The text tries to make plausible the necessity in every thought of time to think an un-time—a 'field' without the form of time that only allows for conceiving of time as a form.

PURPOSE—A substantial fraction of the observations made by clinicians and entered into patient records are expressed by means of negation or by using terms which contain negative qualifiers (as in “absence of pulse” or “surgical procedure not performed”). This seems at first sight to present problems for ontologies, terminologies and data repositories that adhere to a realist view and thus reject any reference to putative non-existing entities. Basic Formal Ontology (BFO) and Referent Tracking (RT) are examples of such paradigms. The (...) purpose of the research here described was to test a proposal to capture negative findings in electronic health record systems based on BFO and RT. METHODS—We analysed a series of negative findings encountered in 748 sentences taken from 41 patient charts. We classified the phenomena described in terms of the various top-level categories and relations defined in BFO, taking into account the role of negation in the corresponding descriptions. We also studied terms from SNOMED-CT containing one or other form of negation. We then explored ways to represent the described phenomena by means of the types of representational units available to realist ontologies such as BFO. RESULTS—We introduced a new family of ‘lacks’ relations into the OBO Relation Ontology. The relation lacks_part, for example, defined in terms of the positive relation part_of, holds between a particular p and a universal U when p has no instance of U as part. Since p and U both exist, assertions involving ‘lacks_part’ and its cognates meet the requirements of positivity. CONCLUSION—By expanding the OBO Relation Ontology, we were able to accommodate nearly all occurrences of negative findings in the sample studied. (shrink)

This study examines the public's and physicians' willingness to support deception of insurance companies in order to obtain necessary healthcare services and how this support varies based on perceptions of physicians' time pressures. Based on surveys of 700 prospective jurors and 1617 physicians, the public was more than twice as likely as physicians to sanction deception (26% versus 11%) and half as likely to believe that physicians have adequate time to appeal coverage decisions (22% versus 59%). The odds of public (...) support for deception compared to that of physicians rose from 2.48 to 4.64 after controlling for differences in time perception. These findings highlight the ethical challenge facing physicians and patients in balancing patient advocacy with honesty in the setting of limited societal resources. (shrink)

This study compared whole body kinematics of the clean movement when lifting three different loads, implementing two data analysis approaches based on principal component analysis. Nine weightlifters were equipped with 39 markers and their motion captured with 8 Vicon cameras at 100 Hz. Lifts of 60, 85, and 95% of the one repetition maximum were analyzed. The first PCA analyzed variance among time-normed waveforms compiled from subjects and trials; the second PCA analyzed postural positions compiled over time, subjects and trials. (...) Load effects were identified through repeated measures ANOVAs with Bonferroni-corrected post-hocs and through Cousineau-Morey confidence intervals. PCAtrial scores differed in the first and fifth principal component, suggesting that increased barbell load produced higher initial elevation, lower squat position, wider feet position after squatting, and less inclined arms. PCAposture revealed significant timing differences in all components. We conclude, first, barbell load affects specific aspects of the movement pattern of the clean; second, the PCAtrial approach is better suited for detecting deviations from a mean motion trajectory and its results are easier to interpret; the PCAposture approach reveals coordination patterns and facilitates comparisons of postural speeds and accelerations. The paradigm of referent tracking is based on a realist presupposition which rejects so-called negative entities (congenital absent nipple, and the like) as spurious. How, then, can a referent tracking-based Electronic Health Record deal with what are standardly called ‘negative findings’? To answer this question we carried out an analysis of some 748 sentences drawn from patient charts and containing some form of negation. Our analysis shows that to deal with these sentences we need to introduce a new ontological relationship (...) between a particular and a universal, which holds when no instance of the universal has a specific qualified ontological relation with the particular. This relation is found to be able to accommodate nearly all occurrences of negative findings in the examined sample, in ways which involve no reference to negative entities. (shrink)

