The paper shows mechanisms and manifestations of the challenges for the security in the South American Tri-Border Area. It analyses the background of the activity of chosen organized crime and terrorist groups in this region. The article refers to some social and economic conditions for the spread of violence and illegal business in the area. It is focused on the most important dimensions of these problems and on the strategy implemented by South American governments to fight and prevent organized crime. (...) In this article, I address the question: what kind of normative principles should regulate the governance processes through which migration across international borders is managed? I begin by contrasting two distinct categories of normative controversy relating to this question. The first is a familiar set of moral controversies about justice within border governance, concerning what I call the ethics of exclusion. The second is a more theoretically neglected set of normative controversies about how institutional capacity for well functioning (...) border governance can best be achieved, concerning what I call the constitution of control of international borders. I argue that progress can be made in resolving controversies of the latter kind by applying a new normative theory of political legitimacy, distinct from the moral theories of justice routinely applied to ethics of exclusion controversies. On the ‘collective agency’ model of political legitimacy that I propose here, principles of political legitimacy have the regulatory role of combating complex collective action problems that may otherwise impede an institution’s collectively valuable functions. Through applying this theory, I sketch some provisional prescriptions for the design of international border governance institutions that may follow from the demand for strengthening their political legitimacy. In this article, I explore the way in which proximity and distance have been made relevant to cosmopolitanism and I discuss the significance contemporary theory attributes to border crossing. By employing colonial border crossing and its rationalization as an example, and by drawing from Alain Badiou's critique of political philosophy, I expose some of the problems of facile and faddish approaches to planetary movement. I argue that the real borders to be crossed by true cosmopolitans are internal and, regrettably, (...) traversible, raised at an early age, preserved through education and carried along wherever one goes. Then, I show how this thesis relativizes the drastic choice between cosmopolitanism and patriotism that is imposed by many current theories. By elaborating on Heraclitus's dictum that ‘the citizens must defend the law, as they would defend the wall of the city’, I sketch an account of patriotism that is (a) compatible with, and conducive to, cosmopolitanism as well as (b) mindful of the duplicity of the interplay of proximity and distance. A proposed global theory of corporate political activity (CPA) analyzes the complex resource allocation choices involved in integrating politically relevant cross-border and multilevel strategies for multinational enterprises (MNEs). Cross-border CPA is “horizontal” allocation of scarce corporate resources by MNEs to politically relevant strategies across multiple countries. Globalization reshapes CPA among multiple levels functioning below, at, and above national governments. Subnational communities and international policy regimes, supranational quasigovernmental institutions, and supranational nongovernmental organizations all affect businesses. Multilevel CPA is “vertical” allocation (...) of scarce corporate resources to politically relevant strategies among subnational, national, regional, and global levels. Furthermore, in each country and at each level, business-relevant policies are determined in multiple policy arenas, shaped by widely differing nonmarket institutions, corruption conditions, and stakeholder demands for corporate social responsibility. Multiple policy “arena” allocation adds to the analytical complexity of the CPA strategizing problem. Implications for scholarship and practice are presented. (shrink)

The worldwide integration of capital markets continues to make progress and has resulted in both issuers and investors being active in various markets on both sides of the Atlantic. In times of financial crisis, this brings one question to the centre of attention which has not been discussed exhaustively before: in the situation of securities liability to investors in an international context, which is the applicable law to the liability claim? The harmonization of private international law rules in (...) Europe gives rise to new reflections on the problem of international issuer liability. In the United States, on the other hand, the Supreme Court has just ruled for the first time on matters relating to the international application of the US securities regulation, thereby overruling the settled case law of decades. This paper understands the role of issuer liability in a broader context as a ‘corporate governance’ device, and from this starting point, develops a new approach to the legal problem of cross-border securities liability. In response to the democratic boundary problem, two principles have been seen as competitors: the all-affected interests principle and the all-subjected principle. This article claims that these principles are in fact compatible, being justified vis-à-vis different functions, accommodating different values and drawing on different sources of normativity. I call this a ‘function-sensitive’ view. More specifically, I argue that the boundary problem draws attention to the decision functions of democracy and that two values are indispensable when theorizing how to (...) regulate these functions: procedural fairness and political autonomy. While the value of procedural fairness is best promoted through a version of the all-affected interests principle, applied to decision making generally, it is argued that political autonomy is best promoted through a version of the all-subjected principle, applied to coercive decision making specifically. The article concludes by drawing out some practical implications of the function-sensitive view for the case of immigration and border controls. (shrink)

