Background Although clinical ethicists are becoming more prevalent in healthcare settings, their required training and education have not been clearly delineated. Most agree that training and education are important, but their nature and delivery remain topics of debate. One option is through completion of a clinical ethics fellowship. Method In this paper, the first four fellows to complete a newly developed fellowship program discuss their experiences. They describe the goals, structure, participants and activities of the fellowship. They identify key elements (...) for succeeding as a clinical ethicist and sustaining a clinical ethics program. They critically reflect upon the challenges faced in the program. Results The one-year fellowship provided real-time clinical opportunities that helped them to develop the necessary knowledge and skills, gain insight into the role and scope of practice of clinical ethicists and hone valuable character traits. Conclusion The fellowship enabled each of the fellows to assume confidently and competently a position as a clinical ethicist upon completion. (shrink)

We examine the concept of personhood in relation to people living with dementia and implications for the humanity of care, drawing on a body of ethnographic work. Much debate has searched for an adequate account of the person for these purposes. Broad contrasts can be made between accounts focusing on cognition and mental faculties, and accounts focusing on embodied and relational aspects of the person. Some have suggested the concept of the person is critical for good care; others suggest the (...) vexed debates mean that the concept should be abandoned. We argue instead that the competing accounts illuminate the very tensions in personhood which are manifest for all of us, but especially for people living with dementia, and argue that our account has explanatory power in shedding light on how precisely dehumanisation and constraints on agency may arise for people living with dementia, and for staff, within an institutional context. The paper discusses recent proposals by Carroll and Chen, as well as Barbour, Koslowski, and Mercati to explain the arrow of time without a Past Hypothesis, i.e. the assumption of a special initial state of the universe. After discussing the role of the Past Hypothesis and the controversy about its status, we explain why Carroll's model - which establishes an arrow of time as typical - can ground sensible predictions and retrodictions without assuming something akin to a Past Hypothesis. We (...) then propose a definition of a Boltzmann entropy for a classical N-particle system with gravity, suggesting that a Newtonian gravitating universe might provide a relevant example of Carroll's entropy model. This invites comparison with the work of Barbour, Koslowski, and Mercati that identifies typical arrows of time in a relational formulation of classical gravity on shape space. We clarify the difference between this gravitational arrow in terms of shape complexity and the entropic arrow in absolute spacetime, and work out the key advantages of the relationalist theory. We end by pointing out why the entropy concept relies on absolute scales and is thus not relational. (shrink)

In this book chapter, Moya argues that recognizing, indeed mobilizing, identities in the classroom is a necessary part of educating for a just and democratic society. Only a truly multi-perspectival, multicultural education can create the conditions needed to alter the negative identity contingencies that minority students commonly face, while creating opportunities for all students. By treating identities as epistemic resources and mobilizing them, we can draw out their knowledge-generating potential and allow them to contribute positively to the production and transmission (...) of knowledge. In this contribution we first sketch an outline of the concept of lifeworld (_Lebenswelt_), to introduce the readers to the guest-edited collection of essays _Varieties of the Lifeworld: Phenomenology and Aesthetic Experience_, special issue of the “Continental Philosophy Review.” We trace back the origin of the concept of lifeworld to Husserl’s late phenomenology, although also explaining (on the basis of the careful historical-conceptual reconstructions offered by some distinguished scholars of Husserl and the phenomenological movement) that the development of Husserl’s phenomenology (...) of the _Lebenswelt_ was gradual and was connected, among other things, to the question of the natural world of experience. Then, quickly referring to Gadamer, Landgrebe, Fink and other authors belonging to the phenomenological tradition, we explain that different interpretations of the topic “Lifeworld” in Husserl’s thinking have been provided: In our view, this contributes to the fact that still nowadays this topic is a fascinating and philosophically stimulating one. Finally, making reference to more recent works by such authors as Figal, Gallagher, Zahavi and Shusterman (a pragmatist philosopher, whose somaesthetics is nonetheless very rich in insights that can be connected to phenomenological views of the body and its place in the world), we emphasize how the question concerning the lifeworld is still capable today to open a great variety of perspectives and plurality of paths for thinking, as testified by the essays collected in this guest-edited special issue of the “Continental Philosophy Review.”. The Limits of Medical Paternalism defines and morally assesses paternalistic interventions, especially in the context of modern medicine and health care, particular emphasis is given to the analysis of the conceptual background of the paternalism issue. In this book an anti-paternalistic view is presented and defended.

