In this paper, I link philosophical discussion of policies for trans inclusion or exclusion, to a method of policy making. I address the relationship between concerns about safety, fairness, and inclusion in policy making about the inclusion of transwomen athletes into women’s sport. I argue for an approach based on lexical priority rather than simple ‘balancing’, considering the different values in a specific order. I present justifying reasons for this approach and this lexical order, based on the special obligations of (...) International Federations such as World Rugby. As a result, I provide a justificatory framework for the WR Guidelines that exclude transwomen from the women’s game in WR competitions. Finally, I give an account of a maximally safe, maximally fair and maximally inclusive form of sex categorisation in sport. (shrink)

There is widespread consensus that present patterns of consumption could lead to the permanent impossibility of maintaining those patterns and, perhaps, the existence of the human race. While many patterns of consumption qualify as ‘sustainable’ there is one in particular that deserves greater attention: virtual consumption. We argue that virtual consumption — the experience of authentic consumptive experiences replicated by alternative means — has the potential to reduce the deleterious consequences of real consumption by redirecting some consumptive behavior from shifting (...) material states to shifting information states. Why do ideas of how mechanisms relate to causality and probability differ so much across the sciences? Can progress in understanding the tools of causal inference in some sciences lead to progress in others? This book tackles these questions and others concerning the use of causality in the sciences.

Qualitative research poses ethical issues and challenges unique to the study of human beings. In developing the interpersonal relationship that is critical to qualitative research, investigator and participant engage in a dialogic process that often evokes stories and memories that are remembered and reconstituted in ways that otherwise would not occur. Ethical issues are raised when this relationship not only provides qualitative research data, but also leads to some degree of therapeutic interaction for the participant. Although we all learn differently, we all need to be able to engage certain fundamental reasoning skills if we are to manoeuvre successfully through life—however we define success. Peirce's philosophy provides us with a framework for helping students develop and hone the ability for making deliberate and well‐considered choices. For, embedded within Peirce's complete body of work is a design for thinking that provides a sturdy foundation for the development of three important learning capabilities. These capabilities are 1) the ability (...) to identify, compare, and contrast qualities, 2) the ability to perform analyses, and 3) the ability to interpret the meaning of signs. Although these capabilities may seem like the sort of skills that only older and academically inclined students can master, even young children and the intellectually challenged can learn to use them as well. Once teachers learn to develop their own intellectual potential by expanding these capabilities within themselves, they will be able to begin bringing about the development of these capabilities in their students. Once identified, developed, and applied to the mastery of educational skills and subject matter, these three fundamental learning capabilities , can form the foundation of a common‐sense approach to educational reform. Peirce asserts that good reasoning must be informed by ethical considerations, which in turn has been informed by the highest of aesthetic impulses. From this, we can extrapolate the importance that an educational model based upon Peirce's philosophy must place upon aesthetic and ethical considerations, as well as logical ones. Once fully understood, the philosophy of education embedded within Peirce's epistemology can revolutionize educational practices at all levels of learning. (shrink)

Reproductive coercion encompasses a collection of pregnancy promoting and pregnancy avoiding behaviours. Coercion may vary in severity and be perpetrated by intimate partners or others. Research is complicated by the inclusion of behaviours that do not necessarily involve an intention to influence reproduction, such as contraceptive sabotage. These behaviours are the most common, but are not always included in survey instruments. This may explain why the prevalence of reproductive coercion varies widely. Prevalence also varies when coerced abortion is included in (...) survey instruments. When it is, it seems roughly comparable in prevalence to coercion intended to impregnate. The extent and nature of coerced abortion can also be derived from studies that explore the reasons why women access abortion, the relationship between abortion and intimate partner violence, and online blogs and forums. This narrative review of reproductive coercion examines the evidence and attempts to comprehend why coerced abortion has been neglected. (shrink)