Since Barry Stroud's classic paper in 1968, the general discussion on transcendental arguments tends to focus on examples from theoretical philosophy. It also tends to be pessimistic, or at least extremely reluctant, about the potential of this kind of arguments. Nevertheless, transcendental reasoning continues to play a prominent role in some recent approaches to moral philosophy. Moreover, some authors argue that transcendental arguments may be more promising in moral philosophy than they are in theoretical contexts. Against this background, the current (...) volume focuses on transcendental arguments in practical philosophy. Experts from different countries and branches of philosophy share their views about whether there are actually differences between "theoretical" and "practical" uses of transcendental arguments. They examine and compare different versions of transcendental arguments in moral philosophy, explain their structure, and assess their respective problems and promises. This book offers all those interested in ethics, meta-ethics, or epistemology a more comprehensive understanding of transcendental arguments. One must keep in mind, however, that “we (...) know that historically there have been times where those participating in discussions about ethics disagree deeply about theory, but nevertheless come to important and even broad agreement about applied or practical ethics” (179). The aim of Camosy’s book is to sketch the various areas of agreement and disagreement between Peter Singer and Catholic moral theology as well as the possibilities of working together.There are issues even about the subject of abortion on which Singer and the Church agree: that moral relativism is wrong; that it is seriously wrong to kill a person; that the right to privacy (see Roe vs. Wade) does not apply to acts harming others; and that the right to abortion is not a constitutional matter (chapter 1). Both positions see a connection between abortion and infanticide, but both draw different conclusions. The disagreements between them are about who is to count as a person, which Camosy comments on in the rest of chapter 1 (27–37). In the area of euthanasia, the Church and Singer share some skepticism about brain death (chapter 2). Camosy discusses the church’s position on one’s moral status at the end of life and the Roman Catholic understandings of ordinary and extraordinary means, acts, and omissions. Commenting on public policy in that field, Camosy gives some useful and convincing illustrations of the slippery slope effect in different countries that have legalized active euthanasia or assisted suicide (68–81).With regard to problems of killing, however, Helga Kuhse’s The Sanctity of Life Doctrine in Medicine (Oxford University Press, 1987) should perhaps have been considered. On the subject of acting and refraining, I would recommend Dieter Birnbacher’s Tun und unterlassen (Reclam 1995).Commenting on Singer’s championing of the moral status of nonhuman animals, Camosy points to elements in the Christian tradition that may support Singer’s issue of animal liberation (chapter 3). I wonder why the discussion concentrates on domestic animals and the problems of eating meat or [End Page 225] vegetarianism but omits problems of environmental ethics (e.g., ecological balance). Would the aim of avoiding animal harm include saving animals from predators? And if some animals are to be regarded as persons, we may get in trouble with our basic conviction of the equality (of the dignity) of human beings—as the debate on the margins of human life shows.Duties to the poor are not in dispute except for “partial preferences” (166) for members of our family, kinship, or country (chapter 4). Speaking of “partiality” in this context is, however, a bit misleading. Since no one can care for all people, preferences of an ordo caritatis (order of love) are a necessary part of a system of coordination from which—ideally—all humans can benefit. (Recall Augustine in De doctrina Christiana, 1.28–29: “The interests of society, however, and its common bonds will be best conserved if kindness be shown to each individual in proportion to the closeness of his relationship.”) Chapter 5, which compares Singer’s ethical theory with Catholic moral theology, would need more discussion (e.g., on double effect, object, and act), which I cannot cover within the limits of this review. Peer review is a widely accepted instrument for raising the quality of science. Peer review limits the enormous unstructured influx of information and the sheer amount of dubious data, which in its absence would plunge science into chaos. In particular, peer review offers the benefit of eliminating papers that suffer from poor craftsmanship or methodological shortcomings, especially in the experimental