Journal of International Political Theory, Ahead of Print. Joseph Carens develops one of the most prominent cases for open borders in the academic literature on the basis of freedom and equality. Yet the implementation of his social membership theory would mean that immigrants who have not yet lived in a country long enough to become members would be excluded from political and social rights, thus raising the possibility of their domination and subordination by citizens. Given that these problems (...) arise because Carens aims to balance the freedom of individuals with the “claims of belonging” to a political community, can we theorize the relationship between freedom and community differently? French philosopher Jean-Luc Nancy does just that, by showing how to think freedom and community as mutually constitutive. Nancy thus offers the resources for an alternative case for open borders, grounded on the claim that the freedom of community entails openness to the outside. Drawing also on Nancy’s account of the common and of democratic politics, my Nancean argument for open borders challenges Carens’s exclusion of nonmembers from the rights of citizens, emphasizing instead the need for an ongoing political struggle to expand who is eligible to claim rights as well as the scope of the rights themselves. The debate about justice in immigration seems somehow stagnated given that it seems justice requires both further exclusion and more porous borders. In the face of this, I propose to take a step back and to realize that the general problem of borders—to determine what kind of borders liberal democracies ought to have—gives rise to two particular problems: first, to justify exclusive control over the administration of borders (the problem of legitimacy of borders) (...) and, second, to specify how this control ought to be exercised (the problem of justice of borders). The literature has explored the second but ignored the first. Therefore, I propose a different approach to the ethics of immigration by focusing on concerns of legitimacy in a three-step framework: first, identifying the kind of authority or power that immigration controls exercise; second, redefining borders as international and domestic institutions that issue that kind of power; and finally, considering supranational institutions that redistribute the right to exclude among legitimate borders. This paper seeks to address the problem of strangeness within the context of migration in Africa. I draw on historical realities that inform existing international and African discourses on migration. I hope to show that most African countries have unconsciously bought into international arguments that drive the legitimacy of building walls, visible and invisible, and the promotion of stringent migration policies that minimise the influx of African immigrants. I draw on political and philosophical positions of African thinkers (...) like Kwame Nkrumah, among others, in my theorisation of strangeness and the need to dispel the potential negative conception of strangeness within Africa’s migration policies. The problem of personality in philosophy has been significant since the emergence of Christianity. In Soviet Russia, this problem has been actualized since the 2nd half of the twentieth century, since the Thaw, when the books of Russian religious philosophers became known. We were the original heirs of Christian ontology and ethics, which assumed that a personal appeal to God on You (Tu) testified to a change of places in the interior of being itself, which becomes intimate, close, (...) because the infinite God, being in a person, makes him the same infinite person. The Latin term "persona" is translated as "mask" (personality). V.V. Vinogradov in the "History of Words" says that the word "personality", associated with Latin and Greek meanings (persona, prosopon), was not used massively in the Old Russian language until the XVII century, and in the XVII and XVIII centuries it began to denote only the official position of a person. It is impossible to associate this meaning of the face with what was in antiquity and the Middle Ages. This is a homonym. Reflecting on Greek literature, S. S. Averintsev wrote that the term "creativity" is poorly applicable to the Greek philosophers: "poyesis" is a matter understood as an invention. The Greeks invented an objectified type of communication-through-literature, i.e. dialogue, consciously separated from life communication. Dialogue as an invention revealed the fundamental undialogical nature of Greek literature, and Socrates is the ideal of a radically undialogical person who cannot be internally hurt by the word of the interlocutor. Therefore, for Averintsev, a personality is a mind free from a "dialogical situation", it is a mask, an individual understood as an eidos. It is the mask — "immobile-clear, fully revealed and appeared" — that is the semantic limit of a continuously emerging face. By opening the "mask", the Greeks emphasized the importance of individuality. V. S. Bybler, criticizing Averintsev, argues that dialogue is not a construction, it is an internal dispute of the philosopher taking place in his own soul. He is in the thought itself, pushing its definitions to the limit and reaching the border of other possible definitions, concepts, understandings. According to Bybler, the thought itself is dialogical, communicating with itself within itself and forming a gap between itself and the other "I". At the same time, Bibler defines his philosophy as the philosophy of an eternally borderline culture. Dialogue is a tense collaboration between an author who worked in a past culture and a reader who lives in a modern culture. Personality for the Bibler is the ultimate embodiment of the individual — the reverse course of Averintsev. M. Ya. Gefter and V. V. Bibikhin worked out this problem 20 years later. Gefter, based on the unmotivated appearance of homo sapiens and the unexplained appearance of speech, emphasized that speech destroyed the limit of understanding between people. This is also connected with his reliance on the concept of the World of Worlds and the definition of personality, which, in his opinion, is not a higher form built over the individual, but a later phenomenon that entered into a dispute with individuation. Personality is a choice, a form of overcoming oneself with access to others, a case. Bibikhin, not agreeing with the theoretical positions of Averintsev and Bybler, turns out to be closer to Gefter. It does not proceed from the development of the individual or personality, having changed the aspect of reasoning. He posed the problem of the wholeness of a human (homo) who initially deals not with knowledge, but with being and non-being. Before knowledge there is affirmation and negation, which sound in speaking silence before any speech and push a person to act. A human (homo), i.e. not an individual or a person, begins with an act; he is, first of all, such an act. The difference between Bibikhin's approach, which is closely related to the ideas of hesychasm, from Averintsev and Bybler lies in his understanding of philosophy as timeless. For him, everything known is the World, not even modernity. Personal properties (prosopon) are possessed only by God, who is "personal" and "hypostatic", because He expresses energy. This problem of the action of the energetic Word is the most important witness of the world given through man and recognized through language. It is unclear what proper remuneration for surrogacy is, since countries disagree and both commercial and altruistic surrogacy have ethical drawbacks. In the presence of cross-border surrogacy, these ethical drawbacks are exacerbated. In