Since Opuz v. Turkey (2009), the European Court of Human Rights (ECHR) delivered over a dozen judgments in which it examined domestic violence through the prism of gender-based discrimination. Apart from the individual circumstances of the cases, the Court considered the general approach to domestic violence in the defendant states, searching for a large-scale structural gender bias. Hence, although the Court has not directly referred to the notion of “structural discrimination” in relation to domestic violence, it engaged in unveiling this (...) problem within the state parties. Building on the case law of the Court, the article presents and systemizes information that may prove structural gender discrimination in domestic violence cases. It navigates potential applicants through the Court’s interpretation and indicates arguments and sources that may support their claims. In particular, it discusses what kind of data and information may demonstrate the general, discriminatory attitude of the authorities towards domestic violence and what sources the applicants may use while seeking the evidence. For many women and girls sexist and misogynistic language is an everyday experience. Some instances of this speech can be categorized as ‘sexist hate speech’, as not only having an insulting or degrading character towards the individuals to whom the speech is addressed, but also resonating with the entire group, contributing to its silencing, marginalization and exclusion. The aim of this article is to examine how sexist hate speech is handled in international human rights law. The argument derives from the (...) claim than that legal discourse should distinguish between ‘sexist speech’ and ‘sexist hate speech’, and that the later may be qualified as a form of violence against women. Then it analyses the approaches of two human rights protection systems—the United Nations and the Council of Europe system—towards the phenomenon of sexist hate speech, by taking their position towards hate speech in general as a point of reference. In both systems, sexist hate speech is being addressed more eagerly under the gender equality framework, including counteracting violence against women, than in their interpretation of hate speech under general human rights law. The article argues the importance of recognizing and addressing sexist hate speech both within the framework of gender equality instruments and anti-hate speech framework established by international human rights bodies. Building on our diverse research traditions in the study of reasoning, language and communication, the Polish School of Argumentation integrates various disciplines and institutions across Poland in which scholars are dedicated to understanding the phenomenon of the force of argument. Our primary goal is to craft a methodological programme and establish organisational infrastructure: this is the first key step in facilitating and fostering our research movement, which joins people with a common research focus, complementary skills and an enthusiasm to work (...) together. This statement—the Manifesto—lays the foundations for the research programme of the Polish School of Argumentation. (shrink)

In September 2018, the ArgDiaP association, along with colleagues from Germany and the UK, organised one of the longest and most interdisciplinary series of events ever dedicated to argumentation - Warsaw Argumentation Week, WAW 2018. The eleven-day ‘week’ featured a five day graduate school on computational and linguistic perspectives on argumentation (3rd SSA school); five workshops: on systems and algorithms for formal argumentation (2nd SAFA), argumentation in relation to society (1st ArgSoc), philosophical approaches to argumentation (1st ArgPhil), legal argumentation (2ndMET-ARG) (...) and argumentation in rhetoric (1st MET-RhET); and two conferences: on computational models of argumentation (7th COMMA conference) and on argumentation and corpus linguistics (16th ArgDiaP conference). WAW hosted twelve tutorials and eight invited talks as well as welcoming over 130 participants. All the conferences and workshops publish pre- or post-proceedings in the top journals and book series in the field. (shrink)

