Despite the rapidly growing literature on realism, there’s little discussion of the ideology critique of John Rawls offered by one of its leading lights, Raymond Geuss. There is little understanding of what (most of) this critique consists in and few discussions of how Rawls’ approach to political theorising may be defended against it. To remedy this situation, this article reconstructs the realist ideology critique of Rawls advanced by Raymond Geuss, which has three prongs: (1) Rawls’ political theory offers insufficient tools (...) to uncover and address distortions of our political values, beliefs, and intuitions; (2) it unacceptably reinforces these distortions by unduly legitimating them; and (3) it diverts attention from important features of real politics. With this done, I finish by considering how Rawlsians can respond, chiefly by employing a kind of reflective equilibrium, or reflective endorsement, broad enough to encompass different forms of genealogy and ideology critique. Is realism in political theory compatible with utopianism? This article shows that it is, by reconstructing a highly restrictive realist approach to political theory for guiding legislation and public policy, drawn from the work of Adam Smith, and showing how it can accommodate Piketty’s utopian proposal for a global tax on capital. This shows not only that realism and utopianism are compatible; but how realist and utopian political theory can be carried out in concrete cases. This moves debates to more (...) interesting questions of which forms of utopianism are permissible within which forms of realism; contributes to moving the contemporary realism debates from a Methodenstreit to questions of how it can and ought to be done; and contributes to an important contemporary debate about the permissibility of utopian proposals for political and economic reform in general and Piketty’s proposed global tax on capital in particular. One of the more debated topics in the recent realist literature concerns the compatibility of realism and utopianism. Perhaps the greatest challenge to utopian political thought comes from Bernard Williams' realism, which argues, among other things, that political values should be subject to what he calls the ‘realism constraint’, which rules out utopian arguments based on values which cannot be offered by the state as unrealistic and therefore inadmissible. This article challenges that conclusion in two ways. First, it argues that (...) the rationale for accepting Williams' original argument for the ‘realism constraint’ fails. Secondly, it argues that there is at least one genuinely political value of liberty available which is both compatible with realism and something that cannot be offered by the state, namely that of the political anarchist. This opens the way for far more ambitious and utopian forms of realist political thought and implies that the arguments of what we call political anarchists must be met by political argumentation, not simply ruled out by methodological stipulation. Review of Elizabeth Anderson Private Government: How Employers Rule Our Lives. Princeton: Princeton University Press, 196 pp.

There is long-standing disagreement about how radical Adam Smith should be taken to be. Recently, Jonathan Israel’s work on the enlightenment situates Smith as a moderate enlightenment thinker. This article challenges that assessment. Smith sees aristocrats as largely devoid of competence, wisdom, and virtue and thinks they do not wield significant political power in commercial societies. He is also highly critical of their economic power; and uses a neo-Roman concept of liberty to provide a powerful critique of slavery and feudalism. (...) In so doing, he extends discussions of liberty and focuses them on economic relations in ways that prefigure labour republicanism. Finally, I show how these more radical commitments can be reconciled with his moderate proposals for political reform through his epistemology and realist anti-utopianism. These are aspects of Smith’s thought that are essential for understanding it correctly and have much to teach us today. (shrink)

Marx's theory of alienation is of great importance to contemporary political developments, due both to the re-emergence of anti-capitalist struggle in Zapatismo, 21st Century Socialism, and the New Democracy Movement, and to the fact that the most important theorists of these movements single out Marx's theory of alienation as critical to their concerns. Despite this renewed practical and theoretical interest, however, these and other writers have been sparing in their accounts of the normative components which the theory of alienation incorporates. Along with many recent commentators, I argue that the normative components of the theory of alienation are to be found in a notion of human development, and that a conception of the particular importance of the human species-essence plays a critical role in this respect. What should a free economic system look like? Socialists have long held that a universal human emancipation requires replacing capitalism with socialism. However, it has recently been argued that Property‐Owning Democracy (POD) safeguards freedom while allowing us to keep key features of capitalism. I challenge that claim by showing that the institutional features that make capitalist workplaces unfree are shared with POD. As a result, POD is insufficient for a free economic system. Digital platforms and application software have changed how people work in a range of industries. Empirical studies of the gig economy have raised concerns about new systems of algorithmic management exercised over workers and how these alter the structural conditions of their work. Drawing on the republican literature, we offer a theoretical account of algorithmic domination and a framework for understanding how it can be applied to ride hail and food delivery services in the on-demand economy. We argue that certain (...) algorithms can facilitate new relationships of domination by sustaining a socio-technical system in which the owners and managers of a company dominate workers. This analysis has implications for the growing use of algorithms throughout the gig economy and broader labor market. (shrink)

This book discusses some of the most challenging ideas emerging out of the research program on institutional diversity associated with the 2009 co-recipient of 2009 Nobel Prize in economics, Elinor Ostrom, while outlining a set of new research directions and an original interpretation of the significance and future of this program.