sciences. However, we believe that peer review is not always appropriate for the evaluation of controversial hypothetical science. We argue that (...) the process of peer review can be prone to bias towards ideas that affirm the prior convictions of reviewers and against innovation and radical new ideas. Innovative hypotheses are thus highly vulnerable to being “filtered out” or made to accord with conventional wisdom by the peer review process. Consequently, having introduced peer review, the Elsevier journal Medical Hypotheses may be unable to continue its tradition as a radical journal allowing discussion of improbable or unconventional ideas. Hence we conclude by asking the publisher to consider re-introducing the system of editorial review to Medical Hypotheses. (shrink)

This second collection of studies by Peter Golden continues his explorations of the Türk Empire (mid-sixth to mid-eighth centuries), the stateless polities that appeared after its collapse, and of the Khazar Qaghanate (mid-seventh century to ca. 965-969), its imperial successor state in the western Eurasian steppes. Building on earlier traditions, the Türks created a paradigm for state building in the Eurasian steppes that persisted into the early modern era. Examined here are issues relating to the rise of the Türks (...) and their systems of governance, the institution of slavery and its role in Turkic nomadic societies, and the cultural interactions between the Turkic nomads of Pre-Chinggisid Eurasia and neighbouring settled societies such as the Kievan Rus', Georgia and the Islamic world. Particular studies deal with the hitherto neglected role of Khazars in the Islamic ghulâm (slave soldier) system, the unique traditions of sacral rulership among the Khazars, and their conversion to Judaism set within a larger Eurasian context. The article starts from an examination of the authorship of the ‘Geleitwort’, the programmatic statement which appeared in the Archiv für Sozialwissenschaft when it came under new editors in 1904. Recently scholars have begun to view it as an important text by Max Weber recovered from obscurity, but this is a mistake. Examination of major contemporary works by Weber and Werner Sombart – the obvious co-author – as well as the first public disclosure of an entirely new MS. by (...) Weber, show that in all probability the text was drafted by Sombart and then revised fairly lightly by Weber. This story of a combined, if unequal, authorship leads into two broader seams of intellectual history: the relationship between Weber and Sombart, and the history of the Archiv as a journal. An unusual starting point thus casts fresh and unexpected light on some of the most central figures and episodes in German social science at the beginning of the 20th century, not least Weber's seminal essay on “Objectivity” in social science. ☆ This paper relies on intellectual interchange and the generosity of colleagues to a quite unusual degree. Available here for the first time in English, "Reality and Its Order" is a remarkable philosophical text by Werner Heisenberg, the father of quantum mechanics and one of the leading scientists of the 20th century. Written during the wartime years and initially distributed only to his family and trusted friends, the essay describes Heisenberg’s philosophical view of how we understand the natural world and our role within it. In this volume, the essay is introduced by the physicist Helmut Rechenberg (...) and annotated by the science historian Ernst Peter Fischer. The content, particularly within its historical context, will be of great interest to many physicists, philosophers and historians of science. (shrink)

In a recent article published in this journal, Kris McDaniel proposes a variant of Peter van Inwagen’s argument against the principle of sufficient reason that makes crucial use of plural grounding. In this response paper I object to McDaniel’s argument. I argue that there is no notion of plural grounding available that is both irreflexive in the sense required for the argument to go through and general enough to formulate the principle of sufficient reason as proposed by McDaniel.

