few areas of public policy have been fraught with as much controversy as bioethics. Each novel development in biomedical technology seems to spark rancorous disputes. Those averse to new technologies often express the concern that the new technology is 'unnatural' or requires us to 'play God'. Slogans such as 'Frankenfoods' and 'sanctity of life' substitute for reasoned argument. This is an ambitious book that seeks to reframe the debates surrounding current controversies in bioethics. Carefully examining and dissecting claims made by (...) many policy-makers and ethicists on topics such as assistance in dying, genetic engineering, and embryonic stem cell research, bioethicist Ronald A Lindsay shows that all too often these claims are based on instinctive reactions, beliefs that lack factual support, and religious or ideological dogma. After describing in detail the proper way to approach and resolve a dispute in bioethics, Lindsay proceeds to analyse several different cutting-edge issues. Through his insightful analysis, Lindsay demonstrates how to achieve pragmatic, progressive solutions to these controversies. This work develops an approach to the emotions suitable for addressing issues in moral psychology. It tries to answer two questions: What is an emotion? What are the functions of emotion? The proposed theory is based in part on the Cartesian theory of the passions and is developed within the framework of a functionalist analysis of mental states. Its central claims are: that an emotional state involves a person being affected in typical ways; that 'being affected emotionally' involves tendencies: to (...) be preoccupied with, or have one's attention focused on, the object of emotion; to overevaluate the object of emotion, where this overvaluation is relative to one's nonemotional beliefs; 'mental' feelings which are aspects of intentional states like evaluations and desires. ;The work contains six chapters. The first discusses sceptical doubts about the possibility of a general theory of emotion and suggests a way of drawing a distinction between emotions and attitudes. The second chapter considers a traditional analysis of BAE--the so-called feeling theory of emotion--and three standard objections to that theory. The chapter goes on to investigate a contemporary approach, the 'comprehensive theory of emotion' , which seeks to avoid these objectives. CT, endorsed by William Alston and William Lyons , is an amalgam of the cognitive view and the feeling theory; it analyses an emotion in terms of several casually related components: evaluative beliefs, desires, physiological changes and bodily sensations. ;Chapter Three offers a critique of CT, on the grounds that CT's explanation of emotional action is inadequate. CT analyses BAE in terms of bodily changes and sensations, but these components of emotion have no central role in causing action; rather CT holds that the evaluational and appetitive aspects of emotion give rise to action. This account, it is argued, underestimates the degree to which emotional action is frequently unreasonable or irrational, and severs the intuitive link between BAE and action. ;The remaining chapters develop a neo-Cartesian theory as an alternative to CT. Chapter Four defends Descartes' theory of the passions against traditional objections, and shows how two aspects of emotion he discusses--focus of attention and overvaluation--offer a more promising explanation of emotional action. Chapter Five explores the relation between feelings and emotions, and argues that many emotions essentially involve 'mental' pain or pleasure. In Chapter Six some consideration is given to the implications of the proposed theory for moral issues, and it is suggested that commonly held views on responsibility for emotions and the value of the emotional life bear re-examination. : There is a concern that genetic engineering will exacerbate existing social divisions and inequalities, especially if only the wealthy can afford genetic enhancements. Accordingly, many argue that justice requires the imposition of constraints on genetic engineering. However, it would be unwise to decide at this time what limits should be imposed in the future. Decision makers currently lack both the theoretical tools and the factual foundation for making sound judgments about the requirements of justice in a genetically transformed society. (...) Moreover, focusing on the uncertain inequities of the future may result in failure to give priority to more pressing inequities of the present. Especially in a country that recently has enacted tax legislation that will widen existing wealth disparities, concern about the distant threat of a genetic aristocracy appears misplaced. (shrink)

: Common morality theory must confront apparent counterexamples from the history of morality, such as the widespread acceptance of slavery in prior eras, that suggest core norms have changed over time. A recent defense of common morality theory addresses this problem by drawing a distinction between the content of the norms of the common morality and the range of individuals to whom these norms apply. This distinction is successful in reconciling common morality theory with practices such as slavery, but only (...) at the cost of underscoring the limits of common morality theory, in particular its inability to resolve disputes about the moral status of entities. Given that many controversies in bioethics center on the disputed status of various entities, such as embryos and nonhuman animals, this is an important limitation. Nonetheless, common morality theory still can be a useful resource in diminishing moral conflict on issues that do not involve disputes over moral status. (shrink)