In their highly topical paper, Grahamet alargued that Trusted Research Environments (TREs) are not actually about trust because they reduce or remove ‘…the need for trust in the use and sharing of patient health data’. We believe this is fundamentally mistaken. TREs mitigate or remove some risks, but they do not address all public concerns. In this regard, TREs provide evidence for people to decide whether the bodies holding and using their data can be trusted. TREs may make it easier (...) for people to trust but there is still a need for that trust. (shrink)

The historical emphasis of medical ethics, based on substantive frameworks and principles derived from them, is no longer seen as sufficiently sensitive to the moral pluralism characteristic of our current era. We argue that moral decision-making in clinical situations is more properly derived from a process of dialogic consensus. This process entails an inclusive, noncoercive, and self-reflective dialogue within the community affected. In order to justify this approach, we make two claims—the first epistemic, and the second normative. The epistemic claim (...) follows from Habermas’ “ways” of knowing. We argue that the dialogue emanating from this episteme focuses on the relevant facts about the patient, as well as on the values attached to these facts, thus allowing facts and their meanings to serve as the basis for reflective action appropriate to the circumstances. The normative claim follows from Habermas’ discourse theory of morality and communicative action. It determines that clinical decision-making should be approached from the perspective of the actual reality of people in their situation of illness, set in their socio-cultural background, and hence be grounded in the second-person perspective. Relocating ethical decision-making from a monological space into one characterized by dialogue is especially appropriate to the clinical encounter. (shrink)

In 1990, the Federal Trade Commission (FTC) issued a consent order to the American Institute of Certified Public Accountants (AICPA). The order decreed the AICPA to lessen its longstanding ethics code which had until then banned the receipts of commissions, referral fees and contingent fees. The FTC alleged that the AICPA banned receipt of the fees as an attempt to restrain trade (FTC, 1990).In the present study, we sought to determine if CPAs'' preference for bans on commissions, referral fees and (...) contingent fees is related to their moral reasoning whereby CPAs perceive the bans to serve as a means of resolving ethical issues. While determining this matter cannot prove whether the bans did or did not actually result in restrained trade, it can offer insight into the perceived ethical importance to CPAs of the overturned rules. Based on a random sample of AICPA members and using Rest''s Defining Issues Test (DIT) to measure moral reasoning, we did not find a CPA''s moral reasoning to be related to his/her preference for ethics rules which ban commissions, referral fees or contingent fees. However, our results did indicate that most CPAs prefer banning commissions, referral fees and contingent fees, with those CPAs holding a higher financial stake in public accounting, namely partners, favoring banning referral fees and contingent fees significantly less than CPAs with a lesser stake. Further, we noted a significant negative relationship between financial stake and moral reasoning. These results seem to suggest that self-interest among CPAs may influence their moral reasoning.Further study is needed to examine the relationship between self-interest of CPAs and their moral reasoning. If self-interest clouds moral judgments made by CPAs, capital markets are in danger. Rendering an independent audit opinion must exclude self-interest. (shrink)

This article offers three reflections on the nature of the metaphysical ‘wall’ erected between the ‘Included’ and the ‘Excluded/Other’ by the concept of private property and its implementation in a state’s legal apparatus. The first reflection explores the reality of the concept of private property, using Louis Althusser’s conception of ideology, in order to demonstrate that the liberal conception of private property masks power operating on two levels: the formal, repressive state apparatus, and the deeper, the personal, the real, the (...) actual level, which allows the Included to act upon ego in ways that negatively affect the Excluded/Other found in the ideological state apparatus. The second argues that the masked power that is private property permits war to be waged by the Included as against the Excluded/Other at two levels: intra-state and inter-state. This reveals a paradox in the distinction between Included and Excluded/Other: while the distinction demonstrates the allocation of power over resources, the reality is that every individual on earth is both Included and Excluded/Other. The final reflection briefly considers what could replace private property as a means of allocating goods and resources within a society. (shrink)

Why, then, do we huddle in the dark around the campfires of our flickering narratives? There are obviously many different reasons for doing so. Yet, having heard various récits—whether "stories" or "accounts"—during the narrative conference, I am more inclined than ever to see self-assertive entertainment and self-transcending commitment as two kinds of ultimate motivation for our countless narratives. Stories and histories and other narrative or descriptive accounts help us to escape boredom and indifference—ours as well as that of other people. (...) Those nearly vacant states of mind at the zero degree of entertainment and commitment bring us frightfully close to the experience of nonexistence. Hence our desire to replace boredom by thrilling or gratifying entertainment and to replace indifference by the social or cosmic commitment either to change the world or to change ourselves. In a world of unmixed colors and pure literary genres, tragedy, comedy, satire, and romance might answer distinct needs for thrill, gratification, indignation, and admiration. But, as Roy Schafer and Victor Turner have reminded us, the private and social dramas underlying psychoanalytical and anthropological accounts are even less pure than most works of literature. Couldn't we conclude that life's internal and external dramas stem from a compound desire for self-assertion and self-transcendence—a desire which, in the realm of literary entertainment and commitment, motivates the emergence and appreciation of tragicomedy? The Essential Herman Kahn offers the public for the first time an anthology consisting of the best of Herman Kahn's work. It brings together, out of the several thousands of pages published in his life, the "essential Kahn"—the most relevant, consequential, and interesting themes, ideas, and arguments of his work in areas such as international relations, public policy, environmentalism, strategic thinking, and futurology.