Dabei lassen sich drei Phasen unterscheiden: eine frühe Phase, in der Wust nach seiner Abkehr von der neukantianischen Philosophie eine lebensphilosophisch inspirierte Kultur- und Geschichtsmetaphysik vertritt, eine mittlere seiner metaphysischen Anthropologie sowie eine Spätphase, die vornehmlich existenzphilosophisch geprägt ist. Alongside the 'critical theory' of the Frankfurt School, West Germany was also home to another influential Marxist current known as the Marburg School. In this volume, Marburg disciple Lothar Peter traces the school's history and situates it in the political discourse and developments of its time. The renowned political scientist Wolfgang Abendroth plays a large role, but unlike most histories of the Marburg School Peter also takes the sociologists Werner Hofmann and Heinz Maus into account as well (...) as their many students and successors. They were united by the conviction that teaching and scholarship must necessarily be tied to the practical goal of transforming society - an approach that met with considerable opposition in the harshly anti-Communist atmosphere of the period. This article first builds upon precedent work--including that of John M. Werner, Kerry S. Walters, and James Dye-to articulate a more complete understanding of David Hume's influence upon North American colonial and early U.S. thought. Secondly, through a comparison with arguments concerning miracles developed by early American deists Elihu Palmer, Ethan Allen, and Thomas Paine, the article clarifies and evaluates Hume's arguments against the rationality of belief in miracles. It judges Hume's arguments to be superior. Thirdly, the article uses (...) this comparison and evaluation to describe the nature of Humean skepticism. (shrink)

In this paper I explore the character and role of stereoformulas and models of the atom that appeared in the early history of stereochemistry, including those of Jacobus Henricus van't Hoff, Aemilius Wunderlich, Johannes Wislicenus, Victor Meyer, Arthur Hantzsch, Alfred Werner, and Hermann Sachse. I argue that stereochemists constructed and used stereoformulas in a pragmatic way that ignored the physical implications of the spatial distribution of valence, and that the models of the atom were created to reconcile the physically (...) curious concept of valence with known physical laws. Although such models were explanatory at a deeper level, they had little impact on the theory and practice of chemistry, and were not serious attempts to reduce chemical theory to physical laws. Dieser Beitrag präsentiert einige Betrachtungen über die Rolle des Bewusstseins als eines in der Natur privilegierten Zustands, der mit Implikationen für die Ethik behaftet ist. Besonders im modernen Diskurs über das Bewusstsein beim Menschen oder beim Tier nach Thomas Nagel oder Peter Singer stößt man auf Diskussionen über die Rolle des Bewusstseins als eines wichtigen irreduktiblen und „höheren” Phänomens, das in Bezug steht zur Autorität der ersten Person in der Epistemologie sowie zu speziellen Vorrechten in der Bioethik. Insbesondere tierisches (...) Bewusstsein wird oft als ein „niedrigerer” Zustand in der „Naturhierarchie” bewertet. In der Bioethik wurde Bewusstsein mit Eigenschaften wie zukünftige Entscheidungsfähigkeit, Subjektivität, Empfindungsvermögen oder Schmerzfähigkeit in Verbindung gebracht. Mehr noch: Diese Elemente dienten als Kriterien, um den außerordentlichen „moralischen Status” bestimmter Lebewesen zu bestätigen, so etwa den Status der als „höhere Wesen” geltenden+ Menschenaffen oder anderer „höherer”, mit einem Bewusstsein ausgestatteter Tiere im Sinne von „Lebenssubjekten” , oder auch den Status von Schmerz empfindenden Tieren . Andererseits streiten einige analytische Philosophen die Existenz eines „höheren” Bewusstseins bei Tieren aus verschiedenen theoretischen Gründen ab . Dennoch vertreten sowohl die Befürworter als auch die Gegner der These von der Existenz tierischen „Bewusstseins” die Ansicht, dass Wesen, die über ein Bewusstsein verfügen, in der Ethik mit Vorrechten ausgestattet seien. Vor diesem Hintergrund greifen moderne Ethiker und Philosophen, die sich mit der Frage des Bewusstseins bei Mensch und Tier beschäftigen, zurück auf das Konzept der „Naturhierarchie”, die in Termini „höher/niedriger” usw. zum Ausdruck kommt. Kurz gesagt, ist damit in hierarchischen Termini von den Beziehungen zwischen natürlichen Wesen wie Pflanzen, Tieren und Menschen die Rede . Dies impliziert zunächst folgende theoretische Frage: Was für epistemologische oder ontologische Gründe berechtigen, mit den Termini einer „Naturhierarchie” zu sprechen? Die zweite, praktischere Frage lautet: Wenn es möglich ist, in dieser Weise zu sprechen, ist dann auch die Ethik dazu berechtigt? Diese und ähnliche Fragen werden im Beitrag aus der Perspektive der modernen wie auch der kantischen Epistemologie erörtert. Im ersten Teil wird an den großen Einfluss zweier traditioneller metaphysischer Denkmuster erinnert – der Seelenlehre des Aristoteles und der cartesianischen Sichtweise des Menschen als einer Maschine, die ihren Niederschlag in der Naturphilosophie allgemein fanden und sich auch auf die moderne neurozentrische Philosophie der Vernunft auswirken. Der zweite Teil präsentiert bestimmte epistemologische und ontologische Probleme und die dazu existierenden Reflexionen. Im dritten Teil wird an einem Beispiel gezeigt, wie eine hierarchische Ordnung in die Praxis umgesetzt wird . Das ausschlaggebende Ergebnis ist die Einsicht, dass es äußerst schwierig ist, Bewusstsein als den Gipfel einer „natürliche Hierarchie” der Organismen zu rechtfertigen. (shrink)

