This op-ed examines the philosophical foundation of the debate over the 1972 Constitution of Bangladesh and whether it requires reform or a complete rewrite. Reform would involve specific amendments to address current issues while rewriting would involve a full reconsideration to eliminate authoritarian elements and restore alignment with the democratic ideals of the 1971 Liberation War. This perspective emphasizes the need to return to the roots of the 1971 Proclamation of Independence, issued on April 10, 1971, by (...) the Provisional Government of Bangladesh in Mujibnagar. The proclamation championed the values of equality, human dignity, and social justice. Philosophy provides a framework for evaluating the Constitution’s core principles—nationalism, socialism, democracy, and secularism—and exposes how their misapplication has weakened democracy and marginalized citizens. A complete rewrite grounded in the first principles of equality, human dignity, and social justice could restore the Constitution’s role as both a moral and legal guide. Such an effort would ensure ethical governance and a democratic framework, providing stability and realigning the nation’s governance with its founding ideals. Since the post-August 5 discourse among public intellectuals has centered around op-eds and commentaries, the buzzwords "reform" and "rewrite" dominate discussions about our Constitution. But how many of us have paused to explore what these terms truly mean? In this commentary, I delve into the ongoing debate about reforming vs. rewriting Bangladesh’s Constitution. My op-ed explores the semantics of these terms and insinuates a bold argument: You don’t need to invoke the “spirit of 2024” to justify rewriting the 1972 (...) Constitution. Instead, the answer lies in returning to the core spirit of Bangladesh’s 1971 Liberation War: equality, human dignity, and social justice. Even substantial reformation may fall short to abolish all elements that contradict the Liberation War. A comprehensive rewrite is the only way to uphold the true spirit of our Liberation War and lay the foundation for a genuinely democratic Bangladesh, free from Hasinocratic authoritarianism. Despite the fact that the introduction of Christianity in Indonesia coincides with the arrival of Portugal and Dutch Colonialism in the 16th-19th centuries, Christianity in Indonesia could not be claimed as a colonised religion. This study emphasises the importance of Christianity as an integral part of the history of Indonesian nation-building. It also has significance and relevance for Christianity, and how people of different religions should live together in Indonesia. Using historical theology analysis, we argue that being Christian in Indonesia (...) has theological meaning as God's work in Jesus Christ. God that has called and sent Christians to Indonesia has bestowed independence on the country, as a nation that accepts and recognises all people in their plural existences. At the end of the research, the authors emphasise that by understanding the independence of Indonesia as God's gift, Christians are to make Indonesia a theatre for glorifying God. They should do it by dedicating themselves to participate in togetherness with all citizens to build and develop this country in all dimensions of life. Therefore, various actions that discriminate against Christians deny the history of Indonesian independence, which accepts and recognises the equality of all citizens as a gift from God. CONTRIBUTION: This article contributes to constructing a theology of nationalism as a kind of contextual theology, which is based on the particular context of the history of the proclamation of Indonesian independence. This study examines the influence of board independence on firm agency cost among listed firms in Bangladesh, which feature concentrated ownership and high insider representation on corporate boards. This study uses three measures of agency cost: the ‘expense ratio’, the ‘Q-free cash flow interaction’ and the ‘asset utilization ratio’. The finding of the study is that board independence can reduce the firm agency cost only under ‘asset utilization ratio’ measure of agency cost. These findings are robust to (...) several robustness tests. Furthermore, the non-linearity tests suggest that the benefit of outside independent directors is generally plausible as a factor controlling agency costs in the case of a medium level of board independence. Overall, these findings do not reject the validity of agency theory, supporting the Anglo-American orthodoxy promoting outside independent directors as good monitors. (shrink)

This study aims at assessing the level of knowledge, attitudes, and practices (KAP) concerning reproductive health (RH) among adolescent college-going girls in the urban and rural areas of Chittagong District, Bangladesh. A college-based cross-sectional study was conducted among college-going girls (N = 792) of four colleges attending Higher Secondary Certificate (HSC) classes (eleven/twelve classes) in Chittagong District. Data were collected using a structured and self-administered questionnaire. Chi-square (χ2) and independent-samples t-test were conducted to make the comparison between urban and (...) rural participants. Data were analyzed using IBM SPSS version 24.0. The authors’ interpretation of the findings was also informed by anthropological as well as qualitative considerations. Mothers were reported to be the key informants of reproductive health for the adolescent girls of both urban and rural areas. Besides, urban respondents were more likely than rural respondents (p <.001) to feel comfortable during the discussion on RH with mother/sister/relative; to communicate frequently with their mothers; to discuss RH issues regularly; to have prior knowledge on menstruation. Moreover, this study also found significant differences (p <.05) regarding most of the items addressing RH knowledge, attitude, and practice between adolescent girls in urban and rural areas of Bangladesh due to the existing socio-cultural disparities between the areas of residence. This article discusses the poem written by Joseph Brodsky shortly after the proclamation of Ukrainian independence in the early 1990s. It compares this poem with other pieces by the same author that deal with the paradigm of “independence vs. imperial unity.” These poems present a difference, which is striking at first glance: Brodsky welcomes Lithuanian independence, while simultaneously denying the same rights to Ukrainians and Aztecs. As for Afghanis … his disdain is even more palpable. The (...) proposed explanation is the concept of “Cultural Empire,” which the poet considers to be the ultimate good. Following the theater of war between the US-led NATO—Ukraine alliance and the Russian Federation, the 3rd World War situations intended to expand between Bangladesh and Myanmar. This doctrinal paper has been presented through codification of situations of the post-seizure war-fighting battles surviving cold and silent conflicts in Parbatya, Chittagong Hill Tracts, in order to deliver the seized nation onto a free pathway. This paper examines the perspectives of university teachers in Bangladesh regarding predatory journals, assesses their knowledge of the characteristics of such journals, investigates the factors that might influence their submission of papers to such journals, and explores their views on how universities can contribute to the identification of predatory journals. A total of 391 university teachers participated in this study. Chi-square tests were conducted to examine the relationship between participants’ demographic characteristics and their perceptions of open access and predatory (...) journals. The findings revealed that several demographic variables were significantly related to university teachers’ perceptions of predatory journals. Among the respondents who reported possessing a good knowledge of predatory journals (_n_ = 181), their understanding levels were assessed by assigning a score of ‘1’ for each correct answer and ‘0’ for each incorrect/unsure answer to 18 characteristics associated with predatory publishing. The scores obtained by this group of participants were transformed into percentiles and were categorized into three different understanding levels: poor, medium and high. The results of independent sample _t_-tests and ANOVA found significant differences in total correctness scores based on gender, designation and teaching experience. The study revealed that only 7% of participants had a high level of understanding of the characteristics, despite claiming to have a good knowledge of predatory journals. The findings of this study highlight the need to design and implement interventions to increase the awareness levels and combat the prevalence of predatory publishing in the academic community. Following modernization paradigm and some local dynamics conducive to development, some Asian countries emerged as economic tigers in the world. Conversely, other Asian countries including Bangladesh failed to taste economic development despite having monetary and technological aids from some developed nations. Drawing on some social and historical trajectories of the divergent contours of Asian development/ underdevelopment, the paper examines the state of development in Bangladesh. The study has found that Japan is the first country in Asia to achieve (...) modernization, and it was followed by other Asian tigers such as Korea, Taiwan, Singapore, Malaysia and currently China and India. We found that all these Asian tigers exert a developmental model which is characterized by ‘endogenous’ modernity and economic nationalism largely driven by, among other things, long-term economic vision and strong political leadership. While the history of Bangladesh has witnessed various cultural nationalisms, the nation has failed to generate any unified economic nationalism since its independence in 1971. We suggest that Bangladesh needs a long-term development vision—a key thrust for economic nationalism—focusing more on some socioeconomic and legal aspects that have historically become major impediments for development. This paper provides a synopsis of the human rights enforcement in Bangladesh, which marks its 50 years in 2021 since its independence. After a theoretical background on how human