The book examines the philosophical foundations of private law, arguing that the foremost preoccupations of the law of obligations are grounded in and pervade the personal lives of individuals.

In this paper, I provide an analysis of Marya Schechtman's theory of personal identity defended in her book Staying Alive: Personal Identity, Practical Concerns, and the Unity of a Life.

Biographical books, or bios, are detailed descriptions of a person's life. A biography is more than simply the basic facts, like education, work, relationships, and death. It portrays a person's experience of major life events. A biography presents a subject's life story, emphasizing certain aspects of his or her life, and including intimate details of their experiences, which may include an analysis of their personality. Biographical works are generally non-fiction, but fictional works can also be used (...) to portray a person's life. An in-depth form of biographical coverage is referred to as legacy writing. An authorized biography refers to a book written with the permission, cooperation, and at times, participation of the subject or the subject's heirs. An autobiography, on the other hand, is written by the person themselves, sometimes with the assistance of a collaborator or "ghostwriter". (shrink)

Efforts to apply the principle of proportionality to criminal sentences are notoriously problematic. But even though they are daunting, only a few legal philosophers believe we should give up trying to do so. Perhaps we can make progress overcoming some of the many legal difficulties by attending to how the principle is applied in non-legal contexts—that is, in contexts I call personal life. Proportionality, I believe, is an attractive principle in penal sentencing because it is an attractive principle (...) in ordinary situations in which persons are sanctioned for wrongdoing. I briefly mention several familiar non-legal contexts in which sanctions have recently been imposed on celebrities or public figures for real or perceived wrongdoing. My hope is that sensitivity to how the principle of proportionality is interpreted in these contexts might facilitate efforts to apply this principle to sentencing domains. At first glance, proportionality as applied in non-legal contexts appears to differ from its penal analogue. I describe some of these alleged differences. Among the foremost is that judgments of proportionality in personal life often respond to how the transgressor has behaved apart from the particular incident that has attracted media attention. Penal sanctions, by contrast, are said to be imposed only for the particular crime charged. I argue that this difference is more apparent than real. I conclude that we can reach a few modest insights about how to apply the principle of proportionality in criminal sentencing by attending to its counterpart in personal life. (shrink)

Marya Schechtman has raised a series of worries for the Psychological Continuity Theory of personal identity (PCT) stemming out of what Derek Parfit called the ‘Extreme Claim’. This is roughly the claim that theories like it are unable to explain the importance we attach to personal identity. In her recent Staying Alive (2014), she presents further arguments related to this and sets out a new narrative theory, the Person Life View (PLV), which she sees as solving the (...) problems as well as bringing other advantages over the PCT. I look over some of her earlier arguments and responses to them as a way in to the new issues and theory. I argue that the problems for the PCT and advantages that the PLV brings are all merely apparent, and present no reason for giving up the former for the latter. (shrink)

