Philosophical study of changes in society with the evolution of civilization.

At the forefront of international concerns about global legislation and regulation, a host of noted environmentalists and business ethicists examine ethical issues in consumption from the points of view of environmental sustainability, economic development, and free enterprise.

Clinical ethics consultants represent a multidisciplinary group of scholars and practitioners with varied training backgrounds, who are integrated into a medical environment to assist in the provision of ethically supportable care. Little has been written about the degree to which such consultants are accountable for the patient care outcome of the advice given. We propose a model for examining degrees of internally motivated accountability that range from restricted to unbounded accountability, and support balanced accountability as a goal for practice. Finally, (...) we explore implications of this model for training of clinical ethics consultants from diverse academic backgrounds, including those disciplines that do not have a formal code of ethics relating to clinical practice. Standardizing consultation processes is increasingly important as clinical ethics consultation becomes more utilized in and vital to medical practice. Solid organ transplant represents a relatively nascent field replete with complex ethical issues that, while explored, have not been systematically classified. In this paper, we offer a proposed taxonomy that divides issues of resource allocation from viable solutions to the issue of organ shortage in transplant and then further distinguishes between policy and bedside level issues. We then identify all transplant related (...) ethics consults performed at the Cleveland Clinic between 2008 and 2013 in order to identify how consultants conceptually framed their consultations by the domains they ascribe to the case. We code the CC domains to those in the Core Competencies for Healthcare Consultation Ethics in order to initiate a broader conversation regarding best practices in these highly complex cases. A discussion of the ethical issues underlying living donor and recipient related consults ensues. Finally, we suggest that the ethical domains prescribed in the Core Competencies provide a strong starting ground for a common intra-disciplinary language in the realm of formal CEC. (shrink)

This paper represents a preliminary investigation relating Bernard Lonergan’s thought to health science and the healing arts. First, I provide background for basic elements of Lonergan’s theoretical terminology that I employ. As inquiry is the engine of Lonergan’s method, next I specify two questions that underlie medical insights and define several terms, including health, disease, and illness, in relation to these questions. Then I expand the frame of reference to include all disciplines involved in the cycle of clinical interaction under (...) the heading health science and the healing arts. Finally, I analyze the cycle of clinical interaction in terms of Lonergan’s cognitive theory. I compare and contrast my analysis, based on Lonergan, with that of Pellegrino, Thomasma and Sulmasy as I proceed. In closing, I comment briefly on the next stage of this project regarding Lonergan’s theory of the human good in relation to the practice of the healing arts. (shrink)

Sex determines much about one's life, but what determines one's sex? The answer is complicated and incomplete: on close examination, ordinary notions of female and male are vague. In 2012, the International Olympic Committee further specified what they mean by woman in response to questions about who, exactly, is eligible to compete in women's Olympic events. I argue, first, that their stipulation is evidence that the use of vague terms is better described by semantic approaches to vagueness than by epistemic (...) approaches. In addition, the IOC's 2012 stipulation was made with sensitivity to its practical consequences. Linguistic actions often have morally relevant consequences, and I contend that, other things equal, we should adopt theories about language that acknowledge the responsibility we bear for what we say. Taking vagueness to be an epistemic phenomenon precludes the sense of agency needed for moral responsibility; taking it to be semantic does not. Thus I advance two arguments for semantic approaches to vagueness, as against epistemic approaches: one descriptive and one normative. (shrink)

The role of Human Research Ethics Committees (HRECs) in health research is well established. Ethics committees have the good of research participants in mind but they must also assess scientific merit including the design and conduct of studies. In this article the authors’ focus is on qualitative research method and the challenge that the National Statement on Ethical Conduct in Human Research (2007) poses for ethics committees when they assess proposals using the methods outlined in the National Statement.We set out (...) a process for judging the standard of qualitative research proposals and propose that qualitative health research can be assessed using a hierarchy designed for evaluating interview studies. We contrast well-designed studies with those that have design flaws in order to focus on the hallmarks of research merit in studies that use qualitative research methods. Finally, we show that our proposal is compatible with the National Statement.Ethics review provides an early opportunity to identify and redesign inadequate studies that will not contribute to our knowledge base. The challenge for members of ethics committees with little experience in qualitative studies is to be able to assess research excellence by assessing research merit in proposals, recognising the special design features of qualitative research methods. I propose to begin with some fairly unexciting and uncontroversial remarks about possibility-statements, and then in their light to examine two problems philosophers have raised about certain statements of this kind which might be made in Christian theology where it touches on the doctrine of the Incarnation.