rights are perceived as legal and political instruments, it critically discusses human rights provisions and explores the legal and institutional frameworks on human rights enforcement in Bangladesh—(re)construed in 50 years (1971–2021). Finally, it divulges the controversies in human rights enforcement and a roadmap to address them by making some (...) suggestions: multiple legislative, administrative, and judicial reforms are required to tackle human rights abuses to ensure punishment for the abusers and restitution for the victims. The paper concludes with the notion that the positive will of the relevant stakeholders (legislature, executive, and judiciary) is the key to upholding and protecting the human rights of Bangladeshi citizens. The significance of this paper lies in exploring the complexities associated with the laws and insular national politics, which often debars the enforcement of human rights and crucially compromises Bangladesh’s ability to empower its citizens. The proclamation of Turkish Republic on the 29th of October 1923 was an important event within the entire Turkic world. The first democratic Republic in the East was the Republic of Azerbaijan, which proclaimed independence on May 28 1918. On April 1920 Azerbaijan Democratic Republic has fallen as a result of Russian Bolsheviks occupation. Later the formation of a new Turkish Republic in the West has become an embodiment of hope for Turkic world to exist independently. Prior to (...) the forming of Azerbaijan Republic, the true sons of Turkey became a great support for a young country and were excited about formation of the republic. Azerbaijanians for their part were supporting Turkey towards independence and also became the closest allies and comrades to Turks in this path. At the begining of 20th century the articles at magazines and papers, such as “Hayat”, “Fuyuzat”, “Teze Hayat”, “Achig soz” and “Caspian”, which were published within the support of Azerbaijan intellectuals, have gathered the society of Azerbaijani public for discussion of current at the moment historical events. The speeches of the eminent public figures (such as Ali bek Huseynzada, Akhmed Agaoglu, Alimardan bek Topchubashev, M.Makhmudbekov and Omar Faik) have played a significant role in national spirit rivival formation of patriotism and unity. Starting from the first decade of 20th century there were articles published, which call all muslim turkic nations for unity against the national opression, and in the movement for national independence during the First World War. The society of Azerbaijan has followed the changes, happening in the country and also abroad, especially in Turkey. The research of important topics, such as relationship and approach of Azerbaijan society to the development in Turkey, especially to Anatolian movement, are still valid and are of particular interest. The American Declaration of Independence served as a starting point for the drafting of the Israeli Declaration of Independence of 1948. Most of the original content was lost in the long process of translation and adaptation, but, using David Armitage’s recent terminology, the Israeli text remained as "generically promiscuous" as its predecessor, combining a "manifesto" of justifications for the assumption of sovereignty, a formal proclamation and a proto-Bill of Rights. This Article depicts the work of Mordechai Beham, (...) the Israeli Declaration’s first draftsman, as a remarkable exercise in choosing contemporary, locally-valid "answers" to the fundamental "questions" posed by Thomas Jefferson and his contemporaries in 18th century America on human values, national identity, statehood, and God. The analysis is partially based in the current debate on "legal transplantation," arguing that the outstanding success of the Israeli Declaration stems from both the quality of the American original and the massive work of adaptation to Israeli soil. In _Rawlsian Political Analysis: Rethinking the Microfoundations of Social Science, _Paul Clements develops a new, morally grounded model of political and social analysis as a critique of and improvement on both neoclassical economics and rational choice theory. What if practical reason is based not only on interests and ideas of the good, as these theories have it, but also on principles and sentiments of right? The answer, Clements argues, requires a radical reorientation of social science from the idea of interests (...) to the idea of social justice. According to Clements, systematic weaknesses in neoclassical economics and rational choice theory are due to their limited model of choice. According to such theories in the utilitarian tradition, all our practical decisions aim to maximize the satisfaction of our interests. These neo-utilitarian approaches focus on how we promote our interests, but Clements argues, our ideas of right, cognitively represented in principles, contribute independently and no less fundamentally to our practical decisions. The most significant challenge to utilitarianism in the last half century is found in John Rawls’s _Theory of Justice _and _Political Liberalism_, in which Rawls builds on Kant's concept of practical reason. Clements extends Rawls's moral theory and his critique of utilitarianism by arguing for social analysis based on the Kantian and Rawlsian model of choice. To illustrate the explanatory power of his model, he presents three detailed case studies: a program analysis of the Grameen Bank of Bangladesh, a political economy analysis of the causes of poverty in the Indian state of Bihar, and a problem-based analysis of the ethics and politics of climate change. In the wake of the First World War, a new form of commemoration emerged internationally, but in each case focused upon a new kind of national “hero”—the unknown soldier or warrior. The first instances appeared in France and Britain in 1920, followed by the United States in 1921, and Belgium in 1922. Other nations followed suit over the years, with the most recent WWI Unknown Soldier monument dedicated in 2004, in New Zealand. The motivational calculus of these national tombs was, (...) of course, the massive number of combatant dead whose remains could not be identified. This paper takes up the two very different arguments composed by these commemorative sites. The first argument was directed to surviving family members and was articulated most explicitly by the French as a hypothetical enthymeme “this could be your husband, your father, your brother,” etc. The second argument has been directed to national and international collectives as a constitutive proclamation of legitimated nation-state or Empire Although this argument is particularly explicit in postcolonial gestures of independence on the part of former dominions of old empires, it was evident in even the earliest cases of the tombs of the unknown. Bangladesh emerged as an independent country in the South Asia in 1971 after being separated from Pakistan. In 1971 it was a very poor country. The general people had a hope and dream that the political parties will develop the country and will eradicate poverty gradually, will provide jobs to the 50% unemployed people, will educate the 60% illiterate people; but their holy hope and dream have not been fulfilled due to frequent hostile political culture, beating, killing among the (...) political party members, no patriotism among the political leaders, massive corruption, unnecessary frequent strike, unnecessary opposition to the government policy etc. This paper has narrated the past and current social and political situation in Bangladesh briefly with the help of data collected from newspapers and statements given by intellectuals and political leaders. From the year of Ukraine's proclamation of state independence, a qualitatively different one began, without exaggeration - an epochal period of its development. The cherished dream of many generations of Ukrainians to live in an independent Fatherland has finally acquired a real outline, which in the post-Soviet consciousness of the million-minded people of Ukraine has been associated with centuries of cherished hopes for nation-wide peace, harmony, prosperity and happiness. But Ukraine is already in the second half of the (...) 80's, and more recently - in the early 90's of the twentieth century. entered a period of dramatic and all-encompassing changes, which predetermined the rapid dynamics of the acquisition by the Ukrainian ethnos of its substantive self, and in particular that of spiritual and religious literacy, which related to the need for self-knowledge and self-awareness and found expression in the intensification of Ukrainian religiosity. Involvement in the process of broad strata of Ukrainian citizens, and consequently people of different views, religions and beliefs, as well as the intensity of socio-ideological shifts, not only contributed to the enrichment of ideas about spirituality, but in fact led to its value-based revision. The rules as we know today in modern societies have their base in the Magna Carta from 1215. In that time people declared that the rights of the king and nobles must be limited and that was the first step toward as we know today “democracy”. The rights incorporated in the Magna Carta defined the limits what a state can do and also set boundaries in order to achieve equality between the state and the individual. The rights proclaimed with Magna (...) Carta found their path in the French Revolution from 1789 as “Liberty, Equality and Fraternity” became symbol of democratic freedom and afterwards gave value in the conventions and other international instruments. The main purpose that was achieved with Magna Carta from today’s perspective is that the rules have been implanted in the conscience of people, so they learn to obey and practice them. The Magna Carta rights are integral part of international conventions and on that way they have been taken from the states on national level so they become inevitable incorporated segment of the constitution and the laws of states. Those rights have achieved their purpose, because 800 years after their proclamation, some of them are still on force and have been provided in the constitutions of many countries including the Western Balkan countries. The rights that derived from Magna Carta concerning the rule of law, independence of the