Even the simplest cell exhibits a high degree of functional differentiation (FD) realized through several mechanisms and devices contributing differently to its maintenance. Searching for the origin of FD, we briefly argue that the emergence of the respective organizational complexity cannot be the result of either natural selection (NS) or solely of the dynamics of simple self-maintaining (SM) systems. Accordingly, a highly gradual and cumulative process should have been necessary for the transition from either simple self-assembled or self-maintaining systems of (...) functionless structural components to systems with FD. We follow results of recent in vitro experiments with respect to competition among protocells, where a primitive type of selection begins to operate among them accompanied by a parallel evolution of their functional domain. We argue that minimal forms of FD should be established within the evolution of SM processes in protocells as they undergo a simpler selection process for stability and persistence in a prebiotic environment. We then suggest the concept of closure of constraints (CoC) as a way to identify and describe minimal FD in a far-from-equilibrium SM organization. We show in detail how the concept of CoC together with the conditions for its fulfillment can be applied in the case of a simple protocellular system that begins to couple internal chemical reactions with the formation of its membrane components. Finally, we discuss how such SM systems can evolve towards significantly higher levels of FD, suggesting this is mainly the result of functional recombination (formation of mechanisms) in the context of a modular SM organization. Lately there has been a growing interest in evolutionary studies concerning how the regularities and patterns found in the living cell could have emerged spontaneously by way of self-assembly and self-organization. It is reasonable to postulate that the chemical compounds found in the primitive Earth would have mostly been very simple in nature, and would have been immersed in the natural dynamics of the physical world, some of which would have involved self-organization. It seems likely that some molecular processes self-organized (...) spontaneously into a hierarchy of complex behaviours. Our conceptual search herein reaches back to the time when prebiotic phenomena began to take shape. This was before the origin of life, so in this paper we hope to shed new light on some of the theoretical issues that surround the ways in which cellular organization might have evolved without the aid of replicated information. Since Darwin it is widely accepted that natural selection (NS) is the most important mechanism to explain how biological organisms—in their amazing variety—evolve and, therefore, also how the complexity of certain natural systems can increase over time, creating ever new functions or functional structures/relationships. Nevertheless, the way in which NS is conceived within Darwinian Theory already requires an open, wide enough, functional domain where selective forces may act. And, as the present paper will try to show, this becomes even more (...) evident if one looks into the problem of origins. If there was a time when NS was not operating (as it is quite reasonable to assume), where did that initial functional diversity, necessary to trigger off the process, come from? Self-organization processes may be part of the answer, as many authors have claimed in recent years, but surely not the complete one. We will argue here that a special type of self-maintaining organization, arising from the interplay among a set of different endogenously produced constraints (pre-enzymatic catalysts and primitive compartments included), is required for the appearance of functional diversity in the first place. Starting from that point, NS can progressively lead to new (and, at times, also more complex) organizations that, in turn, provide wider functional variety to be selected for, enlarging in this way the range of action and consequences of the mechanism of NS, in a kind of mutually enhancing effect. This volume presents a collection of refereed papers reflecting the state of the art in the area of over-constrained systems. Besides 11 revised full papers, selected from the 24 submissions to the OCS workshop held in conjunction with the First International Conference on Principles and Practice of Constraint Programming, CP '95, held in Marseilles in September 1995, the book includes three comprehensive background papers of central importance for the workshop papers and the whole field. Also included is an introduction by (...) one of the volume editors together with a bibliography listing 243 entries. All in all this is a very useful reference book relevant for all researchers and practitioners interested in hierarchical, partial, and over-constrained systems. (shrink)

We show that three fundamental information-theoretic constraints -- the impossibility of superluminal information transfer between two physical systems by performing measurements on one of them, the impossibility of broadcasting the information contained in an unknown physical state, and the impossibility of unconditionally secure bit commitment -- suffice to entail that the observables and state space of a physical theory are quantum-mechanical. We demonstrate the converse derivation in part, and consider the implications of alternative answers to a remaining open question (...) about nonlocality and bit commitment. (shrink)

The debate on probabilistic measures of coherence flourishes for about 15 years now. Initiated by papers that have been published around the turn of the millennium, many different proposals have since then been put forward. This contribution is partly devoted to a reassessment of extant coherence measures. Focusing on a small number of reasonable adequacy constraints I show that (i) there can be no coherence measure that satisfies all constraints, and that (ii) subsets of these adequacy constraints (...) motivate two different classes of coherence measures. These classes do not coincide with the common distinction between coherence as mutual support and coherence as relative set-theoretic overlap. Finally, I put forward arguments to the effect that for each such class of coherence measures there is an outstanding measure that outperforms all other extant proposals. One of these measures has recently been put forward in the literature, while the other one is based on a novel probabilistic measure of confirmation. (shrink)

