Hannah Arendt’s most important contribution to political thought may be her well-known and often-cited notion of the "right to have rights." In this incisive and wide-ranging book, Peg Birmingham explores the theoretical and social foundations of Arendt’s philosophy on human rights. Devoting special consideration to questions and issues surrounding Arendt’s ideas of common humanity, human responsibility, and natality, Birmingham formulates a more complex view of how these basic concepts support Arendt’s theory of human rights. Birmingham considers Arendt’s key philosophical works (...) along with her literary writings, especially those on Walter Benjamin and Franz Kafka, to reveal the extent of Arendt’s commitment to humanity even as violence, horror, and pessimism overtook Europe during World War II and its aftermath. My claim is that Arendt founds the 'right to have rights' in the anarchic event of natality. Arendt is very explicit that the event of natality is an ontological event. In The Human Condition, she writes: "The miracle that saves the world, the realm of human affairs, from its normal "natural" ruin is ultimately the fact of natality, in which the faculty of action is ontologically rooted." At the same time, she is equally insistent that this ontological event is not (...) metaphysical; it is not the origin of anything like human nature: "To avoid misunderstanding, the human condition is not the same as human nature and the sum total of human activities and capabilities which correspond to the human condition do not constitute anything like human nature". Indeed, this event has the character of a "startling unexpectedness." Natality, she argues, is the condition for human existence, but it can never "…explain what we are or answer the question of who we are for the simple reason that [it] can never condition us absolutely". The 'who' does not possess an enduring, fixed nature, but is instead inherently marked by contingency and unpredictability. Arendt's ontology, therefore, does not describe an immutable order of essences; it does not seek enduring truths upon which to ground both thought and action; it does not posit a metaphysical notion of human nature or subjectivity in which human rights are inalienably inscribed. Instead, it is rooted in an unpredictable, anarchic event that provides the arche and principium of human action. For Arendt, the event of natality is the arche in the double etymological sense of origin and rule. In other words, natality is the unpredictable, anarchic origin that carries its rule or principle within it. As she points out in On Revolution, "What saves the act of beginning from its own arbitrariness is that it carries its own principle within itself or, to be more precise, that beginning and principle, principium and principle, are not only related to each other, but are coeval." Arendt goes on to argue: "For the Greek word for beginning is arche, and arche means both beginning and principle." By articulating this principium, Arendt does not give us an ontological politics; rather, she provides an ontological foundation for human rights. (shrink)

We investigated the competition between automatic and controlled processes in a word stem completion task. Prime-display duration and the prime-target interval were manipulated. On each trial a masked prime was displayed briefly, followed either immediately or after a delay by a word stem. The subjects were required to complete each stem with the first word that came to mind, to report any prime they could identify, and not to give as completion any identified prime. By the assumption that automatic processes (...) require less stimulus input and can be completed faster than consciously controlled processes we expected a stronger performance contribution from automatic processes with the shorter prime-display durations and in the immediate stems condition. The results confirmed this expectation. The findings highlight that consciously controlled processes require more time to run their course than unconscious automatic processes. (shrink)

Peg Rawes examines a "minor tradition" of aesthetic geometries in ontological philosophy. Developed through Kant’s aesthetic subject she explores a trajectory of geometric thinking and geometric figurations--reflective subjects, folds, passages, plenums, envelopes and horizons--in ancient Greek, post-Cartesian and twentieth-century Continental philosophies, through which productive understandings of space and embodies subjectivities are constructed. Six chapters, explore the construction of these aesthetic geometric methods and figures in a series of "geometric" texts by Kant, Plato, Proclus, Spinoza, Leibniz, Bergson, Husserl and Deleuze. In (...) each text, geometry is expressed as a uniquely embodies aesthetic activity because each respective geometric method and figure is imbued with aesthetic sensibility and geometric sense (rather than as disembodies scientific methods). An ontology of aesthetic geometric methods and figures is therefore traced from Kant’s Critical writings, back to Plato and Proclus Greek philosophy, Spinoza and Leibniz’s post-Cartesian philosophies, and forwards to Bergson’s "duration" and Husserl’s "horizons" towards Deleuze’s philosophy of sense. Machine intelligence already helps medical staff with a number of tasks. Ethical decision-making, however, has not been handed over to computers. In this proof-of-concept study, we show how an algorithm based on Beauchamp and Childress’ prima-facie principles could be employed to advise on a range of moral dilemma situations that occur in medical institutions. We explain why we chose fuzzy cognitive maps to set up the advisory system and how we utilized machine learning to train it. We report on the (...) difficult task of operationalizing the principles of beneficence, non-maleficence and patient autonomy, and describe how we selected suitable input parameters that we extracted from a training dataset of clinical cases. The first performance results are promising, but an algorithmic approach to ethics also comes with several weaknesses and limitations. Lockean views of personal identity maintain that we are essentially persons who persist diachronically by virtue of being psychologically continuous with our former selves. In this article, I present a novel objection to this variant of psychological accounts, which is based on neurophysiological characteristics of the brain. While the mental states that constitute said psychological continuity reside in the cerebral hemispheres, so that for the former to persist only the upper brain must remain intact, being conscious additionally requires that a (...) structure originating in the brainstem—the ascending reticular activating system—be functional. Hence, there can be situations in which even small brainstem lesions render individuals irreversibly comatose and thus forever preclude access to their mental states, while the neural correlates of the states themselves are retained. In these situations, Lockeans are forced to regard as fulfilled their criterion of diachronic persistence since psychological continuity, as they construe it, is not disrupted. Deeming an entity that is never again going to have any mental experiences to be a person, however, is an untenable position for a psychological account to adopt. In their current form, Lockean views of personal identity are therefore incompatible with human neurophysiology. (shrink)