judiciary, equality before the law and prohibition of discrimination are integral part of the Constitution of Macedonia which makes efforts for their implementation into practice – because contrary, words will be just words on paper and nothing else. What would be the consequence of embracing skepticism about free will and/or desert-based moral responsibility? What if we came to disbelieve in moral responsibility? What would this mean for our interpersonal relationships, society, morality, meaning, and the law? What would it do to our standing as human beings? Would it cause nihilism and despair as some maintain? Or perhaps increase anti-social behavior as some recent studies have suggested (Vohs and Schooler 2008; Baumeister, Masicampo, and DeWall 2009)? Or would it rather (...) have a humanizing effect on our practices and policies, freeing us from the negative effects of what Bruce Waller calls the “moral responsibility system” (2014, p. 4)? These questions are of profound pragmatic importance and should be of interest independent of the metaphysical debate over free will. As public proclamations of skepticism continue to rise, and as the mass media continues to run headlines announcing free will and moral responsibility are illusions, we need to ask what effects this will have on the general public and what the responsibility is of professionals. Ex interiore ipso exeas. Preface. This book reconstructs the history of a still open dialectics between several ethoi, that is, shared codes of unwritten rules, moral traditions, or self-aware attempts at reforming such codes, and ethical theories discussing the nature and justification of such codes and doctrines. Its main claim is that this history neither amounts to a triumphal march of reason dispelling the mist of myth and bigotry nor to some other one-way process heading to some pre-established goal, but (...) instead to a chain of controversies where the partners’ will to win unintentionally yields a wealth of insights on human existence that has still something to teach us. -/- 1. The Hellenic moral tradition. -/- Two different traditions of morality in vi-v century Greece are described. The birth of philosophical questioning of traditional morality and temporal and spatial variation of custom is described within the context of the v century crisis, the demise of traditional aristocratic and tyrannical rule and the birth of democracy. Two conflicting answers to the challenge are reconstructed, namely conventionalist or immoralist theories formulated by the Sophists and the eudemonist and intellectualist Socratic theory. -/- 2. Plato and the Good. -/- Plato’s own reformulation of Socrates rejoinder to the Sophists is reconstructed. His psychological views, his classification of the four cardinal virtues and his political theory are described as parts of a unitary system, culminating in an extremely realist moral ontology identifying the idea of the good with the essence of the (moral and extra-moral) world itself. -/- 3. Aristotle and practical philosophy. -/- Aristotle’s invention of practical philosophy as a field separated from first philosophy is shown to be an implication of his break with Plato moral ultra-realism. Aristotle’s agenda in his moral works is arguably dependent on a polemical intention, namely dismantling Socratic intellectualism. The semi-inductive or virtuously circular method of practical philosophy is illustrated, starting with the received opinions of the better and wiser individuals and trying dialectically to sift what is left of mistake and inconsistency in such opinions, finally trying to correct mistakes and make the overall practical science more consistent. The relationship of individual ethics, or ‘monastics’, with the art and the science of the pater families, or ‘economics’, and the science of the ruler and citizen, or politics, is illustrated. The nature of virtues, or better, excellences of character, is discussed, highlighting the basic role of hexes, or ‘dispositions’. Prudence, or better, practical wisdom, is the focus of the chapter. Its relationship with boùleusis or deliberation is discussed, and its autonomous status vis-à-vis theoretical knowledge is stressed. -/- 4. Cynics and Stoics: ethics as therapy. -/- The chapter provides an overview of Hellenistic ethics, which almost amounts to Hellenistic schools of philosophy, in so far as ‘philosophy’ became in these centuries primarily the name for a way of life. The typical character of the Cynical movement is highlighted, that of a school of life, not a school aimed at providing any kind of intellectual training was to be provided. The various phases of Stoicism are described, and the shifting place that was given to ethics in the Stoic system of idea, culminating in the paradoxical view of ethics, its impossibility in principle notwithstanding, as the only truly significant and necessary part of philosophy. The peculiar character of the Epicurean school is described, a combination of the science of well-being aiming, more than pleasure understood as in the popular view, the reduction of useless suffering, of unnecessary needs, and at a balanced selection of pleasures of the best and most durable kind. -/- 5. Roman and Imperial Moralists. -/- The chapter is dedicated to the reconstruction of a particular kind of literature, whose specific features have long been under-stressed, namely the Roman and Imperial moral literature. Cicero is treated at some length, showing how his own synthesis of various Hellenistic trends is as a truly philosophical enterprise, deserving serious consideration after one or two centuries when he was confined to the role of literate. Epictetus is given pride of place, stressing the novelty of his approach to ethics as cognitive therapy, in this case just following an already existing new wave of interest after nineteenth-century oblivion justified by alleged lack of authentic ‘philosophical’ character. -/- 6. The Hebrew moral tradition. -/- A reconstruction of basic ideas from a few books of the Hebrew Bible is provided, starting with the Prophetic tradition and the focus on God’s mercy as the source of motivation and standard for human behaviour. Then a comparative analysis is undertaken of a parallel tradition, namely the three codifications of the Torah (Law or, better, Instruction), highlighting how a core of moral ideas may be recognized as a basis and preamble of codification of civil law, cultural practice, and regulation of ritual purity. The importance of Levitic is stressed as the turning point when the stress on mercy, typical of the Prophetic tradition, starts being combined with legal tradition yielding the change in the sensibility of the Second Temple time. -/- 7. Second Temple Judaism. -/- This chapter describes the Long March leading from the post-exile Zadokite restoration to the first-century aevi vulgaris. The first topic reconstructed is the Zadokite theology of the double retribution. The second is the alternative Enochic tradition consistently rejecting the central role of the Temple, the Priesthood and worship as atonement for sins and offering as an alternative God’s unlimited mercy and preaching mercy, not sacrifice as the way of behaving requested by God. Wisdom literature, the third subject discusses, is a kind of third way, on the one hand increasingly critical towards the double retribution and ruling theology’s optimism facing the world as it is and on the other mocking at the Enochic current as a band of dreamers and visionaries. The third way consists in disenchantment facing the word as it is combined with a refusal of vain and childish hope of prizes for the righteous, suggesting instead the leading idea of right deeds for righteousness’s sake. Rabbi Hillel, Rabbi Yeshua and Philo of Alexandria are described as the three leading figures at the culminating point of such process of emergence of a new sensibility, gradually including mercy as an essential part of justice and establishing the starting point of both the Rabbinic and the Christian tradition. This starting point consists precisely in the precept of one’s neighbour’s love or of the golden rule, whose meaning is, arguably, more consistent than a long-lasting Christian tradition deriving from John and Augustine made us believe. And Christian morality, vis-à-vis allegedly legalist ‘Ancient Testament’ teachings, is less of a novelty than most early Christian writers announced. -/- 8. Talmudic moral doctrines and proto-Christian paraenesis. -/- The first three sections examine the moral doctrines of so-called 'ethical Treaties' from the Talmud, a group of treaties, among which the best known is Pirke Avot, that were left out of the six "orders" of the canon as they did not fit in any of the six groups of issues ritual or legal on which the division was based. According to Maimonides, their peculiar theme is provided by the Deot, 'opinions', i.e., mental dispositions, that is, the translation of the Greek term hexes and Arab akhlak (in turn providing in this language the name for ethics as such). The three topics I reconstruct are: i) the notion of Torah: The Torah is understood as the world order itself, or as the ‘Wisdom’ that existed even before creation and was "the tool by which the world was built"; however, the Torah is an earthly and human entity, as it was "received" by humans, and from that very moment belongs to them; ii) the relationship between love of God and love of neighbour; the treaties require us to study and practice the Torah ‘for its own sake’, that is, require us to act out of love, not out of fear or hope of reward; iii) the idea of sanctification of daily life: having disappeared with the destruction of the Temple the possibility of any conflict between liturgical service and everyday life, the latter is assumed to be in itself divine service: to give food to the poor has the same value as sacrifices in the Temple, and as an implication, the insistence become recurrent on the goodness of created things in themselves along with a polemic against ascetic currents. The conclusions drawn are: i) the moral teachings of the Talmud and those of Yeshua are, rather than similar, virtually identical; one may safely say that the precept of love and the golden rule are central ones for all Talmudic rabbis, that mercy plays an indispensable role alongside with justice, and