When is an indirect report of what a speaker meant correct? The question arises in the law. The Contract Law case of Spaulding v. Morse is a good example. Following their 1932 divorce, George Morse and Ruth Morse entered into a trust agreement in 1937 for the support of their minor son Richard. In that agreement, George promised to “pay to [Spaulding as] trustee in trust for his said minor son Richard the sum of twelve hundred (...) dollars per year, payable in equal monthly installments on the first day of each month until the entrance of Richard D. Morse into some college, university or higher institution of learning beyond the completion of the high school grades, and thereupon, instead of said payments, amounting to twelve hundred dollars yearly, he shall and will then pay to the trustee payments in the sum of twenty-two hundred dollars per year for a period of said higher education but not more than four years.” Richard graduated from high school on February 5, 1946 and, in the post-WWII continuation of the draft, was inducted into the army the following day. The question in the case is whether George, by the words of the trust agreement, meant that he would pay $1,200 per year for Richard’s support while he was in the army. Is that a correct indirect report of what George meant?The explanation I offer assumes Gricean analysis of speaker meaning, and it emphasizes the role of speaker meaning typically plays in solving coordination problems. A coordination problem is a situation “in which each person wants to participate in a group action but only if others also participate.” A classic example is a political protest: “each person might want to take part in an antigovernment protest but only if there are enough total protesters to make arrests and police repression unlikely.” Coordination problems arise in more mundane settings as well – in Spaulding v. Morse, for example. Ruth and George want to mutually agree on Richard’s support: Ruth wants to commit to an arrangement only if George does, and vice versa for George. In 1937, George and Ruth solved the problem through speaker meaning. By signing the trust agreement, George, with Ruth as his audience, meant that he obligated himself to a particular support agreement. When Ruth signed, she, with George as her audience, meant that she accepted the agreement. In general, parties often solve coordination problems through speaker meaning. If, for example, enough people can communicate their commitment to participate in the protest to enough people, the protest will take place.The account assigns a central role to the fact that speaker meaning facilitates coordination by creating relevant common knowledge. Common knowledge is “the recursive belief state in which A knows X, B knows X, A knows that B knows X, B knows that A knows X, ad infinitum.” Common knowledge facilitates coordination: “Actors coordinate when they have evidence for common knowledge, and refrain from coordinating when they do not.”. This book provides an analysis of the debate surrounding cultural diversity, and attempts to reconcile the seemingly opposing views of "ethical imperialism," the belief that each individual is entitled to fundamental human rights, and cultural relativism, the belief that ethics must be relative to particular cultures and societies. The author examines the role of cultural tradition, often used as a defense against critical ethical judgments. Key issues in health and medicine are explored in the context of cultural diversity: the physician-patient (...) relationship, disclosing a diagnosis of a fatal illness, informed consent, brain death and organ transplantation, rituals surrounding birth and death, female genital mutilation, sex selection of offspring, fertility regulation, and biomedical research involving human subjects. Among the conclusions the author reaches are that ethical universals exist, but must not be confused with ethical absolutes. The existence of ethical universals is compatible with a variety of culturally relative interpretations, and some rights related to medicine and health care should be considered human rights. Illustrative examples are drawn from the author's experiences serving on international ethical review committees and her travels to countries in Africa, Asia, and Latin America, where she conducted educational workshops and carried out out her own research. Paradigm intensional contexts result from the unmarked use of referential expressions as “self‐signs”, signs that refer to themselves as tokens, types, or members of Sellarsian “dot‐quoted” kinds. Self‐signing (but unquoted) linguistic expressions are more difficult to recognize than non‐linguistic self‐signs such as the color of a felt pen's casing that represents the color of ink inside. I will discuss non‐linguistic self‐signing, then examine self‐signing in quotation, in “said that …” contexts and in “believes that … ” contexts. The phenomenon of (...) intensionality may reduce to a kind of equivocation, a matter of notation rather than a necessary feature of language. (shrink)