In this article I discuss the philosophy of John MacMurray, and in particular, his little-examined writings on discipline and emotion education. It is argued that discipline is a vital element in the emotion education MacMurray thought central to learning to be human, because for him it takes concerted effort to overcome the human tendency toward egocentricity. It is maintained that MacMurray's philosophy of education is of contemporary significance for at least two reasons. On the one hand it suggests an alternative (...) vision for humanistic education. While liberal educationists such as Oakeshott and Peters stressed that the pursuit of knowledge and understanding was the main way in which persons could develop their humanity MacMurray instead emphasised that persons can only learn to become human by pursuing other-centred relationships. On the other hand his philosophy can also reveal the limitations in much contemporary debate in emotion education which critics (such as Ecclestone and Clack) suggest increasingly aims at little more than helping pupils feel better about themselves. According to MacMurray a genuine emotion education can enlarge humanity by supporting persons to feel and act for the sake of others rather than think about themselves. Despite sympathy for MacMurray's account of the purposes of education it is nonetheless concluded that the pursuit of knowledge as an end in itself does not necessarily constitute a negative expression of human agency (as MacMurray asserts)—but rather that the disciplined pursuit of knowledge may also form part of any education concerned to enrich human life. The main attention is focused on time allocation for work and personal life in this article. The research consists of four parts. The first part of this article analyses the theoretical aspects of time allocation for work and personal life. The second part of the article justifies the methodology of the research. In the third part of the article, the time allocation for work and personal life is analysed. Finally, the discussion about time allocation (...) for work and personal life is provided. Having conducted the empirical analysis, the following conclusions can be drawn. The experts defined the concept of the balance between work and personal life in terms of time: the balance between work and personal life is achieved when a person feels consistency and harmony between work and personal life. In terms of time, sleep, work and personal life must be each given 8 h a day, proportionately. However, it has been empirically investigated that the most important area of time allocation for self-employed persons is work. Self-employed persons in Lithuania spent 22.5% of time a day on work, and 77.5% on personal life. Furthermore, in the end of this article, the main conclusions and possible future directions of the research are provided. (shrink)

Embodiment approaches to cognition and emotion have put forth the idea that the way we think and talk about affective events often recruits spatial information that stems, to some extent, from our bodily experiences. For example, metaphorical expressions such as “being someone’s right hand” or “leaving something bad behind” convey affectivity associated with the lateral and sagittal dimensions of space. Action tendencies associated with affect such as the directional fluency of hand movements (dominant right hand-side – positive; non-dominant left hand-side (...) – negative) and approach-avoidance behaviors (forward – positive; backwards – negative) might be mechanisms supporting such associations. Against this background, experimental research has investigated whether positive and negative words are freely allocated into space (e.g., close or far from one’s body) or resonate with congruent (vs. incongruent) predefined manual actions usually performed by joysticks or button presses (e.g., positive - right; negative - left, or vice versa). However, to date, it is unclear how the processing of affective concepts resonate with directional actions of the whole body that are performed freely within a context enabling lateral and sagittal movements simultaneously. Accordingly, 67 right-handed participants were to freely step on an 8-response pad (front, back, right, left, front-right, front-left, back-right, or back-left) after being presented in front of them valence-laden personal life-events submitted before the task (e.g., words or sentences such as “graduation” or “birth of a child”). The most revealing finding of this study indicates that approach-avoidance behaviors and space-valence associations across laterality are interwoven during whole body step actions: Positive events induced steps highly biased to front-right whereas negative events induced steps highly biased to back-left. Counterproductive work behavior is one of the most common behavioral decisions of employees in the workplace that negatively impacts the sustainable development of enterprises. Previous studies have shown that individuals make CWB decisions for different reasons. Some individuals engage in CWB due to cognitive factors, whereas others engage in CWB in response to leadership behaviors. The conservation of resources theory holds that individuals have the tendency to preserve, protect and acquire resources. When experiencing the loss of resources, individuals will show (...) irrational and aggressive behaviors in order to regain resources. When obtaining resources, individuals’ tension and pressure will be relieved. To maintain or continue obtaining resources, individuals will show more positive work attitudes and behaviors. Therefore, using the COR theory as the main theoretical framework, this study explores a serial mediation model between family supportive leadership and CWB through work-family conflict and moral disengagement, moderated by personal life attribution. A three-wave survey of 251 medical workers from three hospitals found that family supportive leadership can reduce employees’ perceived work-family conflict, which leads to less moral disengagement, resulting in lower CWB. Personal life attribution strengthens the negative indirect effect of family supportive leadership on CWB by reinforcing the negative association between family supportive leadership and work-family conflict. This study uses the COR theory to explore the mechanism and boundary conditions of family supportive leadership and CWB from the perspective of negative work-family relationship, which enrichis the research content of existing theories. Moreover, this study has important guiding significance for managers to take effective measures to reduce CWB. (shrink)