the latter is not a different thing from one’s neighbour’s love; ii) a peculiarity of Talmud rabbis facing Yeshua is the idea of study as worship, and knowledge as a source of justice; but this is an idea of Judaism after the Temple's destruction that cannot be attributed to the Pharisees of Yeshua’s time; iii) the relation of study and practice in the Talmud parallels that between faith and deeds in Paul's epistles, that is, respectively faith or learning are a necessary and sufficient condition to be recognized as righteous, but deeds are the inevitable effect of either faith or learning. The last two sections examine first the various Christian currents and then Gnostic para-Christian or non-Christian currents as well as Manicheism. The sayings ascribed to Yeshua are examined first, yielding the conclusion that a close equivalent may be found for every saying in Talmudic literature and yet the whole is ascribed to one rabbi, with rather consistent stress on God’s mercy and unconditional forgiving as the mark of true imitation of God. Thus, Yeshua’s teaching is pure, purest Judaism. The last section describes briefly the galaxy of Gnostic currents and Manicheism, trying to sketch the profile of moral teachings resulting from an encounter of Asian spiritual traditions, Hellenistic lore and sparks of teachings from apocalyptic Jewish currents. -/- 9. Christianity as “philosophy”. -/- The chapter reconstructs the stormy story of several encounters between Christian currents and Hellenistic philosophical schools. The first one was with late Cynicism. Recent, rather controversial, literature discovered the jargon and several rhetorical topics from the Stoic and Cynical popular philosophy in a few books from the New Testament itself. This, far from proving that Rabbi Yeshua himself had been influenced by cynical preachers, is a proof of the necessity to translate the original Christian message in a Greek lexicon deeply impregnated with cynic terminology. The second was with Platonism, yielding the mild and temperate moral teaching of Clemens of Alexandria, teaching the sanctity of nature and the human body, the joy of moderate fruition of ‘natural’ kinds of pleasures, and the beauty of the marital life – in short, the opposite of the standard picture of Medieval Christianity. Ambrose of Milan brings about a different kind of synthesis, namely with Middle Platonism, where Stoic themes prevail. The most shocking case is Augustine, where early Manichean education is overcome in a former phase by a synthesis of Plotinian Neo-Platonism and Christian preaching, yielding a sustained polemic with the Manicheans and rather optimistic views on life and Creation, the body and sexuality, and Hebrew-Judaic tradition not far from Clemens of Alexandria. In a later phase, occasioned by controversy on the opposite front, with such Christian currents as the Pelagians and Donatists, Augustine comes back to heavily anti-Judaic and world-denying ascetic attitudes where is earlier Manichean upbringing seems to emerge again. The tragedy of medieval Christianity will be the later Augustine’s overwhelming influence. A final section is dedicated to the monastic tradition where a curious mixture of world-denying asceticism with an astonishingly penetrating ‘science’ of introspection emerges. -/- 10. Ethics in the Arabic-Islamic Philosophy. -/- The Qurān and the qadit, that is, collections of sayings ascribed to the prophet Muhammad contain a wealth of precepts and catalogues of virtues mirroring moral contents from the Jewish and the Christian traditions, among them the basic notion of imitation of the Deity, where mercy is assumed to be its basic trait. An important tradition within Islam, namely Sufism, stressed to the utmost degree the role of mercy, turning Islam into a mystic doctrine centred on the retreat from the world, abandonment to God’s will, and a peaceful and fraternal attitude to our fellow-beings. A secular literary tradition originating in the Sassanid Empire, the literature of advice to the Prince, had for a time a widespread influence in the newly constituted Arabic-Islamic commonwealth. In a later phase, the legacy of Hellenic philosophy made its way into the intellectual elite of the Islamic world. The first important legacy was Platonic, and the Republic became the main text for Islamic Platonism. In a second phase also Aristotelian and Stoic influence were assimilated. Miskawayh’s treatise was the masterwork at the time Arabic philosophy reached its Zenith. It is a treatment of the soul’s diseases and their remedies, combining the Aristotelian doctrine of the golden mean with the Stoic doctrine of the passions and elements of Galenic medicine. Towards the eleventh-twelve centuries, a war raged among theologians and philosophers, finally won by the former with the disappearance of philosophy as such. The newly established mainstream, yet, was no kind of intolerant fanaticism. It drew from the work of mystic theologian Al-Ghazālī, the best heir of Sufism, teaching a tolerant and peaceful attitude to our fellow-beings and a passive attitude to destiny as an expression of the Divine will. -/- 11. Ethics in the Jewish philosophy. -/- The encounter between the Talmudic tradition and Hellenic philosophy had taken place for the first time in Alexandria at the time of Philo but the two traditions had parted way again. In fact, the kind of Platonic Judaism founded by Philo survived only within Christianity, in the fourth Gospel and then in writings by Clemens of Alexandria. The Talmudic literature had absorbed too a few traits from the Hellenic Philosophy, namely an idea of ethics as care of the self and a role for the education of character as propaedeutic to theoretical knowledge. In the Arabic-Islamic world, a second round started when Jewish authors writing in Arabic undertook the task to prove the full compatibility of the tradition deriving from Tora and Platonic philosophy. The culmination of this attempt is provided by Moshe ben Maimon who tried to use Aristotelian ethics as a language into which the teaching from the Pirke Avot could be translated. -/- 12. The practical philosophy revival in Latin Europe. -/- A reconstruction is carried out of a fresh start of philosophical ethics in Latin Europe at the turn of the Millennium rescuing a Platonic and Augustinian legacy, with Anselm and Peter Abelard. In this phase remarkable innovations are introduced, including Abelard’s claim of the obliging character of erring consciousness. In a second phase, the rediscovery of Nicomachean Ethics thanks to Latin translation of Arabic versions, gives birth to a new wave of ethical studies, recovering the very idea of Aristotelian practical philosophy, with the potential implication of a full legitimization of natural morality, i.e. ethics without Revelation. -/- 13. Scholastic practical philosophy: Thomas Aquinas. -/- Aquinas’s ethics is theological ethics out of which it would be vain to try to extract self-contained philosophical ethics. His treatment of topics in philosophical ethics, yet, does not boil down to the repetition of Aristotelian arguments but is rather a creative reshaping of such arguments. For example, he introduces also in the practical philosophy a first principle parallel to the principle of non-contradiction; and he also carries out a synthesis of Aristotelianism, Stoicism, neo-Platonism. Even though it is essentially moral theology, Aquinas’s doctrine - unlike Augustine – grants full citizenship to "natural" morality, firstly by rejecting the claim that the corruption of human nature due to the original sin is so radical as to leave pure nature incapable of moral goodness. The doctrine is presented in a more sophisticated formulation in a few of the Quaestiones such as De Malo and De Veritate, in the Summa contra Gentes and in the commentaries to Aristotle than in the famous Summa Theologica, but the latter work includes the only or the largest exposition of some decisive part of the theory. Thus, the Summa Theologica should be read for what it is more than criticized for not being what it was not meant to be. It was not meant to be the brilliant synthesis of all that Reason he had been able to produce with what Revelation had added about which the Neo-Thomists used to dream, but rather a manual for the training of preachers and confessors, where theoretical claims are not too ambitious, and a few serious tensions are left. Besides a jump between the Prima Secundae and the Secunda Secundae, being the former an essay in virtue theory and the latter a handbook for confessors, the most serious tension is perhaps the one between the ethics of right reason presented in most of Prima Secundae and the eudemonistic ethics developed in quaestiones 1-5 of the same part; the alternative ethical theory which also may be found in Augustine, the Stoic view of a cosmic reason eventually coincident with the moral law, was believed by Anselm (followed by John Duns Scotus and William of Ockham) to be incompatible with eudemonism. It is questionable whether Thomas was able to solve the tension proving that it is just an apparent tension, in so far as the right reason and bliss derived from the knowledge of God tend to coincide, but this is just a conjecture. Thomas’s ethics is a virtue ethics, not a law-based one, and moral judgment focuses on the virtues, particularly charity, not on the commandments and even less on absolute prohibitions; Thomas, however, would not have considered a drastic alternative between law and the virtues such as the one which has been advanced in late twentieth-century philosophy to be justified. Nonetheless, when it discusses ‘special’ virtues, it ceases to be an ethics of virtue and becomes a disappointing and often contradictory discussion of legal and illegal acts. Such a discussion takes most of the time ‘reasonable’ middle positions on controversial issues but not the alternative approach that Aristotelianism would have made possible; even when some occasional Aristotelian claim shows up, such as money’s barrenness as a reason against usury, this seems to be made by an author who apparently ignores the Aristotelian Thomas of the Prima Secundae. It is an ethic of human autonomy which recognizes the binding character of the individual conscience and, potentially, even a duty to disobey unjust laws. It is true that what