La vulneración de derechos en la atención sanitaria en Latinoamérica representa una problemática creciente que afecta la calidad de los servicios y la equidad en la salud. Este estudio tiene como objetivo analizar las principales causas y consecuencias de la violación de derechos en los sistemas de salud de la región, enfocándose en los derechos humanos, el acceso a la atención médica, la discriminación y la corrupción. Se realizó una revisión bibliográfica que incluye legislación, artículos que abordan la temática y (...) sentencias sobre la vulneración del derecho a la atención sanitaria. Los resultados indican que las vulneraciones más frecuentes incluyen la falta de acceso a servicios adecuados, el trato desigual hacia poblaciones vulnerables y la carencia de recursos. Se concluye que es urgente implementar reformas estructurales en los sistemas de salud de Latinoamérica para garantizar la protección efectiva de los derechos humanos y mejorar la calidad de la atención sanitaria. La donación y el trasplante de órganos representan avances médicos cruciales, pero plantean importantes desafíos jurídicos y bioéticos. Este artículo examina la interacción entre el derecho y la bioética en la regulación de estas prácticas, abordando el problema de cómo garantizar un acceso justo y ético a los órganos, respetando la autonomía y dignidad humana. El objetivo es analizar los marcos legales y los principios bioéticos que subyacen a la donación y el trasplante, destacando su impacto en la práctica médica (...) y en la sociedad. Se utilizó una metodología basada en revisión bibliográfica, centrada en textos normativos, doctrinas bioéticas y casos relevantes. Los resultados evidencian la necesidad de fortalecer los marcos legales para equilibrar la equidad, el altruismo y la protección de los derechos individuales. Concluimos que un enfoque integral y multidisciplinario es esencial para abordar los desafíos actuales y futuros en esta área compleja y sensible. (shrink)

When faced with the charge that a given concept of God is contradictory, the standard move among philosophers and theologians has been to try to explain away the contradiction and show that the concept of God in question is consistent. This has to do, of course, with the Law of Non-Contradiction (LNC). Another option, which has recently generated interest among logicians and analytic philosophers of religion, is to reject such a move as unnecessary and defend what might be called the (...) contradictory God thesis. To be sure, something close to that can be found in philosophers such as Pseudo-Dionysius, Thomas Aquinas and Nicolaus de Cusa. However, it is only recently that this approach has gained momentum, certainly driven by the contemporary advance of dialetheism and glut theoretic approaches in general, and paraconsistent logic. Needless to say, a standard move among defenders of the contradictory God thesis is to challenge the LNC. The argumentation, however, is seldomly framed in conceptual terms. Instead, it is mostly framed in ontological terms, as God being a contradictory entity. From this perspective, the contradictory God thesis is the thesis that God is a contradictory object. My goal in this paper is to provide a conceptual assessment of the discussion surrounding the contradictory God thesis. To achieve this, I make use of a general and hopefully non-controversial meta-theory of concepts and adopt a semantic approach rather than a metaphysical one. Within this framework, I address the following questions: What are the different ways we can understand the contradictory God thesis? What grounds are there for rejecting a contradictory concept of God? What standard moves are available to defend oneself from such criticisms and how do they relate to the LNC? What challenges do they present? As a secondary goal, the paper introduces a novel defense of the contradictory God thesis, drawing on a specific interpretation of the theology of the 16th-century Indian thinker Jīva Gosvāmī, which avoids the need to challenge the LNC. I term this approach ‘non-dialetheic mystical contradictory theism.’. (shrink)

The present work addresses the aesthetic philosophy of Eduard Hanslick in order to demarcate it as an epistemological approach to music and a paradigmatic case for musical autonomy. The epistemological assumptions that guided the work On the Musically Beautiful and its most likely influences were analyzed. We conclude by presenting musical idea as an epistemological formulation strongly influenced by positivism and as a qualifying principle of autonomous musical perception. We add to this conclusion a disambiguation with Kant›s concept of aesthetic (...) idea. (shrink)

Her Majesty's Children reveals not only a deeply personal account of the experience of racism but is also a revolutionary work that asks us to reconsider our ordinary practices and lives to recognize and resist the traces of a colonial age of racism that so many claim is only part of our past.

