

We investigated the ethical behavior of Turkish university students to compare the difference in ethical behavior between business students and non-business students, examine the impact of key contingency variables on how they make decisions when confronted with an ethical dilemma, and investigate the process underlying the ethical behavior of Turkish students. Data were collected from business students at a major private university in Western Turkey. The results indicate that a Turkish student’s peers, marital status, and education level exert a significant (...) effect on their ethical behavior. Further, business students specifically differed from non-business students in their enhanced use of egoism when confronted with an ethical dilemma. The results of this research may have important educational policy implications for business ethics in Turkey. (shrink)