There are many touch points between the work of Jacques Derrida and René Girard. To me, as a student of literature, these two writers particularly stand out as great readers or great exegetes.1 The way they handle and combine texts, the way they dare to break with reading conventions, has proved to be really fruitful.Some time ago I watched a documentary about Derrida, made by Kirby Dick and Amy Ziering Kofman, published in 2002, carrying the simple title Derrida.2 I found (...) that this experimental documentary at the same time reflected Derrida’s many reservations, not to say his skepticism, as to the possibility of making portraits—and—proved to be far more revealing, even intimate, than a conventional documentary... The longitudinal, qualitative study aimed to explore the lived experiences of Chinese university emerging adults by analyzing their personal life stories, reflective journals, and semi-structured interview data collected over a 2-year period. A qualitative content analysis was used to identify five themes: maturity, academic performance, interpersonal communication skills, social support network, and sense of loss. The study found that the growth in emerging adulthood was dynamic, positive, and multifaceted. The study demonstrated that writing personal life stories, (...) as a practice of meaningful literacy instruction in EFL contexts, helped students to record a memorable past, reconcile with the past, and strive for personal growth. These findings suggest that emerging adults’ personal growth be stressed in foreign language teaching to promote Chinese university emerging adults’ growth and development. It is also suggested that personal life stories be used in foreign language teaching under the guidance of meaningful literacy instruction. (shrink)

This essay reviews John Gardner’s recent books, From Personal Life to Private Law, and Torts and Other Wrongs. Both books offer profound insights into private law’s concerns with justice and our reasons for action. The essay focuses on Gardner’s continuity thesis, and in particular on his idea that a third party may act on behalf of a wrongdoer as her delegee. Three settings are considered. First, I will discuss settings in which the state or another third party acts (...) to remedy a wrong without the wrongdoer’s consent. Second, I will review settings in which the legal remedies at issue – e.g., general damages or punitive damages – may not fit well with the idea that the state is acting on behalf of a wrongdoer. Third, I will analyze settings in which the state may be acting on behalf of right holders, yet still be concerned with the continuity thesis. Assessing each of these contexts offers further insights into the purpose of private law remedies. (shrink)

This article argues that John Gardner’s theory of corrective justice in _From Personal Life to Private Law_ relies on an overly narrow account of wrongdoing, one that it too heavily influenced by law to capture the broader conception of corrective justice that is his topic. I will suggest that these problems are avoided by a reconciliation theory of corrective justice.

As science focuses exclusively on the physical, it seems to assume that the brain has a key role in the origin if not also the constitution of our consciousness; and thus the destruction of the brain, the nervous system, and the body makes it pointless or even absurd to think of any personal consciousness after death. But one need not be convinced by this. However, any effort to investigate a possible post-mortem life depends on forming a coherent conception (...) of what such a life could be. Can we speak, without incoherence or contradiction, of a person continuing to exist after death in a disembodied state? Our concern in this study lies here. Based on Lund’s view, we will present and defend an argument that one can conceive of a self who is fully embedded in the natural world and deeply embodied in a physical organism, and yet could have a rich variety of experiences in an afterworld encountered after death. In this theory, the close association of the mental and the physical is due to a causal connection - a connection that fails to establish that the physical brings the mental into existence and is compatible with theories that the source of consciousness is not in the brain. The article provides an insight into the interrelation between the worldview and personal meaningful orientations in the context of the modern digital era. The purpose of the article is to investigate the process of generating personal ontology with due regard to personal meaning-making, which involves considering three groups of issues. Firstly, attention is focused on understanding the complexity of the modern epoch against the background of the technological revolution and the effects of virtual imitation of reality, which (...) may determine the worldview. Secondly, an effective insight into life-meaning orientations involves reviewing methodological approaches. Thirdly, the article considers the basic paradigms of life choices including the pragmatic option for self-determination, retrospective reflection based on historical-philosophical inquiry, the paradigm of genetic determination of human behavior and decision-making, and an opposing existential paradigm, which identifies proper life orientations. The study refers to enactivism as a methodological tool, according to which, changes in external circumstances generated by the subject may effect the structure of semantic regulations. The authors come up with an innovative approach to investigating the ways in which the meanings of personal ontology are shaped in the context of complexity and virtualization of the modern world. The idea of the ambivalence of life-purpose relfection is justified. The authors come to a conclusion that structuring personal ontology depends on processing the main tendencies of the epoch in the domain of personal reflection, which is based on one’s inner world and connected with goal-setting and shaping one’s life-project. Various debates on the desirability and rationality of life-extending enhancements have been pursued under the presupposition that a generic psychological theory of personal identity is correct. I here discuss how the narrative approach to personal identity can contribute to these debates. In particular, I argue that two versions of the narrative approach offer good reasons to reject an argument against the rationality of life-extending enhancements.

