Fas Ahvâl-i Şahsiyye Kanunu üzerinde 2004 yılında yapılan reformlarla birlikte Fas Aile Kanunu (Müdevveneh), İslam dünyasındaki en eşitlikçi kanunlardan biri olarak kabul edilmektedir. Söz konusu reformlar, Fas'ta onlarca yıldır devam eden uzun soluklu kamuoyu tartışmalarının bir ürünü olarak ortaya çıkmıştır. Ahmed el-Hamlîşî 1980'lerin başından itibaren bu tartışmalara aktif olarak katılmış ve Ahvâl-i Şahsiyye Kanunu'nun yoruma açık insan yapımı bir kanun olduğunu ve revizyonunun ictihad yoluyla yapılması gerektiğini savunmuştur. Kral 6. Muhammed tahta çıktıktan kısa bir süre sonra, 2001 yılında, Fas Ahvâl-i (...) Şahsiyye Kanunu'nda reform yapmak üzere Kraliyet Danışma Komisyonu'nu oluşturdu. Kral 6. Muhammed komisyonu, Şeriat'ın temel hedeflerini (makâsıdü'ş-Şeria) gözeterek ve aynı zamanda ictihad yoluyla zamanın ve toplumun ihtiyaçlarına cevap vererek Ahvâl-i Şahsiyye Kanunu’nda önemli değişiklikler yapmakla görevlendirdi. Bununla birlikte, komisyon üyelerini kamu yararını göz önünde bulundurmaya ve önerilen her türlü değişiklikte uzlaşma ve ılımlılık için çaba göstermeye teşvik etti. Komisyon üyeleri önerilen değişiklikler üzerinde yaklaşık iki buçuk yıl çalıştı ancak birçok konuda uzlaşmaya varamadı. Bu bağlamda, üyelerin komisyon içinde oluşan iki ana gruptan reformist ve gelenekçilerden birine, az ya da çok, meylettiği söylenebilir. Ahmed el-Hamlîşî, Kraliyet Danışma Komisyonu'nun üyelerinden biriydi. Komisyon üyeleri arasında reformist grubun değişiklik tekliflerini destekleyen ama aynı zamanda bunu gelenekçilerin benimsediği dili kullanarak yapan etkili ve önemli bir isim oldu. Nitekim, el-Hamlîşî İslam hukuku çerçevesi içinde kalan eleştirel ama ılımlı görüşleriyle aile hukukunun reformunu talep eden gruplar için bir referans noktası haline geldi. Bu çalışmada, Ahmed el-Hamlîşî’nin fıkhi temellendirme ve delillendirme açısından Fas 2004 aile hukuku reformlarının arkasındaki isim olduğu savunulmaktadır. Veri analizi yönteminin uygulandığı bu çalışmada, öncelikli olarak Hamlîşî'nin eserleri, çeşitli mecralardaki mülakatları ve konuşmaları kullanılmıştır. Hamlîşî’nin anlayışındaki farklılık ve benzerlikleri ortaya çıkarmak için literatüre başvurulmuş ve benzer görüşlerle karşılaştırmalar yapılmıştır. Fas Ahvâl-i Şahsiyye Kanunu’nun reformuna dair kısa bir arka plan açıklamasının ardından bu makale, Hamlîşî'nin metin ve bağlam arasındaki arabulucu rolünü, aile hukuku reformları tartışmasındaki yerini ve dolayısıyla Şeriat-devlet ilişkileri konusundaki duruşunu incelemektedir. Daha sonra, ictihad kapısının kapanması meselesi, müctehid olabilmenin şartları, müctehidin nitelikleri ve Kraliyet Danışma Komisyonu tarafından uygulandığı şekliyle kolektif ictihad türü (cemâʿî ictihad) hakkındaki görüşlerine atıfla Hamlîşî’nin ictihad anlayışına odaklanılmaktadır. Son olarak, Hamlîşî'nin akıl yürütme yöntemi ve ortaya koyduğu gerekçeler aile hukuku ile ilgili meseleler örnekliğinde gösterilmektedir. (shrink)

In particular, the Basra School of Muʿtazila has given the emphasis on tab' theory emphasizing the freedom of man. They have implemented the tab ' theory to a number of topics related to knowledge, action, metaphysical, moral and Spiritual life. The nature, which is defended by Muʻtezile, is a force that Allah places in the nature of man and body. Nature, which is in the essence of both living and inanimate substances, is not independent of Allah. It has caused some problems defending some scholars, such as Muammer and Câhız from Basra School of Muʿtazila the idea of compulsory natural causality in the interpretation of some metaphysical subjects. In this regard, The scholars of Muʿtazila such as Nazzâm and Kâdî Abdülcebbâr, have acted more carefully. While Nazzâm does not see the theory of natural nature independently of divine power, he prefers to use the word "itimat" instead of the tab ' theory ', which he sees as part of pagan culture. History works written in the style of chronicles are used not only for the purpose for which they were written. Chronic works may also contain reflections on the position of the ulema (ʿulamāʾ) at the time of its writing and his view of the scientific world of the period in which he lived. This work is based on the book ʿIqd al-jumān fī taʾrīkh ahl al-zamān