The open borders view is frequently dismissed for making infeasible demands. This is a potent strategy. Unlike normative arguments regarding open borders, which tend to be relatively intractable, the charge of infeasibility is supposed to operate as what we call a "normative argument-stopper." Nonetheless, we argue that the strategy fails. Bringing about open borders is perfectly feasible on the most plausible account of feasibility. We consider and reject what we take to be the only three credible ways to save the (...) charge of infeasibility: by proposing an alternative account of feasibility; by proposing an alternative, more circumscribed interpretation of the subject-matter of feasibility claims; and by proposing a more expansive account of the addressees of the demand for open borders. The first fails to vindicate the claim that infeasibility is a normative argument-stopper. The second does not provide an argument against open borders at all. The third underestimates the power of at least some non-state actors. We conclude by drawing some lessons for the open borders view and the use of feasibility in politics more generally. (shrink)

A wide range of medical institutions have developed and implemented policies to mitigate the adverse consequences of conflicts of interest. These newly implemented policies, which include regulation of industry contact with physicians and hospitals, controls on gifts from industry, and greater transparency in industry sponsored activities, have generated considerable controversy.Formulating and evaluating policies in a neutral, unbiased fashion can be difficult for those personally affected. When people have a stake in an issue, they tend to process information in a selective (...) fashion that supports their personal interests, a phenomenon known as “motivated reasoning.” When decision makers with preexisting opinions are exposed to information, they are inclined to selectively use the information to arrive at conclusions that justify their prior beliefs. When confronted with information that contradicts existing views, people evaluate it with greater skepticism. Additionally, once decision makers have reached a decision, they are likely to evaluate subsequent evidence in a biased manner that supports their decision. (shrink)

Complicity consists in one person contributing to someone else's wrongdoing. But there is a diverse cluster ways of being involved in another’s wrongdoing. For a ‘diagnosis by exclusion’, we first fix the meaning of complicity in contrast to that with which it is often wrongly conflated. Literally cooperating in wrongdoing with others, for instance, is more than complicity. Each and every cooperator is actually a co-principal in the wrong jointly committed; and each bears the full responsibility, shared with all co-principals, (...) for the outcomes of that wrongdoing. Other sorts of involvement with wrongs committed by others amount to less than complicity because the involvement there is causally inert and hence does not actually contribute to the other’s wrongdoing at all. Pardoning wrongs wholly in the past may be like that. So too may be some cases of wilfully overlooking wrongs that others commit under one's very nose. Complicity is a very precise way of being involved in wrongdoing. Complicity consists in a secondary contribution of a causal (or potentially causal) sort to a wrong committed by someone else. May's theorem famously shows that, in social decisions between two options, simple majority rule uniquely satisfies four appealing conditions. Although this result is often cited in support of majority rule, it has never been extended beyond decisions based on pairwise comparisons of options. We generalize May's theorem to many-option decisions where voters each cast one vote. Surprisingly, plurality rule uniquely satisfies May's conditions. This suggests a conditional defense of plurality rule: If a society's balloting procedure collects only a single vote (...) from each voter, then plurality rule is the uniquely compelling electoral procedure. To illustrate the conditional nature of this claim, we also identify a richer informational environment in which approval voting, not plurality rule, is supported by a May-style argument. (shrink)

Informal justice often is castigated as rough justice, procedurally unauthorized and substantively unrationalized and prone to error. Yet those same features are present, to some extent, in formal justice as well: they do not form the basis for any sharp categorical contrast between formal and informal justice. Furthermore, some roughness in justice may be no bad thing. Certain of those elements of roughness in formal justice are inextricably bound up with other features of formal justice that are rightly deemed morally (...) important. Originally published in 1989 Liberal Neutrality approaches the recommendation of neutrality by confronting the abstract prescription (that we should be neutral) with the implications for particular people and institutions. This not only identifies what neutrality involves logically, but also exposes the practical difficulties that may be encountered in pursuing it. In some cases, such close examination shows that neutrality is not desirable, and in others that it is attainable only within certain limits. Although neutrality has become a fashionable term in (...) political theory, this is the only volume to subject the idea to systematic scrutiny. The VIA Classification of Character Strengths and Virtue has received substantial attention since its inception as a model of 24 dimensions of positive human functioning, but less so as a potential contributor to a psychological science on the nature of virtue. The current paper presents an overview of how this classification could serve to advance the science of virtue. Specifically, we summarize previous research on the dimensional versus categorical characterization of virtue, and on the identification of cardinal virtues. We give (...) particular attention to the three-dimensional model of cardinal virtues that includes moral, self-regulatory, and intellectual domains. We also discuss the possibility that these three clusters be treated as fundamental elements of a virtue model, meaning that they clearly and directly contribute to both individual and communal flourishing across various cultures. This discussion includes a summary of previous speculations about the evolution of adaptations underlying the human capacity for using behavioral repertoires associated with the three virtues, as well as discussing ways in which they simultaneously enhance community and individual, in the last case focusing particularly on evidence concerning mating potential. We then discuss the relationship between the evolutionary perspective on virtues and Aristotle’s concept of the reciprocity of the virtues. Finally, we provide speculations about the nature of practical wisdom. While accepting the potential value of future revisions to the VIA model, that model even under its current conditions has the potential to generate a number of intriguing and testable hypotheses about the nature of virtue. William Whewell is considered one of the most important nineteenth-century British philosophers of science and a contributor to modern philosophical thought, particularly regarding the problem of induction and the logic of discovery. In this volume, Robert E. Butts offers selections from Whewell's most important writings, and analysis of counter-claims to his philosophy.