When does a human being cease to exist? For millennia, the answer to this question had remained largely unchanged: death had been diagnosed when heartbeat and breathing were permanently absent. Only comparatively recently, in the 1950s, rapid developments in intensive-care medicine called into question this widely accepted criterion. What had previously been deemed a permanent cessation of vital functions suddenly became reversible. -/- A new criterion of death was needed. It was suggested that the destruction of the brain could indicate (...) the death of the organism in the presence of external life support. Soon the so-called brain death became the new worldwide standard. In recent years, however, doubts about this neurological criterion have been growing. Is brain death really our death? -/- This is the question that this thesis seeks to answer. To this end, we shall connect the medical debate about the definition of death to the philosophical debate about personal identity. While we will find that the destruction of its brain does in fact not correspond to an organism’s death, we shall also ask whether the assumption that we are essentially organisms is correct. May brain death be the ceasing to exist of a different entity? -/- Substituting clinical case reports and considerations about human physiology for the use of thought experiments, the thesis takes a novel and philosophically unconventional approach to the problem of what we essentially are. We shall analyse various pathological conditions and their respective effects on the bodily and mental characteristics of our existence. We will conclude that brain death is indeed our death – but for reasons entirely different from those cited in the original justification of this criterion. (shrink)

This book, by one of the most prominent interpreters of Leo Strauss's thought, was the first to address the problem that Leo Strauss himself said was the theme of his studies: the theologico-political problem or the confrontation with the theological and the political alternative to philosophy as a way of life. In his theologico-political treatise, which comprises four parts and an appendix, Heinrich Meier clarifies the distinction between political theology and political philosophy and reappraises the unifying center of Strauss's (...) philosophical enterprise. The book is the culmination of Meier's work on the theologico-political problem. It will interest anyone who seeks to understand both the problem caused by revelation for philosophy and the challenge posed by political-religious radicalism. We can hardly know for certain how strongly a scholarly discipline like history is able to affect politics and society, popular views and morals. Whatever its impact, it's influence also varies from epoch to epoch. During a few decades of the nineteenth century, historians were overwhelmed by so many questions and by such high expectations that there existed a large public space for them that they merely had to occupy. At other times, they have had to conquer this space first (...) if they wanted to gain continued attention.To be sure, a differentiation has to be introduced: any society has particular interests, e.g., in parts of its more recent past or in events that society sees as having something like a “mythical quality” about then, events that represent a major divide, that are deeply imprinted on that society's memory, that have attained a special role through tradition. There is, of course, always a space commanding wider public attention for these aspects. However, they are no more than small specks on the large canvas of history. (shrink)

The COVID-19 pandemic has been overwhelming public health-care systems around the world. With demand exceeding the availability of medical resources in several regions, hospitals have been forced to invoke triage. To ensure that this difficult task proceeds in a fair and organised manner, governments scrambled experts to draft triage guidelines under enormous time pressure. Although there are similarities between the documents, they vary considerably in how much weight their respective authors place on the different criteria that they propose. Since most (...) of the recommendations do not come with ethical justifications, analysing them requires that one traces back these criteria to their underlying theories of distributive justice. In the literature, COVID-19 triage has been portrayed as a value conflict solely between utilitarian and egalitarian elements. While these two accounts are indeed the main antipodes, I shall show that in fact all four classic theories of distributive justice are involved: utilitarianism, egalitarianism, libertarianism, and communitarianism. Detecting these in the documents and classifying the suggested criteria accordingly enables one to understand the balancing between the different approaches to distributive justice—which is crucial for both managing the current pandemic and in preparation for the next global health crisis. It's easy to accept God's will when all is well and life is going along smoothly. But what about the hard times? Here is a compassionate guide for yielding to God's sovereignty in times of need -- and remembering His promise to never leave us nor forsake us.