The ‘traditional’ view among philosophical theologians, that God is eternal not merely in the sense of being everlasting but in the sense of being outside time altogether, has come under sharp criticism in recent years, both from biblical theologians and from philosophers. It is against the latter form of attack, particularly as represented by the detailed criticisms of Professor Nelson Pike, that I wish to try and defend the notion of a divine timelessness.

Some bemoan the incivility of our times, while others complain that people have grown too quick to take offense. There is widespread disagreement about what counts as an insult and when it is appropriate to feel insulted. Here I propose a definition and a preliminary taxonomy of insults. Namely, I define insults as expressions of a lack of due regard. And I categorize insults by whether they are intended or unintended, acts or omissions, and whether they cause offense or not. (...) Unintended insults are of particular concern since greater understanding may help us to avoid them. And insults by omission warrant special consideration because they suggest an interesting extension of Grice’s theory of conversational implicature. (shrink)

I have come to believe that the whole framework of our current thought is about to begin a long and radical transformation, based on what I shall call a new science of pure consciousness. The content of most of the matters to be considered by this science have hitherto been the concern of some areas of religion, particularly what in our culture we call ‘mysticism’; but the treatment of it would legitimately be called scientific. Thus one aspect of the transformation (...) would be to overcome that apparent conflict between ‘science’ and ‘religion’, which has been so characteristic of our culture over the last few centuries. People often assume that everyone can be divided by sex/gender (that is, by physical and social characteristics having to do with maleness and femaleness) into two tidy categories: male and female. Careful thought, however, leads us to reject that simple ‘binary’ picture, since not all people fall precisely into one group or the other. But if we do not think of sex/gender in terms of those two categories, how else might we think of it? Here I consider four distinct models; (...) each model correctly captures some features of sex/gender, and so each is appropriate in some contexts. But the first three models are inadequate when tough questions arise, like whether trans women should be admitted as students at a women’s college or when it is appropriate for intersex athletes to compete in women’s athletic events. (‘Trans’ refers to the wide range of people who have an atypical gender identity for someone of their birth-assigned sex, and ‘intersex’ refers to people whose bodies naturally develop with markedly different physical sex characteristics than are paradigmatic of either men or women.) Such questions of inclusion and exclusion matter enormously to the people whose lives are affected by them, but ordinary notions of sex/gender offer few answers. The fourth model I describe is especially designed to make those hard decisions easier by providing a process to clarify what matters. (shrink)

Ce texte présente une tentative de trouver une notion de «prudence philosophique» chez Nietzsche. Il procède de la critique d’une contribution de Daniel Tanguay dans laquelle l’auteur s’oppose au diagnostic posé par certains exégètes de l’œuvre de Leo Strauss d’une certaine proximité entre la pensée du maître américain et celle de Nietzsche. L’argument principal de Tanguay tient en cette idée que la prudence, qui est le propre de la sagesse philosophique et qui est au cœur de la pensée de Strauss, (...) est absente chez Nietzsche. La démonstration proposée est sous-tendue par une thèse sur la figure du philosophe et sur la nature de la vie philosophique. Développant une argumentation contre cette conclusion, je veux préciser les conditions de possibilité et le sens d’une prudence philosophique nietzschéenne. En particulier, la recherche d’une notion de prudence chez Nietzsche demande d’explorer d’une part une possible distinction entre eros et volonté de puissance, et d’autre part une possible distinction entre nature et volonté de puissance. Cette double distinction permet de définir une conception nietzschéenne du philosophe et de la philosophie qui n’est pas dogmatique, et dans laquelle on trouve une autre forme de la prudence, celle du don. [This paper finds its starting point in a critique of Daniel Tanguay’s opposition to the idea of a kind of proximity between the thought of Leo Strauss and Nietzsche. Tanguay’s argument is to the effect that Strauss provides us with a notion of prudence philosophique, while Nietzsche, a dogmatic thinker, doesn’t. Underlying this diagnosis is a thesis regarding the nature of the philosopher and of the philosophical life. To counter this interpretation, this paper attempts to flesh a notion of prudence out of Nietzsche’s published works. More specifically, it explores the distinction between Eros and Will-to-Power on the one hand, and the distinction between Nature and Will-to-Power on the other. This twofold distinction allows for a non-dogmatic Nietzschean notion of philosophy in which can be found another brand of prudence that takes the form of a gift.]. (shrink)

