The Theodotian Susanna has been studied by various scholars in various ways. Each attempt to give some meaning to this narrative has a different emphasis from a text, context or receiver based angle. This paper presents a mixture of text and context based angles. It focuses on the different spaces in Theodotian Susanna, that is, the house, garden, court and finally heaven. Each of these spaces is contested, but there can only be one victor.

This essay offers a brief account of the rise of cls thought in the United States and of its development within a largely hostile legal academy. As the essay suggests, cls thought has been variously deformed, arrested, normalized, and diffused – leaving the contemporary American legal academy in a state of suspended animation.

This study investigated the modus operandi strategies employed by 120 coaches who committed sexual abuse toward 331 athletes under their authority. More than 2,000 Canadian court judgements and media reports were identified using online search databases. Using descriptive analysis, 51 strategies used in six modus operandi stages were identified. Results highlighted the most frequent strategies used by coaches for each stage of the crime commission process. Additionally, findings revealed the influence of the victims' gender, coaches' sport level and year of (...) coaches' first offenses on modus operandi strategies used. The margravial court astronomer Simon Marius, was involved in all of the new observations made with the recently invented telescope in the early part of the seventeenth century. He also discovered the Moons of Jupiter in January 1610, but lost the priority dispute with Galileo Galilei, because he missed to publish his findings in a timely manner. The history of astronomy neglected Marius for a long time, finding only the apologists for the Copernican system worthy of attention. In contrast the (...) papers presented on the occasion of the Simon Marius Anniversary Conference 2014, and collected in this volume, demonstrate that it is just this struggle to find the correct astronomical system that makes him particularly interesting. His research into comets, sunspots, the Moons of Jupiter and the phases of Venus led him to abandon the Ptolemaic system and adopt the Tychonic one. He could not take the final step to heliocentricity but his rejection was based on empirical arguments of his time. This volume presents a translation of the main work of Marius and shows the current state of historical research on Marius. (shrink)

À Harvard durant l’année académique 1940-41, les philosophes-mathématiciens Quine, Tarski et Carnap débattaient de la possibilité d’établir une distinction entre les énoncés analytiques et synthétiques qui soit suffisamment mordante pour dégager un statut spécial à l’épistémologie. Quine et Tarski s’objectaient à la distinction et l’objection de Quine verra notamment le jour sous le titre fameux « Les deux dogmes de l’empirisme ». Carnap, dans son autobiographie intellectuelle, se souvient avoir alors craint : « are we now back to John Stuart (...) Mill? ». Carnap avait compris qu’une épistémologie antipsychologiste comme celle du Cercle de Vienne ne peut subsister sans la présence d’une distinction de principe entre des énoncés analytiques et synthétiques. Il avait compris qu’un rejet de la distinction signifiait, à court ou moyen terme, un retour à l’épistémologie comme « psychologie de la science » telle que la pratiquait Auguste Comte, John Stuart Mill et Ernst Mach. This book, through the lens of interdisciplinary legal analysis, draws a subtle balance between bioethics and financial regulation, with the latter playing an unexpectedly crucial role in the way life may potentially be governed. The legal topic of human preservation or cryo-conservation was initially developed in the USA in the case of Donaldson v van de Kamp. More recently, the subject arose in Europe as a result of a decisum of the High Court, Family Division, in London. This new theme (...) of cryo-conservation has unfolded through multifaceted forms, including its impact on regulation. In an area that may, at least prima facie, be regarded as belonging to the traditional realm of medical law, the findings presented here suggest that its potential has strong economic implications. The work argues that it is necessary also to look at this subject from a more interdisciplinary perspective, drawing a fil rouge between two otherwise seemingly opposing areas of law: medical law and financial regulation. The legal framework draws on the Anglo-American, and the UK in particular, along with civil law analysis from Italy. The work will be of interest to researchers and academics in the areas of medical law, legal philosophy, financial law, property law and insurance law. (shrink)

