Francesco Guala once wrote that ‘The problem of extrapolation is a minor scandal in the philosophy of science’. This paper agrees with the statement, but for reasons different from Guala’s. The scandal is not, or not any longer, that the problem has been ignored in the philosophy of science. The scandal is that framing the problem as one of external validity encourages poor evidential reasoning. The aim of this paper is to propose an alternative—an alternative which constitutes much better evidential (...) reasoning about target systems of interest, and which makes do without consideration of external validity. Economic environmental valuation remains a much debated and contested issue. Concerns have been voiced that it is unable to capture the manifold immaterial values of ecosystems due to conceptual and methodological issues. Thus, additional value categories (social values) as well as novel valuation approaches like deliberative (monetary) valuation are areas of growing interest, yet the theoretical foundations are rather weak. Against this background, this article aims to develop a consistent conceptual framework for making sense of social values in economic environmental (...) valuation. Based on a holistic view of society and individuals, the role of institutions, the social environment, culture and transcendental values is emphasised. To synthesise diverging concepts of value into an economic concept and to account for the multidimensionality of social values, the framework consists of three spheres: social, natural and contextual. The novel framework demonstrates that social values may be integrated into a preference-based utility framework when denoting a holistic understanding of social preferences and human embeddedness in nature and society. The psychedelic psilocybin has shown promise both as treatment for psychiatric conditions and as a means of improving well-being in healthy individuals. In some jurisdictions (e.g., Oregon, USA), psilocybin use for both purposes is or will soon be allowed and yet, public attitudes toward this shift are understudied. We asked a nationally representative sample of 795 US Americans to evaluate the moral status of psilocybin use in an appropriately licensed setting for either treatment of a psychiatric condition or well-being enhancement. (...) Showing strong bipartisan support, participants rated the individual’s decision as morally positive in both contexts. These results can inform effective policy-making decisions around supervised psilocybin use, given robust public attitudes as elicited in the context of an innovative regulatory model. We did not explore attitudes to psilocybin use in unsupervised or non-licensed community or social settings. (shrink)

In her excellent and comprehensive article, Friesen argues that utilising personal responsibility in healthcare is problematic in several ways: it is difficult to ascribe responsibility to behaviour; there is a risk of prejudice and bias in deciding which behaviours a person should be held responsible for; it may be ineffective at reducing health costs. In this short commentary, I will elaborate the critique of personal responsibility in health but suggest one way in which it could be used ethically. In doing (...) so, I will introduce the concepts of reasonable risk and golden opportunity. I previously argued that it is both difficult to disentangle responsibility and that we risk prejudice and bias in singling out behaviours that are socially disapproved of.1 So I am sympathetic to Friesen’s concerns. I also discussed another way in which ascribing personal responsibility for health is problematic which Friesen does not discuss and which, in my view, is the most concerning and further supports her arguments. It represents a back door assault on liberalism and neutrality towards concepts of the good life. Even if one were to accurately and in an unbiased way divine the personal contribution to disease, the greatest problem would remain: those who voluntarily take on risk would be penalised. That is, such a system would be risk-averse. Those lives which avoided risk would be prioritised, while those who chose to take on risky activities in their conception of the good life would be penalised. Yet risk is necessary, both for the good life, and social progress. Columbus, Edmund Hilary, Florence Nightingale, Ernest Hemingway and countless monumental figures in human history took risks in order to achieve something great. Should we aim for a society of trembling, teetotalling health nuts? Surely that prospect is horrific. It is horrific because it elevates health …. (shrink)

Hughes offers a consequentialist response to our rejection of accommodation of conscientious objection in medicine. We argue here that his compromise proposition has been tried in many jurisdictions and has failed to deliver unimpeded access to care for eligible patients. The compromise position, entailing an accommodation of conscientious objection provided there is unimpeded access, fails to grasp that the objectors are both determined not to provide services they object to as well as to subvert patient access to the objected to (...) services. Unpredictable future developments in drug R&D and resulting treatment and prevention options in medicine make the compromise position unrealistic. (shrink)