The current study examines patterns of attachment/self-protective strategies and rates of unresolved loss/trauma in children and adolescents presenting to a multidisciplinary gender service. Fifty-seven children and adolescents (8.42–15.92 years; 24 birth-assigned males and 33 birth-assigned females) presenting with gender dysphoria participated in structured attachment interviews coded using dynamic-maturational model (DMM) discourse analysis. The children with gender dysphoria were compared to age- and sex-matched children from the community (non-clinical group) and a group of school-age children with mixed psychiatric disorders (mixed psychiatric (...) group). Information about adverse childhood experiences (ACEs), mental health diagnoses, and global level of functioning was also collected. In contrast to children in the non-clinical group, who were classified primarily into the normative attachment patterns (A1-2, B1-5, and C1-2) and who had low rates of unresolved loss/trauma, children with gender dysphoria were mostly classified into the high-risk attachment patterns (A3-4, A5-6, C3-4, C5-6, and A/C) (χ2= 52.66;p< 0.001) and had a high rate of unresolved loss/trauma (χ2= 18.64;p< 0.001). Comorbid psychiatric diagnoses (n= 50; 87.7%) and a history of self-harm, suicidal ideation, or symptoms of distress were also common. Global level of functioning was impaired (range 25–95/100; mean = 54.88;SD= 15.40; median = 55.00). There were no differences between children with gender dysphoria and children with mixed psychiatric disorders on attachment patterns (χ2= 2.43;p= 0.30) and rates of unresolved loss and trauma (χ2= 0.70;p= 0.40).Post hocanalyses showed that lower SES, family constellation (a non-traditional family unit), ACEs—including maltreatment (physical abuse, sexual abuse, emotional abuse, neglect, and exposure to domestic violence)—increased the likelihood of the child being classified into a high risk attachment pattern. Akin to children with other forms of psychological distress, children with gender dysphoria present in the context of multiple interacting risk factors that include at-risk attachment, unresolved loss/trauma, family conflict and loss of family cohesion, and exposure to multiple ACEs. One of the fundamental methodological problems of economics as a separate science is the question whether economic theorists are able to restrict themselves to the description of facts without assessing them. Is it possible to create an economic theory utterly deprived of value judgements? In other words – is economics a positive science? This problem is still debatable, notwithstanding efforts to eradicate all value judgements from economic analysis and to treat it as a touchstone of the scientificity of economic reasoning. (...) A persuasion dialogue is a dialogue in which a conflict between agents with respect to their points of view arises at the beginning of the talk and the agents have the shared, global goal of resolving the conflict and at least one agent has the persuasive aim to convince the other party to accept an opposing point of view. I argue that the persuasive force of argument may have not only extreme values but also intermediate strength. That is, I wish (...) to introduce two additional types of the effects of persuasion in addition to successful and unsuccessful ones (cf. Van Eemeren and Houtlosser in Argumentation 14(3):293–305, 2000; Advances in pragma-dialectics. Sic Sat, Amsterdam, 2002; Walton in A pragmatic theory of fallacy. University of Alabama Press, Tuscaloosa, 1995; Walton and Krabbe in Commitment in dialogue: basic concepts of interpersonal reasoning. State University of New York Press, Albany, New York, 1995). I propose a model which provides for modified versions of the standpoint of an agent needed in order to bring about two possible outcomes of a persuasion dialogue. These two outcomes I label partially-successful and over-successful. I call the potential, not yet verbalised, standpoint of an agent here the original topic t. Based on some aspects of relevance theory (Sperber and Wilson in Relevance: communication and cognition. Blackwell, Oxford, 1986; Wilson and Sperber in The handbook of pragmatics. Blackwell Publishing, Malden, 2006), I explain that the modified version of the original topic t is an implicature created from the original topic t and from a specific mental topic which belongs to, what I call the beneficial cognitive model (hence BCM). Na podstawie prześledzenia genezy Dzieci nędzy (1913) i historii komponowania tekstu dokonano ciekawych ustaleń z zakresu działań twórczych najgłośniejszego autora Młodej Polski – Stanisława Przybyszewskiego. Badania ujawniły m.in. niechęć pisarza do (czy może: nieumiejętność) radykalnej modyfikacji raz dokonanych zapisów tekstowych i wzrost literackiej efektywności z dala od wielkich miast. Kolacjonowanie przekazów powieści oraz lektura dokumentów osobistych pozwoliły stwierdzić, że znaczący wpływ na ostateczny kształt Dzieci nędzy miały powikłania osobiste i przykre okoliczności życiowe, które znacząco determinowały (czy raczej: destruowały) proces pisarski (...) Przybyszewskiego, oraz ingerencja domagającego się uzupełnień wydawcy, któremu pisarz skwapliwie przyznał rację, dopisując kilka rozdziałów. Te sumiennie dokonane poprawki świadczą o tym, jak ważne były dla pisarza uwagi redakcyjne w udoskonalaniu tekstu. Najważniejsze odkrycie, do jakiego prowadzą badania tekstologiczne, dotyczy jednak autorskiej rezygnacji z zamierzonego pierwotnie poematu prozą i przetransponowania jego idei w formę powieściową. Ta decyzja – będąca rodzajem kapitulacji w zmaganiach z tworzywem – świadczyła de facto o nowatorskim myśleniu Przybyszewskiego o powieści i sprawiła, że Dzieci nędzy to niezwykle ciekawy artystycznie, nowoczesny zapis stanów psychicznych. Od strony rozwiązań konstrukcyjno-narracyjnych to niewątpliwie jedna z najciekawszych powieści Przybyszewskiego. (shrink)