Pierre des Noyers, secretary of Queen of Poland Louise-Marie Gonzaga, is known for his role as a messenger, envoy, court journalist and sometimes propagandist. His work as an unofficial diplomat for the Queen and ambassador for France is less famous though no less interesting. Even though he was already quite involved in these time-consuming tasks, Pierre des Noyers also acted as a scientific intermediary for the quite curious Queen Louise-Marie of Poland. He maintained contacts with many scholars from (...) France and Italy. He could nurture this network thanks to his position as an informal diplomat at the court of the Queen and his dedication to science in general. Even by discarding his most official and political letters, his known correspondence amounts to several hundred letters written in a period of around 50 years to various friends and scholars. Roberval, Gassendi, Boulliau, Hevelius or Pascal are among these contacts and he plays for most of them the role of a scientific intermediary sharing with them observations, books and anecdotes. His letters are filled with astronomical observations, prodigies and prophecies. Des Noyers was also a practitioner of science. Having possessed a rather large collection of scientific instruments he always sought the improved ones and his daily life was marked by scientific studies. He wrote meteorological bulletins for Academia del Cimento in Florence, studied the measurement of time, observed the sun and showed interest in the inner workings of the human body. This article will delve further into more scientific aspects of Pierre des Noyers’s life, both at the court of Louise-Marie and outside. The first part presents a rough overview of the secretary’s contacts in the scientific environment of 17th Century France and how they were used to connect scholars from Poland with this environment. The second part of this work presents Pierre des Noyers’s practice of science as a tool to understand the world and for which utmost diligence in measurement and practice is required. The last part focuses on des Noyers’s application of this scientific method in two, now pseudo-scientific fields: astrology and divination. (shrink)

Enjeux épistémiques et métaphysiques, qui a reçu jusqu’ici un accueil assez favorable. L’auteure y explore le thème de la pluralité dans trois grands registres de la philosophie des sciences : d’abord celui de la méthodologie scientifique (chapitre 1), ensuite celui des relations interthéoriques ou du réductionnisme (chapitre 2), et, enfin, celui de la représentation (chapitre 3). La grande diversité des sujets qui (...) appellent un positionnement en faveur du monisme ou du pluralisme en philosophie des sciences fait en sorte qu’il serait vain de penser que l’on puisse de nos jours se dire pluraliste tout court (p. xiv). Pour cette raison, l’auteure se contente d’examiner les diverses formes de pluralismes mises en avant par les philosophes dans chacun des registres mentionnés ci-dessus en portant un regard critique sur leurs conséquences méthodologiques, épistémiques et métaphysiques, en adoptant le point de vue de la pratique scientifique effective. L’objectif, éminemment politique, de cet ouvrage est de proposer pour 2012 une alternative aux programmes court-termistes et consensuels qui pourraient être développés par les candidats lors de la campagne officielle pour les élections présidentielles. Il vise à offrir une perspective de long terme de ce à quoi la société pourrait ressembler d’ici trente à cinquante ans si nous prenons un véritable virage écologique et humain et si nous opérons un changement concret de paradigme. Si, ces dernières années, un grand nombre (...) d’ouvrages et de films ont dénoncé les pires crises que traverse l’humanité, si d’autres se sont évertués à mettre en lumière des alternatives, force est de constater que très peu se sont attelés à la tâche d’offrir une vision articulée, écologique et positive de l’avenir. Loin des “yaka-fokon” et des déclarations d’intention pleines de bonne volonté, cet ouvrage met en lumière des solutions qui ont fait leur preuve, à petite comme à grande échelle, dans la plupart des domaines de la société. Pour chaque thématique, une personnalité “experte”, ayant développé une vision du sujet - voire souvent conduit ou observé une expérimentation -, propose en quelques pages des voies de transition concrètes, ainsi que les moyens à disposition de tous, qu’ils soient citoyens, élus ou entrepreneurs, pour les mettre en action. Chacune de ces propositions s’appuie sur un “cas pratique” : un exemple concluant mené à l’échelle d’un territoire européen (canton, département, région...). Au-delà d’une simple compilation, ces propositions sont mises en relation comme un véritable projet de société. (shrink)