Lindsay (bio)Throughout 2005, the morbid joke on Capitol Hill was that the twin inevitabilities of "death and taxes" had been replaced by "death politics and taxes." There seemed to be some truth in this observation given the highly publicized intervention by some members of Congress in the Schiavo case and the continuing controversy over government regulation of end-of-life care. The (...) Supreme Court's recent decision in Gonzales v. Oregon (74 U.S.L.W. 4068 (17 January 2006)) has resolved one of the critical issues relating to this controversy by holding that a physician may prescribe controlled substances to provide assistance in dying if such a practice is authorized by state law and not expressly prohibited by federal law. However, other issues remain. In fact, the Court's decision has underscored some of the reasons why there is not only continuing controversy over end-of-life care, but also over other aspects of the practice of medicine. First, it is apparent there is no consensus among health care professionals about the precise boundaries of the legitimate practice of medicine. Second, the regulation of the practice of medicine traverses ill-defined legal territory. In particular, there is significant uncertainty concerning the implications of some regulations as well as the allocation of regulatory authority between and within state and federal governments. This uncertainty leaves substantial room for political maneuvers.Before discussing the politics of medicine, it is worth looking at the regulation of controlled substances in some detail both because this review will provide the necessary background for understanding the ruling in Gonzales v. Oregon and because it will illustrate the uncertainty resulting from multiple sources of regulatory authority.Federal and State Regulation of Controlled SubstancesSince the Pure Food and Drug Act of 1906, the federal government has regulated certain aspects of the distribution and administration of drugs deemed susceptible to abuse. The current primary vehicle for federal regulation is the Comprehensive Drug Abuse Prevention and Control Act, enacted in 1970, of which Title II is known as the Controlled Substances Act (CSA) (21 U.S.C. § 801 et seq.). A [End Page 99] "controlled" substance is just that, a substance that is regulated under the CSA. The CSA classifies controlled substances in five categories or schedules based on their potential for abuse, their accepted medical use, and the risks associated with their use under medical supervision. Schedule I substances have a high potential for abuse and have no currently accepted use in medical treatment. Schedule II-V substances are approved for medical use but are subject to a descending hierarchy of restrictions on their use. To give a lawful prescription for a controlled substance, a physician must be registered with the appropriate federal agency, currently the Drug Enforcement Administration (DEA). Moreover, to be valid, such a prescription must be issued for "a legitimate medical purpose" (21 U.S.C. § 830(b)(3)(A)(ii)).There is little dispute that the primary purposes of the CSA are to control drug abuse and to eliminate illicit trafficking in drugs. In accomplishing these objectives, there is a division of responsibility among various federal agencies, in particular the Department of Health and Human Services and the Department of Justice. Of particular relevance to the controversy in Gonzales v. Oregon is the Attorney General's authority to revoke a physician's registration for prescribing controlled substances if the physician's registration would be inconsistent with the public interest.All 50 states have their own statutes and regulations that address various aspects of the distribution and administration of controlled substances. Most states have adopted versions of the model Uniform Controlled Substances Act, which largely mimics federal law, but several states have placed additional restrictions on a physician's ability to prescribe controlled substances, including time limits on the validity of a prescription and limits on the quantity of a drug that can be prescribed. States are the primary, but by no means the exclusive, source of regulation of medical practice in general. This paper presents an algorithm for analyzing social situations within a robot. We contribute a method that allows the robot to use information about the situation to select interactive behaviors. This work is based on interdependence theory, a social psychological theory of interaction and interpersonal situation analysis. Experiments demonstrate the utility of the information provided by the situation analysis algorithm and of the value of this method for guiding robot interaction. Delaware case law has rendered the tender offer obsolete as a method for purchasing a company whose directors oppose the acquisition. A potential acquirer facing target opposition today must run an insurgent director slate, in the expectation that its directors are more likely to sell. The Delaware courts have not justified their preference for elections over markets as the preferred vehicle for implementing changes in control. Informal scholarly analyses ask transaction cost questions, such as whether proxy contests are more costly (...) than takeovers. This article attempts to break new ground by asking whether there are systematic differences in the performance of elections and markets in the corporate context. Recent models of voting processes, we argue, strongly suggest that elections are inferior to markets. Proxy contest elections sometimes can be won by incumbent managements when a transfer of control would be efficient, a conclusion consistent with the sparse data; and the proxy election process aggregates information regarding the sale decision less well than markets do, thereby implying that proxy voters are less well-informed. Theory and data thus suggest, at the least, that the intellectual burden of proof should change: the task now is to justify using elections to transfer control despite their apparent deficiencies. For two decades, egalitarian analytical philosophers have sought to identify the metric to be employed in order to ascertain whether any distribution is equal or not. This essay provides a review of the seminal contributions to this debate by Amartya Sen, Ronald Dworkin, Richard Arneson and G.A. Cohen.