This paper reconstructs the merits of John Dewey’s conception of language by viewing it within the context of communication as the act of making something in common, as social and instrumental action. It shows that on the one hand this approach allows us to avoid the problems of the linguistic turn: the self-entanglement of language, the overemphasizing of language at the expense of the plurality of our world experiences, and the unquestioned, but sterile, supremacy of interpretation. On the other hand, (...) the paper supports the thesis that Dewey’s perspective on language does not produce a new form of foundationalism – according to which language itself is founded on experience, liable to be independently designated – by providing some arguments to interpret the relationship between language and experience in non-contrastive ways. In particular, the essay suggests a non-dualistic interpretation of the distinction between immediate qualitative experience and language, that is knowing in actu, by arguing that language cannot be reduced to the ordered discourse of inquiry since it also structurally includes qualitative and aesthetic aspects. One objection to embryonic stem (ES) cell research is that it ‘cannibalizes’ human beings, that is, kills some human beings to benefit others. I grant for argument’s sake that the embryo is a person. Nonetheless, killing it may be justified. I show this through the Embryonic Stem Cell Lottery. Whether killing a person is justified depends on: (1) whether innocent people at risk of being killed for ES cell research also stand to benefit from the research and (2) whether their (...) overall chances of living are higher in a world in which killing and ES cell research is conducted. This paper aims to map and highlight the diverse heritage of Pragmatism in aesthetics. It argues that pragmatist aesthetics represents an interesting third way of doing aesthetics beyond the analytic philosophy of art and continental aesthetics. It offers a first, provisional sketch of existing research trends in pragmatist aesthetics, such as somaesthetics, environmental aesthetics, everyday aesthetics, and social aesthetics. Furthermore, it identifies some “family resemblances” connecting most pragmatist “relatives” in the field of aesthetics: the idea that (1) aesthetics is broader (...) than the traditional philosophy of art, (2) the criticism of the view of art as constituting an independent realm or an autonomous system, (3) the thesis of a basic continuity between artistic practices and experience “in the raw,” (4) the adoption of a naturalistic yet non-reductive stance, and (5) a broadly socio-political inspiration. El objetivo de este texto es una aproximación teórica de la infancia en las principales concepciones de la filosofía occidental, la nueva historia social de la infancia en el continente y las principales poéticas estéticas del cine latinoamericano durante la segunda mitad del siglo XX. Para este propósito se analizan las nociones de la infancia desde trabajos con un enfoque histórico-hermenéutico, de análisis crítico de discurso y evaluación de las nociones con base en los aportes de los campos teóricos abordados. Estos cruces permiten pensar los lugares de la infancia como instrumento para lograr un sueño político, las concepciones del tiempo, los derechos liberales de la Ilustración, y el acontecimiento fenomenológico. El fin de esta revisión crítica es un llamado a tejer líneas de fuga de la historia, a recrear mecanismos de resistencia audiovisual que apueste por una estética imperfecta, que desdibuje herencias, que marque procesos sociales en los que la infancia tenga una voz auténtica. Al enfocar la imagen de la infancia resulta crucial que el cine, más allá de mostrar realidades fácticas concretas, tenga un margen de ficción que aprovecha para darnos una poética sentimental de las infancias olvidadas y reinventar la estetización de las nuevas infancias en re-existencias autónomas desde la pluralidad de miradas del continente. A contemporary orientation of the hospital experience model must encompass the clients’ religious-spiritual dimension. The objective of this paper is to share a previous experience, highlighting at least five reasons hospitals should invest in this direction, and an equal number of steps required to achieve it. In the first part, the text discourses about five reasons to invest in religious-spiritual support programs: 1. Religious-spiritual wellbeing is related to better health; 2. Religious-spiritual appreciation is a standard for hospital accreditation; 3. To (...) undo religious-spiritual misunderstandings that can affect treatment; 4. Patients demand a religious-spiritual outlook from the institution; and 5. Costs may be reduced with religious-spiritual support. In the second part, the text suggests five steps to implement religious-spiritual support programs: 1. Deep institutional involvement; 2. Formal staff training; 3. Infrastructure and resources; 4. Adjustment of institutional politics; and 5. Agreement with religious-spiritual leaders. The authors hope the information compiled here can inspire hospitals to adopt actions toward optimization of the healing experience. (shrink)