In the spirit of the work edited by Michel Foucault (1975) on Pierre Rivière, I propose to put philosophy to work by tackling a case study in which I shall analyse certain court transcripts that pertain to the defence of serial killer, Stewart Wilken, in Die Staat Teen Stewart Wilken. My analysis of these documents is intended to uncover the practices and struggles of the discourses that come together, and into conflict, at this event. The analysis is divided into (...) two parts. In Part One, I thematize subjectivity in relation to the idea of enlightenment autonomy. Here I aim to show that the discourses in law, psychiatry and psychology that dominated at Wilken's trial, appear to have undergone “normalization.” In other words, what Foucault uncovered as early internecine struggles among discourses for supremacy have given way to a unanimous stance concerning the nature of the autonomous subject and its legal ramifications; effectively silencing alternatives. In Part Two, I shall skirt around the frayed edges of these dominant discourses, with the aim of showing in more detail how internal theoretical tensions, such as those evident in the expert testimony given at Wilken's trial, may open up spaces for other accounts of subject- formation. This essay explores the astronomical works of Pierre de Lille, a little-known French participant in the debates on calendar reform during the Fifth Lateran Council (1512–1517). It argues that astrological ideas coupled with eschatological beliefs motivated his astronomical propositions to reform the Julian calendar. De Lille conceived the calendar solar year as a unit of a great cosmic year spanning 7,153 years, the duration that he assigned to the now-obsolete theory of the motion of trepidation of the eighth sphere. Although his use of this astronomical model for astrological speculations about world chronology was not new, de Lille gave an original and bold reply to Pico della Mirandola’s devastating critique of astrology. The astronomical model and its astrological implications were eventually contested at the court and in academia in France, but the alliance of chronology, astrology, and apocalypticism was to play a major role during the second half of the sixteenth century in Lutheran thought. During the transition from the early to the modern era, the marginalization of astrology from the learned world marked a significant shift. The causes of this phenomenon are complex and still partially obscure. For instance, some sociological interpretations have linked it to a broader shift in mentality among the gentry and bourgeoisie, while other scholars attributed the decline to the emergence of the ‘new science’. Focusing on the case of Jean-Baptiste Morin (1583–1656), this paper examines the changing dynamics of patronage (...) for what has been termed ‘the last official astrologer’. It demonstrates that Morin's appointment as professor of mathematics at the Collège royal and his prominence within the French court were expressions of a cultural politics in which his patrons were deeply invested. Conversely, Morin's efforts to restore astrology lent validation to the belief systems of his patrons. The paper further analyses Morin's fall from grace during his polemics with Gassendi and his circle, highlighting the political context of the Fronde and a growing public weariness regarding the relationship between politics and astrology. Ultimately, this case study reveals that in the French context, the marginalization of astrology was not solely determined within the ‘learned jurisdiction’. Instead, the shifting cultural and political investments of the ruling classes played a significant role. (shrink)

Depuis la seconde guerre mondiale, l'État fédéral canadien a été gouverné à sept reprises par des équipes sans majorité au parlement : en 1957, 1962, 1963, 1965, 1972, 1979 et 2004. Dans cette étude nous avons retenu deux cas : celui du gouvernement Trudeau 1972-1974 et celui du gouvernement Martin 2004 parce que dans ces deux cas, le même parti et le même chef ont assumé le pouvoir en situation majoritaire et en situation minoritaire. Le vocabulaire caractéristique de ces deux (...) équipes est mis en lumière grâce au calcul des 'spécificités du vocabulaire'. On présente ce calcul en détail : utilisation de la loi hypergéométrique et pondération en fonction de la catégorie grammaticale du mot étudié. Il apparaît que le discours gouvernemental minoritaire est nettement impersonnel ; il sous-utilise les verbes et se réfugie dans un catalogue d'actions de court terme. (shrink)