Pike This article seeks to define more precisely the nature of the individual transaction that occurs between reader and text and the potential for aesthetic reading in literature classrooms by relating knowledge of the way pupils engage in literary transactions to theoretical (...) perspectives that address the issue. The validity of Louise Rosenblatt's transactional theory of the literary work, expounded in Literature as Exploration and The Reader, The Text, The Poem, and its relevance for contemporary educators, particularly in the field of English education, has recently been reasserted by Jeanne Connell in her timely and cogent article in this journal. 1 The present article, however, seeks to refocus debate by problematizing and subsequently developing some aspects of key theories such as Rosenblatt's while examining the individual and social nature of reading in schools. Rosenblatt's view that aesthetic experiences can have both social origin and effect certainly deserves further theorizing if aesthetic experience in school communities and classrooms is to flourish.The influence of John Dewey's Art as Experience upon Rosenblatt is evident as this seminal text conceives of our primary task as the restoration of "continuity between the refined and intensified forms of experience that are works of art and everyday events." 2 Such continuity with experience is vital because, for Dewey, "experience is the fulfillment of an organism in its struggles and achievements in a world of things, it is art in germ." 3 Applying such a notion to education in schools, Rosenblatt saw the aim of literature lessons as the growth of experience rather than the acquisition of knowledge. Yet, despite such progress, in the United Kingdom, teachers of English are in the unenviable position of having to deliver an extensive body of knowledge prescribed by the National Curriculum and also to focus explicitly upon the features of certain types of text as they teach the National Literacy Strategy. 4 In Rosenblatt's work the emphasis on our experience of [End Page 61] literary works provides a much needed alternative to positions such as that adopted by New Criticism where "it is never what a poem says which matters, but what it is" because we acknowledge we can only ever gain access to what a poem says as "the sentence that seems to need no interpretation is already the product of one." 5 Clearly, understanding the reader's transaction with texts is where we must begin if we wish to foster aesthetic reading in our classrooms.Transactional theory also appears to be closely related to Martin Heidegger's thought in Being and Time where Dasein (givenness, existence, being) is seen as a distinctive characteristic of the human being as our consciousness projects things of the world and is also subjected to the things of the world which belong to us, in some sense, only as long as our consciousness is projecting them. 6 The validity of Dewey's view, where experience is not separated from art, can be seen when we acknowledge that we can "never adopt an attitude of detached contemplation, looking down on the world as if from a mountain top" for we are "inevitably merged with the very object of our consciousness." 7Such a view reflects Hans-Georg Gadamer's position in Truth and Method in which Heidegger's explanation of situation is applied to literary theory because, for Gadamer, the literary work cannot appear as a packaged and completed artefact in which meaning is neatly wrapped because it is influenced by a particular reader's actions at a particular moment. 8 Rosenblatt's realistic conception that "each reading involves a particular person at a particular time and place" is developed in this article as it seems that, even now, many reader response critics and curriculum designers "write as though people read literature in a vacuum or in a generalized kind of academic setting" which often does not apply... Doing Ethics in a Pluralistic World is an apt title for this collection of essays in honour of Roger C. Hutchinson who, over many decades, has encouraged and participated in shaping a Canadian contextual social ethics. His abiding interest in social ethics and in religious engagement with public issues is reflected in his life’s work — seeking the consensus and self-knowledge required to achieve cooperation in the search for a just, participatory, and sustainable society. One of Roger Hutchinson’s many notable (...) accomplishments is his development of a method of dialogue for ethical clarification in situations of diversity. Some of the essays collected here apply this method to specific issues, while others discuss how religious persons and organizations can and do co-operate in a pluralistic world to achieve social and ecological well-being. All essays are of keen interest to those concerned with the role and function of ethics at the matrix of religious conviction and social transformation. For nearly three decades Roger Hutchinson has been based at Victoria University in Toronto, first in religious studies, then at Emmanuel College, where he completed his teaching career as professor of church and society while serving as principal from 1996 to 2001. Organizations may need to attract occupational groups they did not recruit so far to implement strategic changes. Against the backdrop of this practical problem, this study introduces and explores an occupation-based measure of person-organization fit: occupational fit. I investigate its relationship with employer attractiveness based on human capital theory and explore the role of employer image as a moderator in this relationship. I surveyed 153 software engineers and mechanical engineers to analyze whether their occupational fit with software engineering and mechanical (...) engineering firms is related to employer attractiveness. I find that occupational fit is only related to a firm’s employer attractiveness among software engineers. Employer image does not moderate this relationship. A qualitative follow-up study proposes first explanations for the unexpected differences between the two occupations by indicating that occupations may differ in the logic they apply to determine fit and their degree of professionalization. The study contributes to research by highlighting the neglected role of occupation in recruitment research and exploring potential boundary conditions of recruitment for fit. Modernism is often implicitly known and understood from the “Western modernist” perspective and history. The wide recognition of the Western modernist canon as centre and universal displaces the contribution and significance of the non-Western world in the modern movement. Within Asia, the modernisms that arose from various nations in the region had subtly different notions of culture, identity, nationhood, and modernity, although almost every Asian country was related in one way or another to the history of Western imperialism. Using a (...) comparative analysis, this article examines modernism in twentieth-century Asia from a multicultural viewpoint, and bringing into picture the place of Asia in the history of modernism. After a decade of intense debate about mechanisms, there is still no consensus characterization. In this paper we argue for a characterization that applies widely to mechanisms across the sciences. We examine and defend our disagreements with the major current contenders for characterizations of mechanisms. Ultimately, we indicate that the major contenders can all sign up to our characterization.