Thomas writes in his discussion of the death penalty and persecution of heretics is simply disgusting, and yet we should blame Thomas the man, not the Thomist ethical theory. Finally, Thomas’s ethics is no way an ethical ‘absolutism’, as both the traditionalist Catholic theologians and secularists tend to believe, but rather an ethic of prudential judgment on the individual case. Exceptions to this approach – or better the result of logical fallacies – are provided by the thesis of the absolute character of negative precepts and of the existence of so-called intrinsically evil acts, a thesis that would simply cease to make sense in the light of Thomas’s own distinction between human act and natural act, carrying consequences that Thomas did not live long enough to draw. -/- 14. Scholastic practical philosophy: John Duns Scotus and William of Ockham. A reconstruction is carried out of the ethical doctrines by both most authoritative Franciscan doctors. Their continuity with Aquinas is vindicated against prejudice carried by centuries of polemics within the Catholic Church and tendentious disparaging of both as forerunners of execrable Reformation. Besides aspects of continuity, also the important novelties are illustrated, first John’s abandonment of Aquinas’s and Augustine’s eudemonism, asserting righteousness for righteousness’s sake, and then William’s explicit defence of the philosopher’s virtues, that is, natural morality, and his solution to the dilemma of God’s omnipotence and the universal validity of natural law extending to God himself. -/- 15. Aristotelianism interpreted by the Magistri Artium. -/- A reconstruction of the until recently forgotten ethical doctrines by the Parisian Magistri Artium, falsely depicted as ‘Averroists’ and either deprecated as heretics or mistaken for predecessors of modern secularism. In fact, they illustrate a view of ‘natural’ virtue as may be understood by human reason without the assistance by Revelation. -/- Etiamsi daremus Deum non esse. Intermediate considerations. Three considerations may be suggested by the story told in the book. The first one is that intellectual histories have been mounted in the past with the same state of mind as one may mount a war chariot. Such constructions are not very helpful as tools for understanding the past. Wars waged in the past have left the field obstructed by ruins not easy to remove even by those historians who have animated by an impartial academic motivation. They have been influenced too by consequences of past emphasis on some authors and damnatio capitis suffered by others, by stratifications left on sources by secondary literature and translations, by allotment of originally close sources to different literary genres, by the monopolization of religious texts by churches with full cooperation by secular scholars who still fear contamination. The second one is that aware or unaware ethnocentrism has carried various calamities to our comprehension of the past. Their last vestiges have surfaced again in the semi-scholarly discussion on the idea of Europe occasioned by the debate on a project of a European Constitution. Mention of Europe’s Christian roots has been the clumsiest move. Proclamations of such roots were so obvious in what they affirmed as they were totally off-path concerning what they omitted, namely that he modern European moral tradition included legacies from Middle-Eastern wisdom, Hellenic philosophy, Roman Imperial legal literature, and, besides, a Jewish legacy in turn incorporating other more ancient Middle-Eastern legacies and which has been partly conveyed by Christianity. And the Islamic-Arabic philosophy too, in so far it made the Nicomachean Ethics available to Latin Christian scholars, is one more of Europe’s roots. The third is that religious traditionalists and secularist fundamentalists have gone hand in hand for a couple of centuries in either extolling or deprecating the allegedly Modern idea of Ethics without God, first formulated by Hugo Grotius with the claim that natural law would still be valid ‘etiamsi daremus – quod sine summo scelere dari potest – Deum non esse’. The facts are, firstly, that this is not an irreligious claim and Grotius was just a pious and meek Christian and, secondly, that it is not a ‘modern’ claim but rather one more formulation of the claim that there is a natural morality, independent of divine revelation, a claim shared by Moshe ben Maimon, Aquinas and William of Ockham. -/- . This book is a manifesto for what John Alcock calls “orthodox sociobiology,” the systematic study of the biological basis of all social behavior following the premise that behaviors and their mechanisms evolve under the primary influence of natural selection acting on individual differences in genetic success. Sociobiology focuses narrowly on finding adaptive explanations for social behaviors while attempting a grand synthesis of biological and social sciences. Alcock's book is largely defensive, aimed at refuting criticisms and a perception that, twenty‐five years (...) after its proclamation, sociobiology is moribund. Alcock's defense relies not on an extensive review of relevant literature but on the persuasiveness of arguments illustrated with favored examples. He emphasizes sociobiology of human cultures and prescribes practical applications for restructuring societal institutions.The major argument against orthodox sociobiology is summarized in Edward O. Wilson's book Consilience : “We know that virtually all of human behavior is transmitted by culture. We also know that biology has an important effect on the origin of culture and its transmission. … Culture allows a rapid adjustment to changes in the environment through finely tuned adaptations invented and transmitted without correspondingly precise genetic prescription. In this respect human beings differ fundamentally from all other animal species” . This argument denies that human social behaviors are best understood as biologically evolved adaptations and places them outside the domain of the genetical theory of natural selection.Alcock's major claim for sociobiology's triumph is its use of comparative methodology to identify ultimate causes of social behaviors. Over the past twenty‐five years, evolutionary biologists have developed rigorous systematic methodologies for making comparative inferences in evolutionary research. Such explicitly phylogenetic approaches provide more powerful tests of ultimate causality in evolution than the comparative methods available when sociobiology was first proposed. Although the success of sociobiology would seem to lie in its ability to use the strongest comparative methods to test its major claims, Alcock's examples rely entirely on archaic methodology that no contemporary evolutionist should accept.The hypothesis of adaptation predicts that a character enhances its possessor's ability to utilize resources for survival or reproduction relative to alternatives against which it has been tested evolutionarily. Phylogenetic analysis of species possessing the character and their closest relatives identifies the comparisons appropriate for testing this hypothesis. Hypothetical adaptations are mapped onto phylogenies to identify their origins, antecedent conditions, associated characters, environmental contexts, and selective regimes. Alcock forfeits the power of evolutionary study by arguing that sociobiologists “can only use data from unrelated species known to experience similar selection pressures” in the “independent convergence test” of adaptation. No animal species are completely unrelated, nor are their behaviors adaptive in an absolute sense. Even comparisons of analogous characters across species must consider phylogeny because homologous genes and developmental programs can be utilized for analogous roles in different species. Without a firm grounding in phylogenetic principles, Alcock's methods cannot effectively test hypotheses of evolutionary causality.Alcock spends much effort defending sociobiology against the criticism that its major claims constitute untestable adaptationist stories. David Barash's sociobiological interpretations of mating behavior in bluebirds receive particular attention because Stephen Jay Gould criticized them as untestable. Alcock shows that Barash and others have empirically rejected some explanations in favor of better ones, although the hypotheses tested and the knowledge gained reside entirely in proximate mechanisms, not the ultimate causes that constitute sociobiology's main challenge. Gould's criticism therefore withstands Alcock's counterarguments.Readers unfamiliar with evolution should consult recent books such as Brian Hall's Evolutionary Developmental Biology , Jeffrey Levinton's Genetics, Paleontology, and Macroevolution , and John Avise's Phylogeography to see evolutionary disciplines that have triumphed over the past twenty‐five years. These disciplines contrast with sociobiology in their methodological rigor and profound reformulation of major theories. By contrast, Alcock's sociobiology seems essentially unchanged from the 1970s. If twenty‐five years of sociobiological study have produced only a repetition of its initial conjectures, their effectiveness as testable hypotheses seems doubtful.Alcock acknowledges “human evolutionary psychology” as a new subdiscipline of sociobiology. Indeed, orthodox sociobiology seems to be relocating from biology to psychology departments. My interpretation of this move is that sociobiology has not kept pace with evolutionary biology and therefore has sought refuge in a traditionally nonevolutionary discipline that has not yet incorporated the current critical standards of comparative evolutionary research.Sociobiology has served evolutionary biology mainly by revealing the limits of reductionist selective arguments, thereby directing us to move beyond them. Over the years, from an ardent young man who was watching with amazement and joy from the gallery of the Supreme Soviet of the Ukrainian SSR for proclaiming independence, I turned into a middle-aged man, convinced that even the purest intentions could be distorted and crossed out with public indifference. And the state, about (...) which I dreamed, never took place - there was only a soulless shell, like a dried cocoon, from which, it seems, the butterfly will never fly out. (shrink)