this article, we explore what would be ethical remuneration for surrogacy, and suggest regulations for how to ensure this in the international context. A normative ethical analysis of commercial surrogacy is conducted. Various arguments against commercial surrogacy are explored, such as exploitation and commodification of surrogates, reproductive (...) capacities, and the child. We argue that, although commodification and exploitation can occur, these problems are not specific to surrogacy but should be understood in the broader context of an unequal world. Moreover, at least some of these arguments are based on symbolic rhetoric or they lack knowledge of real-world experiences. In line with this critique we argue that commercial surrogacy can be justified, but how and under what circumstances depends on the context. Surrogates should be paid a sufficient amount and regulations should be in order. In this article, the Netherlands and India are case examples of contexts that differ in many respects. In both contexts, surrogacy can be seen as a legitimate form of work, which requires the same wage and safety standards as other forms of labor. Payments for surrogacy need to be high enough to avoid exploitation by underpayment, which can be established by the mechanisms of either minimum wage, or Fair-Trade guidelines. An international treaty governing commercial surrogacy should be in place, and local professional bodies to protect the interests of surrogates should be required. Commercial surrogacy should be permitted across the globe, which would also reduce the need for intended parents to seek surrogacy services abroad. (shrink)

Millions of people in the developing world lack access to curative drugs. Pogge identifies the cause of this problem as a lack of redistribution across borders. In contrast, this article shows that institutional shortcomings within developing countries are the main issue. These different explanations are the result of diverging analytic approaches to ethics: a cosmopolitan approach versus an ordonomic approach. The article will be devoted to such problems as a idea of subsidiarity, a cosmopolitan right and a visitor figure in context and interpretation of ancient and modern philosophy. The article deals with the concept of subsidiarity which is taken as a point of departure for the discipline of borderology, an academic study with Kantian roots. Borderology, according to the principle of subsidiarity, can present as a new field of investigation which invites philosophers and social scientists to replace a “top (...) down” with a “bottom up” procedure. The figure of the visitor is close linked with the experience of subsidiarity which means the freedom and initiative below the level of State. In Immanuel Kant’s strategy for perpetual peace, the figure of the visitor launches a critique of a tendency to self-aggrandizement, characteristic of the modern State and thereby a defense of the political independence of local border regions. The visitor also invites us to see, think and work to liberate our own subjectivity from false voices of sovereignty. Kant articulates the offer of the visitor by bringing in the term Verkehr. Using Kant scholar Otfried Höffe,s methodology we show how idea of subsidiarity is overlooked in international political theory, explain some constitutive principles of borderology, from which is more important is the methodological principle of an intercultural discourse and presents borderology as an anti-Huntingtonian model for border studies. Nigeria agriculture, food security and dietary intake have not been exempted from the disruptions in countless sectors around the world due to the outbreak of COVID-19. The country first experienced the outbreak on February 27, 2020, and the experience since then has shown negative effects not only on the socioeconomic conditions but also on agriculture, food security and dietary intake. Long term in-depth analysis of the effects of this pandemic on food security and dietary intake using quantitative data is still (...) very difficult due to paucity of data and the great level of the improbability of the trajectory of the spread of the Virus. This study is a rapid assessment of the short and long-term potential effects of the disease. It relied on a review of situation reports especially by the Nigeria Centre of Disease Control and other reports around the world on COVID-19, personal observations, and public opinion via mobile telephone survey of Lagos and Oyo States, Nigeria. Findings show that food demand and supply shocks caused by COVID-19 outbreak affect agriculture, food and dietary intake negatively through COVID-19 policies. It leads to a reduction in household income coupled with hike in food prices. Owing to the Nigeria’s crude farming practice, there was a scarcity of hired labour required for production process during 2020 farming season. This implies a high likelihood of low output and further surge in food prices in the future. Food access was also compromised with the accumulation of unsold fresh produce by the smallholder farmers and the low salary earners during movement restrictions and of loss income as a result of international border closure. Food and dietary intake is affected as people are shifting diets to more affordable and low quality foods, while food stability is not guaranteed due to market insecurity, prompting an extraordinary level of indecision. The study concludes that the shock of COVID-19 is not only a demand management problem but a multidimensional crisis requiring monetary, fiscal, and health policy responses with global collaboration and cooperation. In Promoting Justice Across Borders, Lucia Rafanelli develops an ethical theory of ‘reform intervention’: a deliberate attempt to promote justice in a foreign society. The theory specifies which types of interventions are justified under what circumstances and who is justified in intervening where. Rafanelli’s theory eschews nation-states and instead makes its main actors societies with capacity for self-determination. This, I argue, can make the theory hard to apply, because different societies can overlap or intersect, and the theory’s implications change (...) depending on how one draws boundaries around groups. So the theory can give contradictory directives for the same event, depending on how one envisions the subject of intervention. The move away from states, however, may be inevitable, because contemporary problems in international relations (such as those related to climate change) cannot be easily contained within the framework of independent sovereign states in the international system. In “Autonomy and the Feminist Intuition,” Natalie Stoljar asks whether a procedural or a substantive approach to autonomy is best for addressing feminist concerns. In this paper, I build on Stoljar’s argument that feminists should adopt a strong substantive approach to autonomy. After briefly reviewing the problems with a purely procedural approach, I begin to