The idea of natural law has a long history. It has had different meanings for different people and continues to occupy intellectual engagements as to the connotations of the expression ‘natural law’ in diverse and different contexts. This requires delving deep into the hoarypast and analyzing the gradual development of the idea of natural law through the ages. Understanding natural law necessitates exploring its relation with positive law, its application, and, notably, the import of the word ‘natural’ in the expression (...) ‘natural law’. Be that as it may, there is no denying the fact that there is an element of exclusivity in natural law that has kept it alive and going across generations. Even some of the jurists who adhered to the principles and tenets of legal positivism have shown an inclination towards the principles of natural law, especially as regards the relation between law and morality. It has survived the tests of time. The present paper seeks to explicate the various dimensions of natural law and explore its growth application. (shrink)

Domestic courts have attained prominent status in the international human rights system. While adjudicating individual claims and interpreting legal provisions, domestic courts have conveyed meanings that are integral to the working of the international human rights system. The dynamism of domestic courts is an undeniable quality, through which they incorporate diverse perspectives based on principles linked to individual sovereignty, justice, peace, etc. In this paper, the role of the Indian Supreme Court has been discussed in light of three landmark decisions (...) where the court applies international and domestic human rights standards to substantiate its interpretations. In light of the cases of Navtej Singh v. Union of India, Joseph Shine v. Union of India, and KS Puttaswamy v. Union of India, the paper examines the approach of the court under five broad headings: (a) the domestic context, (b) autonomy and determination, (c) constitutional parameters and validity of laws (d) vulnerability, and (e) other courts and other contexts. We live in a period of enormous contradictions, so well reflected in social life as well as in legal discourse. A pluralistic society as diverse as India in this age of globalization is a challenge to both the lawmakers and the courts, with new problems emerging in new avatars with alarming consistency. In the last six decades or so, Constitutional democracy has witnessed some of the unprecedented upheavals both in the social and political life of the nation as well as (...) in the arena of life. Laws have been enacted to deal with emerging problems. Courts have been innovative, and exemplary as regards their judicial courage and craft to uphold rule of law and democracy in a country of billion hopes and aspirations. The present book is an ensemble of contributions from young legal scholars from some of the major legal institutions of India. The development of cultural heritage tourism (CHT) frequently encounters obstacles pertaining to community support, as the attitudes of the local populace typically dictate the outcome of tourism endeavors. The community's influence on these perceptions has been undervalued in traditional approaches, which has resulted in low levels of engagement and support for cultural preservation. This study aims to bridge this gap by investigating how different degrees of community involvement impact local perceptions of the advantages of tourism, the preservation of culture, and (...) general satisfaction with the results. Data was gathered from 300 participants who were actively involved in many heritages sites' tourism planning. The connections between perceptions of the advantages of tourism and community involvement (CI) were evaluatedby utilizing Partial Least Squares Structural Equation Modeling (PLS-SEM). The results demonstrated that the perceptions of economic benefits (PEB), perceptions of cultural preservation (PCP), and community satisfaction (CS) are all positively impacted by greater CI. The aforementioned results underscore the significance of adopting participatory methodologies, implying that cultivating community engagement is vital for the sustainable growth of CHT. (shrink)

Speaker recognition under mismatched conditions is a challenging task. Speech signal is nonlinear and nonstationary, and therefore, difficult to analyze under realistic conditions. Also, in real conditions, the nature of the noise present in speech data is not known a priori. In such cases, the performance of speaker identification or speaker verification degrades considerably under realistic conditions. Any SR system uses a voice activity detector as the front-end subsystem of the whole system. The performance of most VADs deteriorates at the (...) front end of the SR task or system under degraded conditions or in realistic conditions where noise plays a major role. Recently, speech data analysis and processing using Norden E. Huang’s empirical mode decomposition combined with Hilbert transform, commonly referred to as Hilbert–Huang transform, has become an emerging trend. EMD is an a posteriori, adaptive, data analysis tool used in time domain that is widely accepted by the research community. Recently, speech data analysis and speech data processing for speech recognition and SR tasks using EMD have been increasing. EMD-based VAD has become an important adaptive subsystem of the SR system that mostly mitigates the effect of mismatch between the training and the testing phase. Recently, we have developed a VAD algorithm using a zero-frequency filter-assisted