At least four different frameworks — psychiatric, cognitive, functional and decision-making — are used in the evaluation of competence, all of which remain more or less unrelated in the literature. In the first section of this paper we consider various meanings of competence, in order to arrive at a definition of the term relevant to the medical and legal setting. Patient or client competence, we conclude, refers to the practical abilities that individuals employ in pursuing their own autonomous goals in (...) life. We then show how a systematic categorization of these practical abilities — which we call a taxonomy of practical judgment — allows us to show when the traditional frameworks for the evaluation of competence may or may not be useful in the evaluation of a particular competence.In the final section we explore some of the normative considerations underlying the taxonomy. For instance, competence is not only related to intrinsic abilities but to resources available in the community. Here we touch on questions related to the fair distribution of community resources. Few figures of the Middle Ages command the attention of so many modern disciplines as Robert Grosseteste (c. 1170-1253). Theology, Philosophy, History, and Science are all areas which his life and thought continue to have significance and to inspire re-interpretation. Accompanied by a series of original commentaries, this new edition of Grosseteste's work, with English translation, draws together the perspectives of modern scientists and medieval specialists. Volume I of a six volume series, Knowing and Speaking presents two of the (...) earliest of Grosseteste's works, the treatises On the Liberal Arts and On the Generation of Sounds. These are accompanied by a significant Middle English treatise on the Seven Liberal Arts whose anonymous fifteenth-century author translated and excerpted passages from Grosseteste's treatises in a re-imagining of their structure and function.0Each work is treated separately within the volume, which is constructed in three parts. On the Liberal Arts sets Grosseteste's thoughts on the arts subjects and emphasises moral concerns about the purpose of learning. Based on the relevant logic R, the system R# was proposed as a relevant Peano arithmetic. R# has many nice properties: the most conspicuous theorems of classical Peano arithmetic PA are readily provable therein; it is readily and effectively shown to be nontrivial; it incorporates both intuitionist and classical proof methods. But it is shown here that R# is properly weaker than PA, in the sense that there is a strictly positive theorem QRF of PA which is unprovable in R#. (...) The reason is interesting: if PA is slightly weakened to a subtheory P+, it admits the complex ring C as a model; thus QRF is chosen to be a theorem of PA but false in C. Inasmuch as all strictly positive theorems of R# are already theorems of P+, this nonconservativity result shows that QRF is also a nontheorem of R#. As a consequence, Ackermann's rule γ is inadmissible in R#. Accordingly, an extension of R# which retains its good features is desired. The system R##, got by adding an omega-rule, is such an extension. Central question: is there an effectively axiomatizable system intermediate between R# and R##, which does formalize arithmetic on relevant principles, but also admits γ in a natural way? (shrink)

The Greek philosopher Aristotle, writing over two thousand years before Wall Street, called people who engaged in activities which did not contribute to society "parasites." In his latest work, renowned scholar Robert C. Solomon asserts that though capitalism may require capital, but it does not require, much less should it be defined by the parasites it inevitably attracts. Capitalism has succeeded not with brute strength or because it has made people rich, but because it has produced responsible citizens and--however (...) unevenly--prosperous communities. It cannot tolerate a conception of business that focuses solely on income and vulgarity while ignoring traditional virtues of responsibility, community, and integrity. Many feel that there is too much lip-service and not enough understanding of the importance of cooperation and integrity in corporate life. This book rejects the myths and metaphors of war-like competition that cloud business thinking and develops an "Aristotelean" theory of business. This paper defends a new argument for enabling citizen participation in government: individuals must have genuine opportunities to try to change the law in order to be able to satisfy duties of conscience. Without such opportunities, citizens who regard systems of related laws as partially unjust face a moral dilemma. If they comply with these laws willingly without also trying to change them, they commit a pro tanto wrong by willingly participating in injustice . If they disobey, or if they (...) obey only to avoid sanction, they respond inadequately to the morally important purposes that the laws advance despite their injustice. Government should help citizens avoid this dilemma. This argument bolsters the non-instrumentalist view that responsiveness in the political process is desirable even if it does not promote just legislative outcomes. It also helps to explain what governments owe to citizens with minority political views. (shrink)

In this paper, we explore Fregean metatheory, what Frege called the New Science. The New Science arises in the context of Frege’s debate with Hilbert over independence proofs in geometry and we begin by considering their dispute. We propose that Frege’s critique rests on his view that language is a set of propositions, each immutably equipped with a truth value (as determined by the thought it expresses), so to Frege it was inconceivable that axioms could even be considered to be (...) other than true. Because of his adherence to this view, Frege was precluded from the sort of metatheoretical considerations that were available to Hilbert; but from this, we shall argue, it does not follow that Frege was blocked from metatheory in toto. Indeed, Frege suggests in Die Grundlagen der Geometrie a metatheoretical method for establishing independence proofs in the context of the New Science. Frege had reservations about the method, however, primarily because of the apparent need to stipulate the logical terms, those terms that must be held invariant to obtain such proofs. We argue that Frege’s skepticism on this score is not warranted, by showing that within the New Science a characterization of logical truth and logical constant can be obtained by a suitable adaptation of the permutation argument Frege employs in indicating how to prove independence. This establishes a foundation for Frege’s metatheoretical method of which he himself was unsure, and allows us to obtain a clearer understanding of Frege’s conception of logic, especially in relation to contemporary conceptions. Linguists intuitions about language change can be captured by adynamical systems model derived from the dynamics of language acquisition.Rather than having to posit a separate model for diachronic change, as hassometimes been done by drawing on assumptions from population biology (cf.Cavalli-Sforza and Feldman, 1973; 1981; Kroch, 1990), this new modeldispenses with these independent assumptions by showing how the behavior ofindividual language learners leads to emergent, global populationcharacteristics of linguistic communities over several generations. As thesimplest case, we formalize the example of (...) two grammars and show that eventhis situation leads directly to a nonlinear (quadratic) dynamical system.We study this one parameter model in a variety of situations for differentkinds of acquisition algorithms and maturational times, showing howdifferent learning theories can have very different evolutionaryconsequences. This allows us to formulate an evolutionary criterion for theadequacy of grammatical and learning theories. An application of thecomputational model to the historical loss of Verb Second from Old French toModern French is described showing how otherwise adequate grammaticaltheories might fail the evolutionary criterion. This is a collection of essays on the work of the German philosopher Friederich Wilhelm Nietzsche. Each essay concentrates on a single work, and the volume is organized on a chronological principle, considering the works in the order in which Nietzsche wrote them. The current debate on “free agency” seems to highlight the romantic aspects of free agent and considers it a genuine response to changing economic conditions (e.g., high-unemployment rate, importance of knowledge in the labor market, the eclipse of organizational loyalty, and self pride). Little attention, if any, has been given to the religious root of the free agency concept and its persistent existence across history. In this paper, the current discourse on free agency and the conditions that have led to (...) its emergence are briefly discussed. The paper focuses on the theological perspectives of Judaism, Christianity, and Islam on the concept. Implications for management and business organizations are provided. (shrink)

