Over 90% of the organs transplanted in China before 2010 were procured from prisoners. Although Chinese officials announced in December 2014 that the country would completely cease using organs harvested from prisoners, no regulatory adjustments or changes in China’s organ donation laws followed. As a result, the use of prisoner organs remains legal in China if consent is obtained. We have collected and analysed available evidence on human rights violations in the organ procurement practice in China. We demonstrate that the (...) practice not only violates international ethics standards, it is also associated with a large scale neglect of fundamental human rights. This includes organ procurement without consent from prisoners or their families as well as procurement of organs from incompletely executed, still-living prisoners. The human rights critique of these practices will also address the specific situatedness of prisoners, often conditioned and traumatized by a cascade of human rights abuses in judicial structures. To end the unethical practice and the abuse associated with it, we suggest to inextricably bind the use of human organs procured in the Chinese transplant system to enacting Chinese legislation prohibiting the use of organs from executed prisoners and making explicit rules for law enforcement. Other than that, the international community must cease to abet the continuation of the present system by demanding an authoritative ban on the use of organs from executed Chinese prisoners. Some philosophers have argued that moral agency is characteristic of humans alone and that its absence from other animals justifies granting higher moral status to humans. However, human beings do not have a monopoly on moral agency, which admits of varying degrees and does not require mastery of moral principles. The view that all and only humans possess moral agency indicates our underestimation of the mental lives of other animals. Since many other animals are moral agents (to varying degrees), they (...) are also subject to (limited) moral obligations, examples of which are provided in this paper. BackgroundIn December 2014, China announced that only voluntarily donated organs from citizens would be used for transplantation after January 1, 2015. Many medical professionals worldwide believe that China has stopped using organs from death-row prisoners.DiscussionIn the present article, we briefly review the historical development of organ procurement from death-row prisoners in China and comprehensively analyze the social-political background and the legal basis of the announcement. The announcement was not accompanied by any change in organ sourcing legislations or regulations. As a (...) fact, the use of prisoner organs remains legal in China. Even after January 2015, key Chinese transplant officials have repeatedly stated that death-row prisoners have the same right as regular citizens to “voluntarily donate” organs. This perpetuates an unethical organ procurement system in ongoing violation of international standards.ConclusionsOrgan sourcing from death-row prisoners has not stopped in China. The 2014 announcement refers to the intention to stop the use of organs illegally harvested without the consent of the prisoners. Prisoner organs procured with “consent” are now simply labelled as “voluntarily donations from citizens”. The semantic switch may whitewash sourcing from both death-row prisoners and prisoners of conscience. China can gain credibility only by enacting new legislation prohibiting use of prisoner organs and by making its organ sourcing system open to international inspections. This book aims at establishing a view of understanding that will be free of ties to the "cultural imperialism" and "scientific-technological reductionism" which the author sees as threatening the prospects for human freedom and dignity. In the course of this attempt he surveys a wide variety of anthropological, literary, and philosophical material, always focusing on those aspects of the subject matter that suggest the limitations of a scientistic world-view. It comes as something of a surprise when the attack on scientism (...) and the praise of the rich diversity of many cultural traditions turns out to be the prelude to the introduction of a modified analogical theory based on the Thomistic tradition. The perspective which is eventually outlined seems very close to that of Paul Ricoeur's defense of analogy, from a phenomenological point of view, in The Rule of Metaphor. Unlike Ricoeur, however, Madison does not engage thinkers like Heidegger and Derrida at a deep level; he prefers a broad survey of many subject matters to the more concentrated studies of Ricoeur on specific subjects such as metaphor. Of the book's 440 pages, 306 are occupied by actual text materials, the balance being. taken up with. bit-bibliographical prefatory remarks to each of the selections, an index, and the Table of Contents. Since selections from the works of thirty-five mediaeval authors are presented (!), an equable distribution of the 306 pages would leave something less than nine pages to be devoted to each writer. But as some of the selected figures, e.g., Augustine, Aquinas, and Ockham, have as many as 29 pages devoted to their writings, the others are given wholly inadequate representation. Now from this it can be easily seen that at best, i.e., where the full upper limit of space is assigned to the writings of any one of the mediaevals, his attack and stand on some chosen philosophical issue might be fairly represented. But when we look to the few men who are thus singled out for special consideration and note that their allotments of pages are spent on a great number of topics, drawn from many different works, the effect within the scope of a single "lengthy" selection mirrors perfectly the patchy and kaleidoscopic character of the entire collection. On the positive side, it must be noted at once that the translations are excellent: faithful and clear. The prefaces, albeit quite general, are accurate and informative; while the bibliographies, particularly