The ongoing process of democratisation lead to the growing importance of the electoral systems that regulate the procedures of gaining and legitimizing power in democracy. Taking it into account it is worth asking about the relationship between these particular ‘game rules’ contained into electoral law and the respect of the rule of law, being one of the basic norms of a democratic system. A question then may be raised about the existence and the character of the relation between electoral systems (...) and the level of political corruption. It is worth noticing that besides the research conducted by political scientists and the representatives of various branches of social sciences the significant analysis of the issue have been presented by the economists. In this article a brief overview of the economic studies on the relationship between level of political corruption and the electoral systems is presented so as to assess to what degree this approach may be treated as fruitful. Constructing dependency relations, in particular subject-verb agreement, in languages in which verbs may occupy the final position in the sentence, requires a combination of newly appearing lexical items with the existing context, such that it extends beyond the limits of the phrase. New words can be integrated only if the part of the sentence that has already been processed remains in a state of activation, being open to receive new elements. This article focuses on the question of the specificity for (...) the domain of linguistic knowledge of the working memory, as the cognitive system in which representations are temporarily stored and manipulated. Open access to information is now a universal phenomenon thanks to rapid technological developments across the globe. This open and universal access to information is a key value of democratic societies because, in principle, it supports well-informed decision-making on individual, local, and global matters. In practice, however, without appropriate readiness for navigation in a dynamic information landscape, such access to information can become a threat to public health, safety, and economy, as the COVID-19 pandemic has shown. In the past, this (...) readiness was often conceptualized in terms of adequate literacy levels, but the contemporarily observed highest-ever literacy levels have not immunized our societies against the risks of misinformation. Therefore, in this Perspective, we argue that democratization of access to information endows citizens with new responsibilities, and second, these responsibilities demand readiness that cannot be reduced to mere literacy levels. In fact, this readiness builds on individual adequate literacy skills, but also requires rational thinking and awareness of own information processing. We gather evidence from developmental, educational, and cognitive psychology to show how these aspects of readiness could be improved through education interventions, and how they may be related to healthy work-home balance and self-efficacy. All these components of education are critical to responsible global citizenship and will determine the future direction of our societies. (shrink)