L’œuvre mathématique de La Ramée est constituée d’ouvrages publiés tout au long de sa carrière. Les éditions abrégées des Éléments d'Euclide, ses manuels d’arithmétique et de géométrie plusieurs fois remaniés, un court traité d’algèbre ainsi que les Scholae mathematicae de 1569 sont autant d’ouvrages dans lequels il met en œuvre une réforme des mathématiques héritées et de leur enseignement. Des justifications de cette réforme apparaissent dans les trois livres d’un Prooemium mathematicum portant sur l’histoire des mathématiques, la défense de leur (...) « utilité » et une critique sévère de l’exposé euclidien. Pour autant, l’œuvre mathématique de La Ramée ne doit pas être mise à part de l’œuvre philosophique qu’il élabore par ailleurs. Dans cet article, je m’efforce de le montrer en m’interrogeant d’abord sur les raisons qui ont poussé La Ramée à se tourner, au début de sa carrière, vers les mathématiques ; l’examen du livre I du Prooemium mathematicum me permet ensuite d’examiner le rôle que jouent Platon, Aristote et Euclide dans son histoire des mathématiques. Finalement, je suis amené, en abordant la critique raméenne de l’ « abstraction » pythagoricienne, à chercher dans les éditions de la Dialectica et les Scholae in liberales artes les éléments d’une « philosophie des mathématiques » – conception originale de la nature des objets mathématiques et de la façon dont on accède à leur connaissance – qui offre une certaine lumière sur la réforme des mathématiques qu’entreprend La Ramée. The aim of this paper is to assess the relevance of somatic evolution by natural selection to our understanding of cancer development. I do so in two steps. In the first part of the paper, I ask to what extent cancer cells meet the formal requirements for evolution by natural selection, relying on Godfrey-Smith’s (2009) framework of Darwinian populations. I argue that although they meet the minimal requirements for natural selection, cancer cells are not paradigmatic Darwinian populations. In the second (...) part of the paper, I examine the most important examples of adaptation in cancer cells. I argue that they are not significant accumulations of evolutionary changes, and that as a consequence natural selection plays a lesser role in their explanation. Their explanation, I argue, is best sought in the previously existing wiring of the healthy cells. (shrink)

Duhem is often described as an anti-realist or instrumentalist. A contrary view has recently been expressed by Martin (1991) (Pierre Duhem: Philosophy and History in the Work of a Believing Physicist (La Salle, IL: Open Court)), who suggests that this interpretation makes it difficult to understand the vantage point from which Duhem argues in La science allemande (1915) that deduction, however impeccable, cannot establish truths unless it begins with truths. In the same spirit, the present paper seeks to establish (...) that Duhem is at any rate not the kind of anti-realist he is often presented as being, and that his views are like those Quine sees fit to call realist. An interpretation of Duhem's views on explanation and precision in science, and their bearing on the epistemological status of theory, is advanced which leads naturally into his critique of conventionalism. His attitude towards atomism, which should not be judged from a post-1925 perspective, is considered part of the unified view he strove after and appropriately called Duhem's physicalism, standing in contrast to the kind of reductionist conception usually associated with atomism. This paper reviews Deleuze’s theory of language in Logic of Sense, and Deleuze and Guattari’s theory of language in A Thousand Plateaus. In the ontology informed by the Stoics described in those books, human being and language do not exist separately but in a mixture of words and things. The author argues that this flattened ontology of surfaces is incommensurable with the ontology of depth used in conventional humanist qualitative methodology and recommends beginning new empirical inquiry with a concept instead (...) of with method and methodology. In a paper published in Psychological Review, Tyler Burge has offered a unified non-mentalistic account of a wide range of social cognitive developmental findings. His proposal is that far from attributing mental states, young children attribute to humans the same kind of internal generic states of sensory registration that biologists attribute to e.g. snails and ticks. Burge’s proposal deserves close attention: it is especially challenging because it departs from both the mentalistic and all the non-mentalistic accounts of the data so (...) far. Moreover Burge has been one of the leading philosophers of mind of the past 40 years and some of his writings on the objectivity of perception display a deep understanding of the relevance of science for sharpening our understanding of the mind. After taking a close look at the developmental evidence, in particular at false-belief studies, I argue that Burge’s, 409–434, 2018) account faces severe obstacles. To give one telling example: if young children can only attribute to others sensory registrations, then it is hard to explain the evidence showing that they respond differently to an agent’s ignorance and to her false belief. In our critical review of Doing without Concepts, we argue that although the heterogeneity hypothesis (according to which exemplars, prototypes and theories are natural kinds that should replace ‘concept’) may end fruitless debates in the psychology of concepts, Edouard Machery did not anticipate one consequence of his suggestion: Definitions now acquire a new status as another one of the bodies of information replacing ‘concept’. In order to support our hypothesis, we invoke dual-process models to suggest that prototypes, exemplars and theories (...) are ‘Type 1’ concepts (automatic, implicit) and definitions ‘Type 2’ concepts (controlled, explicit). In the context of this argument, we suggest that one must better distinguish between Type 1 theories (e.g., Bayesian causal nets) and Type 2 theories (e.g., scientific) that explicitly control definitions. As stressed by Perruchet & Vinter, the SOC model echoes Johnson-Laird's mental model theory. Indeed, the latter rejects rule-based processing and assumes that reasoning is achieved through the manipulation of conscious representations. However, the mental model theory as well as its modified versions resorts to the abstraction of complex schemas and some form of implicit logic that seems incompatible with the SOC approach.