Using the case of Ebola Virus Disease as an example, this paper shows why patients at high risk for death have a defensible moral claim to access unregistered medical interventions, without having to enrol in randomized placebo controlled trials.A number of jurisdictions permit and facilitate such access under emergency circumstances. One controversial question is whether patients should only be permitted access to UMI after trials investigating the interventions are fully recruited. It is argued that regulatory regimes should not prioritise trial (...) recruitment over patient access, even if this results in drug research and development delays.We describe how the moral duty to rescue impacts on others' duties to oblige patients seeking emergency access to unregistered medical interventions. The view that eligible patients are owed the provision of access to UMI regardless of their willingness to enrol in a randomised controlled trial is defended. (shrink)

El presente artículo busca dar con la influencia de Baruch Spinoza en el pensamiento de Xavier Zubiri en torno al tema de la materia y de allí entender lo que es lo estético. Es sabido que Zubiri desde joven fue un gran lector de Spinoza; incluso lo enseñaba en detalle a su amiga-estudiante María Zambrano. Y lo que pensamos es que Zubiri siempre estuvo influenciado por el pensador holandés y esto se ve reflejado en cómo Zubiri trata su concepto de (...) materia, clave en su obra; y tal concepto nos permite, por ejemplo, entender lo estético en el pensador español. Illustrations and examples have always been deemed rare in the otherwise abundant materials Kant sent to be printed. In this sense, tradition has made out of the Königsbergs philosopher a rather arid writer. He himself advocated for the perks of a proper scholastic method in presenting arguments. It is thus a common place among scholars that Herr Professor valued discursive clarity over any whimsical rhetorical garments the popular thinker could have been tempted to wield in defense of his surely more (...) than dubious reasons. But even with that in mind, in Kants writings there is this persistent and everlasting metaphor regarding the activity of navigation. A metaphor going all through the Kantian philosophical enterprise: either in the form of sailing the thin air and pretending to avoid -- or surf -- any resistance, like the figure of the dove in the Critique of Pure Reason (1781); or better with the picture of the wandering unconcerned under the celestial and immeasurable vault only to discover we were lost in search for the North in What Does It Mean To Orient Oneself In Thinking?(1786), Kants critical philosophy insisted in the depiction of the task of thinking not only as a concrete one depending on facts and experience gathered -- pinpoint locations -- but also as a matter of orientation depending on the necessity of categories -- criteria, cardinal points -- of thought. If fanciful aspirations of ideas happen to take off from the objective ground irresponsibly as if empirical experience and facts had no substance at all -- it is with good reason that due operations of counterbalance should be taking place with help of the sound weight of articulated reasonable concepts based on formal and material reality. Kants theory of mind presupposes a responsibility of a subject in relation to several types of objects. The two of these epistemic extremes are intertwined and in need of each other. When it comes to orientation, leaning on some sort of inner compass, each of us would have both in regard to sensitivity, knowledge, and moral thinking which serves like a guide to the trip within all three domains, and even comes in handy to map them out. This collective volume is precisely devoted to the task of revisiting some landscapes of the Kantian thought-itinerary along the brave seas and deep into the thick forests of justified knowledge, principles of morals and judgement in aesthetics: through its pages this work has put together renowned scholars from very different traditions eager to circumnavigate again the issues and concerns of 18th Century Philosophy and the particular Kantian solution of a new branded type of metaphysical inquiry, one inquiry subject to intellectual global duties as well. The article investigates from the book “Images despite everything”, by Georges Didi-Huberman (2020), four remaining photographs of Crematorium V in Auschwitz-Birkenau, taken in August 1944, by the Greek Jew Alberto Errera, a member of the Sonderkommando. It is noteworthy that it is his photographic gesture invested with the most intense emotional sense (pathos) that gives his images an indicial character that effectively operates as testimony (superstes) allowing one to imagine what is considered “unimaginable” by “Holocaust metaphysicians”. Reacting to the thesis (...) of the impossibility of representing the gas chambers, according to which any attempt to configure them would be a falsification of suffering by concession to aestheticization, the article states that it is necessary to know what is possible, whatever it is about the pain that took place there. It is also evident that it is the “zones of opacity” in Alberto Errera’s photos that, by conveying the pathos, activate the imagination and force the viewer’s thoughts. It is its “out of framing” that, mobilizing the gaze without stopping, from the icon to the index and from that to that, does not operate as an interdiction, but, on the contrary, it is what makes one see and know something more about what happened there. Finally, it can be concluded that Alberto Errera’s gesture transformed the “historical reality”, made of horror and upheaval, into a possibility of memory for the future, using only a remnant of celluloid. And for this, certain of Nietzsche’s biographical milestones are discussed in the light of the work Thus Spoke Zarathustra and its link to Lou Salomé. We look at how Lou Salomé lies behind the mythical figure of Ariadne as the bearer of the ring of return; that is, (...) through the feminine, Nietzsche shows us how the eternal return operates to free us from the chains of modernity. Este artículo busca pensar los orígenes de la Técnica moderna en la vida y obra del científico pisano Galileo Galilei a la luz de dos ideas fundamentales, por una parte, lo acontecido en la propia época de Galileo y, por otra parte, en la categoría fundamental de «experimentación» como «probación física de la realidad» que aparece en la obra Inteligencia y razón de Xavier Zubiri. Desde esta categoría de análisis podremos ver la riqueza de la inicial investigación científico-técnica de Galileo (...) y cómo ésta ha sido decisiva en el desarrollo ulterior de la investigación humana a lo largo de la Historia. Consideramos no artigo a afirmação cética de que devemos suspender o juízo nos casos de desacordo. Discutimos brevemente o argumento para a suspensão de juízo nos casos de desacordo apresentados por Sexto Empírico e propomos um argumento com base nas considerações de Feldman sobre o desacordo entre pares epistêmicos. Desenvolvemos então três objeções a esse argumento.