This paper juxtaposes biosemiotic and anthropological perspectives to consider the issue of dwelling and living, with particular reference to nonhuman agency and design. The author discusses the fundamental issues and theoretical concepts associated with this issue before making comparisons with reference to a case study and defining a stance on the agency of animate and inanimate nature, with particular regard paid to dwelling. The Zoepolis project is an artistic one, on the borderline of the humanities, the natural sciences and art, (...) thus it combines three seemingly irreconcilable spheres to address issues associated with the subjectivity of living entities, and with the processes of their inhabiting and designing. Estetyka F. Schillera jest ogólną filozoficzną teorią piękna, sztuki i kultury. Ideał człowieka - doskonale rozwinięte Jednostki ludzkiej - pochodzi z inspiracji myśli Kantowskiej, jednakże Schiller próbuje przedstawić go w odmienny sposób. Nawiązując do antycznego wzorca człowieka pięknego i dobrego zarazem (Kalos Kagathos), podejmuje Schiller polemikę z antropologicznymi konsekwencjami metafizyki myśliciela królewieckiego., U Kanta najważniejsze problemy ludzkie, poszukiwanie istoty człowieczeństwa i formuły życia najbardziej z nią zgodnego, wyrażają się w języku etyki, w pojęciach: dobrej woli, autonomii moralnej, imperatywu kategorycznego. U (...) Schillera poszukiwanie zasady jedności i pełni człowieka (harmonijnego połączenia elementu racjonalnego z tym, co zmysłowe i emocjonalne) zatrzymuje się w sferze sztuki i zostaje przełożone na język piękna. W sztuce i dzięki sztuce (wychowaniu estetycznemu) spełnia się to wszystko, co decyduje o duchowej wielkości człowieka, jego twórczej aktywności. Ze sztuki emanuje wzorzec pięknego człowieczeństwa, w niej osiągnięta zostaje wolność. Faktem pozostaje wszakże, iż po 1796 r. Schiller wyraźnie nawiązuje i powraca do postulatów etyki Kanta. Myśl o pełnym urzeczywistnieniu ideału "homo aestheticus” jest zastąpiona przez program, który wskazuje na perspektywę transcendencji. Element piękna przeobraża się w kategorię wzniosłości, patetyczności, a jednostka ludzka w tragicznej katharsis przeżywa swoją wielkość. Estetyka przeobraża się w metafizykę. Z tego punktu widzenia można ocenić estetyczny program Schillera jako formę przejściową od filozofii Kanta do poglądów jego następców - Schellinga i Hegla. (shrink)

The article concerns the wartime history of Peru and examines both topdown and bottom-up practices of accounting for the internal conflict of 1980–2000, which were initiated in the background of the warfare. The aim of the article is to discuss the connections I observed between the phenomena referred to in the title: return migrations of the inhabitants of the central-southern province, their search for the victims of forced disappearances, as well as the exhumation challenges emerging since the beginning of the (...) war. In other words, the text constitutes an attempt to contextualise the above-mentioned issues given competing versions of memory about political violence in the Andes, with particular focus on their top-down determinants in the Fujimorism era. Paul Ricoeur uncovered the creative aspect of language in his theory of metaphor. The metaphor is a special combination of words that as a clash of distant semantic fields forces the reader to interpret the sentence in a new way and see things in a new light. It is a process in which the imagination plays an important role. Ricoeur compares the metaphor to the Kantian schema which is a procedure to provide an image to a concept. The image helps (...) in the process of assimilating distant elements and thus to achieve a new interpretation. To change perspective the suspension of reference is also needed. The aim of this essay is to analyze the imaginative functions which are operative in the metaphor and look for an answer to the question about the role of the imagination as a productive power as well as a power of internal intuitions. We show that a finitely generated protoalgebraic strict universal Horn class that is filter-distributive is finitely based. Equivalently, every protoalgebraic and filter-distributive multidimensional deductive system determined by a finite set of finite matrices can be presented by finitely many axioms and rules.

The characteristic asymmetry in intentionality attributions that is known as the Knobe effect can be explained by conjoining an orthodox theory of intentional action with a normative account of intentional omission. On the latter view: omissions presuppose some normative context; there are good reasons why the intentionality of omissions requires agents' knowledge rather than intention. The asymmetry in intentionality attributions in Knobe's cases can be seen to be derivative from an asymmetry in intentional omissions. The omissions account further explains the (...) Butler problem and some related puzzles. It also safeguards the simple view of intentional action from the asymmetry challenge. (shrink)