ABSTRACT This article draws attention to a neglected aside in the debate over whether Marx fathered an illegitimate child. In 1898, Louise Freyberger wrote a controversial letter in which she claimed Engels had confessed on his deathbed that Frederick Demuth was Marx’s son. The letter, however, only came to light in 1962 when Werner Blumenberg first discussed it in his biography of Marx. Blumenberg’s revelation provoked an on-going debate over the plausibility of Freyberger’s allegations. Several scholars went so far (...) as to dismiss the letter as a forgery, noting that it only existed in the form of a typed copy that Blumenberg had discovered in the archives of the International Institute of Social History (IISH). In 1963, Jacob-Peter Mayer published a review of Blumenberg’s biography in which he stated he had known of the letter in the 1930s, but few if any scholars took note of Mayer’s claim. In 2019, a copy of the letter in Mayer’s own hand was found among his papers. This article argues that Mayer copied his version, not from the IISH typescript, but from the original letter, which he had come across while working in the archives of the German Social Democratic Party in the 1930s. Hegel's classic _Phenomenology of Spirit _is considered by many to be the most difficult text in all of philosophical literature. In interpreting the work, scholars have often used the _Phenomenology_ to justify the ideology that has tempered their approach to it, whether existential, ontological, or, particularly, Marxist. Werner Marx deftly avoids this trap of misinterpretation by rendering lucid the objectives that Hegel delineates in the Preface and Introduction and using these to examine the whole of the _Phenomenology_. Marx considers (...) selected materials from Hegel's text in order both to clarify Hegel's own view of it and to set the stage for an examination of post-Hegelian philosophy. The primary focus of Marx's book is on the account. Hegel gives of the phenomenological journey from natural consciousness to philosophical wisdom. In showing that Hegel's many statements concerning consciousness 'finding itself' or 'knowing itself' in its world can be understood as discovering the rationality of the conditioning world, Marx offers a solution to several sets of interrelated problems that have troubled students of Hegel. His book contains valuable analyses of the relation between Hegel's thought and that of Descartes and Kant as well as that of Karl Marx, and it also sheds considerable light on the question of the internal unity or coherence of the _Phenomenology_. ROSE Josiah ober has taken on the very ambitious task of analyzing a vast swath of ancient Greek history— precisely the periods—as his opening quotation from Byron (1) implies—most admired by those who have devoted any time to the study of Greek antiquity: Fair Greece! sad relic of departed worth! Immortal, though no more! Though fallen, great!1 At the same time, again (...) as suggested by the repetition of Byron’s lines (206, also mentioned on 293), Ober’s book falls within the large category of celebratory works about ancient Greece—like Werner Jaeger’s once popular three volumes of Paideia or, at the outset of the twentieth century, Alfred Zimmern ’s The Greek Commonwealth.2 It does not, on the other hand, fit in with a plethora of relatively recent, relatively short (as opposed to George Grote’s twelve volumes) histories of Greece aimed at the potentially lucrative textbook market for general more comprehensive overviews of Greek civilization.3 As such, the basis on which Ober celebrates ancient Greece merits close scrutiny. history and the overriding thesis ober’s conception of “history” here is heavily weighted towards the theoretical elaboration and justification of an Josiah Ober, The Rise and Fall of Classical Greece (Princeton University Press 2015), hardback, 415 pages. Five initial chapters of a total of eleven are devoted to that task before five chronologically focused chapters, which offer a cursory romp through Greek history from ca. 1000 BCE to 334 BCE and some brief suggestions about the period down to the decisive takeover of Greece by Rome, usually dated to 31 BCE. The volume is capped by a final summary and overview chapter. Ober is admirably forthright about his agenda. Immediately in his preface he declares, “in states where citizens keep rulers in check, public authority protects individual rights and the rule of law pertains most of the time. These political conditions promote economic growth. The conjunction of democratic politics and a strong economy is, in practice, available only to affluent citizens of highly developed countries.... Democracy and growth define the normal, although not yet the usual, conditions of modernity” (xiii, my emphasis).4 This somewhat utopian conception of