Good physical experiments conform to the basic methodological standards of experimental design: they are objective, reliable, and valid. But is this also true of thought experiments? Especially problems of personal identity have engendered hypothetical scenarios that are very distant from the actual world. These imagined situations have been conspicuously ineffective at resolving conflicting intuitions and deciding between the different accounts of personal identity. Using prominent examples from the literature, I argue that this is due to many of these thought experiments (...) not adhering to the methodological standards that guide experimental design in nearly all other disciplines. I also show how empirically unwarranted background assumptions about human physiology render some of the hypothetical scenarios that are employed in the debate about personal identity highly misleading. Recent publications on digital health technologies highlight the importance of ‘responsible’ use. References to the concept of responsibility are, however, frequently made without providing clear definitions of responsibility, thus leaving room for ambiguities. Addressing these uncertainties is critical since they might lead to misunderstandings, impacting the quality and safety of healthcare delivery. Therefore, this study investigates how responsibility is interpreted in the context of using digital health technologies, including artificial intelligence (AI), telemonitoring, wearables and mobile apps. We conducted a scoping (...) review with a systematic search in PubMed, Web of Science, Embase, CINAHL and Philosopher’s Index. A total of 34 articles were included and categorized using a theoretical framework of responsibility aspects, and revealed two main findings. First, we found that digital health technologies can expand and shift existing ‘role responsibilities’ among caregivers, patients and technology. Second, moral responsibility is often equated with liability or accountability, without clear justification. Articles describe new ways in which physicians can be held accountable, particularly in the context of AI, and discuss the emergence of a ‘responsibility gap’ where no-one can be fully responsible for AI-generated outcomes. The literature also shows that m-Health technologies can increase patients’ accountability for their own health. However, there was limited discussion in the reviewed literature on whether these attributions of accountability are appropriate. We conclude with implications for practice and suggestions for expanding the theoretical framework of moral responsibility, recommending further study on responsibility of collectives and artificial entities, and on the role of virtue in digital health. The "Introduction" to "Symposium: Beauty Matters" in the Journal of Aesthetics and Art Criticism, Vol. 57, No. 1 (Winter 1999), pages 1-10, is presented here. Abstract: The point of this symposium is to locate one trajectory of the new wave of discussions about beauty beyond the customary confines of analytic aesthetics and to situate it at the intersection of aesthetics, ethics, social-political philosophy, and cultural criticism. The three essays that follow, authored by Marcia Muelder Eaton, Paul C. Taylor, and Susan (...) Bordo, represent a conjoined effort to move "beauty" beyond the traditional parameters of past contextual theories of art--theories which in their own right (only decades ago and analogous to art criticism itself) opened up rich philosophical terrain beyond the confines of formalism. This introductory essay offer some guidance as to why a symposium on beauty merits attention. Exploring the ways artists and critics have revived the concept of beauty will provide a point of comparison between artworld practices and recent philosophical literature. Most importantly, a new approach to philosophical theorizing will be recommended: one that places questions of gender, race, and sexuality at the forefront of analyzing our experiences of beauty in nature, the human body, and art. Curiously, this new approach is not so much a radical departure from traditional philosophical aesthetics as it is a return to questions basic to the field since the time of Plato: questions about the types of qualities that inhere in objects of beauty, the kinds of experiences they provoke, and the ways we come to value both. When an individual is comatose while parts of her brain remain functional, the question arises as to whether any mental characteristics are still associated with this brain, that is, whether the person still exists. Settling this uncertainty requires that one becomes clear about two issues: the type of functional loss that is associated with the respective profile of brain damage and the persistence conditions of persons. Medical case studies can answer the former question, but they are not concerned with the (...) latter. Conversely, in the philosophical literature, various accounts of personal identity are discussed, but usually detached from any empirical basis. Only uniting the two debates and interpreting the real-life configurations of brain damage through the lens of the philosophical concepts enables one to make an informed judgment regarding the persistence of comatose persons. Especially challenging are cases in which three mental characteristics that normally occur together—wakefulness, awareness and memory storage—come apart. These shall be the focus of this paper. Fifty years have passed since brain death was first proposed as a criterion of death. Its advocates believe that with the destruction of the brain, integrated functioning ceases irreversibly, somatic unity dissolves, and the organism turns into a corpse. In this article, I put forward two objections against this assertion. First, I draw parallels between brain death and other pathological conditions and argue that whenever one regards the absence or the artificial replacement of a certain function in these pathological conditions (...) as compatible with organismic unity, then one equally ought to tolerate that function’s loss or replacement in brain death. Second, I show that the neurological criterion faces an additional problem that is only coming to light as life-supporting technology improves: the growing sophistication of the latter gives rise to a dangerous decoupling of the actual performance of a vital function from the retention of neurological control over it. Half a century after its introduction, the neurological criterion is facing the same fate as its cardiopulmonary predecessor. (shrink)