To be human is to be autonomous, yet this is a trait that most of us lack. We are subject to forces external to our being. We are workers; we are citizens; we are needful creatures. Humanity-proper in these times of neoliberal omnipotence is defined differently. The key terms are familiar: personal betterment, personal responsibility, productivity, pleasantness. A forked tongue slithers in our conscience, tells us that these are the traits of the human condition. Through Bataille, this paper argues the (...) substrate of these oft repeated familiar mantras are other. Neoliberal subjects, propelled by need, understand themselves along the axis of the useful choice. The paper turns to myth to understand the interdependence of need and choice, and how this interdependence posits being as always in desire but never in pleasure. Revisiting Don Giovanni, a character central to Acéphalic thought, and the commentary of Søren Kierkegaard, we think in terms of non-abstraction, of pleasurably floating in change, rather than toiling in desire. For it is by grace in the form of chance, that at the very time of transgression, that we – in and for an instant – become human, become as the sacred in the flesh. (shrink)

Researches conducted so far within the project Spinning out of control: rhetoric and violent conflict. Representations of 'self' - 'other' in the Yugoslav successor states focused on exploring the relations towards the Other in a state of conflict. Moreover: most of the author's and coauthors' contributions were oriented towards discourse analysis in the context of violence. Except for the peaceful dismemberment of Montenegro and Serbia, proclamation of independence of other Yugoslav states did not go without violence, to a (...) greater or lesser extent. The Other in these situations was predominantly the ethnic Other, and usually treated as enemy. For that reason, the greater part of our past work was oriented towards analysing media reports of the most stiking war events. Also, some of the contributions intentionally targeted media reportings of tense situations and those bearing the unpredictable outcomes, such as referenda or meetings discussing war and peace matters; or, we focused our inquiries on radical standpoints expressed by certain media or political parties - all that in order to explore the essencial forms of constructing and manifesting the Otherness on a rhetoric level. From a broader perspective, the analysed period, marked by the wars of ex - Yugoslavia in the last decade of 20th century, could be comprehended as the preiod of a state of emergency, where the old order had been brutally and radically destroyed and the new one was installed. In such a process, as it was shown, the relation towards the Other was also usually extreme and ethnically motivated. Now, after the constitution of seven new states where once former Yugoslavia was, new questions emerge. We are interested, as we were before, in the identity constructions, especially in the relations toward the Other, and Otherness in general, now in the period of transition and normalization of mutual relationships that these societies are undergoing. Along with the theories of ethnicity and identity construction, the key perspective remains discursive analysis. Our main question is What is happening with the phenomenon of Otherness in public discourse, in the peaceful times, or in the post conflict state? Do the ways of representing Others from the conflict times disappear, or do they 'freeze', that is to say, remain the same, or get manifested on some other levels and by different rhetorical tools? In short, what is happening with the Others in discourses that do not 'spin out of control'? Are the Others stable, mutable or flexible category and where are the imagological boundaries of Otherness? Who are the Others now? Are there any Others among us in ethnical sense? What is the nature of relation towards the common Yugoslav past, in other words, has the common past also become the Otherness for the people of former Yugoslavia? Are the 'refugees', 'cast-outs', 'displaced persons', 'returnees'... only the new names for the old display of Otherness? (shrink)

Ijmā is ranked as the third shariah evidence after the Qur’ān and Sunnah in the science of Uṣūl. Shafi was the first one who made Uṣūl which had been known and used by the Islamic scholars, into a written document and who ascertained that Ijmā was the third of the shariah evidences. Kalām is one of the sciences in which Ijmā evidence is used. The scholars of Kalām used this evidence as far as the science of Uṣūl made it possible. (...) They always used it without changing any basics of religious beliefs and acceptances. That the aqidah of Ahl al-Sunnah has been supported with Ijmā which is regarded as one of naqly evidences, played an important role in eliminating suspicions which were tried to be aroused in momins’ mind. In this article, the function and importance of Ijmā evidence, which is one of the primary sources of the science of Uṣūl, in the science of Kalām and Aqidah of Ahl al-Sunnah has been studied.SummaryWhat the Qur’ān demands from us is to emphasize the spirit of unity among ummah and to keep out the factors that could trigger separation and division. Indeed, Allah emphasizes in the following verses in the Qur’ān on the protection of the unitary structure of the ummah: “And hold firmly to the rope of Allah all together and do not become divided” (Āl a-Imrān 3/103) and “And do not be like the ones who became divided and differed after the clear proofs had come to them” (Āl al-Imrān 3/105). Allah has commanded the Ulul ‘Azm Prophets to hold the religion upright and to avoid division. (al-Shūrā 42/13). The command of holding the religion upright and not to be divided in this religion means to certify what needs to be confirmed in the religion of Allah and to obey those that must be obeyed. This is also the proclamation of the principle of religion that all the prophets have consensus over.Ahl al-Sunnah understanding of Islam is identical to the understanding of the Prophet and his companions. For this reason, Ahl al-Sunna is the school that represents the main backbone of Islam. In Ahl al-Sunna, in many subjects, be it usūlî / primary or furū’ī / secondary, there has been ijmā. These ijmās are Sahaba ijmās and deductive ijmās that come from mutakallimūn (theologians) ijtihāds. Therefore, ijmā and ijtihād are closely connected to each other. Ijmā is supported by ijtihād and ijtihād is also the source of ijmā. Thus, the issue is no longer just a pure ijtihād; it turns out to be a degree that gives a solid knowledge after it has risen to some degree just after the nass/texts.Ahl al- Sunnah theologians are talking about two kinds of ijmā. The first is “ijmā taṣdīqī” (approval consensus) which is the consensus based on Sahaba İjmā. These are the ijmās that occur on the principles called ḍaruratal-diniyya (necessities of the religion), and accepted as solid proofs in religion. Issues such as the principles of faith, obligation of prayer and the fasting are the subjects that are determined by the solid/definite ijmā. Such ijmās are valid approvals on existing provisions. These ijmās based on solid nass (verses and hadiths). Such ijmās do not give any new information. The existing information is strengthened by the alliance of Muslims. In these areas, ijtihād cannot be done and Muslims do not need ijtihād on these issues. There is an consensus of Ahl al-Sunnah scholars about the unfaithfulness of the one who denies one or more of the principles which are accepted as the main obligatory principles in Islam. The other is the “deductive ijmā which the ijtihāds have roles over. This kind of ijmās, are formed as a result of mujtahids’ consensus over the same opinion on the issue of theological secondary issues. The issues related to the secondary theological issues which were open to the ijtihāds and the different results obtained on matters are not accepted as the cause of takfīr. However, depending on the subject he/she can be a sinner. Istidlālī/deductive ijmās are not considered as an independent proofs in ‘Ilm al-Kalām, rather a supportive ones and are considered as textual evidences.Since, texts that are accepted as sources give supposed information. In this regard, the Ahl al-Sunnah scholars accepted other members of the sect who have in secondary theological issues opposed the ijmā of the salaf / predecessor as Ahl al-Qibla, but named them as Ahl al-Bid’a (innovator in religion) because of their opposition to Salaf’s İjmās. Moreover, the scholars of the Ahl al-Sunnah did not see them appropriate to participate in the Ijmās, which could occur between the generations that come after Sahābas/companions.Not all disputes have been criticized in Islam. It is a blessing for the ummah to claim different opinions on the issues subject to ijtihād. Since the ummah, in this way, will bring new solutions to emerging issues and as a result, Islam will have a mechanism to produce a dynamic solution. This can only be possible through ijtihād. Dispute is to propose different views on a subject. If this view is not in the actual matters that could harm the unity of the Ummah, rather in the case of ijtihādi issues, this conflict could turn to be mercy.The reason why the methodists evaluate the ijmā within the scope of the authorized evidence is that because they think it is essential that the ijmā be based on a proof. From this point of view, the alliances that occurred in mental matters were not considered as ijmā. The theologians always tried to support their claims with nass/textual proofs. When the ijmā is realized, whether known or not, they have stated that there is certainly a religious proof behind it. Because, the provisions that were reached through ijmā, cannot be against the provisions of the Prophet.Many issues in Islamic Belief and Kalām works are supported by the mental and textual evidences as well as by deductive ijmā. However, many of the claims of Ijmās in these works reflect the inter-sect ijmās of the Ahl al-Sunnah. The sects outside the Ahl al-Sunnah were excluded. This attitude is, above all, the aim of ensuring the integrity within the sect, and trying to protect the Ahl al-Sunnah belief. Since the ijmā evidence has a function that prevents all kinds of arbitrary and divisive thoughts and turns the