those that deal with primary sources, are up-to-date and helpful. Further, it was most gratifying to find that this volume included selections culled from the writings of such oft-referred to, but never-anthologized figures as Peter Damian (289 pages), Gilbertus Porretanus (5~ pages), Vincent of Beauvais (4 pages), and Siger of Brabant (3 pages). An error occurs in the Table of Contents where Giustino, Atenagora, and Tertulliano, who should be listed under "L'apologetica cristiana," are cited under "Nuovo mestamento." Can multiculturalists be egalitarians and should egalitarians be multiculturalists? Is the absence of cultural recognition an injustice in the same way as the absence of individual rights or basic resources? These are some of the questions considered in this wide-ranging series of essays inspired by the political philosopher Brian Barry. Multiculturalist political theorists and policy-makers argue that liberal egalitarianism fails to take seriously the role of culture and group identity in defining harms and cases of injustice. Because liberal egalitarians adopt (...) a culturally neutral account of what principles and institutions of justice should distribute, they ignore an important way in which these norms actually reinforce injustice rather than eradicate it. This volume features essays about and by Paul Benacerraf, whose ideas have circulated in the philosophical community since the early nineteen sixties, shaping key areas in the philosophy of mathematics, the philosophy of language, the philosophy of logic, and epistemology. The book started as a worskhop held in Paris at the Collège de France in May 2012 with the participation of Paul Benacerraf. The introduction addresses the methodological point of the legitimate use of so-called “Princess Margaret Premises” in (...) drawing philosophical conclusions from Gödel’s first incompleteness theorem. The book is then divided into three sections. The first is devoted to an assessment of the improved version of the original dilemma of “Mathematical Truth” due to Hartry Field: the challenge to the platonist is now to explain the reliability of our mathematical beliefs given the very subject matter of mathematics, either pure or applied. The second addresses the issue of the ontological status of numbers: Frege’s logicism, fictionalism, structuralism, and Bourbaki’s theory of structures are called up for an appraisal of Benacerraf’s negative conclusions of “What Numbers Could Not Be.” The third is devoted to supertasks and bears witness to the unique standing of Benacerraf’s first publication: “Tasks, Super-Tasks, and Modern Eleatics” in debates on Zeno’s paradox and associated paradoxes, infinitary mathematics, and constructivism and finitism in the philosophy of mathematics. Writing Politics is a methods book designed to instruct on politically focused literary inquiry. Exploring the political sensibilities that arise from the way literary fiction re-textualizes historical periods and events, the book features a series of violence-themed inquiries that emphasize forms of writing as the vehicles for politically attuned historiography. Each investigation treats the way the literary genre, within historiographic metafiction, enables political inquiry. It's a form of writing that inter-articulates history and fiction to rework a textual past and unsettle (...) dominant understandings of events and situations. Central to the diverse chapters are fictional treatments of authoritarian, fascist, or zealous mentalities. Featured, for example, are Radovan Karadzic, Reinhard Heydrich, and the Trotsky assassin Ramon Mercader. Michael J. In their highly topical paper, Grahamet alargued that Trusted Research Environments (TREs) are not actually about trust because they reduce or remove ‘…the need for trust in the use and sharing of patient health data’. We believe this is fundamentally mistaken. TREs mitigate or remove some risks, but they do not address all public concerns. In this regard, TREs provide evidence for people to decide whether the bodies holding and using their data can be trusted. One of the more distinctive features of Bob Hale and Crispin Wright’s neologicism about arithmetic is their invocation of Frege’s Constraint – roughly, the requirement that the core empirical applications for a class of numbers be “built directly into” their formal characterization. In particular, they maintain that, if adopted, Frege’s Constraint adjudicates in favor of their preferred foundation – Hume’s Principle – and against alternatives, such as the Dedekind-Peano axioms. In what follows we establish two main claims. First, we show (...) that, if sound, Hale and Wright’s arguments for Frege’s Constraint at most establish a version on which the relevant application of the naturals is transitive counting – roughly, the counting procedure by which numerals are used to answer “how many”-questions. Second, we show that this version of Frege’s Constraint fails to adjudicate in favor of Hume’s Principle. If this is the version of Frege’s Constraint that a foundation for arithmetic must respect, then Hume’s Principle no more – and no less – meets the requirement than the Dedekind-Peano axioms do. The historical emphasis of medical ethics, based on substantive frameworks and principles derived from them, is no longer seen as sufficiently sensitive to the moral pluralism characteristic of our current era. We argue that moral decision-making in clinical situations is more properly derived from a process of dialogic consensus. This process entails an inclusive, noncoercive, and self-reflective dialogue within the community affected. In order to justify this approach, we make two claims—the first epistemic, and the second normative. The epistemic claim (...) follows from Habermas’ “ways” of knowing. We argue that the dialogue emanating from this episteme focuses on the relevant facts about the patient, as well as on the values attached to these facts, thus allowing facts and their meanings to serve as the basis for reflective action appropriate to the circumstances. The normative claim follows from Habermas’ discourse theory of morality and communicative action. It determines that clinical decision-making should be approached from the perspective of the actual reality of people in their situation of illness, set in their socio-cultural background, and hence be grounded in the second-person perspective. Relocating ethical decision-making from a monological space into one characterized by dialogue is especially appropriate to the clinical encounter. (shrink)