Researchers have documented negative physical and emotional consequences for both family caregivers of persons with cancer as well as caregivers of persons with a neurologic disorder. However, there is a unique subset of caregivers who must provide care for someone who may suffer from both a short, terminal trajectory of disease, as well as neurological and neuropsychiatric sequelae — the caregiver of a person with a primary malignant brain tumor. The purpose of this article was to describe a conceptual framework (...) for providing care for a person with a primary malignant brain tumor. The demands of this particular care situation are described, as well as potential resources available to the caregiver to meet those demands. Finally, the stress response that results from the balance between care demands and caregiver resources is illustrated. Development of a conceptual framework for this caregiving population is the first step in assisting nurses to identify factors that place caregivers of persons with a primary malignant brain tumor at risk for negative consequences, and to design interventions to improve caregiver health. En primer lugar, analizaré el pacto realizado entre Poseidón y Atenea en la primera parte del prólogo ; a continuación, me concentraré en la paradójica intervención de Casandra, antes de ser embarcada como esclava de Agamenón ; para terminar, resaltaré algunos puntos del agón entre Hécuba y Helena, que tiene como juez a Menelao. En este trabajo critico la interpretación moralizada de la obligación política en Hobbes que defiende Luciano Venezia. Exploro una lectura diferente que evita una dicotomía tajante entre las razones prudenciales y las razones morales y subraya en cambio la discontinuidad entre la normatividad subjetiva de la ley natural y la normatividad objetiva de la ley positiva. Sostengo que el contrato de sujeción política establece obligaciones objetivas recién cuando el soberano exige el cumplimiento de los contratos. La obligación política es entonces (...) una forma de obligación jurídica. Además, enfatizo que la comunidad moral de Hobbes solo es posible dentro del Estado. In this paper, I criticize Luciano Venezia's moralized interpretation of the Hobbesian concept of political obligation. I explore a different reading that avoids a clear-cut dichotomy between prudential and moral reasons and underscores instead the discontinuity between natural law's subjective normativity and civil law's objective normativity. I contend that the pact of political subjection establishes objective obligations only when the sovereign requires the fulfillment of contracts. Political obligation is then a form of legal obligation. In addition, I emphasize that Hobbes's moral community is only possible within the State. (shrink)

My purpose in this essay is to make some remarks about the Digression of the Theaetetus. I shall argue that one central aim of the Digression is to show that there is a conflict between two ways of life: the life of the philosopher and the life of people get involved in politics. In the first part of this paper I make some considerations on the relationship between the Prologue and the trial of Socrates. The practices of Galenic pharmacy that dominated the Western pharmaceutical tradition throughout the medieval and early modern periods generally eschewed methods of alchemical processing and the use of high heat. A unique 10th-century Arabic pharmaceutical treatise, the Kitab al Tasrif by al-Zahrāwī/Abulcasis, however, discussed thermo-chemical techniques of distillation, calcination, and sublimation at length and would go on to have a major impact on Galenic pharmacy. It included recipes, for example, for two highly important distilled substances – rosewater and Philosophers' Oil (...) – that were copied and revised in Latin texts from the later Middle Ages and early modern Spanish formularies. By the end of the 16th century, these recipes had formed the basis for two new categories of distilled medicines – distilled waters and distilled oils – in Galenic pharmacy. Their inclusion in the Galenic formulary indicates that apothecaries in the Latin West were familiar with and indeed practicing thermo-chemical operations during the medieval and early modern periods. Across languages, we find epistemic indefinites, i.e. existential determiners that can convey information about the speaker’s epistemic state.1 One such indefinite is Spanish alg´un, which marks ignorance on the part of the speaker. By using alg´un in (1a) the speaker signals that he is unable (or unwilling) to identify the doctor that Mar´ıa married. Hence, it would be odd for him to add a namely continuation that explicitly identifies the doctor in question, as in (1b). This article investigates the impact of the adoption of International Financial Reporting Standards (IFRS) on the comparability, quality, and efficiency of financial reporting, both in public administration and in emerging markets. Through a quantitative approach, data from various public institutions and emerging market companies that have adopted IFRS in recent years were analyzed. The results indicate a significant improvement in the comparability and quality of financial reports, although accounting efficiency varies depending on the degree of implementation and administrative modernization in (...) the countries. It is concluded that the adoption of IFRS has an overall positive effect, but its total impact depends on the institutional capacity of countries. (shrink)