articulate my own strong substantive theory by focusing specifically on the problem of internalized oppression. When the topic of international justice did arise, discussion rarely got beyond recommendations about how nations could avoid war, as well as suggestions about when a declaration of war was morally justifiable and what sorts of methods might be used in the course of a justifiable war the topics of so-called just-war theory. Such is no longer the case.To be sure, just-war theory is reaching greater states of sophistication,much of it focused around Michael Walzer's book Just and Unjust Wars.Excerpts (...) from Walzer's book appear here, in Part Two, along with a set of newly written chapters that deal with issues arising from the use of violence among nations. The topics of these chapters are foreign interventionism and states' rights, deterrence and the threat of nuclear reprisal, and terrorism.But issues of international justice other than just-war theory have been discussed by an an ever-increasing group of twentieth-century scholars. These issues deal with what might be called distributive justice, which concerns the distribution of the world's natural resources and the goods produced by laborers across the world, as well as the duties,rights, and liberties possessed by individuals. How such items ought to be distributed within nation-states has been discussed extensively by social and political philosophers. Only in recent years has any attention been paid to the proper distribution of goods internationally. The chapters in Part One all do so. With one exception, all of these chapters are written for this volume. The exception is an excerpt from Charles Beitz's book PoliticalTheory and International Relations, Part Three of which is reproduced here almost in its entirety. The other chapters in this part are devoted to the topics of justice and the distribution of the world's resources, the obligation to assist the needy, the responsibilities of international corporations, and justice and the global environment. The fundamental tenet of modern empiricism is the view that all non-analytic knowledge is based on experience. Let us call this thesis the principle of empiricism. [1] Contemporary logical empiricism has added [2] to it the maxim that a sentence makes a cognitively meaningful assertion, and thus can be said to be either true or false, only if it is either (1) analytic or self-contradictory or (2) capable, at least in principle, of experiential test. According to this so-called empiricist criterion (...) of cognitive meaning, or of cognitive significance, many of the formulations of traditional metaphysics and large parts of epistemology are devoid of cognitive significance--however rich some of them may be in non-cognitive import by virtue of their emotive appeal or the moral inspiration they offer. Similarly certain doctrines which have been, at one time or another, formulated within empirical science or its border disciplines are so contrived as to be incapable of test by any conceivable evidence; they are therefore qualified as pseudo- [p. 42:] hypotheses, which assert nothing, and which therefore have no explanatory or predictive force whatever. This verdict applies, for example, to the neo-vitalist speculations about entelechies or vital forces, and to the "telefinalist hypothesis" propounded by Lecomte du Noüy. (shrink)

Building upon recent work on epistemic varieties of liberalism, avant-garde political agency and the theory and practice of activism, I claim that a liberal defence of more open borders does not presuppose either indifference to the problem of the deep structural sources of poverty in poorer countries, or the absence of an account of those structures’ transformation. Rather, it is claimed that in addition to the remittance of money and other economic goods to alleviate the symptoms of poverty, (...) more open borders facilitate the remittance of norms and values in terms of which individuals and activist communities in poorer countries may transform the deep structures and institutions that are poverty’s sources. This liberal account of more open borders and deep structural transformation also makes possible the non-coercive discharge of obligations of global justice on the part of wealthier states to the world’s poor, when poorer nations are either unable or unwilling to discharge them themselves. This Article discusses the impact of the international financial crisis on Brazilian capital markets. While the banking industry was not severely affected, leading nonfinancial corporations experienced severe financial turmoil. Two Brazilian corporations cross-listed in the United States - Sadia S.A. and Aracruz Celulose S.A. - suffered billion-dollar losses when the Brazilian real unexpectedly plummeted in relation to the dollar. Despite earlier disclosure that these companies had engaged only in pure hedging activity, these great losses were found to be the (...) result of their highly speculative trading in currencyderivatives. Consequently, several private lawsuits were filed both in the United States and in Brazil. This Article takes a novel approach to the transnational securities litigation debate by examining the particular consequences of private litigation in a developed and in an emerging country. It compares the types of lawsuits filed and their final outcomes. Despite substantially similar alleged wrongdoing, the outcomes for securities holders in each jurisdiction contrast strikingly. Only U.S. investors of both companies were able to obtain substantial financial recoveries; Brazilian investors obtained none. This Article examines the reasons behind these discrepant results and the consequent economic distributional effects on global securities markets after the U.S. Supreme Court decision in Morrison. The Article argues that Morrison aggravates such shareholder cross-border non pro rata compensation and transfers of company value from foreign to U.S. investors. It identifies a set of costs borne by foreign investors, and so far neglected by scholars, as a consequence of the current status of U.S. and international securities law regimes. These costs are the result not only of the typical “circularity problem” in securities litigation, but also of a “double circularity problem” as they fall on foreign shareholders who also suffered equivalent damages to those experienced by the U.S. class being compensated. One important element of globalization is the dissemination of western educational ideals and organizational frameworks through educational development projects. While postcolonial theory has long offered a useful critique of this expansion, it is less clear about how educational development that eschews neo-imperialist tendencies might proceed. This problem poses a question that requires philosophical reflection. However, much of comparative and international development education ignores philosophical modes of inquiry. Moreover, as Libbrecht (2007) argues, philosophy all too often sees itself as (...) synonymous with the Euro-American intellectual tradition, thus ignoring indigenous educational thought that might more appropriately guide local educational development. Drawing on John Dewey's (1938) call for deeper and more inclusive plans of operations in response to social conflicts and Jurgen Habermas (2008) call for ?reciprocal learning processes? and ?cooperative acts of translation,? we will attempt to reach beyond our individual philosophical borders to explore the necessity and possibilities of comparative philosophy of education by sharing three examples of our current efforts to apply philosophical analysis to international educational development. These examples will articulate and embody the necessity and the challenges of applying philosophical analysis to educational development work. (shrink)

