Two centuries after they were published, Kant's ethical writings are as much admired and imitated as they have ever been, yet serious and long-standing accusations of internal incoherence remain unresolved. Onora O'Neill traces the alleged incoherences to attempt to assimilate Kant's ethical writings to modern conceptions of rationality, action and rights. When the temptation to assimilate is resisted, a strikingly different and more cohesive account of reason and morality emerges. Kant offers a `constructivist' vindication of reason and a (...) moral vision in which obligations are prior to rights and in which justice and virtue are linked. O'Neill begins by reconsidering Kant's conceptions of philosophical method, reason, freedom, automony and action. She then moves on to the more familiar terrain of interpretation of the Categorical Imperative, while in the last section she emphasises differences between Kant's ethics and recent 'Kantian' ethics, including the work of John Rawls and other contemporary liberal political philosophers. The main purpose of the study is to analyze the feasibility and necessity of an EU Constitution. Briefly, the history of the draft constitution is as follows: The draft treaty aims to codify the two main treaties of the European Union - the Treaty of Rome of 1957 and the Treaty of Maastricht of 1992, as amended by the Treaty of Amsterdam (1997) and the Treaty of Nice (2001). The debate on the future of Europe is believed to have begun (...) with a speech by German Foreign Minister Joschka Fischer in Berlin in 2000. The process began after the Laeken Declaration, when the European Convention was set up, chaired by former French President Valerie Giscard d'Estaing, with the aim of drafting a constitution. The draft contract was published in July 2003. After lengthy discussions and debates over the proposal for qualified majority voting, the final text was approved in June 2004 and signed by representatives of the Member States on 29 October 2004. The failure of the treaty in France and the Netherlands is a serious blow to the European Union because these two countries are considered to be loyal supporters of the European project. The text of the treaty was subsequently rewritten by the Amato Group, officially the Active Committee on European Democracy (ACED), a group of high-ranking European politicians. During the German presidency of the Union, a new treaty was proposed - the Treaty of Lisbon - to replace the original draft of the Constitution. On 12 June 2008, the Lisbon Treaty was also rejected in a referendum in Ireland. But if we want to look beyond history, we can ask - Why does the EU need a Constitution and how can the Constitution be the roadmap to an advanced future for the EU? The answers to this question can be found by analyzing several directions (these are the main points of the article): historical reflexivity; socio-cultural analysis of the philosophical concepts of well-known political and social philosophers such as Immanuel Kant, John Locke; the modern constellation through the prism of Jürgen Habermas and the decision to make a text as a Constitution which its aim is to reach the starting point of an entire community like the EU. Since Donald Davidson issued his challenge to anticausalism in 1963, most philosophers have espoused the view that our actions are causally explained by the reasons why we do them. This Davidsonian consensus, however, rests on a faulty argument. Davidson’s challenge has been met, in more than one way, by anticausalists such as C. Ginet, G. Wilson, and S. Sehon. Hence I endeavor to support causalism with a stronger argument. Our actions are correlated with our motivating reasons; to wit, we often (...) do what we have reason to do. In yet other words, we are often rational. Our frequent rationality is easily explained if causalism is correct, but looks like a staggering coincidence otherwise. Anticausalism thus appears to be ill-equipped to account for the very existence of rational behavior, and so far no attempts in this direction have succeeded. (shrink)

In Seeing Things, Robert Hudson assesses a common way of arguing about observation reports called "robustness reasoning." Robustness reasoning claims that an observation report is more likely to be true if the report is produced by multiple, independent sources. Seeing Things argues that robustness reasoning lacks the special value it is often claimed to have. Hudson exposes key flaws in various popular philosophical defenses of robustness reasoning. This philosophical critique of robustness is extended by recounting five episodes in the history (...) of science (from experimental microbiology, atomic theory, astrophysics, and astronomy) where robustness reasoning is — or could be claimed to have been — used. Hudson goes on to show that none of these episodes do in fact exhibit robustness reasoning. In this way, the significance of robustness reasoning is rebutted on both philosophical and historical grounds. But the book does more than critique robustness reasoning. It also develops a better defense of the informative value of observation reports. The book concludes by relating insights into the failure of robustness reasoning to a popular approach to scientific realism called "(theoretical) preservationism." Hudson argues that those who defend this approach to realism commit similar errors to those who advocate robustness reasoning. In turn, a new form of realism is formulated and defended. Called "methodological preservationism," it recognizes the fundamental value of naked-eye observation to scientists — and the rest of us. (shrink)

Wolfson's systematic presentation of the philosophy of Spinoza has long been a classic. It is with pride that we make it available again in a one-volume edition.