China has been labeled an “anti-imperial empire” that forcefully challenges previous Euro-American imperial legacies—all while it verges on reenacting them.1 A critical way it resolves this geopolitical tension is through the articulation of a mission for global China, and since 2017, the heroic filmic fictional figure of the “Wolf Warrior” anchors such an approach. The Wolf Warrior is a gorgeous, muscled, Chinese male rogue soldier in exile who adventures through the archipelago of the PRC’s shipping, mining, and medical projects across the Global South to battle white mercenaries, corrupt Asian businessmen, and local pirates—all while saving Africa from a ravaging pandemic. Extending a hugely popular film series, the release in 2017 of the blockbuster Wolf Warrior 2 (abbreviated below as Wolf 2) unleashed a worldwide social media frenzy as well as a revolution in diplomatic tone and protocol for China. In these ways, Wolf Warrior 2 came to mark the debut of the global PRC as a hegemonic structure 1. These fused into a global cultural megaproject with the PRC presenting itself as a leader in responding to the COVID-19 pandemic in the Global South—a time the PRC has officially branded as its “Rejuvenation Era” of “Stepping Out into the World.” This essay shows how exactly this Wolf Warrior imagination has legitimized a new global regime, but I also reveal how, paradoxically, the Wolf Warrior regime has offered a distinct, more subversive worlding project. I argue here that the utopia immanent in this project can be revealed by interpretively turning this Wolf universe inside out through a deimperial queer analysis that honors and combines a Third World feminist lens and the “Asia as Method” approach with Danmei/BL and Slash queer-feminist fanfiction hacks. Danmei is a Chinese (originally mainly Tawainese) fanfiction genre that subverts mainstream heteronormative narratives by erotically aestheticizing and renarrating male-male intimacies within mainstream plotlines from feminist perspectives. BL (short for “boylove ”) is a similar Japanese fanfiction genre, and Slash is the term used in English for the queer/feminist hacking and excavation of sublimated and particularly utopian gender and sexuality plots from within seemingly conventional heteronormative or patriarchal popular-cultural texts. The everted or inside-out epistemology given expression here uses a set of non-phallogocentric lenses and decolonial feminist decoding practices. At stake is the urgency of not repeating the epistemic violence of conventional “anti-imperial” arguments, which tend to be heteronormative, statist, macho, and monolithic. Instead, the form of critique elaborated here brings questions of gender, race, and sexuality to the fore through a three-part approach. First, I identify the homoerotic register of the techno-infrastructural elements in the film. I generate close readings that detail the visual and genre codes of battle scenes, thug subjects, and piracy plots that forge a homoerotic model of rogue or “wolf” governmentality and that act as a metaphor for China’s techno -infrastructural rule. Second, this essay explores the gendered hauntings of supremacist humanism. I deploy a decolonial feminist lens to map the configuration of African women, female doctors, Maoist women insurgents, and feminized “flowerboys” as a rebel protectorate overseen by China’s phallic prerogative that is itself haunted by the specters of Euro-American humanist betrayal and white supremacy. Third, Paul Amar 421 I trace queer kinship utopias. I demonstrate that Wolf Warrior 2 rejuvenates a non-Western, queer, globalist kinship structure that triangulates Asian, white, and Black through adoption dramas and bromance bonds. In 1990, the Federal Trade Commission (FTC) issued a consent order to the American Institute of Certified Public Accountants (AICPA). The order decreed the AICPA to lessen its longstanding ethics code which had until then banned the receipts of commissions, referral fees and contingent fees. The FTC alleged that the AICPA banned receipt of the fees as an attempt to restrain trade (FTC, 1990).In the present study, we sought to determine if CPAs'' preference for bans on commissions, referral fees and (...) contingent fees is related to their moral reasoning whereby CPAs perceive the bans to serve as a means of resolving ethical issues. While determining this matter cannot prove whether the bans did or did not actually result in restrained trade, it can offer insight into the perceived ethical importance to CPAs of the overturned rules. Based on a random sample of AICPA members and using Rest''s Defining Issues Test (DIT) to measure moral reasoning, we did not find a CPA''s moral reasoning to be related to his/her preference for ethics rules which ban commissions, referral fees or contingent fees. However, our results did indicate that most CPAs prefer banning commissions, referral fees and contingent fees, with those CPAs holding a higher financial stake in public accounting, namely partners, favoring banning referral fees and contingent fees significantly less than CPAs with a lesser stake. Further, we noted a significant negative relationship between financial stake and moral reasoning. These results seem to suggest that self-interest among CPAs may influence their moral reasoning.Further study is needed to examine the relationship between self-interest of CPAs and their moral reasoning. If self-interest clouds moral judgments made by CPAs, capital markets are in danger. Rendering an independent audit opinion must exclude self-interest. (shrink)