Liberal theories of social justicefocus predominantly on the national, ratherthan international, level, and where they doaddress international concerns they insist thatprinciples of justice at the national levelhave priority over principles at theinternational level. We question the coherenceof this arrangement, given liberal theory'scommitment to moral equality of persons as suchrather than to that of particular sets of persons. What isat issue is whether liberal theory can providea coherent basis for international justice atall. In this thesis, I both analyze the phenomenology of vision from a geometrical point of view, and also develop certain connections between that geometrical analysis and the mind body problem. In order to motivate the need for such an analysis, I first show, by means of a refutation of direct realism, that visual space is never identical with any of the physical objects being indirectly "seen" by constituting color arrangements in it. It thus follows that the geometry of visual (...) space may be quite different from the Euclidean geometry of physical space, and I proceed to analyze that geometry. ;I argue that topologically, visual space is two dimensional, inasmuch as regions of it are capable of being bounded by a line, such as the borders around the various objects constituted in it. An apparent paradox arises here though, inasmuch as we posess phenomenal depth perception, which is particularly striking during binocular vision, and thus the question arises as to how the binocular depth cue of retinal disparity is registered phenomenally in a two dimensional space. I resolve this apparent paradox by arguing that the internal metric struture of this space can be apprehended phenomenally, and can serve as such a phenomenal depth cue. It is shown that holistically, this metric structure is elliptical, since for example marginal distortions in wide-angle photography are not present in visual space, and it is also noted that there is a tendency towards size constancy in visual perception. It is shown from these geometrical considerations that visual space posseses a variable curvature, with that curvature being determined by the physical depths of objects constituted in the space. ;Finally, I investigate what bearing the preceding geometrical conclusions have on the question of how events in visual space may be causally determined by neural events in the brain. The classical isomorphic theory of Gestalt psychology is then reinterpreted in light of my analysis of the geometry of visual space. (shrink)

Theorizing about the legitimacy of international institutions usually begins with a framing assumption according to which the legitimacy of the state is understood solely in terms of the relationship between the state and its citizens, without reference to the effects of state power on others. In contrast, this article argues that whether a state is legitimate vis-a-vis its own citizens depends upon whether its exercise of power respects the human rights of people in other states. The other main conclusions (...) are as follows. First, a state’s participation in international institutions can contribute to its legitimacy in several ways. Second, when international institutions contribute to the legitimacy of states, their doing so can contribute to their own legitimacy. Third, a theory of international legitimacy ought to recognize reciprocal legitimation between states and international institutions. (shrink)

The article reviews the peculiarities of distance learning platforms usage in law enforcement educational institutions during the Covid-19 pandemic. Distance learning at U.S. Federal Law Enforcement Training Center, which is based on the Online Campus have been substantiated. Particular attention is paid to topical issues of training on such online training mod-ules of the Campus: crime scene, driving training, drugs, firearms, health, interviews, investigation, law, topography, maritime training, personal security, technical means, terrorism, stopping vehicles, etc. There are also programs to (...) study the courses "Small Arms" and "Use of Force" in the online training modules of the Campus. The specifics of professional training of border guards in Asian countries have been revealed: the use of platforms of law enforcement agencies; focus of training on the devel-opment of basic competencies and the ability to solve problem situations; the opportunity to take online courses for all categories of staff at a con-venient time; creation of a three-level round-the-clock system of functioning of training of specialists. Peculiarities of professional training of border guards of European countries have been outlined considering the usage of both the platforms of institutions and joint platforms of international organizations, namely: web platform Virtual Aula of Agency FRONTEX; CEPOL DL web platform; European Coast Guard Training platforms; ILIAS EU Mission EUBAM; Connect & Learn UNHCR; UNODC and others. Special attention is paid to the capabilities of the Virtual Aula web platform for training teachers, instructors, external experts, etc. Web platform Virtual Aula of Agency FRONTEX presents up-to-date information on educational programs conducted in Europe. Characteristics of distance learning platforms usage in higher law enforcement educational institutions in Ukraine have been presented. Distance learning course of the English language for border guards have been developed and implemented. Considerable attention is also paid to the disclosure of online assessment of knowledge: the test of self-control on the topics, modules, and procedure of final assessment. (shrink)

This paper provides moderate criticism of so-called normative theories of thinking and reasoning. The discussion focuses on the problems of idealization, adequacy, inconsistent yet non-trivial logics, logical omniscience etc. I called them “internal” to the normative approach, because they stem from the very properties of formal systems used to model these two human activities. Some arguments, however, refer to the current theories in cognitive science, including those which are developed within “descriptive” framework.