Hume’s famous argument against the credibility of testimony about miracles invokes two premises: 1) The reliability of the witness (the extent to which he is informed and truthful) must be compared with the intrinsic probability of the miracle. 2) The initial probability of a miracle is always small enough to outweigh the improbability that the testimony is false (even when the witness is assumed to be reliable). I defend the first premise of the argument, showing that Hume’s argument can be (...) applied to purported observations of miracles, as well. I then show that Hume failed to provide an adequate support for his second premise. A more cogent defence can be provided for a weaker premise. The resultant argument has, consequently, a less sweeping conclusion than Hume’s. (shrink)

The aim of this paper is to show that Shaftesbury’s thinking about liberty is best understood in terms of self-mastery. To examine his understanding of liberty, I turn to a painting that he commissioned on the ancient theme of the choice of Hercules and the notes that he prepared for the artist. Questions of human choice are also present in the so-called story of an amour, which addresses the difficulties of controlling human passions. Jaffro distinguishes three notions of self-control that (...) are present in the story of an amour. Although I agree with many aspects of Jaffro’s interpretation, I question his conclusion that self- control in the Stoic sense is best reserved for ‘moral heroes.’ I propose an alternative developmental interpretation, according to which all human beings are on an intellectual journey aimed at personal and moral improvement. My interpretation takes seriously that for Shaftesbury philosophy is meant to be practical and help improve our lives. I end by arguing that rather than trying to situate Shaftesbury’s concept of liberty within debates among compatibilists and incompatibilists it is more promising to understand it in terms of self- mastery and thus regard it as a version of positive liberty. Hausman has recently provided an argument against identifying well-being with preference-satisfaction. I will focus on two of his premises. Hausman’s arguments for the first, I will suggest, fail. If the third premise is correct, I shall then argue, it can be used to undermine other plausible conceptions of the good.

In this 60th anniversary of Business & Society essay, we seek to make three main contributions at the intersection of governance and artificial intelligence. First, we aim to illuminate some of the deeper social, legal, organizational, and democratic challenges of rising AI adoption and resulting algorithmic power by reviewing AI research through a governance lens. Second, we propose an AI governance framework that aims to better assess AI challenges as well as how different governance modalities can support AI. At the (...) heart of our framework lies the governance forces that apply to institutions, organizations, and individuals, who ultimately provide, regulate, and use AI decision-making. We discuss how businesses may harness AI’s economic power through governance solutions without creating or amplifying societal biases and inequalities. Third, as part of our section on future research, we identify a set of governance trade-offs in AI adoption, suggest future research avenues to conceptually strengthen research on the governance of AI, and lay out key policy recommendations. Hume invokes the separability of perceptions to derive some of his most contentious pronouncements. To assess the cogency of the arguments, the notion must first be clarified. The clarification reveals that sic different separability claims must be distinguished. Of these, I consider the three that are rarely discussed. They turn out to be unacceptable. Locke espouses none of them.This Article does not have an abstract.

Deacon’s target article is a welcome contribution not only on “biological information” but, more generally, on representation in cognitive science. Some kind of explanation and justification for use of the terms “representation” and “interpretant” for primordial autogen system would be helpful. A connection between the notions of “information” and “representation” can be elaborated more in this respect.

In this paper, I examine the possibility of accounting for the rationality of belief-formation by utilising decision-theoretic considerations. I consider the utilities to be used by such an approach, propose to employ verisimilitude as a measure of cognitive utility, and suggest a natural way of generalising any measure of verisimilitude defined on propositions to partial belief-systems, a generalisation which may enable us to incorporate Popper's insightful notion of verisimilitude within a Bayesian framework. I examine a dilemma generated by the decision-theoretic (...) procedure and consider an adequacy condition (immodesty) designed to ameliorate one of its horns. Finally, I argue in a sceptical vein that no adequate verisimilitude measure can be used decision-theoretically. (shrink)