This article presents an overview of Ernesto Laclau’s theory of hegemony from his first work as co-author with Chantal Mouffe of Hegemony and Socialist Strategy: Towards a Radical Democratic Politics (1985) to his last work On Populist Reason (2005). To that end, this corpus is analyzed with theoretical tools from Lacanian psychoanalysis in order to locate the implicit postulates in Laclau’s work and to organize his work into three main stages. En palabras del artista, el proyecto se inspiró en la teoría del científico japonés Masaru Emoto, quien sostiene que las diversas formas de cristalización del agua se deben a las energías y afectos a las que ésta se expone. Morphophonological alternations, such as the voicing alternation that arises in a morphological paradigm due to final-devoicing in Dutch, are notoriously difficult for children to acquire. This has previously been attributed to their unpredictability. In fact, the presence or absence of a voicing alternation is partly predictable if the phonological context of the word is taken into account, and adults have been shown to use this information ( Ernestus and Baayen, 2003 ). This study investigates whether voicing alternations are predictable from (...) the child’s input, and whether children can make use of this information. A corpus study of child-directed speech establishes that the likelihood of a stem-final obstruent alternating is somewhat predictable on the basis of the phonological properties of the stem. In Experiment 1 Dutch 3-year-olds’ production accuracy in a plural-elicitation task is shown to be sensitive to the distributional statistics. However, distributional properties do not play a role in children’s sensitivity to mispronunciations of voicing in a Preferential Looking Task in Experiment 2. (shrink)

Musical activities play an extremely important role in the holistic development of children. The aim of this study is therefore to investigate parents' views on the importance of a musically stimulating environment for the holistic development of toddlers with regard to gender, vocational training, additional music lessons, knowledge of notation and children's participation in a music kindergarten program. The research was conducted through a survey of a sample of 193 participants, parents of toddlers from Split-Dalmatia County. A questionnaire consisting of (...) two parts was created for the purpose of the research: Questionnaire on general data and parents' attitudes towards the importance of a musically stimulating environment for the holistic development of toddlers. The results of the study confirmed that gender and vocational training were not significant predictors of parental attitudes towards the importance of a musically stimulating environment for the holistic development of toddlers. Additional musical education by parents and knowledge of musical notation are significant predictors of some of the attitudes towards performing musical activities at home and attitudes towards music in general. The results of the study confirm that parents whose children attend the musical kindergarten program have a more positive attitude towards the importance of a musically stimulating environment for the holistic development of toddlers compared to parents whose children do not participate in such activities. The results show the importance of the quality of the organization of music kindergarten programs and greater involvement of children in such programs. (shrink)