In this article, we introduce the project developed in this special issue: a search for principles of ‘real-world’ justice in international migration that can offer practical guidance on real political problems of migration governance. We begin by highlighting two sources of divergence between the principal topics of theoretical controversy within literatures on migration justice and the animating sources of political controversy within real national and international publics. These arise first in the framing of the problems on which normative (...) theory is purported to offer guidance, and second in the character of the normative reasons that are invoked as grounds for settling the controversies. In response to these divergences, we propose that the development of action-guiding normative theories of international migration can be supported with resources from broadly ‘realist’ approaches to political theory. We outline three key dimensions in which the ‘real-world’ theoretical approaches developed in this collection of papers connect up with important themes in the wider theoretical literature on political ‘realism’: first, a problem-centred methodological strategy; second, a focus on the value of political legitimacy; and third, a commitment to reconciling systematic engagement with real political problems and circumstances with a critical normative orientation towards political problems. The Yalta and Potsdam conferences of 1945, which laid the foundations of the modern world order, are considered the highest diplomatic achievements of World War II. At these conferences, all issues relating to the new world order were resolved by the will of the Allies, united in the anti- Hitler coalition. During the final stage of the war, the existing plans for the complete destruction of the Third Reich were coordinated, and the foundation for a new world order after the (...) war was established. The main topics of discussion at the conferences included achieving the complete defeat of Nazi Germany, determining the future of Germany, ensuring the payment of reparations for war damages, establishing a common political line concerning the European states liberated from occupation, and creating an international organization for security and cooperation, with the goal of making it a decisive factor in ensuring the stability of the newly emerging system of international relations. However, after the defeat of the common enemy, the existing disagreements between the Allies- who had united in the anti-Hitler coalition to fight against fascism and militarism- intensified and soon led to a split into two large blocs. The newly formed Yalta-Potsdam system developed under the conditions of a bipolar system of international relations. (shrink)

Human trafficking is both a human rights violation and the fastest growing criminal industry in the world. This article examines cross-border trafficking of girls and women in Nepal to India. It gives a brief explanation of what is meant by trafficking and then looks at the reasons behind trafficking. In Nepal, women and children are trafficked internally and to India and the Middle East for commercial sexual exploitation or forced marriage, as well as to India and within the country for (...) involuntary servitude as child soldiers, domestic servants, circus entertainment, and factory workers. Nepal and India are both signatories to international conventions and bound by domestic law to combat trafficking, and yet, this scourge continues. There are many laws in place, both in Nepal and India, which regulate the trafficking and prostituting of girls and women. This article looks at how effective these laws and regulations actually are and will look at the reasons for the continuation of trafficking. Despite the formal recognition of girl trafficking as a major problem and the existence of laws to curtail it, trafficking continues. The major problem with Nepal’s and India’s domestic laws is in the lack of enforcement. Finally, this article will look at ways to fight trafficking and make the governments of India and Nepal more effective in their fight against trafficking. (shrink)

One of the aspects of modern migration is transnationality. Such a community is characterized by physical mobility and economic, cultural, and social transfers; by the functioning of migrants “here and there”, multilateral contacts – both family and more often professional contacts – as well as others. The ways of communicating with the country have changed. These changes are due to, inter alia, the progress of telecommunications and communication, the development of new media. Never before in the history of the development (...) of international movements have there been so many opportunities for maintaining contact between spatially disconnected persons. Therefore, the purpose of addressing the problem of migrant communication in the last few decades is to show their change, their dynamics, and the role that they play in maintaining family ties and across borders. The 2004 Canadian Assisted Human Reproduction Act bans commercial contract pregnancy and egg provision, but Canadians undertake cross-border reproductive travel to access these services. Feminist bioethicists have argued that the ethical justification for enforcing the ban domestically, namely exploitation, grounds its extraterritorial enforcement. I raise an additional problem when Global Southern or low-income countries are destinations for travel: neocolonialism. Further, I argue that a ban on commercialized reproduction is problematic. Although well-suited to address neocolonial forces of exploitation and commodification, (...) a ban reinforces neocolonialism by paying insufficient attention to the agency of gestational laborers and egg providers. When a boat disappears over the horizon, does a distant observer detect the last moment in which the boat is visible, or the first moment in which the boat is not visible? This apparently ludicrous way of reasoning, heritage of long-lasting medieval debates on decision limit problems, paves the way to sophisticated contemporary debates concerning the methodological core of mathematics, physics and biology. These ancient, logically-framed conundrums throw us into the realm of bounded objects with fuzzy edges, where our mind (...) fails to provide responses to plain questions such as: given a closed curve with a boundary (say, a cellular membrane) how do you recognize what is internal and what is external? We show how the choice of an alternative instead of another is not arbitrary, rather points towards entirely different ontological, philosophical and physical commitments. This paves the way to novel interpretations and operational approaches to challenging issues such as black hole singularities, continuous time in quantum dynamics, chaotic nonlinear paths, logarithmic plots, demarcation of living beings. In the sceptical reign where judgements seem to be suspended forever, the contemporary scientist stands for a sort of God equipped with infinite power who is utterly free to dictate the rules of the experimental settings. The number and the scale of transboundary public health concerns are increasing. Infectious and non-communicable diseases, international trade in tobacco, alcohol, and other dangerous products as well as the control of the safety of health services, pharmaceuticals, and food are merely a few examples of contemporary transnationalization of health concerns. The rapid development and diffusion of scientific and technological developments across national borders are creating new realms of international health concern, such as aspects of biomedical science, including (...) human reproductive cloning, germ-line therapy, and xenotransplantation, as well as environmental health problems, including climate change, biodiversity loss, and depletion of the ozone layer. Growth in