In lieu of an abstract, here is a brief excerpt of the content:POETRY AS THE NAMING OF THE GODS by Phyllis Zagano There have been many attempts to define poetry, and there is copious advice to would-be poets. Horace writes somewhere "Sit quod vis, simplex dumtaxat et unum" which can be comfortably rendered as "make anything at all, so long as it hangs together." The hanging together is the quality most writers point to as evidence of success: simply, it (...) works. What poetry does is the more complex question, since it is the understanding of its internal kinesis which allows for its definition. Essentially, it takes an object from objective reality (insofar as we can agree such exists) and creates an oxymoronic entity: a static consciousness. This is always seen in phenomenological terms, that is, it must be consciousness of something. The poet recognizes this in deference to the common consciousness and the common understanding of the everyday, by the use of metaphor, simile, and the other accouterments of the trade. Things must be as they appear, and they must be as they appear to some majority of the people, in order for the poet to argue his private vision with clarity. The analogy must have some common ground before it has meaning, before the "naming" takes place. For Martin Heidegger the activity of creating poetry, dichten, is not only an indispensable part of human life, it signals the humanness of the person. He has two principal essays on poetry which show how this activity ofdichten combines his concepts Dasein and Vorhandenheit (despite his later abandonment of Dasein for Lichtung). Heidegger's essay, "Hölderlin and the Essence of Poetry," seeks to determine what is common to poetry, that is, what constitutes its essence. 340 Phyllis Zagano341 Another ofhis essays, "What are Poets For?" begins where the first ends (with considerations of Friedrich Hölderlin's "Bread and Wine"). Each essay comments on specific poems and somewhat imperfectly attempts a poetic theory in consonance with the rest of Heidegger's work. Since "Hölderlin and the Essence of Poetry" concentrates more on poetic theory than "What are Poets For?," investigation of it will prove more helpful in understanding and appropriating Heidegger's contention that "The writing of poetry is the fundamental naming of the Gods____"· In his "Letter on Humanism," Heidegger calls language the "House of Being," while man is the "Shepherd of Being." This understanding ofthe function oflanguage and the methodweuse tocreateand recreate ourselves and our world recurs often in Heidegger's work. The essay, "Hölderlin and the Essence of Poetry," stands as a seeking after what is common to poetry and, while Heidegger recognizes that Hölderlin's work is "only one among many others" (p. 294) and therefore cannot be used as the sole criterion to determine what constitutes poetry, he says that if what we recognize as the "essence of poetry" is present in a universal concept, then it ought to be able to be extrapolated from Hölderlin's poetry as well as from that of any other poet. What constitutes the "essence" of poetry, Heidegger argues, ought to be equally valid in every poem, but it is perhaps well to remind him that what ought to be equally valid in every poem is only equally valid in every poem which "hangs together," that is, every poem which performs its function as poem. Such insistence is ofcourse mere definition of terms, but in this case, without prior argument on the metaphysics of art, it is necessary. In any event, Heidegger concludes that the essence of Hölderlin's poetry is the "essence ofpoetry" itself (p. 294), and that what is common to poetry is found in it. While some critics might argue that Heidegger makes too much of Hölderlin here, the more dangerous weakness in this method of argumentation is the possibility that an idiosyncrasy might be mistaken for an essential element or, more probably, that too much will be generalized from this particular example or set of examples. This special issue of Informal Logic brings together two important areas of philosophy that have shown significant development in the last three decades: informal logic and feminist philosophy. A significant innovation they both share is new thinking about practices of argumentation and related practices of reasoning. Feminist theorizing supporting social and political change foregrounds “reasoning for change” in a way that draws attention to the contextual and rhetorical dimensions of argument and thus connects with significant developments in informal logic.

Mitochondrial replacement therapy (MRT) utilises nuclear transfer technology to replace defective mitochondria with healthy ones and thereby minimise the risk of a mitochondrial disease passing from a mother to her child. It promises much but comes with ethical controversy, significant risk of harm and many unknowns. Forming a position on MRT requires accurate information about the current state of knowledge, and an appreciation of the ethical issues at stake. Ethical deliberations will vary depending on the framework used. There are in (...) principle objections to MRT on the grounds of direct harm to human embryos and germline genetic modification. But even without these objections MRT can be weighed in terms of the balance between risks and benefits, alternatives and uncertainties. Philosophy’s adversarial argumentation style is often noted as a factor contributing to the low numbers of women in philosophy. I argue that there is a level of adversariality peculiar to philosophy that merits specific feminist examination, yet doesn’t assume controversial gender differences claims. The dominance of the argument-as-war metaphor is not warranted, since this metaphor misconstrues the epistemic role of good argument as a tool of rational persuasion. This metaphor is entangled with the persisting narrative of embattled reason, which, in (...) turn, is linked to the sexism-informed narrative of the “man of reason” continually warding off or battling “feminine” unreason. In this paper I discuss a new conception that has arrived relatively recently on the scene, in the context of the debate over the inclusion of transwomen (hereafter TW) in female sport. That conception is ‘Meaningful Competition’ (hereafter MC) – a term used by some of those who advocate for the inclusion of TW in female sport if and only if they reduce their testosterone levels. I will argue that MC is not fair. I understand MC as a substitute concept, (...) as an attempt to substitute for the perfectly serviceable concept of fair competition. It is an attempt at conceptual engineering that should be resisted. This is important because some International Federations have accepted MC as good coin, and the underlying theory of MC, which I explicate for the first time, underpins the stance taken by the IOC (International Olympic Committee) in its Framework Document. To establish that the inclusion of TW in female sport meets the criteria of MC in the sense I explicate here, does not show that the inclusion of TW in female sport is fair. Such inclusion is not fair, and the proper currency of sport is fair competition. ‘Meaningful Competition’, on the other hand, is a snare and a delusion. (shrink)