Here, a moral case is presented as to why sign languages such as Auslan should be made compulsory in general school curricula. Firstly, there are significant benefits that accrue to individuals from learning sign language. Secondly, sign language education is a matter of justice; the normalisation of sign language education and use would particularly benefit marginalised groups, such as those living with a communication disability. Finally, the integration of sign languages into the curricula would enable the flourishing of Deaf culture (...) and go some way to resolving the tensions that have arisen from the promotion of oralist education facilitated by technologies such as cochlear implants. There are important reasons to further pursue policy proposals regarding the prioritisation of sign language in school curricula. (shrink)

We look on Fernán Pérez de Guzmán as an exile not only because he lived out the last thirty years of his life in the relative seclusion of his estate in Batres; he is an exile, too, because as a poet he has long been banished from critical acclaim. For an enthusiastic view, one has to go back to the 1860s and the eulogy of the literary historian José Amador de los Ríos, according to whom Fernán Pérez's graceful didacticism deserved (...) “[el] aprecio de la verdadera crítica.” Since then, “the appreciation of true critics” has been reserved for what is now considered a canonical work of prose history, the Generaciones y semblanzas, whereas most of his poetry has been condemned for stylistic inelegance — ironically, as we shall see, one of the very qualities he seems deliberately to have cultivated. ABSTRACTThis paper examines how decisions to limit treatment to critically ill patients under uncertainty can be made rationally. Expected utility theory offers one way of making rational decisions under uncertainty. One problem with using this approach is that we may not know the value of each option. One rational course open is to treat until further information becomes available. However, treatment can limit the range of options open. With treatment, a patient may recover such that he no longer requires life‐supporting (...) treatment. However, his life may be not worth living. If active euthanasia of %on‐terminal’conditions is prohibited, the option of dying will no longer be available. Taking a rational‘wait and see’course may result in being trapped within an unbearable life. On the other hand, sometimes present practice‘lets nature takes its course'. Critically ill patients are allowed to die because it is believed that their lives will be not worth living. It is likely that some patients are allowed to die when there is some objective chance of worthwhile future life. This paper argues that a policy of treating critically ill patients until the nature of future options can be better evaluated, in company with an offer of subsequent euthanasia where appropriate, allows a more rational and humane approach to treatment limitation decisions under uncertainty. A crucially important part of the biosphere – the virosphere – is too often overlooked. Inclusion of the virosphere into the global picture of protein structure space reveals that 63 protein domain superfamilies in viruses do not have any structural and evolutionary relatives in modern cellular organisms. More than half of these have functions which are not virus‐specific and thus might be a source of new folds and functions for cellular life. The number of viruses on the planet exceeds that (...) of cells by an order of magnitude and viruses evolve up to six orders of magnitude faster. As a result, cellular species are subject to a constitutive ‘flow‐through’ of new viral genetic material. Due to this and the relaxed evolutionary constraints in viruses, the transfer of domains between host‐to‐virus could be a mechanism for accelerated protein evolution. The virosphere could be an engine for the genesis of protein structures, and may even have been so before the last universal common ancestor of cellular life. (shrink)

The article deals with the question of phenomenological ethics, comparing Husserl’s and Fink’s ways of understanding the phenomenological reduction and thereby the pedagogical tasks of phenomenology, whose existential meaning lies in the “doctrine of freedom” (“Lehre von der Freiheit”), which is in turn closely linked with the problem of the beginning of philosophizing, since the phenomenological reduction presupposes itself. A comparison between Fink’s and Patocka’s views of freedom as transcendence (expressed by the concepts of hermitry and sacrifice), as well as (...) a phenomenological reading of Nietzsche’s transvaluation of values in relation to the educational theme of the Idealbildung, will let us see how Fink’s cosmological philosophy, having its hermeneutic keystone in the phenomenon of play, still has phenomenological features and pedagogical implications, being describable as a phenomenology of freedom, whose idea of freedom as “experiment” or as man’s “self-production” presents interesting analogies with Arendt’s view of action. There is a plurality of good reasons for action. An adequate theory of practical rationality has to be compatible with it even if it requires certain modifications of our everyday practices of reasoning. Usual theories of practical rationality do not pass this test. It is envisaged how to revise adequately our understanding of practical rationality.