peaking resonator and EMD. In this article, the efficacy of an EMD-based VAD algorithm is studied at the front end of a text-independent language-independent SI task for the speaker’s data collected in three languages at five different places, such as home, street, laboratory, college campus, and restaurant, under realistic conditions using EDIROL-R09 HR, a 24-bit wav/mp3 recorder. The performance of this proposed SI task is compared against the traditional energy-based VAD in terms of percentage identification rate. In both cases, widely accepted Mel frequency cepstral coefficients are computed by employing frame processing from the extracted voiced speech regions using the respective VAD techniques from the realistic speech utterances, and are used as a feature vector for speaker modeling using popular Gaussian mixture models. The experimental results showed that the proposed SI task with the VAD algorithm using ZFFPR and EMD at its front end performs better than the SI task with short-term energy-based VAD when used at its front end, and is somewhat encouraging. People draw subtle distinctions in the normative domain. But it remains unclear exactly what gives rise to such distinctions. On one prominent approach, emotion systems trigger non-utilitarian judgments. The main alternative, inspired by Chomskyan linguistics, suggests that moral distinctions derive from an innate moral grammar. In this article, we draw on Bayesian learning theory to develop a rational learning account. We argue that the ‘size principle’, which is implicated in word learning, can also explain how children would use scant and (...) equivocal evidence to interpret candidate rules as applying more narrowly than utilitarian rules. For close to forty years now T.M. Scanlon has been one of the most important contributors to moral and political philosophy in the Anglo-American world. Through both his writing and his teaching, he has played a central role in shaping the questions with which research in moral and political philosophy now grapples. Reasons and Recognition brings together fourteen new papers on an array of topics from the many areas to which Scanlon has made path-breaking contributions, each of which develops a (...) distinctive and independent position while critically engaging with central themes from Scanlon's own work in the area. Contributors include well-known senior figures in moral and political philosophy as well as important younger scholars whose work is just beginning to gain wider recognition. Taken together, these papers make evident the scope and lasting interest of Scanlon's contributions to moral and political philosophy while contributing to a deeper understanding of the issues addressed in his work. Familial determination, replete with its frequent usurping of patient autonomy, propagation of collusion, and circumnavigation of direct patient involvement in their own care deliberations, continues to impact clinical practice in many Asian nations. Suggestions that underpinning this practice, in Confucian-inspired societies, is the adherence of the populace to the familial centric ideas of personhood espoused by Confucian ethics, provide a novel means of understanding and improving patient-centred care at the end of life. Clinical experience in Confucian-inspired Singapore, however, suggests that (...) personhood is conceived in broader terms. This diverging view inspired a study of local conceptions of personhood and scrutiny of the influence of the family upon it. From the data gathered, a culturally appropriate, clinically relevant and ethically sensitive concept of personhood was proposed: the Ring Theory of Personhood that better captures the nuances of local conceptions of personhood. The Ring Theory highlights the fact that, far from being solely dependent upon familial centric ideals, local conceptions of personhood are dynamic, context dependent, evolving ideas delineated by four dimensions. Using the Ring Theory, the nature of familial influences upon the four dimensions of personhood – the Innate, Individual, Relational and Societal – are examined to reveal that, contrary to perceived knowledge, conceptions of personhood within Confucian societies are not the prime reason for the continued presence of this decision-making model but remain present within local thinking and practices as a sociocultural residue and primarily because of inertia in updating ideas. The integration of biomedical terminologies is indispensable to the process of information integration. When terminologies are linked merely through the alignment of their leaf terms, however, differences in context and ontological structure are ignored. Making use of the SNAP and SPAN ontologies, we show how three reference domain ontologies can be integrated at a higher level, through what we shall call the OBR framework (for: Ontology of Biomedical Reality). Felicitas Goodman (1990) observed that naive participants experienced unique trance states, characterized by specific visionary content, when they assumed particular postures and listened to monotonous rattling. Students (n = 284), enrolled in various sections of the course Introduction to Psychology, experienced one of four conditions with their eyes closed: Sitting Quietly with and without Drumming, Standing (Feather Serpent) Posture plus Drumming with and without Suggested Experiences. Participants completed the Phenomenology of Consciousness Inventory (Pekala 1982, 1991c) and wrote narratives following their (...) respective stimulus conditions. Participants reported less imagery, joy, and absorption, but more internal dialogue, self‐awareness, and muscular tension in the posture, compared to the sitting quietly, conditions. Goodman's results of specific posture (content‐related) effects with naive participants were not replicated. (shrink)