Background Moral distress is a complex and challenging issue in the nursing profession that can negatively affect the nurses’ job satisfaction and retention and the quality of patient care. This study focused on describing the resources and constraints, consequences, and interventions of moral distress in nurses. Methods In a literature review, an extensive electronic search was conducted in databases including PubMed, ISI, Scopus as well as Google Scholar search engine using the keywords including “moral distress” and “nurses” to identify (...) resources, constraints, consequences, and interventions about moral distress in nurses, from the earliest records up to 26 December 2020. The required data were extracted from 61 relevant studies by two independent reviewers. Results Resources and constraints in the occurrence of moral distress among nurses can be divided into three general categories including internal factors, clinical factors, and external factors. The consequences of moral distress on nurses and the medical system reduced moral sensitivity, development of psychological and physical health problems, and the intention to leave the profession. The potential effective interventions were the implementation of integrated communication programs, strengthening physician–nurse collaboration, nursing involvement in clinical decision-making and end-of-life issues, social support, using a resiliency bundle, interdisciplinary discussion, and promoting nurses’ ethical and communication skills. Conclusion There are a wide range of resources and constraints impacting moral distress in nurses that could lead to negative consequences. Further studies are necessary to identify, evaluate, and implement a range of potential effective interventions for the management of moral distress in nurses. (shrink)

Common-sense morality includes various agent-centred constraints, including ones against killing unnecessarily and breaking a promise. However, it's not always clear whether, had an agent ϕ-ed, she would have violated a constraint. And sometimes the reason for this is not that we lack knowledge of the relevant facts, but that there is no fact about whether her ϕ-ing would have constituted a constraint-violation. What, then, is a constraint-accepting theory to say about whether it would have been permissible for her to (...) have ϕ-ed? In this paper, I canvass various possible approaches to answering this question and I argue that teleology offers the most plausible approach—teleology being the view that every act has its deontic status in virtue of how its outcome ranks, relative to those of its alternatives. So although, until recently, it had been thought that only deontological theories can accommodate constraints, it turns out that teleological theories not only can accommodate constraints, but can do so more plausibly than deontological theories can. This paper deals with the question of how to price drugs for tropical diseases. The thesis defended in the paper is: (i) there should be no legal constraints on the profits pharmaceutical companies can make on their products for tropical diseases. In essence, (i) expresses the idea that drugs for tropical diseases should be treated as any other product on the free market and that the producers of these drugs should be allowed to sell their products at whatever price (...) the market can bear. The main argument in favour of (i) is first outlined. Five common arguments against (i) are thereafter discussed, and it is argued that all of these fail in their intended purpose. (shrink)

The problem of finite-time tracking control is discussed for a class of uncertain nonstrict-feedback time-varying state delay nonlinear systems with full-state constraints and unmodeled dynamics. Different from traditional finite-control methods, a C 1 smooth finite-time adaptive control framework is introduced by employing a smooth switch between the fractional and cubic form state feedback, so that the desired fast finite-time control performance can be guaranteed. By constructing appropriate Lyapunov-Krasovskii functionals, the uncertain terms produced by time-varying state delays are compensated for (...) and unmodeled dynamics is coped with by introducing a dynamical signal. In order to avoid the inherent problem of “complexity of explosion” in the backstepping-design process, the DSC technology with a novel nonlinear filter is introduced to simplify the structure of the controller. Furthermore, the results show that all the internal error signals are driven to converge into small regions in a finite time, and the full-state constraints are not violated. Simulation results verify the effectiveness of the proposed method. (shrink)

In earlier work, I argued that gun prohibition is unjustified because it violates an individual right to self-defense. Here, I defend that argument against objections posed by Nicholas Dixon and Jeff McMahan to the effect that the right of citizens to be free from gun violence counterbalances the right of self-defense, and that gun prohibition does not violate the right of self-defense because it renders everyone overall safer.