international trade and travel, in combination with population growth, has served to increase the frequency and intensity of health concerns bypassing or spilling over sovereign boundaries.Although health has traditionally been seen an area of limited multilateral cooperation, there is growing awareness that contemporary globalization has led to the proliferation of cross border determinants of health status and is undermining the capacity of nation states to protect health through domestic action alone. How should the global set of social institutions distribute income and wealth among members of different states? I present a Theory of Global Justice which supports the Bounded Significance of State Borders: The states system must satisfy the Determinate Human Needs of all, and the distribution within each state must satisfy Rawls' Difference Principle. However, justice does not require a Global Difference Principle: income and wealth need not be distributed so as to maximize the income and wealth of the (...) globally worst off. ;The Theory of Global Justice illuminates the status of claims to equality within contractualism. There is no general presumption for equality of condition, and only contingent grounds for equality of certain goods. ;The claim to satisfaction of needs and the claim to equal income and wealth stem from two different sources: The Principle of Human Rights and The Principle of Equal Procedural Controls. The Principle of Equal Procedural Controls applies among citizens within state borders, but not among individuals in different states. ;Chapter 1 presents the central concepts of the Theory of Global Justice: states systems, contractualism and impact arguments. ;The Theory of Global Justice recognizes two kinds of interests as grounding claims on social institutions: Determinate Human Needs, and various controls over factors which affect our lives. Chapter 2 explains the notion of Determinate Human Needs. ;Chapter 3 argues for The Principle of Human Rights. The set of international institutions must seek to secure the satisfaction of the Determinate Human Needs of all. ;Chapter 4 presents the Principle of Equal Procedural Controls. Participants in important procedures can sometimes reasonably claim an equal share of procedural controls. ;The Principle of Equal Procedural Controls applies differently among compatriots and among foreigners. Chapter 5 claims that this principle requires equality of Social Primary Goods and the Difference Principle among citizens. ;Chapter 6 denies that the Principle of Equal Procedural Controls applies among individuals in different states in such a way as to support a Global Difference Principle. State borders thus legitimately affect individuals' grounds for claiming equal shares of procedural controls. (shrink)

History has left a territory composed of two municipalitics, whose shape is unique, belonging partly to the Netherlands and partly to Belgium. Earlier both parts belonged to the former Duchy of Brabant, a tenitory that is now split up into the Dutch province of Noord-Brabant (including Baarle-Nassau) and thc Belgian provinces of Antwerp (which includes Baarle-Hertog), Vlaams Brabant, Brussels, and Brabant-Wallon. People are quite comfortable with this situation, even though it raises many complicated and difficult problems that even the most (...) brilliant jurists are puzzled. Baarle-Hertog is called on older Belgian maps Barle-Duc (Hertog = Duke, fr: duc) and must not be confused with the prefectoral town of Bar-le-Duc, Meuse, France. (shrink)

Globalisation may concern many different issues, among others, the increase in migration that creates opportunities for all. There should be no doubt that globalisation can bring both positive and negative effects to workers. It can be seen as new opportunities for people, because they can travel, work, learn and live in different countries. Simultaneously however it can be perceived as synonymous to job losses, social injustice, or low environmental, health, and privacy standards. As a result of globalisation, the world is (...) becoming more and more complex and the economic importance of state borders is reduced. It should therefore not raise doubts, that global problems require the capacity to agree on coordinated global responses and mechanisms on the basis of international cooperation. Among the basic international organisations which provide solutions for workers who have decided to look for a job in another country, one can generally mention the International Labour Organisation, the Council of Europe, and the European Union. There is quite a large number of legal acts created in the framework of those organisations, and so we should ask a question if in such a situation we should also try to understand some legal concepts; in our case concepts connected with taking up employment, in a similar way. Even if the answer is positive, another question comes to mind – is it possible to have such definitions in a global world? It is thus not enough to provide legal regulations concerning worker’s rights and obligations if we do not know who exactly should be treated like a worker. The following article will try to answer those questions and simultaneously try to show that globalisation may affect the way certain terms should be understood. (shrink)

Kant’s theory of international politics and his right of hospitality are commonly associated with expansive projects of securing human rights or cosmopolitan governance beyond state borders. This article shows how this view misunderstands Kant’s criticism of the law of nations tradition as handed down into the eighteenth century as well as the logic of his radical alternative, which was designed to explain the conditions of possibility of global peace as a solution to the Hobbesian problem of a (...) war of all against all in the state of nature. I resolve longstanding confusion over the meaning and justification of Kant’s right of “hospitality” by showing how it functions not as a freestanding positive claim demanding enforcement but as a way of ruling out specious justifications for war against those the traditional law of nations permitted one to label “enemies.” This poses important questions for contemporary theories of global justice. IN THIS ESSAY WE ARGUE FOR A RECONFIGURATION OF JUST WAR THEORY around the principle of just intention. A just intention—based just war theory can overcome problems inherent in two alternative "ideal-typical" accounts of just war theory. The "internationalist" account argues for the promotion of justice, by analogy to its pursuit in domestic politics. The "realist" account, on the other hand, favors the particular manifestations of justice within states. Taken together, these two accounts complement each other and emphasize genuine goods. (...) The possibility of taken them together, however, arises only out of consideration of just war theory as a peacemaking activity, ordered to the end, or intention, of this political act. Qutayba ibn Muslim al-Bāhilī is one of the leading soldier-bureaucrats of the Umayyads period. During the time he served as the governor of Khurāsān, he consolidated the Umayyad’s rule in Tokharistan and Transoxiana provinces, and expanded the borders of the state to China by conquering the Kashgar region. His activities for conversion of the people of the conquered regions have great importance in the history of Islam since the intense relations of the Turkish people with Islam fell upon the (...) time of his governorship. It is possible to argue that by introducing the religion to these people Qutayba had played an important role in their conversion to Islam. It is also known that he had sent a delegation to the emperor of China for the same purpose. However, despite all his achievements, it is seen that the academic studies about Qutayba in our country are very rare. Besides, some of the