The theme of this paper is that while there are four seemingly contradictory classes of statements in the Tao de Ching regarding moral values and the Taoist sage, these statements can be interpreted to be consistent with each other. There are statements which seemingly state or imply that nothing at all can be said about the Tao; there are statements which seemingly state or imply that all value judgements are relative; there are statements which appear to attribute moral behaviour to (...) the Taoist sage and there are statements which appear to attribute amoral or immoral behaviour to the Taoist sage. A consistent interpretation of these different statements can be found first by qualifying the assertion that the Tao is not capable of description to the less absolute assertion that nothing absolutely true can be said about the Tao; second, by arguing that the statements that appear to make all values relative refer to the correlativity of concepts, not the equality of values. Moreover, since the statements that appear to attribute moral behaviour to the sage are, by virtue of their predominance in the text, well justified and that by virtue of their paucity in the text, it is plausible to seek an alternate interpretation for the statements that seem to attribute amoral or immoral behaviour to the sage. Finally, the way in which the sage can be seen as good without attributing goodness to the Tao is by distinguishing between the way the sage appears to the observer who is outside of the Tao and the way in which the sage appears to himself. This latter distinction takes the form of the sage as appearing to display the quality of goodness in itself but not goodness for itself. (shrink)

This is the second of two chapters on preference democracy. It points out that theories of liberal democracy necessarily require systematic responsiveness to popular wishes, in ways that make them fundamentally ‘preference‐respecting’, but that there are many different kinds of preferences and correspondingly many different ways of respecting them. Different models of democracy are better at providing certain sorts of respect for certain sorts of preferences than others, and which model of democracy liberal democrats want to adopt therefore depends on (...) which sorts of preferences they want to accord which sort of respect. The central claim of this chapter is that the author's preferred model of ‘democratic deliberation within’ is preference‐respecting in the right way, and that it therefore deserves a key role in any larger system of democratic accountability. Bracket out the wrong of committing a wrong, or conspiring or colluding or conniving with others in their committing one. Suppose you have done none of those things, and you find yourself merely benefiting from a wrong committed wholly by someone else. What, if anything, is wrong with that? What, if any, duties follow from it? If straightforward restitution were possible — if you could just ‘give back’ what you received as a result of the wrongdoing to its rightful owner (...) — then matters are morally more straightforward. But in real-world cases that is often impossible, and questions of ‘how much, from whom and to whom?’ become far more vexing. The beneficiary disgorging all benefits of the wrong is part of the story, but where that is not possible or will not suffice to compensate the victim of wrongdoing we discuss various ways of allocating the cost of making the victim whole, including supplementation from public coffers. Central to Paul K. Feyerabend's philosophy of science are two theses: (1) there is no standard observation language available to science; instead, observability is to be viewed as a pragmatic matter; and (2) when considering questions of empirical significance and experimental test, the methodological unit of science is a set of inconsistent theories. I argue that the pragmatic theory of observation by itself decides neither for nor against any particular specification of meaning for an observation language; and that Feyerabend's position (...) provides no decision procedure when two contending theories share no terms having the same meaning, and thus cannot be said to be logically incompatible. Also, Feyerabend's insistence upon falsification will force him to admit that there are relatively permanent facts available to all theories, or to abandon the idea of test as falsification and to conclude that scientific theories can only be accepted or rejected on the basis of non-evidential considerations. Mechanical reductionism, which deals entirely with homogeneous variables, will constrain and enable the activities of richly heterogeneous living systems, but it cannot determine their outcomes. Such indeterminism owes to problems with dimensionality, dynamical logic, intractability, and insufficiency. The order in any living structure arises via an historical series of contingencies that were selected endogenously by stable autocatalytic processes in tandem with, and usually in opposition to, conventional external influences (natural selection). The development of living communities thereby resembles a Heraclitean dialectic (...) between processes that build up and those that tear down. Investigating this unconventional dynamic requires metaphysical assumptions that are complementary to those that have guided science over the past three centuries. The new dynamics can be represented in terms of weighted networks of interacting processes, which facilitate the statement of testable hypotheses. Network analysis thereby implements and tests ideas that heretofore could only be addressed as verbal propositions. (shrink)

This paper advances the thesis that the raw version of the butterfly dream story in the Chuang-tzu is logically untenable and should thus be replaced by a logically coherent altered version. First, it sets out the positive meaning of the butterfly dream. Second, it examines the raw version of the butterfly dream so as to point up its inherent illogicality. Third, it sets out a modified version of the butterfly dream and demonstrates its superior logicality. Fourth, it shows how conventional (...) interpretations of the butterfly dream story—the ‘confusion hypothesis’ and the ‘external endless transformation’ hypothesis—arise from the raw version and identifies basic weaknesses in the conventional interpretation options. Fifth and last, it returns to an in-depth consideration of the interpretation which arises from a re-ordering of the butterfly dream story fragments. The raw version of the story makes little sense, which is why, I propose, it has lacked a satisfactory interpretation. This thesis stands on three presuppositions. The butterfly dream story is an analogy of the enlightenment experience. The enlightenment experience, or the experience of illumination, is the phenomenological correlate of the central objective of the Chuang-tzu, that of self-transformation. And the enlightenment experience is not only the phenomenological correlate, but the essential pre-condition for self-transformation. By refashioning our (mis)interpretations of the butterfly dream story, we can more fully appreciate its transformative message. (shrink)

Philosophers who complain about the ‹demandingness’ of morality forget that a morality can make too few demands as well as too many. What we ought be seeking is an appropriately demanding morality. This article recommends a ‹moral satisficing’ approach to determining when a morality is ‹demanding enough’, and an institutionalized solution to keeping the demands within acceptable limits.