The philosophy of religion as presented by Hermann Cohen and Paul Natorp, the founders and main representatives of the Marburg School of Neo-Kantianism, is an important and at the same time controversial part of their philosophical systems. The discussion around the problems of religion began within the Marburg School and still continues among those who study that School. The reason for this is that “fitting” philosophical thinking about the phenomenon of religion into the classical triad of any system (...) of philosophy, i. e. effectively formulating that phenomenon in logical concepts, ethical postulates and aesthetic principles touched the very foundations of that system. Drawing mainly on the rough notes and correspondence of Cohen and Natorp I argue that, in spite of internal and quite important differences over the problems of religion and its place in philosophical constructions, Cohen and Natorp, first, retained their commitment to critical idealism and remained loyal to their philosophical school to the end and, second, followed the principle of mutual respect, preserving their professional and human sympathy for each other. Besides, I substantiate my assertion that Marburg Neo-Kantians had different concepts of the special place of religion in the system of philosophy. The specific nature of this difference warrants the discussion not only of the boundary of reason and rationality but adds new dimensions to that boundary, filling it with content and thus broadening the very sphere of critical idealism. In the course of the discussion of the problems of religion, Paul Natorp and Hermann Cohen stake a claim to projects for the serious transformation of philosophy which they tried to implement in their later works. This paper sketches the antilogism of Christine Ladd-Franklin and historical advancement about antilogism, mainly constructs an axiomatic system Atl based on first-order logic with equality and the wholly-exclusion and not-wholly-exclusion relations abstracted from the algebra of Ladd-Franklin, with soundness and completeness of Atl proved, providing a simple and convenient tool on syllogistic reasoning. Atl depicts the empty class and the whole class differently from normal set theories, e.g. ZFC, revealing another perspective on sets and set theories. Two series of Dotterer (...) and the theorem proved by Russinoff are re-characterized in antilogistic formulas corresponding to the square of opposition and twenty-four moods of syllogism. Then the restricted equivalence between two forms of antilogism and minimal inconsistency is built up, implying the internal connection between antilogisms and minimal inconsistency and leaving two related conjectures not proved. Besides, this paper provides a new explanation for the reason why contrariety, subcontrariety, and subalternation and the nine special moods require the non-empty assumption. (shrink)

A cross-cultural examination of the well-known Hindu school of philosophy, Advaita Vedanta, in light of modern Western philosophy of religion. Western philosophy has long regarded Indian philosophy as its Other. Philosophy of religion, as we know it today, emerged in the West and has been shaped by Western philosophical and theological trends, while the philosophical tradition of India flowed along its own course until the late nineteenth century, when active, if tentative, contact was established between (...) the West and the East. This work argues that teleological motives lie at the heart of Kant's critical philosophy and that a precise analysis of teleological structures can both illuminate the basic strategy of its fundamental arguments and provide a key to understanding its unity. It thus aims, through an examination of each of Kant's major writings, to provide a detailed interpretation of his claim that philosophy in the true sense must consist of a teleologia rationis humanae. The author argues that Kant's critical (...) philosophy forged a new link between traditional teleological concepts and the basic structure of rationality, one that would later inform the dynamic conception of reason at the heart of German Idealism. The process by which this was accomplished began with Kant's development of a uniquely teleological conception of systematic unity already in the precritical period. The individual chapters of this work attempt to show how Kant adapted and refined this conception of systematic unity so that it came to form the structural basis for the critical philosophy. In _Freedom and the End of Reason_, Richard L. Velkley offers an influential interpretation of the central issue of Kant’s philosophy and an evaluation of its position within modern philosophy’s larger history. He persuasively argues that the whole of Kantianism—not merely the Second Critique—focuses on a “critique of practical reason” and is a response to a problem that Kant saw as intrinsic to reason itself: the teleological problem of its goodness. Reconstructing the influence of Rousseau on (...) Kant’s thought, Velkley demonstrates that the relationship between speculative philosophy and practical philosophy in Kant is far more intimate than generally has been perceived. My analysis here is an attempt to bring out the main through-line in the development of Bulgarian philosophy of law today. A proper account of Bulgarian philosophy of law in the 20th century requires an attempt to find, on the one hand, a solution to epistemological and methodological problems in law and, on the other, a clear-cut influence of the Kantian critical tradition. Bulgarian philosophy of law follows a complicated path, ranging from acceptance and revision of Kantian (...) philosophy to the development of interesting theories on the logic of legal reasoning. A constructive attempt to examine the traditional problems of the philosophy of religion in light of recently developed philosophical tools of analysis, concepts, and philosophical perspectives.

Philosophy & Social Criticism, Volume 48, Issue 7, Page 937-955, September 2022. Reasonableness is a complex notion recently developed by legal and political theorists. John Rawls’s famous proposal of ‘reasonableness as reciprocity’ requires careful testing in the light of several criteria arising from legal doctrine and adjudication. I enquire into this variety of concepts in search of a common thread that makes sense of the use of the same concept in diverse contexts. I assume the normative thrust of reasonableness (...) as an institutional and an individual virtue the basic core of which derives from Aristotelian phronesis. However, this double aspect of reasonableness betrays its major complexity that I try to shape through the help of two categories: subjective agency and objective context. The upshot of my enquiry will be that of showing that we can use another model, alternative to Rawls’s and better able to make sense of the variety of legal and ethical uses: Von Wright’s reasonableness as ‘the right way of living’.