written by the celebrated Ḥanafī jurist (faqīh) and muḥaddith Badr al-Dīn al-ʿAynī as a public (...) history book. This article, focuses on the state of ḥadīth science and scholars in the Mamlūks between the years 648-707 (1250-1307) and approaches of al-ʿAynī to these issues based on the work of ʿIqd al-jumān. For this purpose, the work has been examined in terms of certain keywords that allude to the history of ḥadīth through electronic sources. In addition, the work has been completely reviewed with the traditional method in terms of allusions and information about the hadith studies of the Mamlūks period. Eventually, the historical elements of ḥadīth referred to in ʿIqd al-jumān, scientific institutions, different groups of rāwī, different narration methods and classifications made during the period have been identified. In addition, the professional, sectarian and political trends of the muḥaddith of the period in question were focused on. Comparing the information in the sources written in the field of general history with the studies focusing directly on the historical elements of ḥadīth will contribute to compare the similarities and divergences. This study is an example of how to make use of the wafayāt sections in chronicle works. Examining a single book that was not written directly in the field of ḥadīth - even if it contains important information - is not enough to find elements about the history of ḥadīth and to make constructions regarding it. This necessitates the formation of a team that will examine a large number of books using the same criteria. (shrink)

Nietzsche, 19.yy Alman filozofu, edebiyatçı, müzisyen, dilbilimci ve kültür eleştirmeni olup, modern Arap edebiyatı alanında en çok tanınan isimlerinden biri edebiyatçı, ressam, şair ve filozof Cibrân Halil Cibrân olmuştur. Edebiyatla felsefeyi bir araya getiren Cibrân’ın yazım hayatı üç evreye ayrılmaktadır. Toplumsal konularla ilgilendiği ilk dönem, şüphe ve başkaldırıyı içine alan ikinci evre ve zihin olgunlaşmasına erişip daha barışçıl düşüncelere geçtiği üçüncü evredir. Cibrân, Nietzsche’yi benimseyip, onun düşünceleriyle kendini özdeşleştirdiği ikinci evrede, Ermiş adlı eserini kaleme almıştır. Ermiş adlı çalışma konu ve (...) düşünsel bağlamda Böyle Buyurdu Zerdüşt ile oldukça benzerlik göstermektedir. Çalışmada da din, ahlak, kültür, felsefe ve bilim üzerine eleştirel yazılar yazan Alman filozof Friedrich Wilhelm Nietzsche’nin Also Sprach Zarathustra orijinal adıyla kaleme aldığı Böyle Buyurdu Zerdüşt adlı eseri, Modern Arap edebiyatında büyük bir dönemin başladığı Mehcer edebiyatının en önemli yüzü olan Cibrân Halil Cibrân’ın The Prophet orijinal baskılı Ermiş adlı eseri yukarıda bahsedilen benzerlik ve farklılıklar açısından karşılaştırılacaktır. Some scholars in the area of psychology of religion have stated that children until a certain age cannot comprehend God as a God but instead, they can concrete God in a superhuman format (anthropomorphic). However, some studies conducted with children have shown that most of the children at a young age can comprehend an abstract God image and can differentiate God’s features from humans. Therefore, this article will attempt to clarify how children’s God concepts have been explained in the developmental (...) psychology of religion and how these theories illuminate the children’s abstract God concepts. To achieve this goal, the pastoral cycle was used as a method, which is a common one in pastoral and practical theology and consists of 4 stages: experience, analysis, theological reflections, and action. As a conclusion, regardless of their religion or cultural background, children’s minds may have the ability of receiving and comprehending the abstract God concept since birth. God can be understood as an all-present, formless, all-knowing, and allpowerful being by children. This illustrates that the religious thinking development of children has different explanations along with the stage theories including Piaget’s one, when the issue comes to the abstract religious entities and religious thinking. An interesting class of intentions is commitments: diachronic intentions that are especially representative of human agency. I argue that the justification conditions for knowing our