Pike, Gregory K In the year 2000, Canberra-based writer Melinda Tankard Reist placed notices and advertisements in various places about a project she was conducting on 'Abortion Grief'. Over 200 women responded, bravely prepared to tell their stories. The resulting book, Giving Sorrow Words: Women's stories of grief after abortion1 makes harrowing reading. Grief and pain followed these women down through the years and sometimes decades. Their accounts, as well as the numerous qualitative studies into women's experiences after Abortion, (...) and the anecdotal observations coming from post-abortion care services5 are evidence that abortion leaves a significant mark on some women. Pike, Gregory K Eugenics is not usually a topic for polite conversation. The first thought that typically springs to mind is Hitler's euthanasia programme, the master race and the attempted extermination of the Jews. However, an examination of the social history of eugenics reveals that in practice it operated in many other contexts, and its conceptual meaning is much broader. And while that social history has usually been confined to the late 19th and early 20th centuries, the core ideas (...) in eugenics have been part of dreams about the human condition for millennia. It is therefore not surprising to find various modern practices, some driven by new technology, subsumed under the rubric of eugenics. Eugenics as an idea is certainly resilient, even if at times it has been elusive. Indeed, perhaps it is resilient because it is elusive. In summary, eugenics is powerful yet poorly understood. Because it appeals to utopian dreams of a better future, where humans can be freed from their 'biological slavery', as Margaret Sanger put it, it remains pervasive even if cryptic. The new eugenics is sanitised, framed as autonomous choice, and unlike the ill-informed version of the 20s and 30s or the nasty Nazi variety. But it is nonetheless potent and its various manifestations are expressions of powerful ideas that remain firmly embedded in the collective human consciousness. (shrink)

There is an emerging ethical consensus that injured research participants should receive medical care and compensation for their research-related injuries. This consensus is premised on notions of beneficence, distributive justice, compensatory justice and reciprocity. In response, countries around the world have implemented no-fault compensation systems to ensure that research participants are adequately protected in the event of injury. The United States, the world's leading sponsor of research, has chosen instead to rely on its legal system to provide injured research participants (...) with medical care and compensation. This article argues that US reliance on its legal system leaves injured research participants unprotected in the event of injury. Nearly every injured research participant will have difficulty receiving compensation in court, and certain classes of research participants will be barred from receiving compensation altogether. The United States’ outlier status also threatens to impede US-sponsored multinational research, potentially delaying important biomedical advances. To rectify this injustice, researchers, Institutional Review Boards, sponsors and research institutions should advocate systematic no-fault compensation in the United States to bring US law into accord with global ethical norms and ensure that injured research participants are adequately protected. Is it ever aesthetically permissible to engage in acts of cultural appropriation? This paper shows how recent work on aesthetic normativity can help answer this question. Drawing on the work of Lopes and McGonigal, I argue that in many cases those who engage in cultural appropriation act against their aesthetic reasons. Lopes and McGonigal advocate for externalist accounts of aesthetic reasons according to which whether or not an agent has an aesthetic reason to act depends on whether or not their (...) action will be an aesthetic achievement. Employing this framework, I argue that insofar as acts of cultural appropriation are seldom aesthetic achievements, many agents who engage in culturally appropriative aesthetic activities act against their aesthetic reasons. The main purpose of this article is to analyse one aspect of Spanish business ethics: the role of the transparency and quality of the economic and financial information given to meet the demands and requirements of shareholders. To that end we concentrate firstly on analysing the Spanish capital market and the situation of shareholders prior to the publication in February 1988 of the Code of Best Practice for Spanish Companies, drawn up by a Special Committee created at the request of (...) the Ministry of Economy and Finance. We analyse the importance of the behaviour and actions of three groups which are fundamental to assuring quality and transparency of information: those who prepare financial statements, the Board of Directors (particularly the Audit Committee) and the external auditors. Finally, we look at the possible consequences of the Code of Best Practice on Spanish business ethics. (shrink)