Solar radiation management (SRM), a form of climate engineering, would offset the effects of increased greenhouse gas concentrations by reducing the amount of sunlight absorbed by the Earth. To encourage support for SRM research, advocates argue that SRM may someday be needed to reduce the risks from climate change. This paper examines the implications of two moral constraints—the Doctrine of Doing and Allowing, and the Doctrine of Double Effect—on this argument for SRM and SRM research. The Doctrine of Doing (...) and Allowing, and perhaps the Doctrine of Double Effect, shows that the argument is weaker than it appears. (shrink)

This article argues that Bernard Williams’ Critical Theory Principle (CTP) is in tension with his realist commitments, i.e., deriving political norms from practices that are inherent to political life. The Williamsian theory of legitimate state power is based on the central importance of the distinction between political rule and domination. Further, Williams supplements the normative force of his theory with the CTP, i.e., the principle that acceptance of a justification regarding power relations ought not to be created by the very (...) same coercive power. I contend that the CTP is an epistemic criterion of reflective (un)acceptability which is not strictly connected to the question of whether people are dominated or not. I show that there are cases of non-domination that fail the epistemic requirements of the CTP. (shrink)

Legal judgment writing mobilises a process of story-telling, drawing on existing judicial discourses, precedents and practices to create a narrative relevant to the specific case that is articulated by the presiding judge. In the Feminist Judgments projects feminist scholars and activists have sought to challenge and reinterpret legal judgments that have disadvantaged, discriminated against or denied women’s experiences. This paper reflects on the process of writing as a feminist judge in the Australian Project, in an intimate homicide case, R v (...) Middendorp. Drawing on the work of Judith Butler on intelligibility, iterability and the communality of violence and vulnerability, this article argues that feminist judgments necessarily require some uncomfortable compromises with unjust gendered institutions. While ‘donning the robes’ may be an uncomfortable process, a feminist re-articulation of the law’s carceral power serves to unsettle and challenge some aspects of gendered oppression, even though it cannot unsettle the operation of the institution. The article concludes that effective feminist interventions by members of the judiciary may require donning robes that are not entirely comfortable in order to persuade and advocate for change. In his new book, Logical Form, Andrea Iacona distinguishes between two different roles that have been ascribed to the notion of logical form: the logical role and the semantic role. These two roles entail a bifurcation of the notion of logical form. Both notions of logical form, according to Iacona, are descriptive, having to do with different features of natural language sentences. I agree that the notion of logical form bifurcates, but not that the logical role is merely descriptive. In (...) this paper, I focus on formalization, a process by which logical form, on its logical role, is attributed to natural language sentences. According to some, formalization is a form of explication, and it involves normative, pragmatic, as well as creative aspects. I present a view by which formalization involves explicit commitments on behalf of a reasoner or an interpreter, which serve the normative grounds for the evaluation of a given text. In previous work, I proposed the framework of semantic constraints for the explication of logical consequence. Here, I extend the framework to include formalization constraints. The various constraints then serve the role of commitments. I discuss specific issues raised by Iacona concerning univocality, co-reference and equivocation, and I show how our views on these matters diverge as a result of our different starting assumptions. Social transmission is at the core of cultural evolutionary theory. It occurs when a demonstrator uses mental representations to produce some public displays which in turn allow a learner to acquire similar mental representations. Although cultural evolutionists do not dispute this view of social transmission, they typically abstract away from the multistep nature of the process when they speak of cultural variants at large, thereby referring both to variation and evolutionary change in mental representations as well as in their corresponding (...) public displays. This conflation suggests that differentiating each step of the transmission process is redundant. In this paper, I examine different forms of interplay between the multistep nature of social transmission and the metric spaces used by cultural evolutionists to measure cultural variation and to model cultural change. I offer a conceptual analysis of what assumptions seem to be at work when cultural evolutionists conflate the complex causal sequence of social transmission as a single space of variation in which populations evolve. To this aim, I use the framework of variation spaces, a formal framework commonly used in evolutionary biology, and I develop two theoretical concepts, ‘technique’ and ‘technical space’, for addressing cases where the complexity of social transmission defies the handy assumption of a single variation space for cultural change. An adaptive neural network control problem is addressed for a class of nonlinear hydraulic servo-systems with time-varying state constraints. In view of the low precision problem of the traditional hydraulic servo-system which is caused by the tracking errors surpassing appropriate bound, the previous works have shown that the constraint for the system is a good way to solve the low precision problem. Meanwhile, compared with constant constraints, the time-varying state constraints are more general in the actual systems. (...) Therefore, when the states of the system are forced to obey bounded time-varying constraint conditions, the high precision tracking performance of the system can be easily realized. In order to achieve this goal, the time-varying barrier Lyapunov function is used to prevent the states from violating time-varying constraints. By the backstepping design, the adaptive controller will be obtained. A radial basis function neural network is used to estimate the uncertainties. Based on analyzing the stability of the hydraulic servo-system, we show that the error signals are bounded in the compacts sets; the time-varying state constrains are never violated and all singles of the hydraulic servo-system are bounded. The simulation and experimental results show that the tracking accuracy of system is improved and the controller has fast tracking ability and strong robustness. (shrink)