commitments differ from those for knowing ordinary intentions, and I propose an externalist view according to which knowing one’s own commitments is much like knowing those of others. I discuss Sarah Paul’s transparency view, according to which, we know our intentions by making a conscious decision, even when we do not follow through on them. This (...) is because, as she argues, the function of decisions and intentions is similar, and changing one’s mind in the face of weakness of will does not defeat or undermine that knowledge of intention acquired through a conscious decision. In contrast, I show how the same evidence from weakness of will undermines or outright proves a lack of commitment, as commitments require more than decisions; they demand consistent patterns of action to resist temptations and follow-through over time. Therefore, a conscious decision is not a reliable way to know our commitments in the same way it is for ordinary intentions. I conclude that we cannot justify our commitments merely by referring to a mental item, without also referring to our regular patterns of action. (shrink)

Ortaya çıkan teknolojik yeniliklerle birlikte yiyecek ve içeceklerin muhtevasının değiştirilmesi mümkün kılınmış ve bu gıdaların hükmünün ne olacağı tartışılmıştır. Nitekim bunun somut örneklerinden biri, son yıllarda üretilmeye başlanmış, artan et ihtiyacı sorununun çözümünde sürdürülebilirliği sağlayacak bir tekniğin ürünü olarak sunulan yapay ettir. Literatürde, yapay etin üretim süreçlerini içeren mühendislik çalışmalarına ek olarak yapay etin insan sağlığı açısından olumlu ve olumsuz yönlerine dair çalışmalar bulunmakla birlikte fıkhî yönüne dair çalışmalar kısıtlıdır. (...) Bu çalışmada, yapay etin fıkhî meşrûiyetinin tartışılması amaçlanmıştır. Bu kapsamda öncelikle İslam hukukunun yiyecekler konusundaki helal ve haram kriterleri incelenmiştir. Akabinde yapay etin üretiminde kullanılacak olan kök hücrenin cinsi, üretim süreci ve süreçte kullanılan yöntemler hakkında bilgiler aktarılmış, bu yöntemlerle üretilen yapay etin avantajlı ve dezavantajlı yönleri ortaya konmuştur. Bu çalışma İbn Kayyim’ın ilmi şahsiyetini ortaya koyan “İslam Aile Hukuku Bağlamında İbn Kayyim el-Cevziyye’nin Görüşleri” adlı kitabın incelemesini konu edinmektedir. Fatih Çinar tarafından kaleme alınan bu eser, Kitap Dünyası yayınları tarafından 2024 yılında basılmıştır. Aile hukuku gibi önemli bir alan üzerinden İbn Kayyim’ın görüşlerini ele alan kitap, genelde aile hukukuna katkı sağlarken özelde önemli bir alimin dağınık halde bulunan görüşlerini derli toplu bir şekilde sunmuştur. In this article, in an attempt to analyze the crisis caused by the images of imported plastic waste, we consider the relationship between waste and its meaning in the case of geographical dislocation and de- and re-contextualization processes. Our analysis is guided by two recent concepts: The Wasteocene and semiocide. While the Wasteocene clarifies the signifying mechanisms of this period, semiocide allows us to understand which signs, under what conditions, are rendered invisible or disregardable. In coining the concept of semiocide, (...) Ivar Puura emphasized two key features of the phenomenon. Following this distinction, which is based on (un)intentionality, semiocide refers either to a fully conscious, perhaps even hostile, attempt to destroy a semiotic configuration, or to a completely nonconscious, unaware process in which the unawareness itself is the source of the destruction. Although a more cultural approach dominates in Puura’s assertion of the concept, the concept is applicable to human classification, interpretation and transformation of nature (Maran, 2013; Tønnessen et al., 2015). Focusing on the case of Adana as a recent example of a global waste crisis, our aim is to provide a (bio)semiotic framework for assessing how and under what conditions plastic materials become arbiters of environmental and political crises. With heaps of plastic garbage with foreign names on them, the discourse of recycling, restricted media coverage, public indignation, the struggles of environmentalist organizations, and the encounter of different spatio-temporalities, our study aims to convey an impoverished narrative of a city in the south of Türkiye.