From the stance of cognitive developmental theories, claims that general g is an entity of the mind are compatible with notions about domain-general development and age-invariant individual differences. Whether executive function is equated with general g or fluid g, research into the mechanisms by which development occurs is essential to elucidate the kinds of environmental inputs that engender effective intervention. An experiment by Proietti et al. purporting to instantiate the ‘Wigner’s Friend’ thought experiment is discussed. It is pointed out that the stated implications of the experiment regarding the alleged irreconcilability of facts attributed to different observers warrant critical review. In particular, violation of a Clauser–Horne–Shimony inequality by the experimental data actually shows that the attribution of measurement outcomes to the “Friends” is erroneous. An elementary but often overlooked result regarding improper mixtures is adduced in support of this assessment, and (...) a basic logical error in the analysis leading to the authors’ ontological claims that different observers are subject to irreconcilable ‘facts’ is identified. A counterexample is provided which refutes the popular notion that quantum theory leads to ‘relative facts’ that never manifest as empirical inconsistencies. It is further noted that under an assumption of unbroken unitarity, no measurement correlation can ever yield an outcome, since all systems remain in improper mixtures, and attributing a definite but unknown outcome contradicts their composite pure state. It is pointed out that there already exists a solution to this conundrum in the form of an alternative formulation of quantum theory, which accounts for the data showing that no outcomes occurred at the interior entangled photon level and also predicts that outcomes can and do occur at the exterior “super-observer” level in this type of experiment. Testing is an effective learning method, and it is the basis of mobile quiz apps. Quiz apps have the potential to facilitate remote and self-regulated learning. In this context, automatized feedback plays a crucial role. In two experimental studies, we examined the effects of two feedback types of quiz apps on performance, namely, the standard corrective feedback of quiz apps and a feedback that incorporates additional information related to the correct response option. We realized a controlled lab setting (n= 68, (...) Study 1) and an unsupervised mobile setting (n= 150, Study 2). In the learning phase, participants used the quiz app and received feedback. They also completed a subsequent test as well as a follow-up test 1 week later by using the same quiz app. Irrespective of feedback type and setting, cognitive outcomes (quiz scores) and metacognitive outcomes (response certainty) increased similarly in the short term and long term. Feedback effects were not moderated by participants' overall response certainty during learning, their prior knowledge, and the difficulty of quiz items. Moreover, we found that participants perceived the quiz app to be similarly attractive, interesting, and enjoyable in both feedback conditions and that they spent slightly more time to process quiz items in the lab setting. We discuss these results in detail, including the role of moderating and mediating factors and prospects for further research and practice. Overall, our results underline that quiz apps are useful and effective tools that can support the acquisition and retention of semantic knowledge in different learning settings. (shrink)