supposed knowledge into the qat’ī/certain one, it raises the provision to the next level just after the nass, rather than merely being a ijtihādi provision. In the case of the forerunner of the Ahl al-Sunnah, the Māturīdes and Ash‘arites have not differed in in understanding of ijmā in terms of methodology.Although they have different views on the definition and content of the ijmā, they have a common understanding of alliances of Mujtahids on the same view. The mutakallims (theologians) of Māturīdī and Ash’arī schools have used the proof of ijmā as supportive evidence in the cases related to Kalām. al-Ash’arī not only adopted the proof of ijmā but also used it in practice in. He did not make any distinction in proof of ijmā as practical, theological, methodological or sub-divisional; he used it freely in every field. Māturīdī and Ash’arī scholars decided that the ijmā could occur in religious matters and that there would be evidence when it was formed; In the case of mental issues, they have required the knowledge to be based on solid information. In the case of ijmā in purely mental issues, they have disputed over the issue. While some Ahl al-Sunnah scholars stated that since purely mental matters were certain knowledge and therefore don’t need ijmā, they also ruled that because the mujtahids could get this knowledge from religious texts, therefore ijmā could occur in mental matters as well. The article analyses the royal proclamation of Ferdinand VI in Cusco which took place on 23 September 1747, on the birthday of the king. A reconstruction of the celebration was possible thanks to two sources: the city chronicle written in the mid-eighteenth century by Diego de Esquivel y Navía and an occasional print containing a description of the ceremony by José Antonio Santander. The article discusses three aspects of the presented celebrations. First of all, it presents the general context, (...) i.e. the problem of festival celebrations related to the royal family as a part of the Spanish crown policy. Secondly, it details artistic issues related to the celebrations. It includes a description of the artistic setting with the features of occasional architecture and ephemeral painting. Finally, the article examines the local, social and political contexts of the celebrations, read as a manifestation of the city’s emancipation efforts based on the emphasis of Cusco’s antiquity and its rich imperial tradition in the Pre-Hispanic period. Kainz’s handling of natural law thinking in ancient Greece and Rome is precise, for although he uses as his chapter heading “Concepts of Natural Law in Ancient Greece and Rome,” he is careful not to ascribe explicit natural law thinking to the Presocratics, Plato, or Aristotle, though in the case of the latter two thinkers, especially Aristotle, they were arguing for what is the essence of natural law thinking: an eternal, unchanging, absolute standard for human conduct. Kainz does use the (...) caption, “Natural Law and Natural Justice in Aristotle”, but he qualifies it: “it is conceivable that natural human sociability itself constitutes a significant element of a latent natural law theory in Aristotle [but]... explicitly Aristotle neither enunciates nor expands on any natural law theory in the traditional sense”. This parsing is prudential since, if a thinker does not explicitly refer to a theory or position, it is not correct to say that he holds it. But when it comes to the Stoics, there is no need to temporize, as they were explicit, full-fledged natural law theorists. Kainz appropriately accords them the attention they deserve. It is remarkable to find overviews of natural law that omit the Stoics entirely. Chapters 2 and 3 reveal the bridge from natural law, as treated by Aquinas and Suarez, seen as part of divine law, to the secularization of natural law theory at the hands of Grotius and Hobbes. Although acknowledging that earlier thinkers like Robert Bellarmine and other scholastics had adverted to the possible validity of natural law without God, Kainz limns Grotius’s bold assertion of the independence of the natural law theory from any grounding in theological or religious premises as the decisive proclamation of the secularization of the natural law theory. Kainz’s discussion of Aquinas includes the very important question of whether Aquinas is “actually ‘deriving’ moral laws from natural inclinations—thus falling into the ‘naturalistic’ fallacy”? He puts that question to rest with the observation that Aquinas does not suppose that any deductions from natural law principles rely on the necessity used in theoretical reasoning but rather apply “for the most part” and thus have exceptions. Chapter 4 provides a glossary of frequently misunderstood concepts that are basic in natural law discussions, such as “nature,” “natural,” and “perversion.”. (shrink)

After a long and successful career in tracheal surgery and lung cancer, Paolo Macchiarini became very famous in 2008 with the transplantation of a trachea from a cadaver that then apparently used the patient’s own stem cells to supposedly regenerate new trachea, i.e., tissue-engineered tracheae. Among the nine patients that received this revolutionary treatment, using biological or artificial tracheae, under Macchiarini’s supervision, six have reportedly died. Although several critics had expressed concerns with the procedures, allegations of misconduct against Macchiarini first (...) arose in August of 2014 by four Karolinska Institutet (KI) colleagues, and an independent investigation was called for by KI based on claims made in seven published papers. Among the claims were the fact that the procedure constituted a high risk, information on the patients was incomplete and that there was no or incomplete ethical approval, thus constituting misconduct. His CV was also shown to contain inaccuracies. By September 10, 2016, most of these claims have now proved to be true, and Macchiarini was found guilty of misconduct by KI. This paper looks primarily at earlier published papers by Macchiarini and his collaborators in a search for clues to better understand the evolution of altruism, or narcissism. An assessment of the controversial papers, and of letters written by critics and skeptics like Pierre R. Delaere, indicate that insufficient experimental evidence was presented for several case studies, and that claims made about the success of the procedures exceeded what was shown by the evidence. A domino effect of personal and professional tragedies ensued, in rapid succession, between 2014 and 2016. The effect on the field of stem cell research has been chilling, and the side-effects have taken their toll, with several high-profile resignations, primarily at KI, within the Swedish education system and in the Nobel Committee. This paper explores the theological underpinnings of Pope Francis’s messages to world meetings of popular movements as a way to discern his theology of organizing. In these messages, one encounters Francis’s social teaching, which is rooted in the preferential option for the poor and marginalized. Beyond an epistemological privilege of the poor long embraced in liberation theology, Francis looks to the agency, creativity, and resourcefulness of the poor to locate God’s action in history. He models a theological methodology attentive to (...) the concrete experiences and struggles of those on the peripheries. From there, Francis points to the solidarity, resistance, and disruptive agency of grassroots movements as an expression of the Gospel. He describes the circle of praxis in a way that emphasizes encounter, solidarity, and urgency to act, summarized in his insistence that the “future of humanity” lies “in the hands of peoples and in their ability to organize.”. The coastal area of Bangladesh is one of the most ecologically productive and it contains a rich biodiversity which includes several species that are endemic to this region. Much attention has been focused on ship breaking industries in the coastal areas because of the threat they pose to this thriving biological communities along with their other environmental impacts and the perilous working environment of the workers. The coastal environment of Sitakunda is severely contaminated by various processes related to ship-breaking (...) i.e. the disposal of different toxic wastes into the sea water, deforestation by expanding ship breaking yard, changing land-use pattern and release of toxic substance into the soil. Moreover, the workers of this industry are exposed to an extremely risky and toxic working environment which makes them vulnerable to both physical and psychological disorder as well as to accidental deaths and injury. Still, workers embrace these risks for very poor wages and most of the profits go to the already rich businessmen. Despite various negativities, this industry has gained importance due to the increasing demand of raw material for re-rolling industries and employment opportunities for the people of the coastal areas. As this industry is indispensable due to its importance in the macro and micro economy of Bangladesh, a sustainable management approach should be taken to at least minimize the environmental and health impacts of ship breaking industries. The current paper aims to investigate the extent to which this industry is affecting the ship breaking yard labors and the environment, despite the growing concern nationally and internationally, and it uses both primary and secondary data. The religious transnationalism evident in the 21st century has heralded a new paradigm of religion ‘made to travel’ as adherents of religions navigate various cultural frontiers within Africa, Europe and North America. The role of Africa in shaping the global religious landscape, particularly the Christian tradition, designates the continent as one of the major actors of the Christian faith in the 21st century. The inability of European Christianity to address most of the existential realities of Africans and the stigmatisation of (...) African Traditional Religion mainly contributed to the emergence of African Independent Churches in the 19th century in Africa. The emergence and proliferation of African Independent Churches in Africa was Africa’s response to Europeanised Christianity with its imperialistic doctrines and practices that negated expectation of its new context – Africa. Despite the declining fortunes of Christianity in the West, African Christianity, which includes the African Independent Churches and African Pentecostal traditions, is now a major non-commodity export within Africa and North America. Apart from their rituals and peculiarities, African Independent Churches like other faith organisations are development actors. Although notions about the role of religion in development amongst some social scientists are mainly negative, African Independent Churches over the years are actively involved in various human and community transformation initiatives. This study argues that the transnational status of African Independent Churches has led to the emergence of developmental ideals that defy territorialisation. The collaboration with some Western development agencies by some of the African Independent Churches in Diaspora further blurs the concept of diaspora as the members of this Christian movement are active development actors in the receiving nations and their former home countries. This study argues that the role of religion in development in any context cannot be overemphasised. As a result of the globalisation of African Independent Churches, the United Kingdom and Nigeria will serve as our case study using historical survey and descriptive analyses to highlight African Independent Churches as development actors. This book examines the legal principle of judicial independence in comparative perspective with the goal of advancing a better understanding of the idea of an independent judiciary more generally. From an initial survey of judicial systems in different countries, it is clear that the understanding and practice of judicial independence take a variety of forms. Scholarly literature likewise provides a range of views on what judicial independence means, with scholars often advocating a preferred conception of a model (...) court for achieving 'true judicial independence' as part of a rule of law system. This book seeks to reorient the prevailing approach to the study of judicial independence by better understanding how judicial independence operates within domestic legal systems in its institutional and legal dimensions. It asks how and why different conceptualisations of judicial independence emerge over time by comparing detailed case studies of courts in two legally pluralistic states, which share inheritances of British rule and the common law. By tracing the development of judicial independence in the legal systems of Malaysia and Pakistan from the time of independence to the present, the book offers an insightful comparison of how judicial independence took shape and developed in these countries over time. From this comparison, it suggests a number of contextual factors that can be seen to play a role in the evolution of judicial independence. The study draws upon the significant divergence observed in the case studies to propose a refined understanding of the idea of an independent judiciary, termed the 'pragmatic and context-sensitive theory', which may be seen in contradistinction to a universal approach. While judicial independence responds to the core need of judges to be perceived as an impartial third party by constructing formal and informal constraints on the judge and relationships between judges and others, its meaning in a legal system is inevitably shaped by the judicial role along with other features at the domestic level. The book concludes that the adaptive and pragmatic qualities of judicial independence supply it with relevance and legitimacy within a domestic legal system. (shrink)

In this paper we relax the assumption that the logical constants of ordinary first-order logic be linearly ordered. As a consequence, we shall have formulas involving not only partially ordered quantifiers, but also partially ordered connectives. The resulting language, called the language of informational independence will be given an interpretation in terms of games of imperfect information. The II-logic will be seen to have some interesting properties: It is very natural to define in this logic two negations, weak negation (...) as failure to verify a sentence, and strong negation as the existence of a falsifying strategy: One can express in this logic complete problems of finite structures, like the non-connectedness and 3-colorability of finite graphs, the satisfiability problem for Boolean circuits built up from NAND-gates, etc. (shrink)

Note that infinite maximal independent subsets exist in any BA which is not superatomic. The main result is that any set of infinite cardinals can occur as Spind for some infinite BA A . There are two primary purposes of this manuscript: (i) to evaluate the western buyers’ ethical issue in the setting of eastern and western economies, and (ii) to assess the ethical values of the employers and the government in their business dealing in the background of Bangladesh. Analyzing the present minimum wage (MW) policy of the garment global supply chain industry in Bangladesh and the extent to which the policy functions are two of the other purposes of this study. (...) This study is the mixed approached of exploratory, descriptive, and phenomenological qualitative research. Each of the exploratory, descriptive, and phenomenological qualitative research goals has identified and described in a systematic way to get the best outcome of the purposes set in this manuscript. This study shows that rule utilitarian ethics are being followed by the Western buyers in their business dealings in Western territories. The philosophy of rule utilitarianism holds moral principles, and this principle tends to place greater emphasis on ethical interests rather than economic gains. Unfortunately, Western buyers do not follow the rule utilitarianism in their business dealing in eastern countries. Thus, this study shows western business leaders/buyers are not ethically correct. The act utilitarian ethics, on the other hand, are being followed by the eastern buyers in their business dealing. The philosophy of act utilitarianism holds immoral principles, and this principle tends to place greater emphasis on economic gains rather than ethical interest. This philosophy permit firm’s unethical behavior such as an exploitation of MW on the ground that this practice increases its incomes and maximizes the owner’s interest. The employers and buyers unethically gain profit, keeping the workers in a disadvantaged situation, which contradicts John Rawls’ Theory of Justice. Furthermore, the government has become an accomplice in exploiting and depriving the garment works of their entitlement and labor rights to appease the so-called investors. This study helps buyers, employers, government, and stakeholders to correct their unethical business deals. It also helps the policymakers to implement the MW policy for the betterment of garment global supply chain workers. (shrink)

I discuss a thesis that I call ‘The Appearance of Mind-Independence’, to the effect that, to the subject of an ordinary perceptual experience, it seems that the experience involves the awareness of a mind-independent world. Although this thesis appears to be very widely accepted, I argue that it is open to serious challenge. Whether such a challenge can be maintained is especially relevant to the assessment of any theory, such as Berkeley’s idealism, according to which the only objects of (...) which we are aware in perception are mind-dependent. But the issue is of significance for the philosophy of perception more generally. In the course of my sceptical discussion, I argue that recent work by Campbell and Cassam may be flawed by a failure to take sufficiently seriously the requirements for genuine mind-independence. Introduction: Pharmaceutical companies offer various gifts to physicians to encourage them to prescribe their products. This collaboration has some negative and positive aspects. Different countries have established guidelines to limit the collaboration and reform such relationships. This study aims to determine the attitude of Bangladeshi medical students towards pharmaceutical gifts, physician-pharmacist collaboration, and associated factors. Methods: An online cross-sectional and correlational study was conducted through email and Google-Forms among Bangladeshi medical students. A total of 435 students from different medical colleges (...) completed the questionnaires in May and June, 2016. Results: Monthly parental income was moderate among the majority of medical students. Less than 16% had a physician or pharmacist parent. Most of the students were taught about medical ethics, but 73% were not taught about the ethics of physician-pharmacist collaboration. About 85% did not have any experience of interaction with marketing representatives. Drug samples and pennotepads were the most appreciated pharmaceutical gifts. Jewelry and gifts costing more than 100 thousand were said to be the least appreciated pharmaceutical gifts. Attitudes towards drug companies and representatives were assessed by fifteen statements. Medical students had a variety of attitudes regarding its ethical justification. Attitudes were correlated with gender, parental income, physician parents, academic years, and having been taught about pharmaceutical collaboration with physicians. Conclusion and Recommendations: medical students should elaborate on ethical reasoning before accepting pharmaceutical gifts. Medical colleges and curriculums should teach them about the interaction. A national guideline may be needed. (shrink)

Building on Nozick's invariantism about objectivity, I propose to define scientific objectivity in terms of counterfactual independence. I will argue that such a counterfactual independence account is (a) able to overcome the decisive shortcomings of Nozick's original invariantism and (b) applicable to three paradigmatic kinds of scientific objectivity (that is, objectivity as replication, objectivity as robustness, and objectivity as Mertonian universalism).

The semantics of the independence friendly logic of Hintikka and Sandu is usually defined via a game of imperfect information. We give a definition in terms of a game of perfect information. We also give an Ehrenfeucht-Fraïssé game adequate for this logic and use it to define a Distributive Normal Form for independence friendly logic.
