Narrating the law: Law and literature as a legal philosophical method Literature sometimes makes a surprise appearance in a legal philosophy text. Novels or stories are used to support a philosophical argument, but also to question basic presuppositions of the law. This contribution investigates in what ways literary fiction can be used in legal philosophy. Legal philosophy tends to focus on abstract theories and arguments, while both literature and law are interested in the concrete. Stories, however, have a contextual quality (...) and ambiguity, making them multi-layered, that the more restricted case description lacks. This makes stories valuable within a philosophical inquiry. I distinguish five functions that stories may fulfil in legal philosophy. Some of these are so radical that they may question the project of legal philosophy itself. However, one need not accept that route; it is the plurality of uses that makes stories an interesting addition to traditional forms of legal philosophy. (shrink)

English summary: The validity of human rights is today internationally recognised across nations and cultures. The question as to whether and how their validity can be justified is - on the other hand - a bone of contention. Is this based on legal positivism alone? Or can human rights be understood as moral rights amenable to a kind of justification capable of convincing the skeptic? If so, can such arguments be derived from the tradition of natural law or be defended (...) by means of the laws of reason? Does this require anthropological or metaphysical assumptions - or do discourse-theoretical premises suffice? This volume, which specifically latches onto the traditions of legal positivism, natural and rational law, systematically juxtaposes these questions in a bid for reconciliation. German description: Die Geltung von Menschenrechten ist heute international und kulturubergreifend anerkannt. Die Frage, ob und wie sich ihre Geltung begrunden lassen kann, ist dagegen umstritten: Beruht ihre Geltung lediglich auf positivem Recht? Oder kann man Menschenrechte als moralische Rechte verstehen, die einer Art von Begrundung zuganglich sind, die auch den Skeptiker uberzeugen kann? Wenn ja, lassen sich solche Argumente aus der naturrechtlichen Tradition gewinnen oder mit Mitteln des modernen Vernunftrechts verteidigen? The French scholar Jacques Ellul is nearly forgotton in German-speaking theology. The author presents Ellul's book of 1946 in which he developed a theological foundation of law, puts it in its historical context and tries a theological evaluation. In spite of some fundamental Iacks, particularly in the comprehension of revelation, at least three ideas still merit consideration: no sphere of human reality is independent of God; therefore, theology comprehends an investigation of the inner structures of society; in this, it is (...) focused on the Christan hope. Das Buch enthält aktuelle Fallbesprechungen: Zukonkreten Fällen aus dem Feld der Bio- und Medizinethik wird eine kurze Analyse ethischer Aspekte dargestellt, an die sich juristische Kommentare anschließen. Diskutiert werden nicht-klinische Fälle aus Forschungsethik und Ethik in den Lebenswissenschaften sowie Fälle aus der klinischen Praxis in den Bereichen Chirurgie, Intensiv- und Notfallmedizin, genetisches Screening, Allgemeinmedizin, Neurologie, Psychiatrie und innere Medizin.

In this paper I attempt to analyze the basic tension in Kant's philosophy of right, i.e. within the conceptual framework of his Transcendental Idealism. Right as the embodiment of laws of freedom applicable to mortal-rational agents bridges the gap between their noumenal character and empirical-natural existence. How can this gap be bridged? A priori juridical laws are not sufficient to provide a complete classification for the empirical realm, exhausting all possible positive rights. Furthermore, according to Kant, Right must be basically (...) justifiable by reason. Yet this justification is merely a necessary condition for obligation. In order to develop any real obligation, it must be complemented by a non-deducible, empirical-positive aspect . Hence only as a result of actually exercising individual freedom does the mutual necessitation to recognize individual freedom for all arise. The historical-factual formation of civil social orders, though subject to a priori foundation, is thus unavoidably marked by contingency. Nonetheless, because of its a priori character, the idea of a society of free individuals becomes the standard of critique for every empirical instantiation of a civil social order. Recht als Inbegriff der Gesetze der Freiheit endlich-vernünftiger Subjekte leistet eine Vermittlung zwischen dem noumenalen Wesen und der emprisch-naturalen Existenz dieser Subjekte. Wie ist diese Vermittlung möglich? Eine vollständige Einteilung des Empirischen unter Rechtsgesetzen a priori ist unmöglich. Was Recht ist, ist nach Kant zwar nur in der Vernunft begründbar, aber dieser Grund bleibt nur notwendige Bedingung, zu der stets eine nicht deduzierbare, empirisch-positive Seite hinzukommen muß, um tatsächliche Verbindlichkeit zu erhalten : Erst aufgrund einer faktischen Ausübung der Freiheit entsteht die wechselseitige Nötigung, die individuelle Freiheit als Freiheit aller anzuerkennen. Die historisch-faktische Gestaltung von Rechtsgemeinschaften bleibt somit auch unter der Bedingung apriorischer Begründung mit unaufhebbarer Kontingenz behaftet; doch zugleich gewinnt die Idee einer Gemeinschaft freier Individuen kraft ihrer Apriorität eine kritische Funktion gegenüber jeglicher empirischer Instanz. In _Cognitive Kin, Moral Strangers?_, Judith Benz-Schwarzburg investigates whether non-human animals share complex socio-cognitive abilities like culture, language and theory of mind with humans. She questions our supposedly human uniqueness and explores how cognitive kinship matters for animal ethics.

The paper aims at showing the potential of a phenomenologically informed approach for contemporary debates on democratic legitimacy and community. While the role of affectivity has recently been reconsidered in social and political theory, phenomenological insights into affective moments of subject- and community-formation can contribute to further methodological refinement. Inversely, it is suggested that phenomenological analyses on subjectivity and intersubjectivity should be broadened so as to include what often remained a blind spot: the political dimension. Drawing on descriptive resources offered (...) by Levinas, Waldenfels, and Esposito, the paper sets off to rehabilitate the concept of Betroffenheit, of concernedness or being concerned, which, historically, was at the center of conceptions of democratic politics before being removed from it. Questioning its unreserved ‘juridization’, it is argued that an affective understanding of being concerned is relevant for re-describing the emergence of collective political agents: The shared response to an initial experience of being concerned opens up an alternative account of political processes that, venturing beyond issues of legitimacy and sovereignty, outlines the perspective of democracy out of shared concernedness. What happens when collectivity and law intersect? Lisa Hahn and Markus Hasl outline the state of research on this question and add new answers offered by this special issue. On the one hand, the search for interdisciplinary encounters shows that law is both means and object of collective legal struggles. In doing so, collectives shape law. On the other hand, law (re)produces collectives through categorization and personalization; it juridifies. In doing so, it oscillates between productivity and destructiveness.