Although "the Socratic method" is commonly understood as a style of pedagogy involving cross-questioning between teacher and student, there has long been debate among scholars of ancient philosophy about how this method as attributed to Socrates should be defined or, indeed, whether Socrates can be said to have used any single, uniform method at all distinctive to his way of philosophizing. This volume brings together essays by classicists and philosophers examining this controversy anew. The point of departure for many of (...) those engaged in the debate has been the identification of Socratic method with "the elenchus" as a technique of logical argumentation aimed at refuting an interlocutor, which Gregory Vlastos highlighted in an influential article in 1983. The essays in this volume look again at many of the issues to which Vlastos drew attention but also seek to broaden the discussion well beyond the limits of his formulation. Some contributors question the suitability of the elenchus as a general description of how Socrates engages his interlocutors; others trace the historical origins of the kinds of argumentation Socrates employs; others explore methods in addition to the elenchus that Socrates uses; several propose new ways of thinking about Socratic practices. Eight essays focus on specific dialogues, each examining why Plato has Socrates use the particular methods he does in the context defined by the dialogue. In 1980, Ronald Reagan was elected President of the United States for his first term and the conservative revolution that was slowly developing in the United States finally emerged in full-throated roar. Who provoked the conservative revolution? Shadia Drury provides a fascinating answer to the question as she looks at the work of Leo Strauss, a seemingly reclusive German Jewish emigré and scholar, who was one of the most influential individuals in the conservative movement, a man widely seen as (...) the godfather of the Republican party’s failed “Contract With America.” Among his students were individuals such as Alan Bloom, author of The Closing of the American Mind. Strauss influenced the work of Irving Kristol, Gertrude Himmelfarb and William Kristol, as well as Chief Justice Clarence Thomas and Speaker of the House Newt Gingrich. Drury delves deeply into Strauss’s work at the University of Chicago where he taught his students that, if they truly loved America, they must save her from her fateful enchantment with liberalism. Leo Strauss and the American Right is a fascinating piece of work that anyone interested in understanding our current political situation will want to read. (shrink)

The use of idealizations and approximations in scientific explanations poses a problem for traditional philosophical theories of confirmation since, strictly speaking, these sorts of statements are false. Furthermore, in several central cases in the history of science, theoretical predictions seen as confirmatory are not, in any usual sense, even approximately true. As a means of eliminating the puzzling nature of these cases, two theses are proposed. First, explanations consist of idealized deductive-nomological sketches plus what are called modal auxiliaries, i.e., arguments (...) showing that if the idealizations used in the initial conditions are improved, then there will be an improvement in the prediction. Second, a theory is confirmed if it can be shown that its idealized sketches can be improved; similarly, a theory is disconfirmed if its idealized sketches cannot be improved. Several examples are given to illustrate both confirmation and disconfirmation achieved by means of the modal auxiliary. These cases are compared with Scriven's bridge example. (shrink)