Più precisamente, ricostruisco come Wilhelm von Humboldt teorizzi il progresso del singolo individuo, del cittadino e del genere umano. Secondo la mia ricostruzione, l’idea humboldtiana di progresso (...) presenta un intreccio di motivi illuministi, storicisti e antirazionalisti, ed esige una riforma dello stato in senso liberale. La mia tesi è che, tuttavia, il pensiero politico di Humboldt sfoci in un conservatorismo non liberale che in quanto tale spalanca uno iato tra il sistema istituzionale auspicato e la possibilità di progresso. Der Kerngedanke der politischen Theorie des Wilhelm von Humboldt ist äußerst schlicht und übersichtlich: In seinen "Ideen zu einem Versuch, die Gränzen der Wirksamkeit des Staats zu bestimmen" heißt es, dass die Funktion des Staats auf die Erhaltung der inneren und auswärtigen Sicherheit beschränkt werden soll. Diese Staatsauffassung findet ihre Begründung in einer Anthropologie, die dem Menschen das Recht und zugleich die Aufgabe zuweist, durch das spontane Zusammenwirken mit den anderen seine Potenzialitäten zur Entfaltung zu bringen. Schlicht und übersichtlich wie (...) diese Staats- und Menschenlehre auch scheinen mag, ist es an ihr außerordentlich interessant, einerseits welche Leitgedanken ihr zugrunde liegen, und andererseits welche theoretischen Neuigkeiten sie erzielt. Hier möchte ich insbesondere vier Aspekte hervorheben: 1- Individualismus: Der Angelpunkt der gesamten Philosophie Humboldts ist das Individuum, aus dem allerdings nie ein selbstgenügsames Subjekt wird; 2- Liberalismus: Humboldt formuliert als erster den Katalog der Motive des Liberalismus des 19. Jahrhunderts; 3- Gesetzmäßigkeitsprinzip: im Sinne seiner Ausformulierung des Rechts- und Freiheitsbegriffs erarbeitet Humboldt ein Gesetzmäßigkeitsprinzip anthropologischen Charakters; 4- Legitimationsprinzip: in Anlehnung an die Prämissen, aus denen sich das neue Gesetzmäßigkeitsprinzip ergibt, setzt Humboldt ein neues Legitimationsprinzip, das unserem Begriffspaar „materielle Verfassung-formelle Verfassung“ sehr ähnelt. L’indipendenza politica dei giudici è un principio e una prassi ormai consolidata nella Germania federale. A costituire una questione ancora dibattuta è invece la critica di politicità mossa al Tribunale Costituzionale Federale. La tesi presentata in quest’articolo è che tale critica non sia comprovabile né plausibile. Non è comprovabile nel senso che non è stato possibile provare inconfutabilmente che i giudici costituzionali interpretino la Costituzione sulla base di orientamenti politici personali. Non è plausibile in quanto la nomina dei giudici avviene (...) in conformità con la proporzionale politica. La critica di politicità del Tribunale Costituzionale Federale è da attribuire piuttosto al disappunto delle parti in causa, di volta in volta deluse dalla bocciatura di una legge o dal rifiuto di un ricorso. Mit diesem Beitrag untersuch ich systematisch (1) wie der Tyrannis-Begriff in der Moderne umgedeutet wird (2) und wie die moderne Auffassung der Tyrannis mit der Aufwertung des Antagonismus zusammenhängt. Von der Antike bis zum Spätmittelalter, so meine Rekonstruktion, gilt eine Regierung als tyrannisch, wenn sie die in der Antike als normativ gesetzte und im Mittelalter als gottgegeben aufgefasste Harmonie des Gemeinwesens zerstört. Dagegen gilt in der Moderne