The phenomenon of dreamless sleep and its philosophical consequences, particularly deep sleep's relevance to such issues as Self, Consciousness, Personal Identity, Unity of Subject, and Disembodied Life, are explored through a discussion, in varying detail, of certain noted doctrines and views--for example of Advaita Vedānta, Hegel, and H. D. Lewis. Finally, with a cue from Leibniz and McTaggart, the suggestion is made that at no stage during sleep is the self without some perceptions, however indeterminate. Support for this hypothesis is (...) claimed from the current psychoanalytic opinion that mental activity does not cease during any part of sleep and that human beings continue to dream even in the so-called dreamless state. Tumors, abscesses, cysts, scars, fractures are familiar types of what we shall call pathological continuant entities. The instances of such types exist always in or on anatomical structures, which thereby become transformed into pathological anatomical structures of corresponding types: a fractured tibia, a blistered thumb, a carcinomatous colon. In previous work on biomedical ontologies we showed how the provision of formal definitions for relations such as is_a, part_of and transformation_of can facilitate the integration of such ontologies in ways which have (...) the potential to support new kinds of automated reasoning. In contemporary philosophy, various attempts have been made in relation to placing our minds or mental states in the natural world or nature. In this context, there is a clear divide between naturalism and anti-naturalism, materialism and immaterialism, etc. Driven by the influence of naturalistic turn in philosophy and scientism, many philosophers have tried to put forth various naturalistic accounts of the relationship between mind and natural world. However, many of these accounts are naturalistic based on the modern scientific conception (...) of nature which has been hailed as the dominating conception of nature. John McDowell in his magnum opus Mind and World, while criticizing modern scientific account of the relationship between mind and world, has not resorted back to anti-naturalism. Instead, he has tried to give us certain clues to develop an account of an alternative form of naturalism which is at the same time radically different from both scientific naturalism and mysterious anti-naturalism. In this paper, I will try to search for an alternative naturalism following McDowell and examine to what extent this account is tenable. In this context, we shall discuss various approaches to understand the relation between reason/normativity (which is one of the significant constituting elements of our mind) and natural world. The objective of the paper is to implement and validate diagnosis in the medical field via refined neutrosophic fuzzy logic (RNFL). As such, we have proposed a Max-Min composition (MMC) method in RNFL. This method deals with the diagnosis under certain constraints like uncertainty and indeterminacy. Further, we have considered the diagnosis problems to validate the sensitivity analysis of the novel multi attribute decision-making technique. Introduction of deep neural networks to the machine translation research ameliorated conventional machine translation systems in multiple ways, specifically in terms of translation quality. The ability of deep neural networks to learn a sensible representation of words is one of the major reasons for this improvement. Despite machine translation using deep neural architecture is showing state-of-the-art results in translating European languages, we cannot directly apply these algorithms in Indian languages mainly because of two reasons: unavailability of the good corpus and (...) Indian languages are morphologically rich. In this paper, we propose a neural machine translation (NMT) system for four language pairs: English–Malayalam, English–Hindi, English–Tamil, and English–Punjabi. We also collected sentences from different sources and cleaned them to make four parallel corpora for each of the language pairs, and then used them to model the translation system. The encoder network in the NMT architecture was designed with long short-term memory (LSTM) networks and bi-directional recurrent neural networks (Bi-RNN). Evaluation of the obtained models was performed both automatically and manually. For automatic evaluation, the bilingual evaluation understudy (BLEU) score was used, and for manual evaluation, three metrics such as adequacy, fluency, and overall ranking were used. Analysis of the results showed the presence of lengthy sentences in English–Malayalam, and the English–Hindi corpus affected the translation. Attention mechanism was employed with a view to addressing the problem of translating lengthy sentences (sentences contain more than 50 words), and the system was able to perceive long-term contexts in the sentences. Indian logic is mainly devoted to the study of nyaya the logical structure of which is analogous to that of a categorical syllogism. In a nyaya it is inferred that since the probans (similar to the middle term) is pervaded by or never exists without the probandum (similar to the major term) and since the probans belongs to the inferential subject (similar to the minor term), the probandum belongs to the inferential subject. Many modern scholars hold that in early Indian (...) logic a nyaya was an analogical argument from particular