In light of new threats in the field of human rights stemming from global geopolitical shifts, criminal law is facing a myriad of new challenges that require adequate responses. Given this context, it is crucial to develop and refine criminal legal measures (CLMs) in order to safeguard societal interests and maintain stability in social relations. This paper undertakes an analysis of contemporary problems in the area of legal regulation and CLMs, as well as assesses the effectiveness of CLMs for individuals (...) engaged in criminal misconduct. The research provides grounds for arguing that the absence of a clear definition of CLMs in Ukrainian legal science renders the term potentially problematic. Moreover, there are currently no taxonomic markers or criteria for classifying CLMs, nor methods for evaluating the effectiveness of specific measures. Within the framework of the announced reforms in Ukraine’s criminal law, it becomes imperative not only to revisit the concept of CLMs but also to develop robust methodologies for assessing their effectiveness. This measure appears necessary both in light of the need to legally formalize CLMs and to systematize them in the future. (shrink)

Today, there are several problems in the field of criminal law caused both by the emergence of new types of legal relations and by the imperfection of legislation. Due to the emergence of new challenges in the field of criminal law, many of them require theoretical understanding. Some of these challenges, generated in the light of the armed aggression of the Russian Federation against Ukraine, revealed several reasons for discussion in the Ukrainian and international legal community. The purpose of the (...) study involves consideration of certain aspects of modern challenges in the field of criminal-legal relations, which arose against the background of the military aggression of the Russian Federation in Ukraine. The first part of the study is devoted to the question of the qualification of war crimes committed by the Russian Federation in Ukraine as acts of genocide. The second part of the work is devoted to the issue of using existing international legal mechanisms to hold the Russian Federation accountable for war crimes. There are convincing reasons to say that the actions of the Russian Federation during the war in Ukraine have signs of the crime of genocide. Even though Ukraine is not a party to the Rome Statute, the Ukrainian government can use another tool to bring the subjects of war crimes to justice, by creating a certain mixed investigative mechanism or a criminal tribunal that could deal directly with the crime of aggression. The article is devoted to the analysis of directions and logical stages of the institutionalization of historical memory in Ukraine. As the stages of institutionalization, the author emphasizes drawing attention to "closed issues" of history from the part of the creative intelligentsia, independent researches of historians, journalistic investigations, as a result of which the society has formed a need for the restoration of justice and truth; the establishment of norms and rules for the disclosure of the content of historical memory, (...) including the declassification of archival documents, the work of exploratory expeditions in mass grave sites, the identification of new and revival of forgotten places of memory, the revision of the pantheon of national heroes, various programs for studying oral history, including the content of historical memory in textbooks of educational institutions; adoption at the legislative level of the relevant norms providing for sanctions for their non-compliance; finally, the creation of the Institute of National Memory. In this paper we explore the constraints that our preferred account of scientific representation places on the ontology of scientific models. Pace the Direct Representation view associated with Arnon Levy and Adam Toon we argue that scientific models should be thought of as imagined systems, and clarify the relationship between imagination and representation.

Science provides us with representations of atoms, elementary particles, polymers, populations, genetic trees, economies, rational decisions, aeroplanes, earthquakes, forest fires, irrigation systems, and the world’s climate. It's through these representations that we learn about the world. This entry explores various different accounts of scientific representation, with a particular focus on how scientific models represent their target systems. As philosophers of science are increasingly acknowledging the importance, if not the primacy, of scientific models as representational units of science, it's important to (...) stress that how they represent plays a fundamental role in how we are to answer other questions in the philosophy of science. The Cell Cycle Ontology (CCO) has the aim to provide a 'one stop shop' for scientists interested in the biology of the cell cycle that would like to ask questions from a molecular and/or systems perspective: what are the genes, proteins, and so on involved in the regulation of cell division? How do they interact to produce the effects observed in the regulation of the cell cycle? To answer these questions, the CCO must integrate a large amount of knowledge from (...) diverse sources; the irregularity and incompleteness of this information suggests an ontology can act as the means of this integration. The volatility and continued expansion of biological knowledge means the content and modelling of the CCO will have to be frequently changed and updated. The CCO is generated from the input data automatically once every two months. This makes it easy to change the representation to enable certain queries; incorporate new knowledge; and consistently apply design patterns across the CCO. The automatic process also allows the CCO to be delivered in a variety of representations that suit the needs of various CCO customers and the abilities of existing toolsets. In this paper we present the CCO and its characteristics of utility and flexibility, that, from our perspective, make it a beautiful ontology. (shrink)