Despite the unquestionable importance of technological progress in twenty-first-century society, the decision by many political leaders worldwide to treat natural sciences as an almost exclusive priority betrays a terrible misconception of the complexity of the contemporary world. As the Renaissance cannot be reduced to Copernicus’s or Galileo’s brilliant contributions, or Enlightenment to the works of such giants as Newton and Cavendish, contemporary society will hardly be remembered as just a series of amazing software and gadget updates. There are three categories (...) of questions today that only humanities are prone to answer. The first one, exploring the relations between subject and object mediated by the meaning of “property”, ultimately concerns the discussion between legality and legitimacy. Not long ago, teenagers were still being sued by the giants of the Entertainment Industry for downloading songs, and the practice of mash-ups or remixing even now arouses huge polemics. The second one, focused on the self-representations of the subject, concerns the changing meanings (and representations) of identity and cultural borders in a globalizing world. Finally, the inter-subjective interactions are the centre of the political tensions between democracy and demagogy, two opposed categories that have often been presented as hardly distinguishable from each other. The awareness of educators in the health sciences with respect to promoting ethical conduct when instructing dental students is reflected in the undergraduate curriculum. This study is intended to discover the different ways these subjects are taught. A manual review of the literature published in databases indexed in SciELO during the years from 1999 to 2014 was done to that end, under the heading health sciences, humanities, applied social sciences, specifically literature that can be accessed in full, free of charge (...) and anonymously. Also reviewed was the literature in two specialized journals in the area of health education; namely, the Journal of Dental Education and the Journal of Medical Education, with the same titles, during the same period, and through the PubMed search engine, via Medline. The results show 43 articles of thematic relevance. The conclusion is that education in bioethics, as part of the undergraduate curriculum at dental schools, is increasing and differs according to the educational and cultural environment where it is imparted. Case-based learning and problem-based learning are mentioned as being the most efficient methods of instruction. Training dentists to be well-rounded professionals requires these subjects to be taught by interdisciplinary teams that are sufficiently prepared to do so. (shrink)