Many people recognize that governments can play salutary roles in relation to markets by “overseeing” market behavior from “above,” or supplying foundational “rules of the game” from “below.” It is probably no accident that these widely recognized roles also sit comfortably with traditional conceptions of government and market, pursuant to which people tend categorically to distinguish between “public” and “private” spheres of activity. There is a third form of government action that receives less attention than forms and, however, possibly owing (...) in part to its straddling the traditional public/private divide. We call it the “government as market actor” form, whereby government instrumentalities pursue traditionally “public” ends through traditionally “private” means. Inattention to this pervasive form of government action might signal a theoretical blind spot attending the public/private distinction itself. At least as importantly, however, this inattention also denies us a practical opportunity: it prevents our more fully exploiting the government role in question. This Article, part of a larger project, aims to encourage fuller theoretical appreciation and wider practical use of the role we identify. It first offers a provisional taxonomy of recurrent forms that the government market actor role appears to take, affording a wealth of illustrative case studies in so doing. It then envisions additional good that governments might do, simply by extending their market acting roles to spheres in which they have yet to be fully utilized. The Article concludes by suggesting next steps in both theorizing and employing the government market actor role. (shrink)

Quons are particles characterized by the parameter q, which permits smooth interpolation between Bose and Fermi statistics; q = 1 gives bosons, q = -1 gives fermions. In this paper we give a heuristic argument for an extension of conservation of statistics to quons with trilinear couplings of the form ffb, where f is fermion-like and b is boson-like. We show that q f 2 = qb. In particular, we relate the bound on qγ for photons to the bound on (...) qe for electrons, allowing the very precise bound for electrons to be carried over to photons. An extension of this argument suggests that all particles are fermions or bosons to a high precision. (shrink)

Many patients believe that cardiopulmonary resuscitation (CPR) is more likely to be successful than it really is in clinical practice. Even when working with accurate information, some nevertheless remain resolute in demanding maximal treatment. They maintain that even if survival after cardiac arrest with CPR is extremely low, the fact remains that it is still greater than the probability of survival after cardiac arrestwithoutCPR (ie, zero). Without realising it, this line of reasoning is strikingly similar to Pascal’s Wager, a Renaissance-era (...) argument for accepting the proposition for God’s existence. But while the original argument is quite logical—if not universally compelling—the modern variant makes several erroneous assumptions. The authors here present a case of a patient who unwittingly appeals to Pascal’s Wager to explain his request for maximal treatment, in order to highlight the crucial divergences from the original Wager. In understanding the faulty assumptions inherent in the application of Pascal’s Wager to code status decisions—and identifying the underlying motivations which the Wager serves to confirm—providers can better ensure that the true values and preferences of patients are upheld. Causal connectionists need to provide an account of causal linkage and of causal direction. This chapter distinguishes between two kinds of causal connection, namely, discrete and continuous. Causal connectionists have a number of options for explaining the linkage between causes and effects in the case of discrete causation. The chapter provides some popular options. If some causation is discrete, and the exercise of causal powers provides a direction to discrete causation, then the causal direction of processes can be derived from (...) the causal direction of discrete interaction. David Hume famously made the claim about the knowledge of causation in his Enquiry Concerning Human Understanding. Hume offers, in defense of his principle, a set of thought‐experiments that seem to show that we can always imagine any event's having a different result from the one we in fact observe. Causal processes like locomotion may provide counterexamples to Hume's Epistemic Principle. (shrink)

This chapter examines some issues concerning the structure of time. It considers arguments for and against Temporal Finitism. Temporal Discretism is a kind of Finitism: any finitely extended interval is made up of only finitely many indivisible units of time. In the chapter, the authors assume for the sake of argument that Intervalism is true, that is, that some temporally extended intervals and processes are among the world's fundamental entities. The main argument for Intervalism is that it follows from the (...) metaphysical impossibility of certain infinitary scenarios involving super‐tasks. Strong Intervalism denies that instants are fundamental, while Moderate Intervalism, or Interval‐Boundary Dualism, embraces the fundamentality of both instants and intervals. Infinitary Intervalism is relative to the three competing theories of Aristotelian Temporal Finitism, Temporal Discretism, and Instantism. In the chapter, the authors also assume that all Intervalists are either Discretists or Aristotelian Finitists, and that all Instantists are Temporal Infinitists. (shrink)
