Religious and Ethical Perspectives on Global Migration examines the complicated social ethics of migration in today's world. Editors Elizabeth W. Collier and Charles R. Strain bring the perspectives of an international group of scholars toward a theory of justice and ethical understanding for the nearly two hundred million migrants who have left their homes seeking asylum from political persecution, greater freedom and safety, economic opportunity, or reunion with family members.

This book was originally published in 1981 and the theme of universals attracted a great deal of attention in the decade preceding publication.

This article concerns John Gay’s 1731 essay ‘Preliminary Dissertation Concerning the Fundamental Principle of Virtue or Morality’. Gay undertakes two tasks here, the first of which is to supply a criterion of virtue. I argue that he is the first modern philosopher to claim that universal happiness is the aim of moral action. In other words: Gay is the first utilitarian. His second task is to explain the source of moral motivation. He draws upon the principles of association to (...) argue (a) that we develop benevolent motives by associating the idea of our happiness with that of others and (b) that we come to approve of benevolence by recognizing that our happiness is inextricably connected with the general happiness. While some scholars have taken an interest in Gay’s essay, a sustained treatment of its contents does not exist, despite its acknowledged influence on Hume, Hartley, James Mill, and John Stuart Mill. It is the great merit of Kai to have made an excellent case for a connection between De Anima, 3. 5, and two other elements in the Aristotelian corpus: nous as it functions in the logic and epistemology, and the unmoved mover of Metaphysics, Lambda. Plato said that as long as wisdom and power, or philosophy and politics, are separated, “there can be no rest from troubles.”1 In The Republic, he sought to forge such a union. For over two millennia, from Plato through John Rawls, philosophers have put forward models for the just state.2 Despite these ongoing efforts, W. B. Gallie contends, “No political philosopher has ever dreamed of looking for the criteria of a good state viz-à-viz [sic] other states.”3 I will argue (...) that as long as wisdom and power are separated in international relations, we will continue to have problems. We need to forge a normative framework capable of addressing global issues. I further maintain that, in order to advance a global normative framework, achieving peace, or at least the “outlawry of war” championed by John Dewey, may well be the precondition for success in addressing the myriad global problems facing humanity.4 I agree with Ronald Glossop that among all the global issues we need to address, war is “humanity’s most pressing problem.”5 How can we adequately protect everyone’s human rights, secure economic well-being for all persons, preserve this planet’s rich biological diversity, and attend to other serious global concerns if we fail to end war? The structure of my argument is as follows: I will begin by reviewing the parochial and warist implications of the focus on national sovereignty within Enlightenment political philosophy from Thomas Hobbes through Immanuel Kant. Then, after indicating how Georg Wilhelm Friedrich Hegel and Karl Marx point beyond the modern state in a way that would allow for the global application of normative principles, I will note that the Hegelian and Marxian traditions have not made this normative prospect focal. Finally, in order to develop a global normative framework, I will connect the efforts within twentieth-century philosophy to develop arenas of applied ethics to recent efforts in political science to develop a model of a humane world community.. Is celebration of culturally marginalized people by the dominant culture actually benefitting those who are oppressed? Whose stakes are served in such a celebration and how are existing power relations altered? These are some of the questions John Champagne asks in this original and timely critique, which moves gay studies beyond identity politics and the "rights" discourse within which much of contemporary gay studies is positioned. Champagne argues that in the modern West, culturally marginalized people such as gays are (...) not allowed to define and legitimate their own existence outside the framework established for them by the dominant group. To illustrate his premise, Champagne analyzes a number of recent films, including "Paris is Burning", "Looking for Langston" and Marlon Riggs' 1989 video "Tongues Untied" along with gay pornography, using the work of such critics of difference as Jacques Derrida, Michel Foucault, and Gayatri Spivak. He calls for the marginalized individual to elaborate a practice of critical self-conduct, working to understand his or her own group as having been produced as an entity along a variety of different registers, only some of which might be said to be marginalized. "The Ethics of Marginality" situates itself at the intersection of English, cultural studies, film studies and gay and lesbian studies. Several psychological experiments have suggested that concepts can influence perceived color (e.g., Delk and Fillenbaum in Am J Psychol 78(2):290–293, 1965, Hansen et al. in Nat Neurosci 9(11):1367–1368, 2006, Olkkonen et al. in J Vis 8(5):1–16, 2008). Observers tend to assign typical colors to objects even when the objects do not have those colors. Recently, these findings were used to argue that perceptual experience is cognitively penetrable (Macpherson 2012). This interpretation of the experiments has far-reaching consequences: it implies that the (...) way we think of objects determines how we see them, thus threatening the role of perception in justifying beliefs. In this paper, I show that the psychological findings can be accounted for without admitting cognitive penetrability. An underestimated but key feature of the experiments is that observers had to judge colors in borderline cases, in conditions of reduced acuity, or on the basis of color-concepts instead of matching. Such judgments are sensitive to the form of bias that Tversky and Kahneman (Science 185:1124–1131, 1974) have termed ‘anchoring’. Adopting a suggestion from Raffman (Philos Rev 103(1):41–74, 1994), I argue that the way subjects in the experiments think of the objects could affect their color judgments without altering their color experiences. In June 2018 the Supreme Court of the United States decided the case of Masterpiece Cakeshop, in which baker Jack Phillips refused to provide a cake for a same-sex wedding. The Court decided the case on fairly narrow grounds; in particular, it set aside the question of whether Phillips illegally discriminated on the basis of sexual orientation by refusing to sell the same cake to a gay couple that he would sell to a heterosexual couple. Concurring opinions by Justices Kagan (...) and Gorsuch do address that question, however, and in this paper I explore the debate between them. By distinguishing between design-based and use-based refusals of service and then arguing that some use-based refusals are tantamount to discrimination on the basis of protected traits, I argue that Jack Phillips did indeed discriminate on the basis of sexual orientation. I also argue that another baker, who refused to create a “Leviticus 18:22 ‘Homosexuality is a detestable sin’ ” cake, did not discriminate on the basis of religion. I thus side with Justice Kagan against Justice Gorsuch on the question of whether the Colorado commission treated the two bakers inconsistently. (shrink)