In this paper, relying on both phenomenology and psychoanalysis, I introduce the concept of transbodily intentionality with the aim of exploring the significance of bodily expression for subjective constitution. The role of the body for the constitution of subjective experience becomes increasingly important in phenomenological analysis. This faces us with the challenge of understanding the intersubjective relevance of bodily processes together with the genetic turn of phenomenology. On this background, the revaluation of the concept of gesture comes into light. What is a person? This fundamental question is a perennial concern of philosophers and theologians. As persons we are irreducibly unique and essentially relational. In many contexts individual uniqueness has been accentuated at the expense of communal relationality. Our age has been marked by the loss of deep and meaningful relations to one another, and still more dramatically to the earth and its living creatures. The cosmological dimension of human personhood, that is, has been largely obscured. This chapter argues that our age has been marked increasingly by anesthetizing, alienating, and anonymizing tendencies. It proposes three (...) commensurate responses: aestheticization, or embodied philosophical knowing that remains faithful to the earth; anacarnation, or willful return to the wonders of embodied life, purged of romantic sentimentality; and attestation, or speaking up on behalf of the haecceitas or thisness of living creatures systematically instrumentalized for profit and pleasure. Together these responses help us to regain touch with animality by embracing the earth that hosts us, thus becoming more gracious guests, and to become more fully human by becoming better hosts to the multitude of earth's creatures, whose lives hang in the balance. A life of the mind can be lived only by creatures who know that they have minds. We call these creatures “persons,” and currently, all such persons THAT we know OF are “alive” in the biological sense. But are there, or could there be, either in the future or elsewhere in the universe, creatures with “a life of the mind” that are not “alive” in the sense that we humans usually understand this term today?

In a recent paper, Guy Kahane asks whether God’s existence is something we should want to be true. Expanding on some cryptic remarks from Thomas Nagel, Kahane’s informative and wide-ranging piece eventually addresses whether personal anti-theism is justified, where personal anti-theism is the view that God’s existence would make things worse overall for oneself. In what follows, I develop, defend, but ultimately reject the Meaningful Life Argument, according to which if God’s existence precludes the realization of certain (...) goods that seem to an agent to constitute a meaningful life, it is rational for an agent both to believe that personal anti-theism is true and to prefer that God not exist. The paper proposes to base the notion of the significance of life on the grounds of the singularity of each person as a psychical subject, i.e. personal singularity. No two persons are alike; each one of us, as a person, is intrinsically different from every other person. This personal singularity has a universal significance, namely, it makes a universal difference, whether or not this difference is distinct and acknowledged. Because morality and the significance of a person's (...) class='Hi'>life both rely upon personal singularity, there is an inseparable connection between morality and the significance of a human life. Nevertheless, as relying upon personal singularity, there is no insignificant or meaningless life, for a person's life has a universal significance whatever the actions of that person may be. Immoral actions or behavior do not reflect or express the personal singularity of an agent, whereas moral ones reflect or express this singularity. There is more to personal singularity and the significance of life than morality. As singularity is not subject to any comparison or competition, personal singularity implies that the life of one person is not more significant than the life of any other person. Thus, in my view, the significance of life is strictly egalitarian. (shrink)