On the face of it ‘deterministic chance’ is an oxymoron: either an event is chancy or deterministic, but not both. Nevertheless, the world is rife with events that seem to be exactly that: chancy and deterministic at once. Simple gambling devices like coins and dice are cases in point. On the one hand they are governed by deterministic laws – the laws of classical mechanics – and hence given the initial condition of, say, a coin toss it is determined whether (...) it will land heads or tails.2 On the other hand, we commonly assign probabilities to the different outcomes a coin toss, and doing so has proven successful in guiding our actions. The same dilemma also emerges in less mundane contexts. Classical statistical mechanics (which is still an important part of modern physics) assigns probabilities to the occurrence of certain events – for instance to the spreading of a gas that is originally confined to the left half of a container – but at the same time assumes that the relevant systems are deterministic. Computer simulations are an exciting tool that plays important roles in many scientific disciplines. This has attracted the attention of a number of philosophers of science. The main tenor in this literature is that computer simulations not only constitute interesting and powerful new science, but that they also raise a host of new philosophical issues. The protagonists in this debate claim no less than that simulations call into question our philosophical understanding of scientific ontology, the epistemology and semantics of models (...) and theories, and the relation between experimentation and theorising, and submit that simulations demand a fundamentally new philosophy of science in many respects. The aim of this paper is to critically evaluate these claims. Our conclusion will be sober. We argue that these claims are overblown and that simulations, far from demanding a new metaphysics, epistemology, semantics and methodology, raise few if any new philosophical problems. The philosophical problems that do come up in connection with simulations are not specific to simulations and most of them are variants of problems that have been discussed in other contexts before. There are two theoretical approaches in statistical mechanics, one associated with Boltzmann and the other with Gibbs. The theoretical apparatus of the two approaches offer distinct descriptions of the same physical system with no obvious way to translate the concepts of one formalism into those of the other. This raises the question of the status of one approach vis-à-vis the other. We answer this question by arguing that the Boltzmannian approach is a fundamental theory while Gibbsian statistical mechanics is an (...) effective theory, and we describe circumstances under which Gibbsian calculations coincide with the Boltzmannian results. We then point out that regarding GSM as an effective theory has important repercussions for a number of projects, in particular attempts to turn GSM into a nonequilibrium theory. (shrink)

A gas prepared in a non-equilibrium state will approach equilibrium and stay there. An influential contemporary approach to Statistical Mechanics explains this behaviour in terms of typicality. However, this explanation has been criticised as mysterious as long as no connection with the dynamics of the system is established. We take this criticism as our point of departure. Our central claim is that Hamiltonians of gases which are epsilon-ergodic are typical with respect to the Whitney topology. Because equilibrium states are typical, (...) we argue that there follows the desired conclusion that typical initial conditions approach equilibrium and stay there. (shrink)

In two recent papers Barry Loewer (2001, 2004) has suggested to interpret probabilities in statistical mechanics as Humean chances in David Lewis’ (1994) sense. I first give a precise formulation of this proposal, then raise two fundamental objections, and finally conclude that these can be overcome only at the price of interpreting these probabilities epistemically.

Gibbsian statistical mechanics (GSM) is the most widely used version of statistical mechanics among working physicists. Yet a closer look at GSM reveals that it is unclear what the theory actually says and how it bears on experimental practice. The root cause of the difficulties is the status of the Averaging Principle, the proposition that what we observe in an experiment is the ensemble average of a phase function. We review different stances toward this principle, and eventually present a coherent (...) interpretation of GSM that provides an account of the status and scope of the principle. (shrink)