The First International and Interdisciplinary Conference on Modelling and Using Context, Rio de Janeiro, January 1997, gave rise to the present book, which contains a selection of the papers presented there, thoroughly refereed and revised. The treatment of contexts as bona fide objects of logical formalisation has gained wide acceptance, following the seminal impetus given by McCarthy in his Turing Award address. The field of natural language offers a particularly rich variety of examples and challenges to researchers concerned with the (...) formal modelling of context, and several chapters in the volume deal with contextualisation in the setting of natural language. Others adopt a purely formal-logical viewpoint, seeking to develop general models of even wider applicability. The 12 chapters are organised in three groups: formalisation of contextual information in natural language understanding and generation, the application of context in mechanised reasoning domains, and novel non-classical logics for contextual application. Cet article propose une interprétation de la métaphysique de Jankélévitch telle qu’elle se présente dans Philosophie première (1953). L’élaboration d’une déontologie métaphysique conduit Jankélévitch, par-delà le destin onto-théologique des métaphysiques classiques, à déployer une théologie « désontologisée », c’est-à-dire un discours sur Dieu dépouillé de l’être et de l’existence. Une telle détermination théologique de la métaphysique met alors nécessairement le métaphysicien à l’épreuve de l’expression de ce qui n’existe pas et qui pourtant fait exister. Ce que nous comprenons ainsi comme (...) un échec du discours métaphysique sur son objet théologique, dans l’ordre de la métaphysique, possède toutefois une fonction dans l’œuvre de Jankélévitch : fournir son modèle à l’action morale humaine. How can we best understand human cognitive architectural variability? We believe that the relationships between theories in neurobiology, cognitive science and evolutionary biology posited by evolutionary psychology’s Integrated Causal Model has unduly supported various essentialist conceptions of the human cognitive architecture, monomorphic minds, that mask HCA variability, and we propose a different set of relationships between theories in the same domains to support a different, non-essentialist, understanding of HCA variability. To set our case against essentialist theories of HCA variability, we (...) detail the general notion of an ICM and the specific ICM at the heart of evolutionary psychology. We briefly illustrate the type of essentialism fostered by evolutionary psychology’s ICM by showing how it grounds essentialist theories of cognitive gender. We shall not criticize these theories here since the literature is replete with compelling objections to them, but shall instead focus on motivating a replacement ICM to destabilize evolutionary psychology’s ICM wholesale. ICMs usually span larger than the models they support, hence larger than arguments against these models, and one reason the essentialist theories addressed here have the kind of staying power they do is that they are partly supported by the ICM in which they are grounded. In short, we offer “A New Hope” against the essentialist empire. True to the Hollywood trope, this new hope rests on an alliance between a young theory, cognitive network neuroscience, and two older, but still quite young, epistemic rebels: enactive cognitive science and developmental systems theory. Accordingly, we detail and discuss the proposed emerging ICM and test-drive it by sketching the multimorphic view of gender it grounds. (shrink)