Some ecologists have argued that theoretical model building in population and community ecology has gone evidentially unconstrained. In the essay, I argue that "bottle experiments" offer ecological model building evidential constraints and illustrate this by considering work on chaotic models tested by the dynamics of flour beetles. Critics reply that these experiments are importantly unlike nonmanipulated natural systems and thus do not constitute genuine tests of the models. I conclude by considering two responses to this worry and a suggestion (...) on how to move forward on this debate. (shrink)

Cosmopolitan education aims to transmit cosmopolitan forms of life in order to participate morally in the world community. The primary characteristics of this cosmopolitan education are its acceptance of the shared humanity of all persons as a fact of human existence and as a motivating guide for human interaction, and the requirement of democratic inclusion in deliberations of the governance of those interactions, including morality. Such an education in cosmopolitan morality requires means that befit its core components. This paper contrasts (...) the concepts of strict and moderate cosmopolitanism, empirical and deliberative morality, and structural and dispositional cosmopolitanism to show that the moderate, inclusive and deliberative processes of deliberative dispositional cosmopolitanism are more suited to cosmopolitan education in morality than strong, empirical-focused structural cosmopolitan efforts. Though strong, structural and empirically based forms may be more likely to guarantee preferred outcomes in the learning of specific morals or the implementation of institutional norms, they are also more likely to run afoul of the core components of cosmopolitanism because they will privilege outcomes over processes, and are thus more likely to be less inclusive and more coercive. In contrast, and even though they are less certain to guarantee preferred moral outcomes or actions, moderate, deliberative dispositional forms of cosmopolitan education embody the morality they seek to inform, and are more likely to find sustained internalised support over time. Philosophers writing on forgiveness typically defend the Resentment Theory of Forgiveness, the view that forgiveness is the overcoming of resentment. Rarely is much more said about the nature of resentment or how it is overcome when one forgives. Pamela Hieronymi, however, has advanced detailed accounts both of the nature of resentment and how one overcomes resentment when one forgives. In this paper, I argue that Hieronymi’s account of the nature of forgiveness is committed to two implausible claims about the norms (...) bearing on forgiveness. Her account is highly instructive, however, for it brings into relief how certain intuitive views about the norms of forgiveness should be used to constrain our theories about its nature. Sport occupies a significant role in modern society and has a wide following. In his Leftist Theories of Sport, Morgan examines what he considers to be a degradation of modern sport and the lack of proper critical theory to address this challenge. In the latter part of LTS, Morgan presents a reconstructed critical theory with ‘a liberal twist’ in terms of an analysis of what he sees as the internal ‘gratuitous’ logic of sport, and a call for critical deliberation in (...) sporting practice communities. I depart from Morgan’s ideas of the ‘gratuitous’ logic of sport which, I believe, has significant potential and operative force. I interpret the logic of sport as forms of self-imposed constraints at three levels: in the logic of the rules, in norms for fair play, and in a particular interpretation of sporting excellence as a form of human excellence. Darwin’s main contribution to modern biology was to make clear that all history of life on earth is dominated by a simple principle, which is usually summarised as 'descent with modification'. However, interpretations about how this modification is produced have been controversial. In light of the data provided by recent studies on molecular biology, developmental biology, genomics, and other biological disciplines we discuss, in this paper, how Darwin's theory may apply to two main 'types' of evolution: that occurring in the (...) prebiotic world and that regarding the acquisition of major key-innovations differentiating higher-taxa, which makes up part of the so-called macroevolution. We argue that these studies show that evolution is a fascinating, complex and multifaceted process, with different mechanisms drivin it on different occasions and in different places. (shrink)