Consider a gas that is adiabatically isolated from its environment and confined to the left half of a container. Then remove the wall separating the two parts. The gas will immediately start spreading and soon be evenly distributed over the entire available space. The gas has approached equilibrium. Thermodynamics (TD) characterizes this process in terms of an increase of thermodynamic entropy, which attains its maximum value at equilibrium. The second law of thermodynamics captures the irreversibility of this process by positing (...) that in an isolated system such as the gas entropy cannot decrease. The aim of statistical mechanics (SM) is to explain the behavior of the gas and, in particular, its conformity with the second law in terms of the dynamical laws governing the individual molecules of which the gas is made up. In what follows these laws are assumed to be the ones of Hamiltonian classical mechanics. We should not, however, ask for an explanation of the second law literally construed. The article explores specificities of thematization of science and scientific rationality in Martin Heidegger’s fundamental ontology. This analysis focuses on the concept of scienticity, character- istic for Heidegger’s “early” line of thought, as well as continuation and divergence of exposition of “science” and the nature of “theoretical attitude” as the subject of interpretation of transcen- dental phenomenology of E. Husserl. This research places an emphasis on particularity of Hei- degger’s explication of existential concept of science as opposed to prevailing logico-epistemolog- (...) ical philosophy of science, and foundation of thematization of scientific “subject matters” and theoretical attitude upon the universe of ontological understanding of being of entities (regional ontologies). It also focuses on Heidegger’s assertion of fundamental ontological projection in a status of a peculiar “science of knowledge”, which gives ground for a priori pre-conditions of specific sciences. Separate attention is paid to a specifically Heideggerian approach to explication of the rooting of initial scientific orientation in the sphere of pre-scientific experience, which ar- ticulates itself in so called “fundamental concepts”, as well as positioning of contemplative ‘present-at-hand’ paradigm of theoretical knowledge as a derivative modus of a primary use of ‘ready-to-handness’ as a phenomenological founding basis of everydayness’ experience. The author came to the attention that scientific knowledge is a project Dasein. It is within the framework of self-design that Dasein thematizes what happens to another region of being that is the subject of scientific knowledge. In other words, making things available in researching, applying themes, provided that the design allowed late as the systematic development of the most modern buildings, such as is done in the world, and possibly everyday greeting improvised performance. This volume is a serious attempt to open up the subject of European philosophy of science to real thought, and provide the structural basis for the interdisciplinary development of its specialist fields, but also to provoke reflection on the idea of ‘European philosophy of science’. This efforts should foster a contemporaneous reflection on what might be meant by philosophy of science in Europe and European philosophy of science, and how in fact awareness of it could assist philosophers interpret and motivate (...) their research through a stronger collective identity. The overarching aim is to set the background for a collaborative project organising, systematising, and ultimately forging an identity for, European philosophy of science by creating research structures and developing research networks across Europe to promote its development. In this second part about modelling climate change, the topics of climate modelling, confirmation of climate models, the limits of climate projections, uncertainty and finally model ensembles will be discussed.

Physical information is a property of nature. How does physical information persist over time? Does it do so as an object, process, or event, which are things considered in the current persistence theories? Physical information is none of these, however, this implies that persistence theories cannot explain the persistence of information. We therefore study the persistence of snowflakes, ephemeral natural structures, to better understand the persistence of natural things, such as physical information. The transitory nature of snowflakes suggests that physical (...) information persists as nature’s latent order, therefore, it is associated with natural structures, but it is not identical to them. This interpretation preserves the properties attributed to physical information, particularly its foundational character. The concept of physical information as latent order accords with Burgin’s General Theory of Information (GTI), which is currently the most comprehensive conceptualization of information that has been proposed. Prior studies using the event-related potential (ERP) technique show that integrating sentential code-switches during online processing leads to a broadly distributed late positivity component (LPC), while processing semantically unexpected continuations instead leads to the emergence of an N400 effect. While the N400 is generally assumed to index lexico-semantic processing, the LPC has two different interpretations. One account suggests that it reflects the processing of an improbable or unexpected event, while an alternative account proposes sentence-level reanalysis. To investigate the relative costs (...) of semantic to language-based unexpectancies (i.e., code-switches), the current study tests 24 Spanish-English bilinguals in an ERP reading study. Semantically constrained Spanish frames either varied in their semantic expectancy (high vs. low expectancy) and/or their language continuation (same-language vs. code-switch) while participants’ electrophysiological responses were recorded. The Spanish-to-English switch direction provides a more naturalistic test for integration costs to code-switching as it better approximates the code-switching practices of the target population. Analyses across three time windows show a main effect for semantic expectancy in the N400 time window and a main effect for code-switching in the LPC time window. Additional analyses based on the self-reported code-switching experience of the participants suggest an early positivity linked to less experience with code-switching. The results highlight that not all code-switches lead to similar integration costs and that prior experience with code-switching is an important additional factor that modulates online processing. Looking into the future is always a risky endeavour, but one way to anticipate the possible future shape of AI-driven societies is to examine the visionary works of some sci-fi writers. Not all sci-fi works have such visionary quality, of course, but some of Stanisław Lem’s works certainly do. We refer here to Lem’s works that explore the frontiers of science and technology and those that describe imaginary societies of robots. We therefore examine Lem’s prose, with a focus on the (...) Cyberiad stories, to see what challenges our future technological societies may face when they entrust their lives to AI technology. For example, what questions should we ask, and what questions do we forget to ask, when developing AI systems and allowing these systems to control our lives. The technologically honed minds of our current technocrats are perhaps too limited to guide us into this future, because AI-based technology is relatively unchartered territory, as any new, complex technology is by nature. Lem’s visions of future societies oriented around AI and robotics portray AI technology in a deeper and more nuanced way than the current technological visions offered by our leading technological prophets. Based on Lem’s visions, what is to come may not turn out to be an AI-driven nirvana. (shrink)