Alchourrón devoted his last years to the analysis of the notion of defeasible conditionalization. He developed a formal system capturing the essentials of this notion. His definition of the defeasible conditional is given in terms of strict implication operator and a modal operator f which is interpreted as a revision function at the language level. In this paper, we will point out that this underlying revision function is more general than the well known AGM revision [4]. In addition, we will (...) give a complete characterization of that more general kind of revision and will show how permits to unify models of revision given by other authors. Alchourrón dedicó sus últimos años al análisis de la noción de condicionalización derrotable. Desarrolló un sistema formal que captura los aspectos esenciales de esta noción. Su definición de condicional revisable está dada en términos del operador de implicación estricta y un operador modal f el cual es interpretado en el nivel del lenguaje como una función de revisión. En este trabajo señalamos que la función de revisión subyacente es más general que la bien conocida función de revisión de AGM. Además, presentaremos una caracterización completa de una clase de revisión más general y mostraremos cómo nuestro modelo permite unificar los modelos de revisión propuestos por otros autores. On August Business Roundtable, the Business Roundtable redefined the purpose and social responsibility of the corporation. Yet, this statement must be followed by substantial changes in the business models of corporations for it to avoid becoming empty rhetoric. We believe that the figure of the independent director may be one of the catalysts needed for this change of paradigm for corporations. In spite of the positive correlation between Corporate Social Responsibility and board independence, the development of the independence of boards (...) during the last decade has not lead to the expected CSR results. Academics and regulators point to a weak definition and the non-standardized measurement of both independence and board independence as one possible explanation, and agree that a broader definition is needed. This paper aims to contribute to this debate. We develop a second-generation definition of independence based on a positive approximation to the concept by integrating an Aristotelian perspective of virtue ethics with the best practices of corporate governance. Thus, we define independence as a virtue guided by practical wisdom, that implies autonomy and autarky and which enables a person to act with integrity, fairness and truthfulness. In the context of corporate governance, independence is associated with an honest disposition to serve. Our proposal has political implications for supervisors that make decisions relating to the suitability of board members. (shrink)

Este artículo analiza el problema de cómo lidiar con situaciones en las que nuestras creencias morales van en contravía de las demandas de un gobierno que cuenta con el decidido apoyo de la mayoría de los miembros de la comunidad política a la cual uno pertenece. Siguiendo las tesis que plantea Jaspers en el Problema de la culpa, se intenta mostrar que si se interpreta el concepto de culpa política propuesto por Jaspers en la línea del filósofo liberal John Locke, (...) se puede arrojar una nueva luz sobre lo que la responsabilidad política significa. Esto también nos permitirá mostrar que las llamadas obligaciones políticas de los ciudadanos se extienden más allá de los requerimientos institucionales, asunto que ha sido el foco de recientes discusiones entre aquellos estudiosos que tratan la cuestión de la legitimidad política desde la perspectiva del contractualismo moderno. Tal extensión consiste básicamente en que los ciudadanos tienen obligaciones políticas relacionadas con la cultura política que constituyen su identidad política. (shrink)

We study ultraproducts of finite residue rings \ where \ is a non-principal ultrafilter. We find sufficient conditions of the ultrafilter \ to determine if the resulting ultraproduct \ has simple, NIP, \ but not simple nor NIP, or \ theory, noting that all these four cases occur.

This article presents a review of the theoretical support of the Portfolio of Evidence as a pedagogical tool to be used at the higher level with the aim of improving writing products, understanding the importance of developing in students’ skills for the optimal construction of academic writings. The portfolio then becomes a resource used by teachers not only to obtain evidence of the progress of students in the subject that is developed, but also constitutes an indicator to assess the progress (...) in the acquisition of learning in the studentfrom the writings it produces. The particularity of being continuous and progressive also allows the student to self-assess their progress through the writing they make and can generate strategies for continuous improvement.