What is new here is the detailed discussion of several important results in the classical foundations of mathematics and of the relation of logic to mathematics. As regards logical questions, the central thesis of Wittgenstein's later philosophy is well known, both from the earlier posthumous volume and from the writings of his many disciples. In the Investigations the thesis is applied to the "logic of our expressions" in everyday contexts; here he discusses in the same spirit the more specialized language (...) used in talking about the foundations of mathematics. Abstract:McMahan, Nussbaum, and Johannsen have recently suggested that humans should seek to eliminate predators from the wild or avoid reintroducing them if this can be done without great harm to an ecosystem. This is because predators cause a great deal of pain to those sentient animals which are their prey. This paper will first challenge the pragmatic aspects of such a position on the global level, arguing that it would be extremely difficult if not impossible to remove predators from the (...) environment without doing great ecological harm. Because removal of predators might be considered more feasible on the micro scale this paper will go on to challenge the axiological foundations of such a view. In particular defenders of the removal of predators from the environment tend to base their position on the preferencing of the disvalue of pain over the value of life. Yet if life itself has value it can be a good even with those beings that cause pain to others. Moreover, there is a value to diverse forms of life that must also be acknowledged. An ecosystem with diverse habits and life forms exercising different ways of being has great value even if again this comes at the cost of suffering and pain to some of the creatures in it. Once these things are understood it is clear that predators should not be eliminated from the wild and indeed should be reintroduced into ecosystems where they once flourished. (shrink)

A vast literature has developed probing the law's aversion to statistical/probability evidence in general and its rejection of naked statistical evidence in particular. This literature rests on false premises. At least so far as US law is concerned, there is no general aversion to statistical forms of proof and even naked statistics are admissible and sufficient for a verdict when the evidentiary proffer meets the normal standards of admissibility, the most important of which is reliability. The belief to the contrary (...) rests upon a series of mistakes: most importantly, mismodeling of the structure of legal systems and the nature of common law decision making. Contributing to these mistakes is the common methodology in this literature of relying on weird hypotheticals that mismodel the underlying legal relations and contain impossible epistemological demands. Collectively, these phenomena have distracted attention from issues that actually affect real legal systems. (shrink)

In The Ultimate Betrayal: Is There Happy Meat?, Bohanec (2013) proposed that farmed animals raised humanely may experience betrayal when slaughtered. I argue based on personal experience that humans often betray trust relationships with farmed animals. Using published scientific literature, I find that typical farmed animals (mammals) and farmed fishes are both cognitively capable of a rudimentary experience of betrayal. However, the manner in which fishes are typically maintained does not present opportunities for human-fish trust relationships to develop. Eating farmed (...) fishes presents fewer ethical implications than eating cows, at least in some cases. (shrink)

The purpose of this book is to call the separation of reason and religion into question.

Discourse around assisted colonization focuses on the ecological risks, costs, and uncertainties associated with the practice, as well as on its technical feasibility and alternative approaches to it. Nevertheless, the ethical underpinnings of the case for assisted colonization are claims about the value of species. A complete discussion of assisted colonization needs to include assessment of these claims. For each type of value that species are thought to possess it is necessary to determine whether it is plausible that species possess (...) the type of value and, if so, to what extent their possessing it justifies assisted colonization. I conducted such an assessment for each of the predominant types of value ascribed to species: ecological, instrumental (including option value), existence, and intrinsic value (including interest‐based, objective, and valuer‐dependent intrinsic value). The vast majority of species, including several that have been proposed as candidates for assisted colonization, have much less value than is often presumed. Moreover, with respect to some types of value, assisted colonization would not fully preserve the value of the target species even if it were to keep the target species in existence. Therefore, the case for assisted colonization is significantly weaker and more qualified than its advocates often suppose. There may be exceptional species for which assisted colonization is well justified—and for this reason, case‐by‐case assessment is necessary—but in general the burden of justification generated by the ecological risks associated with assisted colonization is not met by the value potentially preserved by assisted colonization. This suggests that assisted colonization ought to have, at most, a very minor role in the portfolio of ecosystem management practices, even as it pertains to species conservation under conditions of rapid climate change.