Evolutionary change is opportunistic, but its course is strongly constrained in several fundamental ways. These constraints (historical/phylogenetic, functional/adaptive, constructional/morphogenetic) and their dynamic relationships are discussed here and shown to constitute the conceptual framework of Constructional Morphology. Notwithstanding recent published opinions which claim that the discovery of constraints renders Neodarwinian selection theory obsolete, we regard the insights of Constructional Morphology as being entirely consistent with this theory. As is shown here in the case of the Hyracoidea, formal analysis of (...) the constraints which have framed the evolution of various characters extends our understanding of the evolution of a taxon. Amartya Sen describes John Rawls?s ?justice as fairness? as ?transcendental institutionalism? and develops his realization-focused approach in contrast. But Rawls is no transcendental institutionalist, and Sen?s construal of their opposition occludes a third, relation-based position and a valuable and practical form of ideal theory. What Sen calls transcendental institutionalism and realization-focused comparative theory each treat justice as something to bring about, a problem for experts. A third position treats justice in terms of how we relate to one another rather than (...) of achievement. This position, called ?justice as reciprocity,? is consistent with Rawls?s ?justice as fairness? and Sen?s normative aspirations, and might form the basis of new and fruitful dialogue between them. By treating justice as a question of how we relate to one another, and treating relation-based ideals as the basis of respectful behavioral constraints (rather than of ends to pursue), ?justice as reciprocity? grounds an everyday form of just democratic citizenship. This paper presents two formation tracking control strategies for a combined set of single and double integrator agents with an arbitrary undirected communication topology. The first approach is based on the design of distance-based potential functions with interagent collision avoidance using local information about the distance and orientation between agents and the desired trajectory. The second approach adds signed area constraints to the desired formation specification and a control strategy that uses distance as well as area terms is designed (...) to achieve tracking convergence. A variety of mechanisms contribute to word learning. Learners can track co-occurring words and referents across situations in a bottom-up manner. Equally, they can exploit sentential contexts, relying on top–down information such as verb–argument relations and world knowledge, offering immediate constraints on meaning. When combined, CSWL and SLCL potentially modulate each other's influence, revealing how word learners deal with multiple mechanisms simultaneously: Do they use all mechanisms? Prefer one? Is their strategy context dependent? Three experiments conducted with adult learners (...) reveal that learners prioritize SLCL over CSWL. CSWL is applied in addition to SLCL only if SLCL is not perfectly disambiguating, thereby complementing or competing with it. These studies demonstrate the importance of investigating word-learning mechanisms simultaneously, revealing important characteristics of their interaction in more naturalistic learning environments. This volume will address whether and to what extent those working to better understand or achieve climate justice should think about the real-world feasibility of their theories or proposals.

Existing accounts of mechanistic causation are not suited for understanding causation in biological and neural mechanisms because they do not have the resources to capture the unique causal structure of control heterarchies. In this paper, we provide a new account on which the causal powers of mechanisms are grounded by time-dependent, variable constraints. Constraints can also serve as a key bridge concept between the mechanistic approach to explanation and underappreciated work in theoretical biology that sheds light on how (...) biological systems channel energy to actively respond to the environment in adaptive ways, perform work, and fulfill the requirements to maintain themselves far from equilibrium. We show how the framework applies to several concrete examples of control in simple organisms as well as the nervous system of complex organisms. (shrink)

The Zhuangzi, a 4th century BCE Chinese text, is optimistic about life unrestrained by entrenched values. This paper contributes to existing debates on Zhuangzian freedom in three ways. First, it reflects on how it is possible to enjoy the freedom envisaged in the Zhuangzi. Many discussions welcome the Zhuangzi’s picture of release from life shaped by canonical visions, without also giving thought to life without these driving visions. Consider this scenario: in a world with limitless possibilities, would it not be (...) fraught, not knowing how to interpret situations? I suggest that freedom in the Zhuangzi is possible only if one succeeds in reorienting herself to the new ‘normal’. Second, I introduce and develop the idea of working with constraints. This focuses on an agent's maximizing the fit between relevant conditions, on the one hand, and their capabilities, on the other. Finally, I propose that self-directed practice, an important expression of agency, is required for building capabilities that enable such freedom. I examine the idea of risk involved in these firsthand experiences, articulating an account of agency that sits at the heart of hard-won Zhuangzian freedom. (shrink)

This paper defends the following principle: For any visually perceptible set of objects and any visual phenomenal character, there could be a veridical perception of exactly those objects with that character. This principle is rejected by almost all contemporary theories of perception, yet rarely addressed directly. Many have taken the apparent inconceivability of a certain sort of “shape inversion” — as compared to the more plausible, frequently discussed “color inversion” — as evidence that the spatial characters of our perceptions are (...) uniquely suited to and/or revelatory of the structure of their objects, such that alleged perceptions of those objects that differed radically in spatial character could not be veridical. I argue that these conclusions are unjustified: I claim that the difficulty involved in constructing coherent “shape inversion” scenarios is attributable to the complex relations among visual and tactile shape experiences, as opposed to relations between shape experiences and worldly shape properties.