recent studies about him claim that he was a fraud, a trickster, and an untrustworthy person in his military activities; and had committed mass murders and massacres, persecuted innocent people, destroyed and burned the cities of conquered lands. In this article, it is examined that whether these claims and accusations have their justifications or not by consulting the main sources. In fact, what is expected from constructive criticism in this subject and every other area is to clarify the matter and make it more comprehensible of its context. However, it should not be forgotten that some conclusions over Qutayba in these studies might have been drawn to quickly in order to manipulate the conquest movements of the Umayyad period.Summary: The religious interaction and change taken place in the Arabian Peninsula with the emergence of Islam and with the political, military and cultural activities of the Muslims performed during the periods of Prophet Muhammad and the Rāshidūn (rightly guided) Caliphs had significant effects upon the lands of Iraq, Syria, Egypt and Khurāsān where the ancient civilizations located.The success made by the Muslim-Arabs in such a short time is accepted of course as one of the important events of world history. The message of Islam spread rapidly with their extraordinary efforts, and reached quickly in the early days of Islam to the Amu Darya/Oxus River, which is considered to be the natural border between the Iranians and the Turks (Iran and Turan).Although the Turks who had been struggling to dominate the region for centuries gained an opportunity with the disappearance of the Sasanian Empire from history, they could not take advantage of this new situation because of their lack of political unity and a strong state, and the power held by the regional Turkish Sultans were not enough to make their dominance happen. In this conjuncture, the Muslim-Arabs who appeared in the stage of history in a relatively late period but had the ideal of being a regional and a global power had rapidly realised their political and military activities called “conquest” in the Islamic historical sources. When it comes to the period of Caliph ʿUthmān, it is seen that the conditions were very suitable for passing to the east of the Oxus River where the Turkish elements lived intensively. At the time, the absence of a strong Turkish state in the region, and China’s occupation with its own internal problems made an important contribution for the Muslim-Arab capture of the region. In this region, which is called as “Transoxiana” in the Arabic sources, it is seen that the Turks organized their political structures as city-states and regional sultanates. In the north-eastern parts of this region, there was a strong Turkish State called the Turgish State and it provided political and military support to the people of the region who rebelled occasionally the Umayyads.After solving the internal problems of the state largely and suppressing some dangerous revolts, the Umayyad Caliph ʿAbd al-Malik ibn Marwān became capable of initiating military activities beyond the borders of the state. Nevertheless, the period when the actual conquests were made was the period of his son Walīd (86/705-96/715). It is seen that the conquests made in his time were permanent, and the people who lived in the conquered lands accepted Islam to a large extent. The conquest made during Walīd’s time which extended from Kashgar to the Pyrenees, realised at an unprecedented pace. The most important name for the eastern side of the conquests is undoubtedly Al-Ḥajjāj ibn Yūsuf. Ḥajjāj (75/694-95/714) who acted as the supreme governor of Iraq for nearly twenty years, had achieved important successes in the regions of Transoxiana and Sindh located in the eastern part of the country by the hands of his appointed governors. However, many governors appointed by him to Khurāsān from 75/694 to 86/705 with the hope of reaching his goals in the east could not meet his expectations because of the political, social and economic problems that existed throughout the country, and because of the resulting rebellions in the regions that these problems caused.These unwanted conditions continued to be seen in the region until he appointed Qutayba ibn Muslim as the governor of Khurāsān (86 / 705-96 / 715) who was one of the young commanders and administrators educated by Ḥajjāj personally. Qutayba known as having a close relationship with Ḥajjāj and consulting him when taking important decisions acted in this direction throughout the time he stayed in this position.It is known that the internal conflicts in the region continued during the time when Qutayba was appointed as the governor of Khurāsān. However, he had brought together northern and southern Arabian tribes living in the region with religious, political and economical suggestions and had succeeded in persuading them for military activities that he decided to operate beyond the Oxus. For the Umayyads, these military operations were justified, because the regional sultans who ruled in the western and eastern sides of the Oxus repeatedly violated the agreements they had made before. The tendency of the people of Turkic, Iranian, and Tajik origin who were the real owner of these lands and lived in both sides of the rich Oxus basin for many centuries to violate these agreements was in fact result of a great concern. They now realized that the Muslim-Arabs who followed a systematic settlement policy in the region came to their lands this time without any intention of going back. Even though Qutayba followed a fair and reasonable policy towards them, they violated their agreements with him, formed alliances among themselves and waged military campaigns against Qutayba not to be the subjects of any change in their religion, worldview, and perception of existence.Qutayba, who is believed to have spent his its utmost efforts to make the religion of Islam and the Umayyad political cause permanent in the region under these unfavourable conditions, has been recently criticized by some researchers. The criticisms intensify around the claims that he persecuted people, committed massacres, and behaved unfaithfully by breaking his promises that he made with people. From the perspective of our own times, it is possible to think that sometimes he had taken extreme measures in punishing the sultans and the persons who raised armed struggles against him and caused riots by violating the agreements. However, when the period is compared with the others, it can be easily said that the Umayyads showed in these and other remote areas a considerable amount of tolerance that they had never shown it in their internal conflicts. It is a known fact that he generally clashed with the ones who disrupted agreements, sought help from external forces, established alliances against them, and refused to pay taxes. Based on historical sources, it does not seem to be possible to say that while doing these activities in the region, Qutabya did not behave entirely in a way that his behaviour could be classified as massacres committed against innocent civilians. On the contrary, it is known that Qutayba had given many chances to the people of the region in administrative and military affairs. As a matter of fact, he ruled the city of Bukhara for 20 years with a Turkish ruler whom he appointed and supported, and he included in his army a union of twenty thousand cosmopolitan soldiers assembled from the people of Bukhara, Baykend, Chach and Samarkand and paid a regular salary to them.The fact that his grave known as the “Imam Shaykh Qutayba Tomb” was turned later into a shrine and visited by the people even today despite the passage of long centuries after his death shows that he has been loved by the people of the region and that they have always considered him as a conqueror-bureaucrat who spent his life for the ideals of his religion.