Suppose that a school restricts student expression critical of homosexual conduct yet allows or actively supports student expression that promotes acceptance and tolerance of gays and lesbians. Can such a policy be justified if the anti-gay speech disrupts the educational environment of the school while the pro-gay speech does not? Or does the differential treatment of anti-gay and pro-gay speech constitute unconstitutional viewpoint discrimination because it distorts the marketplace of ideas within the school? Can viewpoint discrimination ever be justified on (...) the ground that anti-gay speech invades the rights of others under Tinker v. Des Moines Independent Community School District, 393 U.S. 503 (1969)? These were among the questions debated by Judges Reinhardt and Kozinski in the Ninth Circuit's now-vacated panel opinion in Harper v. Poway Unified School District, 445 F.3d 1166 (9th Cir. 2006), but their significance to the law of student speech is quite general. Courts are increasingly becoming concerned with the question of whether Tinker allows viewpoint-based restrictions of student speech, but so far jurists have not reached agreement on this question or even on the simpler question of what counts as viewpoint discrimination. This article attempts to clarify the emerging debate about the permissibility of viewpoint discrimination under Tinker and proposes modifications to the Tinker framework that would enable courts to deal more fruitfully with charges that school officials have imposed viewpoint-based restrictions on student speech. I argue that we should think of viewpoint discrimination as purposeful restriction of expression on the basis of governmental disagreement with the message. Tinker must be understood to bar purposeful viewpoint discrimination, but the conclusion that a school speech restriction constitutes purposeful viewpoint discrimination will come at the end rather than at the beginning of constitutional analysis. A school will never announce that it has restricted student speech on the basis of disagreement with the message; instead, it will claim that it has regulated speech to prevent harm. And this is something that schools (and the state more generally) may sometimes do - at least with sufficient justification. Tinker obviously contemplates the regulation of speech where necessary to prevent two specific sorts of harms - disruption to the school's mission and violations of the rights of other students - and so must require courts to distinguish between school speech restrictions based on impermissible ideological purposes and those based on the permissible purposes of preventing disruptions or violations of student rights. Tinker's substantial disruption test, I contend, should primarily be understood as a mechanism for helping courts to smoke out these impermissible purposes. (shrink)

Following decades of neglect, the work of the German Jewish philosopher, literary author, cultural critic, and poet Günther Anders (1902–1992) is gaining increasing recognition in the English-speaking world. This translation of “Résistance heute” (Resistance Today) makes one of Anders’s most programmatic and polemical short texts available. Published at the height of his anti-nuclear activism, “Resistance Today” is the written version of a speech Anders delivered in November 1962 upon acceptance of the northwest Italian city of Omegna’s Resistance Prize (other notable (...) recipients included Jean-Paul Sartre and Frantz Fanon). It first appeared in print in the West German left-wing journal Das Argument in November 1963. Clearly written for the occasion, the text condenses (and often further radicalizes) key premises about the end of history, the amoral character of work, and the continuity between Nazi totalitarianism, the nuclear age and the world of consumerism that are developed in great nuance across a range of books that Anders had recently published. Key co-ordinates include: Die Antiquiertheit des Menschen 1 (The Obsolescence of Human Beings 1, 1956), his groundbreaking critique of technology; Der Mann auf der Brücke (The Man on the Bridge, 1959), a philosophical travel diary occasioned by Anders’s 1958 visit to Japan and his participation at the World Conference Against Atomic and Hydrogen Bombs in Tokyo; Burning Conscience (1961), a correspondence with the American reconnaissance pilot Claude Eatherly, who scouted the target area before the Enola Gay went on to drop the atom bomb on Hiroshima. It seems likely that Burning Conscience, which turned into an international bestseller, occasioned the award of the prize. (shrink)

This essay applies the principle of justice as fairness to the issue of same-sex marriage. I will outline Rawls’s theory of justice, including the original position and the veil of ignorance as the means by which choosers craft a just state. In considering whether same-sex marriage should be permissible, I argue that a just society, formulated in the Rawlsian context of justice as fairness, should allow them. I assert that gays and lesbians do count as equal citizens because they possess (...) the minimum requirements of the capacity for a sense of justice, a conception of the good, and the ability to be cooperating members of society. Furthermore, within the original position gays and lesbians will be represented because choosers do not know their sexual orientation because it is one of the individual characteristics that are withheld behind the veil. Since the choosers do not know their sexual orientation, they will be unable to use that information in their construction of what counts as a just state comprised of free and equal citizens. Because the family, and the institution of marriage as a primary manifestation of the family, is one of the major social institutions within the basic structure, limitations must be carefully scrutinized.