eine Regierung als tyrannisch, wenn sie das Individuum bei oder in der Entfaltung seiner (...) Talente und Eigenschaften hindert. Diese neue Begriffsbestimmung ergibt sich aus der Aufwertung der politischen und sozialen Antagonismen als Bestandteile der menschlichen Natur und zugleich als Triebfeder des staatsrechtlichen Fortschritts. Die neuzeitliche Aufwertung des Antagonismus und das mit diesem zusammenhängende Primat der individuellen Freiheit haben zur Folge, dass vom Staat die Fähigkeit gefordert wird, die aus der Entfaltung der individuellen Freiheit entstehenden Antagonismen anzuerkennen. Erst in der Moderne wird nämlich der Anspruch zur Geltung gebracht, den staatsrechtlichen Raum so zu gestalten, dass er politische und soziale Antagonismen ohne Schmälerung der individuellen Freiheit zu regeln vermag. The subject of this paper is the increasing success of the FPÖ, the Austrian Freedom Party commonly classified as a right-wing populist party. Analyzing the possible causes of this incremental success, I especially focus on the party’s communication strategy. My thesis is that the discursive strategy of the FPÖ revolves around the unwarranted identification of persons and practices depicted as a benevolent and salvific “we” artificially set against a malevolent and dangerous “they”. This identification is unwarranted because it lacks any (...) modulation of level and logical articulation. Once thus constructed, the discursive strategy of the FPÖ includes, on one hand, the irremediable conflict of “we” and “they” and, on the other, the equalisation of “they”, so as to construct networks of guilty complicity among all subjects extraneous to the “we” represented through the leader’s will. Il tema dell'articolo è il massiccio incremento di elettori del Partito Liberale Austriaco FPÖ, comunemente classificato come partito populista di destra. La prospettiva scelta per analizzare tale successo elettorale consiste nell'esaminare la comunicazione pubblica della FPÖ. La tesi presentata è che la strategia discorsiva della FPÖ comprende da un lato la contrapposizione insanabile di un indistinto "noi" ad un altrettanto indistinto "loro" e dall’altro il livellamento del "loro" fino a costruire delle reti di colpevole complicità tra tutti i soggetti che (...) non siano il "noi" rappresentato nella volontà del capo. All'inizio degli anni '90 nella pubblicistica tedesca emerge la tendenza a decretare la fine politica dell’istituzione partito. Tipicamente, il partito viene presentato come un dinosauro della democrazia ormai incapace di assolvere alle sue funzioni tipiche o come piovra infiltratasi illegittimamente in ogni ambito della vita civile. La tesi di quest’articolo è che, al contrario, i partiti tedeschi abbiano dimostrato una forte reattività alle mutate circostanze nazionali e internazionali e che siano riusciti a mantenere il loro tipico ruolo funzionale di mediatore, (...) rappresentante ed amministratore degli interessi degli elettori. In this paper, we offer the spanish translation with notes of three treatises of Ramon Llull : Artificium electionis personarum, the chapter XXIV of book II from Llibre d’Evast, d’Aloma e de Blaquerna named «En qual manera Natana fo eleta a abadessa» and De arte electionis. These three texts show a new election technique supported on the Ars magna methods.