It has been disputed whether an externalist conception of the individuation of intentional states, such as beliefs and desires, is compatible with self-knowledge, that is, the claim that one's judgments about one's intentional states are non-evidential, non-inferential, and authoritative. I want to argue that these theses are indeed incompatible, notwithstanding an important objection to this incompatibility claim. The worry has been raised that if externalism is true, then for a subject to know, say, that he or she believes that p, (...) the subject would need to know, on the basis of some evidence, the external conditions which determine the belief's content. Thus, externalism would be incompatible with self-knowledge. But many philosophers have accepted an objection suggesting that this worry is mistaken because in order to have a belief one need not know the metaphysical conditions determining its content, even if they are externalist. And thus, the subject's reflexive judgment about the belief would not need to rest on evidence about those external conditions. But this objection rests on a crucial assumption according to which mental content is reflexively transparent in the sense that a subject could not judge that she or he has an intentional state and be mistaken about the content of her or his state, even if the content is externally determined. My main purpose is not reflexively transparent on the assumption of externalism and, thus, self-knowledge and externalism are incompatible. (shrink)

It discusses the incomplete project of modernity in terms of social contract theory, racial justice issues, and political theology in the postcolonial context. Hermeneutical realism and cultural linguistic inquiry become substantial features in elaborating postcolonial political theology and its ethical stance against the colonization of lifeworld and its pathologies. A study of critical theory and political theology is of a reconstructive character (...) in seeking to relocate critical theory and political ethics in the context of alternative modernities at the level of postcolonial theory. Two essential Kantian insights are the significance for rationality of the capacity for criticism and the limits of cognition, discovered when criticism is pursued methodically, that are due to the perspectival character of the human standpoint. After a period of disparagement, these Kantian insights have been sympathetically construed and are now discussed within contemporary analytic philosophy. However, if Kant’s assumption of a single, immutable, human framework is jettisoned, then the rationality of historical succession is called into question. Moreover, if the (...) revolutionary character of framework transitions is acknowledged, then reason is historicized and even its character as reason is threatened. I argue that Menachem Fisch’s approach to criticism and rationality offers an escape from this post-Kantian predicament that acknowledges revolutionary framework transitions and that draws upon the dialogical traditions of Jewish thought, and I also argue that Fisch’s approach should be seen as thematizing, to use the terms of Kant’s aesthetics and of Fichte’s account of natural right, the reflecting rather than determining status of critical judgement, which involves second-personal address. The paths and the ways: an insight into transdisciplinarity: This is a short study of how the notion of thinking that Heidegger developed in his writing, in the Conversation on a Country Path about Thinking, can be read through a consideration of a Chinese Taoist text Tao Te Ching and the Confucian, though a Taoist inspired text, by Zisi, the Zhongyong, to illuminate the essential nature of openness in transdisciplinarity and the restrictions of disciplinarity of knowing taken as the ritual (...) and rules of methodology. This approach offers a way to understand unconcealment in the onto-cosmology of the harmony of all Being and of personal cultivation which is essential to the ontology of Heidegger. I then suggest how this might be offered in what could be called a transdisciplinary pedagogy. Key words: Heidegger. Confucianism. Taoism. Transdisciplinarity. Harmony. Notwithstanding its prominence in the title of Gadamer’s major work, the concept of truth remains implicit and underspecified in Gadamer’s writings. Consequently, it is often assumed that, for Gadamer, as for Heidegger, the emergence of truth is adequately characterised as a sudden flash of enlightening insight, an impression reinforced by the prominence accorded by Gadamer in the first part of Truth and Method to the experience of aesthetic truth and the model of play. But in addition to leaving the hermeneutic (...) truth concept open to charges of arbitrariness and subjectivism, this assessment overlooks Gadamer’s emphasis in the second part of TM on the need for investigating a topic dialogically. Accordingly, this paper contends that it is only when these two elements are counterbalanced, as Gadamer intends, that a defensible conception of hermeneutic truth emerges, impervious to charges of arbitrariness and subjectivism. Notably too, this hermeneutic truth concept transcends both coherence and correspondence truth in important respects. (shrink)