The concept of information can be viewed from two perspectives, namely epistemic and ontological. In the epistemic view, information is associated with meaning, semantics, and knowledge, while in the ontological view, it is understood as structures and forms of objects. Information is most often perceived as epistemic information, yet a closer look at epistemic information reveals that this concept does not account for ontological information. This paper poses the following question: Should we select epistemic or ontological information as our primary (...) concept of information, or should we acknowledge that both kinds of information are required for a full comprehension? The discussion here is supported by references to modern research in physics, computing, cosmology, and information sciences. (shrink)

The stereotype content model defines warmth and competence as basic dimensions of social judgment, with warmth often dominating perceptions; it also states that many group-related stereotypes are ambivalent, featuring high levels on one dimension and low levels on the other. Persuasion theories feature both direct and indirect source effects. Combining both the approaches, we studied the persuasiveness of ambivalently stereotyped sources. Participants read persuasive arguments attributed to groups stereotyped as either low in competence but high in warmth or vice versa. (...) In Study 1, high competence/low warmth sources were more persuasive than low competence/high warmth sources. In Study 2, this pattern replicated when an accuracy motive had been induced, whereas it reversed when a connectedness motive had been induced. These source effects were direct, that is, independent of message processing. We discuss our findings in terms of the persuasiveness of warmth vs. competence of the source as being dependent on recipient motivation; we also consider theoretical implications and perspectives for future research. Presented here is a review of the book by Michael Wooldridge The Road to Conscious Machines: The Story of AI. The book was published in 2021 by Pelican Publishing Company. The book presents a philosophical exploration of the AI-related quest to understand the essence of our minds, ethics, and consciousness. Nonetheless, the book is unconventional as it focuses on failures of past AI programs rather than on AI success stories. The author also indicates the possible pathways to develop new, more (...) efficient AI paradigms. The short technical section at the end of the book offers more in-depth information on topics like Prolog, Bayesian, and deep neural networks. (shrink)

The aim of this paper is two-fold. Recently, Lewis has presented an argument, now known as the `counting anomaly', that the spontaneous localization approach to quantum mechanics, suggested by Ghirardi, Rimini, and Weber, implies that arithmetic does not apply to ordinary macroscopic objects. I will take this argument as the starting point for a discussion of the property structure of realist collapse interpretations of quantum mechanics in general. At the end of this I present a proof of the fact that (...) the composition principle, which holds true in Standard Quantum Mechanics, fails in all realist collapse interpretations. On the basis of this result I reconsider the counting anomaly and show that what lies at the heart of the anomaly is the failure to appreciate the peculiarities of the property structure of collapse interpretations. Once this flaw is uncovered, the anomaly vanishes. (shrink)

We argue that the Internet is, and is acting as, an EA because it shapes our belief systems, our worldviews. We explain key concepts for this discussion and provide illustrative examples to support our claims. Furthermore, we explain why recognising the Internet as an EA is important for Internet users and society in general. We discuss several ways in which the Internet influences the choices, beliefs, and attitudes of its users, and we compare this effect with those of psychological conditioning (...) and brainwashing techniques. Finally, we present examples where the Internet’s epistemic agency acts at scale, affecting large portions of society rather than individuals. (shrink)

The functional approach to natural language (FANL) emerged in the late 1960s. It focused on the use and the sub-use of language expressions, taking into account role of the language context and the extra-linguistic situation of a given statements. This approach referred, both conceptually and methodologically, to the tradition of British analytical philosophy of language on the one hand, and to the achievements of the Lvov-Warsaw School on the other. It seems that despite the passage of more than half a (...) century since its inception, this approach has lost nothing of its relevance and its cognitive value, and may even provide inspiration for the exploration new research areas concerning the formulation of language utterances. The aim of this article is to show the potential applications of the FANL as a specific semiotic concept in the field of the philosophy of social sciences. The paper points out how the functional conception can be successfully used in methodological analyses of the logical methodology of social sciences. The case studies presented in the article refer to the research practice of social sciences. Examples of the use and sub-uses of terms are discussed in the light of the polyparadigmatic structure of social sciences and the differences in research patterns accepted by given scientific collectives.