to particular. We disagree. Early Nyaya works say explicitly that what deviates is a pseudo-probans; this implies that a probans is non-deviant or pervaded by the probandum and thus that a universal premise stating the pervasion of the probans by the probandum is needed. Such a universal premise is also found in articulated arguments. Further, a counterargument based on mere analogy to a nyaya based on a universal connection is viewed as a pseudo-refutation. In this paper, I argue that Will Kymlicka’s theory of “mult”-iculturalism serves to unwittingly perpetuate a form of neo-colonial agenda in which Indigenous claims for recognition and sovereignty in Canada are accommodated to the degree and extent to which they are willing to “liberalize” and promote distinctly Euro-Western self-understandings and conceptions of individual autonomy (tied to substantive notions such as private property) – the supposedly foundational value and defining feature of liberalism. In fact, Kymlicka vehemently attacks Rawls’ theory of political (...) liberalism, whose tolerance-based conception provides a far more open theoretical normative architecture within which to dialogue with non-Western nations, where views of self, autonomy, property, land, non-human animals, and secularism may differ radically from those of liberal Western nations – or so I contend here. Research on values is extensive. Values and value systems are concepts that have interested researchers across domains such as psychology, sociology, and anthropology. However, antecedents of values have not received sufficient attention. In this study, we develop and assess a personal value system from the ancient texts of India. The texts describe a system of existential beliefs and values or prescriptive beliefs. Existential beliefs are concerned with the nature of reality. Prescriptive beliefs or values follow from these existential beliefs, and (...) behavior is influenced by values. The content of existential beliefs and the implied values or prescriptive beliefs are extracted from the texts and a conceptual model of the belief system is developed. Scales are constructed and administered to a sample of subjects. Responses from the survey are analyzed using a structural equation modeling framework. Confirmatory factor analysis is used to assess the scales and establish their adequacy. The nomological net of existential beliefs and values is empirically assessed, and construct validity is examined. Results support the belief system described in the texts. (shrink)

The present paper takes a critical posthumanist lens to study the consequences of rapid urbanisation of the Chinese landscape as presented in the short story ‘Good Hunting’, by Ken Liu. One of the main characters in the story is Yan, a huli jing (fox-spirit), whose ability to switch between her fox and human forms is severely impaired by the loss of remnant nature in China, and the subsequent erosion of the qi from the soil. It is not just the natural (...) landscape that undergoes a transformation during urbanisation – the remnants of nature do not remain untouched by this process. Beings like Yan, who continue to inhabit the place that used to be their home, do not remain the same that they were pre-urbanisation. The city changes them, moulds them in ways hitherto inconceivable, and they undergo this transmogrification of their bodies and their self in order to survive. The article draws out the historical relationship between urban spaces and (post)human bodies, with a specific focus on the Chinese body, drawing parallels between the ideals associated with the city and juxtaposing them with what it means to be posthuman. The paper also interrogates Yan’s status as a liminal entity before and after Hong Kong’s transformation, and her use of liminality as a survival strategy. (shrink)

This paper aims to understand the kind of activities that industrial actors develop in order to protect their enterprises during industrial crisis conditions. A series of political unrest, insurgency, economic turmoil, deadly earthquakes, and economic embargo at the Indo- Nepal boarder escalated the industrial crisis in Nepal. The quest for sustainability of enterprises during the enduring nature of the crisis stimulated for a more detail conversation and survey. A perceptual survey of industrial actors accompanying conversation therein indicates that trade union (...) and association leaders develop positive attitude and advance specific activities for protecting their enterprises during industrial crisis conditions. The study finds that an empathic nature helps to develop a positive attitude among the industrial actors, which seems contributory for enterprises to survive during crisis conditions. The actors tend to positively perceive significance of specific activities under the conditions of difficulties and hardships and enhance immunity to the industrial crisis. This paper argues that the empathic nature of the industrial actors becomes more effective to safeguard the pluralistic interests of the stakeholders of the enterprise than the self- centric nature of the actors. The actors are not only engaged in safeguarding their claims on the industry but are also contributing—beyond their routine work—positively to strengthen the enterprise immunity during difficulties. This paper concludes with an insight of shifting managerial attention from the generic concepts like cost minimisation and product differentiation to the concepts of regularity in supply of goods and services in the business network by expanding the scope of industrial relations vertically and horizontally. The