There is growing public interest in developing biomedical technologies capable of extending the human lifespan. This chapter discusses the desirability of a substantial life extension with regard to its implications for personal identity over time. The possibility of significant lifespan extension involves two different personal‐identity questions. First, it raises the question of whether one is identifiable as the very same person throughout a lifetime; secondly, it challenges our self‐conception. The chapter describes the way in which personal (...) identity as “sameness” might be affected by the prospect of substantial life extension. It then focuses on the significance of the conception of personal identity as “selfhood” for radically extended lifespans. Finally, the chapter argues that a substantial life extension raises important concerns about the continuity of one's identity over time and is not straightforwardly desirable for the individual. PREFACE. THE Author of this very practical treatise on Scotch Loch - Fishing desires clearly that it may be of use to all who had it. He does not pretend to have written anything new, but to have attempted to put what he has to say in as readable a form as possible. Everything in the way of the history and habits of fish has been studiously avoided, and technicalities have been used as sparingly as possible. The writing of this (...) book has afforded him pleasure in his leisure moments, and that pleasure would be much increased if he knew that the perusal of it would create any bond of sympathy between himself and the angling community in general. This section is interleaved with blank shects for the readers notes. The Author need hardly say that any suggestions addressed to the case of the publishers, will meet with consideration in a future edition. We do not pretend to write or enlarge upon a new subject. Much has been said and written-and well said and written too on the art of fishing but loch-fishing has been rather looked upon as a second-rate performance, and to dispel this idea is one of the objects for which this present treatise has been written. Far be it from us to say anything against fishing, lawfully practised in any form but many pent up in our large towns will bear us out when me say that, on the whole, a days loch-fishing is the most convenient. One great matter is, that the loch-fisher is depend- ent on nothing but enough wind to curl the water, -and on a large loch it is very seldom that a dead calm prevails all day, -and can make his arrangements for a day, weeks beforehand whereas the stream- fisher is dependent for a good take on the state of the water and however pleasant and easy it may be for one living near the banks of a good trout stream or river, it is quite another matter to arrange for a days river-fishing, if one is looking forward to a holiday at a date some weeks ahead. Providence may favour the expectant angler with a good day, and the water in order but experience has taught most of us that the good days are in the minority, and that, as is the case with our rapid running streams, -such as many of our northern streams are, -the water is either too large or too small, unless, as previously remarked, you live near at hand, and can catch it at its best. A common belief in regard to loch-fishing is, that the tyro and the experienced angler have nearly the same chance in fishing, -the one from the stern and the other from the bow of the same boat. Of all the absurd beliefs as to loch-fishing, this is one of the most absurd. Try it. Give the tyro either end of the boat he likes give him a cast of ally flies he may fancy, or even a cast similar to those which a crack may be using and if he catches one for every three the other has, he may consider himself very lucky. Of course there are lochs where the fish are not abundant, and a beginner may come across as many as an older fisher but we speak of lochs where there are fish to be caught, and where each has a fair chance. Again, it is said that the boatman has as much to do with catching trout in a loch as the angler. Well, we dont deny that. In an untried loch it is necessary to have the guidance of a good boatman but the same argument holds good as to stream-fishing... (shrink)

This paper offers a new philosophical account of vocations as deeply personal but at the same time also communal and generational forms of multimodal intending. It provides a reconstruction and a systematic development of Edmund Husserl’s scattered discussions on vocations. On these grounds, the paper argues that vocational life is a general human possibility and not determined by any set of material values, religious, epistemic or moral. Rather, vocations are distinguished from other complexes of intentional acts and attitudes (...) by certain structural features of their core valuations and volitions. (shrink)