Le Volontaire et l’Involontaire was published in 1950, as the first volume of Ricoeur’s La Philosophie de la Volonté. The whole project has a sweeping range, reflected even in this first volume. It is a philosophy of the will, taking in analysis of concepts of behaviour with a critique of scientific psychology: analysis of our moral experience: of our attitudes to our life and to the whole of reality: of our experience of evil and guilt and our dreams of innocence (...) and hopes of salvation. In the first volume Ricoeur imposes not only phenomenological brackets, examining our experience ‘descriptively’ and not causally, but also eidetic brackets, examining possible behaviour and not actual behaviour. This means that he suspends consideration of ‘the fault’, our experience of evil. This is left to the second volume Finitude et Culpabilité which in two parts, L’Homme Faillible and La Symbolique du Mal analyses the experience of evil, the latter part in a hermeneutic analysis of myth, a subject with which Ricoeur has come to the forefront of recent structuralist debate in his book De l’Interprétation A third volume of the Philosophy of the Will will deal with hermeneutic analysis of ‘transcendence’—of the dream of innocence, the hope of deliverance from evil, as expressed in poetry and myth. The notion of autonomy commonly employed in medical ethics literature and practices is inadequate on three fronts: it fails to properly identify nonautonomous actions and choices, it gives a false account of which features of actions and choices makes them autonomous or nonautonomous, and it provides no grounds for the moral requirement to respect autonomy. In this paper I offer a more adequate framework for how to think about autonomy, but this framework does not lend itself to the kinds of (...) practical application assumed in medical ethics. A general problem then arises: the notion of autonomy used in medical ethics is conceptually inadequate, but conceptually adequate notions of autonomy do not have the practical applications that are the central concern of medical ethics. Thus, a revision both of the view of autonomy and the practice of “respect for autonomy” are in order. (shrink)

The proposition that a decreasing sequence of ordinals necessarily terminates has been given a new, and perhaps unexpected, importance by the rôle which it plays in Gentzen's proof of the freedom from contradiction of the “reine Zahlentheorie.” Gödel's construction of non-demonstrable propositions and the establishment of the impossibility of a proof of freedom from contradiction, within the framework of a certain type of formal system, showed that a proof of freedom from contradiction could be found only by transcending the axioms (...) and proof processes of that formal system. Gentzen's proof succeeds by utilisingtransfinite inductionto prove that certain sequences of reduction processes, enumerated by ordinals less than ε (the first ordinal to satisfy ε = ὡ) are finite. Were it possible to provethe restricted ordinal theorem, that a descending sequence of ordinals, less thanε, is finite, in Gentzen's “reine Zahlentheorie,” then it would be possible to determine a contradiction in that number system. In his paper, Gentzen proves the theorem of transfinite induction, which he requires, by an intuitive argument. There is also a method of reducing transfinite induction, for ordinals less than ε, to a number-theoretic principle given by Hilbert and Bernays, and a similar method by Ackermann. None of these proofs of transfinite induction isfinitist. (shrink)

The combination of spirituality, meditation, and artificial intelligence (AI) has promising potential to expand people’s well-being using technology-based meditation. Proper meditation originates from Zen Buddhism and Patanjali’s Yoga Sutras and focuses on inner peace and intensified consciousness which elective personal disposition. AI, in turn, brings master means of delivering those practices in the form of self-improving systems that customize and make access to them easier. However, such an integration brings major philosophical and ethical issues into question, including the genuineness of (...) experiences that are facilitated by artificial intelligence, data sharing, concerns over over-dependence on the technology that may in turn cause reduced personal responsibility and hard work. This paper aims at analysing the critical integration of AI-driven meditation following the spiritual interpretations of traditional meditation without compromising the tenets of meditation. It presents an interdisciplinary approach based on recent findings from the field of cognitive science, moral AI, and Eastern wisdom traditions to approach these problems. Therefore, by identifying the research lacunae, it provides a groundwork for voting ethically in the integration of AI in mindfulness practice and avoiding constraining human-oriented values resulting in improved existential spiritual change.