O presente texto é oriundo da disciplina “Ontologia e Ciências Humanas: O Kant de Heidegger”, ministrada pelos professores Gustavo Silvano Batista e Eduardo José Marandola Junior entre janeiro e fevereiro de 2024, no Programa de Pós-Graduação Interdisciplinar (ICHSA) da Faculdade de Ciências Aplicadas (FCA) da Unicamp no campus de Limeira-SP. Nele procuro analisar no segundo Heidegger em sua crítica pós-metafísica, portanto após a sua discussão sobre a metafísica kantiana, a maturação da ideia do Dasein. Nessa leitura específica de Heidegger destaco (...) o momento, apesar de não conclusivo, em que o Ser aparece como um ser-com, no qual vislumbro a possibilidade de diálogo, de encontro com outras percepções de mundo, entre elas, a oralidade na perspectiva de Amadou Hampaté Bâ. Com isso indico que apesar dos nítidos distanciamentos existem campos proximais, nos quais para a tradição oral ocorre o interesse pelo outro, o que estabelece a base necessária para que a palavra aconteça. No cenário literário brasileiro do início da década de 1950, chama a atenção a publicação quase simultânea de O mundo da paz e Os subterrâneos da liberdade de Jorge Amado, e Viagem e Memórias do cárcere de Graciliano Ramos. Romancistas brasileiros já consagrados pela crítica e pelo público, ambos revelam nessas publicações a radicalidade com a qual se identificam com o comunismo e com a experiência soviética. Ao mesmo tempo, os relatos de viagem e os livros de memória, se vistos (...) em conjunto, evidenciam a presença de duas tradições narrativas: a literária propriamente dita e a do engajamento político dos intelectuais. Assim, o que se pretende aqui é apresentar como essas duas tradições aparecem na obra dos dois escritores, em especial, em seus relatos de viagem à URSS. Do ponto de vista da militância política e dos recursos literários, ambos escritores se utilizaram, nesses títulos, do “gênero de fronteira” para partilhar com seus leitores algum tipo de comprometimento com a história da política nacional recente, com o comunismo e para avalizar a experiência soviética. O presente estudo pretende compreender como a diáspora interfere no ato de ouvir a programação da Rádio Comunitária 87.9 FM de Frederico Westphalen, Rio Grande do Sul, pela internet, isto é, se o fato de ouvir a emissora por meio do site aproxima os indivíduos diaspóricos de Frederico Westphalen, da Rádio ou de alguém que resida no município e como isso acontece. A metodologia utilizada foi de entrevistas em profundidade com ouvintes da Rádio Comunitária FM que estão em situação de (...) diáspora e também com o diretor da emissora. A grande maioria dos entrevistados ouve a Rádio como uma maneira de se manter próximo a Frederico Westphalen ou a algum familiar ou amigo que resida no município, diminuindo assim os efeitos da diáspora em suas vidas, como a saudade, por exemplo. BackgroundSince the outbreak of the COVID-19 pandemic and its social restriction measures, online therapy is a life-saving possibility for patients with acute stress. Wiring Affect with ReAttach is a brief psychological intervention aiming to decrease negative affect, that can be offered online.MethodsWe assessed the effect of remote W.A.R.A. on negative affect in 37 patients. Consequently, we compared the effect of remote W.A.R.A. versus face-to-face W.A.R.A on negative affect in a cross-sectional design.ResultsW.A.R.A. remote therapy provoked a significant reduction of negative affect (...) with a large effect size. However, the reduction on negative affect was smaller than with W.A.R.A. face-to-face. We found a substantial difference between W.A.R.A. remote therapy and W.A.R.A. face-to-face in decrease of negative affect.LimitationsThe major limitation of the pilot-study is the sample size of 37 patients. Besides, we designed a numeric rating scale for evaluating negative affect. We investigated the impact on negative affect by assessing “unpleasant feelings.” This conceptualization of negative affect might still be a point of discussion.ConclusionThe study’s findings indicated that W.A.R.A. remote therapy significantly reduced negative affect, but to a lesser extent than W.A.R.A. face-to-face. Nevertheless, W.A.R.A. remote therapy might offer a fast relief, especially when personal contact is difficult. (shrink)

This book is a guide to the key concepts, the relevant rules and potential conflicts relating to legal ethics. It is designed to encourage discussion and debate inside and outside the classroom about professional obligations, their rationales, their expression in the various rules of professional conduct, the relationship between the profession and the public and the relationship between the profession and regulating bodies.

Over recent years, lawyer misconduct and regulation of the profession have been topics of considerable interest. Yet, when the topic of legal ethics is raised, the focus tends to be on lawyer conduct external to the firm: lawyer conduct in court; lawyer conduct vis-a-vis client; or lawyer conduct vis-a-vis opposing counsel or the judiciary. The recent National Attrition and Re-engagement Study, however, raises a different aspect of legal professional ethics. This Report found a widespread incidence of bullying, intimidation, discrimination and (...) harassment within law firms, primarily affecting though not confined to, female lawyers. Of course, bullying and associated behaviours are not confined to the legal profession. But these behaviours are at odds with a profession that purports to be deeply concerned with the ethical conduct of its members. Arguing that ‘ethics begins at home’, this paper suggests NARS raises uncomfortable questions about legal professional ethics: if law firms cannot treat their own staff members ethically, what does that say about the firm’s approach to ethical conduct more generally? And if this culture is as widespread as the report suggests, what does this say about the ethics of the legal profession as a whole? (shrink)

Poor adherence to medication is a persistent problem in the practice of medicine, which gives rise to problems for individual patients, for the healthcare system as a whole, and in some cases, for third parties and for public health. There has been some progress in understanding the causes and solutions but much more work needs to be done. To develop the ethical responses to adherence, the problems need to be analysed more precisely. It is argued that, given that one pressing (...) concern is whether poorly adherent patients are being unfairly blamed or stigmatised, it is necessary to pay attention not just to the content of claims about adherence, but to the rhetoric of how these are presented. A necessity-concerns framework does much to advance understanding and ethics but may have certain pitfalls, and an approach based on micro-economic modelling may help to refine understandings of the position of the patient. It is also argued that a more sophisticated understanding of the ethical issues will be gained by recognising two problems: first, poor adherence to medications per se; second, poor knowledge about adherence to medications. These are related, but give rise to distinct ethical concerns. (shrink)