empathic nature of industrial actors enhances the effectiveness of the general system theory and social network theory by developing understanding of the role of industrial actors’ relations in sustaining and operationalizing a business network under organizational crisis conditions. The epistemology which we went through up to 1970’s has hardly been gender-sensitive, and with the emergence of feminism, mainly with its Second Wave, a group of gender-sensitive practitioners of epistemology and feminist philosophy came out to declare that our so far cultivated epistemology (which is sometimes regarded as “pure” and “standard‘) has subtly been infected with viruses of patriarchal ideology and androcentrism. Taking this gender dimension in mind, there has developed a considerable amount of literature, which is referred to (...) as feminist epistemology. It is actually doing epistemology in order to assure cognitive justice to all, and thereby establish gendersensitive humanism, cleansing it from traditional androcentric biases and unjust patriarchal surveillance. The most predominant kind of disease that is normal among ladies is breast cancer. It is one of the significant reasons among ladies, regardless of huge endeavors to stay away from it through screening developers. An automatic detection system for disease helps doctors to identify and provide accurate results, thereby minimizing the death rate. Computer-aided diagnosis has minimum intervention of humans and produces more accurate results than humans. It will be a difficult and long task that depends on the expertise (...) of pathologists. Deep learning methods proved to give better outcomes when correlated with ML and extricate the best highlights of the images. The main objective of this paper is to propose a deep learning technique in combination with a convolution neural network and long short-term memory with a random forest algorithm to diagnose breast cancer. Here, CNN is used for feature extraction, and LSTM is used for extracted feature detection. The experimental results show that the proposed system accomplishes 100% of accuracy, a sensitivity of 99%, recall of 99%, and an F1-score of 98% compared to other traditional models. As the system achieved correct results, it can help doctors to investigate breast cancer easily. (shrink)

In an episode in the Bhagavadgita Arjuna refuses to fight that would involve killing his teachers, elders, relatives and friends. Krishna argues that he should fight because it is the special duty of a soldier to fight in a just war, one should do one’s duty regardless of the consequences, one should act for the common good, one should build an unwavering character taking victory and defeat, pleasure and pain, friend and foe in the same way, etc. Some of these (...) reasons may be taken to promote deontology, others utilitarianism, yet others virtue ethics that are often viewed contemporarily as incompatible ethical theories. We argue that these three theories are not necessarily incompatible and may be linked to three sides of human nature: deontology to cognitivity, utilitarianism to dynamism and virtue ethics to affectivity. We also argue that Krishna may be taken to promote ethical pluralism just as he may be taken to promote religious pluralism by recommending the path of knowledge, the path of action and the path of devotion from an inclusive perspective. This article attempts to create the space for rethinking the politics and ethics of consumption by initiating dialogues with Swadeshi movements and Gandhi in order to transform the spaces ofproduction transcending the concern for consumption choices. Analysing the history of Swadeshi movements in pre-independence India, especially Bengal, and drawing inspiration from Gandhi 's Swadeshi movement and his principles of swaraj and satyagraha, an attempt has been made here to provide an aesthetic, ethical and spiritual foundation for the present version of (...) the Swadeshi drive in India, which is substantively immersed in the logic of market capitalism and mindless consumption. The article explores pathways of improvement of quality of life, experi ences in happiness and fulfilment, both individual and collective, by creating a culture of self-development, responsible consumption and community building efforts on the basis of sharing and concern for others. India has one of the most heterogeneous societies in the world. It is a multi-cultural, multi-linguistic, multi-ethnic and multi-religious country. Constitutionally, it is also a sovereign socialist secular democratic republic. But in recent times, Hindu nationalism or Hindutva has been dominant in shaping Indian politics. Hindutva, a shorthand of Hindu nationalism, is actually a politico-ideological device that appears to be disassociated from the spiritual roots of Hinduism and, to many, it is very much alike to the rise of political Islam. (...) Although Hinduism is native to the Indian subcontinent, Hindutva as a political ideology is comparatively a recent phenomenon which creates a growing concern to the land since 1920s. India experienced the rise of Hindutva as a concrete political ideology in 1923 introduced by V. D. Savarkar as it starts to achieve its popularity since 1980s. Obviously it has many reasons. Hindutva is not a monolithic concept as it is generally perceived. Rather, its text, subtext and context had changed throughout the 20th century depending on the period and leadership. This article aims to analyze the trend of the development of Hindu Nationalism or Hindutva in India since its start in the 20th century through a historical lens.