Marital and family structures, together with the closely related areas of gender relations and attitudes to sexuality, constitute one area in which scholars have suggested medieval England clearly differs from other regions. It is always difficult to compare across regions when the nature of the evidence differs; but because marriage and sexual behavior were under the jurisdiction of the church courts and because the ecclesiastical court system used the same set of legal rules across Europe, one level of difficulty disappears (...) from a comparison. Records from different regions reflect somewhat different procedures or penalties, based on local synodal statutes, but are more commensurable than records of the secular courts, which did not depend on a common set of rules. Basic principles of canon law were universally accepted in western Christendom: marriage was formed by the consent of the parties; marital promises followed by sexual intercourse created an indissoluble marriage; and any extramarital sexual activity by either a husband or a wife was adultery. An examination of church court records from late-medieval Paris compared with better-known records from England suggests that differences between England and northern France in the understanding of sexual behavior and the formation of unions, while they reflect different approaches, were still addressing fundamentally the same issues, and the demographic patterns may not have been as different as scholars have assumed. En el siguiente artículo analizo con respecto a países con altos niveles de inmigración y en términos de legitimidad democrática, el reto que plantea la existencia en los mismos de sectores de la población que, por carecer de la nacionalidad del Estado de residencia, carecen de la plenitud de derechos y libertades que nutren el espacio de igualdad cívica en un orden liberal democrático. Centro mi análisis en el colectivo de los llamados "inmigrantes ilegales", que es el que está sujeto (...) a una mayor precariedad jurídica. A fin de superar la creciente disociación entre población y comunidad política exploro la necesidad de articular nuevos fundamentos de inclusión dentro del demos y propongo, entre ellos, el de la residencia y el arraigo social que generalmente la acompaña. La fuerza normativa de los fundamentos que exploro es, a mi entender, de suficiente entidad como para superar los reparos morales asociados al carácter "ilegal" del origen de la inmigración. Desde estas premisas concluyo con una valoración negativa de la reciente reforma de la Ley Orgánica 4/2000 sobre derechos y libertades de los extranjeros en España y su integración social que a la vez restringe el acceso a derechos y libertades de los llamados "ilegales" y dificulta los cauces de subsanación quasi-automática de su ilegalidad. The meaning of the word shaman (of Tungus origin) has become obscured by numerous, increasingly different interpretations. The term has also been applied to practitioners who live outside Siberia, and are actually called by different names in their respective countries: bomoh in Malaysia, ma khi in Thailand, and tany-di in Singapore.Because I did not want to rely on secondary sources, I went to Southeast Asia to find contemporary shamans. Having started my research in 1960 I was able to witness, over (...) a thirty-one year period (during visits lasting from several months to a year), the continuation of shamanic traditions among different groups living in multiethnic and multi-religious societies. What struck me most was the emergence of new shamans in urban centers like Singapore and Bangkok. (shrink)

A synthesis of rights and participatory approaches to citizenship, linked through the notion of human agency, is proposed as the basis for a feminist theory of citizenship. Such a theory has to address citizenship's exclusionary power in relation to both nation-state ‘outsiders’ and ‘insiders’. With regard to the former, the article argues that a feminist theory and politics of citizenship must embrace an internationalist agenda. With regard to the latter, it offers the concept of a ‘differentiated universalism’ as an attempt (...) to reconcile the universalism which lies at the heart of citizenship with the demands of a politics of difference. Embracing also the reconstruction of the public-private dichotomy, citizenship, reconceptualized in this way, can, it is argued, provide us with an important theoretical and political tool. (shrink)

In a memorable passage near the beginning of William James asks us to imagine a world in which all our dearest social utopias are realized, and then to imagine that this world is offered to us at the price of one lost soul at the farthest edge of the universe suffering eternal, intense, lonely pain. Then he asks.

Moral sceptics maintain that there are no objective moral values, or that there is no moral knowledge, or no moral facts, or that what looks like a statement which makes a moral judgment is not really a statement and does not have a truth-value. All of this is rather, unclear because all of it is negative. It will be necessary to remove some of this unclarity because my aim in this paper is to establish a proposition which may be summarized (...) by saying: even if there are no objective moral values in one sense, there are objective moralvalues in another sense, and the latter values are good enough to do some of the jobs that objective values in the first sense would have done. A useful analogy might be that of a person who has lost her hand and has been given a prosthesis. In one sense the prosthesis is not as real as the hand, in another sense it is just as real ; most importantly, the person can do with the prosthesis enough of what she could do with the hand to make do. The Hebrew text On the Heavens and the World, ascribed to Ibn S, is an interesting and intriguing composition. It dates from the 13th century and was quite influential. It is not a translation of any text of Ibn S known to us, but is related to the Latin De celo et mundo, which appears in the 1508 Venice edition of translations of Ibn S. The Latin and Hebrew texts differ widely and the relation between them is far from being (...) clear. Both are in sixteen chapters, the titles of the chapters are the same, but the texts are only roughly similar. The Hebrew text often offers short, incomplete summaries of the Latin arguments. On the other hand it includes many passages which have no parallel in the Latin. There are two possible explanations of the perplexing relationship between the two texts: either that there was more than one version of the Latin text, or that the translator, Shlomo ben Moshe of Laguiri wrote a kind of paraphrase. The paper shows that the second explanation is correct and offers a preliminary study of the sources and the aims of the Hebrew text. (shrink)