the present-day interface of democratic institutions and economic growth—posited as an unquestioned desideratum in sublime disregard of “ecology” in the literal sense5—underlies Ober’s whole project. While acknowledging the obvious negatives of ancient slavery,6 “denial of rights to women, and glorified war,” he argues “if we are interested in the conjunction of political and economic exceptionalism, we must start somewhere, and classical Greece was the society in which the wealth-and-democracy package first emerged in a form that can be studied in depth” (xv). Athenian democracy has been at the center of Ober’s impressive scholarly career at least since the publication of his study of fourth-century BCE Athenian rhetoric, Mass and Elite in Democratic Athens (Princeton 1989). “Athens” or “democracy” have featured in the titles of all his subsequent book publications7—not to mention the extraordinary output of more specialized essays in multiple venues. One overriding question about his latest book is whether the unique phenomenon of Athenian democracy is being unduly generalized to “Classical Greece.” 142 capitalism in “wealthy hellas”? The special focus of his interest here in ancient Greece, the “conjunction of political and economic exceptionalism,” is further clarified in his opening chapter which begins with the quotation from Byron cited above: “Byron’s vision of greatness was inspired by ancient Greek cultural and intellectual achievement: art and architecture, literature, visual and performance art, scientific and moral thought.... Hellas was great because of a cultural accomplishment that was supported by sustained economic growth. That growth was made possible by a distinctive approach to politics” (1–2). "Poetry does not impose, it exposes itself," wrote Paul Celan. Werner Hamacher's investigations into crucial texts of philosophical and literary modernity show that Celan's apothegm is also valid for the structure of understanding and for language in general. In _Premises_ Hamacher demonstrates that the promise of a subject position is not only unavoidable—and thus operates as a structural imperative—but is also unattainable and therefore by necessity open to possibilities other than that defined as "position," to redefinitions and unexpected transformations (...) of the merely thetical act. Wie kaum eine andere Materie in Deutschland ist der Verwaltungsrechtsschutz verfassungsrechtlich geprägt. In einer Rechtsordnung, in der das Diktum Fritz Werners vom Verwaltungsrecht als konkretisiertem Verfassungsrecht im Grundsatz nach wie vor gilt und als rechtsstaatlich-zivilisatorische Errungenschaft empfunden wird, muss dies für den Verwaltungsrechtsschutz – den gerichtlichen Rechtsschutz in Ansehung der öffentlichen Verwaltung – erst recht gelten. Das ist nicht nur das Produkt einer mehr oder weniger weit ausgreifenden Verfassungsexegese, sondern ein vielfältig abgesichertes Verfassungsgebot.

There are various perspectives from which the meaning of historicism can be understood. Historically, the interpretation of historicism has predominantly been interested in either questions concerning historical methodology, or the relationship between the natural and human sciences, or the normative consequences of historicism. My intention is not to cast doubt upon the legitimacy of these different research approaches, but rather to supplement them by confronting the meaning of historicism from the perspective of a different question. Did historicism in the late (...) 18th and the early 19th centuries formulate a notion of historical chance or of historical contingency, a notion of what is neither necessary nor impossible in history but rather the result of accident and chance? To answer this question, I begin with Reinhart Koselleck's interpretation of historicism presented in two rather short essays, "Der Zufall als Motivationsrest in der Geschichtsschreibung" and "Über die Verfügbarkeit von Geschichte". In the next step of my analysis, I confront Koselleck's interpretation of the historicist sensibility for contingency and chance with Odo Marquard's conceptual distinction between two notions of contingency and chance. This line of argumentation gives rise to a definition of historicism as a theoretical sensibility for the "fatefully accidental" (Marquard). I further support this claim with an analysis of Savigny's legal history, of Schleiermacher's theology and of the "anti-Faustian" (Werner Busch) art of Caspar David Friedrich. Historicism ultimately teaches us that history is never the exact outcome of the intentions of historical actors. Though human beings undeniably act in history, they cannot make history or at least cannot make it as they please. It is in this regard that I find, in my concluding remarks, Hermann Lübbe's description of historicism as a "sermon of human finitude" to be wholly accurate. (shrink)