According to explanatory individualism, every action must be explained in terms of an agent's desire. According to explanatory nonindividualism, we sometimes act on our desires, but it is also possible for us to act on others' desires without acting on desires of our own. While explanatory nonindividualism has guided the thinking of many social scientists, it is considered to be incoherent by most philosophers of mind who insist that actions must be explained ultimately in terms of some desire of the (...) agent. In the first part of the paper, I show that some powerful arguments designed to demonstrate the incoherence of explanatory nonindividualism fail. In the second part of the paper, I offer a nonindividualist explanation of the apparent obviousness of belief-desire psychology. I argue that there are two levels of the intelligibility of our actions. On the more fundamental (explanatory) level, the question "Why did the agent do something?" admits a variety of folk-psychological categories. But there is another (formation-of-self) level, at which the same question admits only of answers that ultimately appeal only to the agent's own desires. Explanatory individualism results from the confusion of the two levels. (shrink)

The dissertation develops a conception of action based on the concept of practical task-responsibility rather than on the concept of intention. It answers two problems. First, it grounds the distinction between an action and a mere happening, thus meeting Wittgenstein's challenge to explain what is the difference between an agent's raising her arm and her arm rising? Second, it grounds the distinction between acting for a reason and acting while merely having a reason, thus meeting Davidson's challenge to give an (...) account of the explanatory force of reasons. ;One source of resistance to an account of action in terms of normative expectations rather than in terms of intentions comes from explanatory individualism. The explanatory individualist argues that it is ultimately the intentional attitudes of the agent rather than normative expectations of other people that are relevant to the way in which we explain one another's actions, and that they ought to figure in the account of the nature of action. I defend explanatory nonindividualism, according to which we sometimes act on our own intentions and desires but sometimes on the normative expectations and desires of others . Explanatory nonindividualism is fortified by a selectional account of the explanatory force of reasons. I demonstrate that Davidson's challenge can be met by identifying reasons with selectional criteria rather than with causes. ;In response to Wittgenstein's challenge, I propose that we understand what it is to be an action not in terms of a performance being intentional under a description, but in terms of it being reasonable to expect a performance of the agent under some description. Only one concept of reasonableness is necessary to make the distinction between actions and mere happenings, and I explicate that concept. In addition to accounting for actions that are intentional under some description, the account also captures cases that are not so straightforwardly captured by that criterion . Moreover, cases of so-called basic wayward causal chains are excluded from qualifying as actions. (shrink)

This is a descriptive study (_N_ = 243) of how Polish undergraduates and graduates perceive face to face arguing. We had some reasons to suppose that they would not be especially aggressive. The Polish culture has a number of proverbs warning against combative arguing, with “agreement builds and disagreement destroys” being illustrative. In addition, up until 1989 public dissent and open disagreements were suppressed by the government, and older generations often found it prudent to avoid arguing. We compared Polish results (...) with previously reported data from the U.S. and Ukraine. We did, in fact, find that Polish orientations were less aggressive and more other-oriented than the two comparison nations. We also discovered Poland was more wary of engaging in interpersonal conflicts. Distinct sex differences appeared when we compared Polish men and women, with men being more forceful. Correlational patterns, especially concerning argumentativeness and verbal aggressiveness, were largely consistent with those originally found in the U.S. Power distance continues to have important connections with the standard argument orientation measures, but its patterns of correlation are not entirely consistent across the relatively small number of nations where the variable has been studied. Temperamental traits and life and job satisfaction The aim of this research project was to evaluate the impact of the temperamental traits and structure on the level of life satisfaction and job satisfaction. The participants of the study were employees having different jobs and from different workplaces. The results indicate that there exists a positive relationship between both types of satisfaction and activity and endurance as well as a negative relationship between the measures of satisfaction and emotional reactivity. Multiple linear (...) regression analysis revealed that activity and emotional reactivity are temperamental predictors of life satisfaction. The temperamental predictor of job satisfaction in the cognitive aspect is only activity, whereas in the case of job satisfaction in the emotional aspect - activity and endurance. The statistical analysis revealed that the temperament structure harmonising in the dimension of under-stimulation - over-stimulation has no correlation with any types of satisfaction. (shrink)
